The current rise in malpractice litigation has led to concern in the research community as to the prospect of litigation against researchers. Clearly as the responsibility for the day-to-day conduct of the research falls upon the researchers they will be potentially liable should there be negligence in the conduct of the research project itself. But to what extent can the research ethics committee and its members be held liable should harm result to the research subject? How far does the prospect (...) of the threat of litigation equate with the reality of the prospect of liability? Although the NHS research governance framework suggests that primary responsibility for the conduct of the trial is with the researcher this does not mean that REC members will be immune from actions in tort where research subjects suffer harm in the conduct of a research project approved by their NHS REC. This paper focuses upon the prospect for liability in the law of tort of NHS RECs and their members. While in practice the vast majority of such claims are unlikely to be successful members of RECs may incur resultant legal costs as a consequence of involvement in proposed litigation. It is submitted that the scope of indemnity provision provided to RECs and their members should be precisely determined, otherwise there is a real prospect that the risk of malpractice litigation may deter individuals from serving on such committees. One of the forgotten "small masters" of German Romanticism is the aesthetician Solger. Besides his famous Erwin, his only major writing is the Lectures on Aesthetics. It displays a coherent and original theory of the beautiful and of art, even though a continuous polemical relationship to Schelling, Fichte and Hegel is ever present in its pages. Solger's sensitive theorizing reconciles the norms of classicism with the aims of romanticism and at the same time points beyond them towards the fundamental (...) principles and attitudes of the coming realistic aesthetic. This book is a posthumous one, based upon lectures which Solger never intended to publish. As a matter of fact, he strongly opposed the practice of printing university courses as such. Yet, these texts are perhaps most representative of the subtle and harmonious thought of this man who died at the height of his creative life. Their reprinting is an important literary event.—M. J. The present reprint of Reinhold's principal work is a great service to anybody undertaking a genetic study of the evolution of Fichte's Wissenschaftslehre from Kant's Critique. Reinhold was by no means an original and creative mind. His major importance lies in his systematic formulation of some central problems in the Kantian philosophy in an attempt to overcome the latter's major weakness: the rigid separation of the knowing faculties from each other. But the unified "faculty of representation" proposed by (...) Reinhold shifted the focus of epistemological considerations into an overtly psychological direction which only Fichte was to correct. All the same, among the epigons [[sic]] and half-Kantians of the outgoing eighteenth century, Reinhold alone can still be read with interest and genuine appreciation.—M. J. V. (shrink)

The present volume completes the publication of the most important and most representative Husserl texts from the twenties. The second half of the book contains important variants selected from the earlier versions of the lectures, a large number of independent short essays and notes, and finally a huge number of editorial notes on the texts and their reconstruction. The lectures deal with perception, expectation, and their implied phenomena, centered around the underlying major theme of the in-itself, hence of the (...) passivity of the flux of consciousness. By sacrificing deliberately an in extenso publication of the three versions of the lectures in favor of concentrating the theme into one volume, the editor chose to satisfy the most pressing needs of the Husserl scholar. Yet, one cannot but wonder whether an author of Husserl's stature might not deserve a more complete presentation.--M. J. V. (shrink)

Even though the last decade has seen more original and significant work on Fichte, the flow of studies on his rival and "successor," Schelling, seems to continue uninterrupted. Beyond so many short and often quite modest writings, Kasper's huge book is towering, and not only because of its size. Kasper, like Horst Fuhrmans to whom he seems to be the most indebted and who is not in Schelling studies, is a Roman Catholic theologian who commands an immense and impressive knowledge (...) of the history of theological speculation from the Greek Fathers to the nineteenth century school of Tübingen. Like most major studies on Schelling, the present one must struggle its way through the evolution of the many phases of his thought before getting down to the more systematic investigation. Such an endeavor must express a "preference" for one of those phases, and, as is usually the case today, the greatest appreciation is directed towards the Spätphilosophie. The core and kernel of the book is the beautiful and highly concentrated exposition on "God as the ground and the Lord of history" where historicity itself receives its ontological deduction from the premisses of theism. The book concludes with the concrete modalities of the divine mediation of history through the great issues of the fall, mythology, and revelation. For more than a decade Walter Schulz's interpretation of Schelling's late philosophy has seemed to overshadow, and to dismiss, all more Weltanschauung-orientated research. It has long been time for a study focusing on Schelling, the philosopher of Christianity, which is what Schelling considered himself to be for the last forty-five years of his life.--M. J. V. This book is a reprint of one of the pioneer works on German mysticism of the nineteenth century. It is a comprehensive account of the most fertile hundred years of German spiritual and mystical history in the Middle Ages. In contrast to Bach's and Lasson's books on Eckhart written in the same decade, Greith's viewpoint is one of narrow scholastic orthodoxy. However, the wealth of detail and the pleasant simplicity of style compensate for those rather irritating lamentations about the "errors" (...) of Meister Eckhart. Although this book was written before Denifle's discovery of Eckhart's Latin works, it remains of value today due to its systematic study of the doctrinal positions of the major mystical writers of the Rhineland. Included as well is an interesting analysis of mystical poetry centered around the works of the famous Sister Mechtild. The book ends with a lengthy and detailed description of the spirituality and spiritual theory developed in the scattered nunneries of the preaching orders.—M. J. V. (shrink)

