This essay explores the two main objectives of Bishop’s book, which he analyzes in the context of the care for the dying: the medical metaphysics underlying medical science and biopolitics as governance of the human body. This essay discusses Bishop’s claims in view of newer developments in medicine, especially the turn to the construction of life, and confronts the concept of the patient’s sovereignty with an alternative model of vulnerable agency. In order to overcome the impasses of contemporary bioethics, the (...) essay argues that practical reason requires a two-fold ethics: first, it must develop a new hermeneutics of illness and disease, and second, in order to protect the individuals in the process of dying, moral claims concerning death must be based on the concept of human rights. In The Future of Human Nature, Jürgen Habermas raises the question of whether the embryonic genetic diagnosis and genetic modification threatens the foundations of the species ethics that underlies current understandings of morality. While morality, in the normative sense, is based on moral interactions enabling communicative action, justification, and reciprocal respect, the reification involved in the new technologies may preclude individuals to uphold a sense of the undisposability of human life and the inviolability of human beings that is necessary for (...) their own identity as well as for reciprocal relations. Engaging with liberal bioethics and Catholic approaches to bioethics, the article clarifies how Habermas’ position offers a radical critique of liberal autonomy while maintaining its postmetaphysical stance. The essay argues that Habermas’ approach may guide the question of rights of future generations regarding germline gene editing. But it calls for a different turn in the conversation between philosophy and theology, namely one that emphasizes the necessary attention to rights violations and injustices as a common, postmetaphysical starting point for critical theory and critical theology alike. In 2001, Jürgen Habermas published a short book on questions of biomedicine that took many by surprise.[1] To some of his students, the turn to a substantive position invoking the need to comment on a species ethics rather than outlining a public moral framework was seen as the departure from the “path of deontological virtue,”[2] and at the same time a departure from postmetaphysical reason. Habermas’ motivation to address the developments in biomedicine had certainly been sparked by the intense debate in Germany, the European Union, and internationally on human cloning, pre-implantation genetic diagnosis, embryonic stem cell research, and human enhancement. He turned to a strand of critical theory that had been pushed to the background by the younger Frankfurt School in favor of cultural theory and social critique, even though it had been an important element of its initial working programs. The relationship of instrumental reason and critical theory, examined, among others, by Max Horkheimer, Theodor W. Adorno, and Herbert Marcuse and taken up in Habermas’ own Knowledge and Interest and Theory of Communicative Action became ever-more actual with the development of the life sciences, human genome analysis, and genetic engineering of human offspring. Today, some of the fictional scenarios discussed at the end of the last century as “science fiction” have become reality: in 2018, the first “germline gene-edited” children were born in China.[3] Furthermore, the UK’s permission to create so-called “three-parent” children may create a legal and political pathway to hereditary germline interventions summarized under the name of “gene editing.”In this article, I want to explore Habermas’ “substantial” argument in the hope that philosophy and theology become allies in their struggle against an ever-more reifying lifeworld, which may create a “moral void” that would, at least from today’s perspective, be “unbearable”, and for upholding the conditions of human dignity, freedom, and justice. Taking Catholic sexual ethics and liberal feminist ethics as points of departure, this essay argues that both frameworks are ill-prepared to deal with the moral problems raised by sex trafficking: while Catholic sexual ethics is grounded in a normative understanding of sexuality, liberal feminist ethics argues for women's sexual autonomy, resting upon freedom of action and consent. From a perspective that attends both to the phenomenological interpretation of embodied selves and the Kantian normative interpretation of dignity, it becomes possible to (...) critique both the Catholic and the liberal feminist frameworks of ethics. I argue that Catholic sexual ethics requires a reconceptualization as social ethics in order to meet the challenges of our present time, but that the shift is possible without giving up the moral imperatives of both Catholic and feminist ethics to protect human dignity and women's rights. In the wake of the recent global refugee and migration crisis, Hannah Arendt’s defense of the right to have political rights has become prominent again. Her work is read as an early reminder that the internationally promoted human rights regime may be