Many decisions involve multiple stages of choices and events, and these decisions can be represented graphically as decision trees. Optimal decision strategies for decision trees are commonly determined by a backward induction analysis that demands adherence to three fundamental consistency principles: dynamic, consequential, and strategic. Previous research found that decision-makers tend to exhibit violations of dynamic and strategic consistency at rates significantly higher than choice inconsistency across various levels of potential reward. The current research extends these findings under (...) new conditions; specifically, it explores the extent to which these principles are violated as a function of the planning horizon length of the decision tree. Results from two experiments suggest that dynamic inconsistency increases as tree length increases; these results are explained within a dynamic approach–avoidance framework. (shrink)

The construct of Cognitive Moral Development (CMD) has drawn much attention in the study of business ethics for over two decades. The Defining Issues Test (DIT) has made a significant contribution to the literature as an easy-to-administer CMD instrument, and the Moral Judgment Test (MJT), an alternative scale, has also been used widely especially in Europe. The two scales differ in their approaches to measuring CMD, focusing on stage preference (DIT) and stage consistency (MJT), yet empirical comparisons (...) have been scarce. The present research empirically compares the two scales in terms of their correspondence with ethical ideology as a reference scale, and it demonstrates a clear distinction between the DIT and the MJT. The paper deals with the approaches to researching music from the scientific perspective. It is argued that the scientific literature concerning music contains two different methodological approaches which significantly determine the range of possible conclusions to be reached by the research. The approach „from the outside“ investigates music by automatically applying to music the more general conclusions concerning human cognition and other capacities and behaviors. Thus, this approach omits music’s internal factors. In contrast, the approach „from within“ (...) consists in empirically investigating reactions to music, capacities necessary for its understanding, performing, etc., and their relationships with the reactions and capacities outside the domain of music. The paper shows that, even though the scientific research of music is still in the beginning stage, the approach from within enables more complete explanations concerning music, due to taking into account a larger number of factors relevant for philosophical understanding of the phenomenon of music. Theoretical accounts of development exhibit several internal tensions and face multiple challenges. They span from the problem of the identification of the temporal boundaries of development (beginning and end) to the characterization of the distinctive type of change involved compared to other biological processes. They include questions such as the role to ascribe to the environment or what types of biological systems can undergo development and whether they should include colonies or even ecosystems. In this chapter we discuss these conceptual (...) issues, and we argue that adopting an organizational approach may help solve or clarify them. -/- While development is usually identified with the achievement of an adult form with the capability to reproduce and therefore maintain a lineage, adopting the organizational approach may provide a different strategy, which focuses also on the maintenance of the current organization of the organism. By doing so an organizational approach favors a switch in perspective which consists in analyzing how organisms maintain their viability at each moment of development rather than considering them as going through intermediate stages of a process directed toward a specific goal state. This developmental dimension of biological organization has yet to be given a general and detailed analysis within the organizational theoretical perspective, apart from some preliminary attempts. How a biological organization is maintained through a series of radical organizational changes and what these changes are issues that still require clarification. In this chapter we offer the beginnings of such an analysis of developmental transitions, understood as changes in functionality brought forth by regulatory mechanisms in the context of the continued maintenance of organizational viability at every step. The right to a fair trial as a fundamental human right has been widely established in the international community. While the notion of a fair trial is typically associated with procedural safeguards, fairness can be reflected in spatial dimensions. Courtroom design, apart from achieving its main functional objectives, reflects the institutional ideology of how justice can be staged in public. In alignment with the perspective that courtroom as theatre consists of a sign system, this paper adopts a semiotic approach (...) to the courtroom setting of Chinese criminal trials. With a thick description of space, mobility and attire, it attempts to probe into how judicial ideology is symbolically framed in the field. Drawing from ethnographic fieldwork of three courts, this paper discusses how courtroom space is constructed semiotically as a performative stage on which legal dramas unfold. Ultimately this paper argues that a semiotic investigation of Chinese courtrooms will shed light on an understanding of its judicial value, ideology of justice and dynamics of power relationship. The Plant Ontology (PO) is a community resource consisting of standardized terms, definitions, and logical relations describing plant structures and development stages, augmented by a large database of annotations from genomic and phenomic studies. This paper describes the structure of the ontology and the design principles we used in constructing PO terms for plant development stages. It also provides details of the methodology and rationale behind our revision and expansion of the PO to cover development stages for all plants, particularly (...) the land plants (bryophytes through angiosperms). As a case study to illustrate the general approach, we examine variation in gene expression across embryo development stages in Arabidopsis and maize, demonstrating how the PO can be used to compare patterns of expression across stages and in developmentally different species. Although many genes appear to be active throughout embryo development, we identified a small set of uniquely expressed genes for each stage of embryo development and also between the two species. Evaluating the different sets of genes expressed during embryo development in Arabidopsis or maize may inform future studies of the divergent developmental pathways observed in monocotyledonous versus dicotyledonous species. The PO and its annotation databasemake plant data for any species more discoverable and accessible through common formats, thus providing support for applications in plant pathology, image analysis, and comparative development and evolution. In this book, classicist Joshua Billings considers classical Greek drama as intellectual history. Developing an innovative approach to dramatic form as a mode of philosophical thought, Billings recasts early Greek intellectual history as a conversation across types of discourses and demonstrates the significance of dramatic reflections on widely-shared conceptual questions. He integrates evidence from tragedy, comedy, and satyr play into the development of early Greek philosophy in order to place poetry at the center of Greek thought. He thus offers (...) a substantially new history and map of classical intellectual culture: drama, on his view, appears as our best source for understanding the thought of the fifth century, while at the same time revealing significant tensions and anxieties in the development of philosophy. At the heart of the book is a novel approach to the philosophical qualities of drama. Though dramatists and their works have been considered philosophical in a variety of ways going back to antiquity, scholarly approaches have consistently taken "literature" and "philosophy" as defined categories, tracing more or less direct connections between one and the other. On the contrary, Billings argues that neither "literature" nor "philosophy" were available as stable categories in the fifth century. Rather he describes the way that drama treats issues that would come to be called philosophical, without relying on assumptions concerning what constitutes philosophical method or literary form. Our article aims to analyze the different stages of the Fang culture, particularly the one of Equatorial Guinea in order to know the current situation of the aforementioned culture. It should be said that the Fang is a social group, an ethnic group that belongs to the Bantu trunk. These Fangs developed their culture from an original perspective; that is to say in a raw state before they made contact with Westerners. Culture is a concept that has gone through many (...) studies, hence it has a variety of definitions. According to the dictionary of the Spanish language of the Royal Academy, culture is the set of ways of life and customs, knowledge and degree of artistic, scientific, industrial development, in a time, of a social group. It is estimated that the term culture carries with it what is identity, and precisely a culture’s identity. Thus, no culture can develop outside a society. With respect to our reference, which is the Fang culture of Equatorial Guinea, it can be said that a cultural profile has been developed and it is measured through cultural elements and manifestations such as dances, beliefs, art, religion, language, myths, funeral rites, etc. they all constitute a rich knowledge from a raw state. Thanks to this research we are going to look chronologically at the stages of the said culture from its original stage reaching colonization to the end with decolonization. The impact that Western culture has had on Fang culture is analyzed from another angle. In accordance with the general objective that consists of studying the Fang culture. Well, it can be seen that the contact with Western culture has greatly adulterated the Fang culture, and today, with the processes of globalization, it is fading even more. As it is a research that addresses a sociocultural issue such as the current situation of the fang culture, we have found it necessary to adopt a qualitative methodology. The paper re-expresses arguments against the normative validity of expected utility theory in Robin Pope (1983, 1991a, 1991b, 1985, 1995, 2000, 2001, 2005, 2006, 2007). These concern the neglect of the evolving stages of knowledge ahead (stages of what the future will bring). Such evolution is fundamental to an experience of risk, yet not consistently incorporated even in axiomatised temporal versions of expected utility. Its neglect entails a disregard of emotional and financial effects on well-being before a particular risk is (...) resolved. These arguments are complemented with an analysis of the essential uniqueness property in the context of temporal and atemporal expected utility theory and a proof of the absence of a limit property natural in an axiomatised approach to temporal expected utility theory. Problems of the time structure of risk are investigated in a simple temporal framework restricted to a subclass of temporal lotteries in the sense of David Kreps and Evan Porteus (1978). This subclass is narrow but wide enough to discuss basic issues. It will be shown that there are serious objections against the modification of expected utility theory axiomatised by Kreps and Porteus (1978, 1979). By contrast the umbrella theory proffered by Pope that she has now termed SKAT, the Stages of Knowledge Ahead Theory, offers an epistemically consistent framework within which to construct particular models to deal with particular decision situations. A model by Caplin and Leahy (2001) will also be discussed and contrasted with the modelling within SKAT (Pope, Leopold and Leitner 2007). (shrink)

