La investigación pretende implementar una propuesta de intervención psicológica que fortalezca las estrategias de afrontamiento y habilidades sociales de las personas privadas de la libertad [PPL], internas en el complejo penitenciario y carcelario de Jamundí, que aporte al proceso de resocialización y prevención de conductas disruptivas y suicidas en el marco del programa institucional INPEC “Preservación de la vida”. La metodología cuenta con un enfoque mixto, diseño explicativo secuencial, alcance explicativo – exploratorio de corte transversal. La muestra: conformada por 80 (...) In this paper we consider the relation between beliefs and goals in agent theory. Beliefs play three roles in reasoning about goals: they play a role in the generation of unconditional desires from conditional ones, they play a role in adoption of desires as goals, and they play a role in the selection of plans to achieve goals. In this paper we consider the role of goals in reasoning about beliefs. Though we assume that goals do not play a role (...) in the belief generation problem, we argue that they play a role in the belief selection problem. We show the rationality of the use of goals in belief selection, in the sense that there are cases in which agents that take their goals into account in selecting a belief set from a set of alternatives outperform agents that do not do so. We also formally distinguish between the rational role of goals in belief selection and irrational wishful thinking. (shrink)

This paper aims to investigate the current state of play on Environmental Social and Governance (ESG) integration and check the validity of the current metrics system by assessing if it will survive the COVID-19 crisis. By adopting a qualitative research approach through semi-structured anonymous interviews with 14 senior managers of six European listed companies we use a framework by assessing the mechanisms of reactivity on the effectiveness of ESG measures in times of COVID-19. By interpreting the practitioners’ points of view (...) through the lens of the sociological framework by Espeland and Sauder (Am J Sociol 113:1–40, 2007) our findings show different mechanisms of reactivity by companies on the effectiveness of ESG measures in times of COVID-19, i.e., active and passive conformity and active resistance. We also identified the main Corporate Social Responsibility (CSR) institutional factors that affect managers’ reactivity. An extensive re-formulation of the ESG metrics is required in the light of times of crisis, given that accountability and transparency are strongly linked to quantitative measures which can play a critical role in the financial system and investors’ engagement. Particularly, the strict distinction between “E”, “S” and “G” issues should be abandoned claiming a different holistic re-design of sustainability measures by considering the increasing relevance of the Social dimension in time of COVID-19. This study provides a valuable contribution to the existing literature on the measurement of sustainability within the link of accountability and crisis by highlighting new corporate needs to re-design the ESG metrics system. This paper argues that debates regarding legal protections to preserve the privacy of data subjects, such as those involving the European Union’s right to be forgotten, have tended to overlook group-level forms of epistemic asymmetry and their impact on members of historically oppressed groups. In response, I develop what I consider an abolitionist approach to issues of digital justice. I begin by exploring international debates regarding digital privacy and the right to be forgotten. Then, I turn to the long history (...) of informational asymmetries impacting racialized populations in the United States. Such asymmetries, I argue, comprise epistemic injustices that are also implicated within the patterns of racialized incarceration in the United States. The final section brings together questions regarding the impact of such epistemic injustices on incarcerated peoples and focuses specifically on the public availability of criminal histories in online search databases as a fundamental issue within conversations regarding digital justice. I thus conclude by building from the work of contemporary abolitionist writers to argue that the underlying concerns of an individualized right to be forgotten should be transformed into a collective effort to undermine societal carceral imaginaries. En diciembre de 2011, Samba Martine, interna del Centro de Internamiento para Extranjeros de Aluche, muere de una infección evitable por no haber sido diagnosticada y tratada de manera adecuada, a pesar de haber solicitado insistentemente asistencia sanitaria. La madre de Samba, con el apoyo de varias entidades sociales, denuncia los hechos y llega a los tribunales. Ocho años más tarde, en junio de 2019, se anuncia la absolución por homicidio imprudente del único responsable procesado. Nueve años más tarde, en (...) octubre de 2020, el Ministerio de la Presidencia, Relaciones con las Cortes y Memoria Democrática emite una Resolución por la que se atiende la reclamación de responsabilidad patrimonial por el fallecimiento de Samba Martine. Tomando como punto de partida este caso, este trabajo tiene como objetivo analizar los factores que hacen de él un ejemplo de injusticia epistémica en tres niveles interrelacionados: micro, meso y macro. La relevancia de esta propuesta radica en mostrar cómo la dejación de funciones por parte de la Administración y sus instituciones contribuye a generar una ignorancia, que, combinada con la falta de credibilidad del testimonio de