Criminal law abolitionists claim that legal punishment cannot be morally justified and that we should therefore abolish criminal law. While this is still a minority position in the current debate, the number of proponents has been increasing, and even opponents have developed a certain degree of sympathy for such claims in recent years. Yet one of the reasons many remain hesitant regarding the abolition of criminal law appears to be the lack of a thought-through alternative, in addition to abolitionists (...) disagreeing considerably amongst themselves on what an alternative should look like. I will call this the missing alternative objection. To address this central concern, I will argue in this paper that the most prominent versions of abolitionism actually converge on the same alternative core to criminal law — even though they are driven by vastly different motivations. This core that current abolitionist theories converge on is two-fold: first, the claim that the state should compel offenders to provide restitution for the victim; second, the claim that restorative processes should be used wherever possible when addressing criminal wrongdoing. I construe Relevant Alternatives Theory (RAT) as an abstract combination of anti-skepticism and epistemic modesty, then re-evaluate the challenge posed to it by the missed clue counter-examples of Schaffer [2001]. The import of this challenge has been underestimated, as Schaffer’s specific argument invites distracting objections. I offer a novel formalization of RAT, accommodating a suitably wide class of concrete theories of knowledge. Then, I introduce abstract missed clue cases and prove that every RA theory, as formalized, admits such a case. (...) This yields an argument - in Schaffer’s spirit - that resists easy dismissal. According to the relevant alternatives theory of knowledge (RA), I know that p only if my evidence eliminates all relevant alternatives to p . Jonathan Schaffer has recently argued that David Lewis's version of RA, which is perhaps the most detailed version yet provided, cannot account for our failure to know in cases involving missed clues, that is, cases in which we see but fail to appreciate decisive evidence. I argue, however, that Lewis's version of RA survives exposure to missed (...) clue cases. Moreover, even though Schaffer maintains that Lewis's Rule of Belief provides no protection against missed clue cases, I argue that we should credit the Rule of Belief with ensuring the survival of Lewis's version of RA. The classic version of the relevant alternatives theory (RAT) identifies knowledge with the elimination of relevant alternatives (Dretske 1981, Stine 1976, Lewis 1996, inter alia). I argue that the RAT is trapped by the problem of the missed clue, in which the subject sees but does not appreciate decisive information.

Working memory is a cognitive process that involves maintaining and manipulating information for a short period of time. WM is central to many cognitive processes and declines rapidly with age. Deficits in WM are seen in older adults and in patients with dementia, schizophrenia, major depression, mild cognitive impairment, Alzheimer’s disease, etc. The frontal, parietal, and occipital cortices are significantly involved in WM processing and all brain oscillations are implicated in tackling WM tasks, particularly theta and gamma bands. The theta/gamma (...) neural code hypothesis assumes that retained memory items are recorded via theta-nested gamma cycles. Neuronal oscillations can be manipulated by sensory, invasive- and non-invasive brain stimulations. Transcranial alternating-current stimulation and repetitive transcranial magnetic stimulation are frequency-tuned non-invasive brain stimulation techniques that have been used to entrain endogenous oscillations in a frequency-specific manner. Compared to rTMS, tACS demonstrates superior cost, tolerability, portability, and safety profile, making it an attractive potential tool for improving cognitive performance. Although cognitive research with tACS is still in its infancy compared to rTMS, a number of studies have shown a promising WM enhancement effect, especially in the elderly and patients with cognitive deficits. This review focuses on the various methods and outcomes of tACS on WM in healthy and unhealthy human adults and highlights the established findings, unknowns, challenges, and perspectives important for translating laboratory tACS into realistic clinical settings. This will allow researchers to identify gaps in the literature and develop frequency-tuned tACS protocols with promising safety and efficacy outcomes. Therefore, research efforts in this direction should help to consider frequency-tuned tACS as a non-pharmacological tool of cognitive rehabilitation in physiological aging and patients with cognitive deficits. Food is becoming an increasingly important issue in the urban context. Urban food policies are a new phenomenon in Czechia, where urban food alternatives to the current food regime are promoted by food movements or take the form of traditional self-provisioning. This paper examines how urban food governance in Prague and Brno is constituted based on the municipalities’ relations with actors engaged in urban food alternatives. We argue that prioritizing aspects of local food system transformation compliant with the status quo (...) is non-systemic and implies a fragmentation of urban food alternatives based on different levels of social capital and radicality. We conceptualize urban food alternatives as values-based modes of production and consumption and focus on values that guide urban food governance in its participatory and territorial interplay with the actors of urban food alternatives. Our analysis reveals that the values underpinning the