This is a completely revised and updated second edition of Rights Before Courts (2005, paper edition 2008). This book carefully examines the most recent wave of the emergence and case law of activist constitutional courts: those that were set up after the fall of communism in Central and Eastern Europe. In contrast to most other analysts and scholars, the study does not take for granted that they are a "force for good" but rather subjects them to critical scrutiny against a (...) background of wide-ranging comparative and theoretical analysis of constitutional judicial review in the modern world. Law and Evil presents an alternative evolutionary picture of man, focusing on the origins and nature of human evil, and demonstrating its useful application in legal-philosophical analyses. Using this representation of human nature, Wojciech Załuski analyses the development of law, which he interprets as moving from evolutionary ethics to genuine ethics, as well as arguing in favour of metaethical realism and ius naturale.

Kazimierz Twardowski attributed high cognitive value to introspection because he believed it plays a fundamental role in psychology, the primary philosophical discipline. He believed that basing philosophy on inner experience would allow it to obtain universal and justified results. Internal experience consists of perceiving one’s own mental facts; it is non-sensual and selfevident. Twardowski referred to introspection in his investigations in various ways, which is presented in the article.

Głównym celem książki jest rekonstrukcja teorii retorycznej, wyłożonej przez Bartłomieja Keckermanna (1572–1609), profesora filozofii w Gdańskim Gimnazjum Akademickim, w obszernym traktacie pod tytułem System retoryki (Systema rhetoricae, Hanau 1608). Opierając się na przejrzystej metodzie, u której podstaw leżała zasada podziału dychotomicznego, wywiedziona wprost z pism logicznych Arystotelesa (Organonu), Keckermann przeprowadził systematyzację sztuki przemawiania. Dzięki twórczemu wykorzystaniu koncepcji Stagiryty, Cycerona i Kwintyliana, a także współczesnych sobie teoretyków wymowy, głównie Rudolfa Agricoli, Erazma z Rotterdamu, Filipa Melanchtona i Piotra Ramusa, stworzył on summę (...) renesansowej wiedzy o retoryce. Retoryka ujmowana paradoksalnie (oksymoronicznie) jako antystrofa dialektyki, ukazująca się nam w figuratywnym przebraniu wiernej służebnicy albo nieodłącznej, choć często niepożądanej, towarzyszki logiki (filozofii), została skrojona na miarę ludzkich zdolności i słabości. Jako względnie autonomiczna forma racjonalności (a więc zgodnie z intencją Arystotelesa) i model dyskursywności zbudowany wokół amplifikacji i figuratywności (czyli zgodnie z koncepcją Keckermanna) stanowi apologię niemal powszechnej niekonkluzywności dyskursu, sprzeciwu wobec supremacji intelektu w dziedzinie praktyk sensotwórczych i zgody na brak ostatecznego wyjaśnienia. Mimo tego ma być ona lekarstwem uśmierzającym chroniczną niepewność poznania i środkiem przynoszącym wytchnienie podczas gorączkowego poszukiwania sensu. Dlatego w zależności od potrzeb chwili i celu perswazji retoryka staje się lekarką serc i dusz ludzkich, twórczynią zmysłowych i wielobarwnych obrazów rzeczywistości, a także rewelatorką prawd doskonale już znanych. Za każdym razem zjawia się przed nami pod postacią figury przekształcającej prostą mowę litery w wieloznaczną sekwencję znaków, symboli i obrazów. Przemawiając we własnym imieniu na gruncie teorii wymowy (nawet tej najbardziej metodycznej i usystematyzowanej), retoryka nie może mówić inaczej, jak tylko retorycznie, ożywiając zastygłe w dyskursie toposy i budząc uśpione w języku figury. Game theory is a branch of mathematics that studies strategic interactions, i.e., interactions which involve more than one agent and in which each agent makes her/his decision while striving to predict the decisions of other agents. Game theory has been successfully applied in many areas of both the natural and social sciences, and it is the belief of this book's author that it can also be gainfully invoked in the area of legal philosophy. In this book, Wojciech Zaluski analyzes (...) legal-philosophical concepts - such as legal interpretation, justice, legal rights, contract law, tort law, and property law - through the lens of game theory. The book appeals mainly to game theory's conceptual rather than the technical side, and intertwines game-theoretical analysis with the philosophical. Self-esteem and emotional reactivity may be important personality determinants of human functioning in situations of social exposure. In this study, we compared the levels of these personality variables in a group of professional theater actors and a group of professional illusionists with a control group of participants who were neither actors nor illusionists and had no artistic education. We also examined the correlations between emotional reactivity and self-esteem in the three groups. For emotional reactivity, we found (1) very strong evidence (...) that the level is less for magicians than for controls, (2) substantial evidence that the level is less for magicians than for actors, (3) anecdotal evidence that the level is less for actors than for controls, and (4) decisive evidence that the average score is less for males than for females. For self-esteem, we found (1) anecdotal evidence that the level is higher for magicians than for controls, (2) substantial evidence that there is no difference between actors and magicians, (3) anecdotal evidence against a difference between actors and controls, and (4) anecdotal evidence against a difference between males and females. Based on the entire sample we found a moderate correlation between self-esteem and emotional reactivity (r = -.30, p < 0.001). Our results are compatible with the notion that emotional reactivity – as part of the temperament concept – is a factor influencing the choice of an artistic profession. (shrink)

