Objective To determine whether presenting delivery room management options as defaults influences decisions to resuscitate extremely premature infants. Materials and methods Adult volunteers recruited from the world wide web were randomised to receive either resuscitation or comfort care as the delivery room management default option for a hypothetical delivery of a 23-week gestation infant. Participants were required to check a box to opt out of the default. The primary outcome measure was the proportion of respondents electing resuscitation. Data were analysed (...) using χ2 tests and multivariate logistic regression. Results Participants who were told the delivery room management default option was resuscitation were more likely to opt for resuscitation (OR 6.54 95% CI 3.85 to 11.11, p<0.001). This effect persisted on multivariate regression analysis (OR 7.00, 95% CI 3.97 to 12.36, p<0.001). Female gender, being married or in a committed relationship, being highly religious, experiences with prematurity, and favouring sanctity of life were significantly associated with decisions to resuscitate. Discussion Presenting delivery room options for extremely premature infants as defaults exert a significant effect on decision makers. The information structure of the choice task may act as a subtle form of manipulation. Further, this effect may operate in ways that a decision maker is not aware of and this raises questions of patient autonomy. Conclusion Presenting delivery room options for extremely premature infants as defaults may compromise autonomous decision-making. (shrink)

This note evaluates the claim of Steven Pinker in The Better Angels of Our Nature that the advent of strong states led to a decline in violence. I test this claim in the modern context, measuring the effect of the strength of government in lower-income countries on reductions in homicide rates. The strength of government is measured using Polity IV, Worldwide Governance Indicators, and government consumption as a percentage of GDP. The data do not support Pinker’s hypothesis.

An implicit goal of many interventions intended to enhance integrity is to minimize peoples' exposure to unethical events. The intent of the present effort was to examine if exposure to unethical practices in the course of one's work is related to ethical decision making. Accordingly, 248 doctoral students in the biological, health, and social sciences were asked to complete a field appropriate measure of ethical decision making. In addition, they were asked to complete measures examining the perceived acceptability of unethical (...) events and a measure examining perceptions of ethical climate. When these criterion measures were correlated with a measure examining the frequency with which they had been exposed to unethical events in their day-to-day work, it was found that event exposure was strongly related to ethical decision making but less strongly related to climate perceptions and perceptions of event acceptability. However, these relationships were moderated by level of experience. The implications of these findings for practices intended to improve ethics are discussed. (shrink)

Scholars have proposed a number of courses and programs intended to improve the ethical behavior of scientists in an attempt to maintain the integrity of the scientific enterprise. In the present study, we conducted a quantitative meta-analysis based on 26 previous ethics program evaluation efforts, and the results showed that the overall effectiveness of ethics instruction was modest. The effects of ethics instruction, however, were related to a number of instructional program factors, such as course content and delivery methods, in (...) addition to factors of the evaluation study itself, such as the field of investigator and criterion measure utilized. An examination of the characteristics contributing to the relative effectiveness of instructional programs revealed that more successful programs were conducted as seminars separate from the standard curricula rather than being embedded in existing courses. Furthermore, more successful programs were case based and interactive, and they allowed participants to learn and practice the application of real-world ethical decision-making skills. The implications of these findings for future course development and evaluation are discussed. (shrink)

It is commonly held that early career experiences influence ethical behavior. One way early career experiences might operate is to influence the decisions people make when presented with problems that raise ethical concerns. To test this proposition, 102 first-year doctoral students were asked to complete a series of measures examining ethical decision making along with a series of measures examining environmental experiences and climate perceptions. Factoring of the environmental measure yielded five dimensions: professional leadership, poor coping, lack of rewards, limited (...) competitive pressure, and poor career direction. Factoring of the climate inventory yielded four dimensions: equity, interpersonal conflict, occupational engagement, and work commitment. When these dimensions were used to predict performance on the ethical decision-making task, it was found that the environmental dimensions were better predictors than the climate dimensions. The implications of these findings for research on ethical conduct are discussed. (shrink)