two cities’ progressive food policies do not match reality on the ground. We propose four types of relations between the two examined cities and aspects of the local food system transformation. Aspects compliant with the status quo, such as food waste reduction and community gardening are embraced, whereas those requiring more public intervention, such as public procurement, short supply chains, or the protection of cultivable land are disregarded, degraded, or, at most, subject to experimentation as part of biodiversity protection. Chances for a successful transformation of the local food system under such governance are low but can be increased by strengthening social capital and coalition work among urban food alternatives. How can black feminist and women of color feminist theoretical interventions help create frameworks for discerning agentic action in the context of power, oppression, and violence? In this paper, I explore the social dimension of agency and argue that intention is not just authored by the agent as a function of practical reasoning, but is also socially authored through others' discernment and translation of her action. Further, when facilitated by reasoning designed to reinforce and rationalize systems of domination, social authoring (...) systematically distorts the intentions of some agents. Although some theorists have argued that those agents whose intentions are not recognized by others are forced to exercise a diminished agency, I contend that this account obscures agency that is practiced despite or through conditions of oppression. As an alternative, I propose that feminist of color theory that examines the structural and existential erasures of women of color maps a conceptual space to help us better discern agentic action that is practiced by those subjects whose acts are defined away from them. Reinforcement learning systems usually assume that a value function is defined over all states that can immediately give the value of a particular state or action. These values are used by a selection mechanism to decide which action to take. In contrast, when humans and animals make decisions, they collect evidence for different alternatives over time and take action only when sufficient evidence has been accumulated. We have previously developed a model of memory processing that includes semantic, episodic and working (...) memory in a comprehensive architecture. Here, we describe how this memory mechanism can support decision making when the alternatives cannot be evaluated based on immediate sensory information alone. Instead we first imagine, and then evaluate a possible future that will result from choosing one of the alternatives. Here we present an extended model that can be used as a model for decision making that depends on accumulating evidence over time, whether that information comes from the sequential attention to different sensory properties or from internal simulation of the consequences of making a particular choice. We show how the new model explains both simple immediate choices, choices that depend on multiple sensory factors and complicated selections between alternatives that require forward looking simulations based on episodic and semantic memory structures. In this framework, vicarious trial and error is explained as an internal simulation that accumulates evidence for a particular choice. We argue that a system like this forms the “missing link” between more traditional ideas of semantic and episodic memory, and the associative nature of reinforcement learning. (shrink)

This paper considers the trajectory of Althusser's Spinozism pre- and post-May ‘68. Where Althusser's application of Spinoza would often lead him into unknown or non-Marxist territory, one alternative way to think this relation is through the figure of Mao, whose concept of non-antagonistic contradiction I propose to read in terms of Spinoza's “determinate negation.” Although not going so far as to suggest that a certain combination of Mao and Spinoza would have enabled Althusser to “complete” Marx, this paper speculates (...) on this omission from his work and what positive insights we can draw from it retrospectively for developing Althusser's political philosophy. Following the formation of disciplines/sciences in different fields of Islamic thought, the specific concepts and terminologies of these disciplines/sciences began to emerge. Then the special meaning and the area of utilization for every concept in each discipline/science were further clarified by compiling specific epistles of definition (ḥudūd), which would contribute to this process of conceptualization. For the terminological meaning of the used concept to be determined primarily and thus for the followed theological/sectarian affiliation to be supported, works belonging to this (...) genre have been written specifically for the field of theology. Especially, the Muʿtazilī theologians undoubtedly made the greatest contribution. Thusly, specific treatises containing theological concepts were compiled by names such as al-Qāḍī ʿAbd al-Jabbār (d. 415/1025), and his students Abū Rashīd al-Nīsābūrī (d. after 420/1029) and Ibn Sharwīn (fl. first half of the Vth/XIth century). Zaydī theologian and jurist Abū’l-Qāsim al-Bustī’s (d. 420/1029) Tahdhīb al-ḥudūd, which has no available copy, is also contemporary to the mentioned works. This tradition found its reflection in the Imāmī-Muʿtazilī line in Abū Jaʿfar al-Ṭūsī’s (d. 460/1067) al-Muqaddimah fī l-madkhal ilá ṣināʿat ʿilm al-kalām, which could be seen as a concise theological work in terms of its construct and the explanations which it comprises, and in the work called al-Ḥudūd wa-l-ḥaqāʾiq, which is attributed to al-Sharīf al-Murtaḍá (d. 436/1044). Abū Jaʿfar al-Muqrī al-Nīsābūrī’s (d. mid-VIth/XIIth