Law and ethics or a sense of professional responsibility are not always aligned. A characterization of the disconnect falls into one of two broad categories. At times, the law may not go far enough in achieving an ethical or professional response, at other times the law goes too far and forecloses a response based on ethical principles or professional responsibility. In the instance of the latter, ownership or control rights often conflict with other rights such as access to information, privacy, (...) or a general sense of free speech. Where the law does not go far enough an opportunity arises for gentle intervention through education and awareness-raising. The law can, however, be said to align with principles or responsibility, and while not perfect leads to a more harmonious and desirable response. Along these three characterizations the role of the information intermediary such as a library or school is examined. In addition, the characterization is assessed in three subject areas: copyright, privacy, and free speech. The discussion results in further opportunity for reflection on the purpose and role of law and preferred or professional responses. (shrink)

This article explores recent developments inthe regulation of Internet speech, inparticular, injurious or defamatory speech andthe impact the attempts at regulation arehaving on the `body' in the sense of theindividual person who speaks through the mediumof the Internet and upon those harmed by thatspeech. The article proceeds in threesections. First, a brief history of the legalattempts to regulate defamatory Internet speechin the United States is presented; a shortcomparative discussion of defamation law in theUK and Australia is included. As discussedbelow, this (...) regulation has altered thetraditional legal paradigm of responsibilityand, as a result, creates potential problems forthe future of unrestricted and even anonymousspeech on the Internet. Second, an ethicalassessment is made of the defamatory speechenvironment in order to determine which actorshave moral responsibility for the harm causedby defamatory speech. This moral assessment iscompared to the developing and anticipatedlegal paradigm to identify possible conformityof moral and legal tenants or to recognize theconflict between morality and law in assigningresponsibility to defamatory actors. Thisassessment then concludes with possiblesuggestions for changes in the legal climategoverning the regulation of defamatory speechon the Internet, as well as prediction of theresult should the legal climate continue todevelop on its present course. This is not tosuggest that all law, or even the law ofdefamation, be structured to reflect thesubjectivity of a moral construct, but since itis the authors position that the legalassignment of liability in online settings ismisaligned, this reflection can serve asbeginning reassessment of that assignment. God vs. the Gavel challenges the pervasive assumption that all religious conduct deserves constitutional protection. While religious conduct provides many benefits to society, it is not always benign. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else - and truth be told, religion is capable of great harm. This may not sound like a radical proposition, but it has been under assault since the 1960s. The majority of (...) academics and many religious organizations would construct a fortress around religious conduct that would make it extremely difficult to prosecute child abuse by clergy, medical neglect of children by faith-healers, and other socially unacceptable behaviors. Various philosophical arguments havepreviously been put forward to support the creation andmaintenance of intellectual property systems. However, in an age of information, access toinformation is a critical need and should beguaranteed for every citizen. Any right of controlover the information, adopted as an incentive toencourage creation and distribution of intellectualproperty, should be subservient to an overriding needto ensure access to the information. The principlesunderlying intellectual property regimes (...) in the UnitedStates recognize and embody this. In addition, thephilosophical/ethical dimensions of this debate couldalso be structured to support this attitude as well. Intellectual property is fast becoming digitalproperty. New technologies allow owners to extendtheir control of both legitimate uses and misuses ofthe intellectual property. Recent trends demonstratethat the access principle has not always beenparamount in judicial or legislative applications. Thetrend rather is to allow a proprietarianism factor todominate the analysis. Finally, several principles areforwarded which would assist adjudicators and policymakers in reaffirming the basic purpose of theintellectual property law, which is to benefit thepublic at large. As the National Information Infra- structure develops new avenues for information products and services will open. Creating, identifying and protecting the information market space is a critical component to the success of information product and service developments. As a result, the producers of those products and service seek to protect their proprietary interest in the underlying information. However, these actions have broader consequences: Attempts to extend legal protection to basic facts and other public domain information demonstrate that the public information (...) space is slowly being reduced. Reviewing several information controversies as case studies is fruitful. Not only for assessing current trends in information disputes (warfare) but can form the basis for establishing several predictors useful in determining when future information ownership controversies may develop and result in the loss of public information space. One set of predictors helps define the information controversy and is descriptive. The second set of predictors characterizes the marketplace environment. It provides further nuance to the economic factors that force information owners to seek legal remedy. Identifying instances where both models suggest a change in information rights or ownership is most likely to result in the critical loss of access to public information space. (shrink)

It examines why process philosophy and process theology have had a minimal impact in Roman Catholic circles compared to Protestantism, and investigates avenues of promising engagement between process thought and Roman Catholicism.

