How does a subject who is competent to detect the irrationality of a belief that p, form her belief against weighty or even conclusive evidence to the contrary? The phenomenon of self-deception threatens a widely shared view of beliefs according to which they do not regularly correspond to emotions and evaluative attitudes. Accordingly, the most popular answer to this question is that the belief formed in self-deception is caused by an intention to form that belief. On this view, the state (...) of self-deception is taken to be a calculated outcome involving a person's intentional manipulation of her own thoughts. I argue that this answer is false and forms an impediment towards making sense of self-deception. I show that, contrary to philosophical prejudice, emotions and desires exert vast and systematic effects on the formation of beliefs. In this, and other, sections of the article, the results of experimental work are brought forward. Self-deception is portrayed here as resembling numerous instances of belief formation which are regularly affected by motivational factors. I argue that self-deceptive beliefs are direct expressions of the subject's wishes, fears and hopes. Qua beliefs which mostly correspond to such factors (rather than to evidence), self-deceptive states are a kind of fantasy. (shrink)

The first is Mele's attempt to account for self-deception by appealing to a desire to believe, together with an instrumental belief concerning the means of satisfying this desire. Contrary to Mele, it is argued that such an account requires a recognition on the part of agents that their actions instantiate these means. Second, Mele misidentifies the most essential – and flawed – ingredient of the standard approach to self-deception, the agent's desire (...) to form the belief (the belief that is undermined by the evidence). The notions of acting against one's better judgment and self-deception are notoriously problematic. Often, they have been deemed incoherent in a tradition which may be traced back to Socrates. My inquiry into these notions, unlike many others, explicitly draws upon considerations pertaining to the interpretation of speech and action and the role which rationality plays within it, the nature of psychological explanation and the framework in which it is embedded. This work is motivated by the view that, if carried out (...) properly, a study of the mind which focuses on deviant phenomena will also improve understanding of standard cases of action and belief-formation. ;The possibility of acting against one's better judgment seems, prima facie, to be at odds with our notion of action. I begin by critically examining several arguments purporting to show that akrasia is in fact incompatible with the notion of a free intentional action. I show that, overall, an agent appears more rational, and thus more intelligible, if instances of local irrationality of this kind are acknowledged as such rather than re-interpreted as non-akratic actions. The position I reject represents the agent as significantly more inconsistent than necessary, and in some sense, undermines the endeavor of a psychological explanation. ;I proceed to argue that reasons play a unique role in the context of explaining actions. At the same time, the framework of action explanation must be expanded so as to include additional familiar elements such as emotions and fantasies in order to improve understanding of the choices we make. I argue that the causal influence of these elements cannot be fully captured as merely a source of reasons for actions; thus, some of the mental causes responsible for our actions lie outside the realm of reasons. Finally, I show how expanding the explanatory framework of actions makes the phenomenon of akrasia less puzzling in some respects; indeed, this expansion should incline us to expect that persons would act akratically on occasion. ;My discussion of self-deception focuses on two major questions: whether every case of self-deception involves the presence of an intention to form a belief and to what extent this phenomenon warrants a view of the mind as divided. With respect to the first question, I suggest that a view which refrains from interpreting every case of self-deception as involving an intention to form a belief is psychologically more plausible and accounts for some key cases for which the intentionalist view fails to account. As for the second question, I contend that there are at least two ways in which the mind may be properly seen as divided, yet divisions which introduce homuncularism should be rejected. What emerges from my discussion of self-deception, as well as the preceding discussion of akrasia, is a view of the mind that essentially incorporates both rational and non-rational elements. People often think that their special relationships with family, friends, comrades and compatriots, can ground moral reasons. Among these reasons, they understand some to be duties – pro tanto requirements that have genuine weight when they conflict with other considerations. In this paper I ask: what is the underlying moral structure of associative duties? I first consider and reject the orthodox Teleological Welfarist account, which first observes that special relationships are fundamental for human well-being, then claims that we cannot have (...) these relationships, if we do not recognise associative duties, before concluding that we should therefore recognise associative duties. I then introduce a nonteleological alternative, grounded in the Appropriate Response approach to ethical theory. (shrink)

