The legitimacy of conscientious objection to abortion continues to fuel heated debate in Italy. In two recent decisions, the European Committee for Social Rights underlined that conscientious objection places safe, legal, and accessible care and services out of reach for most Italian women and that the measures that Italy has adopted to guarantee free access to abortion services are inadequate. Nevertheless, the Ministry of Health states that current Italian legislation, if appropriately applied, accommodates both the right to conscientious objection and (...) the right to voluntary abortion. One empirical argument used to demonstrate that conscientious objection does not create barriers to abortion is the “no correlation” argument, which the Italian Committee for Bioethics employed to demonstrate that no association exists between conscientious objection and waiting times for voluntary abortion in Italy and to support the weak form of conventional comprise adopted by the Italian legislation to balance the conflict between women’ autonomy and healthcare professionals’ moral integrity. Conversely, we showed how the “no correlation” argument fails to demonstrate the absence of a relationship between the number of conscientious objectors and waiting times for voluntary abortion, and that the limitations of the “no correlation” argument itself demonstrate how it is still difficult to describe the real effect of conscientious objection on the access to abortion services and to evaluate the suitability of conventional compromise to effectively balance conflicting moral principles. Further studies are needed to better describe the relationship between conscientious objection and waiting times for voluntary abortion. If new evidence would show that the increasing proportion of objectors does undermine the efficacy of the Italian law and the right of a woman to freely obtain a voluntary abortion, new ways will need to be found to address the conflict between moral principles and restrict the protection accorded to the principle of moral integrity. This would inevitably imply the need to constrain and to redefine the terms and conditions for claiming conscientious objection. (shrink)

