Siminoff (bio), and Renie Schapiro (bio)This issue of the Kennedy Institute of Ethics Journal (KIEJ) centers on a piece of empirical research. The motivation behind the study of Laura Siminoff, Christopher Burant, and Stuart Youngner (2004) was to find out more about what the general public understands and believes about when a person is dead. More specifically, the study tried to determine (...) how members of the public define death, especially their acceptance and interpretation of the medical concept of "brain death," and their attitudes toward the so-called "dead donor rule," an informal but powerful social and legal norm insisting that the taking of organs for transplantation not cause the death of the source of those organs.As the demand for organs increases and the waiting list grows, the United States has explored multiple ways to expand the pool of potential donors. One approach has been to gerrymander (coherently or not) the line between life and death to shift patients who are extremely compromised but traditionally considered to be in the living category into the dead category. In this way, the dead donor rule remains technically intact. This reasoning is explicit in the report of the Harvard Medical School Ad Hoc Committee (1968) that "introduced" "brain death" to the American culture. Since then, other efforts to redraw the line have been proposed and rejected.One alternative to gerrymandering is to consider under what conditions, if any, it is morally acceptable to violate the dead donor rule. Some would argue that this alternative is the more "honest" approach. Rather than sidestepping moral problems by calling people dead, it brings the moral problems to the surface where the necessity of sticking to the rule can be considered on its own merits. However, when the Journal of the American Medical Association printed a position paper that proposed making anencepahlic newborns an exception to the dead donor rule, along with arguments about why this was acceptable, the outcry was so great that the proposal was retracted (AMA 1995).Clearly, our society has identified organ transplantation as a priority, although two papers in this volume (those by Courtney Campbell and by Megan Crowley-Matoka and Robert Arnold) take issue with that prioritization. The fact that the donor pool has remained relatively stable (and inadequate) despite massive efforts [End Page 211] to increase it speaks, at least in part, to the cultural and legal resistance to "new" ways to procure more organs. Voluntarism seems to have peaked. Financial incentives clash with the heavily endorsed notion of the "gift of life" and seem to many to violate the dignity of the human body. Presumed consent or eminent domain, in which the community has a greater claim to a person's organs than that person or his/her family, go against the grain of American individual freedom and the ethos of patient autonomy.Abandoning the dead donor rule generally is regarded as an even tougher sell to the American public and its legislators. The study by Siminoff and colleagues attempts, among other things, to gauge just how tough this sell would be. What the data actually demonstrate is a matter of interpretation, and this issue of the KIEJ is devoted to some of those interpretations. The authors, with the exception of Daniel Hausman, came together for a meeting in Cleveland, Ohio, during which the study's methods and data were presented with time for questions, clarifications, and general discussion. I argue that Kierkegaard’s Journals and Notebooks deserve to be read as works of philosophy and not just used as supplements to bring order and respectability to Kierkegaard’s other writings. There are at least three specific philosophical values in Kierkegaard’s journals – three ways in which the journals create philosophy within their own pages and therefore deserve to be read as independent works of philosophy and not just as supplements to Kierkegaard’s other writing: (1) The journals demonstrate what a true (...) work of existential philosophy looks like. (2) The journals contribute to Kierkegaard’s theory of indirect communication. (3) The journals create new philosophical concepts. All three of these are best understood as philosophical performances or a kind of philosophical theatre. The idea that philosophy can be a kind of theatre is inspired by the work of Gilles Deleuze and Felix Guattari, particularly their book What is Philosophy? I draw from Deleuze and Guattari especially in section (3) to argue that Kierkegaard’s Journals create new philosophical concepts. (shrink)