century [?]) al-Ḥudūd stands out as the most voluminous example in this tradition. The most important work belonging to this genre in the Muʿtazilī tradition, as it is the first among the available works, is the Ḥudūd al-alfāẓ of al-Qāḍī ʿAbd al-Jabbār, which is found together with some other important Zaydī-Muʿtazilī works in a compilation discovered by us and thought to be lost until recently. In this treatise, which generally includes theological concepts and partially includes the concepts of Islamic law and the history of sects, al-Qāḍī ʿAbd al-Jabbār has put forward a language-based definition theory. His approach here is in line with the views he put forward on definition in his al-Mughnī. Accordingly, instead of definition (ḥadd) and description (rasm) carried out over five universals in classical logic, he adopted a method of lexical definition based on wording that agrees with the meaning of the concept in question and is clearer than it, and consequently gave a brief definition and explanation of the concept he deals with. This clearly shows that the previous Muʿtazilī theologians’ approach of language-based definition, which was used as an alternative to the conception of Aristotelian definition due to their distanced stance to philosophy was also inherited by al-Qāḍī ʿAbd al-Jabbār. The approach seen in some sources in the period following al-Qāḍī, such as Abū Rashīd al-Nīsābūrī’s al-Ḥudūd, also indicates his influence. (shrink)

Since its origins in the mid-Twentieth Century, Cognitive Science has almost exclusively operated within the philosophical frames provided by Cartesian Representationalism. In recent years, alternative, phenomenological and pragmatist, frames have served as a resource for the emergence of non-representational approaches to mind and cognition. These have been gathered under the label ‘4E cognition’, indicating their Embodied, Extended, Enacted and Embedded nature. This chapter examines one version of 4E cognition, which builds upon Ecological Psychology, and argues that it fails to (...) pass the Evaluation Test: it cannot account for the central role of normativity and evaluation in our responsiveness to loci of significance in the lifeworld, while failing to provide an argument for the exclusion of evaluative and normative aspects. The concept of missed care refers to an irrefragable truth that required nursing care, which is left undone, occurs in the delivery of health care. As a technical concept, missed care offers nurses the opportunity to articulate a problematic experience. But what are we to make of missed care from an ethical perspective? Can nurses be held morally responsible for missed care? Ethically speaking, it is generally accepted that if a person has a moral obligation to do something, s/he needs (...) to have the capacity to do it. If a person does not have the capacity to fulfil a moral obligation, then s/he cannot be held responsible for failing to do so. This is captured by the “ought implies can” (OIC) principle. This paper brings the OIC principle to the forefront of the discussion on missed care. It is contended that nurses – qua moral agents – may be discharged from a moral obligation to carry out a required caring act because of some inability that is not of their making and therefore may not be morally responsible for missed care. However, the OIC principle may not be applied to all situations of missed care depending on their causes. In addition, following in the thought of Sapontzis (The Southern Journal of Philosophy, 1991, XXIX, 383–393) it is contended that when an original obligation to deliver a required act of care cannot be fulfilled, other obligations may be generated as summed up in the “Principle of Making Amends” and the “Principle of Appropriate Feeling.” It is the view of this paper that these further principles could prevent the OIC principle from being used to simply excuse omissions of care from a normative standard and could support the view that nurses continue to have alternative obligations to make amends and to respond with appropriate feelings to missed care. The present paper discusses Kitcher’s framework for studying conceptual change and progress. Kitcher’s core notion of reference potential is hard to apply to concrete cases. In addition, an account of conceptual change as change in reference potential misses some important aspects of conceptual change and conceptual progress. I propose an alternative framework that focuses on the inferences and explanations supported by scientific concepts. The application of my approach to the history of the gene concept offers a better account of (...) the conceptual progress that occurred in the transition from the Mendelian to the molecular gene than Kitcher’s theory. Ecology, with its emphasis on coupled processes and massive heterogeneity, is not amenable to complete mechanical reduction, which is frustrated for reasons of history, dimensionality, logic, insufficiency, and contingency. Physical laws are not violated, but can only constrain, not predict. Outcomes are predicated instead by autocatalytic configurations, which emerge as stable temporal series of incorporated contingencies. Ecosystem organization arises out of agonism between autocatalytic selection and entropic dissolution. A degree of disorganization, inefficiency, and functional redundancy must be retained by all (...) living systems to ensure flexibility in the face of novel disturbances. That physical and biological dynamics exhibit significant incongruencies argues for the formulation of alternative metaphysical assumptions, referred to here as “Process Ecology”. (shrink)

