The study analyses the issues of protection of national minorities from the perspective of international law. The study consists of three parts. In the first part, the author reveals the understanding of a national minority on the basis of objective and subjective features. This part focuses on such problematic issues as national minorities and citizenship, non-dominant position of a national minority. The second part of the study concentrates on international minorities as subjects of international law. The author analyses international legal (...) subjectivity of national minorities. A question is raised whether the rights of national minorities are individual or collective rights. The third part of the study focuses on the analysis of normative basis for the protection of national minorities. The author notes that the monist system exists in the Republic of Lithuania regarding the relation of international and national law. Under this system, the international treaties ratified by the Lithuanian Parliament (Seimas) are seen as an indivisible part of the legal system of the Republic of Lithuania. Therefore, the Convention for the Protection of National Minorities is an international treaty that is directly applicable in the legal system of the Republic of Lithuania. The fourth part of the study focuses on the question whether Lithuania should become a party to the European Charter for Regional or Minority Languages. Although this issue is complex and includes the problems of political, economic, legal and other nature, the author focuses on the legal analysis of the problems related to the participation in the Charter. It is emphasised that the Charter is not the only document that ensures the linguistic rights of national minorities. Under the Law on International Treaties of the Republic of Lithuania, while considering participation in the Charter, the right of treaty initiative should be implemented, and the question of efficiency of the treaty must also be solved. The protection of national minorities forms a constituent part of the international protection of human rights. General human rights treaties (the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention for the Protection of Human Rights and Fundamental Freedoms and others) create guarantees for the protection of persons belonging to national minorities on the basis of individual human rights. Although the mentioned treaties are not specifically devoted for the protection of national (...) minorities, it is important to underline that non-minorities treaties establish articles of special relevance for persons belonging to national minorities. Non-minorities treaties on the basis of non-discrimination and equality oblige the contracting states to ensure equal treatment of persons, including those belonging to national minorities. It may be noticed that non-minorities treaties provide the protection for persons belonging to national minorities indirectly through the interpretation of the ambit of general human rights. The core question is whether the protection granted on the basis of general human rights is sufficient for the effective protection of persons belonging to national minorities. The aim of the article is to analyze general and specialized international legal grounds of special significance for persons belonging to national minorities in order to determine the particularities of the protection granted for them. The conclusion is drawn that general human rights alone do not effectively protect national minorities: general human rights contribute to the protection of persons belonging to national minorities as a supplement element that inextricably interrelates with specialized rights together comprising the protection devoted to national minorities. The article deals with the application rationae personae of the right to selfdetermination. Relying on the existing international legal framework, decisions of the judicial bodies and doctrine, the author analyses conceivable beneficiaries of the above-mentioned right: the inhabitants of Trust and Non-Self-Governing territories, peoples under foreign occupation, the entire population of a state and subgroups within a state.

Šiuo metu vykstančio fenomenologinės psichopatologijos atsinaujinimo kontekste straipsnyje pristatoma viena esminių fenomenologinės psichopatologijos prielaidų – poreikis prasmingai inkorporuoti su patologija susidūrusio subjekto potyrius į jo gyvenimo naratyvą. Aptariama, kaip psichozei progresuojant subjektas palaipsniui praranda agentiškumą savo dėmesio bei prasmių kūrimo atžvilgiu. Pasitelkiant W. Gombrowicziaus romaną Kosmosas rekonstruojamas aktyviosios psichozės stadijos epizodas – subjekto dėmesį ir prasmę struktūruojantys centrai įsisteigia tarytum nepriklausomai nuo jo, jų pagrindu besikuriantiems kliedesiams plečiantis tampa vis sunkiau išlaikyti ryšį su supančiu pasauliu. Naratyvo kūrimas tokioje (...) situacijoje pasirodo kaip savigydos pastanga – mėginimas pakitusio patyrimo epizodus prasmingai inkorporuoti atgal į savo agentiškumo