. Textline segmentation in handwritten documents is of real challenge and interesting in the field of document image processing. In this paper, we propose a handwritten textline segmentation scheme based on the concept of linked list. The proposed method consists of three stages, namely, preprocessing, linked list and mathematical morphology. The concept of the linked list approach is used to build a textline sequence and mathematical morphology is used to obtain the line separator. We experimentally evaluated our proposed method (...) on a document containing handwritten Kannada script. The results are compared with recent methods and show encouraging results. (shrink)

The Transcendental Psychology Approach to the study of perception has been developed by A.I. Mirakyan at the Psychological Institute (Moscow, Russia) about 30 years ago. This article considers the results of theoretical and experimental investigations and provides a historical overview of the approach’s development. Started with the investigations of constancy in perception, it went beyond the traditional Product Basis Paradigm (relying on perceptual features for finding perceptual mechanisms) into Philosophical Metaphysics of “nothing” and “something” concepts for revealing the (...) form-generating principles as fundamental axiomatics of the Transcendental Psychology Approach. Several principles were developed and justified: structure-process anisotropy, spatial-temporal discreteness, the formation of anisotropic (particularly, symmetric) relations, the coexistence of alternatives, and some others. Principles are explanatory for the regulations of sensory-perceptual processes and are the direct object of further specification and experimental verification using hypothetical transcendental models of perceptual structures. The theory suggests that the internal mechanisms of these models would not naturally manifest themselves in experiments within the functional range of perception, and to see the phenomena, it is necessary to bring the perceptual system out of its natural functional range. The form-generating processes are named adiaphorous in the sense that they specifically generate new structures and forms, regardless of the characteristics of products used and produced in the processes. In general, it is possible to speak about the class of so-called structurally-generative processes that are specific to the process of transition between the system-generating structures studied by different hierarchically interrelated sciences. The proposed two-staged qualitative model of the perceptual process consists of two substantially different parts: the direct sensory perception and a process of form designation or sensory name assignment. Further investigations of structurally-generative processes seem likely to shed light on the mechanisms of brain function and to contribute strategically to new directions in philosophical psychology and neuroscience. During the co-evaluation of student teacher of trainees’ learning with the associate teacher, several supervisors experience a discomfort with their role, their actions and their posture. For some, this discomfort is due to a lack of continuous training preventing their professional development. By creating a community of practice, we supported the reflection and analysis of student teaching supervision that take place within triads, made up of the trainees’, the associate teacher and the supervisors. Our objective was to study the contributions (...) of this community to their practices. In this article, we first present the problematic. We then present the conceptual framework consisting of experiential learning, professional development and the community of practice. The methodological approach is then explained, followed by data collected by means of semi-directed individual interviews with the supervisors of the community of practice. The results of the reported practice highlight the contributions of the community of practice to the professional development of its members. (shrink)

The detailed analysis allows to discern seven kinds of integration, namely: I₁ consisting in the synthesis of scientific disciplines from their elements, including disciplinary unification I₁; I₂ inclusion of a science in (reduction to) another, more general; I₃ - links between different sciences, especially establishing of common elements; I₄ - interdisciplines bridging various sciences; I₅ - combination of two (or more) disciplines into a new (complex) science; I₆ - a general approach to several domains or multidisciplinary unification; I₇ - (...) transdisciplinary sciences about relations of the same type in various traditional domains. These kinds of integration are interwoven with processes of differentiation, viz. D₁ - internal differentiation of the sciences resulting of I₁; D₂ - interdisciplinary differentiation concomitant I₄, and D₃ - specialization of I₇ sciences in several sections. As a result integration and differentiation are combined in the pairs I₁ - D₁, I₇ - D₃, and D₂ - I₄. The processes of integration (and differentiation) may be presented schematically in the following (not strictly isolated one of another) sequence: in the 17th century started I₁ followed by D₁, and in the last decades by I₁'; during the 18th and the 19th c. cases of I₂ and I₃ appear; I₄ (together with D₂) is unfolding since the late 19th century. Finally, I₇ (and D₃), as well as I₅ and I₆ pertain to the latter half of our century. In an age of nationalisation of international educational policy, or vice versa, the politics and conflicts behind such policies often take centre stage to the detriment of professional expertise. In response, this article develops a nuanced critical realism to propose a practice-based development and implementation of educational policy reforms. Based on empirical reports of head teachers’ subversive practice, the article concludes by highlighting that professional expertise is a central component, dubbed ‘formless capability’, that all stakeholders use to turn policy (...) intentions into policy actions. Actuality consists of the three traditional domains of critical realism – the real, the actual and the empirical – whose importance is derived from whether it is a means to or an end in itself. IntroductionAcademic integrity policy that is inaccessible, ambiguous or confusing is likely to result in inconsistent policy enactment. Additionally, policy analysis and development are often undertaken as top down processes requiring passive acceptance by users of policy that has been developed outside the context in which it is enacted. Both these factors can result in poor policy uptake, particularly where policy users are overworked, intellectually critical and capable, not prone to passive acceptance and hold valuable grass roots intelligence about policy enactment.Case (...) descriptionThe case study presented in this paper describes the actions of a community of practice at a regional Australian university to deconstruct and translate ambiguous academic integrity policy into a suite of accessible academic integrity resources that were intelligible to staff and students, and which assisted academic staff to consistently enact policy. The paper narrates the formation of the CoP, the tangible and intangible value it created, the social learning practices enacted by its members, its grassroots policy work and the material resources produced from that work.Discussion and evaluationAn evaluation of the CoP was conducted using a value creation framework to explore its immediate value, potential value, applied value, realised value, and reframing value. These values were considered at each stages of the CoP’s lifespan. The evaluation was a useful process that demonstrated the wide-ranging value created by the CoP. Six insights were drawn from the evaluation which promote understanding of the value created for a university by a CoP, particularly in contributing to academic integrity culture over a sustained period of time.ConclusionsThis paper contributes to a research gap on specific examples of discretion within rule-based systems. It illustrates how academics and members of the CoP used their discretion to interpret and enact academic integrity policy within a higher education setting. Statistical power is often a concern for clustered randomized control trials (RCTs) due to variance inflation from design effects and the high cost of adding study clusters (such as hospitals, schools, or communities). While covariate pre-specification can improve power for estimating regression-adjusted average treatment effects (ATEs), further precision gains can be achieved through covariate selection once primary outcomes have been collected. This article uses design-based methods underlying clustered RCTs to develop Lasso methods for the post-hoc selection of covariates for ATE (...) estimation that avoids a lack of transparency and model overfitting. Our focus is on two-stage estimators: in the first stage, Lasso estimation is conducted using data on cluster-level averages or sums, and in the second stage, standard ATE estimators are adjusted for covariates using the first-stage Lasso results. We discuss l 1 {l}_{1} consistency of the estimated Lasso coefficients, asymptotic normality of the ATE estimators, and design-based variance estimation. The nonparametric approach applies to continuous, binary, and discrete outcomes. We present simulation results and demonstrate the method using data from a federally funded clustered RCT testing the effects of school-based programs promoting behavioral health. (shrink)