Can the question "Why do what morality requires?" be answered in such a way that anyone regardless of their desires or interests has reason to be moral? One strategy for answering this question appeals to constitutive arguments. In general, constitutive arguments attempt to establish the normativity of rational requirements by pointing out that we are already committed to them insofar as we are believers or agents. This study is concerned with the general prospects for such arguments. It starts by explaining (...) the general constitutive argument strategy, followed by an examination of constitutive arguments that have been given regarding theoretical reason and the instrumental principle in practical reason, and concluding with a discussion of some challenges to constitutive arguments in moral philosophy and some possible responses to these challenges. Constitutive arguments for the principles of practical reason attempt to justify normative requirements by claiming that we already accept them in so far as we are believers or agents. In two constitutive arguments for the requirement that we must will universally, Korsgaard attempts first to arrive at the requirement that we will universally from observations about the causality of the will, and secondly to establish that willing universally is constitutive of having a self. Some rational requirements may be established by (...) some version of this second argument, but the strategy does not seem promising when it comes to establishing the requirement that we will universally. I draw on the discussion of Korsgaard to highlight a challenge facing constitutive arguments in general. (shrink)

We use phenomenology to reflect on the experience of being with others as mediated by screens through videoconferencing platforms, a phenomenon accelerated by the Covid-19 pandemic and social isolation measures. We explore two directions to explain the intersubjective experience of a videoconference. One direction introduces a conceptual background based on previous contributions in phenomenology, while the other one is more speculative: we introduce the novel idea of a phantom other. First, we understand this phenomenon either as a correlate of image (...) consciousness or as a paradoxical perception. Then, we introduce the phantom other using ideas offered in phenomenological descriptions in which the phantom limb appears as a quasi-presence. The phantom other is the same flesh and blood body with whom I co-constitute senses of the world. In a videoconference, the other appears as a whole body with which I coordinate, although she appears as a phantom other. (shrink)

Throughout the nineteenth and early twentieth centuries, judges and lawmakers sought to erase the visibility of unmarried women. In the public law arena, for example, legislators conflated women and wives for the purpose of the franchise, arguing that women did not need the vote because their husbands voted for them. In the private law arena, doctrines intended to guarantee support to unmarried women functioned by constructing single women's legal identities in relation to marriage, thereby suggesting that marriage could provide for (...) all women's material needs. This essay argues that understanding the history of single women's legal rights is critical to understanding the legal construction of marriage as the dominant institution for regulating all women's private relationships to men and public relationships to the state. Denying single women's existence allowed the law to ignore the potential threat they posed to a marriage-centric socio-legal order. Legal and political changes in the early decades of the twentieth century, however, made it increasingly difficult for the law to deny the existence of unmarried women. As single women gained social prominence, nonlegal writers in the 1930s and 1940s produced a new genre of prescriptive and descriptive literature for and about women living outside of marriage. Unlike earlier legal texts, these works embraced single women as a permanent and visible part of society. Like their legal predecessors, however, these modern authors sought to minimize the threat posed by single women to the institution of marriage, pointing to single women as proof of marriage's modern, consensual, democratic nature. We argue that two long-term goals of AI research stand in tension with one another. The first involves creating AI that is safe, where this is understood as solving the problem of value alignment. The second involves creating artificial general intelligence, meaning AI that operates at or beyond human capacity across all or many intellectual domains. Our argument focuses on the human capacity to make what we call “existential choices”, choices that transform who we are as persons, including transforming what (...) we most deeply value or desire. It is a capacity for a kind of value misalignment, in that the values held prior to making such choices can be significantly different from (misaligned with) the values held after making them. Because of the connection to existentialist philosophers who highlight these choices, we call the resulting form of risk “existentialist risk.” It is, roughly, the risk that results from AI taking an active role in authoring its own values rather than passively going along with the values given to it. On our view, human-like intelligence requires a human-like capacity for value misalignment, which is in tension with the possibility of guaranteeing value alignment between AI and humans. (shrink)