From the early writings composed in response to the emergence of National Socialism to the closing years ofhis life in which he confessed to a "perhaps misplaced sensitivity towards murder"1 as the primary catalyst for his philosophical pursuits, Voegelin is preoccupied with the relationship between the good (...) of order and the violence that can both undermine and preserve that order. His theory of consciousness, his philosophy of history, and his "new science ofpolitics" form a complementary whole when understood as expressions of his lifelong concern to find ways to guard against social and political chaos. This preoccupation with order makes Voegelin especially wary of any social, political, or religious movements which, in his view, contribute to the dissolution ofsocial stability. It is in this context that his uneasy relationship with the Bible must be understood. As revelation of the "God beyond the gods" the Old and New Testaments are unsurpassable expressions ofthe transcendent source of order. At the same time, they are the seedbeds in which social upheaval easily germinates. As generators of both order and disorder, few biblical books have been as influential as the four gospels. It is Voegelin's treatment ofthese texts that will be my concern here. The ambiguity ofVoegelin's relationship to the gospels is reflected in the twofold meaning ofthe word "missed" in the title ofthis essay. In the first place, the word can be understood as referring to Voegelin's critique ofthe gospels; to speak ofwhat Voegelin "missed" in this sense is to focus on that which he finds lacking in them (yet wishes were there). My primary interest, however, is on the meaning ofthe word as indicating that which Voegelin fails to understand about the gospels. The two meanings are related; for it is in Voegelin's criticism of the gospels that we can detect the manner in which he misunderstands them. In order to make this clear, it is necessary to say something about his evaluation and critique; only then will it be possible to raise relevant questions about his approach. After summarizing Voegelin's perspective on the gospels, I introduce the thought of René Girard as possible counterpoint. This is followed by a comparison of Voegelin and Girard with regard to their understanding ofthe gospel texts. A concluding section offers reflections on Voegelin's evaluation ofthe gospels. I realize that there is little to be gained from finding fault with a thinker for not doing what it was never his intention to do in the first place. This paper compares the nascent theory of the ‘semiotic symbol’ in cognitive science with its computational relative. It finds that the semiotic symbol as it is understood in recent practical and theoretical work does not have the resources to explain the role of symbols in cognition. In light of this argument, an alternative model of symbol internalisation, based on Vygotsky, is put forward which goes further in showing how symbols can go from playing intersubjective communicative roles to intrasubjective cognitive (...) ones. No contemporary intellectual historian has produced more influential reflections on the historian’s craft than Hayden White and Quentin Skinner, yet their legacy has never been meaningfully compared. Doing so reveals a surprising complementarity in their approach, at least to the extent that Skinner’s stress on recovering the intentionality of authors fits well with White’s observation that irony is the dominant rhetorical mode of historical narrative in our day. Irony itself, to be sure, has to be divided broadly speaking into its (...) dramatic or Socratic variants and the unstable and paradoxical alternative defended by poststructuralist critics. The latter produced in White an anxiety about the anarchistic implications of an allegedly inherent undecidability in historical interpretation and narration, which threatened to conflate history entirely with fiction. By recovering the necessary role of intentionality as a prerequisite for a more moderate version of Socratic and dramatic irony—in which hindsight provides some purchase on a truth denied actors at the time history is made—it is possible to rescue an ironic attitude that can register the frequency of unintended consequences without surrendering to the conclusion that no explanation or interpretation is superior to another. Against yet a third alternative, which tries to reconstruct the past rationally as a prelude to the present, acknowledging the ironic undermining of intentions avoids giving all the power to the contemporary historian and restores a dialogic balance between actors in the past and their present-day interpreters. Robert Roth, among the first few Catholics to write favorably, even if critically, about American pragmatism, presents here a creative piece of comparative philosophy in which he achieves a long-term goal of attempting a reconciliation between pragmatism and a classical spiritual and religious perspective. The title, Radical Pragmatism, is an adaptation of William James’s "radical empiricism." James had argues that the classical empiricists, Locke and Hume, did not go far enough in their account of experience. PurposeThere are a lot of discussions about privacy in relation to contemporary communication systems (such as Facebook and other “social media” platforms), but discussions about privacy on the internet in most cases misses a profound understanding of the notion of privacy and where this notion is coming from. The purpose of this paper is to challenge the liberal notion of privacy and explore foundations of an alternative privacy conception.Design/methodology/approachA typology of privacy definitions is elaborated based on Giddens' theory of (...) structuration. The concept of privacy fetishism that is based on critical political economy is introduced. Limits of the liberal concept of privacy are discussed. This discussion is connected