Death is an invariant of human existence, a kind of its “omega point”. At the same time, the attitude towards it is not a constant, but rather undergoes changes, being incorporated in a wide sociocultural context. The mail goal of the article is an analysis of the nature of these changes at the present stage specifically under the influence of rapid biotechnological progress and dilemmas generated by these changes. Firstly, there is a tendency of increasing optimism: some theorists tend (...) to perceive death not as an inevitable reality, but rather as a problem and a challenge. At the same time a radical direction arises, believing that death can be overcome only through the complete separation of man from its body substrate. The utopian nature of this project forces more moderate theorists to look for indirect way, which consists in a “war” with aging as the main predecessor of death, up to attempts of its complete abolition. Gradually, the formation of scientific immortology as a kind of opposition for thanatology takes place. At the same time, many theorists, and even more ordinary people remain skeptical position about the prospects for victory over death. It can be concluded that biomedical progress actualizes general human intention for self-preservation and death avoidance, but science requires an assessment of not only the objective possibilities for overcoming death but also both ontological and anthropological consequences of it. This article, corresponding to a part of the restitution of a financed international research project between France, Brazil, Canada, Italy and Belgium, aims to offer a modelisation and qualitative evaluation of mediation care settings based on an original methodological tool that involves identifying the typical games at the foundations of creativity, following a multidisciplinary perspective. Therapeutic mediations are settings or devices organised around a “pliable medium”, often artistic, like painting, modeling, writing, ​and theatre, which are very widespread in institutional practices, (...) both in France and abroad. The scientific objectives of this research consist in a multi-disciplinary exploration (anthropology, criminology, neuroscience, clinical psychology) of the process of creative symbolisation understood as a process of transformation involving play. According to this orientation, play can be defined as a psychic process whereby a subjective experience can be explored with pleasure, and consequently symbolised and appropriated. Our fundamental and original hypothesis is that play is at the source of the creative process, conceived as a work of metabolisation by the psyche of playful experiences during the different stages of life. The review of the understanding of play in psychoanalysis, anthropology, criminology and neuroscience emphasises the richness of this model and the importance of reflecting on the typical games in the field of psychic care. A clinical example of treatment in a pictorial therapeutic mediation setting of a child with psychotic disorders makes it possible to identify a number of typical games as well as the modalities of interpretation of the therapists through play. These multidisciplinary studies lead to the presentation of a general table of typical games, and these first results highlight the richness of identifying typical games in clinical settings. Ultimately, the multidisciplinary approach shows the interest of the model of play in the evaluation of therapeutic mediation settings, with a convergence of the different disciplines emphasising the pertinence of this model. The scientific impact of this research overlaps with its societal impact, through the development of innovative tools for evaluating therapeutic mediations, in order to take account of the evolution of the different forms of social expression of psychic suffering. Many are reading books about Buddhism, and some are also meditating, participating in Buddhist retreats, and studying under Buddhist teachers. As they do so, they approach what might be called "dual religious belonging."The phrase (...) itself can suggest at least three metaphors. We can imagine them (1) as people crossing a bridge into the world of Buddhism and who then return to Christianity with fresh insights; or (2) as people with two intravenous tubes in their arms, one providing fluid from a Buddhist lineage and one providing fluid from a Christian lineage, for the sake of a more complete life; or, shifting to a more organic metaphor, (3) as people with primary roots in Christian soil but with secondary roots in Buddhist soil, who receive anchorage and sustenance from both kinds of soils.Shortly I will draw upon the third metaphor to suggest the desirability of a "taproot" as opposed to a "fibrous" approach for such double belonging, at least in its initial stages. First, a word is in order about the philosophical backdrop for my approach, which draws upon the philosophy of Alfred North Whitehead and its theological counterpart, process theology. Toward this end, I will draw upon the first metaphor: the bridge. A Bridge for Double Belonging Process theology emerged in the 1930s at the University of Chicago and has since been used by many Christians and some Buddhists, mainly but not exclusively Pure Land Buddhists, to interpret their respective religious perspectives. I myself have used this theology in several books to try to show how Christians can draw deeply from the wells of Buddhist insight and practice in ways that enrich and deepen Christian life.Process theology draws upon the "philosophy of organism" developed by the late philosopher and mathematician Alfred North Whitehead. Whitehead's philosophy is unique in that it has deep similarities with numerous Buddhist points of view even as it also offers a rich way of interpreting and appreciating core Christian insights. Decisions of regulatory government bodies and courts affect many aspects of citizens’ lives. These organizations and courts are expected to provide timely and coherent decisions, although they struggle to keep up with the increasing demand. The ability of machine learning (ML) models to predict such decisions based on past cases under similar circumstances was assessed in some recent works. The dominant conclusion is that the prediction goal is achievable with high accuracy. Nevertheless, most of those works do not consider important (...) aspects for ML models that can impact performance and affect real-world usefulness, such as consistency, out-of-sample applicability, generality, and explainability preservation. To our knowledge, none considered all those aspects, and no previous study addressed the joint use of metadata and text-extracted variables to predict administrative decisions. We propose a predictive model that addresses the abovementioned concerns based on a two-stage cascade classifier. The model employs a first-stage prediction based on textual features extracted from the original documents and a second-stage classifier that includes proceedings’ metadata. The study was conducted using time-based cross-validation, built on data available before the predicted judgment. It provides predictions as soon as the decision date is scheduled and only considers the first document in each proceeding, along with the metadata recorded when the infringement is first registered. Finally, the proposed model provides local explainability by preserving visibility on the textual features and employing the SHapley Additive exPlanations (SHAP). Our findings suggest that this cascade approach surpasses the standalone stages and achieves relatively high Precision and Recall when both text and metadata are available while preserving real-world usefulness. With a weighted F1 score of 0.900, the results outperform the text-only baseline by 1.24% and the metadata-only baseline by 5.63%, with better discriminative properties evaluated by the receiver operating characteristic and precision-recall curves. This article focuses on two Brechtian principles that Haus has employed in his University of Delaware and Villanova productions: first, what he characterizes as “physicalized” acting and, second, a sense of theatre as a community event. Physicalization permits the actors to “get in touch with” their bodies and use them (...) differently and more fully in performance. In Haus's Oedipus Rex at Villanova, the chorus, a diverse group of actors ranging in age from 18 to 70, became the central character. Through the use of a chorus in several of his Delaware productions and other alienation techniques (an African American Grusha, a woman playing Ui), Haus has consistently moved his audiences to see the relevance of theatre to the contemporary world. Although the potential of indigenous knowledge in sustainable natural resource management has been recognized, methods of gathering and utilizing it effectively are still being developed and tested. This paper focuses on various methods used in gathering knowledge on the use and management of tree fodder resources among the Maasai community of Kenya. The methods used were (1) a household survey to collect socio-economic data and identify key topics and informants for the subsequent knowledge elicitation phase; (2) semi-structured interviews using key (...) informants to gather in-depth information; (3) tree inventory to collect quantitative data on the ecological status of trees and shrubs on rangelands; and (4) group consensus method to countercheck information elicited from key informants. Study results obtained show that the use of multiple methods in an appropriate sequence is an effective way of building upon the information elicited from each stage. It also facilitates the collection of different types of data and knowledge allowing a measure of triangulation, which can be used to confirm the validity and consistency of indigenous knowledge. Multiple methods also allow the collection of more knowledge than can be obtained if only one method is used. Therefore, it is recommended that future studies on indigenous knowledge systems use multiple methods that combine both individual and group interviews in order to obtain more complete and accurate information. Within the last decade, several approaches using quaternion numbers to handle and model multiband images in a holistic manner were introduced. The quaternion Fourier transform can be efficiently used to model texture in multidimensional data such as color images. For practical application, multispectral satellite data appear as a primary source for measuring past trends and monitoring changes in forest carbon stocks. In this work, we propose a texture-color descriptor based on the quaternion Fourier transform to extract relevant information from multiband (...) satellite images. We propose a new multiband image texture model extraction, called FOTO++, in order to address biomass estimation issues. The first stage consists in removing noise from the multispectral data while preserving the edges of canopies. Afterward, color texture descriptors