Though in a slightly recalcitrant mood, continental Neo-Scholastic writers have been for many decades quite extensively dealing with Kant and the major "critical" problems. An interesting product of this preoccupation is Santeler's long study of the foundation of human dignity in Kant. The thesis of the author is that Kant rejected metaphysics, i.e., ontology, not so much because of the well-known classical theoretical and epistemological reasons but in order to formulate a more fundamental, more autonomous notion of human dignity. (...) We could say the Santeler is motivated by the famous Kantian remark about limiting understanding in order to make room for faith. There is undoubtedly a considerable amount of historical scholarship in those small-printed pages but their fighting mood is more reminiscent of contemporary Anglo-American Kant literature than of the usual elaborate exegesis offered by Continental scholars.--M. Neither the speculative depth of Meister Eckhart nor the willpower and inner drive of Tauler are to be found in the writings of the third great mystic of fourteenth-century Rhineland, Henry Seuse. But we might well be compensated by authenticity of the description of the spiritual experience. This is not an edition for scholars and does not even try to resurrect the so savagely fought for issue on the authorship of Seuse's autobiography. We have here a major document of (...) spiritual life, with a great literary work making up about one-half of it. The other half contains the Booklet of the Eternal Wisdom, the Booklet of Truth, the Booklet of Letters, and two Sermons. Perhaps a little more critical apparatus and a little more comment on the themes of the texts would have improved the book, but instead of giving this, the translator simply refers to a book on Henry Seuse published in the same year, 1966. It was bound to happen that Hegel's thought, like that of so many other great philosophers, would be studied from the viewpoint of the question of language. The title is innocent and modest and it seems to promise a monograph on a particular topic. Instead, however, we are led through a number of major Hegelian themes, taken from the totality of his opus. There are chapters on transcendence and infiniteness, on praxis, on the figures of self-consciousness, on religion and (...) the state, and finally on language and system and language and thought. And there is, underlying the whole work, an apparent preoccupation to "situate" Hegel with regard to other great thinkers of modern times: Kant, Marx, Kierkegaard and Heidegger.--M. J. V. (shrink)

This big book is a welcome collection of some of the most important theological studies on St. Paul written by German scholars of this century. Some of the authors are among the greatest names of modern exegetical science and the present selection enables the reader to have access to a wide range of first-rate, often classical, accounts of Paulinian research, without being forced to go through the back-issues of German theological journals. It seems to be more and more evident that the onto-theological notion of the Trinity is at the center of Hegel's thought. Already strongly present in the Jugendschriften, sparingly though most forcefully treated in the Phenomenology, it comes really to the fore in the Encyclopedia and in the Lectures on the Philosophy of Religion. Though none of the major commentators have avoided the issue, until recent years there had been only the short study of J. Hessen devoted to the (...) problem. Splett promises to treat extensively the questions Hessen has only touched upon, and does so by a combination of a historical and a systematic analysis of Hegel's thought. The first chapter shows his progression from the texts of Frankfurt via the fascinating Jenafragment on the Divine Triangle to the Phenomenology. The second chapter is devoted to the Propaedeutics, the Logic, and the Encyclopedia where the idea is represented in its naked, speculative articulation. Thereafter comes a collection of relevant texts taken from different lectures on the philosophy of the spirit--and, finally, a clear and succinct exposé of the mature doctrine of the Philosophy of Religion. In the conclusion the author tries to formulate a number of issues where Hegelian speculation and Christian dogmatics might converge. To sum up: this is a good, clear, well-written monograph.--M. J. Neo-scholasticism is supposed to be a "creative" development of the spirit of Thomism and its application to contemporary philosophical themes. Yet its partisans as well as its adversaries largely ignore the fact that many of the neo-scholastic thinkers are increasingly applying the transcendental method to reach the major ideas of Aquinas. The thesis of the present book is that the "transcendental method," viewed in a large sense as stretching from Kant to Heidegger, is an integral part of the thought (...) of several well-known neo-Thomists, and that it touches the work of many others. The author studies extensively the work of J. Maréchal, who was the first to attempt an integration of transcendental idealism into the realistic metaphysics of the school of Saint Thomas. Following a review of minor figures like Grégoire, Defever, and Isaye, short chapters investigate the critical approach of certain important contemporary Catholic thinkers to the transcendental method. A highly interesting part of the book treats the neo-scholastic "dialogue" with Heidegger, which is especially important in the work of the most powerful theological mind of contemporary Roman Catholicism, Karl Rahner. Finally, Muck shows, in the chapters on A. Marc, B. Lonergan, and E. Witnessing to the strong present-day interest in the formation of the great scholastic syntheses of the thirteenth century are the large number of studies devoted to the lesser thinkers of the preceding century. The English-born Robert of Melun is one of these so far largely neglected authors. Despite the edition of his major works in Louvain by R. M. Martin, little has been written on this gifted pupil of Abelard. Horst cuts a large and central piece out of Robert's (...) "system": the doctrines of the Trinity and of God. After a detailed analysis of the sources of his thinking, the Trinity is dealt with and then God. Under the pen of Robert, the sharp dialectical method of Abelard serves to elaborate Augustine's speculation on the Trinity. Yet the author—in line with the contemporary interest in trinitology—is not satisfied to expound the subtle distinctions Robert made but strives to show also how they can have a bearing on the "economy of salvation." There is a rather liberal dose of lengthy Latin quotes, footnotes mushroom, and secondary literature is quoted by the yard. To sum up: this is a serious and articulate treatment of two central questions of scholastic theology and we are glad to read the promise of a continuation treating Robert's anthropology, angelology, and his views on the First Man.—M. Karl Barth's younger brother died shortly before the publication of this monumental work, the crowning piece of his long philosophical career. Since Sein und Zeit and L'Etre et le Néant the present book has been the first real "treatise" in what now we might call "the existentialistic tradition." Such a short notice cannot even hope to enumerate the major themes of this huge volume. This is a truly significant work covering most of the themes that attract a passionate concern (...) for the history of Western philosophizing. The continuity with this history is preserved through the determination of existence as knowledge. The question and the quest about appearance is conducted in such a way that neither the existentialist nor the transcendental elements are neglected. Throughout the entire book it is argued that appearance and existence are positively grounded in transcendence.—M. J. V. (shrink)