to the theories of Marx, Arendt and Habermas. Some foundations of an alternative privacy concept are outlined.FindingsThe notion of privacy fetishism is introduced for criticizing naturalistic accounts of privacy. Marx and Engels have advanced four elements of the critique of the liberal privacy concept that were partly taken up by Arendt and Habermas: privacy as atomism that advances; possessive individualism that harms the public good; legitimizes and reproduces the capitalist class structure; and capitalist patriarchy.Research limitations/implicationsGiven the criticisms advanced in this paper, the need for an alternative, socialist privacy concept is ascertained and it is argued that privacy rights should be differentiated according to the position individuals occupy in the power structure, so that surveillance makes transparent wealth and income gaps and company's profits and privacy protects workers and consumers from capitalist domination.Originality/valueThe paper contributes to the establishment of a concept of privacy that is grounded in critical political economy. Owing to the liberal bias of the privacy concept, the theorization of privacy has thus far been largely ignored in critical political economy. The paper contributes to illuminating this blind spot. This chapter discusses the implications of an acceptability test designed to evaluate the Swedish native speakers's reluctance to form the neuter gender of certain adjectives such as the defective adjectives. This chapter provides some observations related to the Löwenadler paper. While the paper focused on the certain Swedish adjective forms which are regarded as ungrammatical by most Swedish speakers, the present chapter places emphasis on the actual evaluation of the logically possible yet unacceptable neuter alternatives. To provide a better understanding (...) of the reluctance of speakers to use neuter gender, the chapter provides some additional factors aside from the inflectional process that define the judgements derived from the acceptability test. Midwives and nurses play a critical role in safeguarding the lives of women in resource-constrained African countries. Working within the context of scarce resources may undermine their moral agency and hinder their ability to care. The purpose of this paper is to understand the influence of resource scarcity on midwifery and nursing care and practice. A critical ethnography was conducted in the obstetric department of three tertiary-level facilities in Ghana. Purposive sampling was used to recruit 30 midwives and nurses and (...) semistructured interviews, field notes and documentary materials were used to generate in-depth understanding. Ethical approval was granted from Canada and Ghana and written, and ongoing informed consent was obtained from the participants. Five conceptual themes depicting the impact of scarce resources on midwifery and nursing care were discovered: compromised care, constrained care, dehumanized care, missed care and disengaged care. Improving the maternal health of women and averting avoidable maternal morbidity and mortality require governments and institutions to invest in health infrastructure that will support the delivery of ethical and safe midwifery care for women in their most vulnerable period. The history of the publication of the gravitational field equations of general relativity in November 1915 by Einstein and Hilbert is briefly reviewed. An analysis of the internal structure and logic of Hilbert's theory as expounded in extant proofs and in the published version of his relevant paper is given with respect to the specific question what information would have been found on a missing piece of Hilbert's proofs. The existing texts suggest that the missing piece contained the (...) explicit form of the Riemann curvature scalar in terms of the Ricci tensor as a specification of the axiomatically underdetermined Lagrangian in Hilbert's action integral. An alternative reading that the missing piece of the proofs already may have contained the Einstein tensor, i.e. an explicit calculation of the gravitational part of Hilbert's Lagrangian is argued to be highly implausible. Three experiments demonstrated that decisions resulting in considerable amounts of profit, but missed alternative outcomes of greater profits, were rated lower in quality and produced more regret than did decisions that returned lesser amounts of profit but either did not miss or missed only slightly better alternatives. These effects were mediated by upward counterfactuals and moderated by participants’ orientation to the decision context. That decision evaluations were affected by the availability and magnitude of alternative outcomes rather than the (...) positivity of actual outcomes is counter to the outcome bias effect—a bias in which decisions are rated more positively when they led to more positive outcomes. Experiment 3 demonstrated that these effects represent a bias that occurs even when it is clear that the process by which decisions were made followed rational decision processes. A recent study suggests that vaccine hesitancy amongst key demographics – including females, younger individuals, and certain ethnic groups – could undermine the pursuit of herd immunity against COVID-19 in the United Kingdom. At the same time, the UK Joint Committee on Vaccination and Immunization (JVCI) indicated that it will not facilitate the choice between available COVID-19 vaccines. This paper reflects upon lessons from the introduction of the UK’s combined Measles, Mumps and Rubella (MMR) vaccine strategy of the 1980s when (...) Member of Parliament Miss Julie Kirkbride argued that had parents been allowed to choose between vaccine variants, then the crisis of low herd immunity – and subsequent outbreaks – could have been avoided. This paper explores this argument, as applied to the COVID-19 vaccination strategy, by considering how three key elements of informed consent – disclosure of risk, benefit, and reasonable alternatives – may be employed to tackle vaccine hesitancy and build vaccine confidence. Wynes and Nicholas (2017) argue that the most effective action to reduce individual greenhouse gas (GHG) emissions is to have one fewer child. We raise methodological concerns about the way in which the authors attribute responsibility for emissions: they rely on multiple counting when calculating the emissions of future generations, and they exclude scenarios in which global emission trajectories become net-zero or negative. This may distort recommendations from policy makers and educators who rely on their study. We propose an (...) class='Hi'>alternative way of attributing responsibility that avoids multiple counting. Investigating the implications of having children under this proposal with regards to the full range of different scenarios, including likelihood analyses, calls for further studies. (shrink)

This paper attempts to show how the logical empiricists’ interpretation of the relation between geometry and reality emerges from a “collision” of mathematical traditions. Considering Riemann’s work as the initiator of a 19th century geometrical tradition, whose main protagonists were Helmholtz and Poincaré, the logical empiricists neglected the fact that Riemann’s revolutionary insight flourished instead in a non-geometrical tradition dominated by the works of Christoffel and Ricci-Curbastro roughly in the same years. I will argue that, in the attempt to interpret (...) general relativity as the last link of the chain Riemann–Helmholtz–Poincaré–Einstein, logical empiricists were led to argue that Einstein’s theory of gravitation mainly raised a problem of mathematical under-determination, i.e. the discovery that there are physical differences that cannot be expressed in the relevant mathematical structure of the theory. However, a historical reconstruction of the alternative Riemann–Christoffel–Ricci–Einstein line of evolution shows on the contrary that the main philosophical issue raised by Einstein’s theory was instead that of mathematical over-determination, i.e. the recognition of the presence of redundant mathematical differences that do not have any correspondence in physical reality. This article assesses Herman Paul's intellectual biography of Hayden White, the most important figure in the philosophy of history of the past half century. Offering a clear overview of White's career and contribution, Paul's account proceeds chronologically from the 1950s to the present, distinguishing the phases of White's career, but convincingly pinpointing an abiding core of concerns around an existentialist and liberationist humanism. In that light, White sought to show the way beyond historiographical realism to more innovative approaches—ideally to serve (...) progressive politics. Paul notes, however, that White failed to connect with most mainstream historians, and Paul's account is not sufficiently probing and critical to explore the gulf. Indeed, following White, Paul is too prone to take White's particular liberationist agenda as the only alternative to a conservative, passive realism—and thereby to gloss over alternative ways of conceiving the postrealist cultural space. Moreover, Paul fails to note White's tendency sometimes to imply that mainstream history claims more than it does, and sometimes to denigrate prejudicially what it in fact does, or could do. Although much of White's challenge could have been especially salutary, he tended toward mischaracterizations that fostered polarization in the historical discipline and reinforced prejudicial understandings of historiography in the wider culture. Paul's overview provides a useful, and in many ways exemplary, introduction to White's legacy, but it is too deferential to provide a convincing overall critical assessment. (shrink)

Transferred malice, or transferred intent, is the criminal doctrine that states that if D tries to kill A, and accidentally kills B, the intent to kill transfers from A to B, and so D is guilty of murdering B. This is widely viewed as a useful legal fiction. One of the finest essays on this topic was written by our honorand, Douglas N. Husak. Husak views both the potential usefulness of, and his preferred alternative to, transferred malice through the (...) lens of sentencing – how much hard treatment the offender will receive. In this essay, I take a step back and ask in what ways transferred malice might be useful. I find its potential usefulness is not restricted to sentencing, but thinking about other ways in which it might be useful actually brings other potential drawbacks into focus – in particular, I argue, transferred malice mislabels the crimes the offender committed, and does so in a way that erases one of the victims from the moral description of the crime. Habermas’s argument from human nature, which speaks in favour of holding back the use of human germline editing for purposes of enhancement, has lately received criticism anew. Prominent are objections to its supposedly genetic essentialist and determinist framework, which underestimates social impacts on human development. I argue that this criticism originates from an instrumentalist reading of Habermas’s argument, which wrongly focuses on empirical conditions and means-ends-relations. Drawing on Habermas’s distinction of a threefold use of practical reason, I show how an (...) alternative—the ethical—reading avoids essentialist and determinist objections by addressing an existential level of sense making. I present three reasons that speak in favour of the ethical reading and I demonstrate how it incorporates social aspects of character formation. Habermas’s account therefore offers exactly what the critics claim is missing. The paper concludes with a conceptual challenge that the ethical reading has to face within Habermas’s overall approach to genetic engineering. (shrink)