sritį. Dėl šios priežasties pabrėžiama, kad psichoterapijoje svarbu ne mėginti pakeisti subjekto naratyvą racionalizuotu terapeuto kuriamu naratyvu, o įtraukti subjektą į kooperatyvų dialogą apie asmeninę jo potyrių prasmę. Gene editing in the environment must consider uncertainty about potential benefits and risks for different populations and under different conditions. There are disagreements about the weight and balance of harms and benefits. Deliberative and community‐led approaches offer the opportunity to engage and empower diverse publics to co‐create responses and solutions to controversial policy choices in a manner that is inclusive of diverse perspectives. Stories, understood as situated accounts that reflect a person's life experiences, can enable the articulation of nuanced perspectives, (...) diversify how perspectives are communicated, encourage wider participation, open dominant perspectives to challenge, and invite participants to assess appropriate empathy and precaution in collective positions. An emphasis on storytelling in deliberations on gene editing of organisms emphasizes carefully designed recruitment and facilitation to support hearing from a range of perspectives, including those that present a different set of assumptions than those that may be held by experts or other stakeholders, among these, consideration of how to understand our relationships to nature. The authors find East Asians to be holistic, attending to the entire field and assigning causality to it, making relatively little use of categories and formal logic, and relying on "dialectical" reasoning, whereas Westerners, are more analytic, paying attention primarily to the object and the categories to which it belongs and using rules, including formal logic, to understand its behavior. The 2 types of cognitive processes are embedded in different naive metaphysical systems and tacit epistemologies. The authors speculate that the (...) origin of these differences is traceable to markedly different social systems. Our current work seeks to provide direct empirical evidence on whether Chinese international students’ experiences studying abroad promote dialectical thinking. We collected behavioral data from 258 Chinese international students studying in multiple regions. We found that there was a main effect among the four conditions. More specifically, when primed with studying abroad or typical day, participants were more likely to show tolerance for contradiction by deeming both sides of contradictory scientific statements as convincing and rating them more favorably. Therefore, it (...) is plausible that Chinese international students’ experiences studying abroad promote their dialectical thinking. More work is needed to further this line of research by extending these effects with other measures of dialectical thinking such as perception of interconnectedness and prediction of change, adopting differing paradigms to provide more robust findings, and probing the underlying processes as to why experiences studying abroad promote dialectical thinking. Who can feel both happy and sad at the same time, but not discomfort? This study aimed to investigate the cultural differences in mixed emotional experiences induced by conflict stimuli among American and Chinese undergraduate students. In total, 160 Americans and 158 Chinese watched two different valence advertisements (one predominantly positive and the other predominantly negative) that elicited mixed emotions; their feelings were assessed through self-reported measures. Findings indicated the impact that cultural differences have in people’s mixed emotional experiences depends (...) on the emotional components of the mixed emotional situations. The Americans and Chinese both experience a comparably intense mixture of emotions in different valence situations, but their discomfort toward conflicting stimuli is different. Further, dialectical thinking may be a mechanism behind the influence of cultural differences in people’s mixed emotional experiences. Implications for emotion theory and research are discussed. Recent research suggests that individuals from East Asian and Western cultures differ in the degree to which they hold a folk world view known as naïve dialecticism, which is characterized by tolerance for contradiction, expectation of change, and cognitive holism. The current research utilizes the Mouse Paradigm to investigate the dynamic nature of naïve dialecticism in real time by measuring individuals’ fluctuations in judgment during the process of contemplation. The results showed cultural differences in dynamic measures of evaluation process: Japanese (...) participants took more time to stabilize their thought and showed more fluctuations in their judgment than American participants. These cultural differences were fully mediated by individual differences in levels of naïve dialecticism as measured by the level of dialectical self-views. Resumo: O presente artigo sistematiza informações sobre a implementação do Programa Jovem de Futuro, PJF, na rede