The article analyses, in a comparative perspective, the phenomenon of the evolution of the protection of surviving spouse’s inheritance rights in France and Lithuania, the two legal systems historically having some points of interaction. The protection of the surviving spouse is one of the major preoccupations of married couples of today, the couple occupying a central role within the contemporary family. Comparative analysis reveals certain points of convergence between these two legal systems inasmuch the surviving spouse is considered by both (...) legislations as an heir ab intestat and whose protection over the years has been considerably strengthened. The surviving spouse is called to inherit alongside with the heirs of the first or second order and is entitled to the proportions in assets that have not ceased to increase. Lithuanian law seems to have been innovative at an earlier stage than French law, as it is only in the beginning of the 21st century that significant reforms were carried out in this area of law in France. Analysis has also revealed apparent differences in the scope of protection of the surviving spouse, both in regards to the protection provided by law (statutory protection), as well as protection organised by the will of the spouses (voluntary protection). In some respects the statutory protection is more extensive in France (for example, complementary statutory rights of the spouse in regards to the dwelling place or the quality of héritier réservataire) and the instruments of this protection seem to be more varied (for example, the possibility for the spouses to organise their matrimonial regime by inserting specific clauses into the nuptial contract, mechanisms outside the nuptial contracts, such as donations, wills or life insurance contracts). However, this protection might appear to be more extensive under Lithuanian law as far as the voluntary protection is concerned taking into account the introduction, by the new Lithuanian Civil Code of 2000, of the joint will of spouses under which the whole property of the deceased spouse shall be inherited by the surviving spouse (except the mandatory share of succession). The article raises some doubts as to the desirability or even feasibility of aligning the two models of protection given the fact that each of the two countries has its own history and traditions. Nevertheless, a proposition resurges from the analysis in regard to the possible improvement of the protection of the rights to the dwelling place of the surviving spouse under Lithuanian law. Some elements from the existing French model could be transposed given that the dwelling place is an essential family element providing some stability for the surviving spouse. (shrink)

Team reasoning is the idea that we can think as a ‘we’ and this can solve some coordination dilemmas, such as Hi-Lo. However, team reasoning can only solve the dilemmas it is intended to solve if the conditions for team reasoning warrant the belief that others will also perform team reasoning and these conditions cannot render team reasoning otiose. In this paper, I will supplement the theory of team reasoning by explaining how agency transformation also involves a change (...) in the normative attitude. To do this, I will use the theory of affordances, which is the idea that the environment provides ways to interact with it. I will argue that when a person perceives as a group member, she associates herself and the other members with the group’s mosaic of affordances. This triggers a feeling of joint ownership of the agency. It is the feeling that it is up to us to deal with the situation, so we feel entitled to demand each other to cooperate. It warrants the belief that others are team-reasoners without rendering team reasoning otiose. This means that the agency transformation (from I to we) involves a change in the normative attitude. Innovation is often seen as essential for ventures to succeed. High business failure rates in entrepreneurship, however, suggest that innovations are frequently driven by entrepreneurs blinded by overconfidence. Thus, anticipating when and why entrepreneurs will be motivated to innovate is fundamental for entrepreneurial success. Using a large sample obtained from population surveys conducted in 77 countries, this study analyzes the variables that are significantly associated with innovative behaviors. The research tests a model proposing that the joint effects of (...) hubris, growth aspirations, and an entrepreneur’s level of entrepreneurial experience have a crucial impact on innovative endeavors. It finds that hubris is significantly related to entrepreneurs’ growth aspirations and that ambition, in turn, is positively related to innovative behaviors. In addition, the study finds that both relationships are moderated by the level of entrepreneurial experience. These findings highlight the need to wise up amateur entrepreneurs before they embark on innovative endeavors. (shrink)

