Die philosophischen, traditionellen Ansätze zur Moral beruhen hauptsächlich auf metaphysischen und theologischen Konzepten und Theorien. Unter den traditionellen Ethikkonzepten ist die göttliche Befehlstheorie die prominenteste (DCT). Gemäß der DCT gibt Gott der Menschheit moralische Grundlagen durch ihre Schöpfung und durch Offenbarung. Moral und Göttlichkeit sind seit der fernsten Zivilisation untrennbar. Diese Konzepte tauchen in einen theologischen Rahmen ein und werden hauptsächlich von den meisten Anhängern der drei abrahamitischen Traditionen angenommen: Judentum, Christentum und Islam: dem bedeutendsten Teil der menschlichen Bevölkerung. Die (...) göttlichen Befehlstheorien halten den Glauben und die Offenbarung für ihre Grundlage und unterliegen nicht strikt der Demonstration. Die Gegner der Gottesbefehlskonzeption der Moral, gegründet auf der Unmöglichkeit der Demonstration ihrer metaphysischen und religiösen Annahmen, haben seit vielen Jahrhunderten (obwohl erfolglos) versucht, ihre Bedeutung zu devalvieren. Sie hielten das Argument, dass es keine materiellen Beweise und logische Kohärenz zeigt und aus diesem Grund nicht für wissenschaftliche oder philosophische Zwecke berücksichtigt werden kann. Es ist nur ein Glauben und sollte daher verstanden werden. Abgesehen von diesen extremen Gegensätzen widersprechen viele andere Konzepte den Theorien des göttlichen Befehls, in der einen oder anderen Weise, teilweise oder vollständig. Von der klassischen griechischen Philosophie bis heute behaupten viele Philosophen und Sozialwissenschaftler, dass Moral nur ein Konstrukt ist und somit kulturell relativ und kulturell bestimmt ist. Dies führt jedoch zu vielen weiteren Diskussionen und stellt die Herausforderung dar, die Bedeutung der Kultur, welche Elemente der Kultur moralisch bestimmend sind, und schließlich die Grenzen dieser Relativität zu bestimmen. Moralischer Determinismus behaupten, dass alles, was mit menschlichem Verhalten zusammenhängt, einschließlich der Moral, bestimmt wird, sobald der freie Wille nicht existiert. In jüngerer Zeit haben moderne Denker argumentiert, dass es eine strenge Wissenschaft der Moral gibt. Doch trotz der Erklärung mehrerer Tatsachen und Beweise kann die wissenschaftliche Methode allein nicht den gesamten Inhalt und die volle Bedeutung der Ethik erleuchten. Ungeachtet dieser Umstände und ihrer intrinsischen Bedeutung sind diese Fragen jedoch weit entfernt vom methodischen Ansatz einer analytischen Diskussion über objektive Moral, die in der Tat das Ziel und den Umfang dieser Arbeit ist. Wir sollten diese prominenten traditionellen Theorien kurz überprüfen, weil diese Arbeit eine vergleichende Studie beherbergt, und ihre Annahmen unterscheiden sich zumindest tief von allen herkömmlichen Theorien. Daher wird es notwendig, dem Leser direkte und spezifische Elemente des Vergleichs für gültige Kritik anzubieten, ohne unterbrechende Forschung. Doch auch wenn wir die traditionellen Theorien für diesen vergleichenden und kritischen Expositionszweck überdenken, werden sie als „aliena materia" an der Seite unserer primären Anliegen gehalten werden. Unabhängig von der Gültigkeit eines oder aller der Elemente dieser Diskussion und ihrer Bedeutung als philosophisches Universum unserer Forschung, ist der Zweck dieses Werkes, dass die Existenz und die Bedeutung der prähistorischen moralischen Archetypen, die direkt aus den grundlegenden sozialen Bedürfnissen und Anstrengungen für das Überleben demonstrierten Archetypen sind, die Definition der wesentlichen Grundlage der Ethik, ihre Aggregation in das kollektive Unbewusste und die entsprechende logische Organisation und Übertragung auf die evolutionären Stadien des menschlichen Genoms und verschiedene Raum-Zeit-Beziehungen, unabhängig von jeder zeitgenössischen Erfahrung der Individuen. Das durch diese Archetypen definierte System bildet ein evolutionäres menschliches soziales Modell. (shrink)

The paper begins by defending the Hohfeldianaccount of rights (as equivalence relations) from thecharge that it cannot capture their specialsignificance, and thus cannot be used in a right-basedmoral theory. It goes on to argue that, because of amisunderstanding of this relational account, theconception of right-based morality that has emerged inrecent years has been variously flawed from theoutset. A particular form of explanatory priority waswrongly taken to be essential, and then eitherincoherently combined with equivalence, or taken to bea reason for rejecting (...) equivalence where right-basedthinking is concerned. In fact, this form of priorityis not sufficient for establishing a right-based moraltheory. It is also not necessary, since theHohfeldian analysis can be shown to be entirelyadequate to meeting the original aims of thoseproposing this approach to ethics. (shrink)

