Fundado na obra de José Roberto Dromi, que estabelece as características do “constitucionalismo do futuro”, o presente trabalho busca delinear as características do novo constitucionalismo latino americano e traçar um paralelo entre os dois. Para tanto, através de uma abordagem dedutiva, será realizada uma pesquisa bibliográfica e estudo comparado das constituições latinas. Os pensamentos anticolonialistas são fundamentos desse novo modo de pensar o constitucionalismo, que devolve o poder ao povo, sustentando um Estado plurinacional, promovendo uma verdadeira refundação estatal. O objetivo deste trabalho é debater as formulações de Cruz Costa sobre a história e o destino da filosofia nacional, à luz de outros autores mais contemporâneos, como Ivan Domingues, intentando estabelecer qual seria o liame da filosofia brasileira, e se há possibilidade de traçar um quadro de nossa produção bem como um vaticínio de seu futuro. Destarte, traçamos uma breve história da produção filosófica nacional, seguindo Cruz Costa e Domingues, chegando aos dias atuais e discutindo (...) se a predição de Cruz Costa sobre a filosofia brasileira se mantém. Ao mesmo tempo em que empreendemos este debate metafilosófico, fazemos breve incursão na história e na economia brasileira, passando por uma discussão pedagógica lacônica, sobre o fazer filosofia no Brasil e sua inserção no mundo atual, nos valendo de autores como Chang, a fim de precisar o papel da filosofia e do filósofo no país. True ecotourism requires us to regain an understanding of the inextricable links between the habitats of a region, including its inhabitants, and their habits. With this systemic approach that integrates economic, ecological, and ethical dimensions, we define ecotourism as “an invitation to a journey (‘tour’) to appreciate and share the ‘homes’ (oikos) of diverse human and non-human inhabitants, their singular habits and habitats.” Today, mass nature tourism often denies theselinks and is generating biocultural homogenization, socio-ecological degradation, and marked distributive injustices (...) in iconic places, such as Costa Rica, the Galapagos and Cape Horn. In order to implement genuine ecotourism in Latin America and elsewhere, it is imperative to overcome marketing ambiguities, and pay close attention to local autonomy and biocultural diversity. La presente investigación aborda el estudio de las transformaciones producidas en el paisaje del poblado de Puerto Morelos, Quintana Roo, por la incorporación de la actividad turística en la vida cotidiana de sus pobladores. A medida que los objetos, usos y el lenguaje del turismo se incorporan a las costumbres, tradiciones, relaciones sociales y estilos de vida de la población; los espacios de vida -laboral, vecinal, doméstico y de ocio- adquieren características físicas poco tradicionales y formas excluyentes de aprovechamiento que (...) contribuyen a configurar y fortalecer paisajes funcionales al capital turístico. La propiedad privada y el mercado de tierras, las políticas para la conservación de los recursos naturales, la deslocalización empresarial, la imagen turística y las oleadas migratorias son factores que han permitido la reorganización de los espacios de vida y, por consiguiente, la configuración de diversos paisajes turísticos a lo largo de la costa. This paper develops an endurantist theory of persistence. The theory is built around one basic tenet, which concerns existence at a time – the relation between an object and the times at which that object is present. According to this tenet, which I call transcendentism, for an object to exist at a time is for it to participate in events that are located at that time. I argue that transcendentism is a semantically grounded and metaphysically fruitful. It is semantically grounded, (...) insofar as a semantic analysis of our temporal talk favors it over rivals. It is metaphysically fruitful, insofar as the theory of persistence that can be built around it – the transcendentist theory of persistence, to give it a name – requires neither temporal parts nor the problematic commitments to which all extant forms of endurantism are committed, such as the possibility of extended simples or multilocation. Speculative fiction, such as science fiction and fantasy, has a unique epistemic value. We examine similarities and differences between speculative fiction and philosophical thought experiments in terms of how they are cognitively processed. They are similar in their reliance on mental prospection, but dissimilar in that fiction is better able to draw in readers (transportation) and elicit emotional responses. By its use of longer, emotionally poignant narratives and seemingly irrelevant details, speculative fiction allows for a better appraisal of the consequences (...) of philosophical ideas than thought experiments. Despite the economic relevance and distinctiveness of family firms, little attention has been devoted to researching their nature and functioning. Traditionally, family firms have been associated both to positive and negative features in their relationships with the stakeholders. This can be linked to different orientations toward corporate social responsibility. Thus, this research aims to identify the approaches that Spanish family firms maintain about social responsibility, based on the model developed by Quazi and O' Brien Journal of Business Ethics 25, 33-51 (...) (2000). An empirical study carried out for 112 Spanish family firms gives support to our initial assumption about these organizations not being a homogeneous group in terms of their orientation towards corporate social responsibility. The differences in perceptions do not seem to be associated to biographical characteristics. These results lead to some relevant academic and practical implications that suggest interesting lines for future research. (shrink)

