  1. Environmental Activism and the Fairness of Costs Argument for Uncivil Disobedience.Ten-Herng Lai & Chong-Ming Lim - 2023 - Journal of the American Philosophical Association 9 (3):490-509.
Social movements often impose nontrivial costs on others against their wills. Civil disobedience is no exception. How can social movements in general, and civil disobedience in particular, be justifiable despite this apparent wrong-making feature? We examine an intuitively plausible account—it is fair that everyone should bear the burdens of tackling injustice. We extend this fairness-based argument for civil disobedience to defend some acts of uncivil disobedience. Focusing on uncivil environmental activism—such as ecotage (sabotage with the aim of protecting the environment)—we (...)

  2. Political vandalism as counter‐speech: A defense of defacing and destroying tainted monuments.Ten-Herng Lai - 2020 - European Journal of Philosophy 28 (3):602-616.
Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses to let them (...)

  3. Justifying Uncivil Disobedience.Ten-Herng Lai - 2019 - Oxford Studies in Political Philosophy 5:90-114.
A prominent way of justifying civil disobedience is to postulate a pro tanto duty to obey the law and to argue that the considerations that ground this duty sometimes justify forms of civil disobedience. However, this view entails that certain kinds of uncivil disobedience are also justified. Thus, either a) civil disobedience is never justified or b) uncivil disobedience is sometimes justified. Since a) is implausible, we should accept b). I respond to the objection that this ignores the fact that (...)

  4. Objectionable Commemorations, Historical Value, and Repudiatory Honouring.Ten-Herng Lai - 2024 - Australasian Journal of Philosophy 102 (1):37-47.
Many have argued that certain statues or monuments are objectionable, and thus ought to be removed. Even if their arguments are compelling, a major obstacle is the apparent historical value of those commemorations. Preservation in some form seems to be the best way to respect the value of commemorations as connections to the past or opportunities to learn important historical lessons. Against this, I argue that we have exaggerated the historical value of objectionable commemorations. Sometimes commemorations connect to biased or (...)

  5. Civil disobedience, costly signals, and leveraging injustice.Ten-Herng Lai - 2020 - Ergo: An Open Access Journal of Philosophy 7:1083-1108.
Civil disobedience, despite its illegal nature, can sometimes be justified vis-à-vis the duty to obey the law, and, arguably, is thereby not liable to legal punishment. However, adhering to the demands of justice and refraining from punishing justified civil disobedience may lead to a highly problematic theoretical consequence: the debilitation of civil disobedience. This is because, according to the novel analysis I propose, civil disobedience primarily functions as a costly social signal. It is effective by being reliable, reliable by being (...)

The term, "objectionable commemorations”, refers to a broad category of public artefacts – such as, and especially, memorials, monuments and statues – that are regarded as morally problematic in virtue of what or whom they honour. In this regard, they are a special class of public artefacts that are subject to public contestation. In this paper, we survey the general ethical and political issues on this topic. First, we categorise the arguments on offer in the literature, concerning the objectionable nature (...)

  7. Rescuing Democracy on the Path to Meritocracy.Ten-Herng Lai - 2022 - Journal of Social and Political Philosophy 1 (1):75-78.
I think Tongdong Bai's Confucian Meritocracy requires a lot of idealisation. Feasibility aside, should we realise the conditions for Confucian Meritocracy to work, we would have created the ideal situation for democracy to function properly. This challenges the purported advantages Confucian Meritocracy enjoys over democracy.

Lachlan Umbers defends democracy against Jason’s Brennan’s competence objection, by showing that voting even incompetently does not violate the rights of others, as the risk imposed is negligible, and furthermore lower than other permissible actions, e.g. driving. I show there are costs in taking this line of argument. Accepting it would make arguing for the duty to vote more difficult in two ways: since voting incompetently is permissible, and not voting imposes less risk than not voting, then not voting is (...)

Delmas successfully guides us to reconsider the traditional “wisdom” of civil disobedience. She also makes a strong case for expanding the notion of political obligation, which has been narrowly construed as mere obedience, to encompass a duty to resist. Principled disobedience, either civil or uncivil, includes a wide range of tools to tackle different forms of injustice, such as education campaigns, peaceful protests, graffiti street art, whistleblowing, vigilante self-defense, and political riots. We may question to what extent the violent disobedience (...)

