This paper examines the use of case studies in ethics education. While not dismissing their value for specific purposes, the paper shows the limits of their use. While agreeing that case studies are narratives, although rather thin stories, the paper argues that the claim that case studies could represent reality is difficult to sustain. Instead, the paper suggests a way of using stories in ethics teaching that could be more real for students, while also giving them a way of thinking (...) about their own professional practices. The paper shows how the method can be used to develop a more critical and reflective practice for students in the health care professions. Some immediate problems with the method are discussed. Habits of Whiteness offers a new way to talk about race and racism by focusing on racial habits and how to change them. According to Terrance MacMullan, the concept of racial whiteness has undermined attempts to create a truly democratic society in the United States. By getting to the core of the racism that lives on in unrecognized habits, MacMullan argues clearly and charitably for white folk to recognize the distance between their color-blind ideals and their actual behavior. Revitalizing (...) the work of W. E. B. Du Bois and John Dewey, MacMullan shows how it is possible to reconstruct racial habits and close the gap between people. This forthright and persuasive analysis of the impulses of whiteness ultimately reorganizes them into something more compatible with our country's increasingly multicultural heritage. (shrink)

The principle of Information Conservation or Determinism is a governing assumption of physical theory. Determinism has counterfactual consequences. It entails that if the present were different, then the future would be different. But determinism is temporally symmetric: it entails that if the present were different, the past would also have to be different. This runs contrary to our commonsense intuition that what has happened in the future depends on the past in a way the past does not depend on the (...) future. To understand how this can be so we observe that while the truth of some counterfactuals is guaranteed by the laws of logic or the laws of nature, some are not. It is among the latter contingent, counterfactuals that we find temporal asymmetry. It is this asymmetry that gives causation a temporal direction. The temporal asymmetry of these counterfactuals is explained by the fact that the dynamical laws of nature are logically irreversible functions from partial states of the world onto other partial states. (Logical reversibility is not to be confused, though it too often is, with time-reversal invariance). Though these irreversible laws are locally indeterministic, they can sum to give a globally deterministic description of the world. This combination of global determinism and local indeterminism gives rise to contingent counterfactual dependence and gives that dependence a direction. That direction is independent of the direction of entropy. The direction of contingent counterfactual dependence is time's arrow. (shrink)