I argue that riskier killings of innocent people are, other things equal, objectively worse than less risky killings. I ground these views in considerations of disrespect and security. Killing someone more riskily shows greater disrespect for him by more grievously undervaluing his standing and interests, and more seriously undermines his security by exposing a disposition to harm him across all counterfactual scenarios in which the probability of killing an innocent person is that high or less. I argue that the salient (...) probabilities are the agent’s sincere, sane, subjective probabilities, and that this thesis is relevant whether your risk-taking pertains to the probability of killing a person or to the probability that the person you kill is not liable to be killed. I then defend the view’s relevance to intentional killing; show how it differs from an account of blameworthiness; and explain its significance for all-things-considered justification and justification under uncertainty. Optimism about our ability to enhance societal decision‐making by leaning on Machine Learning (ML) for cheap, accurate predictions has palled in recent years, as these ‘cheap’ predictions have come at significant social cost, contributing to systematic harms suffered by already disadvantaged populations. But what precisely goes wrong when ML goes wrong? We argue that, as well as more obvious concerns about the downstream effects of ML‐based decision‐making, there can be moral grounds for the criticism of these predictions themselves. We introduce (...) and defend a theory of predictive justice, according to which differential model performance for systematically disadvantaged groups can be grounds for moral criticism of the model, independently of its downstream effects. As well as helping resolve some urgent disputes around algorithmic fairness, this theory points the way to a novel dimension of epistemic ethics, related to the recently discussed category of doxastic wrong. Abstractabstract:The antiutopian effect of Game of Thrones (GoT) is examined as a form of mass entertainment. The first part of this article approaches GoT from the standpoint of dialectical contradiction between Fantasy and Realism peculiar to GoT’s eclectic nature. The second part puts forward a hypothesis about the social basis of GoT horizons, taking into account the fragmented and niched state of contemporary TV audiences.

This paper develops an account of existential choices and their role in practical reasoning. In contrast to other views that attempt to make sense of existential choices as a type of rational choice, the proposed account takes them to be choices among the normative outlooks that determine the reasons we have, and as such are nonrational. According to the argument in the paper, existential choices bring to light a feature of all choices, that they are made against the backdrop of (...) a normative outlook, which grounds the rationality of the choice but is not itself rationally determined. It is generally agreed that using lethal or otherwise serious force in self-defense is justified only when three conditions are satisfied: first, there are some grounds for the defender to give priority to his own interests over those of the attacker (whether because the attacker has lost the protection of his right to life, for example, or because of the defender’s prerogative to prefer himself to others); second, the harm used is proportionate to the threat thereby averted; third, the harm (...) is necessary to avert that threat. The first and second conditions have been exhaustively discussed, but the third has been oddly neglected. Meanwhile a prominent school of thought has arisen, in the ethics of war, which seeks to ground the justification of killing in war in principles of individual self-defense. They too have failed to offer any substantive analysis of necessity, while at the same time appealing to it when it suits them to do so. In this paper, I attempt a detailed analysis of the necessity constraint on defensive force, and explore the implications of that analysis for the attempt to transpose principles of individual self-defense into the context of warfare. Killing civilians is worse than killing soldiers. If any moral principle commands near universal assent, this one does. Few moral principles have been more widely and more viscerally affirmed. And yet, in recent years it has faced a rising tide of dissent. Political and military leaders seeking to slip the constraints of the laws of war have cavilled and qualified. Their complaints have been unwittingly aided by philosophers who, rebuilding just war theory from its foundations, have concluded that this principle (...) is at best a useful fiction. Sparing Civilians aims to turn this tide, and to vindicate international law, and the ruptured consensus. The necessity constraint is at the heart of the ethics of both self-defense and war, and yet we know little about it. This article seeks to remedy that defect. It proceeds in two stages: first, an analysis of the concept of necessity in self-defense; second, an application of this analysis to war, looking at both its implications for just war theory and its application in the laws of war.

