This article explores Hannah Arendt's insights into the forms of social control operating especially in democracies, together with the possibility of resistance to such control. Since the way in which one defines freedom informs one's understanding of the techniques that suppress, regulate, and modify behaviour, the article begins by sketching Arendt's notion of freedom, and compares this to its liberal counterpart. That discussion leads to Arendt's conception of power, whose corollary is freedom, and whose suppression amounts to control. The institutional (...) and ideological infrastructure that accompanies the encroachment of ?the social? ? which Arendt links to the hegemony of liberalism ? is conceived as rendering the individual both powerless and apathetic. The article concludes with suggestions regarding resistance to modern forms of control, viewing Arendt's ontology as a source of tenable strategies for the deepening of democracy. (shrink)

Freedom, conceived ontologically, is power's condition of possibility. Yet, considering that the subject's interests and identity are constantly shaped, one still has to explain how – theoretically speaking – individuals can resist control. This is precisely the issue I address in the following pages. Following a brief overview of Foucault's contribution to our understanding of power, I turn to discuss the role of visibility vis-à-vis control, and show how the development of disciplinary techniques reversed the visibility of power. While Foucault (...) illustrates that during different historical periods, distinct modes of visibility are produced by power in order to control society, I argue that the very same power that produces visibility is concomitantly dependent upon it. In addition, I maintain that visibility is a necessary component of resistance. But Foucault – perhaps due to his premature death – never adequately explains how individuals can resist the mechanisms of control in a world in which power is ubiquitous. To help clarify this enigma, I turn to Hannah Arendt's insights into power, freedom, plurality, and natality. These concepts, I claim, can serve as a corrective to Foucault because they make room for resistance without assuming that humans can exit power's web. (shrink)

Science and the humanities share the same kit of working tools, called the world's literature. While the author of this article deals mainly with the scientific and mathematical literature, the reader probably gravitates towards some other branches, but such distinctions were hardly made in the Middle Ages. The American philosopher, Wallace Stevens, in his book The Necessary Angel remarks that at the time of Aristotle, the Greek language had no word to signify literature. The reason is surely that literature had (...) long since been too universal an element in Greece to require a name. We have no name for the smell of air. This all-pervading power of literature is apparent already two generations before Aristotle, when Socrates made his defence against leading the youth of Athens towards atheism. Plato's Apology tells us how Socrates taunted his accuser: “Have you such a low opinion of the judges, that you fancy them so illiterate as not to know these doctrines are found in the books of Anaxagoras which are full of them? And so, my word, the youth are said to be taught them by Socrates, when they can be bought in the book-market for one drachma at most…” (a coin today worth 1.4 pence!). (shrink)

The subject of this book is the social and political meaning of constitutional texts to the detriment of their legal concretization. Focusing on the discrepancy between the hypertrophically symbolic function of constitutions and their insufficient legal concretization, it offers a critical counterpoint to constitutional theory that treats constitutional texts as a panacea to solving political, legal, and social problems. In contrast to the premises of Niklas Luhmann's systems theory regarding law and constitution in world's society, symbolic constitutionalization is approached here (...) in both a comprehensive and far-reaching perspective. Chapter 1 sets out the debate about symbolic legislation. Chapter 2 explains the notion of symbolic constitutionalization as a problem embracing the whole legal system. Chapter 3 approaches the issue in terms of allopoiesis of law, characterizing it primarily as a problem in peripheral modernity and referring to the Brazilian experience. The final chapter discusses the tendency to a symbolic constitutionalization of world society in the scope of a paradoxical peripheralization of the centre. (shrink)

Radulphus Brito's Quaestiones super Priora analytica Aristotelis is a major work written in the early 1300s which treated Aristotle's text devoted to the theory of the syllogism. Brito, one of the most influential of the group of medieval thinkers known as the Modistae, examines both categorical and hypothetical syllogisms. In the text offered here, based on six known manuscripts which are complete or nearly complete, Brito was critical of many of the theories of his contemporary, Simon of Faversham. Brito edited (...) his work several times; there are at least two versions which indicate Brito returned to this material during his long career at the university in Paris. This volume is the first critical text edition of Brito's Quaestiones super Priora analytica Aristotelis and will therefore be of great interest to those studying the history of logic and its development during the medieval period. The text analyses rituals as endeavours to preserve the identity of a people or a portion of a people. Rituals present or re-present the supposed common history of all the migrants. Social memory and history then tend to merge and to forget... forgetfulness is the driving force behind the writing of history. Particularly critical is the moment when the migration starts, because the need to adapt to new conditions as well as to maintain what is represented as their social identity (...) makes dual – and at times contradictory – demands on the migrants’ imagination. Over 50% of the world population will develop a psychiatric disorder in their lifetime. 1 In the realm of psychiatric treatment, two primary modalities have been established: pharmacotherapy and psychotherapy. Yet, pharmacological interventions often take precedence as the initial treatment choice despite their comparable outcomes, severe side effects and disputed evidence of their efficacy. This preference for medication foregrounds a vital re-examination of what it means to be invasive in medical treatments, namely in psychiatric care. This study investigates whether employees attribute different motives to their organization's corporate social responsibility efforts and if these motives influence employee performance. Specifically, we investigate whether employees could distinguish between intrinsic and extrinsic CSR motives by surveying 229 employee–supervisor dyads from various industries , and the impact of these perceptions on in-role and extra-role performance of subordinates. We found that employee task performance increases when employees attribute both intrinsic and extrinsic motives for CSR. Moreover, when employees perceive that their organization (...) invests in a CSR practice that is both intrinsic and extrinsic, they also tend to exert extra effort in their work. This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

