In this paper, we argue that solutions to normative challenges associated with autonomous driving, such as real-world trolley cases or distributions of risk in mundane driving situations, face the problem of reasonable pluralism: Reasonable pluralism refers to the fact that there exists a plurality of reasonable yet incompatible comprehensive moral doctrines within liberal democracies. The corresponding problem is that a politically acceptable solution cannot refer to only one of these comprehensive doctrines. Yet a politically adequate solution to the normative challenges (...) of autonomous driving need not come at the expense of an ethical solution, if it is based on moral beliefs that are (1) shared in an overlapping consensus and (2) systematized through public reason. Therefore, we argue that a Rawlsian justificatory framework is able to adequately address the normative challenges of autonomous driving and elaborate on how such a framework might be employed for this purpose. Kant's critical philosophy is often regarded as standing in a problematic relation to his works in “anthropology”, or the study of human nature. In the Preface to the second edition of the Critique of Pure Reason Kant describes his critical project as a “Copernican” turn toward the cognitive subject, which might seem to signal a reorientation of philosophy around anthropology.1 However, both in the first Critique and in his subsequent works he relegates “empirical anthropology” and “practical” or “moral anthropology” to (...) the sidelines of his critical projects in cognitive and practical philosophy. Yet Kant's formulation of his critical philosophy coincided almost exactly with the development of his interest in anthropology. During the 1770s, the “silent decade” in which he formulated his critical philosophy, Kant initiated a course on anthropology at the University of Königsberg. This course was among the most popular in his regular schedule, and he offered it annually for twenty-five years until his retirement. He then published a revised version of his lectures as the Anthropology from a Pragmatic Point of View, a text that is one of his most accessible publications, and might even seem uncharacteristically loose and anecdotal to readers of his other works. Kant also published a number of shorter works on anthropological topics during this period, and even suggested, in several scattered remarks, that anthropology in some way encompasses all of the philosophical disciplines. One of the perennially intriguing questions regarding Kant’s approach to the human sciences is the relation between his ‘transcendental psychology’ and empirical cognitive psychology. In this paper I compare his analysis of the a priori conditions of human cognition in the Critique of pure reason with his empirical account of the human cognitive faculties in his Anthropology from a pragmatic point of view. In comparing his approach to self-consciousness, sensibility, imagination, and understanding in these two works, I argue that Kant (...) distinguishes between the transcendental and empirical aspects of the human cognitive faculties, and regards the transcendental functions as configuring the empirical faculties of human consciousness, or as giving them the structure that they require to become faculties of cognition. I then show that the cognitive faculties of human beings may vary in their empirical operation, even while they are configured by the same transcendental structure. Finally, I characterize Kant’s transcendental psychology in the first Critique as an account of the faculties that are required for a mind to be an agent or subject of cognition, corresponding to his account of the conditions that are required universally and necessarily for something to be an object of cognition.Keywords: Immanuel Kant; Anthropology; Psychology; Cognition; Transcendental; Empirical. The original edition of the book "Oxford English Dictionary," as well as the integrated edition of 1989, both contain the definition that "spirit" is the prevailing tone or tendency of a particular period of time. In the essay "Of Luxury," published by David Hume in 1752, he writes that the spirit of the age affects all the arts. One of the persistently controversial issues in the discussion of Kant’s moral philosophy is his view of the relation between the metaphysics of morals and human nature.

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. In this volume, Patrick Frierson provides a study of a central controversial issue in the philosophy of Kant that is a model of clarity, precision, and focus, and also a graceful and engaging work of philosophical literature.