la víctima, tiene como resultado final su muerte. Lejos de ser un caso anecdótico, situaciones de injusticia epistémica como esta forman parte de la cotidianeidad de numerosas personas migrantes indocumentadas, que después de periplos de sufrimiento terminan internadas en limbos legales como los CIE. La circolazione dell’Arte della guerra di Machiavelli ha dato un fondamentale contributo allo sviluppo della cultura militare europea in volgare del Cinquecento. Questo saggio analizza alcuni specifici aspetti della ricezione di quest’opera nella produzione scrittoria militare del tempo e in particolare si concentra su quegli elementi di pensiero legati al tema delle “armi proprie” fortemente propagandato dal libro machiavelliano. A questo proposito, si è qui deliberatamente scelto di offrire l’esempio di due opere diverse per natura ideologica e altezza cronologica: l’una (...) risalente alla prima metà del Cinquecento, l’altra originatasi nell’ambito delle guerre di religione e della diaspora dei protestanti francesi in area elvetica. Si tratta, in effetti, di due libri che permettono di comprendere sfumature poco note del processo di riuso di certi concetti machiavelliani che all’epoca potevano essere considerati politicamente controversi. Al tempo stesso, le due opere sono capaci di far risaltare le difficoltà che emergono ogni volta che si prova ad applicare il moderno concetto di autore a testi nati in un contesto caratterizzato da un continuo riutilizzo e dalla rielaborazione di temi ed elementi ascrivibili a una lunga e articolata tradizione di scrittura militare che si sviluppò lungo il corso del secolo, la quale, tuttavia, aveva trovato un momento di passaggio cruciale nel contributo di Machiavelli. La circulación de El arte de la guerra de Maquiavelo ha supuesto una contribución fundamental al desarrollo en lengua vernácula de la cultura militar europea del siglo xv. Este artículo analiza algunos aspectos específicos de la recepción de esta obra en la producción escrita militar de su tiempo, concentrándose en particular en aquellos elementos vinculados con la cuestión de las “armas propias” que tan ampliamente propagó este libro de Maquiavelo. Con este propósito, se ha escogido deliberadamente el ejemplo de dos (...) obras diversas tanto en naturaleza ideológica como en su altura cronológica: la primera data de la primera mitad del siglo xv, la otra se originó en el contexto de las guerras de religión y de la diáspora de los protestantes franceses hacia suelo helvético. Se trata, en efecto, de dos libros que permiten comprender matices poco conocidos del proceso de reutilización de ciertos conceptos maquiavelianos que en su momento podrían ser considerados políticamente controvertidos. Al mismo tiempo, ambas obras son capaces de señalar o enfatizar la dificultad que emerge cada vez que se trata de aplicar el concepto moderno de autor a textos nacidos en un contexto caracterizado por un continuo reciclaje y reelaboración de temas y elementos adscribibles a una larga y articulada tradición de escritura militar desarrollada a lo largo del siglo, y que, sin embargo, había vivido un proceso crucial de transición con la contribución de Maquiavelo. En el contexto político global contemporáneo, las diversas luchas sociales se están alienando entre sí hasta elpunto de que la ilusión del capitalismo como único sistema socioeconómico posible está difuminando todos los horizontesdel cambio social. En este artículo, trataremos de redefinir las causas comunes de las luchas sociales, demostrando su interseccionalidad e interdependencia. Para ello, nos ocuparemos de una serie de conceptos de la filosofía de Marx. En la introducción, examinaremos la noción de valor, afirmando que la teoría del valor (...) de Marx no es simplemente una teoría laboral del valor, sino que más bien refleja la estructura paralela de la producción y la circulación, cristalizada en la forma de valor última del dinero. Una vez obtenidas estas ideas preliminares, volveremos al fenómeno del trabajo en el capitalismo, para reinterpretar, en la primera sección del artículo, la distinción marxiana entre trabajo productivo e improductivo. A partir de ahí, se darán los primeros ejemplos concretos de la interseccionalidad de las luchas sociales contra la abstracción del capital: a saber, mostrar que las luchas de género y las raciales tienen ciertas causas comunes, enraizadas en la hegemonía gramsciana. En la segunda sección, examinaremos la distinción que Marx establece entre la subsunción formal y la real. Esta última, afirmaremos, es decisiva para entender cómo el capital estructura la cuasi-totalidad de nuestras relaciones sociales. Tras una interpretación de la película Toni Erdmann de Maren Ade, propondremos algunos medios posibles de lucha interseccional contra la subsunción real, que encontrarán su respaldo teórico en el concepto de universales subversivos. Las observaciones finales abordarán la lógica nuclear de la distribución y la acumulación del capital, un síntoma que pervive a lo largo de la historia preservado e impulsado por la omnipresencia de la ideología, y subrayarán de nuevo implícitamente la importancia de la lucha común en el descongelamiento de la emergencia de un nuevo sujeto revolucionario. There is an inextricable link between cultural and clinical safety. In Australia high‐profile Aboriginal deaths in custody, publicised institutional racism in health services and the international Black Lives Matter movement have cemented momentum to ensure culturally safe care. However, racism within health professionals and health professional students remains a barrier to increasing the number of