The papers read at the Semaine des Intellectuels Catholiques of 1958 are here gathered together in the eleventh volume of what is surely one of the most notable French series to appear since the war. Philosophy, history, science law and politics all provide their quota of savants to contribute to a symposium on nationalism viewed from the Christian standpoint. While the word nation can boast of a centuriesold usage not far removed from the modern meaning, the term nationalism first appears (...) at the end of the eighteenth century. For a century and a half it has been perhaps the greatest driving force in world history, and though many would hold that its race is now run in Europe, it is still only getting into its full stride in Africa and Asia. An ideology so alluring and obstinate certainly deserves the closest attention of contemporary Catholic thinkers. (shrink)

Dr. McCracken’s book is partly historical and partly analytical. It opens with as good a summary of Irish history from the founding of the Gaelic League in 1893 until the general election of 1918 as one could wish for. The resounding victory won by Sinn Féin in 1918 prepared the way for the first and second Dáil, whose membership is here analysed from the standpoints of age, religion, education and occupation with some interesting results. This study examined whether worktime control buffered the impact of worktime demands on work-family interference (WFI), using data from 2,377 workers from various sectors of industry in The Netherlands. We distinguished among three types of worktime demands: time spent on work according to one's contract (contractual hours), the number of hours spent on overtime work (overtime hours), and the number of hours spent on commuting (commuting hours). Regarding worktime control, a distinction was made between having control over days off and (...) vacations (leave control) and having control over starting and finishing times (flextime). These three worktime demands were expected to have separate as well as joint effects on WFI, whereas worktime control should buffer these adverse effects of worktime demands on WFI. Stepwise regression analyses showed that working high numbers of contractual and overtime hours was indeed associated with high WFI. Further, worktime control indeed made a difference in terms of WFI: whereas leave control contributed directly to lower WFI, flextime buffered the adverse effects of long contractual workhours. Our results suggest that very long working days should be prevented, and that worktime control may be a powerful tool to help workers maintaining a good work-family balance. (shrink)

When external groups accuse a business organization of unethical practices, managers of the accused organization usually offer a communicative response to attempt to protect their organization's public image. Even though many researchers readily concur that analysis of these communicative responses is important to our understanding of business and society conflict, few investigations have focused on developing a theoretical framework for analyzing these communicative strategies used by managers. In addition, research in this area has suffered from a lack of empirical investigation. (...) In this paper we address both of these weaknesses in the existing literature. First, we explicate Impression Management Theory as an appropriate framework for studying organizational communicative responses, paying particular attention to the concept of accounts. Second, we critique previous investigations of organizational accounts and discuss the major contributions of our study. Third, we propose a coding system and content analyze the accounts offered by managers from 21 organizations that were recently the targets of consumer boycotts. Finally, we report the results of our empirical investigation and discuss ethical issues related to organizational accounts. (shrink)

There has been a lot of interest over the last fifteen years or so in no-collapse interpretations of quantum mechanics. The Bohm interpretation of quantum mechanics has received several thorough accounts, perhaps most notably by Bohm himself.

Jonathan Vogel has recently argued that counterfactual reliabilism cannot account for higher‐level knowledge that one's belief is true, or not false. His particular argument for this claim is straightforward and valid. Interestingly, there is a parallel argument, based on an alternative but plausible reinterpretation of the main premise in Vogel's argument, which squares CR with higher‐level knowledge both that one's belief is true and that one's belief is not false. I argue that, while Vogel's argument reveals the incompatibility of CR (...) and knowledge of certain higher‐level propositions, it does not establish the general claim that CR is incompatible with knowledge that any of one's beliefs is true, or not false. According to deontic justice theory, individuals often feel principled moral obligations to uphold norms of justice. That is, standards of justice can be valued for their own sake, even apart from serving self-interested goals. While a growing body of evidence in business ethics supports the notion of deontic justice, skepticism remains. This hesitation results, at least in part, from the absence of a coherent framework for explaining how individuals produce and experience deontic justice. To address this need, we argue that (...) a compelling, yet still missing, step is to gain further understanding into the underlying neural and psychological mechanisms of deontic justice. Here, we advance a theoretical model that disentangles three key processes of deontic justice: The use of justice rules to assess events, cognitive empathy, and affective empathy. Together with reviewing neural systems supporting these processes, broader implications of our model for business ethics scholarship are discussed. (shrink)

