The first part of this book is a translation of a philosophical work by the Breton philosopher Jules Lequyer, which explores questions of divine justice and human equality. The second part is a biography of Lequyer by Donald Wayne Viney, based on Prosper Hemon's life of Lequyer, and other material.

Do participants in shared activity have mutual obligations to do their bit? This article shows this question has no one-size-fits-all answer and offers a pluralist account of the normativity of shared agency. The first part argues obligations to do one's bit have three degrees of involvement in shared activity. Such obligations might, obviously, bolster co-participants’ resolve to act as planned (degree 1). Less obviously, there also are higher and lower degrees of involvement. Obligations to do one's bit might provide our (...) agency-pooling mechanism. When they do, we act together by virtue of satisfying them (degree 2). Conversely, some shared activities involve no obligation (degree 0). In the second part, I argue shared agency theory is best served by a non-moralistic conception of obligation, one on which co-participants’ obligations need be neither strict-performance obligations, nor directed ones. Overall, my arguments suggest that we can choose how to coordinate normatively our shared activities. (shrink)

Jules Coleman, one of the world's leading philosophers of law, here presents his most mature work so far on substantive issues in legal theory and the appropriate methodology for legal theorizing. In doing so, he takes on the views of highly respected contemporaries such as Brian Leiter, Stephen Perry, and Ronald Dworkin.

Research programs in empirical psychology from the past two decades have revealed implicit biases. Although implicit processes are pervasive, unavoidable, and often useful aspects of our cognitions, they may also lead us into error. The most problematic forms of implicit cognition are those which target social groups, encoding stereotypes or reflecting prejudicial evaluative hierarchies. Despite intentions to the contrary, implicit biases can influence our behaviours and judgements, contributing to patterns of discriminatory behaviour. These patterns of discrimination are obviously wrong and (...) unjust. But in remedying such wrongs, one question to be addressed concerns responsibility for implicit bias. Unlike some paradigmatic forms of wrongdoing, such discrimination is often unintentional, unendorsed, and perpetrated without awareness; and the harms are particularly damaging because they are cumulative and collectively perpetrated. So, what are we to make of questions of responsibility? In this article, we outline some of the main lines of recent philosophical thought, which address questions of responsibility for implicit bias. We focus on (a) the kind of responsibility at issue; (b) revisionist versus nonrevisionist conceptions of responsibility as applied to implicit bias; and (c) individual, institutional, and collective responsibility for implicit bias. Suppose the prevailing distribution of property rights is unjust as determined by the relevant conception of distributive justice. You have far more than you should have under that theory and I have far less. Then I defraud you and in doing so reallocate resources so that our holdings ex post more closely approximate what distributive justice requires. Do I have a duty to return the property to you? There are many good reasons for requiring me to return to you what (...) I have taken. One is that while you may have no right in justice to all that you own, it does not follow that I do, or that I have a right to take it. Thus, requiring me to return the property to you is a way of recognizing that I had no right to take it from you in the first place. (shrink)

Philosophers who have written about implicit bias have claimed or implied that individuals are not responsible, and therefore not blameworthy, for their implicit biases, and that this is a function of the nature of implicit bias as implicit: below the radar of conscious reflection, out of the control of the deliberating agent, and not rationally revisable in the way many of our reflective beliefs are. I argue that close attention to the findings of empirical psychology, and to the conditions for (...) blameworthiness, does not support these claims. I suggest that the arguments for the claim that individuals are not liable for blame are invalid, and that there is some reason to suppose that individuals are, at least sometimes, liable to blame for the extent to which they are influenced in behaviour and judgment by implicit biases. I also argue against the claim that it is counter-productive to see bias as something for which individuals are blameworthy; rather, understanding implicit bias as something for which we are liable to blame could be constructive. This essay is part of a larger project exploring the extent to which the market paradigm might be usefully employed to explain and in some instances justify nonmarket institutions. The focus of the market paradigm in this essay is the relationship between the idea of a perfectly competitive market and aspects of both the rationality of political association and the theory of collective choice. In particular, this essay seeks to identify what connections, if any, exist between one kind of market (...) account of the rationality of political association and one kind of market-based social choice rule. The market theory of political association I intend to discuss I call “market contractarianism,” and the collective choice rule whose relation to it I intend to explore is the unanimity rule. The term 'implicit bias' has very swiftly been incorporated into philosophical discourse. Our aim in this paper is to scrutinise the phenomena that fall under the rubric of implicit bias. The term is often used in a rather broad sense, to capture a range of implicit social cognitions, and this is useful for some purposes. However, we here articulate some of the important differences between phenomena identified as instances of implicit bias. We caution against ignoring these differences: it is likely (...) they have considerable significance, not least for the sorts of normative recommendations being made concerning how to mitigate the bad effects of implicit bias. In this paper we introduce a stochastic model for a population living and migrating between s sites without distinction in the states between residents and immigrants. The evolutionary stable strategies is characterized by the maximization of a stochastic growth rate. We obtain that the expectation of reproductive values, normalized by some random quantity, are constant on all sites and that the expectation of the normalized vector population structure is proportional to eigenvector of the dispersion matrix associated to eigenvalue one, which (...) are, in some way, analogous to the results obtained in the deterministic case. In recent years, most studies of human memory systems have placed the emphasis on differences rather than on similarities. The present study sought to assess the impact of perceptual priming on the creation of new episodic memories. It was composed of three distinct experimental phases: an initial study phase, during which the number of repetitions of target words was manipulated; a perceptual priming test phase, involving both target and new control words, which constituted the incidental encoding phase of a subsequent (...) Remember/Know/Guess recognition task. Results showed that the greater the perceptual priming at encoding, the more the episodic memory performance was enhanced, whereas no such relation was found for know judgments or feeling of familiarity. Furthermore, the words that were associated with the creation of new episodic memories had been perceptually primed to a greater extent during the incidental encoding phase than the words that were subsequently judged to be known or forgotten. These results suggest that the perceptual contents of episodic memories are constituted by the very perceptual representations that generate priming effects. Potential mechanisms linking perceptual priming to the creation of episodic memories are discussed. (shrink)