Stanford California: Stanford University Press, 2004, 335 pp., $47.50 hardcover.From June to September 2003, Britain's famous art gallery, the Tate Modern, housed dramatically in a gigantic, renovated power station on the south bank of the Thames, held its first major photography exhibition, entitled Cruel and Tender after comments made by a critic to (...) describe the work of Walker Evans. The twenty-three artists in the show, including August Sander, Diane Arbus, Rineke Dijkkstra, William Eggleston, Walker Evans, Philip-Lorca diCorcia, and Thomas Ruff, were mainly Americans and Germans. Bill Brandt, who had a reputation as a documentary photographer, was not included. Writing in the catalogue, Tate director Nicholas Serota notes, "Cruel and Tender examines a form of documentary photography that keeps within the limits of the medium, stressing pure description.... Surrealist and Conceptual photography would fit more naturally into the programs and displays at the Tate, but the elusive and documentary qualities in straight photography challenge the traditions of the institution, by concentrating on a form of photography which explores the intrinsic aspects of the medium." In other words, "straight photography" serves as a kind of unemotional, uncreative narrative of ordinary life, avoiding drama, romanticism, sentimentality, deep coding, and, as far as possible, the expressive contributions of the artist. The relationship of photograph to reality, though problematic, is still interesting, according to the catalogue notes, and this contemporary work aims to inform us, literally, of the true essence, banal or otherwise, of our world. This approach acts implicitly to undermine the fake optimism of consumer capitalism.It will be useful to keep in mind this exhibition in considering the work of Brandt, for in the early 1980s Brandt was being lauded as Britain's greatest photographer, and he was nothing if not expressive. It was his métier to find the unusual in the everyday and to create meaning through careful staging and composition, drawing very much on his own personal outlook, aesthetic philosophy, and psychology. He believed all was permitted in photography, whether in the novel choice of lens, use of friends as models, or darkroom processing to achieve his vision. Rather than being a documentary photographer, at least in the purist sense of the Tate collection, he was more the poet ethnographer with a strong sense of the surreal. His was a vision that would be imposed on the world. After reading Paul Delany's excellent biography, it becomes clear why Brandt, all too soon, had become unfashionable in the eyes of the Tate organizers and contemporary photography at large. He is, nevertheless, an artist who can help us question the nature of reality while producing work that is often very complex and beautiful, and someone whose methods and ideas can serve as [End Page 118] a model of individual creative practice. The global interest in photography, the many significant exhibitions and books produced in the past decade, and the prices paid for photographs have by now lain to rest the old debate about whether photography is a genuine art form. As any serious photographer can attest, producing a photograph that has form, presence, and originality is dauntingly difficult, even though photography seems so easy. Everyone, today, has a camera. Yet, constantly fed with glitzy images from commerce and entertainment that direct our minds along certain well-worn grooves—a challenge for aesthetic education—budding artists require a certain strength of character and imagination to resist the literal and obvious and move toward a more authentic way of seeing. Delany's book shows how someone can defy fashion, as Brandt did for half a century, producing "pictorial" images layered with meaning and mystery. As an aside, despite the intent to show images that simply describe the world, some of the Tate pictures still manage, to my eye at least, to have their own ephemeral expressiveness, and at times great beauty, which raises the question, At what point does a document become a work of art? A new science, the science of complexity, is birthing. This science boldly promises to transform the biological and social sciences in the forthcoming century. My own book, Origins of Order: Self Organization and Selection in Evolution, (Kauffman, 1992), is at most one strand in this transformation. I feel deeply honored that Marjorie Grene undertook organizing a session at the Philosophy of Science meeting discussing Origins, and equally glad that Dick Burian, Bob Richardson and Rob Page have undertaken their reading (...) of the manuscript and careful thoughts. In this article I shall characterize the book, but more importantly, set it in the broader context of the emerging sciences of complexity. Although the book is not yet out of Oxford press’s quiet womb, my own thinking has moved beyond that which I had formulated even a half year ago. John Locke's first letter to Stillingfleet addresses a number of important philosophical topics, including the idea of substance, knowledge without clear and distinct ideas, the existence of spiritual substances, the ontological argument for the existence of God, and the real essences of things. He notes that his Essay does not contain a single argument against the doctrine of the Trinity, and indeed, he says that he wrote the entire book "without any Thought of the controversy between the Trinitarians and