are extracted thanks to a discrete form of the quaternion Fourier transform, and finally the support vector regression method is used to deduce biomass estimation from texture indices. Our texture features are modeled using a vector composed with the radial spectrum coming from the amplitude of the quaternion Fourier transform. We conduct several experiments in order to study the sensitivity of our model to acquisition parameters. We also assess its performance both on synthetic images and on real multispectral images of Cameroonian forest. The results show that our model is more robust to acquisition parameters than the classical Fourier Texture Ordination model. Our scheme is also more accurate for aboveground biomass estimation. We stress that a similar methodology could be implemented using quaternion wavelets. These results highlight the potential of the quaternion-based approach to study multispectral satellite images. This research seeks to understand the relationship between philosophy and the formation of concepts in childhood from the perspective of Matthew Lipman. As our own research in the area of philosophy of education, we pose the following question as a problem to be analyzed: how can philosophy contribute to the concept formation process in childhood according to Lipman? The development of this problem was organized in five stages. A first seeks to understand and deepen Lipman's conception of Philosophy for Children, (...) especially the idea of thinking skills and philosophical dialogue in the research community; the second stage consisted of planning philosophical practice with the children at school, in a class with 32 students from the 3rd year of elementary school in a public school in the city of Londrina / PR, in the period of one semester; the third was to carry out the classroom experience with the students and the teacher from the previous stages; the fourth step was the evaluation of the practice and the planning of the following classes after each meeting; and the fifth stage was concerned with the registration, analysis and systematization of the observed. In order to investigate the contribution of philosophy to the concept formation process in childhood, according to Lipman, part of the research methodology was qualitative, analyzing the concepts of philosophy, thinking and the research community of this philosopher. For this, his main works and those of his commentators were consulted. Action research procedures were also employed through the practice of students from Elementary School I, in order to carry out an experience of the analyzed concepts. As a result of the research, it is possible to highlight the fundamental role of Lipman’s Philosophy for Children in the formation of concepts, because, through philosophical practices, the children were more reflective in approaching concepts that in their daily lives could go unnoticed. The work of questioning and dialogue in the research community made it possible to highlight the difficulty of conceptualizing at the beginning of the work, the progress along their approach and the need to seek more in-depth answers. With that, it can be highlighted that the Philosophy classes contributed to such advances and that without them the skills would remain stagnant. This study is added to the philosophical educational movement of teaching philosophy from childhood, which is considered essential for the formation of more reasonable subjects, and most importantly, with the acquisition of skills that will facilitate life in and out of school. This paper makes an independent start with formalizing the rules for the argumentation stage of critical discussions. It does not deal with the well-known code of conduct consisting of ten rules but with the system consisting of fifteen rules on which the code of conduct is based. The rules of this system are scrutinized and problems they raise are discussed. Then a formal dialectical system is defined that reflects most of the contents of these rules. The aim is to (...) elucidate the way the rules work and to show how a formal approach can be useful to achieve this. It is also shown how the present method can be used to study the nature of circular argumentation. While, generally, the formalization follows closely the original rules for the argumentation stage of critical discussions, there will also be proposed some modifications of the original protocol. This chapter offers an account of the aspect of nineteenth‐century naturalism, by focusing on the work of J. S. Mill and Auguste Comte. Both philosophers have high ambitions for naturalism, aiming to offer a sweeping account of all of human knowledge in naturalistic terms. Mill argued that the metaphysical thinking must already have started to exert an influence in order for monotheistic approaches to take hold, and that Comte's account of the theological stage overstated the extent to which fetishistic (...) or polytheistic understanding of phenomena could exist independently of one another. But these are minor disagreements, framed in terms of a narrative that Mill basically accepts. Mill thought Comte's three stage theory important for understanding the rise our way of conceptualizing the world, and consistent with his own account of the rise of scientific induction. (shrink)

Purpose. Based on the anthropocentric approach to the analysis of visual self-presentations of Artemisia Gentileschi in paintings, to present the artwork as self-objectifications of the artist, which give rise to a new cultural reality and are at the same time a means of knowing the essence of man. Theoretical basis. The principles and methods of philosophical and anthropological research in combination with biographical, historical and comparative, iconographic, figurative and stylistic methods were used when writing the article. Among philosophical and (...) anthropological methods the principle of anthropological reduction was used, based on which the works by Artemisia Gentileschi were analyzed as her self-objectification, principle of extrapolation of a separate fact of the painter’s life and anthropological interpretation of art evolution, when an attempt is made to know their creator through a series of chronological consistent works as figurative objectification. The biographical method was used when working with data on the painter’s life, iconographic and figurative stylistic – when analyzing the art visuals: self-portraits, allegories and narrative paintings. The analytical work was carried out in stages as transition from an iconographic interpretation of paintings with gradual elimination of art and style characteristics as extra-anthropological cultural constants with subsequent anthropological reduction of cultural image. Originality consists in the author’s method of analyzing the works of visual art in terms of anthropocentric approach, as well as in considering the artwork by Artemisia Gentileschi as her self-objectification as such that give rise to a new cultural reality. Conclusions. The artworks by Artemisia Gentileschi in diachronic deployment can be seen as the painter’s self-objectification, which traces the evolution of self-expression from a person with traditional self-perception by social gender stereotypes to the phenomenon of personal life, which will determine further evolution of her self-identification and extirpation of sense of shame through virtual revenge, repentance, guilt, and formation of component of the painter’s identity as exemption from social gender prejudices and stereotypes on roles and standards of behavior socially assigned to women. A notion of quantum space-time is introduced, physically defined as the totality of all flows of quantum test particles in free fall. In quantum space-time the classical notion of deterministic inertial frames is replaced by that of stochastic frames marked by extended particles. The same particles are used both as markers of quantum space-time points as well as natural clocks, each species of quantum test particle thus providing a standard for space-time measurements. In the considered flat-space case, the fluctuations in (...) coordinate values with respect to stochastic frames are described by coordinate probability amplitudes related to irreducible stochastic phase space representations of the Poincaré group. Lagrangian field theory on quantum space-time is formulated. The ensuing equations of motion for interacting fields contain no singularities in their nonlinear terms, and therefore can be handled by methods borrowed from classical nonlinear analysis. (shrink)

Adolescence is a vital stage in a person´s development, stressful events within the most significant subsystems at this stage can lead to anxious-depressive symptomatology. The objective of this study was to design a socio-emotional narrative intervention program in order to decrease anxious-depressive symptoms in adolescents. We seek to strengthen emotional intelligence skills, such as: emotional awareness, self-image, self-concept, self-esteem and self-regulation. The research was quasi-experimental, pretest-post-test was carried out with control group and transverse temporality. The research approach (...) was mixed. The sample consisted of 80 women aged 13 to 15. Quantitative results showed a statistically significant difference in experimental group with medium effect for anxiety and small for depression as well as medium and high in the self-image. A qualitive analysis of the verbal and pictographic productions was carried out. It is important to continue proving the effectiveness of this socio-emotional narrative intervention to decrease anxious and depressive symptomatology in adolescents. (shrink)