Religious education (RE) has often found itself at the centre of debates about education's role in promoting social cohesion in contemporary multi-religious societies. The paper considers RE's relationship to religious plurality within the broader context of politics of curriculum and debates on pluralism. Drawing upon the recent works on the history of religion and using the teaching of the histories and cultures of Muslims in RE as a case study, it argues that RE has yet to fulfill its potential in (...) this regard. The main objective of this article is to reconstruct Iris Murdoch's criticism of the moral self as it was developed by liberalism, romanticism, existentialism and linguistic empiricism that interpreted the moral person as entangled either in a world of essences (Kant's view) or in a world of mere existence in which the interplay of both necessity and freedom is at stake. Thus what is missing from all these theories is a sufficient development of what it is to have a (...) regard for others through aesthetic perception, which is the most important aspect of the moral self. At the difference of these conceptions Murdoch offers an alternative view, both to liberal ethics in the Kantian tradition and to contemporary ethics, as she argues that to have regard for others demands responsiveness which can also be explained in terms of aesthetic sensibility. Murdoch's ethics rests on an analogy between aesthetic sensibility and moral sensibility based upon the model of the artist's unconditional love for his characters, which she interprets as being a matter of seeing and loving others. The author's thesis is that love is the crucial point of Murdoch's conception of the moral self where the moral and aesthetical sensibility, as well cognition, intersect each other, because seeing others incorporates emotions of respect and compassion that characterize love and such seeing is cognitive love. Joining the ongoing academic debates around medical students’ alternative career choices, this research examines the role of family in medical school attendees’ entrepreneurial intention. Specifically, this study decomposes the multidimensionality of family embeddedness and highlights the mediated nature of the family–EI relationship. The empirical analysis relied on data from graduation year medical students from diverse geographical locations and from different institution types in China. These data were collected from a total of 687 questionnaires covering the basic information of individual, (...) parents, and family composition, as well as the measuring scale of EI. Examining medical students’ EI and its antecedents provide a dual-missing-link in the extant knowledge, i.e., it adds the medical school piece to the overall picture of university students’ EI, and equally important, it de-trivializes entrepreneurship from the extant theorizations of medical students’ career choices. This study also bears implications for educators, practitioners, and policymakers interested in better understanding EI of medical school attendees and family embeddedness. (shrink)

Some suggest that part of what we are witnessing is some form of deterritorialization of the democratic experience. What is often missing from this claim, however, is a more thorough evaluation of the images of democracy drawn by the movement itself. The first section of this paper will draw from various readings of the democratic experience in (...) view of providing a conceptual framework capable of problematizing the equivalence between democracy and territoriality. On the basis of this understanding of democracy, a second section will offer a reading of the document Alternatives for the Americas prepared by the Hemispheric Social Alliance, a large coalition of civil society groups located throughout the Americas that has organized opposition to the Free Trade Area of the Americas. This document offers a unique opportunity to assess the anti-globalization movement's vision of democracy. Conception has a prominent role to play in Thomas Reid’s philosophy of mind, as is apparent from his Essays on the Intellectual Powers of Man (EIP henceforth). The present investigation concerns Reid’s explanation of how objects (be they real or nonexistent) are conceived. According to him, conception functions in two different ways: it is either an ingredient in another act of thinking, such as perception or memory, or it is exercised by itself, sometimes about objects that do not (and will (...) never) exist. Fictional objects can be remembered, but to do so the mind needs an initial, independent grip on them, which can only be achieved by an exercise of “bare conception”. (shrink)