In recent years, we have seen a new concern with ethics training for research and development professionals. Although ethics training has become more common, the effectiveness of the training being provided is open to question. In the present effort, a new ethics training course was developed that stresses the importance of the strategies people apply to make sense of ethical problems. The effectiveness of this training was assessed in a sample of 59 doctoral students working in the biological and social (...) sciences using a pre-post design with follow-up and a series of ethical decision-making measures serving as the outcome variable. Results showed not only that this training led to sizable gains in ethical decision making but also that these gains were maintained over time. The implications of these findings for ethics training in the sciences are discussed. (shrink)

Ethical decision making measures are widely applied as the principal dependent variable used in studies of research integrity. However, evidence bearing on the internal and external validity of these measures is not available. In this study, ethical decision making measures were administered to 102 graduate students in the biological, health, and social sciences, along with measures examining exposure to ethical breaches and the severity of punishments recommended. The ethical decision making measure was found to be related to exposure to ethical (...) events and the severity of punishments awarded. Differences across fields and experience levels are frequently considered in discussions of ethical decision making and ethical behavior. In the present study, doctoral students in the health, biological, and social sciences completed measures of ethical decision making. The effects of field and level of experience with respect to ethical decision making, metacognitive reasoning strategies, social-behavioral responses, and exposure to unethical events were examined. Social and biological scientists performed better than health scientists with respect to ethical decision making. Furthermore, the ethical (...) decision making of health science students decreased as experience increased. Moreover, these effects appeared to be linked to the specific strategies underlying participants' ethical decision making. We analyze log-data generated by an experiment with Mathtutor, an intelligent tutoring system for fractions. The experiment compares the educational effectiveness of instruction with single and multiple graphical representations. We extract the error-making and hint-seeking behaviors of each student to characterize their learning strategy. Using an expectation-maximization approach, we cluster the students by their strategic profile. We find that a) experimental condition and learning outcome are clearly associated b) experimental condition and learning strategy are not, and c) almost all of (...) the association between experimental condition and learning outcome is found among students implementing just one of the learning strategies we identify. This class of students is characterized by relatively high rates of error as well as a marked reluctance to seek help. They also show the greatest educational gains from instruction with multiple rather than single representations. The behaviors that characterize this group illuminate the mechanism underlying the effectiveness of multiple representations and suggest strategies for tailoring instruction to individual students. Our methodology can be implemented in an on-line tutoring system to dynamically tailor individualized instruction. (shrink)

Recently, Kieran Setiya has challenged this orthodoxy by presenting a form of agent-neutral consequentialism that he claims can capture deontic constraints. Over the last two decades, a growing philosophical literature has subjected virtue ethics to empirical evaluation. Drawing on results in social psychology, a number of critics have argued that virtue ethics depends upon false presuppositions about the cross‐situational consistency of psychological traits. Alasdair MacIntyre’s After Virtue has been a prime target for the situationist critics. This essay assesses the situationist critique of MacIntyre’s account of virtue. It argues that MacIntyre’s social teleological account of virtue is not what his situationist critics (...) take it to be. Virtues, for MacIntyre, are not reducible to psychological traits. They are qualities of one’s socially constituted character, and their intelligibility as virtues derives from their role in the narrative of one’s life. Recognizing this both clarifies and complicates debates about the implication of situationist social psychology for virtue ethics. It also grants a new significance to MacIntyre’s attention to the socio‐historical context of virtue, a significance that should be especially interesting to religious ethicists. (shrink)

In this essay, I argue that we have a non-inferential way of knowing particular explanations of our own actions and attitudes. I begin by explicating and evaluating Nisbett and Wilson’s influential argument to the contrary. I argue that Nisbett and Wilson’s claim that we arrive at such explanations of our own actions and attitudes by inference is not adequately supported by their findings because they overlook an important alternative explanation of those findings. I explicate and defend such an alternative explanation (...) of how we can know such explanations in a non-inferential way, drawing on recent work in the philosophy of self-knowledge. (shrink)

