Este trabajo tiene como objetivo responder a las críticas al liberalismo formuladas en un reciente trabajo de Carlos Kohn. Para mostrar esto expondré, en primer lugar, por qué pienso que Kohn generaliza ilegítimamente una concepción bastante estrecha de liberalismo, relacionada con la economía. En segundo lugar, por qué pienso que Kohn generaliza ilegítimamente una concepción bastante estrecha de liberalismo, relacionada con la economía. In this article, the dominant legitimating discursive strategies around the ever-increasing labour demands and ever-declining standards of safety and well-being at work in Spain are analysed through the lens of Boltanski and Thévenot’s (2006) view of the transformation of capitalism. A qualitative methodology based on semi-structured interviews is used. Results show that the justificatory arguments most commonly put forward by managers and experts are the logic of supply and demand, and values related to flexibility, resilience and adaptability to change. In (...) contrast, the stability and protection established in the twentieth century are widely cherished values, particularly among union representatives and some human resources specialists. We found that discourse practices map two specific legitimating categories (market values and a projects orientation), and one critical category (Civic World), but the critical category has no practical impact, as the predominant feeling is resignation. Our research describes the common attitudes to legitimacy in the job market and points to a deep discontent in some of its key agents. (shrink)

Lorenzo Sacconi and his coauthors have put forward the hypothesis that impartial agreements on distributive rules may generate a conditional preference for conformity. The observable effect of this preference would be compliance with fair distributive rules chosen behind a veil of ignorance, even in the absence of external coercion. This paper uses a Dictator Game with production and taking option to compare two ways in which the device of the veil of ignorance may be thought to generate a motivation for, (...) and compliance with a fair distributive rule: individually-as a thought experiment that should work as a moral cue- and collectively-as an actual process of agreement among subjects. The main result is that actual agreement proves to be necessary for agents to be led towards a fair distributive principle and to generate a significant amount of compliance in absence of external authority. This conclusion vindicates the role of actual agreements in generating motivational power in correspondence with fair distributive rules. (shrink)

Lorenzo Sacconi's The Social Contract of the Firm (Berlin, Springer, 2000) is a major contribution to the normative theory of the firm. It contains a full-fledged contractarian explanation of the role of Corporate Codes of Ethics. Sacconi proposes a game-theoretical model of the normative structure of the firm, including explicit and implicit contracts binding the members of the organisation, and the so-called constitutional contract: the hypothetical agreement that sets the basic co-operative structure in which the organisation consists. While Sacconi's theory (...) is sound and full of suggestions, it is doubtful whether it completely grasps the nature of organisational ethics. In presenting organisations as the product of an agreement among self-interested individuals, the model does not account for the social and systemic embeddedness of business institutions. This paper points to several shortcomings of Sacconi's view, and explores alternative understandings of a contractarian morality as applied to business ethics. (shrink)

Indeed, I would like to follow the evolution of Gauthier's thought not only to show how a thinker evolved from a particular view about a particular problem toward a quite original and suggestive formulation, but also to deepen our comprehension of moral contractarianism and its implications, by means of its contextualization. For this reason, I will focus not (...) on Gauthier's philosophical production as a whole , but on the papers and works that mark the line toward moral contractarianism as it is found in Morals by Agreement . The trajectory we are about to go over is not, therefore, only a personal adventure , but the adventure of ideas. This will not be an easy journey. Our focus on the historical development of concepts will prevent us from giving a fully systematic account of every one of them. The unfamiliar reader may be disappointed as we use somewhat strange terms without completely explaining their meaning. We beg acquiescence with our method, hoping that, on the whole, the essential ideas will be understandable without a detailed discussion. (shrink)

As an alternative, we propose an evolutionary game theoretic approach. We draw upon recent applications of evolutionary game theory to moral philosophy (Skyrms, Danielson), and we use a computer simulation of the trust game. We advance the thesis that the method of experimental economics can make significant contributions to normative, as opposed to descriptive, business ethics. We contend that there are two basic ways in which experimental economics may make this contribution, and we exemplify these ways by pointing to experimental support of social contract theory as rational foundation for business ethics. These two ways are: (1) adding psychological realism; and (2) testing some quasi-empirical assumptions present in normative theory. In order to make good (...) our methodological claim, we first describe the methodological rules of experimental economics, distinguishing this method from other behavioral business ethics approaches. We also contemplate the possible objection that empirical methods cannot bear on normative ethics because there is no way of bridging the gap between descriptive theory (how people behave) and normative theory (how people ought to behave). The article “Diálogos de paz en Colombia: una Mirada desde la justicia del resarcimiento”[1] holds that the end-of-conflict agreement signed by the Colombian government and the FARC does not bring any general utility; specially because of the absolute impunity that Transitional Justice implies. The deal is dubbed “utilitarian”, meaning that the agreement was made in the personal interests of those who intervened in it -Government and guerrilla-. El presente artículo expone la noción de “ser” de Maurice Nédoncelle. Primero se explica la tesis de este filósofo personalista francés sobre la reciprocidad de las conciencias. Enseguida se trata de su ontología en general. Luego, se discute su concepción sobre el ser entendido como relación trascendental. Sostengo que la concepción de Nédoncelle sobre el ser es coherente con las posiciones personalistas sobre la naturaleza de la persona.