The great value of this book does not lie in any new discovery but in its being the most comprehensive monograph to date on the major ideas of Jacobi's thinking as well as on the relationship of the "philosopher of faith" to the leading German thinkers of his time. The first chapters are devoted to a subtle analysis—focussing mainly on his novels—of the moral aspirations underlying his philosophical oeuvre. The next major theme is the well-known polemics with M. (...) Mendelssohn on Lessing's alleged Spinozism—and this is a good pretext for Prof. Verra to display his vast learning by passing in review the views of Herder, Gœthe, and Hegel on Spinoza and continuously referring to the highly important book of Heydenreich. The last three chapters deal with Jacobi's "mature" thought centered around the problem of an intuitive knowledge of reality and his violent polemics against philosophical demonstration as such, which leads necessarily—according to him—to Spinozistic pantheism, i.e., atheism. It is in these chapters that Jacobi's criticism of Kant, Fichte, and Schelling is treated. The footnotes are at the end of the chapters, and they should be read separately. They are sheer delight for anyone a little at home in this period of German intellectual history. Though Joseph Nadler published the definitive, critical edition of Hamanns' complete works, the hermetic character of these texts warrants only too strongly a publication of at least the major texts with commentaries. The annotated edition is planned to comprise eight volumes. From the viewpoint of the history of ideas, Vol. IV is undoubtedly the most interesting, since it contains the important texts on the origin of language. These were directly provoked by Herder's famous Abhandlung über den Ursprung der Sprache; (...) "the Magician of the North" fights the spirit of the Aufklärung even when it is clothed in the more attractive, pre-romantic setting of Herder's prose. Besides a fantastic amount of notes and commentary, Miss Büchsel, the editor of Vol. IV, offers a comprehensive and penetrating introductory study. Especially important are the chapters on the "pre-history" of Hamanns' Herder-interpretation and its influence on the later development of German intellectual life from the early Goethe to the old Schelling Vol. V contains the so-called mystery-writings directly pertinent to the Christian doctrine of the revelation of the Incarnated Son of God. These texts are truly esoteric, and even the multitude of notes accompanying them cannot always fully overcome their terrible obscurity. And here arises the only objection against this edition. The notes and commentaries are a mine of detailed information, and they "unconceal" the meaning of every word. Yet perhaps their very abundance impedes their stated purpose. They do help in understanding the words, but they make sustained reading of the texts themselves impossible. The encyclopedical character of the notes is cause for both exasperation and for growth in knowledge and inspiration.—M. J. V. (shrink)