Increased participation in public affairs by the U.S. Conference of Catholic Bishops during the highly contentious 2012 Presidential election has seemingly brought the traditions of Catholic social teaching and socialism into a high profile conflict. While it is clear that President Obama is not what most academics would consider a “socialist,” modern discourse still presents what I argue is a false dichotomy- one can be either endorse natural law (especially of the Catholic variety) or socialism, but not both. While my (...) goal in this article is to refute the alleged incompatibility, not to determine its historical roots, some speculation about its origin may be illuminating. Recent work on religious identity in the United States suggests that Americans largely identify Christianity with the right wing of the American culture war. Additional research is required to fully grasp where this perception comes from, but one can venture several guesses: the rise of the “Christian Right” in Republican Party politics of the late 1990s and early 2000s, the concept of “social justice” being lampooned by Right-wing talk show hosts, and decades of a Catholic Church that firmly opposed Cold War-era Soviet Communism. The contrast between left-wing and right-wing thought on social issues (same-sex marriage, abortion, etc.) is very well documented and widely discussed. Differences between leftists and natural lawyers on economic issues, however, are more often assumed than argued for. Perhaps this is a matter of “guilt by association,” with those arguing that leftist social policy is at odds with natural law simply assuming that the same must be the case with leftist economic policy as well. Thus, natural law, long tied to Christianity throughout its history, is gratuitously appropriated by right-wing political ideology. Against this claim of incompatibility, I argue that one can rationally hold both socialism and natural law to be true. In his landmark Natural Law and Natural Rights, John Finnis offers what is arguably the twentieth century’s most complete theory of natural law. I will argue that the conception of socialism laid out by G.A. Cohen in hisWhy Not Socialism? is compatible with Finnis’s account of the human goods, and that natural lawyers can therefore reasonably endorse Cohen’s prescription for socialism. (shrink)

Beginning with an analysis of the problematic relation of ‘the particular’ to ‘the universal’ in canonical political texts, this paper explores a variety of frameworks for the study of classical Greek political thought. Specifically, after investigating the influence of Quentin Skinner’s contextualism, the paper examines the ideas, approaches, and methods of Bernard Williams, Leo Strauss, and Josiah Ober. I draw attention to each figure’s distinctive motivations for returning to ancient Greece and to the influence of particular political ideals on those (...) motivations. I also assess their strengths and weaknesses and offer a critical commentary on their chief ideas. Toward the end of the paper, I outline a novel dialectical framework for the study of classical Athens – one that emphasizes the remoteness of the ancient past and the contribution that our studies might make to self-knowledge. In sketching this framework, I focus on what I call ‘ethical Athens’, ‘philosophical Athens’, and ‘critical Athens’. (shrink)

In his article “Insight: Genesis and Ongoing Context,” Fred Crowe calls out Lonergan’s line “the diagram is more important than…is ordinarily believed” as the “philosophical understatement of the century.” Sixteen pages later he identifies elaborating an invariant cognitional theory to underlie generalized emergent probability and thus “the immanent order of the universe of proportionate being,” as “our challenge,” “but given the difficulty” he does not “see any prospect for an immediate answer.” Could this have something to do with the lack (...) of a comprehensive diagram of cognitional theory? Appendix A of The Boston College Lectures on Mathematical Logic and Existentialism offers diagrams of the dynamics of knowing and doing perhaps copied from Lonergan’s own blackboard work, but they do not distinguish explanatory and descriptive insights, let alone statistical insights, and do not illustrate the pull upwards or the fusing of routinized insights. Before we can effectively relate cognitional theory to generalized emergent probability, we must have an adequately rigorous and precise cognitional theory. I firmly believe in the truth of Lonergan’s fundamental insights, but in order to rigorously undergird generalized emergent probability there are many pertinent questions about his cognitional theory which must be asked and answered. In this paper I (1) review some of Lonergan’s attempts to diagram cognitional theory and discuss what insights they do and do not express, (2) elaborate and defend principles for making our formulations of insight into insight rigorous and clear, and (3) attempt to build up a diagram which makes full use of those principles in a maximally expressive way. We argue that explanationist views in epistemology continue to face persistent challenges to both their necessity and their sufficiency. This is so despite arguments offered by Kevin McCain in a paper recently published in this journal which attempt to show otherwise. We highlight ways in which McCain’s attempted solutions to problems we had previously raised go awry, while also presenting a novel challenge for all contemporary explanationist views.