Mario Savio is widely known as the first spokesman for the Free Speech Movement. Having spent the summer of 1964 as a civil rights worker in segregationist Mississippi, Savio returned to the University of California at a time when students throughout the country were beginning to mobilize in support of racial justice and against the deepening American involvement in Vietnam. His moral clairty, his eloquence, and his democratic style of leadership inspired thousands of fellow Berkeley students to protest university regulations (...) that had severely limited political speech and activity on campus. The nonviolent campaign culminated in the largest mass arrest in American history, drew widespread faculty support, and resulted in a revision of university rules to permit political speech and organizing. This significant advance for student freedom rapidly spread to countless other colleges and universities across the country. Mario Savio went on to become a college teacher of physics, logic, and philosophy, to speak and organize in favor of immigrant rights and affirmative action and against U.S. intervention in Central America. He died on November 6, 1996, in the middle of a struggle against California State University fee hikes that hurt working-class students. Savio had submitted this article to the Notre Dame Journal of Formal Logic before he died. Final revisions were made by Philip Clayton with the assistance of Mario's colleagues at Sonoma State University. As reader for the Journal, George Englebretsen not only provided an extensive commentary on the article--much of which has been incorporated here--but also assisted in the difficult task of making revisions without changing the substance of Mario's style or thought. It is fitting that this, Savio's final publication, would be pedagogical in orientation. For him, moral considerations were no less pertinent in logic than in philosophy's less abstract fields. The usual student confusion with Venn diagrams led him to develop the new pictorial device presented in the following pages, which he believed was more sensitive to user psychology. It is hard to miss the political overtones in Savio's closing worry that in Venn diagrams "information of real significance may occasionally appear hidden and distorted." The decision by the Notre Dame Journal of Formal Logic to publish this piece posthumously is a testimony that logic, no less than other fields of philosophy, can be a tool of free speech and political change--as powerful in its way as the rhetorical brilliance of that young man standing on top of a police car who launched a worldwide movement with the words, "There is a time when the operation of the machine becomes so odious, makes you so sick at heart, you can't take part.". Personality traits describe dispositions influencing individuals' behavior and performance at work. However, in the context of personnel selection, the use of personality measures has continuously been questioned. To date, research in selection settings has focused uniquely on predicting task performance, missing the opportunity to exploit the potential of personality traits to predict non-task performance. Further, personality is often measured with self-report inventories, which are susceptible to self-distortion. Addressing these gaps, the planned study seeks to design new personality measures to (...) be used in the selection context to predict a wide range of performance criteria. Specifically, we will develop a situational judgment test and a behavior description interview, both assessing Big Five personality traits and Honesty-Humility to systematically compare these new measures with traditional self-report inventories regarding their criterion-related validity to predict four performance criteria: task performance, adaptive performance, organizational citizenship behavior, and counterproductive work behavior. Data will be collected in a simulated selection procedure. Based on power analyses, we aim for 200 employed study participants, who will allow us to contact their supervisors to gather criterion data. The results of this study will shed light on the suitability of different personality measures to predict an expanded range of performance criteria. (shrink)

Giovanni Arrighi made a remarkably broad-ranging and original contribution to comparative political economy and historical sociology over five decades. His last book shares these qualities. But Adam Smith in Beijing is unfortunately not mainly about the origins and dynamics of Chinese capitalism over the past three decades. It presents Adam Smith not as the apostle of free-market capitalism, but rather of a ‘non-capitalist market society’; and it uses this to make the case that since China’s economic development takes place outside (...) the European/North American capitalist ‘core’, it must, almost by definition, not be capitalist. Markets are conceived here as the instruments of states, yet the theory of the state advanced is severely undeveloped. Arrighi’s argument that China’s economic development is part and parcel of the demise of the US project for establishing itself as the ‘world state’ misinterprets the nature of the US empire as well as misses the extent of China’s integration with US-led capitalist globalisation. One of the UN’s 17 sustainable development goals is to end hunger, achieve food security and improved nutrition by 2030. This goal will be missed. Global hunger is still highly prevalent. In 2021, about 821 million people experience undernourishment every day and more are at risk. Is this necessary? This article calculates the investments needed for both acute and sustainable systems to alleviate food insecurity and decrease global caloric deficits. These economic values are then contextualized by comparing funds spent by (...) individuals and governments on unnecessary or counterproductive products. The results show that divergence of even small fractions of these funds from food waste, tobacco, alcohol, or weapons within the U.S. alone could supplement the caloric needs of those in areas with high levels of food insecurity. America’s net-negative industries whose advertisements and sales could be taxed to improve America’s life expectancy could fund the yearly cost to feed anywhere from 17.1% to 1,467.9% of malnourished people directly, or contribute more than 100% of the estimated cost to sustainably end global hunger. It is concluded that reallocating funds that are detrimental to the U.S. population is a path to achieving food security and sustainable food production for the entire globe. (shrink)