Aboriginal and Torres Strait Islander Health professionals. The Australian Health Practitioner Regulation Agency's Aboriginal and Torres Strait Islander Health Strategy's objective to ‘eliminate racism from the (...) health system’, and the recent adoption of the Aboriginal and Torres Strait Islander peoples led cultural safety definition, has instigated systems level reflections on decolonising practice. This article explores cultural safety as the conceptual antithesis to racism, examining its origins, and contemporary evolution led by Aboriginal and Torres Strait Islander peoples in Australia, including its development in curriculum innovation. The application of cultural safety is explored using in‐depth reflection, and the crucial development of integrating critical consciousness theory, as a precursor to culturally safe practice, is discussed. Novel approaches to university curriculum development are needed to facilitate culturally safe and decolonised learning and working environments, including the key considerations of non‐Indigenous allyship and collaborative curriculum innovations and initiatives. Reseña sobre el libro La técnica del capital. Ensayos sobre Bolívar Echeverría y Karl Marx, de Andrea Torres Gaxiola.

Background Gerontechnologies are increasingly used in the care for older people. Many studies on their acceptability and ethical implications are conducted, but mainly from the perspective of principlism. This narrows our ethical gaze on the implications the use of these technologies have. Research question How do participants speak about the impact that gerontechnologies have on the different phases of care, and care as a process? What are the moral implications from an ethic of care perspective? Research design Secondary analysis of (...) semi-structure interviews, whose segments on specific technologies were analysed through reflexive thematic analysis. Participants and research context Sixty-seven Swiss stakeholders involved in the use of gerontechnologies, including professional caregivers, informal caregivers, and older persons themselves. Ethical considerations The research study was evaluated by the Ethics Commission of Northwest and Central Switzerland (EKNZ). All participants received an information document before the interview date detailing the purpose, procedure, and anonymization measures. After explaining the study during the agreed upon interview time and upon receiving their written informed consent, the interview process began. Findings/results Four themes are identified: Identifying care needs, Taking responsibility, Hands-on work, Responding to care. As part of these themes, many codes highlighting the ambivalent impact of gerontechnologies are created, ranging from ‘Expanded capacity for…identifying care needs’ to ‘Create new & (un)necessary…hands-on work’. The moral implications of these results from the care ethics perspective are discussed, through the ethical elements of: attentiveness, responsibility, competence, and responsiveness. Conclusions The moral implications of gerontechnologies on care phases from the care ethics perspective open up several questions on whether they actually help give care a central role in social life and provide more competent care. With the advent of the cloud computing model allowing a shared access to massive computing facilities, a surging demand emerges for the protection of the intellectual property tied to the programs executed on these uncontrolled systems. If novel paradigm as confidential computing aims at protecting the data manipulated during the execution, obfuscating techniques (in particular at the source code level) remain a popular solution to conceal the purpose of a program or its logic without altering its functionality, thus preventing reverse-engineering (...) on the program even with the help of computing resources. The many advantages of code obfuscation, together with its low cost, makes it a popular technique. This paper proposes a novel methodology for source code obfuscation that can be used together with other traditional obfuscation techniques, making the code more robust against reverse engineering attacks. Three program complexity metrics are used to define three different single-objective combinatorial optimization versions of the problem, which are solved and analysed. Additionally, three multi-objective problems are defined, those considering each of the selected metrics together with the program execution time, in order to avoid strong obfuscations penalizing the performance. The goal of the defined problems is to find sequences of LLVM optimizations that lead to highly obfuscated versions of the original code. These transformations are applied to the back-end pseudo-assembly code (i.e., LLVM Intermediate Representation), thus avoiding any further optimizations by the compiler. Classical genetic algorithms (GAs) are used to solve the studied problems, namely a basic cellular GA for the single-objective problems and the popular NSGA-II for the multi-objective ones. Perception is said to have assertoric force: It inclines the perceiver to believe its content. In contrast, perceptual imagination is commonly taken to be non-assertoric: Imagining winning a piano contest does not incline the imaginer to believe they actually won. However, abundant evidence from clinical and experimental psychology shows that imagination influences attitudes and behavior in ways similar to perceptual experiences. To account for these phenomena, I propose that perceptual imaginings have implicit assertoric force and put forth a theory—the Prima (...) Facie View—as a unified explanation