In this paper we examine the concept of waiting from a phenomenological point of view. In order to do so, we start with a definition from Andreas Göttlich and contextualize it within the theoretical framework provided by Alfred Schutz, Thomas Luckmann and Peter L. Berger. Additionally, we discuss waiting on the basis of our previous research, specifically within the context of a field extract from an earlier life-world analytical ethnography on the parents of pre-adolescent, non-professional soccer players. The field vignette (...) depicts a mother who has problematic possibilities of conflicting preferences due to the apperception of her soccer playing child, who was injured during the match. This negotiation within projects of action will be outlined as a specific facet of waiting. (shrink)

While Specific Informed Consent has been the established standard for obtaining consent for medical research for many years, it does not appear suitable for large-scale biobank and health data research. Thus, alternative forms of consent have been suggested, based on a variety of ethical background assumptions. This article identifies five main ethical perspectives at stake. Even though Tiered Consent, Dynamic Consent and Meta Consent are designed to the demands of the self-determination perspective as well as the perspective of research as (...) a public good, they are still also criticized from both perspectives. In addition, criticisms based on concerns of justice, participation and democratic deliberation, and relational concerns have been levelled at each of the models. As all of these perspectives have valid points to make, the task at hand lies in balancing these ethical perspectives. What constitutes an adequate balancing depends on contextual factors. These factors include digital infrastructure and digital literacy, data safety regulation, good scientific and clinical practice, transparent debates on ethically relevant features of research, social inequalities, anti-discrimination laws and practices, trust in health care institutions and recognition of patient preferences, and consensus on unethical research. We argue that the role of context in determining acceptable models of consent puts the ethical importance of models of consent into perspective. Since altering contextual factors can help to live up to the ethical concerns at stake in debates about models of consent, opting for such a shift of focus comes without ethical loss. (shrink)

In Probabilistic Knowledge Sarah Moss proposes that our credences and subjective probability judgments (SPJs) can constitute knowledge. Mossean probabilistic knowledge is grounded in probabilistic beliefs that are justified, true, and unGettiered. In this paper I aim to address and solve two challenges that arise in the vicinity of the factivity condition for probabilistic knowledge: the factivity challenge and the challenge from probabilistic arguments from ignorance (probabilistic AIs). I argue that while Moss's deflationary solution to the factivity challenge formally works, it (...) leaves us ill-equipped to handle probabilistic AIs. An account of probabilistic knowledge that cannot overcome probabilistic AIs makes knowledge of thoroughly probabilistic contents a rare and unstable phenomenon, at best, or, at worst, impossible. I hold that establishing a metaphysically enriched account of probabilistic truth is therefore mandatory. I go on to develop a truth-conditional approach on probabilistic factivity that is relativistic in its nature and centers on objective chances. I show that while the approach is still compatible with Moss's overall semantics for probabilistic knowledge, it provides us with a simple but forceful answer to probabilistic AIs. (shrink)

The Tongan language has honorific registers, called a ‘language of respect’ (Churchward 1953). These are two limited sets of lexemes used to refer to people of chiefly and kingly rank and thus honour the societal stratification. Anthropological-linguistic research reveals that these honorifics are atapu-motivated linguistic practice. The Polynesian concept oftapu(source of the loanwordtaboo) means that entities with moremana(‘supernatural power’) such as persons of higher rank and their personal belongings are ‘sacred’, and it is ‘forbidden’ to get in physical touch with (...) them. The respectful terminology (hou‘eikiandtu‘i) is restricted to suchtapuentities (signifiers), and its generic character shows that direct verbal contact with the commonkakaisignifier is avoided. Thus, the honorific registers function as a verbal taboo in its emic sense. (shrink)

