This article provides a normative framework for evaluating the moral permissibility of various defences of European Union (EU) values against their violation in EU member states. This requires, first, a coherent interpretation of EU values as the values of liberal democracy; second, a clear notion of when they are violated; third, a theory of how liberal democracy can be defended with measures that are consistent with the values of liberal democracy themselves; and, finally, a discussion of what the EU’s role (...) is in this defence. The article argues that it would be permissible for the EU to combine a number of political, cultural, socio-economic and legal responses in a concentric defence of liberal democracy as long as they respect the separation of powers doctrine and do not rely on problematic notions of collective responsibility. This article argues against the idea that European Union (EU) member states (MSs) that have turned autocratic should be ejected from the EU to ensure that the latter does not itself violate the principle of democracy identified with the all subjected principle (ASP). First, the ASP requires that MSs be democratic before a decision to eject them would be acceptable and at that point, there is no reason to eject them. Second, if EU membership is voluntary as the protagonist of (...) the above idea presupposes, any MS can decide to leave at any point in time and other MSs can decide to leave any MS behind and create a new European organization without it. Taken together, this means that the ASP, which pertains to permanent subjection (to EU law), is irrelevant already from the outset and cannot be used as the main premise for the argument for ejection. Finally, the very disagreement about what kind of organization the EU is and should become, implies that the democratic rights of citizens be given priority over the rights of states. This speaks against the legitimacy of ejecting MSs for democracy protection. (shrink)

Ranking theory is one of the salient formal representations of doxastic states. It differs from others in being able to represent belief in a proposition (= taking it to be true), to also represent degrees of belief (i.e. beliefs as more or less firm), and thus to generally account for the dynamics of these beliefs. It does so on the basis of fundamental and compelling rationality postulates and is hence one way of explicating the rational structure of doxastic states. Thereby (...) it provides foundations for accounts of defeasible or nonmonotonic reasoning. It has widespread applications in philosophy, it proves to be most useful in Artificial Intelligence, and it has started to find applications as a model of reasoning in psychology. (shrink)

In this paper we compare Leitgeb’s stability theory of belief and Spohn’s ranking-theoretic account of belief. We discuss the two theories as solutions to the lottery paradox. To compare the two theories, we introduce a novel translation between ranking functions and probability functions. We draw some crucial consequences from this translation, in particular a new probabilistic belief notion. Based on this, we explore the logical relation between the two belief theories, showing that models of Leitgeb’s theory correspond to certain models (...) of Spohn’s theory. The reverse is not true. Finally, we discuss how these results raise new questions in belief theory. In particular, we raise the question whether stability is rightly thought of as a property pertaining to belief. (shrink)

Abstract Today’s scholarship and policymaking on business and human rights (BHR) urges businesses to better understand their human rights responsibilities and remedy them, when and if abuses do occur. Despite the public discourse about businesses and human rights, the state—as the main duty bearer in international human rights law—plays a fundamental role as the protector and enforcer of human rights obligations. Yet, the existing literature overlooks state involvement as perpetrators of abuse in the corporate context. We develop the term _economic (...) complicity_ to shed light on the state’s role in directly or indirectly abusing human rights within a corporation’s sphere of influence, such as police violence toward nonviolent protesters or granting environmental licenses without adhering to legally required community consultations. We ask: What contributes to the state’s engagement in economic complicity in corporate human rights abuses? We assess hypotheses emergent from the democratic change and development studies literatures with a unique database that includes economic complicity data from Latin America, the Corporations and Human Rights Database (CHRD). This research has important theoretical implications for the business ethics and BHR literatures, as understanding economic complicity highlights the need for business actors to avoid shirking their moral responsibilities to not only ‘do no harm’ but also to protect human rights when they are threatened by the state. Since the early 1990s, the extractive industries have increasingly valued corporate social responsibility in the communities where they operate. More recently, these industries have begun to recognize the importance of adapting CSR efforts to unique local contexts rather than applying a one-size-fits-all model. However, firms understand local context to mean culture and treat the physical properties of the host region—topography, geology, hydrology, and climate—as the exclusive purview of mineral geologists and engineers. In this article, we examine the organization of CSR (...) at two industrial-scale gold mines in Guatemala, owned by the same firm, which yielded starkly distinct levels of support among host community residents. We develop the idea of social terrain to convey the way in which the biophysical environment informs local social relations and imbues phenomena with particular social meanings. We argue that firms must account for social terrain in organizing for CSR. The literature struggles to provide guidelines for identifying and understanding stakeholders. Social terrain, we argue, can begin to bridge this gap between theory and practice. (shrink)