Artykuł prezentuje sposoby pozyskiwania klienta i działania na rzecz jego utrzymania przy pomocy nowych technologii i nowych mediów. Wykazano, iż zarządzanie relacjami z klientem jest pojęciem obszernym ze względu na różnorodność sytuacji, w których kontaktuje się on z przedsiębiorstwem. Zaprezentowano, iż zmiany technologiczne, a zwłaszcza dokonujące się w dynamicznym tempie umasowienie Internetu, przeobrażają oblicza firm i standardy obsługi klienta w stopniu niespotykanym we wcześniejszych pokoleniach. Przedstawiono również, że utrzymanie klienta jest ważniejsze niż pozyskanie nowego – zgodnie z zasadą V. Pareto. (...) Artykuł składa się z czterech rozdziałów. Pierwszy z nich opisuje rozwój metod komunikacji z klientem, które otworzyły się przed przedsiębiorstwami w związku z rozwojem Internetu. Drugi stanowi przegląd metod działań marketingowych polepszających statystyki pozyskiwania i utrzymywania klientów. W trzecim rozdziale opisano strategię zarządzania relacjami z klientami oraz scharakteryzowano typową budowę systemu informatycznego, wspomagającego realizację tejże strategii. Czwarty rozdział stanowi próbę uzasadnienia celowości nakładów ponoszonych na utrzymanie klientów. (shrink)

Die Aussprüche des Konfuzius sind einer der zentralen Texte der chinesischen Kultur. Dennoch ist die Geschichte ihrer Entstehung und Überlieferung weitgehend unerforscht und der heute gelesene Text samt seinem Verständnis kritiklos von der chinesischen Tradition übernommen worden. Dieses Buch unternimmt es, diese Versäumnisse nachzuholen: Durch die Analyse der Aussprüche und anderer früher Texte entsteht ein differenziertes Bild ihrer Entstehung aus mündlich überlieferten Sprüchen und Anekdoten über ein sich schnell verfestigendes Textkorpus bis hin zum Buch im heutigen Sinne. Anhand historischer Quellen (...) und der heute noch in grosser Zahl und Vielfalt greifbaren Textzeugnisse zeichnet der Autor die zahlreichen Wege nach, welche die Aussprüche in ihren verschiedenen Versionen zu uns genommen haben. Darüber hinaus beleuchtet er die geistesgeschichtlichen, politischen und kulturellen Zusammenhänge, welche die Gestalt und das Verständnis des Textes beeinflussten. Zuletzt zeichnet die Arbeit ein Bild von den Entstellungen, denen der Text und sein Verständnis im Laufe der Geschichte unterworfen waren und zeigt den Weg auf, diese zu überwinden und zu einer kritischen und streng wissenschaftlichen Lektüre zu gelangen. Was dabei an den Aussprüchen sichtbar wird, ist auch beispielhaft für die Problematik anderer konfuzianischer Klassiker und der altchinesischen Literatur überhaupt. (shrink)

