Legal theory and practice, particularly on the exchange of pleadings, are referred to as a means of examining current thinking in pragmatics on relevance. The rules of pleadings suggest that the concept of relevance as used in pragmatics is emptied of any meaning and that theories of argumentation have not sufficiently taken into account the preliminary construction which issues to be argued about require.

Ross and I agree on two absolutely central concerns: First, her description of the proper significance of the language under study is perfectly apt, if ultimately irrelevant as a criticism of my work. Of course, I concede the obvious point that the narratives I consider are not perfectly veridical, reliable, or honest. Yet far from being a problem, these rhetorical features make the narratives appropriate and fruitful objects of study. Through the use of philosophical tools and literary-critical practice, I seek primarily to develop an understanding of the ways in which addicts portray their subjectively informed, culturally conditioned, and selectively edited self-observations. Second, I would like to underline Ross' helpful reminder about the contingency of the hypothetical claims I develop through close reading and philosophical references. Our agreement about these fundamental points may reflect my own failure to describe clearly my procedure and desired results. Within the Pragma-Dialectical School of argumentation theory both a normative and a descriptive component are essential in order to account for a reconstruction of argumentative language use. This paper concentrates on the descriptive component and discusses the choice of the adjacency pair as a tool for the systematic description of the confrontation stage of argumentative conversations. First a structural description of confrontation in conversation is developed from the discourse analytical approach to argumentation of Jackson and Jacobs, within (...) the normative frame of the theory of argumentation of Van Eemeren and Grootendorst. Then the pro's and con's of the adjacency pair model for the analysis of conversation in general and for that of argumentative conversation in particular are discussed. Where the adjacency pair fails, alternative models like Edmondson's model for the analysis of spoken discourse (1981) are examined. Finally the description of confrontation in conversations in terms of the adjacency pair is shown to be in line with the rational model for describing the pragmatic aspects of conversational coherence proposed by Jackson and Jacobs in 1983 and with their current thinking on the status of adjacency pairs (1987). From the early 1790s until after the turn of the century, a very productive but also controversial exchange took place between Reinhold and Fichte. Though many key aspects of post-Kantian philosophy were discussed, the philosophical confrontation between Reinhold and Fichte is most instructive for the understanding of post-Kantian philosophy. The exchange started when Fichte published his verdict on Reinhold's Elementarphilosophie and disapproved of its fundamental principle. In 1794 Fichte challenged Reinhold by presenting his Wissenschaftslehre. Reinhold was not convinced of (...) Fichte's foundation of philosophy at first, but announced that he accepted the Wissenschaftslehre in 1797. While Reinhold and Fichte officially collaborated in the following three years, tensions concerning fundamental questions were still present. When Reinhold adopted Rational Realism, his relation to Fichte deteriorated and the exchange between the two finally ended. The contributions in the present collection focus on the central systematic issues at the different stages of the confrontation between Fichte and Reinhold, thereby illuminating questions that are essential to the understanding of the evolution of post-Kantian German philosophy. Any well-structured argumentative exchange must be preceded by some preparatory stages. In the pragma-dialectical four-stage model of critical discussion, the clarification of issues and positions is relegated to the confrontation stage and the other preparatory matters are dealt within the opening stage. In the opening stage, the parties involved come to agree to discuss their differences and to do so by an argumentative exchange rather than by, say, a sequence of bids and offers. They should (...) also come to agree on the rules of dialogue, on roles, on logical principles, on types of argument, and on the propositions that can be used as basic premises. All in all, a lot of work needs to be done before the first topical argument can be put forward. Especially the opening stage seems prone to further disagreements and protracted discussions, e.g., about the admissibility of particular kinds of argument or particular basic premises. There is also the problem that a successful opening stage threatens to settle matters beforehand and thus put the argumentation stage out of business. The paper suggests some measures that could alleviate the workload of the opening stage, without making the argumentation stage otiose. (shrink)

In agriculture, the principle of coexistence refers to a condition where different primary production systems can exist in the vicinity of each other, and can be managed in such a way that they affect each other as little as possible. Coexistence policies aim to ensure that farmers are able to freely grow the crops they choose—be they genetically engineered (GE), non-GE conventional, or organic. In the United States (US), the issue of coexistence has very recently come into sharp relief with (...) the introduction of Roundup Ready® (RR) alfalfa, a landmark court decision in 2007 (Geertson v. Johanns), and subsequent governmental actions, including the first Environmental Impact Statement on a GE crop. By contrast, in 2003 the European Union (EU) created a policy to manage coexistence and to address economic harms that may be caused by contamination. We briefly review the EU framework as an instructive resource. This policy analysis then looks at the US organic industry and its standards with respect to GE before turning to the case of RR alfalfa. With a focus on the field trial stage and on environmental assessments prior to market approval, the case reveals numerous problems in the existing regulatory framework as it pertains to coexistence and prevention of contamination of organic products with GE material. If you turn it one way, you see one colorful pattern; if you turn it the other way, you see yet another. The multiplicity of approaches to drama and theatre education, each with its own aesthetic pattern, often obscures the common ground they all share. As a result, in its unique emphasis on art, pedagogy, and society, each may have its own aesthetic pattern; yet only by looking closely at each distinct