The banner of deliberative democracy is attracting increasing numbers of supporters, in both the world's older and newer democracies. This effort to renew democratic politics is widely seen as a reaction to the dominance of liberal constitutionalism. But many questions surround this new project. What does deliberative democracy stand for? What difference would deliberative practices make in the real world of political conflict and public policy design? What is the relationship between deliberative politics and (...) liberal constitutional arrangements? The 1996 publication of Amy Gutmann and Dennis F. Thompsons Democracy and Disagreement was a signal contribution to the ongoing debate over the role of moral deliberation in democratic politics. 'Deliberative politics' refers to the role of conversation and arguments in politics. Until recently discussion of deliberative politics took place almost exclusively among political philosophers, but many questions raised in this philosophical discussion cry out for empirical investigation. This book provides the first extended empirical study of deliberative politics, addressing, in particular, questions of the preconditions and consequences of high level deliberation. Using parliamentary debates in Germany, Switzerland, the United Kingdom and the United (...) States as an empirical base, the authors measure the level of deliberation by constructing a 'Discourse Quality Index'. This paper will discuss the peace building efforts of the National Democratic Front of the Philippines (NDFP) and the Government of the Philippines (GRP) and argue that these efforts follow the proceduralist conception of Habermas’ deliberative democracy. Habermas, like Kant, contends that peace has a “chronological and ontological priority over violence.”1 The paper will problematize the gap between legality and legitimacy as highlighted by Habermas and relate how such a gap triggered conflicts the same as that of the GRP (...) and the NDFP. I will then propose a communicative process of critique and intervention from civil liberty groups, especially the Church sector, as an avenue to possibly remedy the gaps and its effects. This book critically evaluates liberalism, the dominant attempt in the tradition of political philosophy to provide a philosophical foundation for democracy, and argues for a conception of deliberative democracy to meet this need.

According to the deliberative view of democracy, the legitimacy of democratic politics is closely tied to whether the use of political power is accompanied by a process of rational deliberation among the citizenry and their representatives. Critics have questioned whether this level of deliberative capacity is even possible among modern citizenries--due to limitations of time, energy, and differential backgrounds--which therefore calls into question the very possibility of this type of democracy. In my dissertation, I counter this line (...) of criticism, arguing that deliberative democrats and their critics have both idealized the wrong kind of citizen deliberation. Citizen deliberation should not be concerned with the indeterminate project of "translating" abstract democratic principles and values into everyday cases of political problem-solving. Instead, deliberation should take the form of analogy, just as we already find it in everyday politics and affairs. When ordinary citizens use analogies, they do not derive decisions from general principles or values, but they still reason nonetheless. Seen from this analogical perspective, deliberative democracy is already a practical reality to a large degree. When an election is on the horizon, a campaign season arises in which debates, forums, and "barstool" dialogues exponentially increase the amount of citizen deliberation. In these settings, citizens can readily be seen to be mapping analogous past candidates, elections, issues, and problems onto those currently on the ballot so as to reason about them. Consequently, analogical reasoning allows citizens to treat the majority rule mechanisms that proliferate in real politics as "deliberative outlets," which is to say, as catalysts of deliberation akin to the "creative outlets" that catalyze self-expression in the arts. While citizens may recognize majority rule mechanisms as catalysts of deliberation, many democratic theorists will hesitate to embrace this vision of the practical reality of deliberative politics. Isn't analogical reasoning too low in rigor to be placed at the heart of the deliberative ideal? I develop two arguments to explain the foundational role analogy plays in deliberation and to counter such critics. First, I draw on the explosion of research on analogical reasoning over the past two decades to show that it is far more rigorous and systematic than many suppose. Second, I argue that to the extent that citizen deliberation is concerned with rational planning, rather than just reasoning in general, analogical reasoning is logically superior. When we reason about what to do, we make plans that incorporate predictions about what is likely to ensue when a given course of action is selected. However, as soon as predictions enter into deliberation, its underlying logic changes as well. The reason for this change in logic is that as our probabilistic reasoning expands, the probability