The definitive establishment of public-private governance has forced to abandon the theories of political autonomy that were valid until a few decades ago. In return, there has been a boom in the autonomy of the right conceived as a recovery of the natural law inherent to Human Rights. This article rescues from oblivion the two main criticisms made in the second half of the twentieth century to Human Rights: that of the conservative jurist Ernst Forsthoff and that of (...) the Marxist philosopher Antonio Negri. Although these thinkers are completely antagonistic from the point of view of their political projects, both agree that, in the current technical societies where collaborative work prevails, the liberal conception of right is no longer able to function as a guarantor of the freedoms and empowerment of citizens: it has lost all capacity for control and organization of material production relationships. The Internationale Zeitschrift für Kulturphilosophie was quite a different journal be- fore 1933 than after. The Germanized version of the new title demonstrated this change offensively and shamelessly. A detailed analysis of some selected essays written by a representative group of authors who published in the journal in both periods – partly already from the very beginning, such as Heinrich Rickert, partly later on, such as Ernst Forsthoff – might continue to scandalize today’s reader: Af- ter 1933 these (...) authors lost all their inhibitions like former partisans who now could reveal their very identity. They prepared the journal for the political break by cre- ating a fatal continuity. (shrink)

This article addresses the boundaries of law and historiography in scrutinizing some rarely analyzed aspects of the works of Reinhart Koselleck. The article studies the significance of the tradition of ‘politico-juridical’ concepts in Koselleck’s thought, by tracing the intellectual history and biographies of some notable legal historians that for the large part defined the legal historical discourse after the Second World War. It is argued that a research of the connections between Koselleck and these legal historians provides an insight into (...) the themes of the temporality of law and the universality of legal concepts in Koselleck’s articles. In contextualizing the thinking and texts of Reinhart Koselleck, this article benefits from previously unused primary sources and illuminates the reference group and intellectual atmosphere in which Koselleck worked in and around 1968. Hier (...) aber machte sich alsbald eine eigentumliche Schwierigkeit geltend: die her kommliche logische Lehre vom Begriff zeigte sich in ihren bekannten Hauptzugen als unzureichend, die Probleme, zu denen die Prinzipienlehre der Mathematik hinfuhrt, auch nur vollstandig z u b e z e i c h n e n. Purpose: An attempt to interpret the fragments of Parmenides as a first suggestion of a constructivist epistemology. Today, two and a half millennia later, no one can be sure of what exactly Parmenides had in mind. Method: Reviewing the varying translations of acknowledged experts and paying attention to what Plato said in his Parmenides dialog. Findings: We cannot be certain of any interpretation, but an epistemologically unbiased review of the translations shows that Parmenides may well have believed that experience is (...) the domain accessible to human reason and the structure of the real world lies beyond it. Implications: Forerunners of constructivist ideas may have been overlooked because the interpreters of ancient texts were stuck in dogmatic views of “being.” When studying classical texts written in languages that are no longer spoken, it is fruitful to consult many different translations. Purpose: Radical constructivism holds that experiential reality is created by each individual. As a way of thinking, it unquestionably belongs to the theories of knowledge that are called “subjectivist” and “relativist”. This paper deals with the Italian philosopher Adriano Tilgher’s analysis of the relation between relativism and fascism and examines the possible impact of this connection on constructivism and its view of ethics. Approach: Conceptual analysis and the demonstration of a contradiction in Tilgher’s argumentation. Findings: A review of the ethics (...) inherent in Kant’s categorical imperative shows a tendency towards a subjectivism that may hint at anarchism but in no way implies fascism. Implications: This investigation should make it more difficult for critics of constructivism to relate it to fascism. (shrink)
