A number of unique problems plague human research protection efforts at United States State and Territorial Departments of Health. The first problem is related to the number of Institutional Review Boards operated by and Federalwide Assurances held by DOHs. The lack of these two essential regulatory human research protection program mechanisms points to a possible inadequacy of infrastructure at DOHs for protecting human subjects. The second and third problems are related to the use and interpretation of research protection laws (...) and regulations at DOHs. Parsing public health activities into research or practice can be vexing and likely produces variability in how individual DOHs make the determination between research and practice and the outcomes of such decisions for the same or similar projects. A related problem is that DOH or Institutional Review Board officials might misclassify public health practice activities as research, which can have costly, adverse consequences. (shrink)

This article explores how the institutional context, including central and local governments, has co-evolved with business in relation to small cars and sustainability. This issue is very relevant for business and society in view of the environmental implications of the rapidly growing vehicle fleet in China, the economic importance attached to this pillar industry by the government, and citizen interest in owning and driving increasingly larger cars. The interactions between different levels of government, and with business in countries with (...) a large role for the state is a novel area of study in the business-society area and a complex one given the multitude of objectives and interests involved in industry competitiveness, economic development, energy security, and sustainability. The article shows that the central government has adopted policies to further the production and use of small cars, which it perceives as serving environmental, economic, and social goals. Concurrently, however, many local governments imposed restrictions on small cars and have, implicitly or explicitly, favored larger cars. There seems to be a clear linkage to municipal ownership of those domestic automobile companies which, via joint ventures with foreign firms, focused more on larger cars. By adopting a co-evolutionary approach focused on macro-level interactions, the case helps to shed some more light on concrete sustainability challenges, and broader government–business interactions in a highly institutionalized setting, contributing insights on issues that have remained underexposed in business and society research. Theoretical methods for empirical state determination of entangled two-level systems are analyzed in relation to information theory. We show that hidden variable theories would lead to a Shannon index of correlation between the entangled subsystems which is larger than that predicted by quantum mechanics. Canonical representations which have maximal correlations are treated by the use of Schmidt and Hilbert-Schmidt decomposition of the entangled states, including especially the Bohm singlet state and the GHZ entangled states. Contemporary educational policy is centrally concerned with local management of schooling; a practice apparently supported by and following easily from John Stuart Mill’s views on liberty and representative government. This paper argues that contemporary practices of local management of schooling are conservative rather than empowering, and that Mill’s actual proposals result in an unresolvable paradox in this area. It is then argued that if the State is conceptualised as a relatively autonomous body seeking to secure conditions conducive (...) to accumulation of capital, and if ‘promoting the general welfare’ is formulated in a manner which would not lead inexorably to a free-market capitalist State, then Mill’s ideas can provide guidelines for a radical form of democratisation and devolution of power in relation to local management of schooling. Industrial emissions of greenhouse gases are significant contributors to climate change, which poses a grave threat to social and economic systems. Our understanding of what might drive firms to reduce their emissions of these gases, however, is incomplete, and it is not clear that the knowledge gained from other environmental issues will readily apply to these emissions. We argue and find that indicators of environmental injustice previously shown to relate to toxic pollutants, for example, are poor predictors of greenhouse gas (...) emissions. Instead, we show that the degree of belief in and concern about climate change in a local community is a significant predictor of the facility’s rate of emission improvements. Furthermore, we find that beliefs at both the facility and headquarter communities influence emission reduction, and that those effects are substitutes for each other. (shrink)

