Humans are an exceptionally cooperative species, but there is substantial variation in the extent of cooperation across societies. Understanding the sources of this variability may provide insights about the forces that sustain cooperation. We examined the ontogeny of prosocial behavior by studying 326 children 3–14 y of age and 120 adults from six societies (age distributions varied across societies). These six societies span a wide range of extant human variation in culture, geography, and subsistence strategies, including foragers, herders, horticulturalists, and (...) urban dwellers across the Americas, Oceania, and Africa. When delivering benefits to others was personally costly, rates of prosocial behavior dropped across all six societies as children approached middle childhood and then rates of prosociality diverged as children tracked toward the behavior of adults in their own societies. When prosocial acts did not require personal sacrifice, prosocial responses increased steadily as children matured with little variation in behavior across societies. Our results are consistent with theories emphasizing the importance of acquired cultural norms in shaping costly forms of cooperation and creating cross-cultural diversity. (shrink)

If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

While some scholars lamented a medical overreach into social domains, others hailed its promise for social justice advocacy. Against the backdrop of a growing commitment to health equity across the nation, this article reviews historical interpretations of medicalization, offers an application of the term to non-biologic risk factors for disease, and presents the case of housing the demonstrate the great potential of medicalizing poverty.

The author gives a valuable assessment of Aeschylus' reaction to the then current ideas of Plato and Aristotle. The present volume is welcome for a dual reason; one that it marks the resumption, after a period of over twenty years, of the scholarly translations of St. Bonaventure, begun under Boehner; the second is the intrinsic value of the translation and lengthy introduction, almost a third of the book. Since the Saint Anthony Guild and Franciscan Herald Presses have published some of the shorter and more popular writings of the saint, it is fitting that the Franciscan Institute, noted for (...) its more technical philosophical and theological studies, should have chosen this series of disputed questions. They are undoubtedly one of Bonaventure's most mature and important writings, stemming from his days as the Franciscan regent master of theology at the University of Paris. The translator has already distinguished himself with a number of other articles and translations of the Seraphic Doctor. His scholarly and informative introduction falls into three chapters, one on the historical background, a second on the originality of Bonaventure's general trinitarian theology, and the third on the specific themes treated in this set of disputed questions. The first throws new light on the origin of the Dionysian and Richardian elements that separate Bonaventure's treatment of the trinity from that of Aquinas. Bonaventure became acquainted with pseudo-Dionysius and Richard of St. Victor through the Summa fratris Alexandri attributed to Alexander of Hales and the early Franciscan Masters at the Paris house of studies. Fontal plenitude, fecundity, and goodness, that figured largely in the Greek Fathers, are developed by Bonaventure in an original and personal way. The incompleteness of the Dionysian model is filled in by Richard's psychological analysis of love and his conception of personhood. Innascibility as the key characteristic of the Father is given a positive twist; it implies one who is first in an absolute sense as the summation of Parmenidean perfection and whose fontal plenitude is not only the source of the dual procession in the Trinity, but spills over into a richly diverse and continuing creation that bears in varying degrees the stamp of its triadic source. Man as microcosm mirrors this most of all, especially that man in whom the Logos, or macrocosm of archetypal ideas, became incarnate. It is only in treatment of the Son and his relationship to creation as exemplar cause that the distinctive influence of Augustine appears. In the final introductory chapter, the specific Trinitarian themes of unity, based on a dynamic rather than a static Aristotelian notion of deity, simplicity, infinity, eternity, immutability, necessity, and primacy are discussed and what emerges is a deeper appreciation of the synthetic genius of Bonaventure, who drew from such a myriad of sources, yet wove his material into a unique system in which philosophy functions not as a propadeutic to theology, but as an integral and essential part. For that reason the work is of far wider interest than an arcane theological study that only philosophers with a penchant for history might read with profit.--A.B.W. (shrink)