This study explored the evidence of validity of internal structure of the 12-item Functional Assessment of Chronic Illness Therapy—Spiritual Wellbeing Scale in Brazilian adolescents with chronic health conditions. The study involved 301 Brazilian adolescents with cancer, type 1 diabetes mellitus, or cystic fibrosis. Exploratory Factor Analysis, Confirmatory Factor Analysis, and Item Response Theory were used to test the internal structure. Reliability was determined with Cronbach’s Alpha and McDonald’s Omega. The EFA suggested a one-dimensional scale structure in contrast to the original (...) 2-factor model or the 3-factor model which were not reproduced in the current CFA. All quality indicators for the EFA one-factor exceeded the required criteria. The FACIT-Sp-12 for adolescents yielded strong evidence for a 1-factor model and with good reliability. (shrink)

Martin Heidegger’s sustained reflection on Greek thought has been increasingly recognized as a decisive feature of his own philosophical development. At the same time, this important philosophical meeting has generated considerable controversy and disagreement concerning the radical originality of Heidegger’s view of the Greeks and their place in his groundbreaking thinking. In Heidegger and the Greeks, an international group of distinguished philosophers sheds light on the issues raised by Heidegger’s encounter and engagement with the Greeks. ObjectivePhysical and mental well-being are threatened by climate change. Since hospitals in high-income countries contribute significantly to climate change through their greenhouse gas (GHG) emissions, the medical ethics imperative of ‘do no harm’ imposes a responsibility on hospitals to decarbonise. We investigated hospital stakeholders’ perceptions of hospitals’ GHG emissions sources and the sense of responsibility for reducing GHG emissions in a hospital.MethodsWe conducted 29 semistructured qualitative expert interviews at one of Germany’s largest hospitals, Heidelberg University Hospital. Five patients, 12 clinical (...) and 12 administrative employees on different levels were selected using purposive maximum variation sampling. Interviews were transcribed verbatim and analysed using the framework approach.ResultsConcerning GHG emissions, hospital stakeholders perceived energy and waste as most relevant emission sources followed by mobility. Climate change mitigation in general was considered as important. However, in their role as patients or employees, hospital stakeholders felt less responsible for climate change mitigation. They saw providing best possible medical care to be the top priority in hospitals and were often concerned that patients’ health could be jeopardised by climate change mitigation measures.ConclusionPerceptions of most important emission sources did not coincide with those in literature, highlighting the need to inform stakeholders, for instance, about pharmaceuticals as important emission source. A frequently perceived conflict between reducing emissions and providing high-quality medical care could be eased, if reducing emissions would not only be justified as a contribution to mitigation, but also as a contribution to preventing ill health—a basic principle of medical ethics. An applicant to our graduate program in philosophy, accepted as well by one (but only one) other graduate program, wrestles with his decision. Finally he decides to attend the other program, but he thanks me for our offer, telling me, "I'm glad that at least I had a choice." I want to focus a bit on these two stories, for while the central conclusion in each -- something turning on the importance of choice -- is initially compelling, it is also, (...) on reflection, philosophically puzzling. It is compelling, because many of us in similar positions would share this response; phenomenologically, it feels right to us. We want to believe that the central facts of our lives -- whether or not we have children, where we are educated, what career we follow, with 1 whom we join as partners -- contain in them some fundamental element of our own selection and decision. We will be exploring below exactly what will turn out to be important here, and why, but for now, in our pre-reflective grasp of this phenomenon, we can say that it seems to have something to do with the value we place on autonomy, self-governance, self-authorship. We want, metaphorically speaking, to write the story of our own lives. But let me now begin to draw out why I find this insistence on the importance of choice, which so many of us would share, to be so puzzling. Both individuals, in both stories, want to be offered a certain additional option in order to have -- or at least to feel that they have? -- a choice about what they are going to do next. But, on the one hand, we could argue that, even with this added option, they still don't have a "real" choice -- they don't have the choice of doing what they most want to do; and on the other hand, one could argue that even without the added option, they always had some choice. Let me explain. In the first story, my friend certainly doesn't have open to her the option that would have been her first choice (and, in our society, what we might call the standard choice, the most frequently chosen option): to produce a biological child with her partner in a happy marriage.. In this paper we want to examine how the mutual understanding of speakers is reached during a conversation through collaborative processes, and what role is played by abductive inference (in the Peircean sense) in these processes. We do this by bringing together contributions coming from a variety of disciplines, such as logic, philosophy of language and psychology. When speakers are engaged in a conversation, they refer to a supposed common ground: every