for the empirical findings reviewed. According to this view, mental images are treated as percepts in operations involving associative memory. Finally, I address alternative explanations that could account for the reviewed empirical evidence—such as a Spinozian model of belief formation or Gendler’s notion of alief—as well as potential objections to the Prima Facie View. The main purpose of this article is to consider two of the most popular arguments offered in support of the view that emotions do not cause actions. One argument suggests that emotions come after actions and therefore cannot cause them. The other argument suggests that emotions are not necessarily followed by actions and therefore cannot cause them. I argue that neither of these two arguments is compelling. At the same time, some of the concerns of causation skeptics can help us (...) better understand what a theory of the causal connection between emotions and actions should explain. (shrink)

The subject of musical emotions has emerged only recently as a major area of research. While much work in this area offers fascinating insights to musicological research, assumptions about the nature of emotional experience seem to remain committed to appraisal, representations, and a rule-based or information-processing model of cognition. Over the past three decades alternative ‘embodied’ and ‘enactive’ models of mind have challenged this approach by emphasising the self-organising aspects of cognition, often describing it as an ongoing process of dynamic (...) interactivity between an organism and its environment. More recently, this perspective has been applied to the study of emotion in general, opening up interesting new possibilities for theory and research. This new approach, however, has received rather limited attention in musical contexts. With this in mind, we critically review the history of music and emotion studies, arguing that many existing theories offer only limited views of what musical-emotional experience entails. We then attempt to provide preliminary grounding for an alternative perspective on music and emotion based on the enactive/dynamic systems approach to the study of mind. (shrink)

Logical form has always been a prime concern for philosophers belonging to the analytic tradition. For at least one century, the study of logical form has been widely adopted as a method of investigation, relying on its capacity to reveal the structure of thoughts or the constitution of facts. This book focuses on the very idea of logical form, which is directly relevant to any principled reflection on that method. Its central thesis is that there is no such thing as (...) a correct answer to the question of what is logical form: two significantly different notions of logical form are needed to fulfil two major theoretical roles that pertain respectively to logic and to semantics. This thesis has a negative and a positive side. The negative side is that a deeply rooted presumption about logical form turns out to be overly optimistic: there is no unique notion of logical form that can play both roles. The positive side is that the distinction between two notions of logical form, once properly spelled out, sheds light on some fundamental issues concerning the relation between logic and language. Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

Clarifying the nature of possibility is crucial for an evaluation of the phenomenological approach to ontology. From a phenomenological perspective, it is ontological possibility, and not spatiotemporal existence, that has pre-eminent ontological status. Since the sphere of phenomenological being and the sphere of experienceability turn out to be overlapping, this makes room for two perspectives. We can confer foundational priority to the acts of consciousness over possibilities, or to pre-set possibilities over the activity of consciousness. Husserl’s position on this issue (...) seems to change over time. Ultimately, the establishment of a phenomenological perspective must involve a rejection of any hypostatization of pre-set possibilities, but not all implications of this theoretical step seem to be drawn in Husserl’s texts. This paper is devoted to an illustration of how the phenomenological notion of possibility should change when we reject the hypostatization of possibility, that is, when we reject the idea that all acts of consciousness are to be conceived as realizations of pre-set “ideal forms”. We examine this question, first, by trying to clarify the conceptual constellation of “possibility” in Husserl’s texts. This leads to an overall classification of the features of constituted possibilities. Then we distinguish such constituted possibilities from their constituting conditions, which outlines a different sense of “possibility”. In the last instance two “possibilizing” dimensions are shown to lie at the root of all ontic possibilities. This leads to a final suggestion on the nature of the relation between experience and possibility. Actual experiences create the room for possibility: they are possibilizations. In this sense, experience is to be taken as a generative sphere which goes beyond the customary boundary between epistemic and ontological. Its aim is to show that, although there is something plausible in Aristotle’s thesis and Boethius’ thesis, the intuitions that may be invoked to motivate them are consistent with any account of indicative conditionals that validates a suitably restricted version of them. In particular, these intuitions are consistent with the view that indicative conditionals are adequately formalized as strict conditionals.

