Unarmed surviving Parbatya Chittagong nation of Buddhists population in Bangladesh has not yet been able to form their government since 1997 to 2023, so it has been assumed that Prime Minister Sheikh Hasina & Awami League Government of Bangladesh (ALGOB) cheated to weaponless freedom fighters (...) Buddhists people by taking their weapons through the Chittagong Hill Tracts Peace Accord 1997 that was signed between Bangladesh and Chittagong HillTracts in order to a Commonwealth of Independence of Autonomy Government, Formation of Legislative Assembly House and Parliament Building Construction, which is also the last official initiative of the Parbatya Peace Process in the Chinese Belt and Road. Following the theater of war between the US-led NATO—Ukraine alliance and the Russian Federation, the 3rd World War situations intended to expand between Bangladesh and Myanmar. This doctrinal paper has been presented through codification of situations of the post-seizure war-fighting battles surviving cold and silent conflicts in Parbatya, Chittagong Hill Tracts, in order to deliver the seized nation onto a free pathway. Conventional theories of government formation have assumed that the coalition formation process starts after legislative elections are over and the distribution of parliamentary seats becomes common knowledge. This perspective, however, ignores the important constraints that the formation of electoral coalitions may exert on the formation of the government. The Nanosilver Linings role play case offers participants first-person experience with interpersonal interaction in the context of the wicked problems of emerging technology macroethics. In the fictional scenario, diverse societal stakeholders convene at a town hall meeting to consider whether a nanotechnology-enabled food packaging industry should be offered incentives to establish an operation in their economically struggling Midwestern city. This original creative work was built with a combination of elements, selected for their established pedagogical efficacy and as topical dimensions of (...) the realistic scenario. The product life cycle is used as a framework for integrated consideration of scientific, societal, and ethical issues. The Nanosilver Linings hypothetical case was delivered through the format of the 3-hour workshop Ethics when Biocomplexity meets Human Complexity, providing an immersive, holistic ethics learning experience for STEM graduate students. Through their participation in the Nanosilver Linings case and Ethics when Biocomplexity meets Human Complexity workshop, four cohorts of science and engineering doctoral students reported the achievement of specific learning objectives pertaining to a range of macroethics concepts and professional practices, including stakeholder perspectives, communication, human values, and ethical frameworks. Automated text analysis of workshop transcripts revealed differences in sentiment and in ethical framework preference between societal stakeholder roles. These resources have been recognized as ethics education exemplars by the U.S. National Academy of Engineering. (shrink)

In 2006, the Chief Medical Officer for England published the report Good Doctors, Safer Patients in a call for strengthened regulation of the medical profession. The changing relationship between patients and doctors in the United Kingdom arises from the interplay between societal expectation and clinical governance, personal formation and professional practice, private being and public doing. The wisdom of professional practice is in the habits of professionals, a practical wisdom that is the reflex of professional identity. Socialization into a (...) profession is the formation of such identity through the legitimate peripheral participation of the apprentice, oriented towards the contingent granting of admission to the community of practice. The conditional nature of continued insider status, permitting members to interact with clients across the professional boundary, is essential to the contract through which the profession enjoys the privileges conferred by society. The governance of the profession is therefore also necessarily circumscribed, a political reality that is currently evidenced in the regulation of medical practice in the United Kingdom. (shrink)

How does a sense of touch, figuratively and practically, get deployed within equality governance, and to what questions and ways of thinking about the state does this direct us? Taking 2009–2010 as a snap-shot moment in the development of British equality reform—the year leading up to passage of the Equality Act 2010—this article explores the relationship between touch (the haptic) and equality governance from three angles. First, how have governmental bodies used touch language and imagery, including in geometrical representations of (...) disadvantage? Second, what other, more challenging encounters and actions are imaginable; specifically, can touch mobilise the feeling state as a critical form of active citizenship? Third, what re-conceptualisations of the state does the touching, feeling state invoke, and with what effects? Specifically, does conceiving of the state as a multi-identity formation reframe the risks associated with a haptic state, thereby opening up new strategies for political action? (shrink)

