This paper is an exploration of the nature of what is perhaps the most widely recognized justification for inflicting harm on human beings: the appeal to defense (self-defense and other-defense). I develop and defend a rights-based account of the appeal to defense that takes into account whether and to what degree both the aggressor and his potential victim are morally responsible for the relevant threat. However, unlike most extant rights-based accounts, mine is not a forfeiture account. That is, I do (...)

  7. A new look at the problem of rule-following: a generic perspective.Kai-Yuan Cheng - 2011 - Philosophical Studies 155 (1):1 - 21.
The purpose of this paper is to look at the problem of rule-following—notably discussed by Kripke (Wittgenstein on rules and private language, 1982) and Wittgenstein (Philosophical investigations, 1953)—from the perspective of the study of generics. Generics are sentences that express generalizations that tolerate exceptions. I first suggest that meaning ascriptions be viewed as habitual sentences, which are a sub-set of generics. I then seek a proper semantic analysis for habitually construed meaning sentences. The quantificational approach is rejected, due to its (...)

The Regional Comprehensive Economic Partnership Agreement has come into force and China is one of its members. Furthermore, China is applying to join the Comprehensive and Progressive Agreement for Trans-Pacific Partnership. This study uses the Global Trade Analysis Project model to measure the impact of the RCEP and CPTPP on Gross Domestic Production, import, export, terms of trade, and social welfare of major economies under various scenarios, as well (...)

Beyond Reasonableness: The Dignitarian Structure of Human and Constitutional Rights.Kai Möller - 2021 - Canadian Journal of Law and Jurisprudence 34 (2):341-364.
The last two decades have witnessed a wide-ranging and global discussion of the theory and structure of human and constitutional rights. This debate initially focused on the principle of proportionality and subsequently on the related ideas of the ‘culture of justification’ and the ‘right to justification.’ There is now a far-reaching agreement that both proportionality and justification in human and constitutional rights law are concerned with the reasonableness, alternatively the justification in terms of public reason, of the act under consideration. Epistemic solidarity as a political strategy.Robert E. Goodin & Kai Spiekermann - 2015 - Episteme 12 (4):439-457.
Solidarity is supposed to facilitate collective action. We argue that it can also help overcome false consciousness. Groups practice if they pool information about what is in their true interest and how to vote accordingly. The more numerous can in this way overcome the but only if they are minimally confident with whom they share the same interests and only if they are better-than-random in voting for the alternative that promotes their interests. Being more cohesive and more competent than the (...)

In search of the right fusion recipe: the role of legitimacy in building a social enterprise model.Yung-Kai Yang & Shu-Ling Wu - 2016 - Business Ethics: A European Review 25 (3):327-343.
Social enterprises, as typical hybrid organisations, are embedded in a plural institutional environment in which some stakeholders regard achieving social goals as fundamental, while others see economic profit as the priority. A great challenge for social enterprises is dealing with the conflicts resulting from the diverse expectations of stakeholders. Based on the existing works on organisational legitimacy and the social business model, we propose a legitimacy-based social enterprise model composed of three main phases, namely, legitimacy proposition, legitimacy strategy planning, and (...)

    On Taking Historical Materialism Seriously.Kai Nielsen - 1983 - Dialogue 22 (2):319-338.
In the first chapter of Karl Marx's Theory of History, G. A. Cohen contrasts Marx's image of history with Hegel's, contrasts, that is, a powerful form of historical idealism with historical materialism. Historical idealism stresses the “dominion of thought” ; social change, on such an account, is to be explained principally in terms of changes in consciousness, the course of history being determined by fundamental ruling ideas and conceptions. This view is to be contrasted with historical materialism. The central vision (...)

This book deals with the thorny issue of human rights in different cultures and religions, especially in the light of bioethical issues. In this book, experts from Christianity, Judaism, Islam, Buddhism, Daoism, Hinduism and Confucianism discuss the tension between their religious traditions and the claim of universality of human rights. The East-West contrast is particularly evident with regards to human rights. Some writers find the human rights language too individualistic and it is foreign to major religions where the self does (...)

The Influence of Chinese Machiavellianism and Moral Identity on the Level of Anxiety in Moral Dilemma Situations in Chinese Students.Shujun Tang & Kai Li - 2021 - Frontiers in Psychology 12.
Based on the conflict-of-values theory, this study examines the influences of Machiavellianism and ethical values on anxiety in college students when they face moral dilemmas. Questionnaires on the Chinese equivalent of Machiavellianism, moral identity, and anxiety were completed by 115 Chinese college students. The results suggest that Machiavellianism and ethical values influence anxiety, and the interaction between ethical values and Machiavellianism is significant—among individuals with high ethical values, those with high levels of Machiavellianism exhibit markedly higher levels of anxiety than (...)

Offering a collection of fifteen essays that deal with issues at the intersection of phenomenology, logic, and the philosophy of mathematics, this 2005 book is divided into three parts. Part I contains a general essay on Husserl's conception of science and logic, an essay of mathematics and transcendental phenomenology, and an essay on phenomenology and modern pure geometry. Part II is focused on Kurt Godel's interest in phenomenology. It explores Godel's ideas and also some work of Quine, Penelope Maddy and (...)

There are nationalisms and nationalisms, and as nationalisms vary from barbarous and murderous to benign and, all things considered, perhaps desirable, so theories of nationalism vary from irrational or turgid metaphysical accounts to reasonable and carefully articulated and argued theories of nationalism. André Van de Putte has well described some of the former while David Miller, Yael Tamir, Geneviève Nootens, Ross Poole, and Robert X. Ware have carefully argued for some modest forms of nationalism, sometimes explicitly and sometimes only by (...)

Child versus adult analogy: The role of systematicity and abstraction in analogy models.Angela Schwering & Kai-Uwe Kühnberger - 2008 - Behavioral and Brain Sciences 31 (4):395-396.
The target article develops a computational connectionist model for analogy-making from a developmental perspective and evaluates this model using simple analogies. Our commentary critically reviews the advantages and limits of this approach, in particular with respect to its expressive power, its capability to generalize across analogous structure and analyze systematicity in analogies.

Most of the essays collected here are essaysinmetaethics seeking in exacting and interesting ways to resolve problems raised by the familiar options in metaethics we outlined in our Introduction. Richard Brandt, for example, forcefully argues, going much against the at least modestly holistic grain of our time, for a foundationalism (noncognitivist though it be) which would be foundational in both metaethics and normative ethics. R.M. Hare makes a brief but systematic defense, which is both spirited and clear, of his prescriptivism (...)

    Pragmatism as Atheoreticism: Richard Rorty.Kai Nielsen - 2005 - Contemporary Pragmatism 2 (1):1-33.
This essay offers an account of Rorty's version of pragmatism after the so-called linguistic turn, including his attack on epistemology and metaphysics, his metaphilosophy, his theory of morality, and his political philosophy. Woven into this account of Rorty are some of the most important criticisms made of Rorty, and considerations about how Rorty has responded or could have responded.

The concepts of social transformation, reform, and revolution are characterized. A typology of revolutions is given and revolutions of the appropriate type are compared with reforms. It is argued that reform and revolution are on a continuum and that there are social transformations that with equal propriety could be called ?a cluster of radical reforms? or ?a revolution?. What is sensibly at issue concerning the choice between reform or revolution is whether in bourgeois democracies it is more reasonable to adopt (...)
