The chapters in this volume deal with timely issues regarding democracy in theory and in practice in today's globalized world. Authored by leading political philosophers of our time, they appear here for the first time. The essays challenge and defend assumptions about the role of democracy as a viable political and legal institution in response to globalization, keeping in focus the role of rights at the normative foundations of democracy in a pluralistic world.

Since the publication of Ekins’ The Nature of Legislative Intent, significant attention has been paid to common attitude models of legislative intention, that is, models that require unanimity among its group members. A common interpretation of Ekins is that these common attitudes are to be preferred over aggregated attitudes. I argue that any feasible theory of legislative attitudes will require non-trivial aggregation (ie. not based on unanimity rules alone). Two arguments are put forward in this regard: first, that non-trivial aggregation (...) better explains uncooperative legislative behaviour and second, that mathematical problems with aggregation apply to common attitudes as well since they involve trivial aggregation. These arguments generalise to theories of common attitudes other than Ekins’. (shrink)

Copyright law is often premised on the identification of an author of a literary, dramatic, musical, or artistic work, and then giving this author exclusive rights for a limited period to control the commercial exploitation of his or her intellectual creation. However, the hegemonic modernist position of the romantic authorial text has been challenged by numerous scholars who have argued that the meaning of a text lies not in its origin but in its destination. Roland Barthes’ work, controversial at the (...) time of publication with its assault on modernity and the primacy of authorial control, has nonetheless laid the groundwork for an important body of scholarship on interpretive communities. Whether one adopts the position of neoconservative postmodernism or poststructural postmodernism, this article argues that a semiotic analysis of works of copyright as “signs”, “myths” and “polysemous texts” will nonetheless offer an important framework to understand the full reach of the transformative use doctrine in the United States today. In 'The Standard Picture and its Discontents', Mark Greenberg remarks that the typical way that legal theorists think about legal obligations does not sit well with the way the common law works. I argue that Alexander's and Sherwin’s Rule Model of precedent can deal with all the problems that Greenberg accuses the Standard Picture of having. Nonetheless, I further argue that combining the Standard Picture and the Rule Model ultimately leads to another problem: the inability of the Standard Picture – (...) Theories of aggregated legislative intent posit that the legislative intent of parliament is what a significant enough proportion of legislators intended (e.g., legislative intent is p if a majority intend that p). After all, many think the same way about democracy (‘votes reveal the will of the people’) and about courts (‘a court decision is based on judicial voting’). The existing literature on aggregated legislative intent, however, tends to make two undefended assumptions: (i) Informed Assumption: all legislators have policy intentions; (...) and (ii) Group Intent Assumption: the existence of an aggregated intent entails the existence of a group intent. Despite these assumptions being subject to great scrutiny, they largely remain undefended. This paper defends the Group Intent Assumption and shows that aggregated theories can survive with a weaker version of the Informed Assumption. (shrink)

Identity, Morality, and Threat offers a critical examination of the social psychological processes that generate outgroup devaluation and ingroup glorification as the source of conflict. Daniel Rothbart and Karyna Korostelina bring together essays analyzing the causal relationship between escalating violence and opposing images of the Self and Other.

This paper considers the connections between the Statehood/recognition debate in international law and social ontology. I aim to show that certain theories of social ontology, which I call Groupjective Internalism, can be used to defend Constitutive Theories of Statehood. Among philosophers whom I consider committed to Groupjective Internalism are major figures in the field: Searle, Gilbert and Tuomela. This is an interesting result as Constitutive Theories are generally looked upon with suspicion in international law.