Most models of the formation of political coalitions use either Euclidean spaces or rely purely on game theory. This limits their applicability. In this article, a single model is presented which is more broadly applicable. In principle any kind of set can be used as a policy space. The model is also able to incorporate different kinds of party motivations: both rent-seeking and idealism. The model uses party preferences and power to identify stable coalitions and predict government policy (...) as well as to indicate which member of the opposition will be able to break up the governing coalition if no stable coalition exists. In the latter case it will also indicate on which issue the government is likely to split. Parties may have preferences over issues such as the composition of cabinet and/or the governing coalition as well as the more traditional issues of government formation. Abstract:This paper offers an extended critique of the proliferation of talk and writing of business ethics in recent years. Following Levinas, it is argued that the ground of ethics lies in our corporeal sensibility to proximate others. Such moral sensibility, however, is readily blunted by a narcissistic preoccupation with self and securing the perception of self in the eyes of powerful others. Drawing upon a Lacanian account of the formation of the subject, and a Foucaultian account of the workings (...) of disciplinary power, it is then argued that the governance of the corporation is effected precisely through encouraging such a narcissistic preoccupation with the self. For the most part our narcissistic concerns are bound to ethically indifferent financial interests. But in recent years they have also been harnessed to the demand for environmental, social and ethical responsibility by the corporation. It is argued, however, that the desire to be seen to be ethical—the ethics of narcissus—is the obverse of “being responsible for.”. (shrink)

The purpose of this article is to analyze the variability of the "Self-made-man" idea in the context of the Christian Middle Ages in its primarily historical and philosophical presentation. Research is based on the historical and philosophical analysis of the medieval philosophy presented foremost by the works of Aurelius Augustine, P. Abelard, Thomas Aquinas, and also by the modern researches of this epoch. Theoretical basis. Historical, comparative, and hermeneutic methods became fundamental for this research. Originality. The conducted analysis allowed to (...) draw a conclusion that, despite the still existing view of the Middle Ages as a kind of an ideological gap in the formation of the self-determination idea, the Christian philosophy of this period not only does not reject but also gives essentially the universal character of the ancient intention to recognize the individual’s right to self-determination and self-government, makes it not only religiously acceptable but also obligatory. Conclusions. Despite to general theocentrism, providentialism and fatalism of Christian medieval philosophy and culture in general, at its epicenter there is a man of a special type, focused on preserving spiritual autonomy and identity in the social dimensions of their existence, and at the same time, on personal responsibility for their own destiny. Such focus became a logical and somewhat unexpected result of the complex interaction of numerous factors of medieval culture, as well as the ideas and intentions inherited from Antiquity. In particular, the idea that a person who does not act freely cannot be morally responsible for what he does, as well as the intentions of the ancient sage to autonomy, autarky, and apoliticism. In the Middle Ages, this intention became essentially universal, as it became a right, even an obligation of every Christian to be free, at least from the worldly, in determining and realizing his own destiny. The gradual compromise recognition that personal salvation is possible only as a result of synergy, i.e. the co-participation of God’s grace and human freedom, legitimizes and strengthens its focus on active personal efforts and personal responsibility for one’s own salvation, in fact for one’s own destiny. All this in historical perspective was found in its radicalized and purified from all sorts of mystical and religious layers of expression in the idea of "Self-made-man". (shrink)

Since 1993, coalition governments have replaced the 38-year-long, one-party dominance of the Liberal Democratic Party (the LDP) in Japan. Except for one year, from 1993 to 1994, the LDP has remained a key party in successive governing coalitions, but the dynamics of party competition has been completely transformed since the period of the LDP's dominance. Although the LDP has survived to form a variety of coalitions ranging from a minority to an over-sized majority, since 1998 the Democratic Party of Japan (...) (DPJ) has continued to counter the LDP governments. The transformation of party systems in Japan accompanies the party switching of legislators and the mergers, breakups, extinctions, and formations of parties. In this regard, the Japanese case provides an interesting example to show how parties attempt to change the dynamics of policy competition by switching and reorganizing. Parties also attempt to shift their policy positions to attract public support and to gain a competitive edge in government formation. Using expert survey data about the policy positions of parties, this study explicates the dynamics involved in the reorganization of parties and the formation of governments. (shrink)

This paper criticizes the tendency to view the extension of the class of social actors, which stems from the process of democratization of data, as also implying the extension of the class of the political actors involved in the process of governance of the Information Society. The paper argues that social actors can upgrade to political actors once they become real interlocutors, namely political actors that can participate in the formation of the political discourse and that this can happen (...) only once they are able to combine, to a greater or lesser degree, the reduction of information asymmetries with the reduction of power differentials. This article devoted to study of the issues of formation and functioning of national political elites in the context of globalization processes. According to the author, processes of globalization, socio-political, public-legal, and financial-economic development in national societies and States led to the formation of the national political elites in a single global governing elite in the face of the global Manager class, which, in turn, forms the main approaches, requirements and principles that underlie the formation and functioning (...) of national political elites. However, all this leads to the fact that global and national management of the elite are unable on the one hand, to quickly solve global problems facing humanity, and on the other hand, to ensure the progressive