The enactive approach to cognitive science involves frequent references to “action” without making clear what is intended by the term. In particular, though autopoiesis is seen as a foundation for teleology in the enactive literature, no definition or account is offered of goals which can encompass not just descriptions of biological maintenance, but the range of social and cultural activities in which human beings continually engage. The present paper draws primarily on the work of Juarrero (Dynamics in action. Cambridge, (...) MA: MIT Press, 1999) and Donald (Origins of the modern mind. London: Wiedenfeld & Nicolson, 1991) in an attempt to offer the broad outlines of an account of goals and goal-directedness which is consistent with the enactive approach and which explicates several forms of goal-directedness exhibited by human beings. Four stages of cognitive evolution described by Donald are examined for characteristic mechanisms of adaptivity and goal-directedness. Implications for an enactive theory of meaning are discussed. Assigning the appropriate moral status to different stages of human development is an urgent problem in bioethics. Many philosophers have attempted to assess developmental events using strict ontological principles to determine when a developing entity becomes essentially human. This approach is not consistent with recent findings in reproductive and stem cell biology, including the discovery of the plasticity of early embryonic development and the advent of induced pluripotent stem cells. A Theory of Shopping offers a highly original perspective on one of our most basic everyday activities - shopping. We commonly assume that shopping is primarily concerned with individuals and materialism. But Miller rejects this assumption and follows the surprising route of analysing shopping by means of an analogy with anthropological studies of sacrificial ritual. He argues that the act of purchasing goods is almost always linked to other social relations, and most especially those based on love and care. The (...) ethnographic sections of the book are based on a year's study of shopping on a street in North London. This provides the basis for a sensitive description of the issues the shopper confronts when making decisions as to what to buy. Miller develops a theory to account for these observations, arguing that shopping typically consists of three major stages which reflect the three key stages of many rites of sacrifice. In both shopping and sacrifice the ultimate intention is to constitute others as desiring subjects. Finally the book examines certain historical shifts in both subjects and objects of devotion, in particular, ideals of gender and love. This treatment of shopping from the perspective of comparative anthropology represents a highly innovative approach to one of the most familiar tasks of our daily lives. Written in a clear and accessible manner, this book will be of interest to students and academics in anthropology, sociology and cultural studies, as well as anybody who wants to consider more deeply the nature of their own everyday activities. Aims and Objectives. This article uses the concept of embodiment to demonstrate a conceptual approach to applied phenomenology. -/- Background. Traditionally, qualitative researchers and healthcare professionals have been taught phenomenological methods, such as the epoché, reduction, or bracketing. These methods are typically construed as a way of avoiding biases so that one may attend to the phenomena in an open and unprejudiced way. However, it has also been argued that qualitative researchers and healthcare professionals can benefit from phenomenology’s well-articulated (...) theoretical framework, which consists of core concepts, such as selfhood, empathy, temporality, spatiality, affectivity, and embodiment. -/- Design. This is a discursive article that demonstrates a conceptual approach to applied phenomenology. -/- Method. To outline and explain this approach to applied phenomenology, the Discussion section walks the reader through four stages of phenomenology, which progress incrementally from the most theoretical to the most practical. -/- Discussion. Part one introduces the philosophical concept of embodiment, which can be applied broadly to any human subject. Part two shows how philosophically trained phenomenologists use the concept of embodiment to describe general features of illness and disability. Part three illustrates how the phenomenological concept of embodiment can inform empirical qualitative studies and reflects on the challenges of integrating philosophy and qualitative research. Part four turns to phenomenology’s application in clinical practice and outlines a workshop model that guides clinicians through the process of using phenomenological concepts to better understand patient experience. -/- Conclusion and Relevance to Clinical Practice. A conceptual approach to applied phenomenology provides a valuable alternative to traditional methodological approaches. The hematopoietic system consists of more than ten differentiated cell types, all of which are derived from a single type of hematopoietic stem cell. The accessibility and interest of this system have made it a model for understanding normal and abnormal differentiation of mammalian cells. Newer techniques have generated a mass of data that requires integrative approaches for analysis and interpretation. The traditional view of the differentiation program holds that a small number of regulators are involved in each stage (...) of cell specification. However, this may not be the case. Recent analyses have shown that almost all substantial subsets of genes, including the set of broadly expressed transcription factors, are expressed in patterns that are unique for each lineage. Further, much of this difference between lineages can be captured in two‐dimensional graphs. Understanding the biologic significance, mechanisms and constraints underlying these differences is a challenge for experimentalists and computational biologists alike. In this paper we argue that reflection on the patterns of practical concern that agents like us exhibit strongly suggests that the same person relation comes in continuous degrees rather than being an all or nothing matter. We call this the SP-degree thesis. Though the SP-degree thesis is consistent with a range of views about personal-identity, we argue that combining desire-first approaches to personal-identity with the SP-degree thesis better explains our patterns of practical concern, and hence gives us reason to (...) endorse such an approach. We then argue that the combination of the SP-degree thesis and the desire-first approach are best modelled by a stage-theoretic view of persistence according to which temporal counterpart relations are non-symmetric relations that come in continuous degrees. Ultimately, we think that the overall appeal of this package of views provides reason to accept the package: reasons that outstrip the reasons we have to endorse any particular member of the package. Background Protecting the privacy of research participants is widely recognized as one of the standard ethical requirements for clinical research. It is unknown, however, how research professionals regard concepts of privacy as well as the situations in the research setting that require privacy protections. The aim of this study was to explore the views of research professionals from Arab countries regarding concepts and scope of privacy that occur in clinical research. Methods We adopted an exploratory qualitative approach by the (...) use of focus group discussions. We recruited individuals involved in research from Egypt and Morocco. We analyzed focus group data via a constant comparison approach, which consisted of close reading of the transcribed interviews followed by coding and then determining themes and subthemes. Results Between August 2016 and July 2018, we conducted nine focus group discussions. Respondents discussed several privacy issues that occurred before the research began ; during research, and after the research. Respondents revealed their perspectives of patients towards privacy in the clinical and research settings and mentioned that patients are more likely to permit access to their privacy in the clinical setting compared with research setting due to the existence of benefits and trust in clinical care. Respondents also recommended training regarding data protections for individuals involved in research. Conclusions Our study shows that research professionals discussed a range of privacy issues that are present during the different stages of research. We recommend 1) development of standards regarding privacy protections during recruitment efforts; 2) additional training for individuals involved in research regarding best practices with data security in secondary research; 3) a quantitative study involving investigators and REC members to determine their knowledge, attitudes and practices regarding privacy issues that occur in research; and 4) a quantitative study involving patients to elicit their views regarding their privacy concerns in research. We propose an empirical mode decomposition (EMD-) based method to extract features from the multichannel recordings of local field potential (LFP), collected from the middle temporal (MT) visual cortex in a macaque monkey, for decoding its bistable structure-from-motion (SFM) perception. The feature extraction approach consists of three stages. First, we employ EMD to decompose nonstationary single-trial time series into narrowband components called intrinsic mode functions (IMFs) with time scales dependent on the data. Second, we adopt unsupervised K-means clustering to (...) group the IMFs and residues into several clusters across all trials and channels. Third, we use the supervised common spatial patterns (CSP) approach to design spatial filters for the clustered spatiotemporal signals. We exploit the support vector machine (SVM) classifier on the extracted features to decode the reported perception on a single-trial basis. We demonstrate that the CSP feature of the cluster in the gamma frequency band outperforms the features in other frequency bands and leads to the best decoding performance. We also show that the EMD-based feature extraction can be useful for evoked potential estimation. Our proposed feature extraction approach may have potential for many applications involving nonstationary multivariable time series such as brain-computer interfaces (BCI). (shrink)

The aim of this article is to adapt Peirce’s semiotics to the study of media and arts. While some Peircean notions are criticized and rejected, constructive ways of understanding Peirce’s ideas are suggested, and a number of new notions, which are intended to highlight crucial aspects of semiosis, are then introduced. All these ideas and notions are systematically related to one another within the frames of a consistent terminology. The article starts with an investigation of Peirce’s three sign constituents and (...) their interrelations: the representamen, the object, and the interpretant. A new approach to the interrelations of these three sign constituents is then suggested and manifested in a distinction between representation and neopresentation. This is followed by a critical discussion of Peirce’s three types of representation—iconicity, indexicality, and symbolicity—and their interrelations, which sets the stage for a presentation of what is referred to as the material and mental representation model. This model aims to illuminate the problematic relation between material and mental facets of signification triggered by media and art products, and other material things and phenomena. (shrink)

This book is a philosophical examination of the main stages in our journey from hominid to human. It deals with the nature and origin of language, the self, self-consciousness, and the religious ideal of a return to Eden. It approaches these topics through a philosophical anthropology derived from the later writings of Wittgenstein. The result is an account of our place in nature consistent with both a hard-headed empiricism and a this-worldy but religiously significant mysticism.