Unitarians". One episode in Locke's second letter that nicely illustrates its overall character is a 48‐page discursion in which he recounts conversations that he had with some friends about Stillingfleet's efforts to explain certain key concepts. Locke's second letter focused mainly on Stillingfleet's muddledness, and on the thinness of the pretext for involving Locke in the first place. Youngner (bio)Organ Transplantation requires viable donor organs. This simple fact has become the Achilles' heel of transplantation programs. Progress in immunology and transplant surgery has outstripped the supply of available organs. Between 1988 and 1991, for example, the number of transplant candidates on waiting lists increased by about 55 percent, while the number of (...) donors increased only about 16 percent.1 By the end of March 1993, more than 30,000 potential recipients awaited transplantation (United Network for Organ Sharing Database (UNOS) 1993). Every day six of these patients die prior to receiving a heart or liver transplant, while patients needing kidney transplants must tolerate a lower quality of life on dialysis (Grenvik 1992; Evans, Orians, and Ascher 1992).This scarcity is likely to get worse. As transplantation becomes more successful, it is being offered to sicker and older patients. Attempts to transplant other solid organs, such as small bowel and pancreas, will only fuel the demand for donors. However, the current source of organs is unlikely to grow. Most organs come from patients who have been declared dead by neurologic criteria (commonly referred to as "brain dead" or heart-beating cadaver donors (HBCDs) because their hearts are beating at the time of procurement). Estimates of the potential pool of HBCDs have been revised downward from 20,000-27,000 to roughly 10,000-12,000 (Nathan et al. 1991). Improvements in automobile safety and handgun legislation will likely lead to further reductions. Moreover, the rate of procurement from HBCDs has remained relatively flat despite extensive public awareness campaigns and legislation requiring hospitals to routinely request donation from families of dead patients (Caplan et al. 1992).If organ transplantation is going to continue to flourish, alternative [End Page 103] sources of organs must be found. Recently the University of Pittsburgh Medical Center (UPMC) proposed procuring organs from patients who have been declared dead by traditional cardiopulmonary rather than brain-oriented criteria after they or their families have decided to forgo life-sustaining treatment—hereafter referred to as the Pittsburgh protocol (UPMC Policy 1993). These patients are typically referred to as non-heart-beating cadaver donors (NHBCDs) because their hearts are no longer beating at the time of organ procurement.Although NHBCDs were a major source of transplantable kidneys prior to the institution of death by neurologic criteria, their usefulness was limited by "warm ischemia time." This term refers to the injury to tissues that occurs when the blood supply is interrupted and before the organs are cooled and reperfused. Under the Pittsburgh protocol, therapy is withdrawn in the operating room where a waiting surgical team removes organs immediately after death is declared. By controlling the place and time of death, it has been possible to minimize warm ischemia time and thus solve the technical problems previously associated with procurement from NHBCDs.The potential contribution of NHBCD organs is significant. Nathan (1992), using data from Delaware Valley Transplant Program, concludes that the use of severely brain injured, but not "brain dead" patients, would increase the donor pool by 20-25 percent. Moreover, unpublished data from the Pittsburgh organ procurement organization, the Center for Organ Recovery and Education (CORE), suggests that these organs, particularly kidneys, function as well as those procured from HBCDs (Broznick 1993).This volume is devoted to the ethical, psychosocial, and public policy implications of procuring organs from non-heart-beating cadaver donors after a discussion to forgo life-sustaining treatment. The genesis of this volume was a project in which we invited leading experts in transplantation, ethics, and public policy to use the Pittsburgh protocol as a starting point for exploring a broad range of issues associated with attempts to procure organs from NHBCDs. Pp. 262. $65.00, hardcover; $24.95, paperback.Adriana Cavarero's most recent book, For More than One Voice, offers the reader a critique of Western metaphysics that challenges the hegemony of speech's (...) relation to thought within politics. Revisiting Aristotle's Politics, Cavarero examines the famous definition of man as "zoon logon echon"—usually translated as "rational animal." She is critical of the tradition that renders logos here as "reason" or "rationality," modeled on the abstract and disembodied Platonic idea. Reading the Politics alongside the Poetics, she brings politics into a distinctly rhetorical sphere, and therefore figures