development of humanity as a whole, resulting in the creation and development of a revolutionary situation in the national and international scale. The only alternative to the existing trends of the formation and development of national political elites in anti-state and anti-social manner, which inevitably can lead humankind to destruction or self-destruction, is the growing activity of civil society to the state of leveling of power and influence of the global ruling elite in the face of the global Manager class. _The purpose_ of this study is the reflection on ways of philosophical legitimation for the "Self-made-man" idea in the worldview of the Renaissance and Reformation. _Theoretical basis._ Historical, comparative, and hermeneutic methods became the basis for this. The study is based on the works of Nicholas of Cusa, G. Pico della Mirandola, N. Machiavelli, M. Montaigne, E. Roterodamus, M. Luther, J. Calvin together with modern researchers of this period. _Originality._ The analysis allows us to come to the conclusion that casts (...) doubt on the still widespread belief according to which the emergence of the "Self-made-man" idea is localized by the process of forming the American cultural code and the ideological heritage of Benjamin Franklin. It is highlighted that the formation of this idea is the result of a long process that originated in the ancient world and gains a special impetus in the Renaissance and Reformation. Precisely in the cultural context of the latter, the ancient intention to recognize the individual’s right to self-determination and self-government, which in the depths of Christian theology acquires only a potentially universal character, becomes not only acceptable but also, in the context of Protestantism worldview, the only admissible, in fact, individual’s obligatory life guidelines. _Conclusions._ Humanistic and reformation thoughts quite naturally led to further ideological legitimation of the person’s idea of who is creating oneself. This legitimation was during the complex interaction of numerous factors of culture in the Late Middle Ages, as well as ideas and intentions inherited from Antiquity. Key among them was the gradual formation of a new social order, in essence, indifferent to paternalistic rudiments, together with the ethics of Protestantism corresponding to it. The latter does not only legalize but, de facto, sacralizes the individual’s reorientation from hopes for the synergy of God’s grace and own free will in personal salvation, toward the self-reliance and personal efforts, awareness of personal responsibility for the own fate as key principles of the "Self-made-man" concept. This study assessed whether and how government–business partnerships offer a unique platform that targets profound environmental impacts via the promotion of radical eco-innovation. It applied transactional cost and complementary logics to explain the rationale of GBP formation for radical eco-innovation, and further assessed the operation of GBPs from governance, learning, and rulemaking aspects. This study applied propensity score matching technique to empirically test these theoretical associations using 225 observations representing 166 U.S. firms’ participation in 192 environmental alliances between (...) 1985 and 2013. The study results confirmed GBPs’ role in channeling public and private efforts in pursuing transformative environmental change via the adoption of radical eco-innovation goals. Results highlight four critical elements of GBP operation—effective governance, exploration learning, cognitive learning, and rulemaking—that enable participants to embrace these radical environmental solutions. Many governments promote the concept of multi-destination tourism to attract foreign visitors to stay longer in a region. This study constructs a higher-order multi-destination image model to examine how the unique cognitive images of Hong Kong, Macau, and Guangzhou collectively constitute the overall cognitive image of China’s Greater Bay Area. Then, it further examines how this overall cognitive image builds affective, overall, and conative images of the GBA. The results of an online survey of non-Chinese tourists from Guinea, Japan, New (...) Zealand, United Kingdom, and United States show that cognitive images of three cities in the GBA take different weighting in constructing the overall cognitive image of the GBA. The overall cognitive destination image significantly influences the formation of the affective, overall, and conative images of the GBA region. For constructing the conative image, the affective image shows the greatest impact, overall cognitive image follows; the impact of the overall image is less. This study proposes theoretical implications for future regional tourism studies. Practical recommendations are also proposed. (shrink)

The research analyzes the process of formation of the ethics committee as a new institution in the system of regulation of genetic research. The external factors of this process are the increasing digitalization of medical and research practices, as well as the special situation that is developing in the field of genomic research and the use of genetic technologies, where issues of philosophy, jurisprudence and administration have generated many fundamentally new, and sometimes unexpected contexts. The author shows the similarity (...) and difference of approaches to the inclusion of the ethics committee in the national regulatory systems of different countries and determines the prospects for further integration of the new institution into normative and administrative-regulatory and law enforcement practices. The research applies all the main methods of system analysis and structural and functional analysis, as well as the comparative legal method. At the stage of generalization of empirical material, the author turns to the means and methods of philosophical phenomenology and phenomenological sociology. The study revealed that the ethics committee may have different institutional and regulatory functions in a variety of management and legal systems. Being hybrid in nature, the ethics committee performs various functions, and in various state legal systems and traditions it can combine elements of legislative, executive and judicial power. At times, the ethics committee may go beyond the scope of both a purely administrative and exclusively legal regulator. All this indicates that the integration of this institution into the legal system and into a variety of social practices is far from being completed. (shrink)