pattern can we understand more of the power of drama and theatre to develop human consciousness.In Western education, aesthetic learning seems incidental to the assessment of learning. How did this happen? For Descartes, whose Cartesian philosophy dissociated mind from body, aesthetic feelings are irrational, since they originate in the body's senses rather than in the mind. Theories of education focused on the primacy of cognition, denying feelings in the erroneous belief that learning is independent of its context. Conversely, aesthetic education is concerned with the quality of experience, how it is felt. Dewey believed that "learning by doing" was a "consummatory" experience for the learner; it was dramatic, dialogic, and felt. The confusion between subjective and objective aspects of the aesthetic experience makes aesthetic evaluation difficult, and this may be why cognitively dominated education has steered clear of aesthetics. Richard Courtney recognized that there is an important distinction to be made between aesthetic symbols and [End Page 3] artistic symbols: "Aesthetic symbols emphasize feeling; artistic symbols are context-dependent—they only have meaning in the context of art."2David Best argues that "the failure to recognise the distinction between the aesthetic and the artistic contributes largely to the trivialisation of the potential of the arts in education."3 He points out that "... it may often be necessary to take into account, at least implicitly, wider factors... in order to judge whether [an] appraisal was aesthetic or artistic."4 What are these wider factors, and how can audiences attend to them? As Christopher Havell reminds us,There is increasing pressure on drama teachers to use their teaching expertise purely for the development of social and life-skills training. This instrumental work may, at times, closely resemble the drama process, but the intentions will be confined to an experience that simulates or resembles those "real-life situations" that it is expected students will encounter. The aesthetic search for the "universal" at the centre of the particular will not be a relevant aim in any vocational training! One can only hope that the emerging interest in the aesthetic nature of drama and its place in a coherent arts education will encourage teachers and students to reflect on the final inadequacy of any instrumental view.5I believe that it is through the power of aesthetic education that audiences for drama and theatre will come to appreciate the artistic.In Caravaggio's painting David with the Head of Goliath (1606-10), the viewer is confronted with three time periods simultaneously. As we know, the whole system of Hegel 's thought is based totally on the self-development process of the Geist. In other words, according to dialectical scheme of neoplatonism which Proclus systematized as a triad, μονή-πρόοδος-ἐπιστροφή, Hegel says that the Geist remains in himself, comes out from himself, and then returns to himself. With this process of self-development of the Geist, Hegel tries to explain the realities in general such as nature, history, art, religion, and philosophy. This process of the (...) development of the Geist makes a circle mode with the triadic way of an sich - für sich - an und für sich, but itself as the final destination of the Geist after finishing the whole process, is not a mere itself at the beginning, but the completed itself filled with the self-consciousness and freedom in full bloom. The last moment when the Geist returns to itself, Hegel says it is ‘Ruhe in Gott’. This is the final moment which the Geist as reality of the world and the history arrives and also the conclusion of his philosophy. Then, what happens to this final stage of the return of the Geist to itself, and what does it mean? Most of all, Hegel saw that, as the goal of world history is the achievement of self-consciousness of the Geist on its freedom and the realization of the freedom, this goal was achieved in the self-return of the Geist. And he has seen that the finite and the infinite, which showed constant opposition in the history of Western thought, are united here. According to Hegel, the infinite and finite in the bad concept that came out of the intellect(Verstand) are confronted with each other, and existence and non-existence are substantially separated. However, in the true concept of the infinite derived from reason(Vernunft), is formed the unified moment, in which the confrontations of both parties has been resolved and everything had been included in itself. The transcendence that he advocates is not a transmundane transcendence that is separated absolutely from the finite sensory world in existence and then unreachable absolutely, but a ‘right transcendence’ in which the finite and the infinite are really inseparable and remain as moments of the process of the Geist. In his view, the former which Platonism represents in Western philosophy, is an 'empty transcendence,' but the transcendence that he speaks is a 'full transcendence' that encompasses all moments of the finite in itself. The return of the absolute idea to itself means not only the sublation (Aufhebung) of the finite but also the the sublation of the reality, of the other, of the outwardness, of the abandonment of history, and secures the opposites to those such as ideality, self-identity, inwardness, and trans-historicity. Hegel's Geist as returning to itself has self-consciousness recognizing that it negates and rules the world and the history at the same time. In other words, it is honored and then the glorifying of God has been achieved in the consciousness of itself as the Absolute that it has been the only subject and the sole ruler of world history. According to Hegel, this glorifying of God is the most valuable object of the Geist and history. The Geist that has completed the process of self-development in the return to the itself enjoys the serenity, which is not a 'vacant serenity' but a ‘full serenity’ integrating the finite and the infinite into its inner simplicity. Hegel regarded the transition from the other to being self-internal as a transition from necessity to freedom, and in this serenity the Geist enjoys the freedom that it has in its own nature, as possible as it can. That is to say, in this serenity, the Geist becomes absolutely free and became itself, negating and sublating all other-being(Anderssein). When interlocutors start to talk at cross purposes it becomes less likely that they will be able to resolve their differences of opinion. Still, a critic, in the confrontation stage of a discussion, should be given some room of manoeuvre for rephrasing and even for revising the arguer’s position. I will distinguish between licit and illicit applications of this form of strategic manoeuvring by stating three soundness conditions.

