Not everyone finds a in suffering. Indeed, even those who do subscribe to this interpretation recognize the responsibility of each individual to show not only sensitivity and compassion but render assistance to those in distress. Pharmacologic hypnosis, morphine intoxication, and terminal sedation provide their own type of medical to the terminally ill patient suffering unremitting pain. More and more states are enacting legislation that recognizes this need of the dying to receive relief through regulated administration of controlled substances. Wider legislative (...) recognition of this need would go far toward allowing physicians, in the exercise of their reasonable medical judgment, to administer a range of narcotics and barbiturates to the terminally ill without fear of legal sanctions. Sadly, social attitudes and governmental concerns about the spread of drug addiction provide an undeniable policy nexus that impedes unduly a rational approach or exception for the treatment of pain experienced by the dying. Having thought out the Enlightenment project of individualism, privacy, and autonomy to its end, Anglo-American ethical theory now finds itself unable to respond to the collapse of community in which the practices justified by this project have resulted. In the place of reasonable deliberation about the goals to be chosen and the means to them, we now, it seems, have only what MacIntyre has aptly called “interminable debate” among “rival” positions, debate in which each party merely contends with the others (...) for its own advantage. And this circumstance MacIntyre himself seems unable to escape despite his best efforts. In further elaborating Hans-Georg Gadamer’s hermeneutical reception of Plato, Aristotle, Aquinas, Kant, and Hegel, and in referring simultaneously to Edmund Burke’s parallel political rhetoric, among other tradition-oriented arguments in the English language, this book seeks a recollection of shared ethical principles, a recollection which alone, it is argued, might prevent the devolution of discussion into war with words and make possible some measure of consensus, however provisional and shadowed by dissent it will be. Paper, $18.95.A new English translation of Heidegger’s best book, Sein und Zeit has been eagerly anticipated ever since the appearance of the Macquarrie/Robinson translation in 1962.1 For anyone (...) with an ear for German would find that, in turning Heidegger’s visceral prose into wooden terminology, this first pathbreaking and very scholarly translation failed completely to render the startling and wholly untraditional diction of this work, a diction that rocked a staid and stifling academia and that in lectures preceding the book’s publication had therefore attracted students in droves, among them Leo Strauss, Hanna Arendt, Hans-Georg Gadamer, Karl Löwith, Herbert Marcuse, and Hans Jonas. At long last, a new translation, Joan Stambaugh’s, is here, but, unfortunately, it is no better in this crucial regard, and it is not as scholarly either. (Macquarrie/Robinson do provide many detailed and useful accounts of their choices of translation.) Indeed, the new translation often seems to be a mere revision of the old and falls into much of the old translation’s terminological uprooting of Heidegger’s sometimes thick but always earthy language. Here are three examples.In S we find this rendering of Heidegger’s preliminary account of the phenomenological method he will apply in “laying out” our “factual” human existence “there” “in the world” of our cooperative taking care of life’s tasks:This “a priori” of the interpretation of Da-sein is not a structure which is pieced together, but rather a structure which is primordially and constantly whole. It grants various perspectives on the factors which constitute it. These factors are to be kept constantly in view, bearing in mind the preceding whole of this structure.(S 37)In M/R this same passage is translated, somewhat more readably and accurately, as:In the interpretation of Dasein, this structure is something ‘a priori’; it is not pieced together, but is primordially and constantly a whole. If affords us, however, various ways of looking at the items which are constitutive for it. The whole of this structure always comes first; but if we keep this constantly in view, these items, as phenomena, will be made to stand out.(M/R 65) [End Page 148]We note, first, how many of the M/R translations are taken over by S: “not a structure... pieced together,” which mistranslates “keine zusammengestückte Bestimmtheit” (SZ 41) or “not a determination arrived at bit by bit,” and “[structure]... primordial(ly) and constant(ly) (a) whole” for “eine ursprünglich und ständig ganze Struktur,” in which the English “primordial” turns the rather ordinary “ursprünglich” or “originally” into a technical term. Indeed, this phrase might best be rendered in more usual English along the lines of “This structure, assumed a priori... is originally, and continues to be, a whole.” For the point, lost in S but preserved in M/R with their “however,” is precisely that even though Dasein has been determined ahead of time to have the basic structure of a whole, we can still elucidate different sides of it phenomenologically by “throwing them into relief” (compare