logos as "phone semantike." In this light, man is a "speaking animal," an animal who speaks with a voice (phone) that is meaningful (semantike—an adjectival form that qualifies the voice itself). Cavarero's argument is that voice and meaning—phonic and semantic—must be sharply distinguished. The history of Western philosophy, she contends, has effaced this vital difference and focused instead on speech as a unitary phenomenon in which the vocalic and the semantic are always already joined as meaningful signification. In this way, the singularity of the vocalic itself has been elided in favor of speech that strongly privileges meaning. She therefore wishes to deliver us from language, as it were, through a recuperation of the force of the vocalic, the acoustic, the resonant and sonorous auditory quality of phone.Absent in the history of Western philosophy, this sonorous aspect of the vocalic stands as a corrective to our logocentric metaphysical tradition that singularly values the visual over the acoustic, semantic content over vocal utterances, and an abstract, anonymous "what" over a particular, embodied "who." Cavarero claims that the vocalic is an "anti-metaphysical" force that exceeds and challenges signification. In other words, the vocalic immediately communicates the uniqueness of the speaker without recourse to the signifying content of his or her speech. The voice is essentially relational—a relation that is described as "the condition of every communication.... the communicability of the communicable, or the significance of signification" (29). Indeed, for Cavarero the voice is that which "precedes, generates, and exceeds verbal communication" [End Page 166] (29–30). In this way, remarkably, Cavarero refigures the voice as a presymbolic origin that is both temporally and ontologically prior to signification, as that which is a condition of possibility for signification, and as that which is never exhausted by any signifying speech act as such.The voice is the expression of one unique, embodied individual to another. This expression, a "reciprocal invocation" founded in the sonorous, rhythmic, and resonant materiality of the voice, constitutes a "duet," a musical exchange of voices in and through which individuals mutually invoke one another. Cavarero resists inscribing such a relation within the symbolic realm; yet for her this relation is a "wordless language" that takes place in the paradigmatic scene between mother and infant. Here, in this originary scene, there is not yet the movement of language or speech as such, but the rhythm and cadence of demand and response—the voices of mother and infant that invoke one another. Drawing on Hélène Cixous's and Julia Kristeva's well-known work on the maternal chora, Cavarero demonstrates that the cadence of the "la-la melody" exchanged between mother and infant "configure[s] a reciprocal dependence" (170) that takes a structural form in the movement between demand and response.For Cavarero, the "scene of infancy" enjoys a primacy: it is both ontologically and chronologically prior to the institution of language and law. The maternal chora is figured as that which invisibly underwrites what will be understood as the law of the father—a law that is said to mark the inauguration of language. But if the law of the father is rational and semantic, the maternal should not be conceived as simply irrational and pure sound. Or perhaps you might say, "That's not exactly what I taught them--I didn't say it was a 'motley' assortment." In either case, you would be relying on some form of what Robert Wardy (170, n.r 20) has dubbed the "blame students, not teachers defence." By Zeus, that's no reason to hate physical trainers... and to exile them from their cities! For while these people imparted their skills to be used justly against enemies and wrongdoers, and in [End Page 355] defense, not aggression, their pupils pervert their strength and skill and misuse them. So it's not their teachers who are wicked, nor is this a reason why the craft should be a cause of wickedness; the ones who misuse it are supposedly the wicked ones. And the same is true for oratory as well. The orator has the ability to speak against everyone on every subject, so as in gatherings to be more persuasive, in short, about anything he likes, but the fact that he has the ability to rob doctors or other craftsmen of their reputations doesn't give him any more of a reason to do it. He should use oratory justly, as he would any competitive skill. And I suppose that if a person who has become an orator goes on with this ability and this craft to commit wrongdoing, we shouldn't hate his teacher and exile him from our cities. Abstract In this paper, we explore how the application of technological tools has reshaped food production systems in ways that foster large-scale outbreaks of foodborne illness. Outbreaks of foodborne illness have received increasing attention in recent years, resulting in a growing awareness of the negative impacts associated with industrial