BackgroundIn Sweden, individuals with visual field loss have their driving license withdrawn. The literature clearly indicates that individuals with VFL are unsafe drivers on a group level. However, many drivers with VFL can be safe on an individual level. The literature also suggests that self-perception, beliefs, and insights of one’s own capabilities are related to driving performance. This study had three aims: To investigate self-perceived driving capability ratings for individuals with VFL; to compare these ratings between groups with different medical (...) conditions associated with VFL ; and to relate the self-perception ratings to actual driving performance in an advanced driving simulator.MethodsParticipants comprised 723 individuals whose driver’s license had been withdrawn because of VFL and 92 normally sighted elderly individuals. All participants completed a background survey, rated difficulties with different traffic situations, rated their strengths and weaknesses as drivers, and rated aspects that were important for causing traffic accidents. Of the VFL group participants, 264 also completed a simulator-based driving test that they knew could lead to renewal of their driving license. VFL participants and normally sighted was at the same age when they completed the simulator driving test.ResultsOverall, individuals with VFL rated their capabilities as high on all instruments and scales used, even higher than the elderly normally sighted control group. The only VFL etiology group that rated lower than other groups was the diabetes group. Safety orientation and internal control orientation values were best at discriminating between VFL participants in terms of self-perception of driving performance. Participants categorized as “high” in terms of safety skills and internal control were more modest in their ratings. Finally, participants who passed the simulated driving test did not differ from those who failed, in any of the self-perception measures.ConclusionSelf-perception ratings among individuals with VFL were higher than those of normally sighted elderly individuals. Self-assessed skills did not predict driving performance. Groups with different VFL etiologies rated similarly. Self-ratings of driving abilities cannot be used to assess actual driving performance. Actual driving tests are necessary to discriminate between safe and unsafe drivers with VFL. (shrink)

In this paper, I describe some of the highlights of Melchior’s checking account and then suggest that its explanatory value could be enhanced with a less analyzed concept of checking. This thought inspires a rearguard defense of sensitivity, by no means aiming to rescue it from all its well-known problems, wherein it is suggested that sensitivity fares better as a necessary condition for knowledge when all the bells and whistles with which it has been adorned over the years are stripped (...) away. Finally, I investigate a recognizably Moorean position involving methods that can be construed as sensitive, such that persons using them can claim to have checked that skeptical hypotheses are false. Logical anti‐exceptionalism is the view that logic is not special, it is continuous with science. This continuity is typically understood in terms of the use of the abductive method in logical theory choice, with logical knowledge resulting from our choice of the theory best accounting for the data. In this paper, we argue for two related claims: (i) that this understanding of the continuity between logic and science faces considerable challenges; and (ii) that such challenges may be avoided by elaborating (...) the continuity of logic with science in terms of the “logic‐as‐models” approach. More specifically, we defend that logical theories should be seen in the lights of the “models‐as‐epistemic‐tools” approach, an approach to the nature of models in empirical science more closely connected with current scientific practice. The result is a version of logical anti‐exceptionalism opening new perspectives for the philosophical understanding of logic. (shrink)

This article focusses on the social and legal implications that blockchain technology brings about, not only due to its ideological framework, but also, and especially, due to the concept of law it inaugurates. Thus, this article claims, that, by interlocking technological and legal structures, blockchain technology initiates a profound displacement of legal symbolics and imaginaries. It shows how blockchain law, by emancipating itself from three essential dimensions of law—language, territory, and the body—implies a profound disruption of how we perceive law (...) and its legitimacy. Starting with an overview of the technological details of blockchain, the paper then addresses its ideological context and traces the underlying ideas, values and functions and their relation with—and impact on—the general perception of law and legal issues. By critically assessing the claim that blockchain will liberate the subject from any heteronymic constraints, this paper analyses to what extent this technology has social and legal implications that reach far beyond its virtual, purely blockchain-related scope of applications—and why this technology should matter to us all. Mediation is a process in which two parties agree to resolve their dispute by negotiating over alternative solutions presented by a mediator. In order to construct such solutions, the mediator brings more information and knowledge, and, if possible, resources to the negotiation table. In order to do so, the mediator faces the challenge of determining which information is relevant to the current problem, given a vast database of knowledge. The contribution of this paper is the automated mediation machinery to resolve (...) this issue. We define the concept of a Mediation Problem and show how it can be described in Game Description Language. Furthermore, we present an algorithm that allows the mediator to efficiently determine which information is relevant to the problem and collect this information from the negotiating agents. We show with several experiments that this algorithm is much more efficient than the naive solution that simply takes all available knowledge into account. (shrink)