The possibility of extraterrestrial intelligence (ETI) exists despite no observed evidence, and the risks and benefits of actively searching for ETI (Active SETI) have been debated. Active SETI has been criticized for potentially exposing humanity to existential risk, and a recent game-theoretical model highlights the Hobbesian trap that could occur following contact if mutual distrust leads to mutual destruction. We argue that observing a nearby ETI would suggest the existence of many unobserved ETI. This would expand the game and implies (...) that there may be a mechanism that prevents ETI from attacking us. As a result, the Hobbesian trap would be avoided if both parties assumed the other is not likely to attack. (shrink)

In order to accommodate for the present shortage of oocyte donors, oocyte-donation programs place ads in college newspapers and provide large monetary compensation to encourage participation. Large compensation acts as a strong incentive for young women to undergo the potentially risky procedure of donation. In this enticing situation, it is particularly important for programs to fully inform prospective donors of the risks of the procedure so that they can accurately weigh the costs and benefits of donating. However, because oocyte-donor programs (...) must alleviate the shortage of donors if they wish to maintain a financially viable business, there is reason to fear that they may minimize or misrepresent risks when recruiting egg donors. In this pilot study, the risk information provided by programs (n=19) to prospective oocyte donors in a preliminary phone call inquiry was investigated. The majority of the programs provided incomplete and/or inaccurate risk information. Policy changes are recommended to reduce the potential for undue influence and to standardize and regulate the risk information provided to prospective egg donors. (shrink)

According to a widespread view, a complete explanatory reduction of all aspects of the human mind to the electro-chemical functioning of the brain is at hand and will certainly produce vast and positive cultural, political and social consequences. However, notwithstanding the astonishing advances generated by the neurosciences in recent years for our understanding of the mechanisms and functions of the brain, the application of these findings to the specific but crucial issue of human agency can be considered a “pre-paradigmatic science” (...) (in Thomas Kuhn’s sense). This implies that the situation is, at the same time, intellectually stimulating and methodologically confused. More specifically—because of the lack of a solid, unitary and coherent methodological framework as to how to connect neurophysiology and agency—it frequently happens that tentative approaches, bold but very preliminary claims and even clearly flawed interpretations of experimental data are taken for granted. In this article some examples of such conceptual confusions and intellectual hubris will be presented, which derive from the most recent literature at the intersection between neurosciences, on the one hand, and philosophy, politics and social sciences, on the other hand. It will also be argued that, in some of these cases, hasty and over-ambitious conclusions may produce negative social and political consequences. The general upshot will be that very much has still to be clarified as to what and how neurosciences can tell us about human agency and that, in the meantime, intellectual and methodological caution is to be recommended. This essay explores the connection between representation and explanation in the sciences. I suggest that scientific representation schemes be viewed as pragmatic tools for acquiring the sort of articulated awareness that is the hallmark of nontrivial knowledge. Crystal field theory in chemistry illustrates this perspective. Certain representations achieve the status of being paradigmatically explanatory, thereby shaping models of intelligibility. In turn, these explanatory preferences serve largely to define and differentiate disciplinary communities by implicitly endorsing particular epistemic aims and values. According to simulation or shared-substrates models of emotion recognition, our ability to recognize the emotions expressed by other individuals relies, at least in part, on processes that internally simulate the same emotional state in ourselves. The term “emotional expressions” is nearly synonymous, in many people's minds, with facial expressions of emotion. However, vocal prosody and whole-body cues also convey emotional information. What is the relationship between these various channels of emotional communication? We first briefly review simulation models of emotion recognition, (...) and then discuss neuroscientific evidence related to these models, including studies using facial expressions, whole-body cues, and vocal prosody. We conclude by discussing these data in the context of simulation and shared-substrates models of emotion recognition. (shrink)

