This paper looks at the themes of nature, humanity, and military and industrial development in the nineteenth century American painter Winslow Homer through the lens of the Hegelian theory of art. Robert Pippin's After the Beautiful has recently put the Hegelian framework to very fruitful use in understanding pictorial modernism. This study of Homer follows a similar approach but argues that Homer's canvases represent a development in the modern spirt which, in many ways, goes beyond the canvases of Manet – (...) a very tight modernist contemporary of Homer's. Homer communicates a presentment of the immense and, in certain profound respects, horrifying power of humanity's growing industrialization. I trace the development of this idea over the course of his career, from this early Civil War canvases to his final seascapes and argue that an understanding of Homer's work is important for understanding the modern spirit of the nineteenth and twentieth centuries. Norms provide a valuable mechanism for establishing coherent cooperative behaviour in decentralised systems in which there is no central authority. One of the most influential formulations of norm emergence was proposed by Axelrod :1095–1111, 1986). This paper provides an empirical analysis of aspects of Axelrod’s approach, by exploring some of the key assumptions made in previous evaluations of the model. We explore the dynamics of norm emergence and the occurrence of norm collapse when applying the model over extended durations. It (...) is this phenomenon of norm collapse that can motivate the emergence of a central authority to enforce laws and so preserve the norms, rather than relying on individuals to punish defection. Our findings identify characteristics that significantly influence norm establishment using Axelrod’s formulation, but are likely to be of importance for norm establishment more generally. Moreover, Axelrod’s model suffers from significant limitations in assuming that private strategies of individuals are available to others, and that agents are omniscient in being aware of all norm violations and punishments. Because this is an unreasonable expectation, the approach does not lend itself to modelling real-world systems such as online networks or electronic markets. In response, the paper proposes alternatives to Axelrod’s model, by replacing the evolutionary approach, enabling agents to learn, and by restricting the metapunishment of agents to cases where the original defection is observed, in order to be able to apply the model to real-world domains. This work can also help explain the formation of a “social contract” to legitimate enforcement by a central authority. (shrink)

Abstract: Philosophers interested in Kant's relevance to contemporary debates over the nature of mental content—notably Robert Hanna and Lucy Allais—have argued that Kant ought to be credited with being the original proponent of the existence of ‘nonconceptual content’. However, I think the ‘nonconceptualist’ interpretations that Hanna and Allais give do not show that Kant allowed for nonconceptual content as they construe it. I argue, on the basis of an analysis of certain sections of the A and B editions of the (...) Transcendental Deduction, for a ‘conceptualist’ reading of Kant's Critique of Pure Reason. My contention is that since Kant's notion of empirical intuition makes essential reference to the categories, it must be true for him that no empirical intuition can be given in sensibility independently of the understanding and its categories. The aim of this paper is to bring recent work on metaphysical grounding to bear on the phenomenon of social construction. It is argued that grounding can be used to analyze social construction and that the grounding framework is helpful for articulating various claims and commitments of social constructionists, especially about social identities, e.g., gender and race. The paper also responds to a number of objections that have been leveled against the application of grounding to social construction from Elizabeth Barnes, (...) Mari Mikkola, and Jessica Wilson. The question of whether humans are free to make their own decisions has long been debated and it continues to be a controversial topic today. In _Free Will: The Basics_ readers are provided with a clear and accessible introduction to this central but challenging philosophical problem. The questions which are discussed include: Does free will exist? Or is it illusory? Can we be free even if everything is determined by a chain of causes? This paper concerns the ontological status of ontological categories (e.g., universal, particular, substance, property, relation, kind, object, etc.). I consider E.J. Lowe’s argument for the view that ontological categories do not exist and point out that it has some undesirable consequences for his realist ontology. I go on to argue that the main premise in Lowe’s argument—that ontological categories cannot be categorized—is false and then develop a conception of ontological categories as formal ontological kinds.

Doing so shows a progressive simplification of possibilities for transgression from the pre-Christian world to that of popular sovereignty, i.e., the sovereignty of the crowd, the latter leaving open one avenue for transgression: Sadean victimhood. The article then (...) applies these aspects to the pamphlet in Sade’s Philosophy in the Boudoir, “Frenchmen, Some More Effort If You Wish to Become Republicans,” in relation to a contemporaneous document of popular sovereignty, the preamble to the Constitution of the Year III, titled “Declaration of the Rights and Duties of Man and Citizen.” Attending to the aspects of Sadean victimhood in “Effort” shows that its system’s very impossibility makes it the Declaration’s logical completion. This paper is concerned with the relation between two important metaphysical notions, ‘truthmaking’ and ‘grounding’. I begin by considering various ways in which truthmaking could be explicated in terms of grounding, noting both strengths and weaknesses of these analyses. I go on to articulate a problem for any attempt to analyze truthmaking in terms of a generic and primitive notion of grounding based on differences we find among examples of grounding. Finally, I outline a more complex view of how truthmaking (...) and grounding could relate. On the view explored, truthmaking is a species of grounding differentiated from other species of grounding by the unique form of dependence it involves. (shrink)