Intentionalist theories of legal interpretation are often divided between objectivist and subjectivist variants. The former take an interpretation to be correct depending on what the reasonable/rational lawmaker intended or what the reasonable/rational audience thinks they intended. The latter take an interpretation to be correct where the interpretation is what the speaker actually intended. This paper argues that objectivism faces serious problems as it cannot deal with disagreement: Reasonable and rational people can often disagree as to what the interpretation of a (...) text should be. It also defends subjectivism against criticisms by objectivists. (shrink)

Prior literature on socially responsible investment has contended that excluding “sin stocks” from a portfolio will reduce performance and increase risk. Further, incorporating stocks of firms with positive social responsibility scores will improve performance and reduce risk. We simulate portfolios designed to mimic typical equity mutual funds’ holdings and investigate these propositions. We remove the potentially confounding influences of differences in manager skill, transaction costs and fees, and conduct a clean experiment on the effect of positive and negative portfolio screening. (...) We find no difference in the return or risk of screened and unscreened portfolios. We conclude that a typical socially responsible fund will neither gain nor lose from screening its portfolio. BackgroundPreprint usage is growing rapidly in the life sciences; however, questions remain on the relative quality of preprints when compared to published articles. An objective dimension of quality that is readily measurable is completeness of reporting, as transparency can improve the reader’s ability to independently interpret data and reproduce findings.MethodsIn this observational study, we initially compared independent samples of articles published in bioRxiv and in PubMed-indexed journals in 2016 using a quality of reporting questionnaire. After that, we performed paired comparisons (...) between preprints from bioRxiv to their own peer-reviewed versions in journals.ResultsPeer-reviewed articles had, on average, higher quality of reporting than preprints, although the difference was small, with absolute differences of 5.0% [95% CI 1.4, 8.6] and 4.7% [95% CI 2.4, 7.0] of reported items in the independent samples and paired sample comparison, respectively. There were larger differences favoring peer-reviewed articles in subjective ratings of how clearly titles and abstracts presented the main findings and how easy it was to locate relevant reporting information. Changes in reporting from preprints to peer-reviewed versions did not correlate with the impact factor of the publication venue or with the time lag from bioRxiv to journal publication.ConclusionsOur results suggest that, on average, publication in a peer-reviewed journal is associated with improvement in quality of reporting. They also show that quality of reporting in preprints in the life sciences is within a similar range as that of peer-reviewed articles, albeit slightly lower on average, supporting the idea that preprints should be considered valid scientific contributions. I argue that an account of national responsibility, as both collective and inheritable, that allows for making sense of holding nations responsible as an entity for past international injustices and to make reparations for these injustices is not at odds with the demands of global egalitarianism. A global distributive commitment does not deny this account of national responsibility; to the contrary, we can properly appreciate the scope of national responsibility only in light of what global justice truly demands. Thus while (...) I agree with David Miller that we can hold nations accountable for past international injustices, I do not agree with Miller that this is in tension with global egalitarianism. In Thinking from the Han, David Hall and Roger Ames compare Plato's - and Confucius's views of friendship in relation to the question of transcendence and arrive at the sad conclusion that Socrates and Confucius could not be friends. "Socratic irony would not allow the inequality Confucius requires as a means of self-betterment. Confucius would not permit he and Socrates to hold all things in common." Along the way, they articulate an understanding of Confucius’ view of friendship as "a (...) one-directional relationship in which one extends oneself by association with one who has attained a higher level of realization." Hall and Ames explain their omission of Aristotle on the grounds that Plato provides a better contrast with respect to the notion of transcendence. To contribute to a broader understanding of Confucius' view of friendship, I wish to compare Confucius' and Aristotle's view of friendship in relation to the question of equality in excellence and, through the comparison, to understand its impact on ethical development. The ascendency of science in modern times makes it commonplace to accept that science presents the only true and correct image of reality. This has led to naturalization attempts in various domains, from epistemology, metaphysics, to philosophy of mind, and ethics. Naturalistic ethics may mean different things depending on what we consider natural. David Copp equates it with the empirical – emphasizing the relevance of empirical evidence to justification – while admitting that what is empirical is itself problematic.David (...) Copp, Morality in a Natural World , p. 254. One might count as empirical that which can be observed by our physical senses, or more narrowly that which can be studied by the natural sciences. Modern scientific naturalism limits the natural to what can be successfully explained by science but a more liberal naturalism may define as natural whatever does not contradict the laws of nature without necessarily being accountable .. The paper is a critique of traditional and formal models of theological education that historically have developed in the West and are generally adopted by Asian theological schools in Asia. Globalisation and the emergence of Asian Diasporas presented new problems and opportunities for rethinking appropriate models of contextual training. Building on works by Robert Banks, Ian Stackhouse and David Kelsey, the paper will explore contextual models for the Chinese Christian Diasporas in Britain, and suggest some contributions for the renewal (...) of theological education in Asia. El tema del análisis corresponde al mundo del “actor”, concretamente, a una perspectiva: la asunción y vivencia de la profesión como una vocación. ¿Es cierto, como suele afirmarse, que esta profesión es vocacional? ¿Y es cierto, por tanto, que el teatro es el lugar privilegiado para llevarla a (...) cabo? Normalmente, estas son las respuestas que suelen darse. Sin embargo, tras nuestro análisis, veremos que la afirmación ni es tan fácil, ni tan cierta.The following article will attempt to explore and delve into the phenomenology of the natural attitude. The subject of the analysis corresponds to the world of the “actor”, more specifically to one perspective: the as- sumption and experience of this profession as a vocation. Is it true, as it is often claimed, that this profession is a vocational one? If so, is it true that the theater medium is the ideal place to conduct it? It is usually assumed that the answers to both questions are affirmative. However, after thorough analysis, we shall see that such affirmations aren’t quite as easy or as certain as they might seem. Buena parte del nervio metafísico radica en el esfuerzo, en ocasiones ímprobo, de remontarse al plano de lo quoad se (lo que es «en sí») sin dejarse eclipsar por la seductora inmediatez de lo quoad nos (lo que es «para nosotros», anclados en nuestra propia perspectiva), aun cuando, como en el caso del conocimiento, el objeto tematizado nos toque tan de cerca. De hecho, no se logra abordar satisfactoriamente la realidad del conocimiento en su taleidad, si se parte, en exclusiva, (...) de un primado indiscutible en la línea de lo receptivo, puesto que en tal caso sólo cabe entender el proprium del conocimiento como mero mecanismo «ordenador», entregado sin residuos a la tarea de interconectar y desmadejar una serie de impresiones o datos de conciencia que ya siempre aparecen en él en calidad de «huellas», presumiblemente procedentes desde un «afuera» nouménico que resulta ignoto por principio. Por esto mismo, desde el tomismo, el estudio del conocimiento humano no se puede realizar a espaldas de la íntegra y fundamental constitución metafísica de la persona humana, en cuanto acto de ser esencializado humanamente y singularizado por una materia signada, cuyo fundamento último descansa en la participación ontológica por la que Dios, Ser y Entender subsistente, da el ser a las creaturas. El presente artículo es una propuesta de unidad didáctica para bachillerato. Su objetivo es problematizar el conocimiento que el alumnado suele tener de este periodo histórico tan convulso e interesarles por su estudio a través de diferentes y novedosas fuentes de información (fanzines, música, etc.). Asimismo, el objetivo es plantear un relato inclusivo que huya de maniqueísmos utilizando un amplio elenco de recursos didácticos. La siguiente propuesta de unidad didáctica es una práctica de aula sugerente.