It would be good to end the controversy over Locke's ideological orientation. In the most well-known of recent commentaries on Locke's political thought his ideological placement ranges across the spectrum. Ashcraft believes Locke's thought is that of a radical left-wing revolutionary; Macpherson argues that the Second Treatise provided a conservative justification for the class rule of the rising bourgeoisie; and Gough finds that Locke stands mid-way between the two extreme positions in politics, *¾*his position is not, however, exactly mid-way between (...) these two extremes, but inclines somewhat toward the left*¾*. Each of these analyses rests largely on a particular interpretation of Locke's view of the franchise in the Two Treatises of Government (1690), and this kind of ideological analysis is historically problematic. Yet the premise seems plausible: the authoritarian, arbitrary rule of an absolute sovereign is the position of the far right in seventeenth-century England, and egalitarian popular democracy is the position of the far left at this time. Given this structure, Locke does stand between the extremes, but he is inclined towards the right. This is the position argued for in this essay: Locke's seemingly radical arguments were designed to reinforce socially conservative beliefs. Presenting the evidence for Locke's ideological commitment may help illuminate some other unsettled, secondary, points of interpretation. (shrink)

ABSTRACT What happens to the imagination in the process of overturning despair and becoming an authentic (i.e. a Christian) self? Using the mystic concept of Entbildung (i.e. getting cleansed of images) as heuristics, the article re-examines the relation of the imagination and the will in Kierkegaard. Analysing the rarely compared texts Practice in Christianity and the first of the Ethical-Religious Essay, and paying close attention to the semantics of the image, the article argues that grace and imagination cooperate in the (...) process of Entbildung, restoring the self’s receptivity for possibility as an uncontrollable, non-anticipatable divine possibility. It is in this kenotic discipleship that the aspiring followers of Christ may come to resemble Christ, who in the Garden of Gethsemane prayed ‘Father … everything is possible for you. Take this cup from me. Yet not what I will, but what you will’. (shrink)

A new theoretical approach to Aristotelian Logic based on three axioms has been recently introduced. This formalization of the theory allowed for the unification of its uncommunicated traditional branches, thus restoring the theoretical unity of AL. In this brief paper, the applicability of the three AL axioms to Propositional Logic is explored. First, it is shown how the AL axioms can be applied to some simple PL arguments in a straightforward manner. Second, the development of a proof method for PL (...) inspired by the AL axioms is presented. This method mimics the underlying mechanics of the proof method from AL, and offers a complementary alternative to proof methods such as truth trees. (shrink)

We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

The construction of embodied conversational agents - robots as well as avatars - seem to be a new challenge in the field of both cognitive AI and human-computer-interface development. On the one hand, one aims at gaining new insights in the development of cognition and communication by constructing intelligent, physical instantiated artefacts. On the other hand people are driven by the idea, that humanlike mechanical dialog-partners will have a positive effect on human-machine-communication. Despite evidence in college students indicating a hunger for spiritual insight and spirituality’s application in health care, there continues to be guardedness within the academy towards inclusion of curricula that address spirituality. The purpose of this article is to examine the ethical considerations of teaching spirituality in the academy by describing current trends, issues relevant to nursing education and practice, legitimate concerns of the academy, and the importance of an ethical instructional response when teaching about spirituality. Data supporting the interest (...) and desire by students to explore meaning and purpose in the context of spirituality will be presented. Challenges and barriers inherent in teaching this topic will be described, including the affective response, the lack of a universally accepted definition of spirituality, and spirituality’s relationship to religion. Pedagogical strategies consistent with an ethical instructional response will be discussed as the key to eliciting trust within the academy. A model of teaching spirituality and health will be offered to illustrate these possibilities. (shrink)