Our focus here is on whether, when influenced by implicit biases, those behavioural dispositions should be understood as being a part of that person’s character: whether they are part of the agent that can be morally evaluated.[4] We frame this issue in terms of control. If a state, process, or behaviour is not something that the agent can, in the relevant sense, control, then it is not something that counts as part of her character. A number of theorists have argued (...) that individuals do not have control, in the relevant sense, over the operation of implicit bias. We will argue that this claim is mistaken. We articulate and develop a notion of control that individuals have with respect to implicit bias, and argue that this kind of control can ground character-based evaluation of such behavioural dispositions. Jules Coleman, one of the world's most influential philosophers of law, here expounds his recent views on a range of important issues in legal theory. Coleman offers for the first time an explicit account of the pragmatist method that has long informed his work, and takes on the views of highly respected contemporaries such as Ronald Dworkin and Joseph Raz.

Research programs in empirical psychology over the past few decades have led scholars to posit implicit biases. This is due to the development of innovative behavioural measures that have revealed aspects of our cognitions which may not be identified on self-report measures requiring individuals to reflect on and report their attitudes and beliefs. But what does it mean to characterise such biases as implicit? Can we satisfactorily articulate the grounds for identifying them as bias? And crucially, what sorts of cognitions (...) are in fact being measured; what mental states or processes underpin such behavioural responses? In this paper, we outline some of the philosophical and empirical issues engaged when attempting to address these three questions. Our aim is to provide a constructive taxonomy of the issues, and how they interrelate. As we will see, any view about what implicit bias is may depend on a range of prior theoretical choices. This book is an interdisciplinary study of the fundamental normative issues underpinning immigration policy. Economists, political scientists and philosophers address issues such as the proper role of the state in supporting a particular culture, the possible destabilization of the political and social life of a country through immigration, the size and distribution of economic losses and gains, and the legitimacy of discriminating against potential immigrants in favour of members of the resident population. The need for serious philosophical consideration of this (...) subject is beyond question. This volume should advance discussion in an area of great practical as well as philosophical importance. Philosophers have had a lot to say about blame, much less about praise. In this paper, I follow some recent authors in arguing that this is a mistake. However, unlike these recent authors, the reasons I identify for scrutinising praise are to do with the ways in which praise is, systematically, unjustly apportioned. Specifically, drawing on testimony and findings from social psychology, I argue that praise is often apportioned in ways that reflect and entrench existing structures of oppression. Integrating a historical perspective into studies of prejudicial attitudes facilitates the interpretation of paradoxical findings of the kind cited in the target article. History also encourages research to move beyond the study of prejudice and to consider institutional and structural forces that maintain social inequities. Multilevel approaches can study these factors in both field and laboratory studies.

