Abstract:In Scotland, policies supporting the development of wind farms frequently come into conflict with those designed to protect wild land. The siting of turbines is, amongst other things, administered by wild land areas, whilst wild land areas are, in part, characterized by the absence of turbines. In this article, I focus on how the classification of wild land has been constructed in official narratives and I describe the substantial scale of collaborative human labor implicated in this process. I draw on (...) the story of a public local inquiry into a wind farm proposal to make visible some of the contradictions implicit in the term's use and to argue that wildness, as conceived by Scottish Government, is primarily an aesthetic category which relies on absences. I argue that employing wild land as an administrative technology conceals the various kinds of labor that are intrinsic to creating wild land. The work of extending and reinforcing the technologies which govern land use is hidden behind the notion of wild land as a place from which human exertions and technologies are absent. (shrink)

This study dealt with the interaction between two important trends in future Western societies, i.e. the greying of society and the technology-induced transformation of everyday life. It aimed at formulating a framework of policy recommendations with regard to the elderly and ICT in 2030. To meet this objective a three-phased methodology was developed, relying on methods of participatory technology assessment and technology foresighting. In the first phase of the project, a literature study, semi-structured expert discussions and focus groups with (...) (future) elderly provided the necessary information for the development of scenarios about the future. In the second phase, these scenarios were transformed into a theatre play, which was performed for elderly audiences. Group discussions with senior participants led to the formulation of the “desired” future with regard to the elderly and ICT. In this study, we discuss the role of senior nurses who sit on clinical commissioning groups that now plan and procure most health services in England. These nurses are expected to bring a nursing view to all aspects of clinical commissioning group business. The role is a senior level appointment and requires experience of strategic commissioning. However, little is known about how nurses function in these roles. Following Barrientos' methodology, published policy and literature were analysed to investigate (...) these roles and National Health Service England's claim that nursing can influence and advance a nursing perspective in clinical commissioning groups. Drawing on work by Berg, Barry and Chandler on ‘new public management’, we discuss how nurses on clinical commissioning groups work at the alignment of the interests of biomedicine and managerialism. We propose that the way this nursing role is being implemented might paradoxically offer further evidence of the devaluing of nursing rather than the emergence of a strong professional nursing voice at the level of strategic commissioning. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these (...) associations is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Since April 1996, the National Science and Technology Council (NSTC), in collaboration with the Office of Science and Technology Policy (OSTP) in the Executive Office of the President, has been leading the development of a government-wide Federal policy for research misconduct. While citizens often use non-instrumental arguments to support environmental protection, most governmental policies are justified by instrumental arguments. This paper explores some of the reasons. We interviewed senior policy advisors to four European governments active in global climate change negotiations and the UNCED (United Nations Conference on Environment and Development) process. In response to our questions, a majority of these advisors articulated deeply held personal environmental values. They told us that they normally keep these values separate from their (...) professional environmental policy activities. We interpret these findings within the context of the literature on environmental ethics and values. We suggest that environmental policy could be improved if widely held environmental values were articulated, validated, and admitted into the process of policy analysis and deliberation. (shrink)

In an effort to contain the spread of COVID-19, many states and countries have adopted public health restrictions on activities previously considered commonplace: crossing state borders, eating indoors, gathering together, and even leaving one’s home. These policies often focus on specific activities or groups, rather than imposing the same limits across the board. In this Article, I consider the law and ethics of these policies, which I call tailored policies. In Part II, I identify two types of tailored policies--activity-based and (...) group-based. Activity-based restrictions respond to differences in the risks and benefits of specific activities, such as walking outdoors and dining indoors. Group-based restrictions consider differences between groups with respect to risk and benefit. Examples are policies that treat children or senior citizens differently, policies that require travelers to quarantine when traveling to a new destination, and policies that treat individuals differently based on whether they have COVID-19 symptoms, have tested positive for COVID-19, have previous COVID-19 infection, or have been vaccinated against COVID-19. In Part III, I consider the public health law grounding of tailored policies in the principles of “least restrictive means” and “well-targeting.” I also examine how courts have analyzed tailored policies that have been challenged on fundamental rights or equal protection grounds. I argue that fundamental rights analyses typically favor tailored policies and that equal protection does not preclude the use of tailored policies even when imperfectly crafted. In Part IV, I consider three critiques of tailored policies, centering on the claims that they