Medieval scholars will welcome these two latest volumes in the splendid critical edition of the nonpolitical works of William of Ockham by the Franciscan Institute of St. Bonaventure University. The first completes the set of Ockham’s major logical works that began with the publication of his monumental summa logicae in 1974 and was followed in 1978 by the second volume in the philosophical series, containing the commentaries on Porphyry and Aristotle’s Praedicamenta and Perihermenias, together with the famous tract on predestination (...) and God’s knowledge of future contingents. Known as the Expositio aurea super artem veterem, this second collection was still available in modern photo-reprints of earlier editions, but the Expositio super libros elenchorum, unlike the popular Summa logicae, was never printed before and this last of Ockham’s commentaries on Aristotle’s logical Organon appears here for the first time in other than manuscript form. Though less important than the other commentaries Ockham did on Aristotle at the Franciscan study house in London during the interim between his completion of the lectures on the Sentences and his summons to the papal court at Avignon in 1324, this work, which antedates his commentaries on the Physics, is not without interest. It illustrates, for instance, how Ockham understood "science" and the subject thereof, to say nothing of the light it throws on how he interpreted the various classical fallacies listed by Aristotle to which he continually refers throughout his other writings. Like the other volumes of this edition, this also contains an excellent analytic index that might well serve as a model for improving other critical editions of medieval works as research tools. It has been argued that patrilineal joint family systems tend to bias family planning decisions in favour of sons. A simple model suggests that in such societies, any given son will be more highly valued by his parents (1) the fewer his brothers and (2) the earlier his birth is in the brother series. A daughter's value will be greater (1) the fewer brothers she has and (2) the earlier her birth is relative to other sisters. This study first addresses (...) the extent of son preference as inferred from family composition data for 772 Taiwanese first-graders born in the mid-1970s in two socioeconomically distinct communities in Taipei, Taiwan. It then uses linear regression to consider whether the model criteria help account for statural variation among children in each study area when controlling for differences in measurement age, parental education and housing. With respect to family composition and gender preference, available evidence was consistent with previous surveys. While better-educated parents in the more affluent study area had significantly fewer children (p<0·0005) and were more willing to stop without a son, girls there, as in the less affluent area, were still significantly more likely than boys to belong to large sibships (p[less-than-or-equal]0·005). Evidence from mean height of males and females partially accords with hypothetical predictions. In the less affluent area, the interaction effect of male birth order and the presence of younger siblings was significantly associated with mean stature (p=0·002). Males without brothers were 2·0 cm taller than males with either an older or a younger brother (116·3 ± 0·5 cm vs 114·3 ± 0·4 cm). Males who had both younger and older brothers, but often no sisters, were about as tall, however, as those without brothers. A similar, but less pronounced, pattern was found amoung males in the more affluent area, but only among those who had sisters. These boys were also consistently shorter than boys without sisters (115·6 ± 0·6 cm vs 117·7 ± 0·6 cm; p=0·001). Patterns of mean female stature did not clearly support the hypothesis. Girls in the more affluent area were relatively tall and did not show significant variation. Results among less affluent girls showed significant contrasts, but not necessarily in the predicted direction. (shrink)

Semantic originalism is a theory of constitutional meaning that aims to disentangle the semantic, legal, and normative strands of debates in constitutional theory about the role of original meaning in constitutional interpretation and construction. This theory affirms four theses: (1) the fixation thesis, (2) the clause meaning thesis, (3) the contribution thesis, and (4) the fidelity thesis. -/- The fixation thesis claims that the semantic content of each constitutional provision is fixed at the time the provision is framed and ratified: (...) subsequent changes in linguistic practice cannot change the semantic content of an utterance. -/- The clause meaning thesis claims that the semantic content is given by the conventional semantic meaning (or original public meaning) of the text with four modifications. The first modification is provided by the publicly available context of constitutional utterance: words and phrases that might be ambiguous in isolation can become clear in light of those circumstances of framing and ratification that could be expected to known to interpreters of the Constitution across time. The second modification is provided by the idea of the division of linguistic labor: some constitutional provisions, such as the natural born citizen clause may be terms of art, the meaning of which are fixed by the usages of experts. The third modification is provided by the idea of constitutional implicature: the constitution may mean things it does not explicitly say. The fourth modification is provided by the idea of constitutional stipulations: the constitution brings into being new terms such as House of Representatives and the meaning of these terms is stipulated by the Constitution itself. -/- The contribution thesis asserts that the semantic content of the Constitution contributes to the law: the most plausible version of the contribution thesis is modest, claiming that the semantic content of the Constitution provides rules of constitutional law, subject to various qualifications. Our constitutional practice provides strong evidence for the modest version of the contribution thesis. -/- The fidelity thesis asserts that we have good reasons to affirm fidelity to constitutional law: virtuous citizens and officials are disposed to act in accord with the Constitution; right acting citizens and officials obey the constitution in normal circumstances; constitutional conformity produces good consequences. Our public political culture affirms the great value of the rule of law. -/- We can summarize semantic originalism as a slogan: The original public meaning of the constitution is the law and for that reason it should be respected and obeyed. The slogan recapitulates each of the claims made by semantic originalism, but it is potentially misleading because it does not clearly distinguish between the semantic claims made by the fixation and clause meaning theses, the legal claim made by the contribution thesis, and the normative claim made by the fidelity thesis. -/- Part I introduces the four theses. Part II is entitled An Opinionated History of Constitutional Originalism, and it provides the context for all that follows. Part III is entitled Semantic Originalism: A Theory of Constitutional Meaning, and it lays out the case for original public meaning as the best nonnormative theory of constitutional content. Part IV is entitled The Normative Implications of Semantic Originalism, and it articulates a variety of normative arguments for originalism. Part V is entitled Conclusion: Semantic Originalism and Living Constitutionalism, and it explores the broad implications of semantic originalism for living constitutionalism and the future of constitutional theory. Frickenhaus’ unjustly neglected arguments are here revived and reinforced. It is also argued that Plautus’ Cistellaria and Trinummus are further cases of the same phenomenon.