estadual de ensino no Pará, considerando suas implicações para o Direito Humano à Educação, DHE, de acordo com o proposto no Pacto Internacional sobre os Direitos Econômicos, Sociais e Culturais- PIDESC, que demarca quatro indicadores da ação estatal para a asseguramento do direito à Educação. São eles: Disponibilidade, Acessibilidade, Aceitabilidade, Adaptabilidade e, ainda, Controle Social incorporado na matriz de pesquisa. Em diálogo com tais (...) indicadores, coletamos informações em páginas oficiais da Secretaria Estadual de Educação do Pará e do ator privado responsável pela implementação do Programa, o Instituto Unibanco. Procedemos análise de documentos oficiais localizados nas referidas páginas, além de consultar a produção nacional sobre o PJF, com ênfase à sua consolidação no estado do Pará, no período de 2011-2018. A pesquisa de tipo qualitativa, apoiada em revisão bibliográfica, análise documental e coleta de dados de fontes primárias e secundárias, possibilitou a constatação de forte influência do setor privado na educação pública paraense, que direcionou a adoção de modelos de gestão empresarial para a obtenção de melhores resultados educacionais, com controle e monitoramento em todas as etapas do PJF, com sérias consequências ao DHE. The Jovem de Futuro program in Pará and the implications for the Human Right to Education – DHE Abstract: The article systematizes information about the implementation of the The Youth with a Future Program - PJF in the state education in Pará, considering its implications for the Human Right to Education - DHE, in accordance with what is proposed in the International Covenant on Economic, Social and Cultural Rights - ICESCR, which outlines four indicators of state action to ensure the right to education. They are: Availability, Accessibility, Acceptability, Adaptability and accountability incorporated in the research matrix. Related with these indicators, we collected information on official pages of the Pará State Department of Education and on the private actor responsible for implementing the Program, Instituto Unibanco. We proceeded to the analysis of official documents located on the referred pages, in addition to consulting the national academic production on the PJF, with emphasis on its consolidation in the state of Pará, in the period 2011-2018. Qualitative research, supported by a bibliographic review, document analysis and data collection from primary and secondary sources, made it possible to verify the strong influence of the private sector on public education in Pará, which led to the adoption of business management models to obtain better results. educational institutions, with control and monitoring at all stages of the PJF, with serious consequences for the DHE. Studies suggest that emotional complexity—the experience of positive and negative emotion in response to the same event—is unusual in Western samples. However, recent research finds that the co-occurrence of positive and negative emotion during unstructured situations is more common among East Asians than Westerners, consistent with theories emphasising the prevalence of dialectical folk epistemology in East-Asian culture. The present study builds upon previous research by examining Asian- and European-Americans' experience of a particular positive emotion—love—and a situationally appropriate negative emotion during (...) four structured laboratory conversations with their romantic partner. Among Asian Americans, love and the experience of negative emotion were typically less negatively correlated during these conversations than was true for European Americans. (shrink)

This article analyses that state responsibility in international law is contractual liability, as a state infringes its obligations to another state (states), stemming out of international law. Member State liability in damages to a private party for breach of European Union law is, contrarily, non-contractual liability to a private party. Having analysed the elements of internationally wrongful act, it is stated that the elements of internationally wrongful act can be used to determine the elements of breach of the European Union (...) law. Thus if an international court declares that a state committed an internationally wrongful act, it would be possible to maintain that the elements of breach of the European Union law are met as well. The author of this article notes that it is very important to identify a particular state institution, which has infringed the European Union or international law, as not attributing to the state the acts of the state institution under the European Union or international law, there should be no possibility to apply state liability in damages to a private party for breach of the European Union law or state responsibility in international law – the state can be liable only for acts of its institutions. This article also analyses the cases where application of both Member State’s liability in damages to a private party for breach of the European Union law and state responsibility in international could be possible. In such case a private party can suffer damages if a Member State breaches an international agreement, concluded by the European Union, imposing particular obligations on that Member State. Therefore, it is ascertained that a private party should not have to prove the second condition of liability – sufficient seriousness of the breach1 – if an international court foremost states that a Member State commited an internationally wrongful act – breached its obligation arising out of an international agreement entered into by the European Union. Such an infringement would be considered to be as sufficiently serious per se. (shrink)