merely a rhetorical reference, without the will or international authority for political action. I examine Arendt’s analysis in its historical context and then turn to consider Ricœur’s understanding of human rights. The capability to respond to and to be (...) held accountable by others marks Ricœur’s ethics of responsibility. He agrees with Arendt that legal authority must rest upon power and not domination, but he insists that the undercurrent of common power is the moral capability of an agent. The essay examines the ramifications of Ricœur’s ethics for the current crisis of refugees and migration, and it argues that he offers, at the same time, a correction useful for the ethical foundation of human rights. Vulnerability as a critique of the one-sidedness of the principle of autonomy is at risk of overemphasizing the positive dimension of vulnerability. Moreover, in the discourse on vulnerability, the threat of dehumanization (or moral vulnerability) has not been scrutinized enough ethically. Therefore, the ethics of vulnerability is insufficient when faced with the force of war that requires the conceptualization of vulnerability for political-ethics. The Russian war in Ukraine demonstrates this weakness in a striking way: the called-for openness to the other (...) as well as an active form of nonviolence, as promoted by Judith Butler, may not be an option in times of war. Continuing Jessica Benjamin’s psychoanalytic approach to mutual recognition, the essay shows that the task of morality does not rest upon broadening one’s vulnerability, but rather in understanding vulnerable agency as the dialectic of vulnerability and agency. For the further development of this dialectic, the triadic figuration is emphasized, complementing the dyadic relation of self and other. While the Third can take multiple figurations in the psychoanalytical setting, I understand the Third within the political-ethical context as the possibility of a “moral world” of nonviolence and respect. During war, the role of the bystander is to become a witness who, through the process of witnessing, advocacy, diplomacy, and justice, allows for the moral Third to reemerge. Among others, the ethics of vulnerability must spells out the price for the failure of taking on this responsibility, namely the eclipse of morality. (shrink)

Biomedical technologies capable of sharply reducing or ending human aging, “radical life extension”, call for a Christian response. The authors featured in this article offer some preliminary thoughts. Common themes include: What kind of life counts as a “good life;” the limits, if any, of human freedom; the consequences of extended life on the human species and on the Earth; the meaning and value of finite and vulnerable embodied life; the experience of time; anthropological self-understanding; and human dignity. Reproductive autonomy is often used as an argument to offer assisted reproduction services to women and to continue research into improving this service. What is often overlooked, however, is the gendered and normative background of parenthood, especially of motherhood. In this paper, I attempt to make women visible and to listen to their voices. Turning to the women’s stories, the ethical perspective might be reversed: the so-called 'side-effects' of the overall successful assisted reproduction with or without genetic diagnosis, are to (...) be considered the 'main effects' of assisted reproduction – true for the majority of couples and women. Autonomy, then, must be reformulated as concept of moral agency in the context of divergent social contexts and cultures of parenthood, of socially shaped images of disability, and in the context of scientific visions of technology which do not necessarily match with the medical practice. Under a ‘dirty hands’ model of undercover policing, it inevitably involves situations where whatever the state agent does is morally problematic. Christopher Nathan argues against this model. Nathan’s criticism of the model is predicated on the contention that it entails the view, which he considers objectionable, that morally wrongful acts are central to undercover policing. We address this criticism, and some other aspects of Nathan’s discussion of the ‘dirty hands’ model, specifically in relation to state entrapment to commit a crime. (...) Using János Kis’s work on political morality, we explain three dilemmatic versions of the ‘dirty hands’ model. We show that, while two of these are inapplicable to state entrapment, the third has better prospects. We then pursue our main aim, which is to argue that, since the third model precludes Nathan’s criticism, a viable ‘dirty hands’ model of state entrapment remains an open possibility. Finally, we generalize this result, showing that the case of state entrapment is not special: the result holds good for policing practices more generally, including such routine practices as arrest, detention, and restraint. Objectives: To explore how subjects in a placebo-controlled vitamin A supplementation trial among Ghanaian women aged 15–45 years perceive the trial and whether they know that not all trial capsules are the same, and to identify factors associated with this knowledge.Methods: 60 semistructured interviews and 12 focus groups were conducted to explore subjects’ perceptions of the trial. Steps were taken to address areas of low comprehension, including retraining fieldworkers. 