Background: Living with a renal disease often reduces quality of life because of the stress it entails. No attention has been paid to the moral challenges of living with renal disease. Objectives: To explore the moral challenges of living with a renal disease. Research design: A case study based on qualitative research. We used Walker’s ethical framework combined with narrative ethics to analyse how negotiating care responsibilities lead to a new perspective on moral issues. Participants and research context: One case (...) was chosen from 20 qualitative interviews with renal patients in the Netherlands. Ethical considerations: Several actions have been taken to ensure the informed consent, privacy, anonymity and confidentiality of the patient in this article. More details are offered in this article. The study has been conducted in line with the recommendations of the Medical Ethical Committee of the VU Medical Center. Findings: A renal disease can force people to change their identity, relationships, values and responsibilities. The case study illustrates the moral challenges confronting renal patients. Discussion and conclusion:: Moral issues can be raised by the changes to identities, relationships, values and responsibilities caused by renal disease. Support services for renal patients and their relatives should pay more attention to these issues in order to promote self-management. (shrink)

The Twenty-fifth Congress of the CPSU emphasized that under present-day conditions, problems of ideological struggle and conflict between the two social systems are assuming increasing importance. In this connection, particularly significant for us are questions pertaining to the deepening confrontation of socialism and capitalism in the realm of social philosophy, which, with the relaxation of international tensions and strengthening of scientific and cultural contacts, is in many respects acquiring new sharpness and assuming new forms. It is precisely in the (...) sphere of the theory of social philosophy that bourgeois and revisionist thought strives the most for some kind of "infiltration of ideas," because this sphere is falsely regarded as "remote" from politics and the class struggle going on in the world. In this sphere attempts are being made to find new methods of struggle against Marxism-Leninism, but in fact these are often only modernized variants of the old ones, which have become decrepit and obsolete in the extreme. Of particular significance under present conditions is criticism of bourgeois Marxology as one of the basic and principal trends in the theoretical struggle of capitalism-oriented philosophy against Marxism. At the end of life, pain management is commonly a fundamental part of the treatment plan for patients where curative measures are no longer possible. However, the increased recognition of opioid diversion for secondary gain coupled with efforts to treat patients in the home environment towards the end of life creates the potential for ethical dilemmas in the palliative care management of terminal patients in need of continuous pain management. We present the case of an end-stage patient with rectal (...) cancer who required a continuous residential narcotic infusion of fentanyl for pain control due to metastatic disease. His functional status was such that he had poor oral intake and ability to perform other activities of daily living, but was able to live at home with health agency nursing care. The patient presented to this institution with a highly suspect history of having lost his fentanyl infusion in a residential accident and asking for a refill to continue home therapy. The treating physicians had concerns of diversion of the infusion medication by caregivers and were reluctant to continue the therapeutic relationship with the patient. This case exemplifies the tension that can exist between wanting to continue with palliative care management of an end-stage patient and the fear of providers when confronted by evidence of potential diversion of opioid analgesic medications. We elucidate how an ethical framework based on a combination of virtue and narrative/relationship theories with reference to proportionality can guide physicians to a pragmatic resolution of these difficult situations. The fictional regime of the photographic image allows Helena Almeida to stage a theatrical metamorphosis of her own body through displacements, expansions and dissimulations, placing photography at the heart of a pictorial transgression that undermines the disciplinary boundaries of visual media: the artist becomes ink, inhabits the empty canvas space, multiplies herself in mirror games that produce the unfolding of a body in deep crisis, thrown beyond its physical limits and identity. Moreover, in multimedia works such as Feel me, (...) Hear me and See me (1979–1980), as well as in some images of the series entitled The House (1982–1983), Almeida seems to move towards a radical linguistic and pictorial derangement, likely to break the traditional communicative and representative mechanisms. We seek to demonstrate, on the basis of these different aspects relating to photography’s effects of hybridization, and making use of the post-structuralist thought of Jacques Derrida and Gilles Deleuze, that the artist moves towards the designation of a structural space that combines photography, writing and the reinvention of the body. Almeida’s work confronts us with a complex reconfiguration of ways of seeing, feeling and thinking the photographic act, as well as its discursive features. (shrink)