This commentary explores the potential consequence of latent racial formation in emergent climate finance data projects and draws from ethnographic research on climate finance governance conducted in Fiji. Climate finance data projects emerging in the Pacific aim to ease the flow of finance from the Global North to the South. These emergent data projects, such as renewable energy resource availability and investment mapping, are imbedded in the climate finance organizations that fund, develop, and use them. Thus, the commentary explores (...) climate finance organizations through the lens of Ray’s theory of racial organizations, highlighting the ways in which important climate-related resources are mediated through racial and colonial schemas. The racial mediation of two key resources are spotlighted in this discussion: the finance itself and knowledge. Given that the Pacific region is at the coalface of climate change’s existential effects, the just allocation of resources is imperative. In interrogating the ways in which emergent data projects may deny these resources based on hidden racial schemas, the paper cautions against new and old forms of colonization that may be mobilized through even well-meaning techno-benevolent fixes. A theoretical model is presented for pattern formation in an epithelium. The epithelial model consists of a thin, incompressible, viscoelastic membrane on an elastic foundation (substrate), with the component cells assumed to have active contractile properties similar to those of smooth muscle. The analysis includes the effects of large strains and material nonlinearity, and the governing equations were solved using finite differences. Deformation patterns form when the cells activate while lying on the descending limb of their total (active + (...) passive) stress-stretch curve. Various one-dimensional and two-dimensional simulations illustrate the effects of spatial and temporal variations in passive stiffness, as well as the effects of foundation stiffness and stretch activation. The model can be used to examine the mechanical aspects of pattern formation in morphogenetic processes such as angiogenesis and myocardial trabeculation. (shrink)

The article aims to define the management mechanism of complex, open dynamic systems with human participation. The following parts of the system life-cycle were identified and unified in the theoretical scope: general and specific compositional elements of repeating changes, marginal index boundaries, the dynamics of the compositional elements of the lifecycle, the key points of the change in the character of the index dynamics. In the practical scope, two common trends of socio-economical system life-cycle management are considered. The first trend (...) is the regulation of the comprising element ratio, which provides the increase in the duration of the maximally effective performance of a functioning system. The second trend is the regulation of the reproduction time of a new system. The systems life cycle aspects are investigated in almost all sciences and studied within many disciplines in the field of higher education. Therefore, deepening the mastery of scientific and methodological foundations of the life cycle of a complex open dynamic system is useful for any subject in everyday and practical activities. A human being – in the formation of own human capital. Families – when it is formed, the birth of children, the distribution of income and expenses. Companies – for efficient business activities. As well as local communities, local self-government bodies, public authorities and global entities within their profile activities. The results of the research provide the possibility of the development of applicable mechanisms for effectiveness and stability enhancement of managerial and entrepreneurial operation in business projects. This article engages with the production and government of migrant multiplicities in border zones of Europe, arguing that the specificity of migrant multiplicities consists in their temporary and divisible character. It is argued that there are three different forms of migrant multiplicities: (1) the multiplicity produced due to migrants’ spatial proximity; (2) the virtual multiplicity generated through data; and (3) the visualized and narrated multiplicity that emerges from media portraits of the ‘spectacle’ of the arrivals of migrants. It is (...) claimed that multiplicities are made to divide and partition the migrants and thus prevent the formation of a collective political subject. In the concluding section, the article deals with the ambivalent character of the term ‘the mob’, addressing the twofold dimension of migrant multiplicities: these are in fact generated by techniques of power, at the same time exceeding them and representing potential emerging political subjects. In post-Roman Western Europe a two-class society of lords and their dependents was maintained by an intense concentration of wealth and by the lords' control of the supply of food, arms, and land. When the Normans came to England there was no knightly class. Until the late twelfth century knights were only knights while they were in possession of their weapons, and they were not clearly distinguished from the cultivators from whom they were drawn. All were subject to the arbitrary (...) demands of lordship, and vulnerable to labor services and corporal taxes. In England, thanks to strong royal/public government, the meaning of “freedom” was extended from “not being owned” to “not being dominated” . By the thirteenth century a class of small landholders was able to achieve independence of lordship—and independence of the Crown—to the extent that they could not be taxed without being consulted. Since post-Conquest England had no