food production. These trends indicate a need to examine systemic causes of outbreaks and how they are being addressed. In this paper, we analyze outbreaks linked to ground beef and salad greens. (...) These case studies are informed by personal interviews, site visits, and an extensive review of government documents and peer-reviewed literature. To explore these cases, we draw from actor-network theory and political economy to analyze the relationships between technological tools, the design of industrial production systems, and the emergence and spread of pathogenic bacteria. We also examine if current responses to outbreaks represent reflexive change. Lastly, we use the myth of Prometheus to discuss ethical issues regarding the use of technology in food production. Our findings indicate that current tools and systems were designed with a narrow focus on economic efficiency, while overlooking relationships with pathogenic bacteria and negative social impacts. In addition, we find that current responses to outbreaks do not represent reflexive change and a continued reliance on technological fixes to systemic problems may result in greater problems in the future. We argue that much can be learned from the myth of Prometheus. In particular, justice and reverence need to play a more significant role in guiding production decisions. Paper $17.95.On the beautifully designed cover of Steven Heine's Opening a Mountain: Kōans of the Zen Masters, we gaze at one of the masterworks of Chinese painting, Kuo Hsi's Early Spring, painted in the late eleventh century (...) at what may have been the pinnacle of the Chinese Zen monastic tradition. Allowing our eyes to wander up, down, and across this truly great work, we spot the curved roof of a Buddhist monastery gorgeously nestled in a rugged valley halfway up a towering, mist-covered mountain. No image could more adequately capture the mystique that Chinese Zen monasticism attained in that era and has continued to cultivate into the modern period. Steven Heine's new book masterfully communicates the aura of Zen in those times by highlighting a segment of kōan literature that features the work of Zen masters in "opening a mountain." While it is clear that the mountain in this phrase is really a Zen monastery, and that this phrase became a standard way to refer to the initiation of a new monastery, Heine unravels this act of opening by detailing the enormously interesting historical/cultural tradition behind it.Long before the emergence of the Zen or even the Buddhist tradition in China, mountains symbolized numinous, spiritual power. Early Taoists had already used the image of the mountain as a metaphor of mysterious, otherworldly reality. Chinese [End Page 194] popular tradition pictured the deities residing at these far-off and little-known elevations. Buddhists continued to capitalize on images like this until literature valorizing the T'ang and Sung dynasty Zen masters brought them to their current cultural position. Climbing a mountain, and dwelling there, required the utmost mental and spiritual discipline. Residing in that lofty sphere, one attained a vision of the world that in its depth and breadth trumped any understanding that could be attained in the world below. The mountain recluse and the enigmatic Zen master who drew disciples into remote mountainous regions for mental or spiritual training is by now one of the best known, most powerful images in the world. It is quite understandable that the great Zen masters would "open" their monastic training centers in the kind of setting depicted in Heine's reconstruction of the idea of the mountain in Chinese history.What Heine's analysis makes clear, though, is that there is much more to the act of "opening" than we have hitherto assumed. Prior to the movement of Buddhist monasteries into these remote areas there existed a largely oral tradition concerning enigmatic mountain recluses who, like the legendary Taoist Lao-tzu, had withdrawn from the world in the quest for profound spiritual vision. Popular images of these visionaries were widespread throughout China in the medieval period, and no parallel to them existed in the staid, scholarly world of Buddhist monasticism. The movement of monastic Buddhism into that domain, therefore, necessitated a conflict and melding of images, and the terms in which this ideological battle would take place would not be derived from the rarified philosophical and textual traditions that had made Buddhism so impressive to earlier generations of Chinese converts. Instead, Zen masters would compete for popular recognition in south-central China in terms that were familiar to the residents of that area, namely of magical powers, demons, local deities, and the visions, apparitions, and exorcisms that supported that premodern metaphysical world.The innovation of Opening a Mountain is that, while not denying what Heine calls the "conventional understanding" of the kōan tradition, which has been communicated in largely modern, demythologized, psychological