Retributive theories of punishment argue that punishing a criminal for a crime she committed is sufficient reason for a justified and morally permissible punishment. But what about when the state gets lucky in its decision to punish? I argue that retributive theories of punishment are subject to “Gettier” style cases from epistemology. Such cases demonstrate that the state needs more than to just get lucky, and as these retributive theories of punishment stand, there is no anti-luck condition. I’ll argue that (...) Gettier-style cases demonstrate an impermissible instance of punishment, even though they meet the conditions of retributive theories of punishment. Retributive theories are, therefore, too weak. The safety condition from epistemology provides the anti-luck condition needed for permissible punishment. I argue that two forms of retributivism, rights-forfeiture and what I call standard retributivism, are both subject to Gettier-style cases. Unlike the literature on standards of proof, this paper argues that safety is a condition on punishment itself, i.e., in all nearby possible worlds, the accuser must correctly accuse the convicted for the crime they actually committed. Professor Findlay in this book, originally published in 1961, set out to justify, and to some extent carry out, a ‘material value-ethic’, ie. A systematic setting forth of the ends of rational action. The book is in the tradition of Moore, Rashfall, Ross, Scheler and Hartmann though it avoids altogether dogmatic intuitive methods. It argues that an organised framework of ends of action follows from the attitude underlying our moral pronouncements, and that this framework, while allowing personal elaboration, is not (...) a matter for individual decision. The relations connecting our fundamental value-judgements with one another, and the frames of mind behind them, are not rigorously deductive but are sufficiently compelling to be called logical. Something of a ‘transcendental deduction’ of a well-ordered family for our basic heads of valuation is both possible and necessary. The work is further critical of the notion of obligation which has been extended far beyond legal contracts and understandings. The book also contains a chapter on religion. (shrink)

James L. Anderson analyzed the novelty of Einstein's theory of gravity as its lack of "absolute objects." Michael Friedman's related work has been criticized by Roger Jones and Robert Geroch for implausibly admitting as absolute the timelike 4-velocity field of dust in cosmological models in Einstein's theory. Using the Rosen-Sorkin Lagrange multiplier trick, I complete Anna Maidens's argument that the problem is not solved by prohibiting variation of absolute objects in an action principle. Recalling Anderson's proscription of "irrelevant" variables, I (...) generalize that proscription to locally irrelevant variables that do no work in some places in some models. This move vindicates Friedman's intuitions and removes the Jones-Geroch counterexample: some regions of some models of gravity with dust are dust-free and so naturally lack a timelike 4-velocity, so diffeomorphic equivalence to (1,0,0,0) is spoiled. Torretti's example involving constant curvature spaces is shown to have an absolute object on Anderson's analysis, viz., the conformal spatial metric density. The previously neglected threat of an absolute object from an orthonormal tetrad used for coupling spinors to gravity appears resolvable by eliminating irrelevant fields. However, given Anderson's definition, GTR itself has an absolute object (as Robert Geroch has observed recently): a change of variables to a conformal metric density and a scalar density shows that the latter is absolute. We examine the closure conditions of the probabilistic consequence relation of Hawthorne and Makinson, specifically the outstanding question of completeness in terms of Horn rules, of their proposed (finite) set of rules O. We show that on the contrary no such finite set of Horn rules exists, though we are able to specify an infinite set which is complete.

The Liar paradox raises foundational questions about logic, language, and truth. A simple Liar sentence like 'This sentence is false' appears to be both true and false if it is either true or false. For if the sentence is true, then what it says is the case; but what it says is that it is false, hence it must be false. Abstract: Might knowledge normatively govern conversations and not just their discrete constituent thoughts and (assertoric) actions? I answer yes, at least for a restricted class of conversations I call aimed conversations. On the view defended here, aimed conversations are governed by participatory know-how - viz., knowledge how to do what each interlocutor to the conversation shares a participatory intention to do by means of that conversation. In the specific case of conversations that are in the service of joint inquiry, the (...) view defended is that interlocutors (A, B, ... n) must intentionally inquire together into whether p, by means of an aimed conversation X, only if A,B, ... n know how to use X to find out together whether p. The view is supported by considerations about instrumental rationality, shared intentionality, the epistemology of intentional action, as well as linguistic data. (shrink)

Aristotle's doctrine of the mean is not a counsel to perform mean or moderate actions. It states that excellence of character is a mean state with regard to the having and displaying of emotions. All emotions are morally neutral; character is shown by displaying emotions on the right occasions, Not too often or too rarely, Not too strongly or too weakly, For sufficient and only sufficient reasons, Etc. The difficulties for such a view presented by justice and such bad emotions (...) as envy are discussed. The conclusion is that basically aristotle's theory can resist critical scrutiny. (shrink)

That space and time should be integrated into a single entity, spacetime, is the great insight of Einstein's special theory of relativity, and leads us to regard spacetime as a fundamental context in which to make sense of the world around us. But it is not the only one. Causality is equally important and at least as far as the special theory goes, it cannot be subsumed under a fundamentally geometrical form of explanation. Epistemology is often a problem for libertarianism. Many libertarian texts assume that they need to do more than explain and defend the libertarian conjecture. Instead, they try to offer epistemological support for it (whether empirically or morally); which falsificationism and, more broadly, critical rationalism explains is not possible. Moreover, they often mistake this attempt at support for an explanation of libertarianism (which ought to include an abstract theory of liberty and how it relates to liberty in practice). Misconceptions about energy conservation abound due to the gap between physics and secondary school chemistry. This paper surveys this difference and its relevance to the 1690s–2010s Leibnizian argument that mind-body interaction is impossible due to conservation laws. Justifications for energy conservation are partly empirical, such as Joule’s paddle wheel experiment, and partly theoretical, such as Lagrange’s statement in 1811 that energy is conserved if the potential energy does not depend on time. In 1918 Noether generalized results like Lagrange’s and proved (...) a converse: symmetries imply conservation laws and vice versa. Conservation holds if and only if nature is uniform. The rise of field physics during the 1860s–1920s implied that energy is located in particular places and conservation is primordially local: energy cannot disappear in Cambridge and reappear in Lincoln instantaneously or later; neither can it simply disappear in Cambridge or simply appear in Lincoln. A global conservation law can be inferred in some circumstances. Einstein’s General Relativity, which stimulated Noether’s work, is another source of difficulty for conservation laws. As is too rarely realized, the theory admits conserved quantities due to symmetries of the Lagrangian, like other theories. Indeed General Relativity has more symmetries and hence more conserved energies. An argument akin to Leibniz’s finally gets some force. While the mathematics is too advanced for secondary school, the ideas that conservation is tied to uniformities of nature and that energy is in particular places, are accessible. Improved science teaching would serve the truth and enhance the social credibility of science. (shrink)

Overcoming Uncertainty in Ancient Greek Political Philosophy makes an historical and theoretical contribution by explaining the role of opinion in ancient Greek political philosophy, showing its importance for Aristotle’s theory of deliberation, and indicating a new model for a deliberative republic. Currently, there are no studies of opinion in ancient Greek political theory and so the book breaks new historical ground. The book establishes that opinion is key for the political theories of Plato, Aristotle, and the Stoics because each sees (...) uncertainty as a problem that needs to be overcome if one is to establish a virtuous polity. Since they have different notions of the nature of the uncertainty of opinion, they develop very different political strategies to overcome it. The book explains that Plato’s and the Stoics’ analyses of uncertainty support oligarchy and monarchy, respectively, and that theoretical support for deliberate politics requires a more nuanced understanding of uncertainty that only Aristotle provides.