allodial land, this independence could only be achieved within the tenurial structure. My aim is to discuss, within the framework of the new views of European knighthood and Norman feudalism, some of the factors that brought a large section of the population of England out of dependency to freedom and created an independent landholding gentry. This article deals with the elevation of the administrative status of Jerusalem from vilāya to niyāba and the impact of this transformation on the judicial organization and the appointments in the city. During the early Mamluk period, Jerusalem remained as wilāya, a less significant administrative unit, subordinate to the nā’ib of Damascus. However, in the later eighth/fourteenth century, the city was turned into a separate niyāba, an administrative unit governed by the viceroy (nā’ib al-saltana) of the sultan, and attached directly (...) to Cairo, the political centre of the Mamluks. While the existing scholarship tends to see this change as a manoeuvre against the Crusader threat, this article argues that the foundation of niyāba in Jerusalem was associated with the bureaucratic centralisation of the Mamluk Sultanate and the religious importance of the city. Unlike the Ayyubid politics of fragmented sovereignty between the dynasty members, the Mamluks appointed viceroys on behalf of the sultan to the significant cities of Syria. Therefore, the foundation of niyāba in Jerusalem can be seen as a continuation of this attempt toward the centralisation of the Syro-Egyptian lands. On the other hand, with this change, the Mamluk sultan had the opportunity to express his patronage over Jerusalem in a more powerful way and to control the administrative, judicial, and scholarly realms in the city directly. What is more important in terms of the judicial practices is that Jerusalem was introduced to four chief judgeships (Shāfi‘ī, Hanafī, Mālikī, and Hanbalī) within the thirty-year period after the founda-tion of niyāba. All these changes meant that the city became bureaucratically more integrated with Cairo so that the Cairene elite were increasingly in-volved in local appointments of scholars. Moreover, it became increasingly crucial for Jerusalemite scholars to have connections with Cairene bureaucrats in order to secure scholarly positions in Jerusalem. (shrink)

Vascular calcifications are the consequence of several pathological conditions such as atherosclerosis, diabetes, hypercholesterolemia and chronic renal insufficiency. They are associated with risks of amputation, ischemic heart disease, stroke and increased mortality. A growing body of evidence indicates that vascular smooth muscle cells (VSMCs) undergo chondrogenic commitment eventually leading to vascular calcification, by mechanisms similar to those governing ossification in the cartilage growth plate. Our knowledge of the formation of cartilage growth plate can therefore help us to understand why (...) and how arteries calcify and, consequently, develop new therapeutic strategies. Reciprocally, thorough consideration of the events leading to ectopic chondrocyte differentiation appears crucial to further increase our understanding of growth plate formation. While the cancellation of a number of high-profile loans because of corruption concerns has made headline news, the World Bank's principal approach to poorly governed countries is lending in order to support reforms. Although designed to be an apolitical technocratic development financier, increasingly the Bank has focused its attention and resources on promoting good governance in its borrowers. Bank lawyers and presidents have attempted to hive of apolitical aspects of governance by arguing a distinction between the rule of law and (...) the political character of government, but this distinction is illusory. The Bank's inability to address the political embeddedness of poor governance in neo-patrimonial governments skews risk assessments and impedes the formation of effective strategies. Reform of the charter would not eliminate the Bank's bureaucratic and political constraints. (shrink)

Moreover, merging Tournai with the rural communes serving as abuffer between Tournai and the French border, the new entity will directly touch the "urban community" Lille - a major pole of attraction from the economic and commercial as well as from the cultural point of view.A particular care to keep an equilibrium among rural and urban population accounts for the absorption of several communes that are rather distant and have no direct links with Tournai. Finally, there has been an underlying concern to ensure that in the new entity the christian-democratic and the socialist party would have an almost equal weight and the Walloon Gathering would have a chance to break through ; this seems to explain the fact that Antoing and its peripheral communes, having a socialist majority, have been kept out of the merging operation, one has on the contrary merged several rural communes with a clear christian-democratic tendency, and the government eventually decided to realize a maximum merger which is supposed to electorally favour the Wallon Gathering. The chapter begins with early eighteenth-century descriptions of the use of reason, properly supplemented by faith and grace, in the government of the passions. Next the familiar figures of Shaftesbury and Hutcheson are presented, with emphasis laid upon their insistence that government of the passions is work that the individual has to do for himself. The question is then raised whether all people can be conceived as able to do the work necessary to self-government, and Mandeville is (...) introduced as an advocate of the view that the answer to this question is plainly No. The next section of the chapter provides examples of texts which give the faculty of conscience a governing role, as well texts which see in the formations of associations of ideas the possibility of gradual reform and correction of the passions. In conclusion the chapter makes brief mention of two trends that would prove important in the first decades of the next century: religious revivalism, and the advocacy of physiological cures to mental