The goal of this paper is to make headway on a metaphysics of social construction. In recent work, I’ve argued that social construction should be understood in terms of metaphysical grounding. However, I agree with grounding skeptics like Wilson that bare claims about what grounds what are insufficient for capturing, with fine enough grain, metaphysical dependence structures. To that end, I develop a view on which the social construction of human social kinds is a kind of realization relation. Social kinds, (...) I argue, are multiply realizable kinds. I depart from the Wilson by further arguing that an appeal to grounding is not otiose when it comes to social construction. Social construction, I claim, belongs to the “big-G” Grounding genus, but it is the specific “small-g” relation of realization at work in cases of human kind social construction. (shrink)

I. EITHER-OR? NEITHER! The main features of the Enlightenment were the same everywhere: the autonomy of reason, the solidarity of intellectual culture, ...

There is an increasing need for norms to be embedded in technology as the widespread deployment of applications such as autonomous driving, warfare and big data analysis for crime fighting and counter-terrorism becomes ever closer. Current approaches to norms in multi-agent systems tend either to simply make prohibited actions unavailable, or to provide a set of rules which the agent is obliged to follow, either as part of its design or to avoid sanctions and punishments. In this paper we argue (...) for the position that agents should be equipped with the ability to reason about a system’s norms, by reasoning about the social and moral values that norms are designed to serve; that is, perform the sort of moral reasoning we expect of humans. In particular we highlight the need for such reasoning when circumstances are such that the rules should arguably be broken, so that the reasoning can guide agents in deciding whether to comply with the norms and, if violation is desirable, how best to violate them. One approach to enabling this is to make use of an argumentation scheme based on values and designed for practical reasoning: arguments for and against actions are generated using this scheme and agents choose between actions based on their preferences over these values. Moral reasoning then requires that agents have an acceptable set of values and an acceptable ordering on their values. We first discuss how this approach can be used to think about and justify norms in general, and then discuss how this reasoning can be used to think about when norms should be violated, and the form this violation should take. We illustrate how value based reasoning can be used to decide when and how to violate a norm using a road traffic example. We also briefly consider what makes an ordering on values acceptable, and how such an ordering might be determined. (shrink)

ObjectiveTo examine health and social care professionals’ understanding of the legislation governing research involving adults lacking mental capacity in England and Wales.MethodsA cross-sectional online survey was conducted using a series of vignettes. Participants were asked to select the legally authorised decision-maker in each scenario and provide supporting reasons. Responses were compared with existing legal frameworks and analysed according to their level of concordance.ResultsOne hundred and twenty-seven professionals participated. Levels of discordance between responses and the legal frameworks were high across all (...) five scenarios. Nearly half of the participants provided responses that were discordant in all scenarios. Only two participants provided concordant responses across all five scenarios.DiscussionParticipants demonstrated a lack of knowledge about the legal frameworks, the locus of authority and the legal basis for decision-making. The findings raise concern about the accessibility of research for those who lack capacity, the ability to conduct research involving such groups and the impact on the evidence base for their care.ConclusionThis is the first study to examine health and social care professionals’ knowledge and understanding of the dual legal frameworks in the UK. Health and social care professionals’ understanding and attitudes towards research involving adults with incapacity may warrant further in-depth exploration. The findings from this survey suggest that greater training and education is required. (shrink)

This paper introduces a new approach to the theory of truthmaking. According to this approach, there are multiple forms of truthmaking. Here, I characterize and motivate a specific version of this approach, which I call a ‘Pluralist Theory of Truthmaking.’ It is suggested that truthmaking is a plural, variegated phenomenon wherein different kinds of truths, e.g., positive truths, negative truths, counterfactual truths, etc., are made true in different ways. While the paper only aims to lay the groundwork for a Pluralist (...) Theory of Truthmaking, I show how the theory can be applied to positive and negative truths. The upshot of this application is that truthmaking pluralism allows us to provide negative truths with ‘non-suspicious’ truthmakers. Finally, it is argued that Truthmaker Maximalists would do well to endorse truthmaking pluralism, as it offers a new strategy for upholding Maximalism while diminishing controversial ontological commitments. Identifying plausible truthmakers for negative truths has been a serious and perennial problem for truthmaker theory. I argue here that negative truths are indeed made true but not in the way that positive truths are. I rely on a distinction between “existence-independence” and “variation-independence” drawn by Hoffman and Horvath to characterize the unique form of dependence negative truths exhibit on reality. The notion of variation-independence is then used to motivate a principle of truthmaking for contingent negative truths.