The article presents the conditions for the self-deployment of a globalized world as a set of complex of social systems under conditions of instability. The globalized world as a self-deployment of complex of hierarchical systems under conditions of uncertainty, information stochasticity and "balancing on the brink of chaos" is an integral part of increasing the efficiency of the management system as a whole. The main purpose of the article is the conceptualization of the self-deployment of the globalized world as a (...) set of complex social systems under conditions of stochasticity and "balancing on the verge of chaos”. The term "self-deployment" of complex social systems under conditions of uncertainty and instability reveals the transitions of quality from one state to another. Used methodology - systemic, structural-functional and synergetic methods and approaches that allow to analyze the conditions of instability and uncertainty. The synergetic-reflexive model of management as a complex social system consists of a set of nonlinear processes, in particular dynamic chaos as some of the most complex ordering. The research is based on the following objectives: to reveal the essence of self-deployment and its main stages; determine the role played by autopoiesis in the structuring of social systems as integral units. On the basis of the proposed methods, the conceptual-categorical apparatus necessary for the conceptualization of the self-deployment of the globalized world as a complex of complex social systems is clarified. the synergetic-reflexive model of control necessary for solving problems of stochastic, uncertainty and "balancing on the edge of chaos" is analyzed. The scientific novelty of the research in identifying the ways to overcome disorganization, instability, "balancing on the verge of chaos" and the transition to a stable stage in the development of the social system. This allows us to conclude that the basis of self-deployment of the globalized world as a set of complex social systems is autopoiesis, self-regulation and self-organization, which are aimed at solving problems of uncertainty, information stochasticity and "balancing on the verge of chaos". Reinforcement Learning is a promising technique for creating agents that can be applied to real world problems. The most important features of RL are trial-and-error search and delayed reward. Thus, agents randomly act in the early learning stage. However, such random actions are impractical for real world problems. This paper presents a novel model of RL agents. A feature of our learning agent model is to integrate the Analytic Hierarchy Process into the standard RL agent model, which consists of (...) three modules: state recognition, learning, and action selecting modules. In our model, the AHP module is designed with {\\it primary knowledge} that humans intrinsically have in a process until a goal state is attained. This integration aims at increasing promising actions instead of completely random actions in the standard RL algorithms. Profit Sharing is adopted as a RL method for our model, since PS is known to be useful even in multi-agent environments. To evaluate our approach in a multi-agent environment, we test a PS RL method with our agent model on a pursuit problem in a grid world. Computational results show that our approach outperforms the standard PS in terms of learning speed in the earlier stages of learning. We also show that the learning performance of our approach is superior at least competitive to that of the standard one in the final stages of learning. (shrink)

Decision-making has traditionally been modelled as a serial process, consisting of a number of distinct stages. The traditional account assumes that an agent first acquires the necessary perceptual evidence, by constructing a detailed inner repre- sentation of the environment, in order to deliberate over a set of possible options. Next, the agent considers her goals and beliefs, and subsequently commits to the best possible course of action. This process then repeats once the agent has learned from the consequences of her (...) actions and subsequently updated her beliefs. Under this interpretation, the agent’s body is considered merely as a means to report the decision, or to acquire the relevant goods. However, embodied cognition argues that an agent’s body should be understood as a proper part of the decision-making pro- cess. Accepting this principle challenges a number of commonly held beliefs in the cognitive sciences, but may lead to a more unified account of decision-making. This thesis explores an embodied account of decision-making using a recent frame- work known as predictive processing. This framework has been proposed by some as a functional description of neural activity. However, if it is approached from an embodied perspective, it can also offer a novel account of decision-making that ex- tends the scope of our explanatory considerations out beyond the brain and the body. We explore work in the cognitive sciences that supports this view, and argue that decision theory can benefit from adopting an embodied and predictive perspective. (shrink)

Chapter 1: An Introduction: The ‘Semantic Sting’ Argument Describes Dworkin’s theory as concerning the conditions of legal validity. “A legal system is a system of norms. Validity is a logical property of norms in a way akin to that in which truth is a logical property of propositions. A statement about the law is true if and only if the norm it purports to describe is a valid legal norm…It follows that there must be certain conditions which render certain norms, (...) but not others, legally valid. Hence it also follows that there can be two types of disagreement over the truth or falsehood of propositions about the law. People can disagree over the question ‘What are the conditions of legal validity?’, in which case their disagreement is a theoretical one. Or they can agree on the conditions of validity, and disagree as to whether or not those conditions actually obtain in a given case or not.” Argues that the best way to interpret Dworkin’s ‘semantic-sting argument’ is as a general argument against conventionalism in legal positivism. Summarizes the outcome of Dworkin’s argument as follows: “[I]f Dworkin is right about the legal reasoning of lawyers and judges, conventionalism would be self-defeating: if lawyers and judges recognize as legally binding not only those norms which are uncontroversially identifiable under the Rule of Recognition, that is, if what they recognize as binding is not only source-based law, then conventionalism turns out to be false on its own terms. In other words, either law is not what lawyers and judges think that it is, in which case law is not a matter of conventions, or – if it is what lawyers and judges think – conventionalism is false, as they do not see the law as purely a matter of conventions.” Dworkin’s theory, then, is a new conception of jurisprudence aiming to present itself as a rival to conventionalism. The book will be concerned with re-examining positivism in light of the interpretative challenge. Chapter 2: Meaning and Interpretation “[R]oughly, interpretation can be defined as an understanding or explanation of the meaning of an object.” Interpretation in this narrow sense is distinct from a less formal and broader use of interpretation that makes it equivalent to explanation. “Hence also, only those objects which are capable of bearing some meaning qualify as objects of interpretation.” [Why shouldn’t we think of interpretation as object-identification? This seems to be closer to what Dworkin has in mind.] Thus, a consideration of the philosophical work on meaning is appropriate. First, a consideration of Davidson on interpretation. The thesis is that Davidson’s “radical interpretation” can only account for sentence meaning and not for linguistic interpretation in general. Davidson cannot account for the non-rule-governed aspects of communication. “Semantics, as opposed to interpretation, concerns those aspects of communication which are rule or convention governed…but such rules are normally unavailable as reasons or justifications for an interpretation. On the contrary, interpretation is usually required because the issue is not determined by rules or conventions.” Interpretation, rather, is parasitic with understanding the meaning of an expression and not equivalent with it. As Dummett notes, any reflection on the meanings of words assumes prior knowledge of ordinary meanings. “This leads to the conclusion that understanding or explaining the meaning of an expression and interpreting it, are two conceptually separate things. It also indicates that seman ics can only be employed, if at all, to elucidate the concept of interpretation by way of contrast: interpretation concerns those aspects of communication which are under-determined by semantic rules or conventions.” Pragmatics, the study of problems posed by discrepancies between utterer’s meaning and sentence meaning, would seem to be closer to inquiry into interpretation. Both are concerned with understanding how meaning is possible where conventional rules leave off. Contemporary pragmatics, moreover, recognizes the logically indeterminate character of communicative inferences beyond conventional meaning and that the contextual conditions that account for the possibility cannot be realized in the semantic structure of the sentence. However, different criteria of success may be at work in pragmatics than interpretation. Pragmatics is concerned with how communication is achieved and thus the criteria of success would be grasping a speaker’s intentions. Many think, however, that communication is unimportant in certain spheres of communication, e.g. artistic interpretation, and that in these cases the aim of interpretation is not to uncover the actual artist’s intentions. What kind of meaning is interpretation aimed at then? It cannot be the meaning the object has for the interpreter. “Interpretation purports to be a statement about the object interpreted, not about the subject who offers the interpretation…it is crucial to remember that not everything we say about a work of art, or any other text, amounts to an interpretation of it. Only those aspects of a text which can shed light on its meaning form part of the text’s interpretation. What the text means for someone rarely entails anything about what the text means.” [This is puzzling to some extent for it remains somewhat ambiguous what it means to talk of subject-independent meaning.] Interpretive meaning attribution is, rather, counterfactual. “In general, I will suggest that the answer to this question consists in the fact that meaning is assigned by a counterfactual statement. Given that x is the meaning attributed to, for instance a text T, and x is not the literal meaning of T, nor is it the meaning of T intended by its author, then the attribution of meaning x to T can only be understood as the contention that on the basis of certain assumptions a certain fictitious or stipulated speaker would have meant x by expressing T.” Thus, on this account, interpretation, when it does not concern an actual speaker, turns out to be a kind of counterfactual intention attribution. Twofold point: “First, that interpretation is essentially a matter of attributing intentions, that is, in the pragmatics sense of ‘meaning’, namely, meaning that such-and-such by an act or expression. At the same time, interpretations need not be based on