Several prominent voices have called for a democratization of science through deliberative processes that include a diverse range of perspectives and values. We bring these scholars into conversation with extant research on democratic deliberation in political theory and the social sciences. In doing so, we identify systematic barriers to the effectiveness of inclusive deliberation in both scientific and political settings. We are particularly interested in what we call misidentified dissent, where deliberations are starkly framed at the outset in terms of (...) dissenting positions without properly distinguishing the kinds of difference and disagreement motivating dissent. Antibiotic development and usage, and antibiotic resistance in particular, are today considered global concerns, simultaneously mandating local and global perspectives and actions. Yet such global considerations have not always been part of antibiotic policy formation, and those who attempt to formulate a globally coordinated response to antibiotic resistance will need to confront a history of heterogeneous, often uncoordinated, and at times conflicting reform efforts, whose legacies remain apparent today. : Within both popular and academic literature, concerns have been expressed about the implications of antidepressant use on character development. In this paper, I identify specific versions of these worries and argue that they are misguided. I begin by arguing that the obligation to suffer if it will bring about a noble character is imagined. Legitimate concerns about character enhancement remain, but they do not count against most antidepressant use. Thus there is no moral prohibition against antidepressant use. Ethical issues in international nursing research are identified and the perspectives of the International Centre for Nursing Ethics are offered in an effort to develop an international consensus of ethical behaviour in research. First, theoretical issues are reviewed, then initial conditions for ethical conduct are defined, and protocol design and procedure considerations are examined. A concerted effort is made to identify and avoid a western bias. Broad guiding principles for designing and reviewing research are offered: (1) respect for persons; (2) (...) beneficence; (3) justice; (4) respect for community; and (5) contextual caring. It is difficult to consider, describe or address the ethical issues particular to qualitative research without experience and understanding of the technicalities of qualitative methodologies. The Australian National Statement on the Ethical Conduct of Research Involving Humans charges researchers with a responsibility to demonstrate that they have the appropriate experience, qualifications and competence for their proposed research. Ethical review committees have the responsibility to judge claimed research competence. Process metaphysics (process philosophy) has been suggested as a route, to a more ‘processbased’ approach to organizational studies, as opposed to a ‘substance-based’ view said to be dominant in Western thinking — including most contemporary organizational researchers. This paper explores some of the ideas of early-twentieth-century process thinkers and provides an interpretation of some of the major works of Alfred N. Whitehead. The objective is to evaluate its possible relevance to modern organizational research. The paper argues that Whitehead’s radical ontology (...) — that was based on a generalization of quantum theory in physics — appears largely to have been refuted or disregarded by succeeding process philosophers. Furthermore, his epistemology is found to represent a process view on scientific knowledge creation taken for granted by most contemporary researchers. For different reasons, major elements of his theories do not appear to be directly relevant to efforts to advance organizational theory into more radical process-based theories. On the other hand, the paper argues that the early-twentieth-century process thinkers — including Whitehead — offer a plurality of analytical conceptions that may serve as useful and inspirational contributions to further development of methods and perspectives to investigate into organizations, change and innovation processes. There are also particular approaches within the domain that have properties quite similar to some of those conceptions in process philosophy — like ‘sensemaking processes’ as represented by Karl Weick and others, which may in particular benefit from exploring the area of process philosophy. This essay identifies a point of convergence between economically oriented, distributive approaches to social justice and culturally oriented, identitarian ones.The primary problem of difference politics, I claim, is insuring that disadvantaged groups have equal abilities to participate in the social processes that construct and value identities. I argue that this is best accomplished through a conception of equality promoting human agency in both the cultural and economic spheres.