of its conclusions degenerates. Therefore, when assessing probabilities, we no longer should seek decisions derived from long, elegant chains of reasoning that connect our various options to generalities like values and principles. Instead, what we need is "short and sweet," or terse, humble lines of reasoning, which are more congruent with this form of deliberation. Thus, to the extent that democratic deliberation is involved in rational planning, it calls not for the elegant, deductive kind of reasoning idealized by proponents and critics of deliberative democracy alike. Instead, democratic deliberation calls for the "short and sweet," analogical kind of decision-making we associate with ordinary citizens already. After all, as research has shown, analogies are a much preferred and rigorous way by which even experts engage in probabilistic reasoning. By focusing on analogical reasoning, I therefore conclude that the practical reality of deliberative democracy should be recognized in ways that might ordinarily be dismissed. (shrink)

Initially, deliberative politics offers a failure of self‐identity in that the literature dealing with it divides between its determinate elevation in terms of reason, and such, and its dissipation in response to the diversity of interests pressing on it. Next, drawing on the resources of poststructural jurisprudence and by way of locating law at a defining limit of deliberative politics, a similar divide is found in law itself. Then, more productively, law is shown to be constituted (...) with‐in that divide and to take characteristic content from it. Finally, the analysis is returned to deliberative politics where the divide found in the literature can now be seen as offering this politics possibilities of effective constitution and distinctive content. The objective of this article is to examine how Habermas, guided by a normative intuition of the public use of reason, reconstructs a procedural conception of deliberative democracy which, without disregarding the strategic and instrumental dimensions of the public sphere and of politics, reconstructs the epistemic dimension of democracy: the rational acceptability of political agreements. First, I briefly present a historical and sociological analysis of the concept of the public sphere in The Structural Transformation of the Public Sphere (1962). I then present two lines of argumentation regarding the concept of the public sphere and deliberative democracy in Between Facts and Norms (1992): one refers to the principle of justification based on public reason as an intersubjective and political reconstruction of the Kantian concept of autonomy; the other refers to the essential aspects of the critical theory of society based on the distinction between lifeworld and system, and on the sociological and institutional "translation" of the public use of reason in the concepts of civil society and public sphere. The problem of historical injustice presents a deep challenge to the aspirations of deliberative democrats, especially to those “deliberative activists” who seek to advance deliberation in deeply unjust circumstances (Fung 2005, 399). But the debate over historical injustice can itself benefi t from taking a “democratic turn.” Much of the literature is dominated by arguments over historical entitlement theories of justice or by a legalistic focus on the possibilities for compensation and reparation.1 That much of it is deeply (...) skeptical as well is no surprise given that focus. But what is striking about actual debates over historical injustice in the world today is their intensely political character, and this character needs to be theorized much more explicitly when thinking about the nature and consequences of historical injustice. One crucial aspect of political disagreement, as opposed to moral disagreement, is that it is not just the force of good reasons that is at issue but also the application of force itself, especially by the state. In Deliberative Agency, philosopher Uchenna Okeja offers a way to construct a new political center by building it around the ubiquitous African practice of public deliberation, a widely accepted means to resolve legal matters, reconcile feuding groups, and reestablish harmony. In some instances, the deliberation aims to settle disputes. In others, the aim is to decide the best action to take to address unfortunate incidents such as death. Democratic theorists often place deliberative innovations such as citizen's panels, consensus conferences, planning cells, and deliberative polls at the center of their hopes for deliberative democratization. In light of experience to date, the authors chart the ways in which such mini-publics may have an impact in the “macro” world of politics. This article defends four claims. The first is that in the last few decades, two waves of democratic innovation based on random selection must be differentiated by their partly different concrete devices, embodying different social dynamics and pointing toward different kinds of democracy. The second claim is that the rationale of the first wave, based on randomly selected minipublics, largely differs from the dynamic of political sortition in Athens, as it points toward deliberative democracy rather than radical democracy. Conversely, (...) empowered