The number of students with disabilities has increased by more than 900% in Québec universities Such an increase generates undue pressures on both the academic services available to that clientele and the personnel responsible for internships placement and supervision. In the past decade, a number of studies have attempted to make up for the lack of scientific knowledge on in-class support (measures to support the trainees.), and only a small number of studies worldwide, have focused specifically on accommodation in the (...) context of internships. This situation prompted the current researchers to conduct an exploratory research in partnership with university supervisors, field supervisors and internship coordinators. The research concentrated on three professional programs in order to highlight the specific challenges and issues supervisors must confront while providing support to students with disabilities. The study will eventually focus on testing the identified measures so as to assess their impact and help in developing required modifications. (shrink)

The article explores the complex roles shame plays in the lives of people with one or more chronic conditions. This is achieved through a participatory research process in which people with chronic conditions were invited to share stories of shame on the public social media profiles of a peer-led patient community called ‘Chronic Influencers’. The crowdsourced material shows that 7 out of 10 experience shame in relation to their illness on a daily or weekly basis. Other findings are that shame (...) seems to stick to ‘energetic failures’ of the slow or tired body in various social situations; shame is predominantly produced or anticipated in the intimate sphere; and shame can be ‘rescripted’ as culturally produced and politically contestable – and thus counter the pressure to individualise health as a project of personal improvement and self-inspection – when it is shared through voluntary storytelling among peers on social media. According to pragma-dialectical methodology, a party in an argumentative discussion can be assumed to manoeuvre strategically between dialectical and rhetorical objectives. One confrontational form of strategic manoeuvring occurs when a critic charges an arguer with advancing a standpoint that has socially harmful consequences. In special situations this form of manoeuvring can be dialectically sound, for example when the standpoint is advanced in a way that damages the dialectical process. Moving from viruses, vaccines, and copycat murder to gay panics, xenophobia, and psychopaths, _Transforming Contagion_ energetically fuses critical humanities and social science perspectives into a boundary-smashing interdisciplinary collection on contagion. The contributors provocatively suggest contagion to be as full of possibilities for revolution and resistance as it is for the descent into madness, malice, and extensive state control. The infectious practices rooted in politics, film, psychological exchanges, social movements, the classroom, and the circulation of a literary text or meme on (...) social media compellingly reveal patterns that emerge in those attempts to re-route, quarantine, define, or even exacerbate various contagions. In this paper it is shown is that although poisoning the well has generally been treated as a species of ad hominem fallacy, when you try to analyze the fallacy using ad hominem schemes, even by supplementing with related schemes like argument from position to know, the analysis ultimately fails. The main argument of the paper is taken up with proving this negative claim by applying these schemes to examples of arguments associated with the fallacy of poisoning the well. Although (...) there is a positive finding in this quest, in that poisoning the well is shown to be based on and associated with these forms of argument in interesting ways, the paper in the end is led to the conclusion that the fallacy is irreducibly dialectical. Poisoning the well is thus analyzed as a tactic to silence an opponent violating her right to put forward arguments on an issue both parties have agreed to discuss at the confrontation stage of a critical discussion. It is concluded that it is a special form of strategic attack used by one party in the argumentation stage of a critical discussion to improperly shut down the capability of the other party for putting forward arguments of the kind needed to properly move the discussion forward. In this paper, a solution to the problem of analyzing burden of proof in argumentation is developed by building on the pioneering work of Erik C. W. Krabbe on metadialogues. Three classic cases of burden of proof disputes are analyzed, showing how metadialogue theory can solve the problems they pose. The solution is based on five dialectical requirements: (1) global burden of proof needs to be set at the confrontation stage of a dialogue, (2) there need to be (...) special mechanisms for resolving disputes about burden of proof at all four stages of the dialogue, (3) they are especially significant during the argumentation stage, where burden of proof often shifts back and forth at each move, (4) such local shifts need to be partly regulated by the global burden of proof already set, and (5) the connection between burden of proof and the speech act of making a presumption in a dialogue needs to be clarified. Certainly, as textbooks in argumentation and (...) critical thinking make clear, we should steer clear of erecting and attacking straw men (Ennis 1996, 172; Govier 1985, 109–12; Groarke, Tindale, and Fisher 1997, 123). Still, a critic in a discussion or debate should be given some room to maneuver in order to rephrase the arguer’s position in her own words or to get at the underlying position of the arguer. In this article, I will be dealing with this issue from the pragma-dialectical perspective of strategic maneuvering between the shared dialectical objective of resolving a difference of opinion and the individual rhetorical objective of persuading the other side. According to existing accounts of the straw man fallacy (Talisse and Aikin 2006; Van Eemeren and Grootendorst 1992; Walton 1996), the criterion for fallaciousness resides in whether or not the critic misrepresents or distorts