Purpose The debate about the end-of-life care decision is becoming a serious ethical and legal concern in the Far-Eastern countries of Korea, China and Japan. However, the issues regarding end-of-life care will reflect the cultural background, current medical practices and socioeconomic conditions of the countries, which are different from Western countries and between each other. Understanding the genuine thoughts of patients who are critically ill is the first step in confronting the issues, and a comparative descriptive study of these (...) perspectives was conducted by collaboration between researchers in all three countries. Methods Surveys using self-reporting paper questionnaire forms were conducted from December 2008 to April 2009 in Korea (six hospitals in two regions), China (five hospitals in four regions) and Japan (nine hospitals in one region). The subjects were patients who were critically ill who had been diagnosed as having cancer. A total of 235 participants (Korea, 91; China, 62; Japan, 52) were eventually recruited and statistically analysed. Results Most respondents had sometimes or often thought of their own death, mostly fear of ‘separation from loved ones’. They wanted to hear the news regarding their own condition directly and frankly from the physician. A quarter of them preferred making end-of-life care decisions by themselves, while many respondents favoured a ‘joint decision’ with their family members. The most favoured proxy decision maker was the spouse, followed by the children. Most admitted the necessity of ‘advance directives’ and agreed with artificial ventilation withdrawal in irreversible conditions. The most common reason was ‘artificial prolongation of life is unnecessary’. Most respondents agreed with the concept of active euthanasia; however, significant differences were sometimes observed in the responses according to variables such as patient's country of origin, age, gender and education level. Conclusion Patients in Far-Eastern countries gave various responses regarding end-of-life care decisions. Although familial input is still influential, most patients think of themselves as the major decision maker and accept the necessity of advance directives with Westernization of the society. Stillwell also provides, in a creative dialog form akin to Bateson’s own dialogs, a short review article on Noel Charlton’s Understanding Gregory Bateson: Mind, Beauty and the Sacred Earth. Malcolm Budd speaks for many when he locates the "principal weakness" of Hume's account of the standard of taste in Hume's "blithe optimism about the uniformity of response of his true judges of artistic value". I argue that Hume's optimism is not blithe. I argue, in particular, that it follows from Hume's definition of a true judge that true judges will never disagree, and that it follows from his appeal to the test of time that true judges will (...) agree often enough to support the kind of standard Hume has in mind. To understand how different types of cues in vaccine education messages affect attitude toward campaign messages and vaccination intention, this study examined the impact of the presence of social norm appeals and the presence of fear appeals in coronavirus disease 2019 vaccine campaign posters on perceived communication quality and vaccination intention. A 2 × 2 × 3 within-subject factorial design experiment was conducted in China. Findings demonstrated that the presence of fear appeals in COVID-19 vaccine campaign posters elicited lower levels (...) of perceived communication quality and vaccination intention than those without fear appeals. The interactive effect of fear appeals and social norm appeals was also found to be significant. Specifically, positive-framed messages with group cues and fear appeal messages with individual cues elicited higher perceived information quality and stronger vaccination intention than other types of messages. Understanding how these cues function jointly in COVID-19 vaccine campaign messages will help public health practitioners create more effective intervention strategies. (shrink)

In The Paradox of Self-Consciousness, Jose Luis Bermúdez presents an abductive argument for what he calls ‘the Symmetry Thesis’ about self-ascription: in order to have the ability to self-ascribe psychological predicates to oneself, one must be able to ascribe psychological predicates to other subjects like oneself. Bermúdez discusses joint engagement as a key phenomenon that underwrites his abductive argument for the Symmetry Thesis. He argues that the ability to self-ascribe is “constituted” by the intersubjective relations that are realized in (...) joint engagement. I will argue in §1 that although Bermúdez may be correct that these phenomena support the idea that pre-linguistic infants and non-linguistic animals possess primitive forms of self-consciousness, for conceptual reasons, his account of joint engagement cannot be used to argue for the Symmetry thesis. I will argue in §2 that while Bermúdez is correct that joint engagement is significant for the constitution of self-ascription, his description of that phenomenon is too robust, because it requires that the infant have a mental representation of the other as a psychological subject of perceptions. I argue that Bermúdez’s description requires an iteration of representations each of which requires a form of self-reference, which goes against Bermudez’s aim of avoiding the paradox of self-consciousness. In presenting his argument for the Symmetry thesis and his account of joint engagement, Bermúdez critiques P. F. Strawson’s argument for the Symmetry Thesis. In §3 of the paper, I turn to the positive project of presenting a constructive argument for the Symmetry thesis. In a variety of sources, P. F. Strawson and Gareth Evans present a transcendental argument for the Symmetry thesis. I suggest that an argument for the Symmetry thesis is available in Strawson’s notion of the primitiveness of the person. In §4, this leads to a corresponding account of joint engagement. Instead of the robust account of joint engagement presented by Bermúdez, I suggest that the infant perceives the mother’s acknowledgement of the infant without the capacity for self-reference that the Bermúdez’s iteration requires. I reconstruct an account of other-ascription in terms of what I call “person perception,” relying on a recent discussion of Strawson’s view by Axel Seemann (2008). On the Strawsonian account that I provide, an adult summons a child to recognize and acknowledge a form of life in which it participates as a person. In closing, I consider how my account of other-ascription differs from two classic accounts— the theory-theory and the simulation theory— and discuss how my account provides a genuine third alternative: the Persons theory. I would argue that the Persons theory offers a new approach to key issues in philosophy and psychology concerning self-consciousness and intersubjectivity. (shrink)

When does a group justifiedly believe that p? One answer to this question has been developed first by Schmitt and then by Hakli: when the group members jointly accept a reason for the belief. Call this the joint acceptance account of group justification. Their answer has great explanatory power, providing us with a way to account for cases in which the group's justification can diverge from the justification individual members have. Unfortunately, Jennifer Lackey developed a powerful argument against (...) class='Hi'>joint acceptance accounts. She argues that these accounts lead to epistemically arbitrary reasons and therefore justification at will. Group justification loses the necessary connection to the world to be truth-conducive. In this paper I develop a new form of a joint acceptance account that can deal with Lackey's examples: the anchored joint acceptance account of group justification. I argue that properly understanding the role of epistemic expectations can help us form the best version of a joint acceptance account. While justification is only generated by joint acceptance of evidence, the evidential expectations towards a group are anchored in the group members. This anchoring guarantees that groups cannot manipulate their ultima facie justification illegitimately. (shrink)