In his Knowledge and Belief (1962), Hintikka establishes his system of epistemic logic with the KK (Knowing that One Knows, in symbols, Kp→KKp) principle (KK for short). However, his system of epistemic logic and the KK principle are grounded upon his strong notion of knowledge, which requires that knowledge is infallible, that is, it makes further inquiry pointless, and becomes ‘discussion-stopper’; knowledge implies truth, to wit, cognitive agents will not be mistaken in their knowledge; cognitive agents will be ‘perfect logicians’, (...) i.e. they have infinitive capability of logical inference. Hintikka calls the argument for KK from the strong notion of knowledge as the ‘transcendental argument’ for KK. Obviously, the strong notion of knowledge is far away from our ordinary conception of knowledge; based on such a strong sense of knowledge, epistemic logic has met the problem of logical omnipotence, and is difficult to apply in our ordinary cognitive practice. Mit dem Konzept "Nichtwissenskulturen" lasst sich sowohl theoretisch begreifen als auch empirisch analysieren, wie wissenschaftliche Erkenntnispraktiken mit dem Wissen zugleich neue Raume gewussten wie nicht-gewussten Nichtwissens hervorbringen. Wissenskulturen sind daher auch Nichtwissenskulturen, die sich anhand spezifischer Charakteristika ebenso voneinander unterscheiden wie vergleichen lassen. Die unterschiedlichen Nichtwissenskulturen stellen wichtige Bezugspunkte in (...) den offentlich-politischen Debatten uber den Umgang mit Nichtwissen dar. ABSTRACTBy means of critical reflection on the current situation of Chinese philosophy, this article aims to clarify two different approaches to philosophy. One is for scholars to focus on original texts and thought tradition, concerned with interpretation and inheritance; even in this way, scholars can achieve theoretical innovation through creative interpretation. The other is for researchers to face up questions from academics and from reality, and mainly to do theoretical creation in philosophy on a profound theoretical background, strictly following academic (...) norms and standards. For contemporary Chinese philosophy, the two approaches are indispensable, but the serious problem is that the first approach absolutely is dominant, but the second is too weak. The correct choice of Chinese philosophy should be to let hundreds of flower bloom, to let different approaches compete with each other, and to cooperatively establish the prosperity of contemporary Chinese philosophy. The debate on the yan-yi relation was carried out by Chinese philosophers collectively, and the principles and methods in the debate still belong to a living tradition of Chinese philosophy. From Yijing, Lunyu, Laozi and Zhuangzi to Wang Bi, "yi" which cannot be expressed fully by yan, is not only "idea" or "meaning" in the human mind, but is also some kind of ontological existence, which is beyond yan and emblematic symbols, and unspeakable. Thus, the debate on the yan-yi relation (...) refers firstly to metaphysics, secondly to moral philosophy, and then to epistemology and philosophy of language. Guided by this view, this paper recalls the source of the debate on the yan-yi relation to Yijing and Lunyu, distinguishes four meanings of "yi" in Chinese philosophy, and reconstructs three arguments. These arguments are the "yan cannot express yi fully" argument, "forget yan once you get yi" argument, and "yan can express yi fully" argument. Finally, this paper exposes and comments on those principles, methods and the general tendency shown in the debate from the following five aspects: starting point, value-preference, methodology, texts, and influences. The inscription edited in this paper is the third bilingual Chinese-Sogdian epitaph to be made known, following that of Wirkakk and Wiyusi and that of Nanai-vande and Kekan, published in 2005 and 2017 respectively. The new epitaph is that of a Sogdian lady who died in 736 CE. Apart from its linguistic interest, it is important as attesting the conversion of a Sogdian lady to the “heretical” Buddhist Sanjie or “Three levels” movement, which remained popular despite being officially suppressed under (...) the Tang. In Yizhuan’s interpretation of The Book of Changes, the book’s fundamental concepts, xiang 象 and ci 辞, play different roles. Concepts, including yin and yang, firmness and gentleness, sancai 三才, and the wuxing 五行, are used to interpret The Book of Changes through the interpretation of images, while the core Confucian values, such as benevolence and righteousness, are used to interpret The Book of Changes because of their connection with words of gua and yao. In order to expand the meaning (...) of the words of gua and yao, Yizhuan sometimes connects words with images; in other occasions, however, it simply takes these words as independent guides. The Confucian scholars who wrote Yizhuan, therefore, not only revered the classic, but also used it to send their own message. Out of reverence, they “shu 述 ”; in using it, they “zuo 作 ”. The combination of recitation and creation made the words of gua and yao very flexible in the process of interpretation, while the interpretation changed the meaning of the classic to a great extent. Researchers have consistently identified the disparity between teachers’ practical and legal knowledge regarding teachers’ right to discipline students. However, few studies have investigated teachers’ construction processes that form construction outcomes, which would help navigate the role of legislation in school discipline. This study contributes to a holistic picture of the neglected disciplinary rights that teachers construct in teaching practice and their underexplored attitude toward the law, using an interview-based constructionist method on twelve teachers of Lvliang city in a Chinese K-12 (...) context. The findings suggest that the participants prefer to acquire discipline knowledge by interacting with multiple power relations in their local environment and that their knowledge is historically and culturally specific. Although the disciplinary right they construct is never static, balanced, or essentialised, the participants’ constructions are commonly not in line with legal provisions or the aims of the law. Furthermore, school discipline legislation plays a silent role in empowering teachers to discipline students, but it is more visible in holding back teachers’ use of corporal punishment. These findings illustrate the complexity of implementing school disciplinary law as a universal national policy. (shrink)