The ethical considerations of insider trading have been widely debated in the academic literature :171–182, 1990). In 2013, the STOCK Act, which was initially passed to mitigate insider trading by government officials, was quickly and unexpectedly amended to allow certain government employees to withhold their financial information. To identify and quantify the potential costs placed on investors by non-corporate insider traders, we use the unusual circumstances surrounding this amendment. For a sample of stocks most held by members of Congress, we (...) find that, relative to control stocks, liquidity significantly worsens and volatility increases during the post-amendment period. Our results highlight the costs that are incurred by investors in the presence of non-corporate insider trading. These findings call for a stronger development of an ethical framework that justifies the restriction of all types of insider trading. (shrink)

A prominent way of explaining how race is socially constructed appeals to social positions and social structures. On this view, the construction of a person’s race is understood in terms of the person occupying a certain social position in a social structure. The aim of this paper is to give a metaphysically perspicuous account of this form of race construction. Analogous to functionalism about mental states, I develop an account of a ‘race structure’ in which various races (Black, White, Asian, (...) etc.) are functionally defined social positions. Individual persons occupy these social positions by ‘playing the role’ characteristic of those positions. The properties by which a person plays a race role, are the realizers for one’s race. I characterize the social construction of a person’s race in terms of a realization relation that satisfies a ‘subset’ condition on the social powers of raced persons. Races, on this view, are functionally defined, multiply realizable social kinds. The final section of the paper outlines some explanatory benefits of the account. (shrink)

This paper defends a new version of truthmaker non-maximalism. The central feature of the view is the notion of a default truth-value. I offer a novel explanation for default truth-values and use it to motivate a general approach to the relation between truth-value and ontology, which I call truth-value-maker theory. According to this view, some propositions are false unless made true, whereas others are true unless made false. A consequence of the theory is that negative existential truths need no truthmakers (...) and that positive existential falsehoods need no falsemakers. (shrink)

By looking at the politics of classification within machine learning systems, this article demonstrates why the automated interpretation of images is an inherently social and political project. We begin by asking what work images do in computer vision systems, and what is meant by the claim that computers can “recognize” an image? Next, we look at the method for introducing images into computer systems and look at how taxonomies order the foundational concepts that will determine how a system interprets the (...) world. Then we turn to the question of labeling: how humans tell computers which words will relate to a given image. What is at stake in the way AI systems use these labels to classify humans, including by race, gender, emotions, ability, sexuality, and personality? Finally, we turn to the purposes that computer vision is meant to serve in our society—the judgments, choices, and consequences of providing computers with these capacities. Methodologically, we call this an archeology of datasets: studying the material layers of training images and labels, cataloguing the principles and values by which taxonomies are constructed, and analyzing how these taxonomies create the parameters of intelligibility for an AI system. By doing this, we can critically engage with the underlying politics and values of a system, and analyze which normative patterns of life are assumed, supported, and reproduced. (shrink)

This essay compares Maurice Merleau-Ponty's notion of the flesh with Judith Butler's concept of primary vulnerability in terms of their helpfulness for developing an intersubjective ontology. It compares the flesh with Butler's more recent concept of primary vulnerability insofar as she sees both as useful for intersubjective ontology. The hiatus of the flesh is that which spans between self and world and opens Merleau-Ponty's thought onto an intersubjective ontology. While Butler's discussion of vulnerability as a primary condition of human existence (...) also makes this concept intersubjective, her understanding of violence as articulated through vulnerability makes this a more helpful concept for intersubjective ontology than the flesh. While many discussions of an intersubjective way of life focus almost exclusively on its positive possibilities, almost to the exclusion of violence altogether, the understanding of violence Butler presents through primary vulnerability helps us to discern whether a violation is benign or malign. In turn, this fuller understanding of violence lets primary vulnerability open onto an ethical imperative of reconciliation, but a reconciliation of what is never whole. (shrink)