When should we expect compliance with international human rights norms? Previous literature on the causal mechanisms underlying compliance have focused independently on the roles of state willingness, thought of as the preferences of the regime leadership, and on state capacity, in improving human rights practices within a state. We build an argument that neither of these factors are sufficient on their own to improve compliance with human rights norms. Instead, improved human rights practices require both “the will and the (...) way.” Our central hypothesis is that capacities and willingness, acting jointly, are key determinants of improvements in compliance with international human rights norms. The paper confirms this proposition using two-staged and single-stage regression models and a time-series cross-sectional approach at the country-year level. A highly capable bureaucracy and a state that has signaled its willingness through the acceptance of individual complaint and inquiry procedures in the UN treaty regime are jointly necessary for improved human rights practices. How is it conceivable or even psychologically possible that rational agents sometimes appear to act against their own acknowledged self-interest? This issue, commonly known as “weakness of the will”, has contributed to much of our individual and collective failure to address pressing problems even if solutions are well-known and readily available. It has fascinated philosophers since ancient times. Recent advances in psychology, behavioural economics and neuroscience have allowed us to approach the phenomenon from a new perspective. A novel account (...) that draws on empirical research characterises weakness of will as a failure to persist in an intention in the face of temptation. However, contemporary work finds it difficult to determine whether this account should replace or supplement orthodox views. This is partially due to a larger problem: philosophers struggle to understand and conceptually connect the various independent strands of empirical research into self-control, willpower, delay of gratification, ego depletion, implementation intentions, delay discounting, etc. Targeting both issues, the present work advances current research into weakness of will in two ways: first, it raises a novel challenge specific for orthodox accounts in philosophy. More precisely, I argue that they yield absurd results in dilemmas, and I show that this puzzle has repercussions for decision theory and epistemology. Second, my thesis renders econometric and psychological research into delay discounting intelligible to a philosophical readership. More specifically, I explain why standard discounting models fail to capture core cases of weakness of will that are also the object of research in developmental psychology. I thereby rectify rampant myths about preference reversals and discount functions in the philosophical and scientific literature. In short, my dissertation connects empirical and philosophical work into weakness of will conceptually in order to tackle issues in current research and advance our joint understanding of a longstanding and problematic phenomenon. The ordination of women to the priesthood in the Church of England in 1994 signified great change. The impact of the new priests was well documented, and their integration became the focus of much research in the following years. One important area of change was the altered dynamics of gender identity. New roles had opened up for women, but new identities had also emerged for men. While women priests were a new historical emergence, so too were clergy husbands. This paper (...) will consider the historical construction of masculinities and femininities within the church and will go on to look at this in the context of clergy spouses, specifically focusing on men occupying this role. In this paper, I am going to be concerned with the capacity of human beings to act jointly. In particular, I will focus on the phenomenal aspect of collective action. I shall suggest that the experience of being jointly engaged with another is complex: it comprises both a practical grasp of oneself and of the other person as single agents participating in the joint pursuit, and an experience of collective immersion in the activity, which includes a sense of (...) joint control. This suggestion gives rise to a number of puzzles: firstly, what is the relation between jointly engaged agents' awareness of self and other and their sense of a joint engagement? Secondly, how are we to substantiate the idea of a sense of joint control if it is also obviously true that I don't, however close our psychological and bodily attunements, have control over your doings? I shall argue that a satisfactory solution to these puzzles is possible only if we take seriously the notion of a perceptually constituted “intersubjective perspective” that is shared by the participants in joint activities and gives rise to an attitude of mutual trust. What is the core of the distinctiveness of Homo sapiens? Some of the most famous hypotheses include tool use and tool making, language, free will and moral agency, self-consciousness, mind itself, and reason or rational problem-solving. All these answers are partly true. But recent work in comparative psychology, primatology, and cognitive science have converged on a conception of human distinctiveness that underlies these. Remarkably, it was explored a century ago by George Herbert Mead. The American pragmatists played a special (...) role in the development of non-reductive naturalism. But among them, Mead uniquely endorsed the notion of “emergence” developed by the British Emergentists. This led him to an analysis of the emergence of the human self and mind out of social processes, most famously employing his concept of “significant gesture.” In recent decades both notions have been buttressed by philosophical and scientific work. Emergence has returned in the sciences of nonlinear dynamics and complexity, and has been re-conceptualized by philosophers like Wiliiam Wimsatt. Mead’s social conception of the human mind and self have been repurposed by a host of scientists, as in Michael Tomasello’s conception of “joint intentionality” and Antonio Damasio’s analysis of self-consciousness. These developments show that Mead was remarkably prescient in his core insights. (shrink)

University of Cologne, Germany Joint action and group agency have emerged as focuses of attention in recent social theory and philosophy but they have rarely been connected with one another. The argument of this article is that whereas joint action involves people acting together to achieve any sort of result, group agency requires them to act together for the achievement of one result in particular: the construction of a centre of attitude and agency that satisfies the usual constraints (...) of consistency and rationality in adequate measure. The main discovery in the recent theory of group agency is that this result is not easily achieved; no regular voting procedure will ensure, for example, that a group of individually consistent agents will display consistency in group judgments. The present study explored the role of emotion regulation and emotion lability/negativity as a moderator in the relation between child social avoidance and social adjustment in Chinese culture. Participants were N = 194 children recruited from nine classrooms in two public kindergartens in Shanghai, People’s Republic of China. Multi-source assessments were employed with mothers rating children’s social avoidance and teachers rating children’s emotion regulation, emotion lability/negativity and social adjustment outcomes. The results indicated that the relations between social avoidance and social (...) adjustment difficulties were more negative among children lower in emotion regulation, but not significant for children with higher emotion regulation. In contrast, the relations between social avoidance and social adjustment difficulties were more positive among children higher in emotion lability/negativity, but not significant for children with lower emotion lability/negativity. This study informs us about how emotion regulation and emotion lability/negativity are jointly associated with socially avoidant children’s development. As well, the findings highlight the importance of considering the meaning and implication of social avoidance in Chinese culture. (shrink)