Resumen La experiencia del dolor suele caracterizarse por su temporalidad, localización, intensidad, por qué tan desagradable se experimenta y la manera particular en el que se siente. Estas últimas son las cualidades sensoriales del dolor. Discuto aquí la tesis representacionista según la cual las CSD se explican por un contenido mental que describe la naturaleza del daño corporal. Desarrollo dos argumentos en contra de la regularidad que tal tesis supone entre las CSD y la naturaleza de la lesión, y presento (...) evidencia a partir del "Cuestionario del dolor de McGill", un instrumento clínico para la comunicación del dolor. Concluyo que la lesión corporal y las cualidades sensoriales del dolor no covarían como supone esta forma de representacionismo.The experience of pain is usually characterized by its location, intensity, temporality, unpleasantness, and sensory qualities. Here I focus on the thesis according to which pain sensory qualities are identical with mental representations of bodily damage. I develop two arguments against this, one based on cases of pain absence and another based on pain variability. In the absence argument, I discuss clinical evidence on episodic analgesia, where individuals experience a painless period of time after being injured. In the variability argument, I discuss the "McGill Pain Questionnaire", evidence in clinical settings which shows how variable the relation between pain and the nature of the injury actually is. I conclude that pain sensory qualities and physical damage do not covary, as the strong representationalism supposes. (shrink)