This paper examines the influence of service learning as a pragmatic skills-based teaching intervention. Conceptually, it builds on literature, legitimizing servicelearning in terms of four educational logics– civic engagement, practical relevance, skill development, and responsibility. We investigate whether service learning can always achieve this broad range of educational objectives, in view of students being increasingly exposed to a logic of ‘educational performance’, which they may perceive to be in conflict with the logics of 'civic engagement' and ‘responsibility’. The theoretical part (...) of this paper reviews the evolution of service learning literature and summarizes insights from experiential learning literature. We also report findings from a controlled field experiment with postgraduate management students. We find that service learning influences students’ self-assessment of management skills and awareness stakeholder needs. Surprisingly, our findings provide no evidence for its influence on attitudes to responsibility. (shrink)

Although convergence in emotion expressions within small groups is well documented, the motives that explain why members converge are rarely explicated. We approach expressive convergence from a conformity perspective and introduce the Emotional Conformity Framework, in which we posit that members match their groupmates’ emotion expressions because they are motivated to gain an accurate understanding of reality (informational conformity motive) or to form and maintain social relationships (normative conformity motive). These motives determine members’ standards for correctness, social responses, and plausible (...) convergence mechanisms, while members’ personalities and situational properties shape the relative strength of the two motives. By explicating these motivational underpinnings, the Framework improves our capacity to understand, predict, and regulate expressive convergence and emphasizes its functionality. (shrink)

Die meisten Annahmen mussten verworfen werden. Vor dem Hintergrund aktueller gesellschaftlicher Entwicklungen wird im vorliegenden Beitrag anhand von Zeitreihendaten dieser Frage erneut nachgegangen. Hinterfragt wird aber auch, ob sich der Einfluss vertikaler sozialstruktureller Merkmale auf die Beteiligung am Sport seit den 1970er Jahren abgeschwächt hat und ob dieser Zusammenhang in den letzten Jahren wieder enger geworden ist. In this review, I discuss Balibar’s ‘proposition of equaliberty’ with regard to its theoretical status and contribution, its relationship to other contemporary theories of radical democracy as well as to the problematic of bourgeois versus communist emancipation in Marx. The primary interest of this essay is to develop a detailed understanding of Balibar’s analytical schema, which draws a complex picture of our contemporary ‘human condition’, and to place it within his own theoretical development since his contribution toReading Capitalin the 60s. Over the last years several European patents were opposed for protecting technology violating the morality requirement under Article 53(a) EPC. Attempts have been made by the Appeal Boards of the European Patent Office (EPO), as well as by amendments introduced into the Implementing Regulations of the European Patent Convention (EPC), to address this sensitive patentability requirement more precisely. In Germany, the Medizininformatik-Initiative (Medical Informatics Initiative) has developed a proposal for broad consent for German hospitals which suggests a validity period of 30 years.Definition of the problemAgainst this background, the article discusses how the claim of consent beinginformedhas to be regarded in a temporal perspective. The practice of consent is here understood (...) to be oriented towards the realization of well-being, personal sovereignty, and trust. In the context of medical research, an asymmetry of access to information between research participants, researchers, and data-storing institutions has to be assumed.Argument and conclusionThe article argues that in order to appropriately address this information asymmetry, a continuous dissemination of comprehensibly prepared information to research participants is necessary to enable personal sovereignty. In diesem Kontext wird ein Modell der breiten Einwilligung (_Broad Consent_) diskutiert. In Deutschland hat die Medizininformatik-Initiative einen konkreten Vorschlag für deutsche Kliniken ausgearbeitet, der eine Gültigkeit der Einwilligung für einen Zeitraum von 30 Jahren vorsieht. Der vorliegende Artikel diskutiert vor diesem Hintergrund die Frage, wie der Anspruch der Informiertheit in dieser zeitlichen Perspektive einzuordnen ist. Die Praxis der Einwilligung wird dabei (...) so verstanden, dass sie auf die Verwirklichung von Wohlergehen, persönlicher Souveränität und Vertrauen ausgerichtet ist. Eine anzunehmende Informationsasymmetrie zwischen Forschungsteilnehmenden, Forschenden, und datenspeichernden Institutionen wird dabei als spezifisches Kontextmerkmal herausgestellt. Um dieser Informationsasymmetrie