BFO has been selected to serve as top-level ontology in the Industrial Ontologies Foundry (IOF), an initiative to create a suite of ontologies to support digital manufacturing on the part of representatives from a number of branches of the advanced manufacturing industries. We here present a first draft set of axioms and definitions of an IOF upper ontology descending from BFO. The isolation requirements of the coronavirus epidemic and the intuitive display advantages of live-streaming have led to an increasing number of retailers shifting to social live-streaming platforms and e-commerce live-streaming platforms to promote and sell their products in real time. However, the provision of live-streaming services will also incur high live-streaming effort costs. In this paper, we develop two decision models for retailers to sell goods through a single online shop and both online shop and live-streaming room; we also (...) present the optimal decisions of pricing and live-streaming efforts. Furthermore, we identify the profitability conditions for retailers to determine when to provide live-streaming services. In addition, we examine the impact of the provision of live-streaming services on the optimal price and live-streaming effort. We obtain three findings. First, there is a unique optimal decision on the price and live-streaming effort under certain conditions. Second, when the effect coefficient of the live-streaming room reaches a certain threshold, there are enough customers who enter the live-streaming room to watch and buy and it is profitable for retailers to provide live-streaming service. Finally, the optimal price and live-streaming effort increase with the increase in average return loss, the effect coefficient of live-streaming effort, and the extra return rate and decrease with the increase in the proportion of customers who choose to buy in the online shop and the price discount coefficient in the live-streaming room. Under the Lithuanian legislation, current and future spouses are allowed to sign marital agreements by which their property rights and obligations are set. However, it underlines that in some cases the court may declare the whole agreement or some of its terms unenforceable. The legislator does not specify which particular terms may be declared unenforceable. Therefore, the implementation of the spouses’ right to choose the terms they want is put under doubt. As a result, it is very important (...) to find out the circumstances and the criteria that should be evaluated before a marital agreement or some of its terms are declared unenforceable. Under the Lithuanian legislation, the validity of a marital agreement is considered only at the moment it is signed. However, it is not the case in other countries. For instance, many courts of the United States in deciding on the validity of a marital agreement take into account all the circumstances and conditions both at the time a marital agreement is signed and at the time of divorce. Some courts analyse if an agreement was executed voluntarily, without any pressure or fraud, and if both parties provided fair and reasonable disclosure of the property or financial obligations as well as what were their bargaining powers and expectations. Other courts attempt to establish the effect an agreement will have on the parties after the termination of their marriage. Currently, Lithuanian courts have no practice in declaring a marital agreement unenforceable. However, due to the particularities of marital agreements and the state’s aim to defend the public interest, the means to evaluate the validity of a marital agreement become unclear. (shrink)

"Dimensions of Shared Agency" investigates the way in which standard philosophical accounts have been dealing with the issue of collective actions. In particular, the book focuses on the 'Big Five' of analytical social ontology and their accounts of shared/collective intentions and actions. Through systematic readings of different positions in the debate, the author proposes original ways of analyzing and classifying current theories of shared agency according to whether they advance a member-level or a group-level account of shared agency. While member-level (...) accounts are theories of shared agency based on individuals' attitudes and actions, group-level accounts give attention to the group of individuals considered as a whole, i.e., as an agent itself. Criticism arises against the idea that the Big Five have proposed stable group-level accounts suitable for explaining the case of shared agency as a group-level phenomenon. The widespread tendency in the debate is to endorse a perspective called holistic individualism, which maintains that high-level explanations are objective even though social facts are ontologically reducible to facts about individuals. Lasagni argues that as long as holistic individualism is held, the GLA is reducible to the MLA because holistic individualism upholds ontological individualism based on a deep individualistic premise, fixing the special status of individual agents as natural persons. The premise makes the claim to treat groups as agents contradictory to the general framework of the theory. This book profiles an alternative interpretation according to which agency should be considered as a functional kind, which is equally instantiated by different systems, such as individual human beings and organized social groups. In this way, the author claims, the reduction of the social can be avoided. "Dimensions of Shared Agency" will be of interest to doctoral students, researchers, and scholars interested in social ontology and the philosophy of the social sciences. In the last few years, researchers have begun to investigate the emergence of novel forms of human communication in the laboratory. I survey this growing line of research, which may be called experimental semiotics, from three distinct angles. First, I situate the new approach in its theoretical and historical context. Second, I review a sample of studies that exemplify experimental semiotics. Third, I present an empirical study that illustrates how the new approach can help us understand the socio‐cognitive underpinnings of (...) human communication. The main conclusion of the paper will be that, by reproducing micro samples of historical processes in the laboratory, experimental semiotics offers new powerful tools for investigating human communication as a form of joint action. This paper introduces a new family of cases where agents are jointly morally responsible for outcomes over which they have no individual control, a family that resists standard ways of understanding outcome responsibility. First, the agents in these cases do not individually facilitate the outcomes and would not seem individually responsible for them if the other agents were replaced by non-agential causes. This undermines attempts to understand joint responsibility as overlapping individual responsibility; the responsibility in question is essentially (...) class='Hi'>joint. Second, the agents involved in these cases are not aware of each other's existence and do not form a social group. This undermines attempts to understand joint responsibility in terms of actual or possible joint action or joint intentions, or in terms of other social ties. Instead, it is argued that intuitions about joint responsibility are best understood given the Explanation Hypothesis, according to which a group of agents are seen as jointly responsible for outcomes that are suitably explained by their motivational structures: something bad happened because they didn’t care enough; something good happened because their dedication was extraordinary. One important consequence of the proposed account is that responsibility for outcomes of collective action is a deeply normative matter. (shrink)