Hegel's philosophy of history used to be interpreted mainly in terms of what it is supposed to say about the direction and the end of history, yet the central historical category is, after all, the present, "the spiritual midday." True historicity is in the concrete moment--and this is the thesis that so many commentators of the Phenomenology of the Spirit neglect to emphasize. Hence, after a dutiful examination of the concept of history in this first major work of the (...) philosopher, the author engages in a detailed and interesting history of the interpretations of the Phenomenology. From Feuerbach to Rohrmoser, via Marx, Kierkegaard, and Heidegger we see the radiation of this great work; then comes a discussion with Kojève. In this Auseinandersetzung one definitely senses a sort of aversion toward the brilliant French interpreter but even here the historian's objectivity and expository purpose prevail.--M. J. V. Hamann is one of the greatest religious writers of the eighteenth century in Germany. He is the person whom Schelling, Hegel, and Kierkegaard admired, read, and quoted. This book treats the major themes and insights of Hamann. Texts of Hamann are represented by a large number of quotations. Hamann never wrote a systematic treatise; he wrote short, devastating, illuminating essays and criticisms, as well as letters. Especially interesting are the chapters dealing with Hamann's criticism of contemporary philosophy, and his (...) views concerning the relation of philosophy and faith. This is a complicated and ingenious study of one of the famous friendships of German intellectual history. Miss Knoll's aim is not so much to analyze philosophical ideas as to find the major structural elements of this highly emotional literary friendship between Hamann and Jacobi. The book begins with a short review of Hegel's and Dilthey's treatment of the "subject," Hamann-Jacobi. The author objects to these treatments which, like practically all other students of the question viewed the letters from (...) an exclusively philosophical and speculative viewpoint, and never tackled the deeply personal structure of this metaphysical-religious correspondence. This is exactly what the present author attempts to do. The analysis of Hamann's highly complex reactions to Jacobi's famous book on Lessing's Spinozism reveals to us how strongly and on how many levels the "magician of the North" criticized Jacobi—and through him any attempt to combat the Enlightenment which does not reject it in integro. On the other hand Hamann continuously sent his manuscripts to Jacobi to be read and criticized, and, in this way, he sought to help the latter to grow by making him contribute to works of a dimension and depth completely alien to his own thought But the destiny of Hamann was to be misunderstood by Jacobi, and this misunderstanding was recognized and corrected only by Schelling. Though H. Fuhrmans has already forcefully pointed out what Schelling owed to Hamann, the present book is the first to do justice to Schelling's Hamann-interpretation, until now entirely overshadowed by that of Hegel.—M. There is a quasi-consensus in philosophical circles that Kant had no philosophy of history, and in this respect was one with the Aufklärung. The author's aim is to refute this thesis. He tries to show that the Aufklärung was not unhistorical, but simply considered itself the culmination of all history, and thus was unable and unwilling to see that past centuries might have had autonomous values and goals, or, as Ranke said, that "all periods are immediately towards God." For the (...) Aufklärung, and for that matter for Kant, the past's only role was to be a necessary preparation for the present. However, as Weyand points out, for Kant the present period too is only a step forward since the development of history is unlimited. Another significant point of divergence is the role Kant assigns to the inborn evil in human nature and, following this, to the antagonism between men. In his eyes not reason but "antagonism" rooted in our dark egoistic passions is the major drive in historical progression. All this is explained through a three-fold temporal division of Kant's thought: works written before the Ideas of a Universal History from a Cosmopolitan Viewpoint; from this last book up to the Critique of Judgment; from the third Critique to the Opus Posthumus. Throughout the book Weyand attempts to show that Kant did have a coherent philosophy of history. But despite the painstaking efforts to study every utterance of Kant on the subject, most readers can't help but be struck by the meagerness of what the Great One of Königsberg had to say about history and historicity.—M. This Festschrift is one of the best we have been offered during the last decade. German, French, Turkish, Italian, South African, and Austrian scholars have written 23 essays in honor of one of the foremost historians of philosophy in this century, H. Heimsoeth. Half of the book is devoted to Kantian-scholarship; especially impressive are: Guéroult's study on the structure of the second analogy of experience, Belaval's comparison between Kant and Leibniz, and the richly documented long investigation by G. Tonelli on (...) the presuppositions of Kant's table of judgments in the logic of the eighteenth century. The second part of the present volume is more heterogeneous than the first. One reads with genuine enthusiasm H. Fuhrmans' "The God-World relationship in Schelling's late philosophy." L. Landgrebe's article on the philosophical problem of the end of history is grounded in Kantian soil, but other essays are little connected to Heimsoeth's major interests. These essays include: E. Lichtenstein on the philosophical development of the concept of culture from Meister Eckhart to Hegel; F. Nicolin on the systematic situation of the history of pedagogy since Herbart and Schleiermacher; and H. Wagner's paper on Plato and the beginning of metaphysics as a science. This is a long-awaited reprint of the major work of the late Alexandre Koyré, one of the greatest masterpieces of the history of Western philosophy. The early nineteenth century saw a revival of Boehme studies but even the commentaries of Franz von Baader could not be substituted for a scholarly synthesis of Boehme's thought. Boehme is a universe of his own, and only the immense learning of a man like Koyré, with his rare ability to synthesize and clarify, could (...) have done justice to him. Through and beyond the rich and baroque splendor of the cosmic poetry of the Dawn of the Mysterium Magnum, we see the birth of the modern philosophical spirit. What Boehme offers us is a philosophy of freedom, and, despite the modesty of his comparisons, Koyré does not fail to show how all this anticipates the greatest Idealistic systems.--M. J. V. Franke, "Apology for the protection of the unborn (...) life"; "Basic issues of the Abortion Problem"; "Catechesis according to the Council"; R. Schnackenburg, "The birth of Christ without legends and Myths"; P. Caspers, "The role of the Church in Asia"; C. Aguiar, "Latin-American Catholicism"; "The Memory of Mauriac." The very difficulty of publishing in Hungarian a theologically orientated digest makes this selection dramatically sparing and it seems to give us a more coherent and more essential view of the "happenings" of the West than many of the reviews of America, France or Germany.--M. It becomes increasingly difficult to keep up with studies of Schelling, or more generally of the history of German Idealism, without being conversant with the rapidly growing Italian literature in this field. This book appears twenty-five years after that of Horst Furrmans, and ten years after that of Walter Schulz—the two major studies to date of Schelling's later philosophy. Although Bausola's study does not display the depth and extent of scholarly penetration to be found in Furrmans or Schulz, neither (...) does it display their pretention. It does not claim to be the ultimate interpretation. Its avowed aim is to treat one major theme in the later Schelling: that of relationship between metaphysics and revelation. Yet it also points to a rather novel interpretation, or at least a sketch, of the relationship of the middle Schelling to the writings preceding the Bruno. For the non-specialist, this book is a valuable introduction, offering a clear and well written account of the great themes of Schelling's late philosophy. Included is a competent review of the relevant secondary sources and a bibliographical notice of publications after 1953, the closing date of Schneeberger's standard Schelling bibliography.—M. J. V. This is the first really comprehensive treatment to appear in modern times of the great Alexandrian theologian's life and doctrine. Like his better known contemporaries, Fr. Chr. Baur, J. Müller, and Dorner, Redepenning also united the great heritage of intense speculative interest with the full armor of nineteenth century historical scholarship. In spite of his many footnotes he has a clear and rich style, focusing on major theological and historical questions. He has sense enough to leave some highly specialized (...) issues to a number of appendices. The first volume is devoted to Origen's early doctrines in their historical context. The second volume has two major sections: one deals in the fashion of the first volume with the development of Origen's later doctrines. The other treats in a systematic manner the whole of Origen's doctrines in terms of God, the fallen world, and the redemption. These are the most important chapters of the book but they must be read as Redepenning intended: only after the historical sections. This beautifully printed book is an indispensable instrument to any further study of the history of Patristic thought.--M. J. V. (shrink)