in angemessener Weise zu begegnen, so die These, ist eine kontinuierliche Weitergabe von verständlich aufbereiteten Informationen an Forschungsteilnehmende notwendig, um die Wahrnehmung persönlicher Souveränität zu ermöglichen. -/- Policy regulations of ethically controversial genetic technologies should, on the one hand, be based on ethical principles. On the other hand, they should be socially acceptable to ensure implementation. In addition, they should align with ethical theory. Yet to date we lack a reliable and valid scale to measure the relevant ethical judgements in laypeople. We target this lacuna. -/- We developed a scale based on ethical principles to elicit lay judgments: the Genetic Technologies Questionnaire (GTQ). In two pilot (...) studies and a pre-registered main study, we validated the scale in a representative sample of the US population. -/- The final version of the scale contains 20 items but remains highly reliable even when reduced to five. It also predicts behaviour; for example, ethical judgments as measured by the GTQ predicted hypothetical donations and grocery shopping. In addition, the GTQ may be of interest to policymakers and ethicists because it reveals coherent and ethically justified judgments in laypeople. For instance, the GTQ indicates that ethical judgments are sensitive to possible benefits and harms (in line with utilitarian ethics), but also to ethical principles such as the value of consent-autonomy. -/- In conclusion, the GTQ can be recommended for research in both experimental psychology and applied ethics, as well as a tool for ethically and empirically informed policymaking. The article discusses the impact different concepts of solidarity can have on debates on models of consent for non-interventional research. It introduces three concepts of solidarity that have been referenced in bioethical debates: a purely descriptive concept, a concept that claims some derivative value for most but not all practices of solidarity, as well as a clearly normative concept where solidarity is tied to justice and taken to ground moral duties. It shows that regarding the rivalling models of study-specific consent, (...) tiered consent and broad consent, the first two concepts can be taken to favour tiered consent while only normative solidarity supports a model of broad consent—or an argument to allow non-interventional research without requiring consent at all. As normative solidarity is tied to considerations of justice, however, the argument appears less straightforward than one might expect: It presupposes that the research contributes to overcoming existing social injustices. The final section of the book considers two features of the world which transcend the categories, existence and negation.

Conceiving legal obligations towards future generations is challenging—especially from a positivist stance and if obligations and claims are understood as being correlative in nature. Legal obligations towards future generations are often rejected from the outset if (and insofar as) there is no explicit acknowledgement or established doctrine. This neglects the power of sound legal interpretation. I argue that obligations towards future people and generations are grounded in the relational character of human rights and that their positivity is not a problem (...) in a legal order containing norm texts that can reasonably be interpreted as acknowledging human rights; no additional enactment is necessary for these obligations to be part of the positive law. This claim is based on a (novel) concept of fundamental rights which is compatible with legal positivism. (shrink)

From a giant of health care policy, an engaging and enlightening account of why American health care is so expensive -- and why it doesn't have to be. Uwe Reinhardt was a towering figure and moral conscience of health care policy in the United States and beyond. Famously bipartisan, he advised presidents and Congress on health reform and originated central features of the Affordable Care Act. In Priced Out, Reinhardt offers an engaging and enlightening account of today's U.S. (...) health care system, explaining why it costs so much more and delivers so much less than the systems of every other advanced country, why this situation is morally indefensible, and how we might improve it. The problem, Reinhardt says, is not one of economics but of social ethics. There is no American political consensus on a fundamental question other countries settled long ago: to what extent should we be our brothers' and sisters' keepers when it comes to health care? Drawing on the best evidence, he guides readers through the chaotic, secretive, and inefficient way America finances health care, and he offers a penetrating ethical analysis of recent reform proposals. At this point, he argues, the United