En el presente trabajo se analizan los términos utilizados por E. Husserl en el segundo volumen de Ideas relativas a una fenomenología pura y a una filosofía fenomenológica. Investigaciones fenomenológicas sobre la constitución para nombrar la corporeidad humana. Nos interesa, dentro del abanico semántico desplegado por el filósofo, atender al concepto de Leibköper y mostrar su independencia respecto del par Leib y Körper, en tanto y en cuanto permite describir una dimensión de la experiencia que las otras nociones no parecen (...) agotar. Se discuten, además, las interpretaciones de E. Behnke (1996) y N. Depraz (2001) sobre el concepto de Leibkörper. Mientras para la primera, se trataría de una definición estrictamente naturalista de la corporalidad que debe ser excluida en la actitud fenomenológica, para la segunda es, más bien, un concepto esencialmente fenomenológico, el de cuerpo vivido. Teniendo en cuenta el contexto general de fundamentación de una Fenomenología de la corporeidad que anima el trabajo, el esclarecimiento de esta noción resulta de vital importancia. (shrink)

El presente trabajo intenta constituir un aporte a la tarea de ganar precisión conceptual en la consideración de las temáticas del espacio y el movimiento humano desde una perspectiva fenomenológica y toma como horizonte teórico las lúcidas reflexiones de Maurice Merleau-Ponty sobre estas temáticas. Se analizan en el mismo los aportes de la distinción entre una espacialidad de situación y una espacialidad de posición, se revisan de manera crítica las limitaciones de la misma y se propone la noción de postura (...) como un complemento descriptivo que permite hacer extensiva la reflexión merleaupontiana acerca del movimiento a fenómenos motrices de agentes diestros y entrenados. Moderating effects of religiousness and spirituality on the relations between sexual and non-sexual dyadic communication with sexual and marital satisfaction were examined. Three hundred forty-two married Jewish women responded to self-report measures. Religiousness moderated the relations between both sexual and non-sexual communication with marital satisfaction—for the less religious these relations were stronger in comparison with the more religious—but not with sexual satisfaction. Sexual communication had a unique contribution to the prediction of sexual satisfaction while both types of communication demonstrated unique (...) contributions to the prediction of marital satisfaction. The implications of these findings on the role of dyadic communication in relational satisfaction and the meaning of sexual and marital satisfaction for the more and less religious are discussed. Reasons internalism holds that reasons for action contain an essential connection with motivation. I defend an account of reasons internalism based on the advisor model. The advisor model provides an account of reasons for action in terms of the advice of a more rational version of the agent. Contrary to Pettit and Smith's proposal and responding to Sobel's and Johnson's objections, I argue that the advisor model can provide an account of internal reasons and that it is too caught up (...) in the psychology of the actual agent to be able to account for anything other than internal reasons. Killing in War presents the Moral Equality of Combatants with serious, and in my view insurmountable problems. Absent some novel defense, this thesis is now very difficult to sustain. But this success is counterbalanced by the strikingly revisionist implications of McMahan’s account of the underlying morality of killing in war, which forces us into one of two unattractive positions, contingent pacifism, or near-total war. In this article, I have argued that his efforts to mitigate these controversial implications fail. The reader (...) is left stranded: to reach plausible conclusions, Walzer deployed an implausible conception of our rights to life; McMahan’s more rigorous account of those rights generates untenable conclusions. Absent new developments, it seems that the prospects for grounding the ethics of war in individual rights are poor: any theory of our rights to life that is sufficiently indiscriminate to work in the chaos of war is not discriminating enough to be a plausible theory of our rights to life. Perhaps by rejecting the ideal of the rights-respecting war altogether we might develop an alternative theory of justified warfare, which marries theoretical soundness with conclusions that we can more confidently support. this paper advances a novel account of part of what justifies killing in war, grounded in the duties we owe to our loved ones to protect them from the severe harms with which war threatens them. It discusses the foundations of associative duties, then identifies