disorders. While previous research considering the emergence of strategic alliances has typically viewed their formation through a single theoretical lens, we suggest that multiple theoretical perspectives are needed to understand their complexity. This research conceptually integrates the resource-based view and institutional theory to assess variations in firm-level motivations to form strategic alliances. Applying these ideas to the context of complex environmental problems, we propose that strategic alliances typically are either competency- or legitimacy-oriented, and that four structural dimensions characterize both types (...) of alliances—organization learning, partner diversity, governance structure, and partner relations. We present research propositions that describe how alliances differ along these dimensions, and offer an important broader perspective on alliance formation that is applicable towards understanding their strategic and social outcomes. The present-day arena of Chinese political culture features glocalizational considerations with regard to the exploration of renzheng as humane governance that is somewhat corresponding to shanzhi as good governance. Both forms of governance seem to share such similar principles as accountability, efficiency, equity, honesty and transparency, among others. However, humane governance places more emphasis on humanity, fairness, competence, correctness and morality with its ultimate goal to build up a harmonious society per se. It is claimed to consist in at least (...) two most important dimensions in the social setting of China at the current stage. One is fazhi as rule of law drawn from the Western democracy, and the other is xianming as wise leadership originated from the Chinese Confucianism. This pair of compasses can be employed to draw proper circles so long as they are synthesized into an organic whole by virtue of shiyong lixing as pragmatic reason. Such kind of reason is primarily characteristic of the Chinese mode of thought in one sense, and largely manifesting the ethos of Chinese culture in the other sense. In practice it is often conceived as general as “a creative principle in a dynamic process” of historical accumulation, cultural formation and psychological sedimentation as well. It was first formulated in early Confucianism but stays open to further modification along the passage of time. With respect to the preoccupation with humane governance in the given description, the pragmatic reason comprises at least four essential aspects ranging from usefulness (you yong xing), ethicalness (lun li xing), affective-cum-reasonable synthesis (qing li bu fen) to historical awareness (li shi yi shi). All this helps in varied ways rediscover the traditional sources and transform the conception of humane governance into a relevant strategy in order to upgrade the level of governmental efficiency and social management. After years of the welfare state, the rise of technology, combined with neoliberal governmental apparatuses, has established a new society of the precarious. In this new way of the world, productivity is not just connected to labor in the traditional sense of work hours, but more totally, to the formation of the self: work becomes performative and affective, and personal identities seep more and more into working ones. This new mode of being has another side, however: it can lead (...) to new forms of self-organization, resistance and exodus. Recent years have featured a spate of regulatory action pertaining to the development and/or disclosure of corporate governance structures in response to financial scandals resulting in part from governance failures. During the same period, corporate governance activists and institutional investors increasingly have called for increased voluntary governance disclosure. Despite this attention, there have been relatively few comprehensive studies of governance disclosure practices and response to the regulation. In this study, we examine a sample of 50 U.S. firms and their public (...) disclosure packages from 2004. We find a high degree of variability in the presentation and reporting format choices for many elements of the governance structure. This variability includes several items for which disclosure is mandated by regulators or legislative action. In particular, smaller firms offer fewer disclosures pertaining to independence, board selection procedures, and oversight of management (including whistleblowing procedures). There are also trends associated with board characteristics: boards that are less independent offer fewer disclosures of independence and management oversight matters. Moreover, large firms provide more disclosures of independence standards, board selection procedures, audit committee matters, management control systems, other committee matters, and whistleblowing procedures but do not appear to have a strictly superior information environment when compared to smaller firms. The findings raise questions about compliance with regulatory requirements and the degree to which conflicts of interest between managers and directors are being controlled. While there have been notable improvements in the information environment of governance disclosures, there remain structural issues that may possess negative ramifications for stakeholders. (shrink)