The materials collected in this volume all concern the translations of and receptions to Adam Smith's The Wealth of Nations in ten non-English-speaking countries. The Wealth of Nations provides the perfect basis for studying the international transmission of economic ideas as it is generally considered to be the foundation of modern political economy, and still continues to be read after more than two centuries. Its appeal crosses national, cultural, and ideological boundaries -- countries investigated here range from China to Sweden (...)

Does ‘remembering that p’ entail ‘knowing that p’? The widely-accepted epistemic theory of memory answers affirmatively. This paper purports to reveal the tension between ETM and the prevailing anti-luck epistemology. Central to my argument is the fact that we often ‘vaguely remember’ a fact, of which one plausible interpretation is that our true memory-based beliefs formed in this way could easily have been false. Drawing on prominent theories of misremembering in philosophy of psychology, I will construct cases where the subject (...)

Relearning and remembering are usually seen as two distinct cognitive processes in contemporary philosophy of memory. In particular, relearning is sometimes regarded as a kind of memory error. This paper aims to address two questions. First, is relearning a kind of memory error? Second, how to draw a distinction (if any) properly between relearning and remembering? My answer to the first question is a conditional ‘yes’—it depends on whether relearning can be falsidical and whether metacognitive monitoring counts as a part (...)

Drawing on the core values of western civilization, the author refines the counterparts in Chinese civilization, summarized as four core principles: duty before freedom, obedience before rights, community before individual, and harmony before conflict. Focusing on guoxue or Sinology as the basis of his approach, the author provides detailed explanations of traditional Chinese values. Recent scholars have addressed the concept of guoxue since the modern age, sorting through it and piecing it together, which has produced an extremely abundant range of (...)

It is proposed here that the Confucian li, norms of appropriate behavior, be understood as part of the dynamic process of moral self-cultivation. Within this framework li are multidimensional, as they have different functions at different stages in the cultivation process. This novel interpretation refocuses the issue regarding the flexibility of li, a topic that is still being debated by scholars. The significance of this proposal is not restricted to a new understanding of li. Key features of the various stages (...)

By organizing crowds of scientists to independently tackle the same research questions, we can collectively overcome the generalizability crisis. Strategies to draw inferences from a heterogeneous set of research approaches include aggregation, for instance, meta-analyzing the effect sizes obtained by different investigators, and parsing, attempting to identify theoretically meaningful moderators that explain the variability in results.

Drawing on empirical evidence from psychology and neuroscience, I refute mnemic reliabilism by demonstrating that: (1) patients with memory impairments (e.g., Alzheimer’s disease) can also successfully remember the past despite the unreliability of their corresponding memory processes; (2) some reliability-affecting factors (e.g., stress, divided attention, and insufficient encoding time) can render the memory processes of healthy individuals unreliable without preventing them from (...)

Confucius maintains the proper application and coherence of such virtues as benevolence, wisdom, trustworthiness, straightforwardness, courage, and firmness. Further, Confucius takes benevolence and nobility as characteristic of human being. Particular attention is paid to the distinction and relationship between virtuous characters and virtuous actions.

The Zhuangzi is noted for its advocacy of many different perspectives—chickens, cicadas, fish and the like. There is much debate in the literature about the implications of Zhuangzi’s pluralist inclinations. I suggest that Zhuangzi highlights the limitations of individual, perspectivally-constrained, knowledge claims. He also spurns the ‘view from nowhere’ and is sceptical about the possibility of an ideal observer. For him, wisdom consists in understanding the epistemological inadequacies of each perspective. I propose that Zhuangzi’s philosophy offers significant insights to an (...)

The core thesis of anti-luck epistemology is the incompatibility thesis, that is, knowledge is incompatible with veritic epistemic luck. Traditionally, anti-luck epistemologists hold that there are two distinct types of veritic epistemic luck, viz, intervening luck and environmental luck. The former occurs when something luckily intervenes between the subject’s belief and the target fact, which renders the subject’s belief luckily true. The latter can be found in cases where the subject’s belief is luckily true when she is in an unfriendly (...)

This paper is a preliminary study of Bhāviveka’s Svātantrika-Mādhyamika justifications for taking non-existent things as the subject of an inference, based on his Dacheng Zhangzhen Lun. Bhāviveka’s treatment of inference is similar to that of Dignāga in that the subject is required to be existent. Bhāviveka also holds that, in a conventional sense, words refer to universals and to the existent entities that possess them, while the two are cognised together. However, in his inference for the unreality of unconditioned things, (...)