the sorts of relationships, and the specific duties that they ground, which can be relevant to the ethics of war. It explains how those associa- tive duties can justify killing in theory—in particular how they can (...) justify overrid- ing the rights to life of some of those who must be killed to win a war. It then shows how these duties can be operationalised in practice: first, showing how soldiers who fight on behalf of their community can act on reasons that apply to the members of that community; second, showing that the argument from associative duties does not prove too much—in particular, that it does not license the intentional killing of noncombatants in war. This paper argues for interpreting Nietzsche along the lines of a self-constitution view. According to the self-constitution view, a person is a kind of creation: we constitute our selves throughout our lives. The self-constitution view may take more than one form: on the narrative version, the self is like a story, while on the Kantian version, the self is a set of principles or commitments. Taking Marya Schechtman’s and Christine Korsgaard’s accounts as paradigmatic, I take the self-constitution view to emphasize (...) practical considerations and the first person point of view and to conceive of the self as active in self-creation. The interpretation I offer can make sense of Nietzsche’s remarks about self-creation and of many of Nietzsche’s remarks about the self that would otherwise seem contradictory. In particular, Nietzsche’s anti-metaphysical remarks about the self fit well with the self-constitution view as long as they are understood as theoretical claims that do not undermine the importance of the practical point of view. This article analyses the phenomenon of ‘micro-domination’, in which a series of dominated choices are individually inconsequential for a person’s freedom but collectively consequential. Where the choices concerned are objectively inconsequential, micro- domination poses a problem for ‘objective threshold’ accounts of domination which either prioritise particularly bad forms of domination or exclude powers that do not risk causing serious harm to their victims. Where the choices concerned are subjectively inconsequential to the victim, micro-domination poses a problem for the common republican (...) strategy of creating arenas of contestation for victims of domination, which rely on victims objecting strongly enough to a dominating relationship to sound the alarm. This kind of invigilation may systematically fail victims of micro-domination. Throughout the article, I suggest some ways of better accounting for and responding to cases of micro-domination. International law and conventional morality grant that states may stand ready to defend their borders with lethal force. But what grounds the permission to kill for the sake of political sovereignty and territorial integrity? In this book leading theorists address this vexed issue, and set the terms of future debate over national defence.

Normative ethical theories owe us an account of how to evaluate decisions under risk and uncertainty. Deontologists seem at a disadvantage here: our best decision theories seem tailor-made for consequentialism. For example, decision theory enjoins us to always perform our best option; deontology is more permissive. In this paper, we discuss and defend the idea that, when some pro-tanto wrongful act is all-things considered permissible, because it is a ‘lesser evil’, it is often merely permissible, by the lights of deontology. We show that this raises new problems for deontological decision theory, and we show that to resolve them, we need to take a more innovative approach to morally evaluating decision-making under risk and uncertainty. Many of us believe (1) Saving a life is more important than averting any number of headaches. But what about risky cases? Surely: (2) In a single choice, if the risk of death is low enough, and the number of headaches at stake high enough, one should avert the headaches rather than avert the risk of death. And yet, if we will face enough iterations of cases like that in (2), in the long run some of those small risks of (...) serious harms will surely eventuate. And yet: (3) Isn't it still permissible for us to run these repeated risks, despite that knowledge? After all, if it were not, then many of the risky activities that we standardly think permissible would in fact be impermissible. Nobody has yet offered a principle that can accommodate all of 1-3. In this paper, I show that we can accommodate all of these judgements, by taking into account both ex ante and ex post perspectives. In doing so, I clear aside an important obstacle to a viable deontological decision theory. (shrink)