States appears to have three stark choices: the government can make the rich help pay for the health care of the poor, ration care by income, or control costs. Reinhardt proposes an alternative path: that by age 26 all Americans must choose either to join an insurance arrangement with community-rated premiums, or take a chance on being uninsured or relying on a health insurance market that charges premiums based on health status. Ist nicht das bizarre „schwacher“ durch „freier“ zu ersetzen? Kant verbindet mit der Gerichtshofmetapher die gegen die Politik der Machtsprüche des Absolutismus, aber auch gegen die Gesetzlosigkeit des „status naturalis“ gerichtete Freiheit der Richter und Geschworenen, nicht aber deren Schwäche. Erst im Staat unter Freiheitsgesetzen könne ein Gerichtshof eingerichtet werden – „Zu dieser Freiheit gehört denn auch, seine Gedanken, seine Zweifel, die man sich nicht selbst auflösen kann, öffentlich zur Beurteilung auszustellen, ohne darüber für einen unruhigen oder gefährlichen Bürger verschrieen zu werden [„durch keine Drohung geschreckt“] Das liegt schon in dem ursprünglichen Rechte der menschlichen Vernunft, welche keinen anderen Richter erkennt, als selbst wiederum die allgemeine Menschenvernunft, worin ein jeder seine Stimme hat.“ Die Freiheit bezieht sich auf den Bürgerstand der Menschen und ihre Freiheitsgesetze. Wir befinden uns im Bereich einer Rechtsinstitution – was soll da der Appell an die Schwäche? Gibt es einen bürgerlichen Stand der Schwachen? Nein. Das Ergebnis der Gerichtsverhandlung wird sein, dass weder Satz noch Gegensatz gilt oder dass beide gelten könnten. Nun kommt hinzu, dass Kant zuvor den Menschen charakterisiert, der zwischen These und Antithese hin- und herschwankt – ein schwacher Mensch, dem der nachdenkende und forschende Mensch entgegengesetzt wird, der nun entschlossen vor dem Gerichtshof erfahren will, wie es um die Ansprüche der beiden Parteien steht. Auch im nachfolgenden Text wird emphatisch dafür argumentiert, dass der Mensch das Problem der Antinomie und seine Auflösung in seiner eigenen Vernunft findet und daher „die Verantwortung [Beantwortung?] nicht von sich abweisen und auf den unbekannten Gegenstand schieben kann“. Das Thema Migration wird in Politik, Medien und Offentlichkeit, aber auch in der Philosophie kontrovers diskutiert. Die vorliegende Studie geht von der These aus, dass sich Kants Uberlegungen zum Weltburgerrecht in einer produktiven Disharmonie zu gegenwartig vertretenen philosophischen wie politischen "Lagern" in der Migrationsdebatte befinden. Zur Begrundung dieser These wird zunachst die neuere Debatte um Migration anhand dreier Theoriestrange vorgestellt, die diese massgeblich strukturieren: der Kommunitarismus, der egalitaristische Kosmopolitismus und der liberale Nationalismus. Anschliessend werden die fur die Migrationsdebatte entscheidenden Theoriegange (...) in Kants politischer Philosophie erschlossen. Auf dieser Grundlage wird schliesslich die Produktivitat und systematische Relevanz von Kants Theorie fur die Hauptfragen der gegenwartigen Debatte herausgearbeitet und eine rechtsmoralische Migrationstheorie entworfen. Es werden dabei insbesondere die Themengebiete Asyl, (il-)legitime Abweisungsgrunde, Staatenlosigkeit, der Erwerb der Staatsburgerschaft, das Recht auf Auswanderung und individuelle Hilfspflichten sowie die Frage nach der Notwendigkeit einer "weltburgerlichen Gesinnung" diskutiert. Though the relationship between Goethe, Cassirer and Levi-Strauss has been explored extensively, the focus usually lies on questions of genealogy. This article aims for a different course: Building on the notable similarities between Goethe’s discussion of morphology, Levi-Strauss’ structuralistic approach and Cassirer’s philosophy of symbolic forms we will investigate the epistemological similarities between the three authors. They can be found in a specific form of humanism (or anti-humanism) which connects questions on the conditions of the world and its accessibility with (...) the more global question of humankind and its place within the natural world, thus, by virtue of a specific interpretation of the concept of transformation, opening the door for new approaches which have recently been discussed as ontological turn. The history of Western philosophy can be seen as a battle between those that insist that the "physical universe" exists and those would claim that there is a much larger "world" which contains atemporal and nonspatial things as well. The central part of this book, and the battle, concerns the existence of universals. Starting with the mediaeval definition of the issue found in Porphry and Boethius, the author then considers modern and contemporary versions of the battle. (...) In Plato's Meno , there is a famous discussion of desire and evil. This paper is not a contribution to