In this paper, I set out some desiderata for a model of implicit cognition. I present test cases and suggest that, when considered in light of them, some recent models of implicit cognition fail to satisfy these desiderata. The test cases also bring to light an important class of cases that have been almost completely ignored in philosophical discussions of implicit cognition and implicit bias. These cases have important work to do in helping us understand both the role of implicit (...) cognition in action and our attempts to combat implicit biases. (shrink)

The transmission, emergence, and dissemination of features of racial differentiation are based on the interplay of different sensory perceptions, as this contribution will illustrate. For this purpose, examples from ethnographic travelogues from German East Africa and from the time of German colonial rule were selected to examine the functioning of tactile perception by means of the descriptions of skin colors and skin decorations. The source material reveals multisensuality in the form of synesthesia of the sense of sight with the sense (...) of touch, in that the perception of tactile stimuli is determined less by direct touch and more by the visual representation of haptic properties. The Master Argument, recorded by Epictetus, indicates that Diodorus had deduced a contradiction from the conjoint assertion of three propositions. The Argument, which has to do with necessity and contingency and therefore with freedom, has attracted the attention of logicians above all. There have been many attempts at reconstructing it in logical terms, without excessive worry about historical plausibility and with the foregone conclusion that it was sophistic since it directly imperilled our common sense notion of freedom. This text takes (...) exception to recent tradition, translating the propositions into logical terms. The propositions figuring in The Master Argument are interpreted in terms of temporal modal logic where both the modalities and the statements they govern have chronological indices. This means that the force of the argument comes not from purely logical or modal considerations, but from our experience of time. (shrink)

This paper traces the unspoken, implicit white racial logic of the brain disease model of addiction, which is based on seemingly universal, disembodied brains devoid of social or environmental influences. In the United States, this implicit white logic led to “context-free” neuroscience that made the social hierarchies of addiction and its consequences invisible to, and thus exacerbated by, national policies on opioids. The brain disease model of addiction was selectively deployed among the white middle-class population that had long accessed narcotics (...) and pharmaceutical treatments for narcotics disorders from biomedical clinics, as opposed to from illegal sources subject to law enforcement. In turn, new treatments for opioid addiction were racially marketed to the same white clientele to which newly patented opioid analgesics were marketed, tapping into a circumscribed but highly lucrative consumer base that has long benefited from a legally protected, racially segregated safe space for white narcotics consumption. The connecting thread for the contemporary white opioid “crisis,” therefore, is white race as a ghost variable in addiction neuroscience and in its pharmaceutical and biotechnological translation. In our racially unjust societies, what should white people do? In this paper, I survey answers to this question that recent work in ethics, social epistemology, and philosophy of race suggests.

The modern abundance and prominence of data has led to the development of “data science” as a new field of enquiry, along with a body of epistemological reflections upon its foundations, methods, and consequences. This article provides a systematic analysis and critical review of significant open problems and debates in the epistemology of data science. We propose a partition of the epistemology of data science into the following five domains: (i) the constitution of data science; (ii) the kind of enquiry (...) that it identifies; (iii) the kinds of knowledge that data science generates; (iv) the nature and epistemological significance of “black box” problems; and (v) the relationship between data science and the philosophy of science more generally. Er stellt zugleich eine Reaktion auf Birgit Althans‘ Beschreibung ihrer Scham beim Schauen der Zeugungsszene dar. Der Text positioniert sich damit zwischen dem ethnographisch erhobenen empirischen Material und den dazugehörigen responses: Er ist zugleich Feldnotiz und Reaktion, und spinnt die Fäden von dieser Zwischenposition ausgehend weiter.

This book presents a learned and ingenious attempt to understand the origin and nature of philosophical inquiry. It draws on material from numerous disciplines and from all periods of philosophy and provides challenging arguments on a wide range of topics. The author constructs a hierarchy of ontological claims, beginning with perceptual experience, moving to language and science. He traces subtle and unexpected relations among these and concludes by offering a system for classifying philosophical theories which reveals why they take the (...) form they do and why philosophical dispute is ineradicable. The doctrine of the three orders which distinguishes and hierarchizes flesh, spirit and charity is obviously one of the major themes of Pascal’s thought. But it appears that Pascal meditates as much on the disorder – and dis-order – induced by sin and the corruption of our nature as on the hierarchy and the heterogeneity of these three kinds of reality. In the world he describes, in fact, not only is everything overturned – the lowest order, that of the flesh, (...) now dominating the other two – but also everything is confused – pleasure, for example, obtaining the credence that normally belongs to science, and the flesh invading the order of the spirit through custom and imagination. To maintain then, as several commentators do, that no interference between the orders is possible, so that tyranny can only exist in the state of desire, is in our view to adopt a more Stoic than Pascalian point of view. For to deny disorder is also, according to Pascal, to deny sin by projecting into the second nature the memory of the first. (shrink)