This study analyses sequences where people with dementia are positioned as third parties in stories about their own lives. Previous research emphasises how people with dementia are frequently excluded from social encounters, and how others tend to speak for or about them in their co-presence. Drawing on conversation analytic methods when analysing 15 video recorded interviews with Swedish couples living with dementia, we argue that telling stories in which a spouse with dementia is positioned as a third party in his (...) or her co-presence does not have to be an activity of exclusion. Rather, among couples, third-party positioning is a multifaceted activity where couples employ different practices to organise participation frameworks and manage both inclusion and exclusion in talk-in-interaction. Furthermore, we show how participants display joint speakership and counteract actions of exclusion by making use of various communicative resources such as gaze, touch and bodily orientation. More than one single professional group deals with therapeutic manipulations of the spine and the joints. Osteopaths, Chiropractors, Naprapaths, Physical Therapists (and a contingent Physicians) all share this interest. Each profession is also very clear about where its bulk of knowledge stems from. The disciplines that are reckoned as the oldest are from the USA. A number of “inventors” are to be found, all without a formal university degree in Medicine. Andrew Taylor Still (1828–1917) came up with his system of (...) Osteopathy in 1874. Daniel D. Palmer (1845–1913), the man behind Chiropractic, founded his system in 1894, and Palmer’s colleague and former student, Oakley Smith (1880–1967), developed Naprapathy in 1906/1907. Physical Therapists working with what is called Orthopaedic Manual Physical Therapy are on the other hand not claiming American ancestry, nor do their body of knowledge and clinical skills originate from outside the medical profession. It is an offspring of Orthopaedic Medicine (OM) which was an invention by Physicians. Date and place of birth is said to be 1929 in England. This article turns the above-mentioned chronology on its head. It will show that Orthopaedic Medicine likely is the oldest system. It will also unearth OM’s sturdy roots in a strong but forgotten, and even hidden, discourse of Mechanical Medicine found in 19th century Europe, which was ruled by Physical Therapists. Why “we” do not know about this “history” is analysed and explained from a variety of perspectives. (shrink)

In Homo Deus, Yuval Noah Harari argues that technological advances of the twenty-first century will usher in a significant shift in how humans make important life decisions. Instead of turning to the Bible or the Quran, to the heart or to our therapists, parents, and mentors, people will turn to Big Data recommendation algorithms to make these choices for them. Much as we rely on Spotify to recommend music to us, we will soon rely on algorithms to (...) decide our careers, spouses, and commitments. Harari also predicts that next, the state will take away individuals’ rights to make their own choices about their lives. If Google knows where your children would flourish best in school, why should the state allow a fallible human parent to decide? Liberalism—which, as Harari uses this term, refers to a state of society in which human freedom to choose is respected and championed—will collapse. In this paper, I argue that Harari’s conception of the future implications of recommendation algorithms is deeply flawed, for two reasons. First, users will not rely on algorithms to make decisions for them because they have no reason to trust algorithms, which are developed by companies with their own incentives, such as profit. Second, for most of our life decisions, algorithms will not be able to be developed, because the factors relevant to the decisions we face are unique to our situation. I present an alternative depiction of the future: instead of relying on algorithms to make decisions for us, humans will use algorithms to enhance our decision-making by helping us consider the most relevant choices first and notice information we might not otherwise. Finally, I will also argue that even if computers could make many of our decisions for us, liberalism as a political system would emerge unscathed. (shrink)

The aim of this paper is to explore why Deleuze takes up Hamlet's claim that ‘time is out of joint’. In the first part of this paper, I explore this claim by looking at how Deleuze relates it to Plato's Timaeus and its conception of the relationship between movement and time. Once we have seen how time functions when it is ‘in joint’, I explore what it would mean for time to no longer be understood in terms of (...) an underlying rational structure. The claim can be understood as about a relationship between time and action. In the second part of this paper, I want to relate this new understanding of time to Hamlet itself, in order to see how temporality operates within the play. I will conclude by relating these two different conceptions of time out of joint to one another through Nietzsche's eternal return. (shrink)