This paper takes a cognitive perspective to assess the significance of some Late Palaeolithic artefacts (sculptures and engraved objects) for philosophicalconcepts of art. We examine cognitive capacities that are necessary to produceand recognize objects that are denoted as art. These include the ability toattribute and infer design (design stance), the ability to distinguish between themateriality of an object and its meaning (symbol-mindedness), and an aesthetic sensitivity to some perceptual stimuli. An introduction to the model-theoretic approach in the philosophy of science is given and it is argued that this program is further enhanced by the introduction of partial structures. It is then shown that this leads to a natural and intuitive account of both "iconic" and mathematical models and of the role of the former in science itself.

Physical superpositions exist both in classical and in quantum physics. However, what is exactly meant by ‘superposition’ in each case is extremely different. In this paper we discuss some of the multiple interpretations which exist in the literature regarding superpositions in quantum mechanics. We argue that all these interpretations have something in common: they all attempt to avoid ‘contradiction’. We argue in this paper, in favor of the importance of developing a new interpretation of superpositions which takes into account contradiction, (...) as a key element of the formal structure of the theory, “right from the start”. In order to show the feasibility of our interpretational project we present an outline of a paraconsistent approach to quantum superpositions which attempts to account for the contradictory properties present in general within quantum superpositions. This approach must not be understood as a closed formal and conceptual scheme but rather as a first step towards a different type of understanding regarding quantum superpositions. (shrink)

The purpose of the present paper is to consider the traditional interpretive problems of quantum mechanics from the viewpoint of a modal ontology of properties. In particular, we will try to delineate a quantum ontology that (i) is modal, because describes the structure of the realm of possibility, and (ii) lacks the ontological category of individual. The final goal is to supply an adequate account of quantum non-individuality on the basis of this ontology.

This book features a theoretical depiction of the Italian phenomenological tradition. It brings together the main Italian phenomenologists of the present to discuss the positions and theories of the most important Italian phenomenologists of the past. Those profiled include Antonio Banfi, Sofia Vanni Rovighi, Enzo Paci, Dino Formaggio, Giuseppe Semerari, Enzo Melandri, Paolo Bozzi, Carlo Sini, Giovanni Piana and Paolo Parrini. This collection shows not only the variety of perspectives but also the inner consistency, peculiarity and originality of the tradition. (...) Moreover, the contributors connect continental and analytical traditions, the scientific approach and existentialism. Italian phenomenology, the rise of which dates back to Antonio Banfi’s writings on Husserl in 1923, proves to be from its very beginning, a relational philosophy. It is a philosophy that is capable, precisely by means of its method, of developing actual forms of communication and exchange among the different sciences. Our purpose in this paper is to delineate an ontology for quantum mechanics that results adequate to the formalism of the theory. We will restrict our aim to the search of an ontology that expresses the conceptual content of the recently proposed modal-Hamiltonian interpretation, according to which the domain referred to by non-relativistic quantum mechanics is an ontology of properties. The usual strategy in the literature has been to focus on only one of the interpretive problems of the theory and (...) to design an interpretation to solve it, leaving aside the remaining difficulties. On the contrary, our aim in the present work is to formulate a “global” solution, according to which different problems can be adequately tackled in terms of a single ontology populated of properties, in which systems are bundles of properties. In particular, we will conceive indistinguishability between bundles as a relation derived from indistinguishability between properties, and we will show that states, when operating on combinations of indistinguishable bundles, act as if they were symmetric with no need of a symmetrization postulate. The republican revival in political philosophy, political theory, and legal theory has produced an impressive range of novel interpretations of the historical figures of the republican tradition. It has also given rise to a variety of contemporary neo-republican theories that build on its historical themes. Although there have been some feminist discussions of its historical representatives, neo-republicanism has not generated a great deal of enthusiasm among feminists. The present paper examines Phillip Pettit's theory of freedom as nondomination in order to (...) assess its potential usefulness for those with feminist goals. It defends Pettit's account of interpersonal domination from certain feminist objections, but argues that his account of state domination needs to be amended if it is fully to protect the interests of women and other groups. This study provides empirical evidence on how corporate sustainability performance (CSP), as proxied by membership of the Dow Jones sustainability index, is reflected in the market value of equity. Using a theoretical framework combining institutional perspectives, stake-holder theory, and resource-based perspectives, we develop a set of hypotheses that relate the market value of equity to CSP. For a sample of North American firms, our preliminary results show that CSP has significant explanatory power for stock prices over the traditional summary accounting (...) measures such as earnings and book value of equity. However, further analyses suggest that we should not focus on corporate sustainability itself. Our findings suggest that what investors really do is to penalize large profitable firms with low level of CSP. Firms with incentives to develop a high level of CSP not engaging on such strategy are, thus, penalized by the market. (shrink)