La posmodernidad se caracteriza por la desaparición de la idea de una acionalidad central de la historia, por un rechazo al universalismo moderno, poniéndose de manifiesto en cambio una eclosión de racionalidades ‘locales’ –minorías étnicas, sexuales, religiosas, culturales o estéticas las cuales aparecen como un rechazo a la idea de que sólo existe una forma de humanidad verdaderamente digna de realizarse; a este fenómeno de microgrupos emergiendo en todos los campos se le conoce como neotribalismo. Así pues, la figura que (...) aparece como representativa de la posmodernidad no es la de Apolo (la de un orden universal), sino la de Dionisio (un constante juego ético-estético dado en lo contingente), el cual puede ser afiliado a la imagen del puer aeternus (el joven/niño eterno), contraria a la del adulto serio, racional, productor y reproductor (propia del siglo XIX), que, dejando de lado las calificaciones de tipo moral, normativo y con tan sólo calificar de cool la realidad, anula las pretensiones absolutistas universalistas. Resumen En el siguiente artículo se indaga en torno a la naturaleza del ícono en cuanto tradicional representación pictórica de Cristo y los santos de la Iglesia. Trataremos de entender en qué consiste este arte, cuyos orígenes se pueden rastrear desde los primeros siglos de la cristiandad, cuáles son sus motivaciones, fines y rasgos esenciales, es decir, sobre qué bases ha logrado cumplir un rol tan importante en la vida de innumerables fieles. Por medio de una metodología de revisión bibliográfica (...) y documental, prestaremos atención a las tesis de diversos filósofos, teólogos e historiadores que se han acercado a reconocer y pensar sobre el significado del ícono para el pueblo cristiano. Nuestro propósito es eminentemente filosófico, pero se nutre de muchos autores que se han preocupado, desde diversas disciplinas, por esta especial y conmovedora belleza cristiana. Conocer en profundidad el ícono nos permitirá resolver nuestra pregunta investigativa que apunta a descubrir la herencia que el ícono le entrega al arte universal de todos los tiempos y al arte cristiano en particular. Partimos de la hipótesis de que el ícono encierra un aporte muy original y poco explorado que tal vez pueda ser de gran provecho e inspiración para pensar, por lo pronto, un arte contemporáneo y futuro enriquecido de esta herencia.The following article explores the nature of the icon as traditional pictorial representation of Christ and the saints of the Church. We will try to understand what this art consists of whose origins can be traced from the first centuries of Christianity, what are its motivations, aims and essential features, that is, on what basis has managed to fulfill such an important role in the lives of countless faithful. By means a methodology of bibliographic and documentary review, we will pay attention to the thesis of different philosophers, theologians and historians who have come to recognize and think about the meaning of the icon for the Christian people. Our purpose is eminently philosophical, but it is nourished by many authors who have been concerned, from different disciplines, with this special and moving Christian beauty. To know in depth the icon will allow us to solve our investigative question that aims to discover the inheritance that the icon gives to the universal art of all times and to Christian art in particular. We start from the hypothesis that the icon contains a very original and little explored contribution that may be of great benefit and inspiration to think, for now, a contemporary art and future enriched by this heritage. Finkelstein, Expression and the Inner, publicada originariamente en 2003 por Harvard University Press (2ª ed. 2008) puede ahora leerse en la versión española de Lino San Juan, editada por la ovetense KRK Ediciones con el título: La expresión y lo interno. Finkelstein propone en La expresión y lo interno un análisis expresivista del autoconocimiento. Podría parecer cuando menos sorprendente y aún más admirable que con tan sólo dos capítulos (“Detectivismo y constitutivismo” y (...) “Expresión”) y un Epílogo (“Deliberación y transparencia”), Finkelstein haya conseguido presentar en esta obra un planteamiento calificado por muchos como una auténtica renovación de la discusión analítica en torno al tema del autoconocimiento, o sea, acerca del problema de qué clase de autoridad quepa atribuir a las expresiones sobre nuestros propios estados de ánimo y/o nuestros estados mentales sin más. David Ripley ha argumentado extensamente a favor de una teoría no-transitiva de la verdad que abandona la regla de Corte para así evitar las pruebas de trivialidad causadas por paradojas como la del mentiroso. Sin embargo, es problemático comparar su teoría con varias teorías clásicas que se han ofrecido en la bibliografía. La tarea de formular esta teoría sobre la aritmética de Peano no es trivial, ya que Corte no es eliminable en la aritmética de Peano. En este artículo (...) intento cerrar esta brecha proponiendo una restricción adecuada para la regla de Corte. La restricción nos permite formular una teoría no-transitiva de la verdad sobre la aritmética de Peano que es, desde el punto de vista de la teoría de la prueba, tan fuerte como la teoría clásica de la verdad más fuerte conocida hasta el momento. Kant’s account of the freedom gained through virtue builds on the Socratic tradition. On the Socratic view, when morality is our end, nothing can hinder us from attaining satisfaction: we are self-sufficient and free since moral goodness is (as Kant says) “created by us, hence is in our power.” But when our end is the fulfillment of sensible desires, our satisfaction requires luck as well as the cooperation of others. For Kant, this means that happiness requires that we get other (...) people to work for our ends; and this requires, in turn, that we gain control over the things other people value so as to have influence over them. If this plan for happiness is not subordinated to morality, then what is most valuable to us will be precisely what others value. This is the root of the “passions” that make us evil and make us slaves whose satisfaction depends on others. But, significantly, this dependence is a moral slavery and hence does not signal a loss, or even diminishment of the kind of freedom required for moral responsibility. (shrink)