the arguer’s actual position. In this article I intend to provide more detailed guidelines for critics: a critic distorts or [End Page 195] misrepresents a position when she changes the formulation or nature of the arguer’s standpoint, even though this contribution by her cannot be reconstructed as containing a proposal for a change that might be acceptable to the arguer.In section 2 I will elaborate on the notion of confrontational maneuvering, that is, of strategic maneuvering between the dialectical and rhetorical goals that arise from the confrontation stage of a critical discussion. In section 3 I will characterize the form of maneuvering where an antagonist reformulates or modifies the protagonist’s standpoint in an opportune way. In section 4 I will examine the conditions under which applications of maneuvering of this kind can be sound and legitimate from a dialectical perspective and relate these conditions to the straw man fallacy. In section 5 the results of the preceding sections will be applied to a case.2. Confrontational ManeuveringIn argumentative discourse, participants typically try to achieve two kinds of objectives. First, they try to be dialectically reasonable, and second, they are out for some kind of personal triumph. The act, by the critic, of reformulating or revising the arguer’s standpoint will be dealt with from this dual perspective of strategic maneuvering (Van Eemeren and Houtlosser 2000, 2003). In order to analyze and evaluate the maneuver under discussion, I will elaborate in this section, first, on the notion of critical discussion in order to clarify the meaning of dialectical reasonableness and fallaciousness; second, on the importance of reconstruction for understanding argumentative discourse; third, on the notion of a confrontation stage; and fourth, on the distinction between direct and indirect maneuvering. These notions will be applied as follows: critics have some room for maneuvering when raising critical doubt, even when they change the arguer’s position or formulation, because there are contexts of utterance within confrontations where such a contribution does allow for a reconstruction in such a way that the result is not a direct and fallacious confrontational maneuver but, rather, an indirect and dialectically reasonable one.According to the pragma-dialectical methodology developed by Van Eemeren and Grootendorst (1984, 1992, 2004), an argumentative discourse must be reconstructed and evaluated from the perspective of a critical discussion. A critical discussion is a normative procedure that starts from a difference of opinion and that is solely aimed at resolving this dispute on the merits of the case (as perceived by the participants). Writing, in such a context, supports (...) not only certain useful figures for his particularly heterogeneous works but also the presence of alterity. Feminine imagos, set as the literary equivalent of the eradication of meaning and words, act as levers from which a character produces itself or rather disarticulates and vanishes.Bataille’s fight against writing shows strong similarities to some Lacanian notions: the subject, pleasure (“jouissance”), and, of course, woman. Before trying to map out this perilous comparison—there is no possible perfect transition between the two—we must first extract the significant elements that make it possible. To this end, we propose some reflections on Bataille’s concepts of Oedipus and castration. Dialectics operates, Derrida writes, ‘in raising or erecting what falls’. Yet the Hegelian system is problematized in the sense that, in the Genet column of Glas, what substitutes for the system is not a well-grounded philosophical alternative, but a sort of disseminal substitution itself, working within as much as against the system it resists. The confrontation staged by the text is not between homosexual transgression, on the one hand, and heterosexual normativity as the origin of the social bond, on (...) the other, but instead a confrontation between two perspectives on the transcendental. The problem of Glas is that the two columns seem to ‘come out the same’ at the very moment when they seem to radically differ or diverge. Confronted with numerous scandals, sports organizations are turning to the adoption of ethical codes to attain more ethical behavior. However, the effectiveness of an ethical code as a means to increase ethical behavior remains debated; furthermore, the particular characteristics of a sports context have not yet been taken into account, nor have the different stages of code establishment been considered in evaluation. This article studies the effectiveness, as measured by the Ethical Climate Index, of ethical codes in sports organizations. Moreover, (...) it investigates the effects of the presence, creation, content, implementation, and enforcement of ethical codes on ethical behavior in sports organizations. Our results shed a light on the conditions that need to be in place to install an effective ethical code in sports organizations: a genuine motivation to improve ethical behavior, the involvement of coaches, and the explicit targeting of the management. Confronting the Liar Paradox is commonly viewed as a prerequisite for developing a theory of truth. In this paper I turn the tables on this traditional conception of the relation between the two. The theorist of truth need not constrain his search for a “material” theory of truth, i.e., a theory of the philosophical nature of truth, by committing himself to one solution or another to the Liar Paradox. If he focuses on the nature of truth (leaving issues of formal (...) consistency for a later stage), he can arrive at material principles that prevent the Liar Paradox from arising in the first place. I argue for this point both on general methodological grounds and by example. The example is based on a substantivist theory of truth that emphasizes the role of truth in human