sortition processes that have emerged during the second wave capture better the spirit of radical Athenian democratic traditions. The third claim is normative: these empowered sortition processes are more promising for a real democratization of democracy. Recent discussion in democratic theory has seen a revival of interest in pragmatism. Drawing on the work of C. S. Peirce, Cheryl Misak and Robert Talisse have argued that a form of deliberative democracy is justified as the means for citizens to assure themselves of the truth of their beliefs. In this article, I suggest that the Peircean account of deliberative democracy is conceived too narrowly. It takes its force from seeing citizens as intellectual inquirers, something that I (...) argue is both problematic in itself and relies on a controversial understanding of truth and inquiry. The article goes on to propose reasons for favouring a Deweyan rather than a Peircean account of democracy, one in which deliberation is seen not simply as a matter of arriving at the truth, but as part of a broader view of human flourishing. Advocates of ?deliberative democracy? want citizens to actively participate in serious dialogue over political issues, not merely go to the polls every few years. Unfortunately, these ideals don't take into account widespread political ignorance and irrationality. Most voters neither attain the level of knowledge needed to make deliberative democracy work, nor do they rationally evaluate the political information they do possess. The vast size and complexity of modern government make it unlikely that most citizens can ever reach the (...) levels of knowledge and rationality required by deliberative democracy, even if they were better informed than they are at present. The very thought of deliberative politics in contemporary China may seem surprising. Indeed, there are questions over its veracity. Analyses of scholarship on deliberative democracy in China to date might be said to fall into two camps: one sees the emergence of deliberative democracy in China as a real prospect for democracy; the other dismisses it outright. This essay offers an alternative evaluation to these two camps. It proposes a theoretical reconstruction of deliberative culture that (...) accounts for a proliferation of contemporary deliberative practices in China and the CCP’s sponsorship of deliberative experiments and institutions. The theoretical reconstruction of contemporary deliberative practices bears traces of the Confucian moral code of deliberation and the institutionalization of deliberation throughout the history of the Chinese imperial states. The upshot in taking this theoretical approach is that we can confirm that the practice of deliberation in contemporary China is well and truly alive, but it does not readily map with Western theoretical models of deliberative democracy. This essay sets up a contrast between an authoritarian deliberation—the use of actual deliberative practices by the authoritarian state to improve governance and enhance its authority— and the “western” idealized version of democratic deliberation. It considers the limitations of the Chinese model of authoritarian deliberation and explains why and how it may constitute, at least partially, a defensible normative account of the contributions of deliberation to political legitimacy, and in doing so hopes to illustrate some important historical lessons for Western deliberative democracy. Deliberative democrats conceive of the democratic process as a transformative process, one that requires citizens to participate in authentic deliberation with others rather than engaging in the strategic behaviour characteristic of existing democratic practices. Current practices often pit factions of society against one another in a struggle to win or retain political power. The moralized conception of democracy defended by deliberative democrats is one that emphasizes the importance of being open-minded, reasonable and accommodating. These civic virtues are necessary (...) if we are to treat others as equals when decisions are made concerning the use of political power, power that will influence the life prospects of everyone. Deliberative democrats are thus concerned with the normative legitimacy of a democratic decision; this legitimacy depends ‘on the degree to which those affected by it have been included in the decision-making processes and have had the opportunity to influence the outcomes’. Champions of systemic approaches to deliberative democratic theory consider that deliberative systems serve sundry functions. Whether guaranteeing political freedom should be one of those functions has not been explored in the scholarly literature. This article thus examines which conceptions of freedom underpin systemic approaches to deliberative democracy. I explore and circumscribe the analysis to two prominent options: freedom as absence of interference and freedom as non-domination. The answer to which of these alternatives best serves as a function (...) of the deliberative system hinges on the previous question of whether holistic evaluations of systemic deliberative performance are to be endorsed. The article then argues that holistic evaluations are only compatible with freedom as non-interference. By contrast, freedom as non-domination is incompatible with holism. I then provide reasons for endorsing freedom as non-domination and, by implication, to reject holistic systemic evaluations. (shrink)