Majumder (bio)Human pluripotent stem cell research, meaning research into cells that can multiply indefinitely and differentiate into almost all the cells of the body, has become a minefield in which science, ethics, and politics have collided over the last decade in the United States. President Barack Obama entered this highly charged (...) territory when he indicated during his campaign that once in office he would issue an executive order expanding federally funded human embryonic stem cell (hESC) research and introduce rigorous oversight of it (Obama 2008a & b). Candidate Obama stated that he would require that the hESC lines involved were derived with donor consent from early embryos that otherwise would be discarded following in vitro fertilization (IVF) treatment. However, in contrast with the policy of President George W. Bush, he would do so without regard to the date of their derivation. He added that he would call upon the director of the National Institutes of Health (NIH) to develop guidelines for federally funded hESC and other pluripotent stem cell research that would draw from the guidelines developed in 2005 by the National Academies of Science (NAS) for privately funded research (National Research Council 2005).A similar policy was written into the 2008 version of the Stem Cell Research Enhancement Act, which reiterates the policy enunciated in earlier versions of this bill, passed twice by the Congress but vetoed by President Bush each time (House of Representatives, 110th Congress 2008).1 Depending on how one reads the 2008 version of the act, it could also apply in certain respects to hESC research that is not federally funded. We proceed on the assumption that the act applies at least to federally funded stem cell research. Therefore, it appears that the president or the Congress, or both, will approve of an expanded policy of federal funding of hESC research, as well as other forms of human pluripotent stem cell research. [End Page 79]This policy would make the guidelines developed by a committee appointed by NAS, a prestigious private body of American scientists and related experts, the primary basis for the development of new federal guidelines for oversight of hESC research in the United States. This would have certain advantages in that those familiar with the relevant scientific issues are likely to address them accurately and stem cell investigators are apt to accept restrictions on their research written by fellow scientists and ethics and policy experts whom they perceive as strong supporters of stem cell research. However, it also would have certain disadvantages. Chief among these is that the NAS committee appointed to write guidelines for this research, in its concern to see stem cell science move forward after a period in which many scientists and others maintained that it had been unduly restricted, might have overlooked or deferred consideration of some pressing ethical and policy issues. We maintain that this is the case—although we also maintain that the NAS guidelines provide a responsible foundation for developing NIH guidelines for stem cell research. Consequently, we propose that an NIH task force charged by the director of NIH with writing new guidelines for hESC and other stem cell research should revise and expand the NAS guidelines in ways that we propose below, as well as others that it considers necessary, and make it obligatory for those seeking federal funding of such research to follow these new guidelines.We highlight certain areas in which an ethical case can be made for strengthening the existing NAS guidelines and certain areas in which more fundamental ethical reflection—and building on that, additional guideline/policy development—seems warranted. Among the sections of the NAS guidelines that need clarification and reworking, we include those regarding consent to embryo donation, which provide one of their central focuses, and the development of human-nonhuman chimeras, which they address relatively briefly. This article examines the tradition of punitive house demolition during the Roman Republic, but from a sociocultural rather than institutional-legal perspective. Exploiting recent scholarship on the Roman house, on exemplarity, and on memory sanctions, I argue that narratives of house demolition constitute a form of ethically inflected political discourse, whose purpose is to stigmatize certain social actors as malefactors of a particular sort . The demolition itself is symbolically resonant, and the resultant stigma is propagated by subsequent monuments—various structures, toponyms, (...) narratives, etc.—that attach to the housesite. These monuments are thought to bear the trace of what went before, hence transmit an account of the alleged malefactor's deed and disgrace. Far from obliterating the doer of misdeeds, then, the discourse of punitive house demolition fixes him in cultural memory as a negative exemplum. (shrink)