Abstract:In the Chinese cultural imaginary, the road (Dao, “way”), especially trade routes, has always been an important metaphor for changing circumstances including shifting ideological grounds. Its own life trajectory is both classical and contemporary, and its emergence predates the trains, nation-states, sovereign powers, and so on, all such signs of techno-political modernity at work. Also in that regard, spiritually inflected images of the “West Heaven,” also an old name for India, where Buddhism originated, have always been present in East Asian (...) cultural spheres, which, in turn, points to the presence of a deeper Eurasian world connected through the Middle East as well. Now, however, quite strikingly, such global conceptual structures, long part of the evolving Chinese cultural tradition too, are being rapidly localized and recast into something else. For example, in China, Buddhism, a religion fundamentally critical of idol worshipping, has become pantheistic, and the political ideas that originally promoted equality newly patriarchal. For those living along the China Eastern Railway tracks in the twenty-first century, all such ideologies have become part of a tensional fight of gods in which they, too, are caught: on one hand they long for a linear progression of society that would never turn back, but on the other hand they are reluctant to abandon the self-comforting theory of reincarnation. This is also how they come to praise the imported concept of the motherland while worshipping figures of traditional patriarchal power. (shrink)

Although I do not have any final thoughts about the present topic, it might still be valuable to identify what questions are bothering many Chinese scholars. During an academic meeting last month Professor Yu Dunkang summarized the embarrassing situation confronting the study of Chinese philosophy today, as follows: "The object remains unclear, and the value is misplaced." The phrase "the object remains unclear" means that scholars are not sure what questions need to be studied in relation to what is called (...) "Chinese philosophy," while the phrase "the value is misplaced" means that scholars misunderstand the value and the meaning of their own work. To a large extent, this summary is correct; but the question is how this particular situation came into being. (shrink)

The traditional view that all logical truths are metaphysically necessary has come under attack in recent years. The contrary claim is prominent in David Kaplan’s work on demonstratives, and Edward Zalta has argued that logical truths that are not necessary appear in modal languages supplemented only with some device for making reference to the actual world (and thus independently of whether demonstratives like ‘I’, ‘here’, and ‘now’ are present). If this latter claim can be sustained, it strikes close to the (...) heart of the traditional view. I begin this paper by discussing and refuting Zalta’s argument in the context of a language for propositional modal logic with an actuality connective (section 1). This involves showing that his argument in favor of real world validity his preferred explication of logical truth, is fallacious. Next (section 2) I argue for an alternative explication of logical truth called general validity. Since the rule of necessitation preserves general validity, the argument of section 2 provides a reason for affirming the traditional view. Finally (section 3) I show that the intuitive idea behind the discredited notion of real world validity finds legitimate expression in an object language connective for deep necessity. (shrink)

It is common to distinguish between attributive and predicative goodness. There are good reasons to think that artistic value is a kind of attributive goodness. Surprisingly, however, much debate in philosophical aesthetics has proceeded as though artistic value is a kind of predicative goodness. As I shall argue, recognising that artistic value is attributive goodness has important consequences for a number of debates in aesthetics.

This article systematically challenges Kripke's modal argument and Soames's defence of this argument by arguing that, just like descriptions, names can take narrow or wide scopes over modalities, and that there is a big difference between the wide scope reading and the narrow scope reading of a modal sentence with a name. Its final conclusions are that all of Kripke's and Soames's arguments are untenable due to some fallacies or mistakes; names are not “rigid designators”; if there were rigid designators, (...) description(s) could be rigidified to refer fixedly to objects; so names cannot be distinguished in this way from the corresponding descriptions. A descriptivist account of names is still correct; and there is no justification for Kripke's theory of rigid designation and its consequences. (shrink)

The growing prominence of computers in contemporary life, often seemingly with minds of their own, invites rethinking the question of moral responsibility. If the moral responsibility for an act lies with the subject that carried it out, it follows that different concepts of the subject generate different views of moral responsibility. Some recent theorists have argued that actions are produced by composite, fluid subjects understood as extended agencies (cyborgs, actor networks). This view of the subject contrasts with methodological individualism: the (...) idea that actions are produced only by human individuals. This essay compares two views of responsibility: moral individualism (the ethical twin of methodological individualism), and joint responsibility (associated with extended agency theory). It develops a view of what joint responsibility might look like, and considers the advantages it might bring relative to moral individualism as well as the objections that are sure to be raised against it.