Platonic scholarship, but a direct taking up of the issue whether someone can desire evil. One stock interpretation of the putative impossibility of desiring what is evil or bad is the interpretation which emphasizes an internal or conceptual tie between desire and good. This interpretation compares pairs of terms such as ‘fear—danger’, ‘belief—truth’ and ‘desire—good’. To fear something is to regard (...) it as, or believe that it is, dangerous ; to believe something is to regard it as, or believe it to be, true ; to desire something is to regard it as, to believe it to be, good. Since it is obvious that people believe things which are false, it is maintained that it is equally obvious that people may desire what is bad and fear what is harmless or of no danger. Let us call this interpretation of the doctrine that it is impossible to desire evil the weak thesis. The weak thesis allows what seems a plain fact of human reality, that people believe falsehoods, fear things that cannot harm them and desire things which are not good. Equally obviously, it allows that people fail to believe truths, fail to desire goods, and fail to fear things that are dangerous. On this weak interpretation, the manner in which wickedness to others and self-destructiveness are due to ignorance is that people are ignorant about the nature of things and ways of acting, ignorant about what it would be like to possess something or ignorant about what it would be like to do something or other. Hilary Putnam has recently observed that the fact/value distinction has acquired a strength and pervasiveness in our culture that make it akin to an institution. 1 I take it he meant an institution in the sense that Taboo is an institution in some cultures, not in the sense that the Church is an institution in ours. Invoking the distinction is a widespread conversational gambit in social life, not only in academic discussions. ‘That's a value judgment’ and ‘That's emotive’ are to (...) be heard at dinner parties more often than ‘Pass the salt’. Seit Niccolo Machiavellis Principe (postum) im Jahre 1532 veroffentlicht worden ist, haben sich Generationen von Philosophen, Theologen und Historikern, aber auch von Politikern mit den Thesen des Florentiners auseinandergesetzt. Die Bucher zur Rezeption Machiavellis fullen inzwischen ganze Bibliotheken. Kann man heute - fast funfhundert Jahre spater - noch etwas Neues dazu beitragen? Vielleicht gelingt dies, indem der machiavellische Machtstaat aus interdisziplinarer Perspektive im Spiegel der Zeit beleuchtet wird. Die negative Sicht der Ratschlage Machiavellis an einen neuen Fursten ist mit dem (...) Begriff "Machiavellismus" gebrandmarkt worden. Die Frage, ob der Florentiner selbst ein Machiavellist war, ist heute freilich eher zu verneinen. Die mit dem Schlagwort verbundenen Vorurteile erweisen sich jedoch als resistent gegenuber jedem Gegenargument. Den unterschiedlichen, meist zeitbedingten Interpretationen der Lehre Machiavellis, mit denen der Interpret oft genug nur seine eigenen Anschauungen begrundet, soll in diesem Band nachgespurt werden. The purpose of this essay is to identify the theological comprehension of the Word as Creator in the action of the Trinity, which Thierry of Chartres offers in his Tractatus de sex dierum operibus. In his brief and synthetic explanation, he makes coincide the findings of human reason with biblical notions, such as Figure and splendor, Wisdom, Truth, Word, not as a mere sequence but in their deep and relational meaning. Thierry’s rational method is deductive-mathematical, whereas the philosophical premise is (...) the rerum universitas articulated in levels of necessity and possibility. All this allows creation to be considered as explication of the complicatio—or multiplicity produced by unity— which is typical of the chartrian neoplatonism, with the characteristic seal of Thierry. The recent discovery and structure determination of a novel ubiquitin‐like dimerization domain in protein kinase D (PKD) has significant implications for its activation. PKD is a serine/threonine kinase activated by the lipid second messenger diacylglycerol (DAG). It is an essential and highly conserved protein that is implicated in plasma membrane directed trafficking processes from the trans‐Golgi network. However, many open questions surround its mechanism of activation, its localization, and its role in the biogenesis of cargo transport carriers. In reviewing this (...) field, the focus is primarily on the mechanisms that control the activation of PKD at precise locations in the cell. In light of the new structural findings, the understanding of the mechanisms underlying PKD activation is critically evaluated, with particular emphasis on the role of dimerization in PKD autophosphorylation, and the provenance and recognition of the DAG that activates PKD.