ArgumentThe administration of mountain expeditions from the ground created special managerial problems. The Harvard College Observatory's Boyden Expeditions of 1887–1890 sent men and materiel to three sites: Pike's Peak, Colorado; Mount Wilson, California; and Chosica, Peru. Their goal was to test sites in order to find a suitable site for a permanent Boyden station to conduct astrophysical work in service of Harvard's preexisting projects. The logistical difficulties of living on the mountainside combined with the organizational difficulties of administrating a station (...) at a distance. The men who lived on the mountain were professionally vulnerable, and often cut off from their home observatory both by the weather conditions at their own altitude and local politics on the ground below them. Only when an unbroken line of communication could be established between the mountain station and the Harvard Observatory could the astronomers on both ends work together to create a successful expedition. In a recent study, Becker and Elliott [Becker, C., & Elliott, M. A. . Flicker induced color and form: Interdependencies and relation to stimulation frequency and phase. Consciousness & Cognition, 15, 175–196] described the appearance of subjective experiences of color and form induced by stimulation with intermittent light. While there have been electroencephalographic studies of similar hallucinatory forms, brain activity accompanying the appearance of hallucinatory colors was never measured. Using a priming procedure where observers were required to indicate (...) the presence of one of eight target colors we compared electrophysiological correlates of hallucinatory color with brain states associated with other visual phenomena. Different target colors were accompanied by different patterns of EEG activation. However, in general, we found that the appearance of hallucinatory colors is preceded by a power decrease in the lower alpha band alongside an increase in gamma band frequencies. We argue that decreasing activity in the lower alpha band acts as a gating mechanism, inducing a switch in perception between different colors. The increasing gamma activation may correlate with the formation of a coherent conscious percept. (shrink)

Modal epistemologies aim to explicate the necessary link between belief and truth that constitutes knowledge. This strain of epistemological theorizing is typically externalist; hence, it does not require that the agent know or understand the nature of the knowledge-constituting link. A central concern of modal epistemology is to articulate conditions on knowing such that no merely lucky true belief counts as knowledge. In the effort to eliminate luck, epistemic principles are often cast modally, requiring that an agent’s belief is true (...) not only in the actual world but also in relevant possible worlds, indicating that the link between truth and belief is more than an actual world lucky coincidence. (Note, then, that this entry is not about the epistemology of modals—statements involving modal operators such as “necessarily,” “possibly,” and the like—but about the use of modal principles in characterizing the nature of knowledge in general. For purposes of disambiguation and in deference to the other topic, perhaps “modalized epistemologies” would be a better term, though it is not typically used here.) Modal epistemologies typically have antiskeptical consequences, but the strengths of the antiskeptical results vary significantly, especially between the two best-known modal principles, sensitivity and safety. ABSTRACTThe role of the image in the third part of Practice in Christianity suggests that Kierkegaard was inspired by Meister Eckhart’s and Johann Tauler’s account of detachment. I argue that Kierkegaard was not only indirectly influenced by Tauler through the works of the Pietistic writers, but also directly inspired by Tauler’s sermons. Particularly striking are similarities to a sermon that was included in the Tauler edition owned by Kierkegaard: the second sermon on the Feast of the Exaltation of the Cross. (...) A comparison of the texts shows how both Tauler and Kierkegaard criticize the mental images their contemporaries hold of Jesus Christ. Both stress the importance of existential kenosis, which they describe as Entbildung of the intellect and the will, and which is an essential part of following Christ in his abasement. Furthermore, they analyze inadequate attempts to imitate Christ in a similar manner. Even though Kierkegaard and Tauler differ with regard to the ontological implications of Entbildung, the ethical implications are the same: one should not retreat from the world, but rather turn to it with a selfless attitude. To let humanoid robots behave socially adequate in a future society, we started to explore laughter as an important para-verbal signal known to influence relationships among humans rather easily. We investigated how the naturalness of various types of laughter in combination with different humanoid robots was judged, first, within a situational context that is suitable for laughter and, second, without describing the situational context. Given the variety of human laughter, do people prefer a certain style for a robot’s laughter? And (...) if yes, how does a robot’s outer appearance affect this preference, if at all? Is this preference independent of the observer’s cultural background? Those participants, who took part in two separate online surveys and were told that the robots would laugh in response to a joke, preferred one type of laughter regardless of the robot type. This result is contrasted by a detailed analysis of two more surveys, which took place during presentations at a Japanese and a German high school, respectively. From the results of these two surveys, interesting intercultural differences in the perceived naturalness of our laughing humanoids can be derived and challenging questions arise that are to be addressed in future research. By reading mainly Heidegger’s “What Is Metaphysics?,” the aim of this paper is to illuminate the ontological revelatory function of the nothing that occurs in anxiety. The two parts of this paper describe the same night of anxiety. While the first part shows this night from the point of view of the movement or sweep of anxiety, the second studies this same night from the point of view of the ontological revelatory role of the nothing and its negative logic of (...) disclosure. It is crucial for my analysis to keep apart two different meanings of the nothing. There is the nothing as being’s totally other (nihil negativum), on the one hand, and the nothing as Being, on the other. While with this second meaning one dwells in the realm of the ontological, it is the first meaning-which is the focus of this paper-that secures our access to it. Resumen Mediante la lectura principalmente del texto “¿Qué es metafísica?” de Heidegger, el objetivo de este artículo es iluminar la función reveladora ontológica de la nada que ocurre en la angustia. Las dos secciones de este artículo describen la misma noche de la angustia. Mientras que la primera sección muestra esta noche desde el punto de vista del movimiento o vaivén de la angustia, la segunda estudia esta misma noche desde el punto de vista del papel revelador ontológico de la nada y su lógica negativa de desvelamiento. Para nuestro análisis es crucial mantener separados dos sentidos distintos del concepto de nada: por un lado, está la nada como lo totalmente otro con respecto al ente (nihil negativum); y por el otro lado, la nada como Ser. Si bien con este segundo significado uno habita en el ámbito de lo ontológico, es el primer significado, el cual es el tema central de este artículo, el que asegura nuestro acceso a él. (shrink)