This book is a rather mediocre and unimaginative summary of the major themes of Avicenna's metaphysics. Chahine makes the attempt to situate him against the background of antique and medieval philosophy, but the ideas themselves are never given a contextual treatment. One does not see what was truly original and significant in Avicenna's philosophy; one is left frustrated by the succession of scholastic lieux communs and only seldom gratified by a beautiful quote. There is a certain amount of information (...) on the ideas of other Islamic thinkers influencing Avicenna or influenced by him, but this cannot compensate for the lack of a really penetrating analysis—M. This is an ambitious venture into the thicket of medieval philosophy: what is the true object of metaphysics? The book begins with a number of texts, printed after various manuscripts through which the author hopes to illustrate the development of a certain chain of ideas. After a short introduction on the Aristotelian and Arabic sources of the whole problematics, there are three fundamental solutions of the question: God is one of the many subjects of metaphysics, God is the cause of (...) the subject of metaphysics, God is a part of the subject of metaphysics. These major alternatives are followed by their respective development in the works of later authors. Besides the more usual writers like St. Thomas, Scotus, R. Bacon, Siger of Brabant, Henry of Ghent, we are given interesting and penetrating accounts of the ideas of men like Augustinus Triumphus of Ancona, Petrus of Alvernia, John Quidort of Paris, etc. Despite the first impression provoked by the table of contents this book is not a herbarium of rarities or curiosities but a highly concentrated and often fascinating study of the real topics of all metaphysics and through this perhaps of the very possibility of metaphysics as such.--M. One of the most important and most interesting questions of the history of Christian thought is that of the influence of Platonism on Patristic and Scholastic speculation. Today, perhaps more than ever before, this question of the influence of Plato--and that of his later, more faithful disciples, the Neo-Platonists--presents itself as a fascinating issue. Ivánka is a historian, and the shorter essays and studies of a thirty-year research career are here recast and integrated into a unified book, focussing on some (...) major figures and problems of Christian Platonism. After a lengthy and highly interesting general reflection on Platonism and its historical fortunes, we have chapters on Origen, Gregory of Nyssa, and Augustine, representing the culmination of Platonism in the Greek East and the Latin West respectively. The second part of the book is devoted to speculative mystical theology: Pseudo-Dionysius, Maximus Confessor, the pre-Thomistic West, and at the end a fascinating chapter on the Platonic core of the spiritual doctrine of the late Byzantine centuries.--M. The present "Studienausgabe" is the fruit of over 40 years of labor on Paracelus [[sic]]. While Sudhoff's monumental edition continued by K. Goldhammer is intended to serve the specialist, Peuckert's aim is simply to make Paracelsus accessible to the philosopher and to the historian of ideas. Like Luther's, Paracelus's [[sic]] German is hardly comprehensible today; hence the editor had to "rewrite" it. The result is sound and easily understandable German. This welcome "vulgarization" should, however, have been compensated by notes: as (...) a matter of fact there are no critical or commenting notes in any of the volumes published as of now. We are promised a glossary at the end of the fifth volume, but even this will not mend the edition's essential shortcoming: a complete lack of any kind of scholarly apparatus. The first two volumes contain the major "medical" writings in chronological order. These earlier texts witness Paracelsus's emancipation from the ballast of medieval science: Galen, Avicenna, etc., and a significant turn towards a new conception of natural science in which speculation and experience are intimately interwoven. In the first volume there are several writings on Alchemy, among them the short treatise on the Three First Principles which was so heavily to influence the "pansophy" of the seventeenth century and even the great mystic of Görlitz, Jacob Boehme. The second volume contains the mature medical texts including the "Opus Paramirum," this herald of later bio-chemical thought. Obviously the real interest of the so-called medical texts lies in their speculative elements and they should be read together with the philosophical texts, making up the third volume. This third volume is rightly centered around the monumental "Philosophia Sagax," the major work of Paracelsus. This is the treatise whose influence reached far beyond the twilight of pansophy until the early and late Goethe and Romantic philosophy. Better than any other, this text demonstrates the uninterrupted continuity of German speculation throughout three centuries. If the resolution of the remaining two unpublished volumes turns out to be as fortunate as those reviewed here, these well-printed books should find their way to the shelves of any library, private or public, orientated towards the study of German philosophical thought.—M. The author is one of the greatest contemporary authorities on Classical Jewish philosophy. He applies his vast scholarship to probe into the inter-relationship between medieval Jewish philosophy and the cabala. The profound and daring speculation of the theosophists of the early cabala did not fail to provoke a violent reaction on the part of Jewish scholasticism, and the two long studies in the present volume try to analyze two cases of such antagonistic relationships. The first of the studies is a (...) comparison of the philosophico-theological treatise of Samuel Judah Ibn Tibbon, "The Reconciliation of Philosophy and the Religious Law," with a treatise on the Spanish cabalist Jacob ben Seset. While in this study we see the confrontation of the spirit of Averroes with the cabalistic inspiration, the second essay is devoted to a treatise from the fourteenth century, written by Joseph ben Abraham Ibn Waquar, in which philosophical and cabalistic elements are intimately interwoven in one and the same work. To the two major studies are added ten highly interesting short treatises on cabalistic notions and texts, making the present books together with the writings of Gershon Scholem the most important monument to cabalistic scholarship available in a Western language.—M. After some decades of eclipse, the thought of Schleiermacher has again become the subject of an ever growing number of studies and specialized monographs. The present one deals with one of his principal yet somewhat neglected works, his Christian Ethics. After some discussion of the history of the influence and of the interpretation of the treatise, Birkner analyzes the systematic presuppositions of its teaching within the framework of Schleiermacher's entire doctrine. The author then undertakes the treatment of its major (...) themes. It is a well-written, not over-ambitious yet substantial contribution to the Schleiermacher literature.--M. J. V. (shrink)