Przemiany społeczno-ekonomiczne, kryzysy polityczne, zmiany w kulturze, nauce i technice mogą postawić prawnika oraz „zwykłego” obywatela nie tylko przed koniecznością odpowiedzi na pytanie, „co jest zgodne z konstytucją?”, ale również przed kwestią, „czym jest sama konstytucja?”.Prezentowana monografia poświęcona jest dwóm teoriom konstytucji, których analiza pozwala uwydatnić dwa aspekty jej pojęcia. Konstytucja bowiem z jednej strony stanowi tzw. prawo wyższe, a z drugiej realizuje określoną ideę polityczną. Rozważania zawarte w niniejszej książce rozpoczynają od analizy odpowiedzi Immanuela Kanta na pytanie, w jaki (...) sposób w pojęciu konstytucji łączą się kwestie jej prawnej ważności oraz normatywnej słuszności. Następnie autor przechodzi do zbadania dwóch teorii, które wyrastają z Kantowskiej filozofii: czystej teorii prawa Hansa Kelsena i liberalizmu politycznego Johna Rawlsa. Pierwsza jest nastawiona na deskrypcję norm pozytywnych. Druga formułuje idee o charakterze normatywnym. Pierwsza chce opisywać, druga wyznaczać ustrojowe maximum, do którego powinniśmy zmierzać. W obydwu teoriach konstytucja zajmuje szczególne miejsce. Zawarta w niniejszej monografii ich interpretacja podporządkowana jest zagadnieniu istoty demokratycznej konstytucji, która w formie prawa wyższego wyraża demokratyczną treść.Na ich podstawie następuje próba odpowiedzi na pytanie o naturę demokratycznej konstytucji. We propose a non-standard interpretation of Alternating-time Temporal Logic with imperfect information, for which no commonly accepted semantics has been proposed yet. Rather than changing the semantic structures, we generalize the usual interpretation of formulae in single states to sets of states. We also propose a new epistemic operator for ?practical? or ?constructive? knowledge, and we show that the new logic (which we call Constructive Strategic Logic) is strictly more expressive than most existing solutions, while it retains the same model (...) checking complexity. Finally, we study properties of constructive knowledge and other operators in this non-standard semantics. (shrink)

Expression of physical motion (e.g., man runs by) shows systematic variability not only between language types (i.e., inter-typological) but also within a language type (i.e., intra-typological). In this study, we asked whether the patterns of variability extend to metaphorical motion events (e.g., time runs by). Our analysis of randomly selected 450 physical motion (150/language) and 450 metaphorical motion (150/language) event descriptions from written texts originally produced by German, Polish, and Spanish authors showed strong inter-typological differences in the expression of both (...) event types. German and Polish speakers differed from Spanish speakers in how they packaged manner and path components of a motion event; they also differed in how extensively they expressed each component in their lexicalization of motion. The strong inter-typological differences were accompanied by more modest intra-typological variability: Polish and German writers differed in their packaging and lexicalization of manner and path components of metaphorical—but not physical—motion events. Our results provide evidence for robust inter-typological differences evident in the expression of both physical and metaphorical motion, along with less robust intra-typological differences, largely evident in the expression of metaphorical motion. Our study thus highlights event type as an important factor in determining crosslinguistic variation in motion expression. (shrink)

Prehistory, with the assistance of physical anthropology, palaeogenetics and environmental sciences, aims to explain the processes through which continents were peopled.