The paper analyses the relevant issue of the relationship of international law and European Union law. Therefore, independent systems of law exist, which inevitably arise the issue of relationship and interaction of these systems. Legal literature analyses the question of the relationship of these two systems of law on the basis of various aspects. The author has chosen the following structure of the paper: first, the general problem of the relationship of international and European Union law is discussed. While describing (...) the problem, the nature of the European Union and international law, as well as the distinguishing features of these systems of law, is analysed. The paper also provides a discussion about the decisions of the Strasbourg court and the Court of Justice of the European Union, which provide the basis of solving the problem of the relationship of these systems of law. In the second part of this paper, the main theories are analysed: the monistic, dualistic and coordination theories, which can be used to answer the issue of interaction of the two systems of law – international law and European Union law. Hannah Arendt plačiai žinoma kaip filosofė, kuri mėgino reabilituoti senovės graikų politikos sampratą. Remiantis Žmogaus būklės skaitymu, Arendt paprastai laikoma „graikofile“, jai prikišama „Atėnų nostalgija“. Sunku paneigti Arendt simpatijas graikams – ji iš tiesų atsigręžė į atėniečių politikos supratimą, bandydama jame iškristalizuoti kertinius autentiškos politikos elementus. Vis dėlto ši interpretacija yra pernelyg vienpusiška. Didžiausius nuopelnus politikos suvokimo srityje Arendt priskiria ne graikams, o romėnams. Pastarieji žymiai geriau sprendė politikos stabilumo, tęstinumo ir tvarumo problemą. Visą dėmesį sutelkiant į veiksmą, spontaniškumą (...) ir nepaprastus žygdarbius, kyla grėsmė destabilizuoti ir „išcentruoti“ politinės bend­rijos gyvenimą. Romėnai, įvesdami tokias sąvokas kaip tradicija, autoritetas, steigties (įkūrimo) šventumas, teisė (lex), taip pat pabrėždami politinę atleidimo ir pažado reikšmę, atveria graikams svetimą politinės sedimentacijos plotmę. Ši plotmė suteikia būtinus saugiklius, be kurių tvari politinė egzistencija yra neįmanoma. (shrink)

Lietuvos, kaip ir kitų Europos valstybių, teisės aktai numato bendrovės visuotinio akcininkų susirinkimo sprendimų teisėtumo užtikrinimo priemonę – tokių sprendimų pripažinimo negaliojančiais institutą. Civiliniame kodekse išvardijami teisiniai šio instituto taikymo pagrindai. Kita vertus, visuotinio akcininkų susirinkimo sprendimų pripažinimo negaliojančiais pagrindų sistemos skirtingose valstybėse skiriasi. Šiame straipsnyje siekiama pateikti bendrą įstatymo numatytų bendrovės visuotinio akcininkų susirinkimo sprendimų pripažinimo negaliojančiais pagrindų Lietuvos teisėje apžvalgą, minėtų pagrindų sistemą lyginant su užsienio valstybių teisiniu reglamentavimu.

The 1951 Convention Relating to the Status of Refugees and the 1967 Protocol Relating to the Status of Refugees embody fundamental provisions of refugee law. However, since the adoption of these documents the world has changed dramatically and the laws are not developing fast enough in order to catch up with dynamically changing contemporary situations. The application and interpretation of definition of a refugee was developed through traditional practice of Western states, which was influenced by two world wars and the (...) Cold War, when refugees from Africa or Asia were uncommon. The Qualification Directive specifically aims at ensuring that the member states apply common qualification criteria for persons who need international protection in line with the 1951 Convention Relating to the Status of Refugees. The author supports the statement that the Qualification Directive in principle aims at bringing back under the definition of refugee those, who have been left outside of its scope during the last decades as a result of the restrictive interpretation and application of the definition of refugee. This article investigates the use of natural law in biolaw from the specific perspective of an attorney practising before the European Court of Human Rights. Starting from an exploration of the question of who is a human and thereby to be protected under the European Convention on Human Rights (ECHR), particular emphasis is placed on the right to life under Art. 2(1) ECHR. It