produce inequity, cause harm, or unacceptably limit liberty. I argue that we must evaluate restrictions comparatively: the question is not whether tailored policies are perfectly equitable, wholly prevent harm, or completely protect liberty, but whether they are better than untailored ones at realizing these goals in a pandemic. DeRenzo **This article addresses the National Institutes of Health (NIH) employee conflict-of-interest (COI) policy that went into effect February 2005. It is not, however, merely an account of another poorly crafted government policy that cries out for revision. Instead, it (...) is also a story about one of our nation's most important and prestigious institutions and its struggles to navigate the crosscurrents of scientific aspirations, power politics, public ambivalence toward capitalist economics in the biosciences, and the media's inclination to exaggerate problems and under report complicated facts. It is also a tale of greed, politics, purgatory, and redemption. The dramatic and abrupt change in the NIH COI policy demonstrates the difficulty of balancing the production of cutting-edge science with the demands for transparency resulting from work performed in the public interest on the public tab. It is an unhappy chapter in the life of a government agency that is also a national treasure. And, one hopes, it will be an example of how harmful and ill-conceived law can be revised and amended to advance national health and well-being. What is the New NIH COI Policy? The new NIH COI employee policy, more accurately referred to as the Interim Final Rule (Federal Register 2005), is a sweeping set of prohibitions on activities and holdings to reduce the possibility that NIH employees will have any actual [End Page 199] or apparent conflicts of interest. For the most part, the prohibitions are applied across-the-board—i.e., without distinction to employee category or function. The new policy includes prohibitions on outside activities, stock holdings, and awards. It prohibits all NIH employees from engaging in any compensated or uncompensated employment, including consulting, serving on advisory or other such boards, and compensated teaching, speaking, writing, or editing with certain kinds of entities. The first class of such entities is referred to as substantially affected organizations, defined as biotechnology, pharmaceutical, medical device companies, and others with similar interests. But these are not the only entities included in the prohibitions. Other organizations from which NIH employees now are cut off are hospitals, clinics, and other health care institutions; health, science, or health research-related professional associations and consumer and advocacy groups. Included also are educational institutions and not-for-profit independent research institutes that are, or were, recent NIH funding applicants, grantees, contractors, or cooperative research and development agreement (CRADA) partners. The Brazilian Federal Senate created a Parliamentary Inquiry Commission (CPI) to investigate the Bolsonaro government's irregularities in the management of the COVID-19 pandemic. One of the cases that drew attention was the research conducted by Prevent Senior, a private health insurance company, on the early treatment of COVID-19. The article analyzes the scientific validity of the research and the ethical problems related to its implementation. It is based on analysis of Prevent Senior's report of the clinical study, the (...) Brazilian and USA clinical trial registries, the Senate's CPI report, and on the information reported by the media. This case of scientific fraud and political-ideological bias exemplifies how Prevent Senior, using a questionable protocol to enhance its reputation and gain government support, was instrumental in building the “early treatment” narrative for COVID-19, and shows how it served as a basis for a government public policy that promoted the use of ineffective drugs. To understand the impact of social, financial, cultural capitals, negative culture, and socioeconomic status of families on educational aspiration in the senior high school student athletes, it will be beneficial to promote their career developments. The purpose of this study is to explore the influence of ethnicity, year of sport experience family income, the educational expectations of significant others, and the three aforementioned types of capital on educational aspiration among the senior high school student athletes. This study was (...) conducted with a sample of 262 U-18 male baseball student athletes. Of the participants, 20.20% had attained the qualifications to play on the national team. The results showed that monthly family income positively affected social capital and positively indirectly affected educational aspirations through social capital, whereas monthly family income negatively affected negative culture and positively affected educational aspirations through negative culture. Moreover, social capital positively affected educational aspirations compared with negative culture negatively affected educational aspirations. The results serve as a reference for the formulation of educational policy as it relates to student athletes. (shrink)