For a stable visual world, the colours of objects should appear the same under different lights. This property of colour constancy has been assumed to be fundamental to vision, and many experimental attempts have been made to quantify it. I contend here, however, that the usual methods of measurement are either too coarse or concentrate not on colour constancy itself, but on other, complementary aspects of scene perception. Whether colour constancy exists other than in nominal terms remains unclear.

Hegel's discussion of the concept of “habit” appears at a crucial point in his Encyclopedia system, namely, in the transition from the topic of “nature” to the topic of “spirit” (Geist): it is through habit that the subject both distinguishes itself from its various sensory states as an absolute unity (the I) and, at the same time, preserves those sensory states as the content of sensory consciousness. By calling habit a “second nature,” Hegel highlights the fact that incipient spirit retains (...) a “moment” of the natural that marks a limitation compared to “pure thought” but that also makes perceptual consciousness possible. This makes Hegel's account analogous in important respects to John McDowell's “naturalism of second nature.” But Hegel's account of habit can be seen as a version of a Kantian synthesis of the productive imagination—and hence presupposes a given material that can become one's own by means of habit. This does not mean that Hegel falls into the Myth of the Given, but it does suggest that an appropriate account of second nature might be committed to something McDowell wants to deny: that nonconceptual states of consciousness play a role (even if not a justificatory role) in perception. For Kant, any authentic moral demands are wholly distinct from the demands of prudence. This has led critics to complain that Kantian moral demands are incompatible with our human nature as happiness-seekers. Kant’s defenders have pointed out, correctly, that Kant can and does assert that it is permissible, at least in principle, to pursue our own happiness. But this response does not eliminate the worry that a life organized around the pursuit of virtue might turn out to be one from (...) which we cannot expect any of this (permissible) happiness. To address this worry, Kant would need to establish that there is a kind of harmony between virtue and our own happiness that can give us confidence that aiming at morality does not require us to abandon our hope for happiness in this life. This paper aims to show that Kant—building on insights from Rousseau that Kant identifies with Cynicism—does offer an account of such a harmony between virtue and worldly happiness. (shrink)