Using newly uncovered archival sources, this essay traces the meteoric rise and fall of the peculiar interdisciplinary German scientific journal Physis, founded by the physicist Pascual Jordan and the biologist Adolf Meyer-Abich in 1941. Launched when victory for Nazi Germany seemed certain, Physis was intended by Jordan and Meyer-Abich to be a premier international journal for all sciences suitable for the new “German-led Europe” forged by conquest. Yet the journal was simultaneously a vehicle for institutionalizing Jordan’s remarkably prescient vision of (...) the future of the scientific enterprise in Hitler’s state—a vision nearly identical to what is now termed “big science,” yet suitably “Nazified” for wartime Germany. Behind the scenes, Physis was accompanied by a campaign of intrigue, through which Jordan and Meyer-Abich hoped to find a patron for the journal and big science among the various power centers of the Nazi state. These efforts failed, yet they nevertheless demonstrate that big science is not inherently democratic. (shrink)

Some interpreters have ascribed to Wittgenstein the view that mathematical statements must have an application to extra-mathematical reality in order to have use and so any statements lacking extra-mathematical applicability are not meaningful (and hence not bona fide mathematical statements). Pure mathematics is then a mere signgame of questionable objectivity, undeserving of the name mathematics. These readings bring to light that, on Wittgenstein’s offered picture of mathematical statements as rules of description, it can be difficult to see the role of (...) mathematical statements which relate to concepts that are not employed in empirical propositions e.g. set-theoretic concepts. I will argue that Wittgenstein’s picture is more flexible than might at first be thought and that Wittgenstein sees such statements as serving purposes not directly related to empirical description. Whilst this might make such systems fringe cases of mathematics, it does not bring their legitimacy as mathematical systems into question. (shrink)

In this paper we apply the popular Best System Account of laws to typical eternal worlds – both classical eternal worlds and eternal worlds of the kind posited by popular contemporary cosmological theories. We show that, according to the Best System Account, such worlds will have no laws that meaningfully constrain boundary conditions. It’s generally thought that lawful constraints on boundary conditions are required to avoid skeptical arguments. Thus the lack of such laws given the Best System Account may seem (...) like a severe problem for the view. We show, however, that at eternal worlds, lawful constraints on boundary conditions do little to help fend off skeptical worries. So with respect to handling these skeptical worries, the proponent of the Best System Account is no worse off than their competitors. (shrink)

When a symbol is a marker of a primary bearer of value and, secondarily, a bearer of value itself, then it has symbolic value. Philosophers have long been suspicious of symbolic values, often regarding them as illusory or irrelevant. I suggest that arguments against symbolic values either overgeneralize or else require premises that can only be supported if the normative significance of some symbolic considerations is presupposed. Humans need symbols to represent identity facts to themselves and others. Symbolic values thereby (...) contribute to individuals’ control over their own agency. (shrink)

Abortion jurisprudence in the United States has been criticized by many for allowing the destruction of millions of lives. What many may not know is that the Supreme Court decision which legalized abortion in all fifty states was very similar to another Supreme Court decision, namely, Dred Scott v. Sanford. The parallels between these two cases are astounding, revealing how dehumanization, while a very old idea, is almost always achieved through the same means. A legal analysis of Roe v. Wade, (...) and subsequently Planned Parenthood v. Casey, shows that these cases are both morally and legally unjustified. Just like Dred Scott, Roe, by dehumanizing a specific group of individuals, is a case which does not belong in the American legal system. (shrink)

Being open to persuasion can help show respect for an interlocutor. At the same time, open-mindedness about morally objectionable claims can carry moral as well as epistemic risks. Our aim in this paper is to specify when there might be duty to be open to persuasion. We distinguish two possible interpretations of openness. First, openness might refer to a kind of mental state, wherein one is willing to revise or abandon present beliefs. Second, it might refer to a deliberative practice, (...) according to which one is willing to engage with opposing reasons. We suggest these two interpretations are conceptually and empirically distinct. Once disambiguated, we suggest that different contexts may make different forms of openness appropriate as expressions of respect. (shrink)

Moral pluralism is the norm in contemporary society. Even the best philosophical arguments rarely persuade moral opponents who differ at a foundational level. This has been vividly illustrated in contemporary debates in bioethics surrounding contentious issues such as abortion and euthanasia. It is readily apparent that bioethics discourse lacks an empirical explanation for the broad differences about various topics in bioethics and health policy. In recent years, social and cognitive psychology has generated novel approaches for defining basic differences in moral (...) intuitions generally. We propose that if empirical research using social intuitionist theory explains why people disagree with one another over moral issues, then the results of such research might help people debate their moral differences in a more constructive and civil manner. We illustrate the utility of social intuitionism with data from a national physician survey. (shrink)