Once more these annals offer the reader a substantial collection of varied articles and studies, mostly pertaining to issues of medieval philosophy and metaphysics. The contributors are from Austria, West Germany, and South Korea. Especially interesting are: the study on Kant's early writing, "The Only Possible Proof of God," by J. Bauer; a very strict analysis of the thirteenth chapter of Cusanus' book, De Visione Dei, by the Proclus specialist W. Beierwaltes; and an attempt at the "reconciliation" of metaphysics and (...) positivism by R. Wohlgenannt. There are a number of shorter book reviews and a lengthy instructive review article on R. Berlinger's recent book on Augustine's dialectical metaphysics. This review article is at least as interesting and inspiring as the major articles making up the bulk of the book.--M. J. V. (shrink)

This recent monograph on the famous head of the Protestant theological school of Tübingen is a mature and well-documented writing, despite a certain circularity and many repetitions in its argument. What Geiger tries to expound above all is Baur's speculative basis—or bias. Baur began with Schleiermacher, but the major and striking influence on Baur's thinking was exerted by Hegel. His books on the history of dogma are a theological counterpart of Hegel's phenomenology. But in his last writings, the speculative (...) schemas are quietly effaced, and we read suddenly that the essence of Christianity is the "pure moral conscience and the autonomy of the subject."—M. Albert the Great died on November 15, 1280. It is only to be expected that the 700th anniversary of the death of one of the longest-lived philosopher-theologians of the Middle Ages should be marked by a volume of commemorative essays. Indeed, one of the more interesting features of this present work is the "Introduction," wherein the editors have located the Doctor Universalis in terms of his interests, his many and varied writings, and his companion viatores of the late twelfth and (...) the major part of the thirteenth centuries. We know he survived his most famous pupil, Thomas Aquinas, by some six years. It is perhaps more jarring to note that he may have been five years old at the death of Averroes and eleven at the death of Moses Maimonides. He went, as is said, from the decline of the golden age of Arabic and Jewish Philosophy right through to the beginnings of the decline of Scholasticism at the end of the thirteenth century. (shrink)

Tacitus opens the Annals with a succinct sketch of the constitutional history of Rome from the kings to Augustus (1.1.1). The common interpretation holds that Tacitus adopts a cyclical view of this history which identifies the supremacy of Augustus with kingship, and chooses his vocabulary of power primarily with stylistic variation in mind. The terms employed, princeps and imperium, are also held to announce a major interpretative preoccupation of the Annals, the gap between the ‘appearance’ and the ‘reality’ of (...) power under the principate. This essay will demonstrate that these interpretations of the structure and language of the preface are misleading. Tacitus offers a sequential view of Roman constitutional history that casts Augustus as a pivot between the tradition stretching back to the foundation of the city and a new phase which he identifies in its own terms, not as a reversion to kingship. The introduction of the motif of ‘appearance v. reality’ comes not with the language of princeps and imperium, but at 1.2.1. An appendix analyses the use of the term principatus in Velleius Paterculus and Tacitus. (shrink)