Psychologists and philosophers have written much about gratitude recently. Many of these contributions have endorsed expansionist views of gratitude, counseling agents to feel and express gratitude in many circumstances. I argue that the essential features of the moral norm of gratitude are that a beneficiary acknowledges and appreciates benefits provided by another who is acting from beneficence, and is disposed to provide a comparable benefit to the benefactor if a suitable occasion arises. The best-known philosophical version of expansionist views claims (...) that gratitude is apt even in cases where the “benefactor” not only did not intend to benefit the other, but intended to harm her. In the psychological literature, expansionists typically do distinguish between being grateful to and being grateful that. But they also write as if there is one general character trait of gratefulness. In this paper I argue that the philosophical position considered is mistaken on conceptual and moral grounds, and that the dominant view among psychologists fails to recognize the difference between two different traits of gratitude, one a moral virtue and the other a prudential virtue. Thomas Carson offers the most comprehensive and up-to-date investigation of moral and conceptual questions about lying and deception. Part I addresses conceptual questions and offers definitions of lying, deception, and related concepts such as withholding information, "keeping someone in the dark," and "half truths." Part II deals with questions in ethical theory. Carson argues that standard debates about lying and deception between act-utilitarians and their critics are inconclusive because they rest on appeals to disputed moral intuitions. He defends (...) a version of the golden rule and a theory of moral reasoning. His theory implies that there is a moral presumption against lying and deception that causes harm — a presumption at least as strong as that endorsed by act-utilitarianism. He uses this theory to justify his claims about the issues he addresses in Part III: deception and withholding information in sales, deception in advertising, bluffing in negotiations, the duties of professionals to inform clients, lying and deception by leaders as a pretext for fighting wars, and lying and deception about history, and cases of distorting the historical record by telling half-truths. This book explains what inalienable rights are and how they restrict the behavior of their possessors. McConnell develops compelling arguments to support the inalienability of the right to life, the right of conscience, and a competent person's right not to have medical treatment administered without consent. Yet, surprisingly, he argues that the inalienability of the right to life does not entail that voluntary euthanasia or assisted suicide are wrong. Several methods have been reported for extracting sperm from a man after he dies or enters a persistent vegetative state. Although such sperm retrieval could be performed for nonprocreative purposes, such as research, in this paper I focus on cases involving procreative intent. Since 1980, more than ninety cases have occurred in which family members requested sperm retrieval from patients who died or were irreversibly unconscious, with the intent that a wife, girlfriend, or other woman would be inseminated. Recently, the (...) first report of pregnancy and birth following postmortem sperm retrieval appeared in the media.In these cases, death or PVS typically is caused by anoxic injuries, trauma, or rapidly progressing infections. I then construct a Hegelian version of convertibility and argue that Hegel's system fails for similar reasons to provide a satisfactory account of the problem of evil. Many business ethicists assume that if a type of conduct is illegal, then it is also unethical. This article scrutinizes that assumption, using the rideshare company Uber’s illegal operation in the city of Philadelphia as a case study. I argue that Uber’s unlawful conduct was permissible. I also argue that this position is not an extreme one: it is consistent with a variety of theoretical commitments in the analytic philosophical tradition regarding political obligation. I conclude by showing why business ethicists (...) would have a better rejoinder to the “dominant view” of business ethics associated with Milton Friedman if they dispensed with the assumption that illegal implies unethical. Causation is defined as a relation between facts: C causes E if and only if C and E are nomologically independent facts and C is a necessary part of a nomologically sufficient condition for E. The analysis is applied to problems of overdetermination, preemption, trumping, intransitivity, switching, and double prevention. Preventing and allowing are defined and distinguished from causing. The analysis explains the direction of causation in terms of the logical form of dynamic laws. This paper examines two contexts in ethical theory that some have thought support the claim that attempts, rather than actions, are what are morally required of agents. In each context there is an appeal to the principle that 'ought' implies 'can'. I begin by explaining how I think appeals to this principle typically work. It's well-known that Kant believed that intuition was central to an account of mathematical knowledge. What that role is and how Kant argues for it are, however, still open to debate. There are, broadly speaking, two tendencies in interpreting Kant's account of intuition in mathematics, each emphasizing different aspects of Kant's general doctrine of intuition. On one view, most recently put forward by Michael Friedman, this central role for intuition is a direct result of the limitations of the syllogistic logic (...) available to Kant. On this view, Kant's reasons for introducing intuition are taken to be logical or mathematical, rather than philosophical. The other tendency, which I shall try to develop here, emphasizes an epistemological or phenomenological role for intuition in mathematics arising out of what may loosely be called Kant's ‘antiformalism.’This paper, which focuses specifically on the case of geometry, falls into two parts. This paper has two purposes. One is primarily (but not exclusively) conceptual and the other is normative. The first aim is to say what inalienable rights are. To explain this, inalienable rights are contrasted with the notions of forfeitable rights and absolute rights. A recent novel analysis of inalienable rights by Feinberg is explained and criticized. The first task is concluded by discussing what duties inalienable rights imply. The second aim is to see what moral principles, if any, justify designating (...) some rights as inalienable. The claim of Nozick and others that inalienable rights must be paternalistically grounded is examined and rejected. After a brief critical discussion of the Lockean and Hobbesean accounts of the basis of inalienable rights, it is argued that the harm principle can serve as an adequate ground for categorizing at least the right to life (and perhaps other rights) as inalienable. How should we distinguish between ethical and unethical ways of pursuing profit in a market? The market failures approach (MFA) to business ethics purports to provide an answer to this question. I argue that it fails to do so. The source of this failure is the MFA’s reliance on Pareto efficiency as a core ethical principle. Many ethically “preferred” tactics for seeking profit cannot be justified by appeal to Pareto efficiency. One important reason for this is that Pareto efficiency, as (...) understood by the theory of welfare economics upon which the MFA relies, assumes a static conception of efficiency. This is a problem because many ethically “preferred” tactics can only be justified by appeal to dynamic efficiency considerations. I argue that, instead of Pareto efficiency, we should look to the value of wealth creation to understand the ethical constraints on how market actors may pursue profit. (shrink)

Interpreters are less univocal than one might think in assessing Søren Kierkegaard's attitude toward eudaimonism. Through an analysis of several key texts from across Kierkegaard's authorship, I argue that existing interpretations do not convincingly address the relationship between Kierkegaard's critique of eudaimonism and his mid-nineteenth-century context, which was dominated by post-Kantian idealists. While I am sympathetic to aspects of deontological and aretaic interpretations, a contextual reading shows that his critique centers on what he diagnoses as the enclosure of the modern (...) self. This puts his critique of eudaimonism in the purview of his moral psychology and in continuity with his critique of romanticism. (shrink)

This paper examines political philosophy of Pedro Albizu Campos, a 20th Century political leader and public philosopher from Puerto Rico. It argues that his apparent similarity to other anti-colonial thinkers of his day like José Vasconcelos and José Martí belies a deeper difference. It uses commentaries of his work by scholars such as Carlos Rojas Osorio and Antonio Steven-Arroyo to show that Albizu’s unflinching resistance against imperialism that cost him nearly three decades of freedom and ultimately his life was in (...) his mind not the defiant act of a political rebel but the faithful obedience of a devout Catholic. It argues that Albizu’s radical Catholic nationalism marks him as an eclectic political thinker of the Americas whose work complicates common narratives about the history of political philosophy in Latin America and the geography of anti-colonialism in the Americas. Most importantly, Albizu offers much needed insight into Puerto Rico’s present crisis. (shrink)

If there are rights there is surely a right to self-defense. But self-defense has proved very puzzling to rights theorists. The central puzzle has been called the "paradox of self-defense": If our right not to be harmed gives rise to our right to fight back, what happens to the attacker's right not to be harmed when the defender fights back? If the attacker somehow forfeits his right to self-defense because he is a bad actor, what do we say about innocent (...) threats?