the intentions of actual authors; the meaning of an act or expression is understandable in terms of counterfactual intentions.” [Are we really restricted to understanding the coherence and integrity of meaning in such a way? Presumably the author is a kind of device for organizing meaning, much like Dworkin’s integrity, but need it take that format?] The logic of interpretation is typically reducible to intention attribution. [What role does the counterfactual author play in structuring meaning?] The criteria of interpretive success will depend upon the object, whether it is the real author or the counterfactual author. If the former, success will depend upon the retrieval of the author’s actual intentions. “Likewise, if the author is characterized in terms of some ideal representative of a certain genre, for instance, the presumptions which are taken to determine this c aracterization would provide the criteria of success for the particular interpretation offered.” [The criteria of success would seem, then, to be the principles, ideals, etc. that we attribute to the counterfactual author. These attributed qualities would be doing all the work – is the attribution of intention to the hypothetical author, then, really necessary at all?] [Does this account presuppose a weird dichotomy between what an object is and what it means? This dichotomy is different, if present at all, in Dworkin.] Chapter 3: Dworkin’s Theory of Interpretation and the Nature of Jurisprudence Three main insights of Dworkin’s theory of interpretation: “First, that interpretation strives to present its object in its best possible light. Second, that interpretation is essentially genre-dependent. And third, that there are certain constraints that determine the limits of possible interpretations of a given object.” Why the best light? Dworkin doesn’t really address this question in depth but claims that otherwise we are left with no way of justifying and choosing an interpretation or we are left with the author’s intention model, which we should reject. [Marmor doesn’t seem clear on what precisely it means to present something in its best light – seems to conflate it with most appealing light which, I take it, is different than what Dworkin has in mind.] “Dworkin is quite right to maintain that without having some views about the values inherent in the genre to which the text is taken to belong, no interpretation can take off the ground. The values we associate with the genre partly, but crucially, determine what would make sense to say about the text, what are the kinds of meaning we could ascribe to it.” There is no necessity for an interpretation to present an object in its best light with regards to the genre it is taken to be part of. Interpretations “could simply strive to present it in a certain light, perhaps better than some, worse than others, but in a way which highlights an aspect of the meaning of the text which may be worth paying attention to for some reason or another.” [What kind of reasons would count in choosing to present it in one light rather than another?] There is simply zero grounds for Dworkin’s assertion that we have no reason to pay attention to an interpretation that does not present it in its best light. Take a psychoanalytic interpretation of Hamlet, for example – not the best light, but a legitimate one. [This seems related to the next criticism – clearly Dworkin would have to loosen his insistence on the best, though not to detriment.] Moreover, especially with regards to art, it doesn’t appear possible to make an all things considered judgment about the best interpretation given the incommensurability of different values that are taken to inhere in a given genre. [Dworkin can respond here that we may have different available interpretations that could be justified with respect to the relevant value. Moreover, a lack of common denominator does not prevent any comparison whatsoever.] Constructive interpretation concerns social practices constituted by norms – it imposes a purpose or value rendering intelligible the normative character of the practice. There is a separate aspect of constructive interpretation that maintains that elements of the practice are sensitive to the point of the practice. It is important to note that different social practices will institutionalize themselves in different ways – thus, different practices will establish varying conditions on how the practice can be altered. The position of the positivists is that evaluative judgments concerning what the law should be are insufficient for determining what the law is given the nature of law’s institutionalization.&nb p; [This would seem to reside on a certain conception of law, i.e. an interpretation about where the value of law lies.] “[T]his being one of the main points of dispute between Dworkin and his positivist opponents, Dworkin cannot at this initial state presume law to be sensitive to its value in the manner that other, non-institutional practices might be, without incurring the charge of having assumed the very point at issue.” The upshot for Dworkin is that any explanation of a social practice such as law requires the same kind of reasoning as participation in that practice. This will be called the hermeneutic thesis. We can try to reconstruct a justification for this view based on the necessity of shared background assumptions – but this will not do since Dworkin’s claim is stronger: it contends that participants’ and theorists’ must “adopt one and the same normative point of view.” [The sense of normative here is unclear. It is true, though, that shared background assumptions do not imply viewing the law as valuable in any particular way, or at least it does not imply this in any strong sense.] Dworkin makes two distinct points with the hermeneutic thesis: “First, that the explanation of a social practice, like law or the arts, is essentially interpretative, and as such, necessarily value laden. Second, that the interpretation of such social practices, which Dworkin calls ‘argumentative’, is unique in the sense that the practice itself is an evaluative enterprise, and that therefore the interpreter of such a practice must form an evaluative judgment of her own about those values which are inherent in the practice that she purports to interpret.” [As stated, the first thesis is terribly ambiguous – for Dworkin, it clear implies a commitment to constructive interpretation. For Marmor, who accepts it, it is totally unclear what commitment he intends to make. He seems to mean simply that we have criteria for success concerning what counts as a successful explanation.] Mamor denies the second thesis. “What Dworkin seems to ignore here is that there is a crucial difference between forming a view about the values which are manifest in a social practice, like law, and actually having evaluative judgments about them.” [The problem, however, it that it is a contentious matter what values are part of the law – a theorist’s account of what values are constitutive of a particular legal system must rely on the kind of arguments which participants rely on. Of course, a theorist might simply note a debate about values and attempt to remain agnostic, but this will fail to be a full theoretical account of what law is!] Dworkin’s thesis seems to depend exclusively on his account of constructive interpretation. [This seems exactly right.] Chapter 4: Coherence, Holism, and Interpretation: The Epistemic Foundation of Dworkin’s Legal Theory Begins with discussion of Rawls’ reflective equilibrium. Sums up dual criticism as follows: “[T]he assumption that intuitions are independently true and the converse one, that their truth depends on fitting a coherent scheme, both seem to yield paradoxical results.” Dworkin, in his article “The Original Position”, claims that Rawls cannot commit himself to ethical realism. “[T]he natural model presupposes some form of ethical realism, while the constructive model does not. One important difficulty arising from an attempt to apply the natural model to Rawls is, that under the natural model, any theory which dopes not account for an intuition, at least for one which is held firmly, cannot be wholly satisfactory, just as scientific theory which does not account for certain observational data it is supposed to cover, would not be satisfactory in a familiar way.” Rawls, rather, is committed to a constructivist view of morality. Moreover, the reason we value coherence epistemically in moral theory is that it itself is a value of political morality – fairness requires consistency and publicity in the application of moral standards. Marmor notes the following problem with such a view: “[I]f coherence is justified, as it is here, with reference to certain moral values, that is, a specific conception of fairness, then we face the following problem: the presupposed values of fairness must themselves be based upon intuitive convictions, in which case the question of their truth cannot be ignored. If they are taken to be true…we are driven back to the perplexities of the natural model.” Discusses, helpfully, the Fish/Dworkin debate. The upshot is that Dworkin’s interpretive model is best off if it commits itself to a Quineian holism. However, this undermines his distinction between internal and external skepticism since holism must deny that moral judgments constitute a closed system. [This analysis seems exactly right.] Endorses Simmonds view that Dworkin’s theory does not meet the requirements of complexity he identifies as necessary to avoid vicious circularity in interpretive judgments of fit and identity. Coherence is doing the work through and through and therefore the interpretive theory of law is circular. [Will require further investigation, though it is unclear how coherence is doing any work in the pre-interpretive stage. At this stage, the judgments, if interpretive, seem to be derived from different sources. In any case, using coherence as a value seems to be highly suspect.] Why doesn’t Dworkin just reject Fish’s assumptions: because of his jurisprudence. “If legal texts can have a meaning that is not entirely dependent on a process of interpretation, then it is at least sometimes the case that the law can simply be understood, and applied, without the mediation of interpretation. And if that is the case, then the argument from interpretation against legal positivism collapses. It is no longer the case that every conclusion about what the law is, depends on evaluative considerations about what it ought to be.” Chapter 5: Semantics, Realism, and Natural Law Assessment of Michael Moore’s legal realism and its implications. [The final criticisms of Moore are not decisive.] Chapter 6: Constructive Identification and Razian Authority A consideration of Dworkin’s denial that the communication model of interpretation is appropriate for legal interpretation. Marmor argues that intentions do play a crucial role in the identification of legal norms in a way that is incompatible with Dworkin’s “coherence thesis”. Marmor takes Dworkin to be committed to the constructive identification thesis: that the identification of something as part of the legal, artistic, etc. genre can be done sufficiently by evaluative considerations. “Here, one must maintain that evaluative considerations are sufficient to determine whether something is a legal norm or a work of art”. [Fit, however, constrains possible evaluative considerations – thus evaluative considerations are not sufficient in themselves.] “Now the