This study’s objective was to understand Colombian adolescents’ experiences and preferences regarding access to sexual and reproductive health services (SRHS), either alone or accompanied. A mixed-method approach was used, involving a survey of 812 participants aged eleven to twenty-four years old and forty-five semi-structured interviews with participants aged fourteen to twenty-three. Previous research shows that adolescents prefer privacy when accessing SRHS and often do not want their parents involved. Such findings align with the longstanding tendency to frame the ethical principle (...) of autonomy as based on independence in decision-making. However, the present study shows that such a conceptualization and application of autonomy does not adequately explain Colombian adolescent participants’ preferences regarding access to SRHS. Participants shared a variety of preferences to access SRHS, with the majority of participants attaching great importance to having their parents involved, to varying degrees. What emerges is a more complex and non-homogenous conceptualization of autonomy that is not inherently grounded in independence from parental involvement in access to care. We thus argue that when developing policies involving adolescents, policymakers and health professionals should adopt a nuanced “relational autonomy” approach to better respect the myriad of preferences that Colombian (and other) adolescents may have regarding their access to SRHS. The so-called epistemological turn of the Descartes-Locke-Kant tradition is a hallmark of modern philosophy. The broad family of normativism constitutes one major response to the Cartesian heritage building upon some version of the idea that human knowledge, action and sociality build fundamentally upon some form of social agreement and standards. Representationalism and the Cartesian picture more generally have been challenged by normativists but this paper argues that, even where these challenges by normativism have been taken to heart, our intellectual (...) culture remains fundamentally epistemic in certain problematic senses. Two problems are highlighted: first, normativism remains functionally Cartesian, for human action and sociality appear as processes driven by the shared understandings by competent contributors, and second, normativism is unable to account for forms of human action and sociality other than those occurring in the relatively small worlds of normatively regulated conceptual spaces of mutual access and listening. These points are illustrated by an applied discussion of the blind spots of normativist accounts of the emerging environmental and the on-going economic crises. (shrink)

The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

OBJECTIVES: To investigate the need for hospital clinical ethics committees by studying the frequency with which ethical dilemmas arose, the perceived adequacy of the process of their resolution, and the teaching and training of staff in medical ethics. DESIGN: Interviews with individuals and three multidisciplinary teams; questionnaire to randomly selected individuals. SETTING: Two major London children's hospitals. RESULTS: Ethical dilemmas arose frequently but were resolved in a relatively unstructured fashion. Ethical concerns included: the validity of consent for investigations and (...) treatment; lack of children's involvement in consent; initiation of heroic or futile treatments; resource allocation. Staff expressed the need for a forum which would provide consultation on ethical issues, develop guidelines for good ethical practice, undertake teaching and training, and provide ethical reflection outside the acute clinical setting. CONCLUSION: Multidisciplinary, accountable and audited clinical ethics committees with predominantly advisory, practice development and educational roles could provide a valuable contribution to UK clinical practice and perhaps in other countries that have not developed hospital clinical ethics committees. The objectives of this study were to develop a high-density chromosome bin map of homoeologous group 7 in hexaploid wheat, to identify gene distribution in these chromosomes, and to perform comparative studies of wheat with rice and barley. We mapped 2148 loci from 919 EST clones onto group 7 chromosomes of wheat. In the majority of cases the numbers of loci were significantly lower in the centromeric regions and tended to increase in the distal regions. The level of duplicated loci (...) in this group was 24% with most of these loci being localized toward the distal regions. One hundred nineteen EST probes that hybridized to three fragments and mapped to the three group 7 chromosomes were designated landmark probes and were used to construct a consensus homoeologous group 7 map. An additional 49 probes that mapped to 7AS, 7DS, and the ancestral translocated segment involving 7BS also were designated landmarks. Landmark probe orders and comparative maps of wheat, rice, and barley were produced on the basis of corresponding rice BAC/PAC and genetic markers that mapped on chromosomes 6 and 8 of rice. Identification of landmark ESTs and development of consensus maps may provide a framework of conserved coding regions predating the evolution of wheat genomes. (shrink)

In Aeneid 7. 1–285 Vergil colours his picture of early Latium with a religious atmosphere which can be fully appreciated only if these verses are read with an attentive awareness of Roman religious beliefs and practices. A detailed exegesis of all 285 verses would hardly be possible here, and I will limit myself to two major points, the account of Latinus' ancestry and the description of the royal palace , both because these passages are interesting in themselves for the (...) way they apparently contradict each other, and because they are good illustrations of how Vergil draws on the data of Roman religion, both its folklore and its cult, to fix in his reader's mind certain definite impressions about Latinus and the Latins. This first of two volumes brings together invited papers of the 32nd International Wittgenstein Symposium. The relation between language and the world was undoubtedly a major issue in Wittgenstein's philosophical oeuvre. This volume provides substantial contributions on various aspects of Wittgenstein's writings such as the philosophy of mathematics, the problem of rule following, or the relation between meaning and use.