Of recent years there have appeared in the literature several attempts to apply to the subject matter of chemistry mathematical theories which had not thitherto found any use in that field. With the spirit and purpose of such attempts, the author of this paper is thoroughly in sympathy. But some of the investigators who have undertaken this kind of pioneer work in applied mathematics have apparently entered upon their tasks without appreciating the difficulties involved, and have hence produced results more (...) likely to obscure than to clarify their subjects. This process can be analyzed in conjunction with changes in work and leisure time and their place in the human life cycle. This article aims to approximate the main features of: contemporary position of elderly people, creative ageing policy, benefits from seniors creativity and controversies linked to this concept. This essay also indicates the patterns of recommendations and activities in development of services for older people (...) which may be the subject of further in-depth research. Se realizó una revisión bibliográfica con el objetivo de valorar las implicaciones sociales de la investigación científico-tecnológica en Neurosicología del Adulto Mayor, mediante la caracterización del estado actual del proceso, los condicionantes que favorecen o impiden su desarrollo y los impactos sociales que genera. La investigación científico-tecnológica en esta área está condicionada por necesidades sociales propias del contexto actual. Se han identificado políticas, legislaciones e infraestructuras que la favorecen, aunque, existen algunas limitaciones. La producción tecnológica dirigida a la rehabilitación y (...) estimulación cognitiva continúa en ascenso, utilizando principalmente software y aplicaciones. La investigación del impacto de estas herramientas ha arrojado resultados contradictorios, lo que limita su poder de transformación social. Se pudo concluir que en Cuba es necesario estimular la transferencia de tecnología, la innovación tecnológica y la creación de alternativas de intervención ajustadas a la realidad económico-social de los adultos mayores. A bibliographical review was conducted with the aim of assessing the social implications of scientific-technological research in Senior Citizens' Neurosurgery through the characterization of the current state of the process, the determining factors that favor or stop its development and the social impact it generates. In this field, scientific-technological research is conditioned on social necessities typical of the current context. Policies, legislations and the infrastructures that favor it have been identified. Nevertheless, there are limitations. Technological production directed towards cognitive rehabilitation and stimulation continues to rise using mainly software and applications. The research on the impact of these tools has produced contradictory results, which limit their social transformation power. It was reached the conclusion that in Cuba, there's a need to stimulate technology transfer, technological innovation and the creation of intervention alternatives adapted to senior citizens' social-economic reality. Some portions of it have already been accomplished; but a great deal remains to be done, and the difficulties of the problems yet unsolved impress me as formidable. I believe, however, that it would be hard to overestimate the (...) benefits which might follow from the construction of such an abstract theory, always provided that that theory met certain conditions. Not only must the system in question measure up to the standards of rigor and precision set by the logicians, but it must also be cast in such form that a working scientist could learn to understand at least that part of it applicable to his own specialty without being forced to drop his professional work and devote the labor of years to mastering the subject. Our socio-economic innovation ecosystem is riddled with ever-increasing complexity, as we are faced with more frequent and intense shocks, such as COVID-19. Unfortunately, addressing complexity requires a different kind of economic governance. There is increasing pressure on economics to not only going beyond its traditional mainstream boundaries but also to tackle real-world problems such as fostering structural change, enhancing sustained growth, promoting inclusive development in the era of the digital economy, and boosting green growth, while addressing the divide between the (...) financial sector and the real economy. This book demonstrates how to apply complexity science to economics, in an effective and instructive way, in the interest of life-enhancing policies. The book revolves around the non-negligible problem of why economics, to date, seems to be insufficient in guiding economic governance to navigate through real and ever-intensifying complex socio-economic and environmental challenges. IN THIS ESSAY I CONSIDER WHETHER POLITICAL ENGAGEMENT MAKES good persons. I first examine how the self is formed as a moral agent in and through the exercise of moral agency in political life, which I call "political agency." Politics is a morally ambiguous context of formation. On the one hand, political engagement trains the skills and virtues conducive to good citizenship in particular and the good life in general. But it also entails the instrumental and even coercive uses of (...) power to countervail the interests of others. This often leaves the self disintegrated. Drawing on John Calvin's moral theology, I argue that God transfigures this fractured, political self in the cruciform shape that lives dedicated to politics take. This paper responds to Are the Semi-Living semi-good or semi-evil? (Technoetic Arts, 2003) in which artists/authors Zurr and Catts state that there is not, as yet, an existing discourse that deals with the Semi-Living a new life form created for the purpose of artistic engagement using the tools of tissue engineering and stem cell technology. As a means to reflect on what a discourse on the Semi-Living might include and exclude and to create the potential to say something different beyond (...) the artists own discourse, this paper initiates two approaches. First, it considers that which the Semi-Living defers by working from Zurr and Catts contribution, which I argue evokes a both/and logic that echoes the Derridean deconstructive event. Secondly, it proposes a genealogy of the Semi-Living using a figure of Roman archaic law, homo sacer (sacred man) who shares with the Semi-Living a life exposed to death (Agamben 1998). The symbiosis of these two approaches identifies, problematises and contaminates the limits of acceptable discourse concerning the Semi-Living, concluding with the proposal of a semi-discourse. As the transdisciplinarity of bioart increasingly becomes the focus of academic and artistic inquiry, this paper signals towards the importance of critically acknowledging a community of artists writing and working within the academy, stipulating the acceptable discourses of their practice.