There are countless circumstances under which random individuals COULD act together to prevent something morally bad from happening or to remedy a morally bad situation. But when OUGHT individuals to act together in order to bring about a morally important outcome? Building on Philip Pettit’s and David Schweikard’s account of joint action, I will put forward the notion of joint duties: duties to perform an action together that individuals in so-called random or unstructured groups can jointly hold. (...) I will show how this account of joint duties is preferable to one which defends individual duties to cooperate. I then discuss the limits of joint duties and the ways in which one can fail to comply with them. It will become apparent that the circumstances under which individuals in random collectives acquire such joint duties are rare. (shrink)

The project “A Plurality of Lives” was funded and hosted by the Pufendorf Institute for Advanced Studies at Lund University, Sweden. The aim of the project was to better understand how a second origin of life, either in the form of a discovery of extraterrestrial life, life developed in a laboratory, or machines equipped with abilities previously only ascribed to living beings, will change how we understand and relate to life. Because of the inherently interdisciplinary nature of the project (...) aim, the project took an interdisciplinary approach with a research group made up of 12 senior researchers representing 12 different disciplines. The project resulted in a joint volume, an international symposium, several new projects, and a network of researchers in the field, all continuing to communicate about and advance the aim of the project. In The Transmission of Knowledge (2021), Greco departs significantly from his earlier view of all knowledge as an individual achievement of the knower, allowing that in some testimonial knowledge cases (cases of “transmission”), a hearer’s believing truly will be due to competent joint agency, between herself and the speaker. Greco argues that the new, hybrid view of knowledge as individual or joint achievement is still sufficiently unified and – importantly – still provides a satisfying answer to the (...) value problem for knowledge. I will raise some worries for this latter claim. I begin by raising worries about Greco’s earlier answer to the value problem: that knowledge is distinctively valuable as an (individual’s) achievement. I then argue that these worries are not allayed by expanding the account of knowledge to include joint achievements and indeed are perhaps aggravated by this new move. (shrink)

Joint action among human beings is characterized by using elaborate cognitive feats, such as representing the mental states of others about a certain state of affairs. It is still debated how these capacities evolved in the hominid lineage. I suggest that the consolidation of a shared practice over time can foster the predictability of other’s behavior. This might facilitate the evolutionary passage from inferring what others might know by simply seeing them and what they are viewing towards a mutual (...) awareness of each other’s beliefs. I will examine the case for cooperative hunting in one chimpanzee community and argue that it is evidence that they have the potential to achieve common ground, suggesting that the consolidation of a practice might have supported the evolution of higher social cognition in the hominid lineage. Karl Marx theory of value/labour is primarily based on time. In his theory of value/labour, Marx displays how the economic mechanic of Capital reduces Labour to power and time. Power is the ability to produce, and represent a complex mixture of individual workforce and social cooperation. Time is the general measure of productivity and the partition of labour time gives the units of measure of the value produced. Capitalism is driven by one single linear and universal temporality, signed by the (...) time of production, and by the amount of time/value subtracted to the worker. Within an unorthodox Marxist tradition, Gilles Deleuze and Felix Guattari openly criticised this approach to the production of value. By taking their distance from an image of history as a timeline, Deleuze and Guattari sketched history as a geography, and the capitalist society as an archipelago of temporalities. In this chapter, we will discuss their critique of an idea of linear time. Time is a nexus of lines, flows, segmentations and plateau: it is not merely a subjective experience, nor an objective/quantitative measurement of movement. It rather express a cartography of forms of life, of regimes and assemblages. (shrink)