It is an undeniable empirical fact that a human fetus is a member of the species homo sapiens from the moment of conception. There is thus an important sense in which it is a human being in itself, and not simply part of a pregnant woman’s body, despite what defenders of abortion on demand might want us to think. It is also reasonable to suppose that all human beings, and thus human fetuses, are persons, with all that entails, but this (...) is a metaphysical presupposition as opposed to an empirical fact, and is thus contentious. It is argued, however, that this should be of little comfort to the defenders of abortion, because the mere fact that human fetuses have an inherent tendency to become persons is sufficient reason to confer a moral status upon them, which renders abortion morally problematic at best. Ásta’s Categories We Live By is a superb addition to the literature on social metaphysics. In it she offers a powerful framework for understanding the creation and maintenance of social categories. In this commentary piece, I want to draw attention to Ásta’s reliance on explanatory individualism – the view that the social world is best explained by the actions and attitudes of individuals. I argue that this reliance makes it difficult for Ásta to explain how many social categories are maintained (...) and why certain categories are reliably available to us and so resistant to change. These explanatory deficiencies could be overcome, I argue, by eschewing explanatory individualism and positing social structures to figure in structural explanations of the maintenance and availability of social categories. This paper discusses the suitability of using systemic thinking for teaching environmental rehabilitation to undergraduate students at Federal Universityof Viçosa. This is a predominantly agricultural sciences-based institution located in southeast Brazil. Student receptivity is discussed given concurrent campus paradigms of positivism, Marxism, and individualistic utilitarianism. Student projects using causal-loop diagrams to model degradation and land reclamation are presented. Eight archetypes common to systemic thinking are explained in reclamation contexts. Limitations of systemic thinking are discussed, including theoretical modeling problems and practical (...) teaching considerations. (shrink)

In this dissertation, I argue that we ought to accept an agent-causal view of free and responsible action. First, I set the stage for this claim by highlighting our intuitions regarding moral responsibility and freedom, and by ruling out competing positions. I support Harry Frankfurt's claim that responsibility does not require the ability to do otherwise. I go beyond this claim, however, to argue that responsibility requires that one be the true originator of one's action, and that this requires a (...) kind of freedom that is incompatible with determinism. To bolster this last claim, I argue against the compatibilist, “guidance control” view of John Martin Fischer and Mark Ravizza. I believe the weaknesses of their interesting and compelling view denote potential problems for any compatibilist position. After arguing for incompatibilism, I argue against non-agent-causal incompatibilist views. Specifically, I argue against Robert Kane's “teleological intelligibility theory.” In the final chapters of my project, I lay out my agent-causal view. I argue that agent-causation is possible and coherent if one accepts a realist view of causes. I appeal to Randolph Clarke's idea that the relation between agent and cause is the same relation as that between event and cause. This serves to alleviate the “mysteriousness” of agent-causation. Having shown that it is possible and coherent, and having ruled out competing views in preceding chapters, I am now in position to claim that agent-causation is the correct view. I also demonstrate that it is a compelling position in its own right because it accords with our most basic understanding of ourselves as agents. (shrink)

Barrett's informed exposition of the syntax of this passage, even though he balks at the need to extract a grammatical subject for the verb deducit in 157 from the relative pronoun qua in the previous line. However his persuasive presentation of what he relies on as evidence in support of his suggested interpretation from the mosaics from Zliten in Tripolitania, which portray scenes in an amphitheatre, (...) may seduce the unwary into an over-ready acquiescence in his proposal to read raeda in 157 for taeda of the manuscript tradition. Juvenal's words were correctly understood by T. Maguire as long ago as 1881, and the solution was restated with clarity in a note by W. V. Clausen recently. (shrink)

What role do fables play in Cartesian method and psychology? By looking at Descartes’ use of fables, James Griffith suggests there is a fabular logic that runs to the heart of Descartes’ philosophy. First focusing on The World and the Discourse on Method, this volume shows that by writing in fable form, Descartes allowed his readers to break from Scholastic methods of philosophizing. With this fable-structure or -logic in mind, the book reexamines the relationship between analysis, synthesis, and inexact (...) sciences; between metaphysics and ethico-political life; and between the imagination, the will, and the passions. Extracorporeal membrane oxygenation (ECMO) is typically viewed as a time-limited intervention—a bridge to recovery or transplant—not a destination therapy. However, some patients with decision-making capacity request continued ECMO support despite a poor prognosis for recovery and lack of viability as a transplant candidate. In response, critical care teams have asked for guidance regarding the ethical permissibility of unilateral withdrawal over the objections of a capacitated patient. In this article, we evaluate several ethical arguments that have been made in favor of (...) withdrawal, including distributive justice, quality of life, patients’ rights, professional integrity, and the Equivalence Thesis. We find that existing justifications for unilateral withdrawal of ECMO support in capacitated patients are problematic, which leads us to conclude that either: (1) additional ethical arguments are necessary to defend this approach or (2) the claim that it is not appropriate to use ECMO as a destination therapy should be questioned. A recent presentist strategy has been to deny that truths about the past need presently existing truthmakers. These presentists do not deny that such truths need grounding; they hold that each truth about the past is true because of how the world was, not how it is. This paper argues that this position faces two problems, one of which can be overcome by adopting a certain view of the property of truth for propositions about the past. The second problem cannot (...) be solved. The upshot is that this form of presentism is not a theory of truthmaking for propositions about the past. Rather, it is a theory about why such truths need no present grounding that is motivated by a novel theory of truth. (shrink)