cognition. The key point is that truth requires a certain complementarity of “immanence” and “transcendence”, and this means that some hierarchical structure is inherent in truth. Approaching the Liar Paradox from this perspective throws new light on its existent solutions: their differences and commonalities, their purported ad-hocness, and the relevance of natural language and bivalence to truth and the Liar. In this article it is argued that a complex model that includes Toulmin's functional account of argument, the pragma-dialectical stage analysis of argumentation offered by the Amsterdam School, and criteria developed in critical thinking theory, can be used to account for the normativity and field-dependence of argumentation in science. A pragma-dialectical interpretation of the four main elements of Toulmin's model, and a revised account of the double role of warrants, illuminates the domain specificity of scientific argumentation and the restrictions (...) to which the confrontation and opening stages of scientific critical discussions are subjected. In regard to the argumentation stage, examples are given to show that a general account of argumentation, as advocated by informal logicians, is not applicable to arguments in science. Furthermore, although patterns of inference differ in various scientific practices, deductive validity is argued to be a crucial notion in the assessment of scientific arguments. Finally, some remarks are made concerning the burden of proof and the concluding stage of scientific argumentation. (shrink)

Confronting the uncertain environment, this article adopts a case research approach to resonate with the studies of hybridity. It aims to explain how the perception of uncertainty in the institutional environment affects the adaptation of organizational structure in pursuing legitimacy for hybrid organizations. Based on the empirical data collected from a two-staged fieldwork and in-depth interviews, the case analysis concentrates on the correlation between the evolution of institutional logics and organizational structure change from a diachronic perspective. The findings indicate that (...) in the face of competing and changing institutional logics, Chinese mass media organizations have gradually shifted from a dominated blending strategy in the exploration stage to a deeply compartmentalizing strategy in the stable stage. The hybrids can deal with the uncertainty of the institutional environment by enhancing the uncertainty of the organizational structure. Consequently, the case evolves an organizational integration through internal legitimacy. It manifests a possibility for hybrids of combining the two major response mechanisms in one process. Some people will confront Alzheimer's with a measure of resignation, a determination to struggle against the progressive debilitation and to extract whatever comforts and benefits they can from their remaining existence. They are entitled to pursue that resolute path. For other people, like myself, protracted maintenance during progressive cognitive dysfunction and helplessness is an intolerably degrading prospect. The critical question for those of us seeking to avoid protracted dementia is how best to accomplish that objective.One strategy is to engineer one's (...) own death while still mentally competent to do so (even in the stage of mild dementia). If I were to use a preemptive strategy in the face of a dementia diagnosis, I would probably choose to stop eating and drinking, a process known as voluntarily stopping eating and drinking. An alternative tactic for avoiding prolonged dementia would be to allow oneself to decline into moderate dementia—thus losing capacity to perform self‐deliverance or even to make serious medical decisions—but before getting to that point to provide advance instructions rejecting prospective life‐sustaining medical interventions. These advance instructions would authorize palliative but not curative measures. My current personal instructions define the point of intolerable cognitive decline triggering medical nonintervention as “mental deterioration to a point when I can no longer read and understand written material such as a newspaper or financial records such as a checkbook.” These instructions dictate allowing my demise at a point of moderate dementia when I may not be perceptibly suffering, when I may still be getting some rudimentary satisfaction from my debilitated life, and when I no longer recall the preoccupation with personally intolerable indignity that motivated my instructions. Can I expect that my advance instructions will be implemented in those circumstances? Is it lawful, and is it moral for a surrogate decision‐maker and associated caregivers to allow an uncomprehending, ostensibly content but demented individual to die? My analysis herein contends that it is not only lawful and moral but also legally required to implement clear, considered advance instructions even at a stage of moderate dementia. (shrink)

Numerous issues confront women's healthcare today, among them the medicalization of women's bodies, cosmetic genital surgery, violence against women, HIV, perinatal mental health disorders. The metropolis of Cairo has witnessed unprecedented transformations since the January revolution of 2011. It witnessed evidently an escalation of war zones and confrontations between protesters and police forces; it also witnessed the militarization and policing of the urban sphere, the creation of segregating buffer walls that paralysed entire areas. However, the Tahrir effect remains evident in that it revolutionized the very notion of what a public space is about. It succeeded in imposing an entirely unprecedented novel choreography for the (...) city in which the ‘stage’ of Tahrir was the exemplary moment that triggered extended and replicated dramaturgical violent public confrontations, public performances and occupations in all the squares of Egypt. This article traces the transformations in relation to the debates pertaining to the ‘right to the city’ relating to the expanding visibility of the street vendors. Despite the military taking over after the rule of the Muslim Brotherhood, Cairo has witnessed for the past three years a mesmerizing flourishing art scene. (shrink)