A growing number of consumer technology companies are aiming to convince older people that humanoid robots make helpful tools to support aging-in-place. As hybrid devices, socially assistive robots (SARs) are situated between health monitoring tools, familiar digital assistants, security aids, and more advanced AI-powered devices. Consequently, they implicate older people’s privacy in complex ways. Such devices are marketed to perform functions common to smart speakers (e.g., Amazon Echo) and smart home platforms (e.g., Google Home), while other functions are more specific (...) to older people, including health and safety monitoring and serving as companions to mitigate loneliness. Privacy is a key value central to debates about the ethics of using SARs in aged care, yet there has been very little interchange between these debates and the robust theoretical discussion in the legal literature about the future of privacy and AI governance. Drawing on two qualitative studies of older people’s views on consumer SARs, the paper contributes novel findings about older people’s thinking on privacy and data governance at the intersection of their experiences with present day digital technologies and projections for future AI systems, and places their views in dialogue with debates about the future of privacy protection and AI governance. Several attempts have been made previously to provide a biological grounding for cognitive architectures by relating their components to the computations of specific brain circuits. Often, the architecture's action selection system is identified with the basal ganglia. However, this identification overlooks one of the most important features of the basal ganglia—the existence of a direct and an indirect pathway that compete against each other. This characteristic has important consequences in decision-making tasks, which are brought to light by Parkinson's disease as (...) well as genetic differences in dopamine receptors. This paper shows that a standard model of action selection in a cognitive architecture cannot replicate any of these findings, details an alternative solution that reconciles action selection in the architecture with the physiology of the basal ganglia, and extends the domain of application of cognitive architectures. In this article, I provide a historical and bibliographical exploration of the handwritten, dictated commentaries (dictata) of Johannes de Raey (1620/1622–1702) on the texts of René Descartes (1596–1650), shedding light on their structure, development, and on their relations with the academic commentaries of Johannes Clauberg (1622–1665) and Christoph Wittich (1625–1687). The study of these commentaries, which are extant as class notes, is important because they conveyed one of the first systematic teachings of Descartes’s ideas and constituted a vehicle for their (...) further dissemination across northern Europe. In a range of contexts, one comes across processes resembling inference, but where input propositions are not in general included among outputs, and the operation is not in any way reversible. Examples arise in contexts of conditional obligations, goals, ideals, preferences, actions, and beliefs. Our purpose is to develop a theory of such input/output operations. Four are singled out: simple-minded, basic (making intelligent use of disjunctive inputs), simple-minded reusable (in which outputs may be recycled as inputs), and basic reusable. They (...) are defined semantically and characterised by derivation rules, as well as in terms of relabeling procedures and modal operators. How many logics do logical pluralists adopt, or are allowed to adopt, or ought to adopt, in arguing for their view? These metatheoretical questions lurk behind much of the discussion on logical pluralism, and have a direct bearing on normative issues concerning the choice of a correct logic and the characterization of valid reasoning. Still, they commonly receive just swift answers – if any. Our aim is to tackle these questions head on, by clarifying the range of possibilities that logical (...) pluralists have at their disposal when it comes to the metatheory of their position, and by spelling out which routes are advisable. We explore ramifications of all relevant responses to our question: no logic, a single logic, more than one logic. In the end, we express skepticism that any proposed answer is viable. This threatens the coherence of current and future versions of logical pluralism. (shrink)

This paper takes the dichotomy between “exclusive” and “inclusive” positivism and applies it by analogy to natural-law theories. With John Finnis, and with Beyleved and Brownsword, we have examples of “exclusive natural-law theory,” on which approach the law is valid only if its content satisfies a normative monological moral theory. The discourse theories of Alexy and Habermas are seen instead as “inclusive natural-law theories,” in which the positive law is a constitutive moment in that it identifies moral rules and specifies (...) their meaning.