images, the book undertakes the study of kōan literature by being particularly attentive to these clear representations of the extent to which Zen was born and cultivated in a premodern world. John Stuart Mill's On Liberty is commonly viewed as the classic defense of (...) individual liberty, and Mill himself as the grandfather of modern liberalism. In John Stuart Mill on Liberty and Control Joseph Hamburger seeks to dislodge this orthodox interpretation [End Page 308] of Mill. As the title of the work suggests, Hamburger, who died shortly before this work came to press, seeks to convince the reader that a proper understanding of Mill's account of individual liberty needs to be nuanced by an appreciation of those substantial controls that Mill was willing to place upon individuals.Hamburger suggests that the association of Mill with modern liberalism results from viewing the arguments presented in On Liberty in isolation from the context in which they were written. Hamburger argues that Mill's real purpose in writing On Liberty is neither self-evident nor is it one that is easily assimilated to modern libertarian ideals. Hamburger interprets "Mill as making an esoteric argument in On Liberty" (xvii). There are two additional pieces that Hamburger claims one needs in order to properly decipher the puzzle, and thus grasp the true import of Mill's claims concerning liberty. First, Hamburger argues that Mill's desire to bring about cultural reform was dependent upon his rejection of Christianity. Mill's unpublished writings reveal that he was far more antagonistic to the influence of Christian religion than is often recognized. Hamburger argues that for Mill initiating true moral reform depended upon overcoming the old social order of which Christianity was a primary constituent. In order for this to occur, one needed "to establish liberty for those who would implement his plan for moral reformation" (86). Second, Hamburger argues that we must also grasp Mill's view of history if we are to properly understand his project of moral reform and the place of On Liberty within this project. Hamburger claims that Mill's vision of history was strongly influenced by thinkers such as Comte and St. Simon. From them, Mill adopted the view that societies alternate between transitional and natural states, and that the values that are applicable in these states are quite different. Hamburger claims that "Mill easily recognized his own age as being transitional," and that this influences all of his arguments in On Liberty (111).Putting the above together, Hamburger concludes that Mill's arguments are specifically directed toward securing the liberty of those who would combat the influence of Christianity and the old moral order, and that "the liberty recommended in On Liberty was especially valued because it would hasten the undermining of old doctrines and institutions which occurred in transitional periods" (212). Hamburger argues that the liberty that Mill meant to secure in this work was not intended to apply equally to all persons or in all periods. Thus, Hamburger argues that Mill was quite willing to advocate strong forms of social control in other contexts.The latter claim, which Hamburger argues provides a more coherent interpretation of On Liberty, does not necessarily follow from Mill's view of religion and history. Here, I think there is room for two distinct judgments regarding Hamburger's achievement in this book. Hamburger has undoubtedly provided a great service in examining the often neglected areas of Mill's corpus and their relevance to his more prominent works. Philosophers who view On Liberty as an isolated piece of argument, or at best only consider it in relation to Mill's Utilitarianism, thus would profit much from reading this work. I am less convinced, however, of Hamburger's claim that heeding these aspects of Mill's thought will lead one to form a radically different understanding of Mill's claims concerning... (shrink)

On 26 August 1974, Michel Foucault completed work on Discipline and Punish, and on that very same day began writing the first volume of The History of Sexuality. A little under ten years later, on 25 June 1984, shortly after the second and third volumes were published, he was dead. This decade is one of the most fascinating of his career. It begins with the initiation of the sexuality project, and ends with its enforced and premature closure. Yet in 1974 (...) he had something very different in mind for The History of Sexuality than the way things were left in 1984. Foucault originally planned a thematically organised series of six volumes, but wrote little of what he promised and published none of them. Instead over the course of the next decade he took his work in very different directions, studying, lecturing and writing about historical periods stretching back to antiquity. This book offers a detailed intellectual history of both the abandoned thematic project and the more properly historical version left incomplete at his death. It draws on all