crucial point here is this: if you maintain the possibility of constructive identification in art, you must assume that works of art can be identified as such on the basis of certain features they happen to possess, features which contain no reference to any particular intention to create a work of art…unless we take intentions into account, how can we discriminate between the concept of an aesthetic artifact and the con ept of a work of art?” [It is unclear, and I think false, that constructive interpretation of anything requires identifying something irrespective of an artificers intentions. Those intentions may be relevant, dependent upon the genre under which we are trying to classify the object. Nothing, seemingly, about constructive interpretation in general excludes this possibility.] Marmor’s point is that it turns out to be impossible to identify art as art without reference to an artist’s intentions – especially given the state of contemporary art. [It is notable that Marmor’s response to counterexample implicitly depends upon a fully developed theory of aesthetics. His cursory comments on the matter of identifying art seem insufficient to say the least.] The rest of the chapter considers the incompatibility of Raz’s account of authority with constructive interpretation. The incompatibilities mentioned do not move beyond what Raz identifies in his article “Authority, Law and Morality”, but a defense of this notion of authority is defended in several [inconclusive] respects. [Raz and Marmor want to separate identification from content. This is not clearly a defensible separation.] Chapter 7: No Easy Cases? Chapter defends notion that there is a distinction between easy and hard cases in the positivist sense. Takes a Hartian approach and ultimately defends the distinction by associating it Wittgenstein’s conception of rule following. The point is that one need to look the purpose of rule in order to understand what the rule requires. Chapter 8: Legislative Intent and the Authority of Law Examines the following doctrine concerning the role of legislative intent in adjudication: “[F]irst, it would hold that laws, at least in certain cases, are enacted with relatively specific intentions, and that this is a matter of fact which is discernible through an ordinary fact-finding procedure. Second, that in certain cases the presence of such a fact, namely, that the law was enacted with a certain intention, provides judges with a reason to decide the legal dispute in accordance with the relevant legislative intent.” [It is important that for Marmor, interpretive strategies are only appropriate in hard cases. However, we should wonder what grounds positivism can offer for deciding a hard case in any manner which is not the morally best manner according to the judgment of the judge. There are no legal grounds, by definition, in hard cases and so what justificatory strategy would endorse any judicial decision except for the morally best one?] We can ascribe intentions to a legislative body, when this is possible at all, by taking the shared intentions of the majority, rather than some group intention, to be the significant intentions. Moreover, we should expect a good deal of consensus about intentions for otherwise it is hard to explain how legislative bodies are able to produce so much legislation. Discussion of kinds of intentions concludes as follows: “I have distinguished between three main types of intention that are potentially relevant from the legal point of view. Apart from the intentions that are manifest in the language of the law itself, legislators typically have further intentions in enacting a given law, and sometimes they would have certain intentions bearing on its proper application. I have also suggested that some of these further intentions may be essentially non-avowable, in which case they are rendered initially irrelevant. Finally, I have pointed out that considerations of consistency require that the legislator’s application intentions be taken into account only if, and to the extent that, they are in accord with his further intentions.” The manner in which intentionalism is to be justif ed relies on the distinction, Marmor maintains, between expert and mere collective action authority. “The point I wanted to make is strictly conditional: if, and only if, a certain law is justified on the basis of the expertise branch of the normal justification thesis, would it make sense to defer to the legislature’s intentions in the interpretation of the law, that is, to the extent that there is, in fact,; such an intention and it can clarify something that needs clarification.” Insofar as a legislature can be considered an expert on the matter requiring adjudication and interpretation should the body’s intention be taken into account. Chapter 9: Constitutional Interpretation Begins by laying out general necessary features of a constitution. Then Marmor moves on to consider general questions of constitutional legitimacy. First, he considers what grounds might be offered for the legitimacy of a constitution at all. He notes that the central question is what permits a single generation to bind future generations. He then examines four arguments to avoid this problem. The first is based on the moral legitimacy of the constitution; Marmor rejects this solution for the [truly dubious] reason that the constitution would make no practical difference because it would not supply reasons in addition to those provided by morality [but, presumably, the point is that these legally valid rules would be institutionally enshrined]. The second is based on the moral authority of the framers and Marmor rightly rejects this on the basis of the idealization of the framers it requires and less rightly on the basis that there cannot be moral authorities. Third is the “argument from interpretation” which claims that “as long as the particular content of the constitution is determined by its interpretation, and the authoritative interpretation at any time correctly instantiates the values which ought to be upheld in the community, the constitution would be morally legitimate”. The fourth is Raz’s which argues that a constitution is valid so long as its constraints are morally permissible because conventions of this type might aid the continuity of the legal system, i.e. it is important to have a convention of this type and the constitution is a kind of this type. Marmor appears to endorse these two approaches and concludes: “The conditions for the legitimacy of a constitution must comprise the following conditions. First, the values and principles enshrined in it must be morally permissible…Second, when certain choices are made in particular cases, they would be legitimate if they are either morally underdetermined, or else, morally correct…It follows from this that both arguments must assume that at least in those areas in which the constitution would make a moral difference, it can be interpreted to make the difference that it should, that is, according to the true moral principles that should apply to the particular case...the moral legitimacy of constitutions very much dependent on the practices of their interpretation. In other words, a great deal of the burden of moral legitimacy is shifted by these arguments to the application of the constitution, thus assuming that the constitution is legitimate only if the courts are likely to apply the constitution in a morally desirable way.” [This implies that the only significant value constitutions have is in providing a conventional practice where some such practice is required.] Moves on to argue that courts typically rely, and rightly so, on moral considerations when deciding constitutional issues because typically, in cases of the kind that reach the supreme or constitutional court, there is no law on the case. Much of this relies on his earlier discussion about the nature of interpretation in the law – that legal interpretation is always a matter of cha ging the law. (shrink)

To date, economics has failed to develop a useful theory of entrepreneurship because of its inability to break out of the static equilibrium framework and the modeling of success/failure as a 0-1 variable. Entrepreneurship research also has not achieved this task due to its preoccupation with the quest for “the successful entrepreneur” and/or the successful firm. This essay calls for a new vocabulary for entrepreneurship, consisting of (1) a plural notion of the entrepreneurial process as a stream of successes and (...) failures, wherein failure management becomes the key science of entrepreneurship; (2) an effectual notion of bringing together particular entrepreneurs and particular environments through creative action; and (3) a contingent notion of aspirations that places imagination at the center stage of economics. Together, the new vocabulary allows us to ask new questions and develop new approaches that allow entrepreneurship to tackle the central task of imagination in economics, i.e., to create from the society we have to live in, the society we want to live in. Is bodily awareness a condition on bodily action? I approach this question by weaving an argument based on considerations from action theory, the phenomenology of embodied agency, and from the psychology and neuroscience of action. In this paper, I discuss two accounts on which bodily awareness is a condition on bodily action. The first is an influential philosophical account from O'Shaughnessy, which claims that bodily awareness is necessary for the online control of bodily action. I argue that there are (...) empirical counterexamples to O'Shaughnessy's account. Instead I propose an account on which the capacity for bodily awareness is a condition on our capacity for ordinary bodily action. This alternative account does justice to the causal and functional character of ordinary bodily action as well as its phenomenology. It is also consistent with the psychology and neuroscience of action. I provide a two-stage argument for my view. The first stage shows that a sense of the spatial possibilities of one's body is a condition on intentionally acting with one's body. The second stage demonstrates that bodily awareness is a condition on a normal afferented agent's sense of the actions open to him through examining the role of bodily awareness in motor imagery and the role of motor imagery in preparatory processes for everyday actions. This paper reports on a survey that investigated the moral decision processes of accountants. A formal belief revision model is adapted and hypotheses based on theorizations from the cognitive-developmental school are tested. The moral decision processes of accountants are hypothesized to be influenced by professional expectations, organizational expectations and internalized expectations. Subjects provided specific demographic data and were asked to access the appropriateness of fourteen principles for making moral decisions in business. Subjects were also asked to indicate which of the (...) fourteen approaches would be most appropriate for resolving each of five ethical situations that are representative of common ethical dilemmas in accounting.Subjects'' responses to the appropriateness of the fourteen principles are reduced to two dimensions using factor analysis. The factors are consistent and representative of important underlying dimensions of the stages of moral development. Demographic variables are correlated with the extracted factors using analysis of variance. (shrink)