When philosophers speak of the inconclusiveness of arguments for the existence of God, they often do so as if they were talking about a matter of principle—as if it were in principle impossible to prove God's existence, that every proof was in principle inconclusive. Of course, rebutals of the cosmological, ontological, and teleological arguments are usually designed to show that these types of arguments are in principle inconclusive. But one supposes that religious experience arguments are not all in such difficulties. (...) That is, one supposes, for example, that an encounter with the deity would provide a proof of his existence which is at least as conclusive as proofs for the existence of an ‘external world’. And thus it would be false to maintain in an unqualified way that ‘Reason cannot prove the existence of God’. The most one would be able to say would be that at present , or in terms of the currently available evidence, no one can prove God's existence. Further, whether or not sufficient evidence has ever been available in the past would be seen as an historical question— a matter of contingencies, not logical possibilities. (shrink)

Artificial Intelligence (AI), especially of the machine learning (ML) variety, is used by health care organizations to assist with a number of tasks, including diagnosing patients and optimizing operational workflows. AI products already proliferate the health care market, with usage increasing as the technology matures. Although AI may potentially revolutionize health care, the use of AI in health settings also leads to risks ranging from violating patient privacy to implementing a biased algorithm. This chapter begins with a broad overview of (...) health care AI and how it is currently used. We then adopt a “lifecycle” approach to discussing issues with health care AI. We start by discussing the legal and ethical issues pertaining to how data to build AI are gathered in health care settings, focusing on privacy. Next, we turn to issues in algorithm development, especially algorithmic bias. We then discuss AI deployment to treat patients, focusing on informed consent. Finally, we will discuss existing oversight mechanisms for health AI in the United States: liability and regulation. (shrink)

Jennifer Saul is Waterloo Chair in Social and Political Philosophy of Language at the University of Waterloo. Originally American, she spent twenty-four years at the University of Sheffield in the United Kingdom. Her current focus is manipulative political language, which she explores in Dogwhistles and Figleaves: Linguistics Tricks for Racist and Conspiracist Discourse (forthcoming, Oxford, 2024). She has also written books and articles on feminism, lying and misleading, and implicit bias. She founded the blogs What is it Like to be (...) a Woman in Philosophy and Feminist Philosophers, and was Director of the Society for Women in Philosophy UK 2009–19. Along with Helen Beebee, she published two reports (in 2011 and 2021) on the state of women in philosophy in the UK and drew up good practice guidelines which have been adopted by dozens of departments. The work presents the concept of a structural universal and the criticisms that have been leveled against it. A structural universal is a property had by an individual due to the nature of its proper parts and due to the relations obtaining between those parts. Mellor has argued that there is no reason to accept such universal in addition to the basic universals that compose them. David Lewis has argued –on the other hand– that it has not been satisfactorily explained (...) how universals are composed by other universals. The composition by which a structural universal is given cannot be a set-theoretical construction or a mereological sum. Several proposals to explain the nature of structural universals are discussed. Finally it is argued that a structural universal should be understood as a complexion of higher-order universals.