participant ascribes to the others some knowledge, belief, opinion (...) etc. on which to rely in order to reach mutual understanding. As the conversation unfolds, this common ground is continually corrected and reshaped by the interchanges. An abductive reasoning takes place, in a collaborative setting, in order to build new possible theories about the common ground. In reconstructing this process through the use of a working example, we argue that the integration of a collaborative perspective within the Peircean theory of abduction can help to solve some of the drawbacks that the critics of the latter have outlined, for example its permissivity and non generativity. A capoeira ou capoeiragem é uma expressão cultural brasileira que mistura jogo, esporte, arte marcial, cultura popular, tradição, dança e música. Desenvolvida no Brasil por descendentes de escravos africanos, a capoeira é caracterizada por golpes e movimentos ágeis e complexos, utilizando primariamente chutes e rasteiras, além de joelhadas e cabeçadas, cotoveladas, acrobacias aéreas ou em solo. Praticantes da capoeira aprendem não apenas a lutar e jogar, mas também a tocar os instrumentos típicos e cantar. Assim, os discentes do 6º ano (...) de uma escola estadual da cidade de Itabuna—BA, os quais apresentavam dificuldades para ler e escrever. Entretanto, nas aulas de capoeira, os alunos se mostravam mais motivados para ler. Então, surgiu o problema que norteou essa pesquisa, a saber: como o jogo de capoeira vem sendo trabalhado, para estimular a melhoria da aprendizagem em leitura dos alunos, do 6ºano, em um colégio estadual, na cidade de Itabuna – BA? Portanto, o objetivo geral desse artigo é analisar de que maneira o mestre usa o jogo da capoeira, como ferramenta motivacional, nas práticas pedagógicas, para a melhoria da aprendizagem da leitura, entre os alunos do 6º ano, do ensino fundamental II. Desse modo, a utilização de estratégias de leitura, partindo da diversidade dos gêneros textuais, de modo lúdico, através da capoeira, no processo de ensino-aprendizagem, é um assunto que é discutido nessa pesquisa, pois esta se justifica pela necessidade de contribuir para uma melhora do processo de ensino e aprendizagem, partindo de pressupostos presentes na BNCC. "What do grown children owe their parents?" Over two decades ago philosopher Jane English asked this question and came up with the startling answer: nothing (English 1979). English joins many contemporary philosophers in rejecting the once-traditional view that grown children owe their parents some kind of fitting repayment for past services rendered. The problem with the traditional view, as argued by many, is, first, that parents have duties to provide fairly significant services to their growing children, and persons do not (...) owe repayment for others' mere performance of duty; second, even where parents go above and beyond duty in their loving and generous rearing of their children, the benefits are bestowed, at least on young children, without their voluntary acceptance and consent, and so, again, fail to generate any obligation of subsequent repayment on their part (see Blustein 1982: 182-3). Moreover, the entire idiom of obligation and repayment, in English's 1 words, "tends to obscure, or even to undermine, the love that is the correct ground of filial obligation" (352). English's alternative, however -- that children strictly "owe" their parents nothing except what flows naturally from whatever love and affection exist between them -- also strikes many as problematic. Christina Hoff Sommers offers examples of what seem to be clearly delinquent adult children, who simply don't "feel" like sharing their lives with their aging parents, or providing any emotional or financial support to them, and so don't (Sommers 1986: 440-41). Sommers points out that we need some talk of obligations in order to fill in the cracks in human relationships where love and affection fail: "The ideal relationship cannot be 'duty-free,' if only because sentimental ties may come unraveled, often leaving one of the parties at a material disadvantage'" (450-51). Sommers proposes as her alternative to English that legitimate duties arise out of special relationships defined by social roles: being a father or mother, a son or a daughter, "is socially as well as biologically prescriptive; it not only defines what one is; it also defines who one is and what one owes" (447).. The essay articulates a rhapsodic reflection on the place of images, their surfacing, and the invisible that sustains them. By way of introduction, it focuses on (1) the initial scenes of Pasolini’s Medea (1969). Following this spellbinding sequence, it addresses (2) the abiding philosophical attraction to the phenomenon of dreams and visions. This will lead to (3) the story of a momentous flight from the Eastern Mediterranean to the Western coast of Italy, sometime during the VI century BCE. One of (...) the outcomes of this event was the founding of Velia, Elea in Attic Greek. These meanderings take us to the periphery of the region “we” call “the West.” More precisely, they point to the periphery of a certain received way of thinking and may contribute to unsettle it. For what begins to emerge from this rhapsody is an unusual profile of the most celebrated pre-classical thinker: Parmenides. (shrink)

This article analyzes the spinozist mereology, that is, how parts arerelated according to Spinoza. In order to do this it will be crucial toexplore the concepts of part and whole, considering both the Ethics andthe letters of our philosopher — specially that letter in which we findthe famous example of the worm in blood. The hypothesis that I wantto defend is that, if we consider the degrees of individuation, part andwhole are not mere inadequate ideas of imagination.