What are the contents, limits, and possibilities of Aristotle’s works for critical thinking about money? Recent scholarship has (re)turned to Aristotle as an authority for two key political approaches to money. The first aims to democratize the governance of monetary institutions in order to realize more just economic outcomes. The second seeks to prevent money, or its inherently deleterious excesses, from corrupting political actors and political life. Arguing that these two approaches are insightful, important, and incomplete, I reengage Aristotle’s account (...) of money across the Nicomachean Ethics and the Politics to theorize money as a vital but underexplored means of political subject formation. I illuminate how the use of money produces collective and constitutive relations that emerge by way of people’s engagements and entanglements with the things they produce, acquire, desire, and exchange. Bringing this to light also makes visible, I argue, how Aristotle understands money as something capable of being used to both bring about social justice and to pervasively corrupt the foundations of shared democratic life. Taking stock of this dual capacity of money, I show how money’s relationship to subjectivity simultaneously makes money the site of a seemingly intractable problem for politics under capitalism and the means to revive it and reconnect it to democratic life. This study explores the intra-organizational antecedents of sustainable governance by examining the impact of female presence at the corporate apex. Drawing upon the upper echelon theory, we investigate whether women in top positions influence sustainable governance practices. Our research focuses on a sample of companies operating within two distinct market economies: liberal market economies (LMEs) and coordinated market economies (CMEs). The United States, represented by the S&P100, and the United Kingdom, represented by the FTSE100, serve as examples of LMEs. Conversely, (...) Germany (DAX30), France (CAC40), Spain (IBEX35), and Switzerland (SMI) are illustrative of CMEs. Analyzing archival data spanning from 2010 to 2019, we confirm that the presence of a critical mass of women on the board of directors significantly increases the likelihood of establishing a sustainability committee within organizations. This relationship holds true across both LMEs and CMEs, highlighting the universal importance of gender diversity in driving sustainable governance initiatives. Interestingly, we observe that the impact of women with structural power on sustainability committee formation is specific to LMEs, suggesting the context-dependent nature of female leadership in sustainable governance. The principal argument of the present paper is that the human body is as much a reflective formation of multiple discourses as it is an effect of natural and environmental processes. This paper examines the implications of this argument, and suggests that recognizing the body in this light can be illuminating, not only for our conception of the body, but also for our understanding of medicine. Since medicine is itself a discursive formation, a science with both a history, (...) and a future, it is argued that much can be learned by reflecting on the progression of models, or “paradigm-shifts,”, in terms of which modern medicine has articulated the human body that figures at the heart of its discourse. Four historical periods of medicine will be considered, each one governed by its own distinctive paradigm. It is argued, finally, that, with the emergence of behavioural medicine, and, more particularly, psychoneuroimmunology, a new discursive formation in medicine, one can see a new conceptualization of the human body beginning to take shape; and that this new figure of the body makes it possible for the very first time to conceive the construction of testable hypotheses regarding correlations between the objective body of science and the phenomenological body of experienced meaning. Well-being can be promoted in two ways. Firstly, by affecting the quantity, quality and allocation of bundles of consumption (the Resource Approach), and secondly, by influencing how people benefit from their goods (the Taste Approach). Whereas the former is considered an ingredient of economic analysis, the latter has conventionally not been included in that field. By identifying the gain the Taste Approach might yield, the article questions whether this asymmetry is justified. If successfully exercised, the Taste Approach might not only (...) enable people to raise their wellbeing, but also provide solutions to a number of issues such as sustainable development and global justice. The author argues that recently developed accounts such as Happiness Economics (HE) and Libertarian Paternalism (LP) both can be considered specifications of the Taste Approach. Furthermore a third specification is identified: Inexpensive Preference Formation (IPF). Whereas LP suggests that choice architecture should be exercised when rationality fails, IPF holds that governance in certain instances should improve choices also in absence of no such failure. Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be 'believed' by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the 'religious' affinities of the constitutional preambles. They were held (...) as 'creeds' of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents' big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the 'renaissance' of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. Promising new solutions or risking unprecedented harms, science and its technological affordances are increasingly portrayed as matters of global concern, requiring in-kind responses. In a wide range of recent discourses and global initiatives, from the International Summits on Human Gene Editing to the Intergovernmental Panel on Climate Change, experts and policymakers routinely invoke cosmopolitan aims. The common rhetoric of a shared human future or of one humanity, however, does not always correspond to practice. Global inequality and a lack of accountability (...) within most institutional contexts of international governance render these cosmopolitan proclamations of ‘one human community’ incoherent and even harmful. More generally, there exists no shared normative standard for the cosmopolitan governance of science, with which such global initiatives could be evaluated. Taking a broadly philosophical perspective, the present paper aims to better understand this problem situation, identifying three high-level challenges global governance of technoscience: problematic ideals of technology and science, the unjust formation of “global” concerns, and the limitations of cosmopolitan theory. By holistically engaging these jointly empirical and normative sites of inquiry, scholars can better support humanity’s re-imagination of technoscientific practices within and beyond the nation-state. The stage of the formation and establishment of a market economy in Georgia raises