Foucault’s writings in this period, his courses at the Collège de France and lectures elsewhere, as well as material archived in France and California to provide a comprehensive overview and synthetic account of Foucault’s last decade. As Nelson Goodman highlighted, there are two main senses of “abstract” that can be found in discussions about abstract art. On the one hand, a representation is abstract if it leaves out certain features of its target. On the other hand, something can be abstract to the extent that it does not represent a concrete subject. The first sense of “abstract” is well-known in philosophy of science. For example, philosophers discuss mathematical models of physical, biological, and economic systems as being (...) abstract in this sense. However, it is the second sense that dominates discussions of abstract art in aesthetics. For example, abstract art was (and is) considered revolutionary precisely for being non-figurative. Through an analysis of artists including Kandinsky, Malevich, and Mondrian, we develop a reading of this second sense, which we call “generative abstraction,” as opposed to “subtractive” abstraction. In fact, this is Mill’s phrase describing money as a circulating medium. 1 In utilitarianism, utility is the ubiquitous form of moral currency; like (...) money in the capitalist economy, it functions as the “universal equivalent” in the moral economy. 2 It is therefore unsurprising that economic idioms abound in discussions of utilitarianism, with their talk of trade-offs, calculation, and costs. But it is not the parallel with economic exchange that I want to focus on in this article. Mill’s reference to “a common language” points succinctly to a different connection which will be the center of attention, and that is between forms of ethical and linguistic equivalence.It is this conjunction that the term “moral synonymy” is intended to capture. By moral synonymy I want to indicate a particular conjunction of perspectives on ethics and language, or more precisely, style—a conjunction which, I shall argue, Mill’s work can help us both to see and to see through. A bare and schematic anticipation of my approach would be to say that what a belief in commensurability is to the realm of ethics, a belief in synonymy is to the realm of language. This article will explore the interrelationship of these two ideas. In the end I shall suggest that the collaboration between ethics and style denoted by moral synonymy imposes severe limitations on thinking about ethics and literature, and that an examination of moral synonymy and its [End Page 46] implications should be part of the currently revived attempts to work out the relationship between ethics and literature.Synonymy is the idea that identical meaning can be expressed in different linguistic forms. Style—as linguistic form of expression—can be varied or discarded without altering the body of sense it clothes. 3 To believe in moral commensurability is to believe that there is some common value by means of which different values can be measured against each other, and conflicts between them rationally decided. One leading candidate for the role of common value is, of course, utility, and utilitarianism will be taken here as typical of a commensurabilist approach. So, to outline the parallel between ethics and style that we will focus on: just as the believer in synonymy thinks that distinct linguistic styles may be shown to be so many different vehicles for expressing common meanings, so the utilitarian thinks that distinct values turn out ultimately to be so many forms for conveying the common value of utility. Utilitarians, as commensurabilists, happily commit the ethical variety of the “heresy of paraphrase.” They are happy to reduce different values merely to styles of utility. This is why I want to call utilitarianism a kind of moral synonymy.IIWe can understand ethical commensurability more clearly by turning briefly to Mill’s work. Mill relies on utility as the single criterion for settling ethical conflicts. In Utilitarianism he proposes happiness not as one among the ends or criteria of morality, but as the only one. He argues that “to desire anything except in proportion as the idea of it is pleasant, is a physical and metaphysical impossibility” (X, p. 238). Such assertions are the source of familiar difficulties for Mill’s moral theory, for there would seem to be ends other than happiness under the title of which people desire things. Moreover, some of these ends are arguably not only irreducible but also prone to come into conflict with utility (autonomy is a good example of one such value). So it is improbable that happiness is the unique categorial end. 4 There is in fact a tension—vital to Mill and to this article—between Mill’s formal philosophical adherence to utility and his practical recognition of the diversity of values; but nevertheless, he always professes ultimate allegiance to the idea that utility can be considered as the “common umpire” in ethical disputes (X, p. 226).