Introduction: The decision of “do not attempt resuscitation” in the event of cardiopulmonary arrest is usually made when the patients are critically ill and cannot make an informed choice. Although, various professional bodies have published guidelines, little is know about the patients’ own views regarding DNAR discussion.Aim: The aim of this study was to determine patients’ attitudes regarding discussing DNAR before they are critically ill.Methods: A prospective study was performed in a general out patients department. A questionnaire was distributed to (...) consecutive outpatients along with an explanatory leaflet in the adult outpatient clinic.Results: 364 patients completed the questionnaire . 90% of respondents wanted all patients to be asked regarding DNAR decision at some point during a hospital admission. The majority would not find a DNAR discussion distressing. Only 10% would find it upsetting, however, 48% of these still wanted a discussion. 37% of respondents wanted to discuss DNAR decisions on admission; 32% in outpatients; 17% at consent for surgery, 14% when they are critically ill. 87% of respondents would not object to their relatives being involved in making decisions about their resuscitation status. However, only 12% of the subjects in the study had been involved in discussing the resuscitation status of a relative and 21% would not be comfortable to discuss a relative’s resuscitation status. Although 33% of patients preferred their resuscitation status to simply be documented within their clinical notes, 77% wanted it to be more easily accessible.Conclusions: This study suggests that contrary to current practice most patients want to discuss their DNAR status prior to becoming critically ill. This includes half of the small number that find it distressing to discuss. Although most patients are comfortable with relatives being involved in discussing DNAR, a significant proportion do not want their relatives to be asked. Furthermore, once a decision has been made, the majority of patients want it to be more accessible than current practice allows. (shrink)

_Sufi Castigator_ investigates the writings of Ahmad Kasravi, one of the foremost intellectuals in Iran. It studies his work within the context of Sufism in modern Iran and mystical Persian literature and includes translations of Kasravi’s writings. Kasravi provides a fascinating topic for those with interests in Sufism and Iranian studies as he attempted to produce a form of Iranian identity that he believed was compatible with the modern age and Iranian nationalism. His stress on reason and the de-mystification of (...) religion caused him to repudiate Sufism and much of the Sufi literary heritage as backwards and believed it a reason for the weakness of modern Iran. Kasravi’s historical observations were weak, and his writings indicate that he was working towards pre-determined conclusions. However, his works are of significance because they contributed to a major discussion in the 1930s to 1940s about the ideal image and identity that Iranians should adopt. Despite the academic weaknesses of Kasravi’s works he had a profound effect on the next generation of thinkers. _Sufi Castigator_ is stimulating and meticulously researched book and includes two lengthy translations of Kasravi’s works, _Sufism_ and _What does Hafez Say?_ and will appeal to scholars of middle eastern studies. This book is a reprint of one of the pioneer works on German mysticism of the nineteenth century. It is a comprehensive account of the most fertile hundred years of German spiritual and mystical history in the Middle Ages. In contrast to Bach's and Lasson's books on Eckhart written in the same decade, Greith's viewpoint is one of narrow scholastic orthodoxy. However, the wealth of detail and the pleasant simplicity of style compensate for those rather irritating lamentations about the "errors" (...) of Meister Eckhart. Although this book was written before Denifle's discovery of Eckhart's Latin works, it remains of value today due to its systematic study of the doctrinal positions of the major mystical writers of the Rhineland. Included as well is an interesting analysis of mystical poetry centered around the works of the famous Sister Mechtild. The book ends with a lengthy and detailed description of the spirituality and spiritual theory developed in the scattered nunneries of the preaching orders.—M. J. V. (shrink)

Though Joseph Nadler published the definitive, critical edition of Hamanns' complete works, the hermetic character of these texts warrants only too strongly a publication of at least the major texts with commentaries. The annotated edition is planned to comprise eight volumes. From the viewpoint of the history of ideas, Vol. IV is undoubtedly the most interesting, since it contains the important texts on the origin of language. These were directly provoked by Herder's famous Abhandlung über den Ursprung der Sprache; (...) "the Magician of the North" fights the spirit of the Aufklärung even when it is clothed in the more attractive, pre-romantic setting of Herder's prose. Besides a fantastic amount of notes and commentary, Miss Büchsel, the editor of Vol. IV, offers a comprehensive and penetrating introductory study. Especially important are the chapters on the "pre-history" of Hamanns' Herder-interpretation and its influence on the later development of German intellectual life from the early Goethe to the old Schelling Vol. V contains the so-called mystery-writings directly pertinent to the Christian doctrine of the revelation of the Incarnated Son of God. These texts are truly esoteric, and even the multitude of notes accompanying them cannot always fully overcome their terrible obscurity. And here arises the only objection against this edition. The notes and commentaries are a mine of detailed information, and they "unconceal" the meaning of every word. Yet perhaps their very abundance impedes their stated purpose. They do help in understanding the words, but they make sustained reading of the texts themselves impossible. The encyclopedical character of the notes is cause for both exasperation and for growth in knowledge and inspiration.—M. J. V. (shrink)