In everyday contexts we do numerous things together. Philosophers of collective intentionality have wondered how we can distinguish parallel cases from cases where we act together. Often their theories argue in favor of one characteristic, feature, or function, that differentiates the two. This feature then distinguishes parallel actions from joint action. The approach in this book is different. Three claims are developed: (1) There are several functions that help human agents coordinate and act together. (2) This entails that (...) class='Hi'>joint action should be understood through these different, interrelated, types of coordination. (3) A multidimensional conceptual space, with three levels of control and coordination, will allow us to connect these different forms of coordination and their interdependencies. This allows us to understand the jointness of an action in a more differentiated and encompassing way. This approach has ramifications for several distinctions that are typically understood to be binary, including those between action and mere bodily movement, joint action and parallel action, and action together and not together. The financial crisis that currently besets Europe not only disturbs the life of many citizens, but also affects our economic, political and philosophical theories. Clearly, many of the contributing causes, such as the wide availability of cheap credit after the introduction of the euro, are contingent. Analyses that aim to move beyond such contingent factors tend to highlight the disruptive effects of the neoliberal conception of the market that has become increasingly dominant over the last few decades. Yet while the (...) financial sector has received most of the blame, and rightly so, few commentators seem willing to take into account the role played by representative democracy in its current form. Even if it is granted that actual democratic policies fall short of what they ought to achieve, contemporary representative democracy itself is seldom regarded as part of the tangle it was supposed to resolve. David Merill touches upon this issue when he notes, in the preceding issue of thisBulletin, that ‘the economic dilemmas faced today may be ultimately the consequences of state failure’. The state that has failed to regulate the markets is described as ‘weak’ and ‘subject to external blows, blind to its ends, merely one actor among many in the events of the day’ (Merill 2012: 28). Yet Merill does not seem to consider this weakness to be an inherent feature of the constellation of which contemporary democracy is a part.There are, of course, excellent reasons not to take this path. First, representative democracy has in many cases proved to be the best way of preventing small elites from acquiring political power, and many of the impressive social and political achievements of the twentieth century are the result of democratic processes. When the U.S. conducts warfare, elements of a force are drawn from different services and work together as a single team to accomplish an assigned mission. To achieve such unified action, it is necessary that the doctrines governing the actions of members of specific services be both consistent with and subservient to joint Doctrine. Because warfighting today increasingly involves not only live forces but also automated systems, unified action requires that information technology that is used in joint warfare (...) must be aligned with joint doctrine. It requires also that the separate information systems used by the different elements of a joint force must be interoperable, in the sense that data and information that is generated by each element must be usable (understandable, processable) by all the other elements that need them. Currently, such interoperability is impeded by multiple inconsistencies among the different data and software standards used by warfighters. We describe here the on-going project of creating a Joint Doctrine Ontology (JDO), which uses joint doctrine to provide shared computer-accessible content valid for any field of military endeavor, organization, and information system. JDO addresses the two previously mentioned requirements of unified action by providing a widely applicable benchmark for use by developers of information systems that will both guarantee alignment with joint doctrine and support interoperability. Joint practical deliberation is the activity of deciding together what to do. In this dissertation, I argue that several speech acts that we can use to alter our moral obligations – promises, offers, requests, demands, commands, and agreements – are moves within joint practical deliberation. -/- The dissertation begins by investigating joint practical deliberation. The resulting account implies that joint deliberation is more flexible than we usually recognize, in two ways. First, we can make joint (...) decisions not only about what we will do together, but also about what you or I will do alone. Second, we can deliberate by means of two distinct methods: propose-and-ratify, in which a proposed joint decision must be explicitly accepted to come into effect, and propose-and-challenge, in which a proposed joint decision comes into force unless it is explicitly challenged. -/- Varying these parameters generates a botany of different kinds of proposals we can make within joint deliberation. When we look at these proposals more closely, we make a surprising discovery: for each kind of proposal we can make in joint practical deliberation, there is an everyday speech act with the very same properties. A certain kind of proposal to make a joint decision regarding one’s own actions has the same normative effects, under the same conditions, as a promise. One kind of proposal to make a joint decision regarding one’s addressee’s actions has all the essential features of a command; another kind of deliberative proposal – with the same content but a different method of evaluation – looks exactly like a request. And so on. -/- These similarities are too systematic to be coincidental. The only explanation, I argue, is that these ordinary speech acts are identical to their doppelgängers within joint practical deliberation. Promises and offers are proposals to make joint decisions about what I will do. Commands, demands, and requests are proposals to make joint decisions about what you will do. And agreements are joint decisions about what we will do. Call this the deliberative theory of these speech acts. -/- Considering each speech act in turn, I defend the deliberative theory by arguing that it provides a uniquely powerful explanation of its targets’ social and moral significance. Once we see how naturally these speech acts fall out of our practice of joint deliberation, theories that treat them as sui generis – as many moral philosophers now do – will come to seem redundant and nonexplanatory. Conversely, thinking of promises, offers, commands, demands, requests, and agreements as moves within joint practical deliberation allows us to give an elegant and generative theory of these phenomena that have confounded moral philosophers for so long. With the shift from a society dominated mass media toward a media landscape of targeted messages, mediated social relations are also transformed. This article addresses a civil society increasingly mediated by advanced marketing communication technologies, analyzing the democratic consequences of information flows constituting new forms of social interaction. It is suggestive to think of advanced marketing technologies not as discreet components and legal codes, but as representational technologies that allow the coordination of a variety of sophisticated knowledge specialties, and as (...) laboratories that structure the relationships, possibilities, and options for managers, technicians, viewers, and distributors. By conceptualizing issues of privacy with the focus on the creation and impact of social categories, we have a chance to make the marketing representations and laboratories constructed by concentrated powers less opaque and more open to joint creation. This paper shows that several live philosophical and scientific hypotheses – including the holographic principle and multiverse theory in quantum physics, and eternalism and mind-body dualism in philosophy – jointly imply an audacious new theory of free will. This new theory, "Libertarian Compatibilism", holds that the physical world is an eternally existing array of two-dimensional information – a vast number of possible pasts, presents, and futures – and the mind a nonphysical entity or set of properties that "read" that (...) physical information off to subjective conscious awareness (in much the same way that a song written on an ordinary compact-disc is only played when read by an outside medium, i.e. a CD-player). According to this theory, every possible physical “timeline” in the multiverse may be fully physically deterministic or physically-causally closed but each person’s consciousness still entirely free to choose, ex nihilo, outside of the physical order, which physically-closed timeline is experienced by conscious observers. Although Libertarian Compatibilism is admittedly fantastic, I show that it not only follows from several live scientific and philosophical hypotheses, I also show that it (A) is a far more explanatorily powerful model of quantum mechanics than more traditional interpretations (e.g. the Copenhagen, Everett, and Bohmian interpretations), (B) makes determinate, testable empirical predictions in quantum theory, and finally, (C) predicts and explains the very existence of a number of philosophical debates and positions in the philosophy of mind, time, personal identity, and free will. First, I show that whereas traditional interpretations of quantum mechanics are all philosophically problematic and roughly as ontologically “extravagant” as Libertarian Compatibilism – in that they all posit “unseen” processes – Libertarian Compatibilism is nearly identical in structure to the only working simulation that human beings have ever constructed capable of reproducing (and so explaining) every general feature of quantum mechanics we perceive: namely, massive-multiplayer-online-roleplaying videogames (or MMORPGs). Although I am not the first to suggest that our world is akin to a computer simulation, I show that existing MMORPGs (online simulations we have already created) actually reproduce every general feature of quantum mechanics within their simulated-world reference-frames. Second, I show that existing MMORPGs also replicate (and so explain) many philosophical problems we face in the philosophy of mind, time, personal identity, and free will – all while conforming to the Libertarian Compatibilist model of reality. -/- I conclude, as such, that as fantastic and metaphysically extravagant as Libertarian Compatibilism may initially seem, it may well be true. It explains a number of features of our reality that no other physical or metaphysical theory does. (shrink)