O artigo analisa, a partir sobretudo do pensamento de Hannah Arendt, o desafio que representa para a política “viver junto”. Embora a expressão origine-se com o ensaísta francês Roland Barthes, o objetivo do artigo é quadruplo: (1) apresentar seu fundamento ontológico na condição humana ou existencial de “ser-com”, ou seja, de ser junto aos outros, pensada desde Martin Heidegger; (2) descrever seu sentido político pela conjugação entre isonomia e diferença na forma da pluralidade pela qual cada pessoa pode aparecer singularmente (...) em atos e palavras, de acordo com uma liberdade frente a quaisquer predeterminações; (3) demonstrar como a recente situação da pandemia de Covid-19 radicalizou o impasse de viver junto – e separado – em sociedade, particularmente no caso do Brasil, colocando em relevo uma dimensão coletiva da liberdade pela interdependência entre os seres humanos; e (4) apontar a importância da forma de governo da república, mas também os perigos da sua fragilização nas democracias contemporâneas no que se refere à dificuldade de responder – como viver junto? No presente texto procuramos apresentar um panorama da obra de Paulo Arantes analisando os pontos de contato entre sete de suas principais obras: Ressentimento da dialética, Sentimento de dialética, O fio da meada, Zero à esquerda, Extinção, O novo tempo do mundo e Um departamento francês de ultramar. Procurando ressaltar a preocupação fundamental que alinhava a diversidade temática dessas obras, nos esforçamos em reconstruir a argumentação de Arantes, em especial na medida que lida com o problema dos limites da modernização (...) capitalista, a relação entre esses limites e a racionalidade moderna, e a bizarra sobrevida civilizacional para além deles. Uno de los aspectos dominantes en los desarrollos de las ciencias sociales y las humanidades en la actualidad es la adaptación de enfoques naturalistas. Los programas naturalistas rechazan el estatuto de lo humano que había defendido tradicionalmente la filosofía al sostener que la conciencia es reducible a un hecho contingente y, por lo tanto, puede comprenderse desde un criterio meramente objetivista. El filósofo francés Jean-Marie Schaeffer llama a esta postura la “tesis de la excepción humana” y sostiene que la (...) fenomenología de Edmund Husserl es el último ejemplo de esta postura. Trataremos de mostrar que el antinaturalismo tan característico de la fenomenología husserliana es sostenible pese a la crítica de Schaeffer. En este sentido, buscamos explorar brevemente la posibilidad y sentido de una fenomenología naturalizada.One of the key aspects in the development of the social sciences and humanities today is the adaptation of naturalistic approaches. Naturalists programs reject the status of the human that had traditionally defended philosophy holding that consciousness is reducible to a contingent fact and, therefore, can be understood from a purely objectivist approach. The French philosopher Jean-Marie Schaeffer calls this approach the “thesis of human exception” and argues that the phenomenology of Edmund Husserl is the latest example of this approach. Try to show that the anti-naturalism so characteristic of Husserlian phenomenology is sustainable despite criticism of Schaeffer. The linguafranca, or Mediterranean pidgin, was spoken by sailors and merchants that sailed the Mediterranean Sea during centuries. This pidgin borrowed terms from languages such as: Castilian and Catalan, French and Provencal (Occitanian language), Italian, Genovese, and Venetian. Moreover, words of Arabic and Neogreek origins were added to al1 this common mass. So, this lingua is a great interesting resource to deal with the study of the Spanish naval histoy in the Mediterranean Sea from 12" to 13" century, when its (...) usage started to vanish. From 16" century on, it started to be spoken in America. This common language, between Romance language nations, only uses the infinitive verb for al1 tenses and modes of verb's conjugation. Nowadays, there are terms that still remain in sailors' language such as wind names: leveche, jaloque, maestral or mistral, tramontana; meteorological phenomena names: bórea or boria; and nomenclature for typical crafts: paramola, escálamo, car, batallol, laud or llaüt, latino. Morality, Mortality as a whole deals with certain aspects of ethical theory and with moral problems that arise primarily in contexts involving life‐and‐death decisions. The importance of the theoretical issues is not limited to their relevance to these decisions; however, they are, rather, issues at the heart of basic moral and political theory. This first volume comprises three parts. Part I, Death: From Bad to Worse, has with four chapters, and an appendix, discussing death and why it is bad for (...) the person who dies. Part II, Saving Lives: General Issues, has six chapters, and explores a cluster of moral problems that arise in saving lives. The general question raised is whether we should always, in aiding life, act so as to save the greater number of lives or to produce the greatest amount of good. Part III, Scarce Resources: Theoretical Issues, Specific Recommendations, and Organ Transplants, has five chapters, and deals with the problem of the acquisition and distribution of organs for transplantation. It allows us to apply the theoretical discussion of saving lives and relevant/irrelevant utilities presented in the previous parts. However, the discussion can be understood independently of the first two parts, and the conceptual issues and procedures on which it focuses are relevant to dealing with any scarce resource, including money and time, which are needed to use other plentiful resources. Although the book contains much theoretical and methodological argument, it is firmly grounded in practical ethical issues, and is illustrated throughout by examples. (shrink)

The problem of the finite and the infinite.--Pragmatism and a theory of knowledge.