This article explores the intellectual relations between Carl Schmitt and the German historian Reinhart Koselleck with a focus on the inspiration that Koselleck found in Schmitt's work in the early 1950s. The article goes beyond earlier contributions in the field by illuminating how the most important discursive features that Koselleck drew from Schmitt were utilized toward a very independent intellectual project. This project concerned an attempt to revise modern political thought by means of outlining a new concept of history. Koselleck's (...) concept of history was to depart from all utopian notions of history as a singular, unified and goal-directed process. Instead, it aimed to outline certain fundamental existential structures of the human condition and to take account of the social relations existing among human beings in order to understand (historically) and contain (politically) the potential conflict in human societies. Hence Koselleck believed that his new concept of history would lead to a more responsible foundation of political order and decision making. Following an analysis of how Koselleck developed his project in a dialogue with the work of Schmitt and a number of other scholars, first of all Friedrich Meinecke and Martin Heidegger, the article presents a brief perspective on how his new concept of history was received in the 1950s and on how it came to provide his work with a certain analytical, thematic and argumentative unity. In Hans Urs von Balthasar's 1947 Wahrheit, later republished as Theo-Logic I, he attempted to retrieve the notion that "truth is not just a property of knowledge but a transcendental quality of being as such". Villanova's D. C. Schindler enlists this retrieval in order to overcome "a metaphysics of presence," while also providing readers with an indispensable guide for navigating philosophical aspects of Balthasar's Werke. Although Schindler's text deals with notoriously dense subject matter, an undercurrent of pedagogical sense controls his (...) style and grants readers rewarding assimilation of a logic affirming both identity and difference within the concept of truth. We examine the merits of neoclassical environmental economics and discuss alternative approaches to it. We argue that the basic assumptions of the neoclassical approach, embodied in the indifference curve, make that model inappropriate for environmental analysis. We begin by assuming that the basic postulates of the neoclassical model hold and then argue that even this ideal state is incompatible with environmental sustainability. We discuss the role of the discount rate, the exclusive emphasis on marginal choices, and the assumption of perfect (...) information. (shrink)

Nursing research in China is at an early stage of development and little is known about the practices of Chinese nurse researchers. This interview study carried out at a university in central China explores the informed consent practices of Chinese nurse researchers and the cultural considerations of using a western technique. Nine semistructured interviews were conducted in English with assistance and simultaneous translation from a Chinese nurse with research experience. The interviews were analyzed by one western and two Chinese researchers (...) and major themes were identified. All participants endorsed informed consent as ethically required. Differences were noted between some of the informed consent practices typically recommended in the USA and those identified in this study, such as: recruitment using local and government officials, recruiting directly from medical records without special permission, family consultation in consent and consent control, and not revealing randomization to intervention groups receiving different treatments. BackgroundIn the US, many patients forgo recommended care due to cost. The ANA Code of Ethics requires nurses to give care based on need. Therefore, US nurses are compelled to practice in a context which breaches their professional ethical code.Research ObjectivesThis study sought to determine if nurses do care for patients who forgo treatment due to cost (PFTDC) and if so, does this result in an experience of moral distress (MD).Research DesignSemi-structured interviews were transcribed and analyzed using a qualitative content (...) analysis.Participants and Research ContextA convenience sample of 20 nurses in practice for at least one year from a variety of health care setting participated.Ethical ConsiderationsThis project was approved by the Michigan State University Biomedical Institutional Review Board.ResultsThere were 19 female and one male nurse-participants, averaging 47 years old with an average of 10 years in practice. 18 reported caring for PFTDC. These 17 nurse-participants experienced a moderate degree of MD as a result, averaging 5.4 of 10 on the Moral Distress Thermometer. In the interviews, the following themes were identified, strategies to help PFTDC, and the broken US health care system which had the subthemes of preference for business over patient-oriented benefit, PFTDC using the emergency department, and limited support for treatment/management of PFTDC.ConclusionsThe existence of this phenomenon places the profession of nursing in the US in a position of moral compromise and threatens to corrupt the institution of nursing in the US. Our aim is to explore and develop notions of objectivity that are useful and appropriate for critical realist empirical research. In Part I, we provided an initial definition that introduced the idea that objectivity is a value that must be chosen but that its significance is rooted in a series of other epistemological and ontological matters. We also addressed why it is worthwhile in realist terms to develop the notion of objectivity, and began to develop a revision of the concept (...) to recognise the role of subjectivities. This, we maintain, is an important clarification in developing social research. Part II explores the linkages between objectivity and situated action. In Part II we argue that the growth of knowledge requires engagement and critical analysis. We develop the idea that if subjects are engaged through multiple standpoints, then objectivity becomes significant as a lever of agency in the service of dialogue and debate and of transformations. Again, our aim is to be of use to practical researchers by providing underlying arguments. Specifically, we argue that objectivity is a bridge between the subjectivities of subjects and the rest of the real world. In so doing, the paper works through various desirable characteristics of an adequate theorisation of knowledge that could make objectivity part of the ontological underpinnings as well as the daily practices of a realist researcher. Objectivity thus links philosophical work to the everyday work of realist researchers. (shrink)