Humans accumulate porphyrins in the body mostly during the course of porphyrias, diseases caused by defects in the enzymes of the heme biosynthesis pathway and that produce acute attacks, skin lesions and liver cancer. In contrast, some wild mammals and birds are adapted to accumulate porphyrins without injurious consequences. Here we propose viewing such physiological adaptations as potential solutions to human porphyrias, and suggest certain wild animals as models. Given the enzymatic activity and/or the patterns of porphyrin excretion and accumulation, (...) the fox squirrel, the great bustard and the Eurasian eagle owl may constitute overlooked models for different porphyrias. The Harderian gland of rodents, where large amounts of porphyrins are synthesized, presents an underexplored potential for understanding the carcinogenic/toxic effect of porphyrin accumulation. Investigating how these animals avoid porphyrin pathogenicity may complement the use of laboratory models for porphyrias and provide new insights into the treatment of these disorders. (shrink)

This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. The notion of “integrity” is currently quite common and broadly recognized as complex, mostly due to its recurring and diverse application in various distinct domains such as the physical, psychic or moral, the personal or professional, that of the human being or of the totality of beings. Nevertheless, its adjectivation imprints a specific meaning, as happens in the case of “scientific integrity”. This concept has been defined mostly by via negativa, by pointing out what goes against integrity, that is, through (...) the identification of its infringements, which has also not facilitated the elaboration of an overarching and consensual code of scientific integrity. In this context, it is deemed necessary to clarify the notion of “integrity”, first etymologically, recovering the original meaning of the term, and then in a specifically conceptual way, through the identification of the various meanings with which the term can be legitimately used, particularly in the domain of scientific research and innovation. These two steps are fundamental and indispensable for a forthcoming attempt at systematizing the requirements of “scientific integrity”. (shrink)

The article deals with „The Symbolic Force of Human Rights“. Firstly, it restricts the meaning of the term „symbolic“ and of the expression „symbolic force“. Secondly, it discusses two matters: (1) a semantic matter, concerning the meaning of human rights; and (2) a pragmatic matter, related to utterance of human rights’ holders. The article emphasizes that it is not about „eternal“ rights, but rather a legal-political construction and conquest of modernity. Based on such assumptions, the author goes to the core (...) of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for the generalized affirmation and accomplishment of rights related to legal inclusion in conditions of structural dissension; on the other hand, it acts as a manner of political manipulation, whether to conceal circumstances involving lack of rights or, more abruptly, to give cause to political oppression. In this regard, the article focuses, firstly, on the symbolic force of human rights at the level of National States, and then within the international and worldwide context. Finally, the author states a brief critique concerning the rhetorical use of human rights by the nowadays’ unique superpower, the United States of America. (shrink)

This article sets out to move from questioning the autonomy of law from the external standpoint of sociology to problematizing it from the internal legal standpoint. The first step is an analysis of the Kelsenian theoretical model of the hierarchically structured self-production of law, taking into consideration the concept of reason for the validity of a norm and of a legal order, as well as the role of efficacy as a condition for validity. The second is a presentation of Luhmann’s (...) conception of autopoiesis of the legal system, and in particular the function of the Constitution in the operative closure of law. Based on this exposition, the discussion then focuses on the limits of both conceptions, but in reverse order: first questioning the possibility of transporting the concept of autopoiesis to the different conditions for reproduction of law in contemporary world society, and then raising objections to the adequacy of the concept of hierarchically structured self-production of law to the many different legal orders in today’s world. The conclusion drawn from these critical observations is the argument that the Luhmannian sociological theory of the operative self-reference of the legal system and the Kelsenian legal theory of the self-produced step-structure of law are applicable only to legal systems minimally grounded in the rule of law.