This article examines arguments concerning enhancement of human persons recently presented by Michael Sandel (2004). In the first section, I briefly describe some of his arguments. In section two, I consider whether, as Sandel claims, the desire for mastery motivates enhancement and whether such a desire could be grounds for its impermissibility. Section three considers how Sandel draws the distinction between treatment and enhancement, and the relation to nature that he thinks each expresses. The fourth section examines Sandel's views about (...) parent/child relations and also how enhancement would affect distributive justice and the duty to aid. In conclusion, I briefly offer an alternative suggestion as to why enhancement may be troubling and consider what we could safely enhance. (shrink)

This volume continues the examination of issues of life and death which F.M. Kamm began in Morality, Mortality, Volume I. Kamm continues her development of a non-consequentialist ethical theory and its application to practical ethical problems. She looks at the distinction between killing and letting die, and between intending and foreseeing, and also at the concepts of rights, prerogatives, and supererogation. She shows that a sophisticated non-consequentialist theory can be modelled which copes convincingly with practical ethical issues, and throws considerable (...) light on some of the key distinctions and concepts of ethical discourse. Frances Kamm sets out to draw and make plausible distinctions that would show how and why it is, in some circumstances, permissible to kill some to save many more, but is not so in others. To do so she draws on a famous, and famously artificial, example of Judith Thomson, which illustrates the fact that people intutitively reject some instances of such killings but not others. The irrationality, implausibility and in many cases the self-defeating nature of such distinctions I had (...) attempted to expose in my 'The Survival Lottery' over 25 years ago. I still think these distinctions irrational and implausible and I will try, in this response, to show why this remains the case and why doctrines of additional effects, to however many powers they are taken, remain unhelpful in ethics. Based on a non-consequentialist ethical theory, this book critically examines the prevalent view that if a fetus has the moral standing of a person, it has a right to life and abortion is impermissible. Most discussion of abortion has assumed that this view is correct, and so has focused on the question of the personhood of the fetus. Kamm begins by considering in detail the permissibility of killing in non-abortion cases which are similar to abortion cases. She goes on to (...) consider the case for the permissibility of abortion in many types of pregnancies, including ones resulting from rape, voluntary pregnancy, and pregnancy resulting from a voluntary sex act, even if the fetus is considered a person. This argument emerges as part of a broader theory of creating new people responsibly. Kamm explores the implications of this argument for informed consent to abortion; responsibilities in pregnancy that is not aborted, and the significance of extra-uterine gestation devices for the permissibility of abortion. A common kind of explanation in cognitive neuroscience might be called functiontheoretic: with some target cognitive capacity in view, the theorist hypothesizes that the system computes a well-defined function (in the mathematical sense) and explains how computing this function constitutes (in the system’s normal environment) the exercise of the cognitive capacity. Recently, proponents of the so-called ‘new mechanist’ approach in philosophy of science have argued that a model of a cognitive capacity is explanatory only to the extent that it reveals (...) the causal structure of the mechanism underlying the capacity. If they are right, then a cognitive model that resists a transparent mapping to known neural mechanisms fails to be explanatory. I argue that a functiontheoretic characterization of a cognitive capacity can be genuinely explanatory even absent an account of how the capacity is realized in neural hardware. (shrink)

Prior studies have provided explanations for the presence, use and dissemination of codes of corporate ethics or codes of corporate conduct of business corporations. Most such explanations are functional in nature, and are descriptive as they are derived from the codes and their associated documents. We search for more underlying explanations using two complementary theories: first, social contract theories explaining the exogenous and endogenous reasons of organizational behavior, and then institutional theory explaining why organizations take similar measures in response to (...) institutional pressures. Based on our explanations, we contend that the codes and their use and dissemination are arising from underlying social and institutional pressures for firms to continuously validate their existence in the face of increasing changes and recurrent uncertainties. The Trolley Problem Mysteries considers whether who turns the trolley and/or how it is turned affect the moral permissibility of acting and suggests general proposals for when we may and may not harm some people to help others.

The phrase, “Without Authority,” is used so frequently by Kierkegaard that it becomes a kind of signature; yet it remains little understood. I argue that the phrase works to resist patriarchal, top-down, institutionally sanctioned authority: the authority of “direct” communication. Kierkegaard is not alone in contesting the tyranny of patriarchy: another tyranny—of anonymity, of the crowd—threatens to do away with patriarchal authority too, and with it all authority, all communication. Kierkegaard’s “without authority” defies patriarchy and does so at the risk (...) of this wild-fire destruction, for the sake of a different communication that might yet be possible. (shrink)