Views of what role convention plays in the creation and appreciation of art works gravitate towards two extremes. One view holds that works of art can be apprehended and appreciated as well as created with no reference to convention. The other claims that conventions fully determine how works of art are apprehended and are therefore necessary conditions for the creation of works of art as well as constitutive of appreciation. The former is a version of the Romantic view of art (...) as something that appeals spontaneously to man's most profound emotions, to man's sentient nature, without making use of or needing mediating conventions. The conventionalist view denies that it is possible to respond spontaneously to art. All apprehension and appreciation of art are structured by conventions, and the reader/audience cannot go beyond these conventions because they constitute the experience of the work of art. Depression is a highly recurrent disorder with limited treatment alternatives for reducing risk of subsequent episodes. Acceptance and commitment therapy (ACT) and attention bias modification (ABM) separately have shown some promise in reducing depressive symptoms. This study investigates (a) if group-based ACT had a greater impact in reducing residual symptoms of depression over a 12-month follow-up than a control condition, and (b) if preceding ACT with ABM produced added benefits. This multisite study consisted of two phases. In phase 1, participants (...) with a history of depression, currently in remission (N= 244), were randomized to either receive 14 days of ABM or a control condition. In phase 2, a quasi- experimental design was adopted, and only phase-1 participants from the Sørlandet site (N= 124) next received an 8-week group-based ACT intervention. Self-reported and clinician-rated depression symptoms were assessed at baseline, immediately after phase 1 and at 1, 2, 6, and 12 months after the conclusion of phase 1. At 12-month follow-up, participants who received ACT exhibited fewer self-reported and clinician-rated depressive symptoms. There were no significant differences between ACT groups preceded by ABM or a control condition. There were no significant differences between ACT groups preceded by ABM or a control condition. Group-based ACT successfully decreased residual symptoms in depression over 12 months, suggesting some promise in preventing relapse. (shrink)

Ambiguity is intrinsic to life. Yet, mainstream accountability theory reduces its area of application by not taking ambiguity seriously. The literature treats too many aspects as exogenous to politics and is unlikely to capture accountability dynamics in contemporary representative democracies in transformation, including the European Union. Theorizing accountability requires going beyond predetermined principals and agents, detecting deviance from authoritative orders and rules, and disciplining unruly agents. An institutional perspective is offered, relaxing assumptions regarding what accountability means and implies; what is (...) involved in demanding, rendering, assessing and responding to accounts; what factors foster effective accountability; and how accountability regimes emerge and change. The fluidity and unresolved conflicts of political life make it difficult to correctly assign causal responsibility and to learn from experience. Accountability processes, nevertheless, provide occasions for searching for and testing collective purpose, intelligence, meaning and political equality, as part of institutionalization and de-institutionalization processes.