Human rights are those legal and/or moral rights that all persons have simply as persons. In the current digital age, human rights are increasingly being either fulfilled or violated in the online environment. In this article, I provide a way of conceptualizing the relationships between human rights and information technology. I do so by pointing out a number of misunderstandings of human rights evident in Vinton Cerf's recent argument that there is no human right to the Internet. I claim that (...) Cerf fails to recognize the existence of derived human rights. I argue further that we need to consider what other human rights are necessitated by the digital age. I suggest we need a Declaration of Digital Rights. As a step toward the development of such a declaration, I suggest a framework for thinking through how to ensure the human rights are satisfied in digital contexts. (shrink)

Two kinds of intrinsically valuable entities are distinguished - those that are ends-in- themselves (and therefore sacred) and those that are intrinsically good. It is suggested that it is the individual rather than the group that is sacred in the primary sense. To be sacred or an end-in-itself implies that the sacred entity must not be replaced by a potential entity even if more good can be promoted by doing so. It is suggested that only entities that have an irreducible (...) consciousness should be candidates for the sacred in the primary sense. If so, it would follow that groups are not sacred in the primary sense unless perhaps one regards them as unitary beings. It is argued that though groups have rights that are not reducible to the rights of individuals, this is consistent with the view that the ultimate justification of these rights is provided by an appeal to the interests of the relevant individuals; groups can be derivatively sacred. Activities of collectives can sometimes be intrinsically good, and such considerations, too, would be relevant to deciding upon which collectives should be retained and which modified or replaced. This paper attempts to argue that a radically different notion of freedoms and rights that originates from the other, that is founded on the infinite responsibility for the other, and that demands an encounter with the other as pure alterity, could be a plausible starting point towards the conception and possible realization of a Levinasian society of neighbors. First, an explication is made on why a radical change in the area of freedoms and rights could be the starting point towards (...) a social, political, and moral philosophical framework based on the radical philosophy of Levinas as elaborated in his Otherwise than Being or Beyond Essence. Then, a discussion on conventional conceptions of freedoms and rights, particularly those based on liberalism, libertarianism, and utilitarianism, is presented as groundwork for a comparative analysis between these conventional conceptions and a radical notion that would be entailed by a conception of a Levinasian society of neighbors. Lastly, an attempt is made to characterize a radically different conception of freedoms and rights based on the philosophy of Levinas and to argue how it could be the starting point towards the conception and possible realization of a Levinasian society of neighbors. Libertarian views on rights tend to rule out coercive redistribution for purposes of public health care guarantees, whereas liberal conceptions support coercive funding of potentially unlimited access to medical services in the name of medical needs. Taking the “priority of liberty” seriously as supreme political value, a plausible prudential argument can avoid these extremes by providing systematic reasons for both delivering and limiting publicly financed guarantees. Given impending demographic change and rapid technical progress in medicine, only a two-tier system with (...) explicitly limited public guarantees and optional privately financed health services seems acceptable. This dissertation examines the viability of a feminist ethic of flourishing. The possibility of a eudaimonist, or flourishing-based, ethic adapted for the needs of feminist ethics and politics has recently been raised by a number of feminist moral philosophers. However, in these discussions, the degree to which an ethic of flourishing requires a substantive conception of human nature has not been adequately addressed. Flourishing-based ethical theories appear to require a substantive account of the kind of thing whose flourishing is to (...) be promoted, while contemporary academic feminism is characterized by a strong suspicion toward claims about human nature. Chapter one situates this problem in the current literature and reframes feminist anti-essentialist objections to nature claims. Chapter two analyzes three historically influential exemplars of the ethics of flourishing: Aristotle, Hume, and Marx. Employing the analytic categories developed in chapter two, chapters three through five assess the work of Rosalind Hursthouse, Martha Nussbaum, and Lisa Tessman for their adequacy to serve as the basis of a feminist ethic of flourishing. I argue that each has something of value to offer and yet each is problematic when it comes to how they appeal (or fail to appeal) to human nature. The central argument of this dissertation is that, properly understood, a theory of human nature can be a critical resource for a feminist ethic of flourishing. As such, feminist moral philosophers who would condemn oppression, gender-based subordination, and other injustices by appealing to an ideal of flourishing that is being denied or cut off, would benefit from greater attention to the assumptions about human nature that such theories of flourishing entail. On the view defended here, a normative conception of human nature is a necessary methodological element of a flourishing-based ethical theory that illuminates the reasons one has in support of a particular vision of flourishing. While I leave open the question of how such a conception of human nature could be objectively justified, this dissertation argues that a theory of human nature can serve as a normative resource for feminist moral criticism within a flourishing-based ethical framework. Através da análise do pensamento de Isaac Newton (1642-1727) encontramos os postulados metafísicos que fundamentam a sua mecânica natural. Ao deduzir causa de efeito, ele acreditava chegar a uma causa primeira de todas as coisas. A essa primeira causa de tudo, onde toda a ordem e leis (...) tiveram início, a qual para ele assume um caráter divino, Newton aponta para um Deus sábio e poderoso e responsável pela ordem inteligente e pela a harmonia das leis físicas e universais de tudo o que existe – Deus como criador e preservador da ordem do universo. Há ainda a analogia do conceito de Deus com o espaço e o tempo, na medida em que ambos comunicam infinitude e onipresença. Por fim, nas considerações finais apontarei a importância de Newton para a metafísica moderna e como os seus estudos contribuíram para uma visão posterior do universo e suas leis e do homem enquanto ser pensante.