The latest volume in the splendid critical edition of the Opera philosophica et theologica of William of Ockham in progress at the Franciscan Institute of St. Bonaventure University under the general editorship of Gedeon Gál, O.F.M. The project itself is something of a phenomenon in the area of critical editions of medieval Latin texts in terms of the rapidity at which quality volumes are produced at remarkably reasonable costs. Since 1967 five quarto volumes, totaling some three thousand four hundred pages, (...) have appeared. Three of these contain the first portion of Ockham’s most important theological work, the Ordinatio of his "commentary" on book 1 of the Sentences. The final portion is scheduled to appear early in 1979 as volume 4 of the Opera theologica. Volume 1 of the philosophical opera contains the monumental Summa Logicae, and volume 3 will also appear this year, thus completing with the present volume the edition of the most important of Ockham’s logical works. Editors are also assigned and are already at work on the other major non-political writings, notably the Quodlibet and commentaries on Aristotle’s Physics. Since the Opera politica Guillelmi de Ockham were published in three octavo volumes by the University of Manchester Press, we may expect to have very shortly substantially all the works of the Venerable Inceptor, thanks to the exceptional industry of a team of highly qualified researchers as well as substantial grants by the National Endowment for the Humanities and the De Rance Corporation. Two of the editors of individual works in the present volume are deceased. Father Philotheus Boehner, O.F.M., who came to the Franciscan Institute from Germany before the outbreak of World War II, first conceived of and began work on the critical edition. His text of the Tractatus de praedestinatione was first published in 1945 in Franciscan Institute Publications, Text Series No. 2 and was subsequently translated into English by M. M. Adams and N. Kretzmann in 1969. It differs little in Brown’s revision, which adds variants from the Bruges MS, unavailable to Boehner because of the war. The other posthumous edition is that of E. A. Moody. This too appeared in the aforesaid Text Series as No. 14. The present text is identical with the earlier version, but observations and suggested alternate readings by the general editor are added in footnotes. The thirty-two pages of introduction contains a wealth of information. To mention but two items: One concerns the probable reason why Ockham only incepted in theology but never served as regent master. This apparently had little or nothing to do with Lutterall’s opposition, as Chancellor of the University, to Ockham’s views and his summons later to the papal court at Avignon. It stemmed rather from the Franciscan custom of promoting those bachelors who had completed their magisterial studies to regent master on the basis of seniority. At his time a junior like Ockham could expect a wait of eight to ten years. It was during this period, beginning probably in 1321 that he began his lectures on logic, probably at the Franciscan house of studies in London where he later composed the Summa Logicae and his exposition of Aristotle’s Physics, before the summer of 1324 when he went to Avignon. Another item is the effective refutation of the authenticity views of Prantl and Anneliese Maier of the Expositiones and their relationship to the spurious and derivative Notabilia. As a final comment, we note that this second volume of the Opera philosophica contains all the works of Ockham edited by Marcus de Benevento under the title Expositio aurea et admodum utilis super artem veterem edita per Ven. This book is primarily for the patient and empathetic poetaster; it is a treasure-chest of themes on the imagination, metaphor, day-dream, and memory. Bachelard presents a phenomenology of the poetic image of inner or inhabited space, or what he terms "felicitous space." Inner space refers not only to the house of man but to the houses of things, drawers, chests, and wardrobes, and to the houses of animals, nests and shells. Bachelard's method is to articulate the many reverberations which any (...) poetic image calls forth in the reader's mind. He masterfully interprets the images which he draws from a vast amount of literary material and he is also adept at describing his own daydreams. In his recent book, Until Justice and Peace Embrace, Nicholas Wolterstorff claims that in ethics there exist “sustenance rights,” also called “positive rights,” which demand that people be provided the requirements of productive social living, including food, clothing, shelter, healthful environments, and elementary health care. I defend Wolterstorff’s claims against attacks by social theologian Richard John Neuhaus, who argues in effect that to grant sustenance rights implies both personal and theoretical acceptance of an unreasonable obligation which I call the Duty (...) of Sacrifice (DOS) to transfer all one’s wealth to meet those needs, a charge which Wolterstorff interprets as a demand that he sell his house. It was a bad day. First I presented my idea about a Central America protest to the faculty committee, but the committee played ping-pong with the idea until it was crushed. Then I met Robinson, who has somehow been able to present his theory of action in a serious journal. But the theory is a house of cards, and once his critics rattle the table a bit, the theory will come crashing down. And his book on the history of philosophy, (...) just published, is a cheap TV dinner. He does not understand how to study the history of thought. It is necessary to dig into hidden layers of thought, to uncover earlier strata, to map the subterranean patterns, and then to explain why upheavals take place when they do.The above paragraph contains a number of metaphorical sentences. Now all of the following are, I believe, facts about, or relevant to, those sentences. They can be true or false, and our behavior towards them shows that we take them as candidates for truth. I will be expected to offer evidence in support of their truth, and Robinson's supporters on the faculty, if they hear me state the sentences about him, will accuse me of having made false claims. It is generally clear, in regard to the metaphorical sentences under consideration, what would count as evidence for them and against them. (shrink)