the necessity for economic science to solve fundamentally different problems concerning the improvement of the investment environment and investment climate in national economy. After the collapse of the former Soviet Union, the replacement with new relationships has been quite difficult and painful in which foreign investments should play a crucial role. Issues to be discussed include the questions that explore some of the categories and the (...) constraints of the investment climate. All this leads to the relevance of the article and, therefore, determines the purpose of the article. The research process uses general dialectical methods of socio-economic research as well as modern methods of research of economic theory. The scientific aim of the research is to highlight the current issues of the investment environment and investment climate in economy, to study the transformation processes taking place in Georgia during the last two decades, to conduct analysis using proper methods, to show the current social and political as well as other important processes, to generalize them and to form proper opinions. Findings based on research suggest that it is possible to speed up the process of economic development of Georgia. However, the situation will remain difficult in the region and the factors causing the recession _ instability in oil prices and the weakening of the national currency against the US dollar will still be present. In conclusion, the opinion can be formed that a stable and predictable legislative process is important for the investment environment. Therefore, all the parties that may undergo the changes should be informed and involved in every project planned by the government; At present, it becomes necessary to further extend the deregulation policy, which should include the development of financial and investment sectors and support of the establishment of appropriate infrastructure, promotion of the further development of microfinance institutions, investment companies and funds, designing the system of investment insurance and stimulation, elimination of unnecessary bureaucracy and artificial barriers, etc. (shrink)

Entrepreneurship plays a significant role in promoting the social and economic development of a country. At present, entrepreneurship education is widely carried out in universities and colleges in order to improve students’ entrepreneurial ability, and then to provide support for the formation of a comprehensive entrepreneurial situation. As entrepreneurship education has gradually become a hot topic of teaching for innovation and entrepreneurship education of international students, studies on the influencing mechanism of entrepreneurship education of international students in relation to (...) their entrepreneurial behavior are conducive to providing theoretical basis and empirical evidence for international students’ entrepreneurship education, so as to pertinently guide international students’ innovation and entrepreneurship practice. This study aims to explore the influence of entrepreneurship education, government support for entrepreneurship, global competence, entrepreneurial self-efficacy, and entrepreneurial intention on the entrepreneurial behavior of international students in the Republic of Korea. It summarized and drew on the results of the existing literature research. According to the contents and points of research, this study takes the international students studying in Korea as the sample and uses statistical analysis software, SPSS 22.0 and AMOS 24.0, to establish a structural equation model to conduct empirical study on the influencing mechanism of entrepreneurial behavior of international students in Korea, so as to better understand the influence of entrepreneurship education in Korean universities and colleges on entrepreneurial behavior of international students in Korea. Based on the analysis results, this study puts forward the theoretical basis for the policies related to effective management of entrepreneurship, which will help alleviate the unemployment of young people studying in Korea and the tight labor market supply and demand. The article begins with Derrida’s etymology of the word ‘archive’: a privileged site to which records are officially consigned and in which they are guarded by legal authority. It explores contemporary variations on the theme of archive. The cases presented include efforts to construct scholarly archives that stand as personal monuments, struggles over the collection and consignment of records during official investigations of government scandals, and the ‘popular archive’ produced by the media spectacle surrounding the O. J. Simpson trial. (...) Recent debate over World Health Organization reform has included unprecedented attention to international lawmaking as a future priority function of the Organization. However, the debate is largely focused on the codification of new binding legal instruments. Drawing upon lessons from the success of the Global AIDS Reporting Mechanism, established pursuant to the United Nations' Declaration of Commitment on HIV/AIDS, we argue that effective global health governance requires consideration of a broad range of instruments, both binding and nonbinding. A detailed examination (...) of the Global AIDS Reporting Mechanism reveals that the choice of the nonbinding format makes an important contribution to its effectiveness. For instance, the flexibility and adaptability of the nonbinding format have allowed the global community to: (1) undertake commitments in a timely manner; (2) adapt and experiment in the face of a dynamic pandemic; and (3) grant civil society an unparalleled role in monitoring and reporting on state implementation of global commitments. UNAIDS' institutional support has also played a vital role in ensuring the continuing effectiveness of the Global AIDS Reporting Mechanism. Overall, the experience of the Global AIDS Reporting Mechanism evidences that, at times, nimbler nonbinding instruments can offer benefits over slower, more rigid binding legal approaches to governance, but depend critically, like all instruments, on the perceived legitimacy thereof.