Many of the most pressing moral problems that face our world are structural problems. Problems of this nature present difficulties for Christian ethicists because structural features tend to undermine conditions for the attribution of individual moral responsibility. This essay proposes an approach to this problem that reconciles a social account of sin with individual moral responsibility. Two key moves drive this proposal. First, I argue for a sharper distinction between sin and moral wrongdoing than is common. Second, I argue that (...) both sin and individual moral responsibility ought to be understood socially. Triage situations and other occurrences in which rationing of medical care is necessary require careful distribution of medical equipment, services, or resources. However, the evolution of triage has failed to eliminate certain biases in the standards of care, particularly for groups already facing societal disenfranchisement and discrimination. This article explores the use of triage calculators and other systems of rationing care, their implicit biases, and how to avoid allowing those biases to influence care.

Recent setbacks to international institutions and projects of global governance have been viewed as marking a resurgence of nation-state sovereignty. In fact, however, many of the major controversies and developments in contemporary international law and geopolitics concern the administration, autonomy, and internal hierarchy not of states, but of supra-state regions. The spatial logic of a world divided into such regions is best articulated in Carl Schmitt’s theory of the Großraum, which in various respects describes and explains key features of modern (...) world order. Taking regional systems as self-constituting political units characterized by internal forms of dominance and legitimation aids in identifying the operation of hegemony in contemporary international law and institutions. It also makes possible a reinterpretation of global constitutionalist discourse as a democratizing project that finds its most important expressions in counter-hegemonic movements within the various “great spaces” constituting today’s world. Polybius’ Histories, written in the mid—second century BC, offers an authoritative account of Rome’s rise to uncontested imperial supremacy. The work has been highly influential among political thinkers because of its theory of the “mixed constitution.” This essay proposes to return Polybius’ mixed constitution to its proper location within the narrative of the Histories. This interpretative approach enables us to appreciate Polybius’ frequently neglected emphasis on the connections between republican politics and Roman imperial power. These connections shed light on recent (...) developments in republican political theory. They also lead to an investigation of the didactic purposes of the author, who intended to educate the Roman aristocracy in the virtues necessary for exercising hegemonic power successfully in the ancient Mediterranean world. Wittgenstein's conception of infinity can be seen as continuing the tradition of the potential infinite that begins with Aristotle. Transfinite cardinals in set theory might seem to render the potential infinite defunct with the actual infinite now given mathematical legitimacy. But Wittgenstein's remarks on set theory argue that the philosophical notion of the actual infinite remains philosophical and is not given a mathematical status as a result of set theory. The philosophical notion of the actual infinite is not to be (...) found in the mathematics of set theory, only in a certain associated philosophy – what Wittgenstein calls a certain kind of “prose”. This article sets out an argument from legitimacy for the proposed Indigenous Voice to Parliament in Australia. The article first sets out an understanding of political legitimacy and of legitimacy deficits and argues that the Australian Government faces a legitimacy deficit with respect to its exercise of political power and authority over Indigenous Australians. The deficit arises, it is argued, because Indigenous Australians face significant structural injustice and there is little hope of redressing this injustice within the prevailing governing conventions. The article then argues that the proposed Indigenous Voice to Parliament ought to be seen as part of a package to address this legitimacy deficit by resetting the governing conventions of Australian society. The argument from legitimacy is then compared favorably with more familiar arguments from sovereignty and the right to self-determination. (shrink)

Scholars generally agree that, according to Aristotle, factionalizers are motivated by a sense of injustice (the ‘first cause’) to redress imbalances in wealth and honor (the ‘second cause’). Recent discussions, however, have offered a misleading interpretation of Aristotle’s third cause, which he identifies as the origin of the factionalizers’ sense of injustice. It involves, most importantly, greed, hubris, and other factors such as fear and ‘disproportionate growth’. In conversation with a recent publication in Polis, this article restores the third cause (...) to its proper place in Aristotle’s account. Abusive power holders, driven by greed, hubris, and overreaching, oppress their fellow citizens – following in the tradition of Homer’s Agamemnon, Hesiod’s basileis, and Solon’s aristocrats. These power holders prompt a sense of anger, indignation, and injustice in their fellow citizens, who ultimately form factions and take action on their own behalf. (shrink)