Virgil, in his description of the establishment of a new city by Aeneas for those Trojans who wished to remain in Sicily, is thinking of the Roman practice of colonial foundation: ‘Meanwhile Aeneas marked out the city with the plough and allocated the houses ’. We may note the personal role of the founder, the ploughing of the ritual first furrow, the organized grants to the settlers and the equality of treatment implied in the use of lot . Virgil was (...) writing at the end of the first century B.C. at a time of great activity in land distribution, but the Romans had been founding colonies from the mid fourth century. Each colony involved the creation of an urban area and the settlement of people on the surrounding agricultural land, and so perpetuated the city state, which was central to ancient life and culture. Indeed a colony was a smaller image of Rome itself. In the early Republic, colonies, either of Latins or of Roman citizens, were established on the periphery of Roman territory, largely for military and strategic reasons. Between 200 and 173 B.C. more than 40,000 may have received plots of land, amounting to about 1,000 square miles of territory. Later, the motives for colonial foundations became more complex, being closely connected with increasing economic and political problems. There can have been few more important aspects in the development of colonies than the need to find land for discharged troops. These in the main were rank and file soldiers who would expect equal shares in land allocations. (shrink)

Spanish readers are fortunate in having a publishing house which is committed to reproduce in Spanish the complete works of Georg Lukács. The complete edition will consist of twenty-four, or more, volumes, of which ten are already in print, covering mainly Lukács works on esthetics and literary criticism. The Hegel volume was originally published in German in 1948. The main draft was written as early as the fall of 1938, but the outbreak of World War II delayed publication. Lukács at (...) that time was in the Soviet Union where, following Stalin's lead, Hegel was characterized as an apologist for the Prussian feudal opposition to the French revolution. Considering the winning of the war as more important than provoking a controversy over Hegel, Lukács put his manuscript aside for the duration. In The Young Hegel, Lukács settles his account with Hegel, much as Marx and Engels in The German Ideology--with one significant difference. The objective of Marx and Engels was the abolition of Hegelianism. Their polemic, therefore, was directed against Hegel and the neo-Hegelians. Lukács, on the other hand, sought the restoration of the Hegelian dimension of Marxism, and, while accepting the Marxian critique of Hegelianism, directed his attack against the detractors of Hegel--against the Stalin line within Marxism and against those like Dilthey and Kierkegaard outside of Marxism who transformed Hegel into an "irrationalist." Lukács is consequently much more positive in his treatment of Hegel than Marx and Engels. In History and Class Consciousness, Lukács emphasized the necessity of understanding Hegel in order to properly understand Marx. In The Young Hegel, the emphasis is on the dialectical opposite--Hegel is understood through the eyes of Marx, through the critique of Marx and through a Marxian interpretation by Lukács. Lukács' unique contribution in the present work is the detailed study of the close union of philosophy and economics in the genesis of Hegel's thought. Indeed, the original subtitle of the German edition reads: Über die Beziehungen von Dialektik und Ökonomie. The Spanish edition has a two-and-a-half page preface, written specially for it by Lukács in 1963, in which he states his conviction of the importance in the thought of Hegel and other great philosophers of concern with economic problems, both from the standpoint of economic theory and actual economic conditions. An English edition has been promised by Merlin Press in London, but no date of publication has yet been announced.--H. B. (shrink)