1971 trial subjects were randomly selected for a survey measuring their knowledge (...) that not all trial capsules are the same. The subjects’ fieldworkers were also interviewed about their characteristics and trial knowledge. Factors associated with knowledge were explored using multi-level modeling.Results: Although subjects knew they were taking part in research, most thought they were receiving an active and beneficial medication. Variables associated with knowledge were education and district of residence. Radio broadcasts benefited those with some schooling. Fieldworkers’ characteristics were not associated with subjects’ knowledge.Conclusions: Research and debate on new or improved consent procedures are urgently required, particularly for subjects with little education. There may be, we are told, a million million years before the sun grows weak and the earth becomes farther from the sun so that all life freezes. Long before this man may use up the metals available for his machines, and those ready sources of energy now so wastefully used, by which he at present multiplies and swarms in cities. In such case he will return through birth control or famine, or both, to a simple, uncrowded, pastoral existence. There is little likelihood of his being able to use atomic energy, other than that which reaches the earth as sun radiation and is available directly or as energy stored in water-power, wood, coal, and oil. I defend the relatively orthodox view that reasons for action are premises in good practical reasoning, against recent counterexamples that suggest that, like “government house” moral justifications, some reasons are to be ignored in deliberation. I also explain, positively, what is right about the orthodoxy. Unless reasons are premises in good practical reasoning, reasons cannot be normative in the way they are usually taken to be, and relatedly, are unfit to play certain familiar theoretical and related everyday roles that give (...) many appeals to reasons their distinctive point. Consider normative properties and facts, such as facts consisting in something's being what you ought to do, or the property of being morally wrong. Normative naturalism is the view that normative properties and facts such as these exist, and that they are natural properties and facts. Some suspect, however, that normativity is incompatible with a wholly naturalistic worldview: that the normative couldn't be natural because it's somehow “just too different” from the natural. I critically examine recent forms of this “just (...) too different” objection to normative naturalism, with a view to making the debate accessible to a general philosophical audience. (shrink)

We address the ethics of scenarios in which one party entraps, intentionally tempts or intentionally tests the virtue of another. We classify, in a new manner, three distinct types of acts that are of concern, namely acts of entrapment, of intentional temptation and of virtue testing. Our classification is, for each kind of scenario, of itself neutral concerning the question whether the agent acts permissibly. We explain why acts of entrapment are more ethically objectionable than like acts of intentional temptation (...) and why these, in turn, are more ethically objectionable than like acts of virtue testing. Along the way, we scrutinize, and eventually reject, the view that acts of entrapment are ethically unacceptable because intentional temptation is involved in entrapment. (shrink)

Constitutivists attempt to ground reasons for action in the constitutive features of agency. Central to Enoch's famous “shmagency” objection to constitutivism is the idea that constitutivists should worry about the question whether there is reason to be an agent rather than a “shmagent”-where a shmagent is a non-agent being who lacks the constitutive features of agency, but is otherwise as similar to agents as can be. I explain why constitutivism isn’t in trouble even if there’s no reason to be an (...) agent. The nature of agency can in principle ground authoritative reasons for agents to act, even if there isn’t, in addition, a reason to be an agent. Relatedly, I explain why a prominent strand in previous responses to Enoch is misleading in focusing on whether the request for reasons to be an agent, as posed by the shmagent, is even possible or intelligible. Even if the shmagent’s request for reasons is possible and intelligible-as I argue it is-this doesn’t matter for constitutivists, for the request is misguided: constitutivists need no reasons to be an agent. Though sometimes perceived as a secondary figure, there have been some attempts to recover him as one of, if not the (...) first "sociologist." 