Nature experiences usually lead to restorative effects, such as positive affective states and reduced stress. Even watching nature compared to urban images, which are known to differ in several image properties that are processed at early stages, can lead to such effects. One potential pathway explaining how the visual input alone evokes restoration is that image properties processed at early stages in the visual system evoke positive associations. To study these automatic bottom-up processes and the role of lower-level visual processing (...) involved in the restoring effects of nature, we conducted two studies. First, we analyzed nature and urban stimuli for a comprehensive set of image properties. Second, we investigated implicit associations in a dichotomous set of nature and urban images in three domains, namely, valence, mood, and stress restoration. To examine the role of lower-level processing in these associations, we also used stimuli that lacked the spatial information but retained certain image properties of the original photographs. While original nature images were associated with “good,” “positive mood,” and “restoration,” urban images were associated with “bad” and “stress.” The results also showed that image properties differ between our nature and urban images and that they contribute to the implicit associations with valence, although spatial information and therefore recognition of the environment remained necessary for positive associations. Moreover, lower-level processed image properties seem to play no or only minor roles for associations with mood and stress restoration. (shrink)

‘Crowded places’ have recently been problematized as objects of terrorist attacks. Following this redefinition of terrorism, crowds have been reactivated at the heart of a security continuum of counter-terrorism, emergency planning and policing. How does the crowd referent recalibrate security governance, and with what political effects? This article argues that several subtle reconfigurations take place. First, counter-terrorism governance derives the knowledge of crowds from ‘generic events’ as unexpected, unpredictable and potentially catastrophic. This move activates 19th-century knowledge about crowds as pathological, (...) while the spatial referent of ‘crowded places’ reconfigures workplaces as crowded places and workers as crowds. Second, new guidance for emergency planning and policing deploys a more rational approach to crowds, put forward in recent psychosocial approaches. These modes of knowledge derive ‘generic crowds’ from normal social relations rather than extraordinary events. Generic events and generic crowds effectively depoliticize crowds, as they exclude a more radical generic politics, in which crowds are not derivable, but negate determination. (shrink)

Animals are frequently utilized as a teaching-learning tool in multiple educational settings. It is, therefore, important to understand what students think about this topic, in particular medical and veterinary students as “life caregivers” and competent people for a dynamic and responsible social intervention. In this context, this research aims to characterize and disseminate a set of issues related to animal welfare/wellbeing in higher education in the North of Portugal, particularly as regards the teaching of students of the Integrated Master in (...) Medicine (MIM) and Veterinary Medicine (MIMV). After ethical approval, a survey was delivered on paper to 180 undergraduate MIM (n = 100) and MIMV (n = 80) students. After collecting 139 questionnaires partially or fully completed, with varying response rates for each question, it was concluded that most of the students consider that animal experimentation is ethically acceptable when the benefits balance the harms and assuming that refinement of animal procedures is warranted; they also agree to the establishment, maintenance and performance of animal procedures solely for educational purposes as a way of ensuring optimal acquisition of theoretical knowledge, attitudes and behaviors and technical skills. Nevertheless, it is the responsibility of teachers to explore and implement pedagogical methodologies thar are equally effective but more humane and compassionate towards sentient living beings. La hipótesis que me interesa defender es que, por un lado, las nociones de individuo y de cosa singular no son totalmente equiparables. Por otro lado, que tanto la cosa singular como la acción pueden entenderse en un sentido amplio y en uno restringido; y, por (...) otro, que comprender al individuo como cosa singular acentúa un aspecto crucial de ellos: su acción y operación.