Heideger’s “phänomenal abzuheben”). In S, Heidegger’s pivotal “phänomenal” is lost altogether.Here, next, is how S renders Heidegger’s account of the call of conscience, which calls us back from our having lost ourselves in pressed busyness and vain chattering, at just that moment when these lose all their significance for us and go dead:The call is lacking any kind of utterance. It does not even come to words, and yet it is not at all obscure and indefinite. Conscience speaks solely and constantly in the mode of silence. Power structures are obtained by lifting some mathematical structure (operations, relations, etc.) from an universe X to its power set ${\mathcal{P}(X)}$ . A similar construction provides fuzzy power structures: operations and fuzzy relations on X are extended to operations and fuzzy relations on the set ${\mathcal{F}(X)}$ of fuzzy subsets of X. In this paper we study how this construction preserves some properties of fuzzy sets and fuzzy relations (similarity, congruence, etc.). We define the notions of good, very good, Hoare good (...) and Smith good fuzzy relation and establish some connections between them, generalizing some results of Brink, Bošnjak and Madarász on power structures. In this chapter we explore two important questions that we believe should be central to any discussion of the ethics and politics of cultural heritage: What are the harms associated with appropriation and commodification, specifically where the heritage of Indigenous peoples is concerned? And how can these harms best be avoided? Archaeological concerns animate this discussion; we are ultimately concerned with fostering postcolonial archaeological practices. But we situate these questions in a broader context, addressing them as they arise in connection (...) with the appropriation of Indigenous cultural heritage, both past and present. (shrink)

Jewish law takes an approach to self-defense that differs dramatically from the conventional assumptions of Western secular legal systems. The central theme of Talmudic jurisprudence is that self-defense rests on a duty not to stand idly by while one's neighbor suffers. “Do not stand on the blood of one's neighbor,” as the point is cryptically put in Leviticus 19:16. This way of thinking about self-defense departs in two significant ways from common Western assumptions. First, it stresses that the roots of (...) self-defense are a duty rather than a right to act; second, it treats the case of third-party defense as logically prior to the first-party case of self -defense. Professor Fletcher challenges the traditional account of the development of tort doctrine as a shift from an unmoral standard of strict liability for directly causing harm to a moral standard based on fault. He then sets out two paradigms of liability to serve as constructs for understanding competing ideological viewpoints about the proper role of tort sanctions. He asserts that the paradigm of reciprocity, which looks only to the degree of risk imposed by the parties to a lawsuit on each (...) other, and to the existence of possible excusing conditions, provides greater protection of individual interests than the paradigm of reasonableness, which assigns liability instrumentally on the basis of a utilitarian calculus. Finally, Professor Fletcher examines stylistic differences between the two paradigms which may explain the modern preference for the paradigm of reasonableness. (shrink)

In this article I examine the history of deliberate human infection and CHITs and their utilization prior to the COVID-19 pandemic, key ethical considerations of CHITs in the COVID-19 setting, an analysis of the World Health Organization’s (WHO) Key criteria for the ethical acceptability of COVID-19 human challenge studies, and (...) a review of the two COVID-19 CHITs that have already commenced, their compliance with the WHO criteria and other ethical considerations. For people to live together in pluralistic communities, they must find someway to cope with the practices of others that they abhor. For that reason, tolerance has always seemed an appealing medium of accommodation. But tolerance also has its critics. One wing charges that the tolerant are too easygoing. They are insensitive to evil in their midst. At the same time, another wing attacks the tolerant for being too weak in their sentimentsof respect. “The Christian does not wish to be (...) tolerated,” as T. S. Eliot said; and by this he meant to claim, presumably, that the Christian desires respect and acceptance, and not merely the forbearance suggested by “tolerance.” To make the case for tolerance, we must engage in a three-front campaign: first, against intolerance; second, against the moral failing of indifference; and third, against the desirability of respecting and accepting everyone. The central claim in making this case will be that unlike these three competing sentiments, tolerance is a complex attitude toward the behavior and beliefs of others. Its complexity consists in both moral disapproval and the avoidance of interference. If there is a case to be made for tolerance, it must derive from this peculiar complexity. After surveying its alternatives, I will argue that the complex sentimentof tolerance is more readily praised than its alternatives. (shrink)