is shown that natural law can – and should – impact the interpretation of the European Convention (...) on Human Rights and that concrete consequences follow from this approach, most notably the requirement to ensure that every human being, including the unborn, is actively protected as concerns the right to life. The application of the state immunity doctrine with regard to the guarantee of access to court in the case-law of the European Court of Human Rights has been proved to be a complicated issue. In the ECHR’s case-law before the case Cudak v. Lithuania, the application of the state immunity doctrine had been considered as a proportionate restriction of the right of access to court even in cases of the realization of the protection of the jus cogens norm which was (...) very much criticized by the scholars of international law. Thus, the referral of the case Cudak v. Lithuania to the Grand Chamber could or should change the ECHR’s case-law in this sphere or at least develop certain criteria which would afford ground for a more effective protection to the right of access to court in cases of the application of the state immunity doctrine despite the fact that this right is not absolute. However, the case Cudak v. Lithuania has not fully satisfied these aims. Contrary, the case Cudak v. Lithuania left much obscurity, giving a strong indication that, what regards the realization of the right of access to court, the state immunity doctrine is more a material than a procedural ban, since the argumentation given by the ECHR in this case does not guarantee practical protection of this right. Pasibaigus Šaltajam karui smarkiai išaugęs tarptautinių konfliktų skaičius bei identifikuotos naujos grėsmės paskatino tarptautines organizacijas, tokias kaip Jungtinių Tautų organizacija (toliau – JTO) ir Šiaurės Atlanto sutarties organizacija (toliau – NATO) peržiūrėti Šaltojo karo metu taikytą jėgos panaudojimo praktiką, poreikį ir priemones reaguoti į konfliktus. Tokiomis priemonėmis kaip tik ir tapo vadinamieji „mėlynieji šalmai“, kurie Jungtinių Tautų valstybių narių yra priskiriami Jungtinių Tautų Saugumo Tarybos sankcionuotoms operacijoms vykdyti. Nors priskirtos pajėgos vykdydamos tarptautines operacijas dėvi Jungtinių Tautų simboliką, tačiau (...) jų pavaldumas savo valstybei išlieka visą laiką. Analizuodami valstybių dalyvavimo tarptautinių organizacijų sankcionuotose tarptautinėse operacijose teisinius pagrindus, straipsnio autoriai per jėgos panaudojimo prizmę analizuoja Jungtinių Tautų Saugumo Tarybos ir apskritai tarptautinių organizacijų vaidmenį sankcionuojant jėgos panaudojimą pagal Jungtinių Tautų Chartijos nuostatas bei tarptautinių operacijų vykdymo raidą. Straipsnyje taip pat detaliai apžvelgiami siuntimo į tarptautines operacijas nacionaliniai teisiniai pagrindai ir procedūros bei Lietuvos Respublikos praktika. Šis straipsnis yra skirtas visiems besidominties tarptautinėmis operacijomis ir jų sankcionavimo nacionaliniais ir teisiniais pagrindais. Straipsnio struktūra susideda iš trijų dalių. Pirmojoje šio straipsnio dalyje yra nagrinėjamas jėgos panaudojimas pagal Jungtinių Tautų Chartijos nuostatas, antroje ‒ aptariami dalyvavimo Jungtinių Tautų Organizacijos ir Šiaurės Atlanto Sutarties Organizacijos vadovaujamose tarptautinėse operacijose raida ir teisiniai pagrindai, o paskutinėje dalyje yra nagrinėjamas nacionalinis siuntimo į tarptautines operacijas reglamentavimas. In this article the author analyses specific reservations that are being done to the international documents for the protection of human rights and whether Vienna Convention on the Law of the Treaties applies to those human rights treaties or not. Also, the author analyses if reservations, which are incompatible with object and purpose of the treaty, can be done or not and what consequences they might bring. For this reason the author describes the practice of the state members under the (...) Convention on the Elimination of All Forms of Discrimination against Women and International Covenant on Civil and Political Rights. These treaties were chosen not only because they laid down the most significant principles of the protection of human rights, but also due to the great number of reservations made to the fundamental provisions of these treaties. The importance of the topic is that in the human rights treaties the implementation of Vienna Convention on the Law of Treaties provisions on reservations brings several issues, even though on theoretical level the regulation of reservations seems unproblematic. Firstly, there is a major group of states (especially Islamic countries, which base their explanation on the incompatibility with Islamic law), which want to become parties to the treaties that protect human rights and make reservations to fundamental provisions of them at the same time. Secondly, the state parties that make objections to the reservations have to decide if the reservation is compatible with the object and purpose of the treaty or not. The regulation that is laid down in Vienna Convention on the Law