Achilles is vindictive; he wants to get even with Agamemnon. Being so disposed, he sounds rather like many current crime victims who angrily complain that the American system of criminal justice will not allow them the satisfactions they rightfully seek. These victims often feel that their particular injuries are ignored while the system addresses itself to some abstract injury to the state or to the rule of law itself – a focus that appears to result in wrongdoers being treated with (...) much greater solicitation and respect than their victims receive. If the actual victims are noticed at all, they will likely be told that there is another branch of law – tort law – that has the job of dealing with private injuries and grievances and that, if they pursue this route at their own expense, they might ultimately get some financial compensation for the wrongs done to them. However, just as Achilles felt that mere compensation was inadequate to the kind of injury done to him by Agamemnon, many of these victims will often claim that the injuries they have suffered do not admit of financial compensation. How, they might ask, can a dollar value be set on the humiliation and degradation they have experienced? They might also note that those who injure them tend, unlike Agamemnon, to be judgment-proof – so lacking in resources as to be unable to make any meaningful contribution to any compensation package that the victim may win. While it is widely held that normative reflection is an effective means of controlling our emotions, it has proven to be notoriously difficult to provide a plausible model of such control. How could reflection on the normative status of our emotions be a means of controlling them? Higher-order models of reflective control give a special role to higher-order beliefs and judgments about the normative status of our emotions in controlling our emotions, but in doing so claim that higher-order beliefs and (...) judgments have more control over our emotional lives than they in fact have, and fail to explain some of the central features of reflective control. First-order models of reflective control give a special role to first-order evaluative beliefs and perceptions about the objects of our emotions in controlling our emotions, but in doing so fail to explain how normative reflection could be a distinctive means of controlling our emotions at all. In this essay, I defend a model of reflective control which avoids the twin pitfalls of the higher-order and first-order models of reflective control, while learning from them both. I defend a model according to which normative reflection is a means of bringing our emotions under the control of reflective reason, where an emotion’s being under the control of reflective reason is to be understood in terms of its being under the control of one’s first-order evaluative beliefs and perceptions in accordance with one’s reflective commitments. This paper argues that God may create and exist in any possible world, no matter how much suffering of any sort that world includes. It combines the traditional free will defence with the notion of an ‘occasion’ for good or evil action and limits God's responsibility to the creation of these occasions. Since no possible world contains occasions for more evil than good action, God is morally permitted to create any possible world. With regard to suffering that is not due (...) to free will, namely the suffering of beings who are not moral agents, the paper questions the idea that the relief of such suffering is a moral perfection. A variety of non-human females do not select male partners independently. Instead they favor males having previous associations with other females, a phenomenon known as mate copying. This paper investigates whether humans also exhibit mate copying and whether consistent positive information about a man’s mate value, and a woman’s age and self-perceived mate value (SPMV), influence her tendency to copy the mate choices of others. Female university students (N = 123) rated the desirability of photographed men pictured alone or with (...) one, two, or five women represented by silhouettes. In accordance with the visual arrays, men were described as currently in a romantic relationship; having previously been in one, two, or five relationships; or not having had a romantic relationship in the past 4 years. Women generally rated men pictured with one or two previous partners as more desirable than those with none. Men depicted with five previous partners, however, were found to be less desirable. Younger, presumably less experienced women had a greater tendency to mate copy compared with older women, but high SPMV did not predict greater levels of mate copying. The findings reaffirmed and expanded those suggesting that women do not make mate choices independently. (shrink)

This article reconsiders the relationship between Simmel and Heidegger. Scholars commonly argue that Simmel’s work on the topic of death and mortality influenced the early Heidegger’s work on the same topic, as evidenced in Being and Time. I argue however that Simmel’s work particularly in the Lebensanschauung should be read as challenging the basic presuppositions of Heidegger on death. I then compare the two on the issue of immortality in order to show that Simmel is much closer to the subsequent (...) critics of Heidegger than he is to Heidegger himself. (shrink)