For two thousand years the Mencius was revered as one of the foundational texts of the Confucian canon, which formed the basis of traditional Chinese education. Today it commands considerable attention in current debates on "Asian values" raging in classrooms and boardrooms in both East Asia and the West. This volume, which represents the work of fifteen respected scholars of early Chinese thought and culture, is an especially timely effort to bring the Mencius under fresh scrutiny. Making use of recently (...) excavated manuscripts, the contributors approach the Mencius from novel perspectives, challenge established interpretations, and confront anew issues that continue to attract and divide students of this classic text. Hart’s The Concept of Law is a modern classic of legal theory. However, it is also relevant to moral and social philosophy. Here, it is argued that Hart’s criticism of Austin and Bentham, and his views on the nature of law, morality and coercion continue the tradition initiated by David Hume. Moreover, Hart’s social philosophy has interesting normative implications. I shall focus on one single example: the concept of liberty. Although Hart does not analyze the concept of liberty in his book, I argue that his analysis of law may help us to understand that highly contested notion. (shrink)

The World Health Assembly adopted the new International Health Regulations on May 23, 2005. The new IHR represent the culmination of a decade-long revision process and an historic development for international law and public health. The new IHR appear at a moment when public health, security, and democracy have become intertwined, addressed at the highest levels of government. The United Nations Secretary-General Kofi Annan, for example, identified IHR revision as a priority for moving humanity toward “larger freedom.” This article analyzes (...) the new IHR and their implications for global health and security in the 21st century.The WHA instructed the WHO Director-General to revise the IHR in 1995 because the Regulations did not provide an effective framework for addressing the international spread of disease. Doubts about the IHR's effectiveness had, however, been present long before 1995. The critiques identified the narrow scope of the regulations, the lack of compliance by states, and the absence of a strategy for responding to rapid changes in public health's global economic and technological environments. Early in this volume, David Ehrenfeld describes what prophecy really is. The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, contagious (...) pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. For two thousand years the Mencius was revered as one of the foundational texts of the Confucian canon, which formed the basis of traditional Chinese education. Today it commands considerable attention in current debates on "Asian values" raging in classrooms and boardrooms in both East Asia and the West. This volume, which represents the work of fifteen respected scholars of early Chinese thought and culture, is an especially timely effort to bring the Mencius under fresh scrutiny. Making use of recently (...) excavated manuscripts, the contributors approach the Mencius from novel perspectives, challenge established interpretations, and confront anew issues that continue to attract and divide students of this classic text. The famous Mencian doctrine of the "goodness" of human nature forms one main focus. Questions of context and interpretation bring into sharp relief key hermeneutical issues that surround the text. Does the Mencius present a coherent and systematically developed ethical teaching? Or should it be read as a composite work, comprising different layers of material that reflect different emphases and conflicting doctrines? The incident in May-June 2007 involving Andrew Speaker and drug-resistant tuberculosis joins other communicable disease crises that have forced contemplation or actual application of quarantine powers. Implementation of quarantine powers, which encompasses authority for both isolation and quarantine actions, is important not only for the handling of a specific event but also because the use of such authority provides a window on broader issues of public (...) health and the legal rules, ethical principles, and governance systems that support it. Debates about quarantine powers reflect political and social attitudes about public health that often tell us more about this policy endeavor than acts of isolation and quarantine themselves. (shrink)