There is no direct, constant relationship between the anthropological and cultural aspects of modernity. Anthropologically modern peoples display a certain heterogeneity that is not unconnected with earlier peoples, and the culture produced by modern humans, which is also heterogeneous, is differentiated diachronically and according to territory. Though paleogenetic research seems to point us to a single, African source for modern peoples, who had replaced the pre-sapiens populations in Eurasia, this view is not completely proven or accepted. On the other hand, (...) paleo-genetic research has contributed to our relinquishing the hypothesis of a multiregional ‘total continuity’ of local pre-modern populations in the Old World. Indeed the theory of a partial replacement, by a migration ‘out of Africa’, appears to be getting increasingly plausible. This article deals with the problems of the origins of modern man from the points of view of anthropological, paleogenetic, paleoenvironmental and cultural approaches. (shrink)

Traditional martial arts continue to be interesting and inspiring to many people around the globe. Some of their contemporary adaptations attract enthusiasts for whom they are especially important. In this article, the author bases his observations on his own long-term participation. The analysis takes into account the influence of the perspectives of Jigoro Kano and several other creators of modern varieties of Japanese budo. It can be concluded that regular, even daily, practice—cultivating martial arts and internalizing its values—co-creates the lifestyle (...) of instructors and advanced students. (shrink)

With the meaning of trust, good faith and respect for promises made, protection, or assistance, fides in the non-exclusively religious sense of the word comes from the demand for ethical perfection: as such, it is omnipresent in human relations and in the dynamic of societies in the Middle Ages.

Early twelfth-century logicians invoked past-tensed statements with future-oriented contents to undermine the assumption that every proposition ‘about the past’ is determinate. In the second half of the century, the notion of future-dependence was used to restrict the scope of necessity per accidens. At some point, this idea began to be applied in theology to solve puzzles surrounding predestination, prescience, prophecy, and faith. In the mid-1160s, Magister Udo quotes some thinkers who insisted that the principle of the necessity of the past (...) should exclude dicta that ‘relate to the future’, such as that he has been predestined. Peter of Poitiers adopted this ‘Ockhamist’ strategy around 1170. We find similar accounts in Simon of Tournai and Alan of Lille, who invoked it in other contexts as well. By the time of Praepositinus of Cremona, Hubert of Pirovano, and Stephen Langton, the restricted principle became something of a common view at Paris. (shrink)

SummaryThe Bohr‐Einstein debate on the interpretation of quantum mechanics may be viewed as a discussion on the epistemological status of knowledge gained by physics. It is shown that in fact the advent of quantum theory has led, in a new context, to an old philosophical controversy between epistemological realism and phenomenalism . An inquiry into this controversy, taking into account the contemporary understanding of quantum mechanics based on the axiomatic study of its foundations, leads to the conclusion that contrary to (...) widespread opinion, it is perfectly possible to formulate quantum mechanics in an entirely realistic manner according to the postulate of Einstein. We demonstrate that Bohr's episteme‐logy, in which the role of experimental arrangements in the physical description is taken as a starting point, does not necessarily imply phenomenlism, but may be justifiably considered as a complementary standpoint to the realistic epistemology of Einstein, which is based on the notion of a mental construction which pictures reality. The article is dedicated to the problems of European political identity and European identity as a whole conception and as a foundation for European integration. Before 24 February 2022, European political identity had been in crisis. The contradictions between the EU member states seemed to be hardly resolvable. The Russian aggression against Ukraine gave a strong impetus to the formation of European identity. However, it is still a negative incentive for unity and solidarity rather than cohesion around positive values, as (...) well as from the outset the European integration was caused by devastating World War II as a negative experience, which should never be repeated. The text makes use of methods peculiar to the philosophical sciences, i.e. critical textual analysis, historical-analytical and comparative methods. (shrink)