The one of goals that religious provisions aim to achieve is the preservation of the generation. For this reason, Islam recommends marriage and prohibits all illegitimate relationships outside of marriage. He also ordered the parties to respect each other's rights and fulfill their responsibilities in order to maintain the marriage union. He requested that all attitudes and behaviors that would disrupt the marriage union be avoided. How ever, from time to time, a word said or a behavior exhibited by one (...) or both spouses shakes the marriage union and even leads to its end. Situations that can be described as severe disagreements that occur between spouses and make the continuation of the marital union almost impossible are expressed with the concept of “shiqàq” in fiqh. Failure of the parties to observe marriage law in domestic relations is one of the main reasons that lead to “shiqàq”. Although the reasons for the “shiqàq” that leads the spouses to discord are not explained in the relevant verse, it is recommended that in case of “shiqàq”, the institution of arbitration should be applied and the arbitrators should first reconcile the relationship between the spouses and prevent the breakdown of the marital union. On the other hand, it is controversial among the sects whether arbitrators have the authority to terminate a marriage union that they do not find beneficial to continue. While the fuqaha, who argue that arbitrators are in the position of attorneys, say that referees cannot separate the spouses without the consent of the spouses, those who say that arbitrators are in the power of judges are of the opinion that arbitrators have the authority to separate husband and wife regardless of the consent of the spouses. In addition, in case of “shiqàq”, the man can directly divorce his wife, and the woman can request the judicial authorities to separate from her husband. In this study, which deals with the issue of “shiqàq” in the context of family law, first of all, the meaning of “shiqàq”, the issues that cause this situation and the legal consequences attached to this concept will be revealed. This paper focuses on contemporary Chinese theories of public moral justification and engages in the mainly descriptive project of introducing how, according to at least some contemporary Chinese theorists, we ought to decide which moral order shall figure as the common normative framework for our undertakings so that it can be considered to be publicly justified to all. Giving a closer reading of four Chinese theorists, it will become apparent that these accounts display an internal dynamic that shall allow (...) us to relate them so as to draw the rough outlines of a possible coherent account of public moral justification. In the centre of this account will figure a standpoint that may be coined as a “first-person plural standpoint”. (shrink)

Cooperative animals often find themselves in situations in which they need to monitor and compare pay-offs received from joint ventures. They can compare their pay-offs with a) the history of giving to and receiving from the same partner, b) the effort they put into the venture, or c) what others are getting. There is ample observational evidence that monkeys and apes follow rules of social reciprocity. There is also evidence for market effects of supply and demand. In a series (...) of experiments we have further shown that monkeys show payment for labor and reject income inequality. The latter finding, first reported by Brosnan & de Waal, is directly relevant to the origin of the human sense of fairness. I will discuss how the two relate. (shrink)

The discovery of mirror neurons has given rise to a number of interpretations of their functions together with speculations on their potential role in the evolution of specifically human capacities. Thus, mirror neurons have been thought to ground many aspects of human social cognition, including the capacity to engage in cooperative collective actions and to understand them. We propose an evaluation of this latter claim. On the one hand, we will argue that mirror neurons do not by themselves provide (...) a sufficient basis for the forms of agentive understanding and shared intentionality involved in cooperative collective actions. On the other hand, we will also argue that mirror neurons can nevertheless play an important role in an account of the production and understanding of joint action, insofar as they provide the basic constituents of implicit agent-neutral representations and are useful elements in a process of online mutual adjustment of participants' actions. Joining insights from social science and philosophy, this book offers a nuanced view on the discourse of evil, which has been on the rise in the West in recent years. Exploring the famous 'Pear Theft' episode in St Augustine's Confessions, it looks beyond the theological implications of the event to focus instead on the secular insights that it offers when the event is placed in the context of social thought. With attention to Augustine's lengthy reflections on a seemingly marginal episode, (...) the author contends that it is possible to discern the elements of a convincing account of intentional evil action, the Pear Theft representing a case of joint radical improvisation that lacks collective deliberation. As such, a new perspective emerges on familiar and more intuitive forms of evil in joint action that involve group identification and institutional action. Evil in Joint Action will appeal to scholars of sociology, social theory and philosophy with interests in ethics, collective action and concepts of evil. (shrink)