of Treaties creates difficulties for the state parties and withdrawal of reservations seems to be more problematic in reality than it is in theory. In order to find the solutions for the above mentioned issues, the author analyses whether the Vienna Convention on the Law of the Treaties regime works properly within the mechanism of making reservations to the human rights treaties or not, what reservations should be kept invalid under the human rights treaties and what could be the solutions for the most effective protection from the invalid reservations that address fundamental rights of human beings in the human rights law. There are various notions of capital, but in this article movement of capital is being analysed from the perspective of international investment law – a country has an asset, which it cannot exploit or do so efficiently and there is a foreigner who possesses financing, technology or know-how, which allows to develop such asset. Lithuania is a net importer of capital, thus this article analyses on what might be the asset that Lithuanian government is interested in developing through foreign investment (...) and why Lithuania does not develop such asset through other means, i.e. borrowing. As China is one the biggest capital exporters and becomes one of the biggest outward investors, this article also analyses driving factors behind such increase of outward investment from China – the Going Out policy and various instruments used by China to encourage such policy. Finally, the article analyses the possible underlying reasons Chinese company CAMCE has in Kaunas free economic zone and what such interest means under international investment law. (shrink)

Directive 96/9/EC of the European Parliament and of the Council on the legal protection of databases of 11 March 1996, which was intended to protect the interests of the makers of databases, determined that databases could be protected by double rights: copyright and sui generis right. The article first of all analyses what persons are entitled to be acknowledged as holders of copyright and sui generis right in respect of a newly created database. As the issue of the owner of (...) copyright is not regulated by the 1996 Directive, this is determined by the application of national provisions. Pursuant to the Law on Copyright and Related Rights of the Republic of Lithuania, the owner of copyright may mean, depending on the situation, a natural person – the author of a database or a group of authors, the holder of the right to a collective work, or an employer. The analysis presented in the articleindicates that predominantly it is the author (authors) of a database who is held to be the owner of the copyright. Courts tend to interpret the rule concerning the transfer of copyright to the employer in a restrictive way; besides, in accordance with the specifics of the Lithuanian legal regulation, economic rights are transferred to the employer only for the period of 5 years. The category of collective work is of a subsidiary character and may be applied only in exclusive cases. Therefore, when a database is created upon the commission of another person, including the employer, the customer is expected to form a written agreement where the transfer of economic rights to the customer is clearly defined. Šios analizės tikslas yra trilypis. Visų pirma, bandoma nustatyti pagrindinius Nietzsche’s subjekto kritikos aspektus. Visų antra, bandoma identifikuoti centrinę šios kritikos funkciją. Visų trečia, bandoma interpretuoti Nietzsche’s ginamą subjektą kaip kūnišką stimulų, instinktų, ir reikmių daugialypumą. Esėje parodoma, kad standartinis subjekto problematikos Nietzsche‘s kūriniuose svarstymas nėra adekvatus. Pasak tokio svarstymo, Nietzsche atsisako subjektyvistinių mąstymo kontūrų ir pakeičia juos radikaliai nauja paaiškinamąja schema. Esėje taip pat parodoma, kad Nietzsche niekad nesiekė pateisinti atomistinės ar anarchiškos subjekto sampratos. Nietzsche siekė suprasti subjektyvybę (...) dvigubo patvirtinimo būdu – kaip valdančio stimulo ir subjekto tapsmo patvirtinimą. First, it aims to identify the central aspects of Nietzsche’s critique of the subject. Secondly, it aims to identify the main function that this critique serves. And thirdly, it aims to interpret the subject Nietzsche defends and endorses in terms of a bodily multiplicity of drives, instincts and needs. The paper argues against the standard interpretation of the problematic of the subject in Nietzsche, according to which Nietzsche abandons the subjectivistic approach in favor of an entirely different explanatory framework. The paper shows that far from supporting an atomistic or an anarchic view of the subject, Nietzsche’s narrative endorses a notion of subjectivity that entails a double affirmation: the affirmation of the ruling drive of the body and of the style of the subject’s becoming. In virtue of such a double affirmation, the self discloses itself as both the text and its interpretation.Key words: body, ego, Nietzsche, multiplicity, self, subject. (shrink)