Empirical research in the psychology of nature appreciation suggests that humans across cultures tend to evaluate nature in positive aesthetic terms, including a sense of beauty and awe. They also frequently engage in joint attention with other persons, whereby they are jointly aware of sharing attention to the same event or object. This paper examines how, from a natural theological perspective, delight in natural beauty can be conceptualized as a way of joining attention to creation. Drawing on an analogy between (...) art and creation, we propose that aesthetic appreciation of nature may provide theists with a unique phenomenological insight into God's creative intentions, which are embodied in the physical beauty of creation. We suggest two directions in which this way of looking at the natural world can be fleshed out: in a spontaneous way, that does not take into account background information, and with the help of science. This article discusses Philip Pettit’s neo-republicanism in light of the criterion of self-sustenance: the requirement that a political theory be capable of serving as a self-sustaining public philosophy for a pluralist democracy. It argues that this criterion can only be satisfied by developing an adequate politics of virtue. Pettit’s theory is built around the notion of freedom as non-domination, and he does not say much about the virtues of citizens or the policies the state may employ to encourage their development. (...) In order to explain the motivation to comply with republican laws that promote non-domination, Pettit relies on the phenomenon of civility and the mechanism of the intangible hand. But to understand what underlies an adequate level of robust civility one needs to focus on the more basic phenomenon of personal virtue. Policies that aim to promote non-domination should take into account the need to cultivate virtue among citizens, as well as the full range of conditions that favor its exercise. (shrink)

We apply the recently elaborated notions of ‘pragmatic truth’ and ‘pragmatic probability’ to the problem of the construction of a logic of inductive inference. It is argued that the system outlined here is able to overcome many of the objections usually levelled against such attempts. We claim, furthermore, that our view captures the essentially cumulative nature of science and allows us to explain why it is indeed reasonable to accept and believe in the conclusions reached by inductive inference.

How to accept a conditional? F. P. Ramsey proposed the following test in (Ramsey 1990).(RT) If A, then B must be accepted with respect to the current epistemic state iff the minimal hypothetical change of it needed to accept A also requires accepting B.

To survive and be successful in today's setting of globalisation and complexity, companies are obliged to think in wider strategic terms, developing active and enterprising strategies that include social, political and ecological elements, besides the economic ones. The analysis of the relationship between companies and society is especially interesting when these companies operate in international markets. Countries demand that large corporations contribute to local, regional and national development in such a way that their resources are exchanged for a significant increase (...) in their citizens' quality of life. Faced with that fact, the aim of this work is to establish what actions the subsidiaries will take in order to offer a response to the needs of their stakeholders in the host countries. Secondly, we attempt to identify the factors explaining the different levels of social response of the subsidiaries established in a particular country by different parent companies. The empirical study was carried out on a sample of Spanish subsidiaries in the two manufacturing industries with most foreign investment (the chemical and automobile industries) and the results obtained both confirmed the validity of the tool used to measure social response and permitted us to determine which factors influence the institutionalisation of social responsiveness. This paper describes a community event organized in response to the appropriation and overreliance on the psychiatric patient “personal story” within mental health organizations. The sharing of experiences through stories by individuals who self-identify as having “lived experience” has been central to the history of organizing for change in and outside of the psychiatric system. However, in the last decade, personal stories have increasingly been used by the psychiatric system to bolster research, education, and fundraising interests. We explore how personal (...) stories from consumer/survivors have been harnessed by mental health organizations to further their interests and in so doing have shifted these narrations from “agents of change” towards one of “disability tourism” or “patient porn.” We mark the ethical dilemmas of narrative cooptation and consumption, and query how stories of resistance can be reclaimed not as personal recovery narratives but rather as a tool for socio-political change.