ABSTRACTThe unprecedented progress in bio‐medical sciences and technology during the last few decades has resulted in great transformations in the concepts of health and disease, health systems and healthcare organisation and practices. Those changes have been accompanied by the emergence of a broad range of ethical dilemmas that confront health professionals more frequently. The classical Hippocratic ethical principles, though still retaining their relevance and validity, have become insufficiently adequate in an increasing range of problems and situations. Healthcare that has been (...) practised for centuries on the basis of a direct doctor‐patient relationship has been increasingly transformed into a more complex process integrating the health‐team, the patient and the community. Systematic review of the specialised literatures revealed that Healthcare Ethics education has become a basic requirement for any training programme for health professionals, and should cover the different stages of undergraduate, postgraduate and continuing education. Both theoretical foundations and practical skills are required for the appropriate ethical reasoning, ethical attitude and decision‐making abilities. There is growing evidence that physicians’ professional and moral development is not only determined by the formal curriculum of ethics; rather more, it is determined by the moral environment of the professional practice, the ‘hidden curriculum’ which deserves serious consideration by medical education. On the stage of the religion-and-science dialogue, Buddhism, especially Tibetan Buddhism, is a late arrival. However, thanks primarily to the long-standing personal interest of the Dalai Lama, the Tibetan tradition he represents has come to engage deeply with various disciplines of modern science. This essay follows the active engagement that has occurred particularly in the form of the biannual Mind and Life dialogues between the Dalai Lama and scientists. From the perspective of an active participant, I present the careful (...) deliberations that ensure constructive parameters for these dialogues so that no one side can exert a hegemonic voice. I explore the challenges that are likely to confront the Buddhist side from its encounter with science, particularly with respect to its worldview. I identify specific areas where the two sides can and do engage in concrete collaboration, especially with respect to investigating healthy qualities of the mind and the effects of conscious mental training for attention and emotion regulation. Finally, I explore the question of the possible impact of this dialogue on modern science. (shrink)

McCullough et al 1 confront a challenge that no organisation has fully eradicated: incivility. They emphasise that civility is not merely a matter of common decency and good conduct but also a moral imperative, an aspirational value that should be promoted and modelled by all the members of the institutions and throughout all the stages of practitioners’ careers. In their fusion of ancient wisdom and philosophical classics with their own insights on contemporary workplaces, they forward a defensible case for why (...) civility matters and is worthy of continuous contemplation. Given the clarity and persuasion of their piece, I do not seek to challenge their claims. Instead, I will complement their argument with a perspective highlighting the difficulties of identifying low-level workplace mistreatments and responding to them impartially. While organisations should certainly not skimp on their efforts to promote civility and hold their transgressors accountable, there are nonetheless boundaries to good intentions.2 The unexamined pursuit of civility, if characterised by inconsistent definitions of harm and inappropriate allegations of uncivil acts, runs the risk of fostering its own toxicity spirals. The present volume consists of diverse individual texts, produced between 1980 and 1986, which take two forms: interviews in which Bourdieu confronts a series of probing and intelligent interviewers, and conference papers that clarify and extend specific areas of his research. Now that Bourdieu's work has achieved wide diffusion and celebrity, this is an appropriate time for this volume, a pause for retrospection and resynthesis, for corrections of misreadings and extension of previous insights, and for projection of the next stages (...) of his work. For this English edition, Bourdieu's celebrated inaugural lecture at the Collège de France, Leçon sur la Leçon, has been added. The texts fall into two fundamental areas. The first area provides an overview of Bourdieu's central concepts, never before clearly explained. The second area clarifies the philosophical presuppositions of Bourdieu's studies and gives an account of his relations with the series of thinkers who formulated the problems in social and cultural theory that still preoccupy us: Kant, Hegel, Marx, Durkheim, Wittgenstein, Weber, Parsons, and Lévi-Strauss. Bourdieu's visions of these figures is personal and penetrating, and in his vivacious, spontaneous responses one sees at work a mode of thought that can in itself be a liberating tool of social analysis. Bourdieu applies to himself the method of analyzing cultural works that he expounds, evoking the space of theoretical possibilities presented to him at different moments of his intellectual itinerary. Theater rehearsals are (usually) confronted with the problem of having to transform a written text into an audio-visual, situated and temporal performance. Our contribution focuses on the