Deliberative democracy is often celebrated and endorsed because of its promise to include, empower, and emancipate otherwise oppressed and excluded social groups through securing their voice and granting them impact in reasoned public deliberation. This article explores the ability of Habermas’ theory of deliberative democracy to accommodate the demands of historically excluded social groups in democratic plural societies. It argues that the inclusive, transformative, and empowering potential of Habermas’ theory of deliberative democracy falters when confronted with particular (...) types of historical injustices. It falters because it pays little attention to the historical dimension of injustices and the demands to which it gives rise. The historical dimension of longstanding injustices, it is argued, gives rise to a set of distinctive demands, such as collective memory of exclusion, acknowledgement of historical injustices, taking responsibility, and offering apology and reparations for causing these injustices, which go beyond the type of democratic inclusion that is often offered by deliberative democracy. Yet, the solution is not to abandon the model of deliberative democracy. Quite the contrary, it remains a valuable basis for forward-looking political decision making. The article concludes that in order to achieve inclusive, empowering and transformative deliberation in consolidated democracies that have experienced historical injustices, the politics of reconciliation is indispensable. This article analogises political representation to legal interpretation. It then applies the analogy to the hitherto neglected question of what political representation means for deliberative constitutionalism. The upshot is a conception of deliberative constitutionalism that, while uncompromisingly grounded in the reasoned expression of the preferences of a polity's constituents through deliberative democratic institutional innovations, mandates representatives to translate those preferences into general and abstract constitutional law. In democratic political systems, political equality is often defined as an equality of opportunity for influence. But inequalities in resources and status affect the capacity of disadvantaged citizens to achieve an effective political equality. One common thread running through recent democratic innovations is the belief that appropriate institutional devices and procedures can alleviate the impact of background inequalities on the presence and voice of the disadvantaged within those designs. My objective is to achieve a clearer understanding of the conception of (...) political equality that informs a specific subset of these designs: deliberative mini-publics. I focus firstly on the methods of participant selection advocated to secure equal presence. According to what principle is participation distributed? If it is according to the ‘equal probability’ principle, rather than ‘equal opportunity’, what difference does this make in terms of political equality? Secondly, achieving equality of voice is usually conceived in terms of equalising opportunities for influence among participants. How is this objective understood and what does this say about the underlying conception of political equality? (shrink)

This essay focuses on recent proposals to confer decisional status upon deliberative minipublics such as citizen juries, Deliberative Polls, citizen’s assemblies, and so forth. Against such proposals, I argue that inserting deliberative minipublics into political decision-making processes would diminish the democratic legitimacy of the political system as a whole. This negative conclusion invites a question: which political uses of minipublics would yield genuinely democratic improvements? Drawing from a participatory conception of deliberative democracy, I propose several uses (...) of minipublics that could enhance the democratic legitimacy of political decision-making in current societies. In this article, I discuss what motivated reasoning research tells us about the prospects for deliberative democracy. In section I, I introduce the results of several political psychology studies examining the problematic affective and cognitive processing of political information by individuals in nondeliberative, experimental environments. This is useful because these studies are often neglected in political philosophy literature. Section II has three stages. First, I sketch how the study results from section I question the practical viability of deliberative (...) democracy. Second, I briefly present the results of three empirical studies of political deliberation that can be interpreted to counter the findings of the studies in section I. Third, I show why this is a misinterpretation and that the study results from section I mean that it is implausible that sites of political deliberation would naturally emerge from the wide public sphere and coalesce into institutionalized forms of the practice such that deliberative democracy can satisfy its raison d’être. Finally, in section III, I conclude that viable conceptions of deliberative democracy should be limited to narrower aims. (shrink)