1 Much has been written about Ferguson's contribution to modern social science; 2 this article focuses upon his highly prescient work in the area of conflict theory. It is important to note at the outset, however, that Ferguson's inspiration for these apparently novel insights is classical. His early social theory is curious because it "straddles traditions"; 3 on the one hand he owes a profound debt to classical civic humanism, [End Page 281] but on the other his work quite authentically signposts the emergence of social science proper. This bridging of traditions in Ferguson is a key theme of this paper.Ferguson relies heavily upon conflict in his explanation of historical processes and in the securing of social order. Conflict generates many positive unintended consequences; it leads to the formation of the state, formal defense institutions, and large scale communities; and it plays a pivotal role in the development of the moral personality and contributes to the maintenance of stability and social cohesion. Conflict preserves the balance of powers in government and prevents the encroachment of despotism. In this regard, then, conflict cannot be regarded as wholly unnecessary, destructive, or undesirable but as integral to progress and the march towards civilization. 4Gladys Bryson has noted that Ferguson's exposition of conflict was original with him and "set him off from the conventional position of his century." 5 Even so the benefits of conflict and dissension had been canvassed long before by Tacitus and Machiavelli, both of whom influenced Ferguson's analysis. 6 In it he challenges the false dichotomy promulgated by contractarians of tranquil society on the one hand and violent, isolated chaos on the other; rather, he argues, we are social beings with belligerent tendencies. He also confronts the Aristotelian (and later Hobbesian) premise that the key purpose of society is stability and social harmony. Instead, Ferguson lays great stress on the positive benefits of competition and conflict in our social development and in the maintenance of community. Conflict is just as natural as repose and may even be equally desirable. In this Ferguson indicates his debt to Socrates' suggestion that "some circumstances in the lot of mankind" prompt us to be social, while others prompt us "to war and dissension." 7 As a highlander, Ferguson was well acquainted with the realities of conflict. Ancient moral philosophers, especially Aristotle and his followers, typically shared the assumption that ethics is primarily concerned with how to achieve the final end for human beings, a life of “happiness” or “human flourishing.” This final end was not a subjective condition, such as contentment or the satisfaction of our preferences, but a life that could be objectively determined to be appropriate to our nature as human beings. Character traits were treated as moral virtues because they contributed well toward this (...) ideal life, either as means to it or as constitutive aspects of it. Traits that tended to prevent a “happy” life were considered vices, even if they contributed to a life that was pleasant and what a person most wanted. The idea of “happiness” was central, then, in philosophical efforts to specify what we ought to do, what sort of persons we should try to become, and what sort of life a wise person would hope for. A powerful set of projections has constructed post-apartheid higher education in South Africa. Among these is the expectation that technikons would become universities of technology, with a mission to drive the technology of national reconstruction and development. In this paper, one of the new universities of technology serves as a case study to explore organizational structure and to highlight the ethics of university management and leadership. Building a new university provides the opportunity to place ethics “upfront”, rather than as an (...) afterthought, by constructing an organizational framework that makes ethical issues integral to management and decision-making processes. In imagining the structure of a university of technology, the authors were inspired by future scripting methods developed by Bastiaan De Laat, and by Duncan Den Boer, Arie Rip and Sandra Speller. The research process firstly involved the identification of themes related to values and ethics through an analysis of the environment. These themes were incorporated into three scenarios of possible futures for this new university type. Using these scenarios, the ethical issues that emerged, are compared with the original themes. Conclusions are then drawn with regard to management structures that are hierarchical and entrench compliance, or that are traditionally collegiate and expertise-based, or that might enable mutual appreciation and allow for leaders to emerge within any functional space at a university of technology. The most popular uniting theme in feminist peace literature grounds women's peace work in mothering. I argue if maternal arguments do not address the variety of relationships different races and classes of mothers have to institutional violence and/or the military, then the resulting peace politics can only draw incomplete conclusions about the relationships between maternal work/thinking and peace. To illustrate this I compare two models of mothering: Sara Ruddick's decription of "maternal practice" and Patricia Hill Collins's account of racial-ethnic women's (...) "motherwork.". (shrink)