emergence and stabilization of a gestural form as a solution for embodying a certain aesthetic concept which is derived from the script. This process involves instructions and negotiations, making the process of stabilization publicly and thus intersubjectively accessible. As scenes are repeatedly rehearsed, rehearsals are perspicuous settings for tracking interactional histories. Based on videotaped (...) professional theatre interactions in Germany, we focus on consecutive instances of rehearsing the same scene and trace the interactional history of a particular gesture. This gesture is used by the director to instruct the actors to play a particular aspect of a scene adopting a certain aesthetic concept. Stabilization requires the emergence of shared knowledge. We will show the practices by which shared knowledge is established over time during the rehearsal process and, in turn, how the accumulation of knowledge contributes to a change in the interactional practices themselves. Specifically, we show how a gesture emerges in the process of developing and embodying an aesthetic concept, and how this gesture eventually becomes a sign that refers to and evokes accumulated knowledge. At the same time, we show how this accumulated knowledge changes the instructional activities in the rehearsal process. Our study contributes to the overall understanding of knowledge accumulation in interaction in general and in theater rehearsals in particular. At the same time, it is devoted to the central importance of gestures in theater, which are both a means and a product of theatrical staging. (shrink)

Deconstruction and pragmatism constitute two of the major intellectual influences on the contemporary theoretical scene; influences personified in the work of Jacques Derrida and Richard Rorty. Both Rortian pragmatism, which draws the consequences of post-war developments in Anglo-American philosophy, and Derridian deconstruction, which extends and troubles the phonomenological and Heideggerian influence on the Continental tradition, have hitherto generally been viewed as mutually exclusive philosophical language games. The purpose of this volume is to bring deconstruction and pragmatism into critical confrontation (...) with one another through staging a debate between Derrida and Rorty, itself based on discussions that took place at the College International de Philosophie in Paris in 1993. The ground for this debate is layed out in introductory papers by Simon Critchley and Ernesto Laclau, and the remainder of the volume records Derrida's and Rorty's responses to each other's work. In this essay, I argue that Søren Kierkegaard’s oeuvre can be seen as a theater of ideas. This argument is developed in three steps. First, I will briefly introduce a theoretical framework for addressing the theatrical dimension of Kierkegaard’s works. This framework is based on a distinction between“performative writing strategies” and “categories of performativity.” As a second step, I will focus on Repetition: A Venture in Experimenting Psychology, by Constantin Constantius, one of the best examples of Kierkegaard’s innovative way of (...) doing philosophy. This strange and elusive book introduces the difficult and counter-intuitive notion of repetition. Repetition is a category of performativity that aims to activate the subjectivity of the reader. This performative effect is achieved by confronting the reader with an “unresolved”existential problem that is not yet drawn into clarity but is staged in all its confusions and contradictions. Kierkegaard’s pseudonym Constantius relies here on a performative writing strategy that is animated by a dialectic of advance and withdrawal. In the last and third step, I will analyze Constantius’s own reflection on the performative dimension of his text. Constantius has left several clues behind, each of which suggests that he deliberately developed a performative writing strategy. (shrink)

One of the challenges confronted by language learners is to master the interpretation of sentences with multiple logical operators, where different interpretations depend on different scope assignments. Five-year-old children have been found to access some readings of potentially ambiguous sentences much less than adults do :73–102, 2006; Musolino, Universal Grammar and the acquisition of semantic knowledge, 1998; Musolino and Lidz, Lang Acquis 11:277–291, 2003, among many others). Recently, Gualmini et al. have shown that, by careful contextual manipulation, it is possible (...) to evoke some of the putatively unavailable interpretations from young children. Their proposal is quite general, but the focus of their work was on sentences involving nominal quantifiers and negation. The present paper extends this investigation to sentences with modal expressions. The results of our two experimental studies reveal that, in potentially ambiguous sentences with modal expressions, the kinds of contextual manipulations introduced by Gualmini and colleagues do not suffice to explain children’s initial scope interpretations. In response to the recalcitrant data, we propose a new three-stage model of the acquisition of scope relations. Most importantly, at the initial stage, child grammars make available only one interpretation of negative sentences with modal expressions. We call this the Unique Scope Assignment stage. (shrink)

This essay stages a dialectical confrontation between Adorno–Horkheimer on one hand and Benjamin–Badiou on the other against the background of the former's reductive portrait of Ulysses in Dialectic of the Enlightenment, which depicts him as a proto-bourgeois archetype of profit-seeking and acquisitive ethos. In sharp contrast, Walter Benjamin's allegorical materialism foregrounds, by dialectical illumination, hieroglyphic traces of Homeric virtues. These, I argue, are sustained and further amplified by Alain Badiou's topological ethics and loop-politics.