In the past two decades academic and research literature on “corruption” has flourished. During the same period organizations and initiatives fighting against corruption have also significantly expanded, turning “anti-corruption” into a new research subject. However, despite a few exceptions there is a division of labor between scholars who study corruption itself and those who study the global anti-corruption industry. Juxtaposing corruption’s local discourses and anti-corruption international practices, this article is an attempt to bring together these two intertwined research dimensions (...) and explore how an ethnographic approach might contribute to framing them together. Firstly, it describes how corruption in Romania is often conceptualized and explained in terms of national heritage, something related to old and recent cultural history, including traditional folklore. Secondly, it explores how anti-corruption works in practice, focusing on international legal cooperation projects monitoring the progress and shortcomings both prior to and post Romania’s accession to the European Union. Finally, revealing the articulations of these two apparently unrelated research fields, the article argues that corruption’s local explanations and the circular logic of auditing observed within the anti-corruption industry share a common developmental ideology mirroring the crypto-colonialist structure of power relations and dependency among European nation-states emerging out of the Cold War. An enduring question in the cultural study of psychological experience concerns how emotion may play a role in shaping moral aspects of children’s lives as they are mentored into socially preferred ways of understanding and responding to the world at hand. This article brings together approaches from psychological and linguistic anthropology to explore how cultural schemas of normativity are communicated, embodied, and enacted as children participate in day-to-day family activities and routines. Illustrative examples emanate from a videotaped corpus of naturalistic (...) interactional data that document the daily lives of 32 ethnically diverse U.S. middle-class families who reside in the Los Angeles, California metropolitan region. The article employs discourse and narrative analysis to examine how children are apprenticed into perceiving, appraising, and reacting to the emotions of self and others as culturally shaped indicators for proper comportment. Data analysis emphasizes how implicit components of caregivers’ interactions with children (i.e., gesture, gaze, facial expression) intertwine with explicit, verbal communication to constitute intricately layered affective messages that shape the evaluative frames through which children interpret, display, and respond to emotions. The article identifies two culturally salient childrearing practices, “pep talks” and “time outs,” that apprentice children into moral accountable relationships with others by encouraging them to manage their emotions in culturally preferred ways. Study findings suggest that parental communications conveying praise and approval—or conversely indexing disapproval—towards children are emotionally resonant motivational practices in this cultural milieu as children are mentored into culturally meaningful emotional management techniques. The article highlights how children actively employ semiotic socio-communicative resources and it closely traces their sense-making processes in tandem with their discursive contributions to the moment-by-moment interaction. It argues that emotion, morality, and interpersonal relations are critical in shaping children’s acquisition of consensually validated ways of perceiving, feeling, and responding to the phenomena they encounter in their day-to-day lives. This perspective aims towards contextualized understandings that render plausible connections between local contexts of everyday action and broader macro-level discourses and master narratives, such as those associated with a neo-liberal emphasis on cultivating citizens who learn to regulate their emotions on behalf of self and others. Under a policy first enacted in 1988 and expanded in 1996, federally funded public housing authorities (“PHAs”) and private landlords renting their properties to tenants receiving federal housing assistance have been required to include a provision in all leases under which drug-related criminal activity as well as criminal activity that in any way poses a threat to other tenants or nearby residents constitutes ground for initiating eviction proceedings. This strict liability eviction policy, which has become known as the “One-Strike Rule,” (...) was part of a broader congressional effort to combat the “reign of terror” that Congress believed drug dealers were imposing on public housing and assisted housing tenants. Like many of the crime-related policies enacted in the 1980s and 1990s, the One-Strike Rule has done little to reduce crime rates, but has been wildly successful in ensuring that the situation of poor households receiving federal assistance remains highly precarious. Calls for reform of the One-Strike Rule are almost as old as the policy itself, but given the political outlook of the current administration, the prospects for reform at the federal level are dim. While federal law and a combination of gridlock and unwillingness in the congressional and executive branches foreclose a range of possible strategies for reform, there is nonetheless room to mitigate the socially corrosive effects of the One-Strike Rule through legislative efforts at the state and local level. Courts in various jurisdictions have upheld state laws that protect vulnerable tenants despite the federal strict liability policy, and these holdings help to provide a framework for how state and local governments seeking to protect tenants can do so without their efforts necessarily falling prey to the Supremacy Clause. This article describes that framework and proposes three concrete measures that fit it. The article is structured as follows: after explaining the One-Strike Rule and the threat it poses to vulnerable tenants (Section II), the article discusses the burden the Rule imposes on tenants and the benefits it is supposed to bring to other parties, and argues that the resulting distribution of burdens and benefits is unjust (Section III). The article then lays out three concrete measures that state and local governments can enact to protect tenants who face eviction for criminal activity under the Rule without falling prey to a federal preemption challenge: requiring “good cause” for eviction, giving tenants the right to cure a breach of their lease, and providing tenants with free counsel in landlord-tenant court (Section IV). Three issues related to Feldman and Levin's treatment of biological variability are discussed. We question the usefulness of the indirect component of δλ. We suggest that trade-offs between speed and accuracy in aimed movements support identification of δλ, rather than λ, as a control variable. We take issue with the authors' proposal for resolving redundancy in multi-joint movements, given recent data.

This study examines the influence of Christian religion on corporate decisions related to human rights in the United States. Specifically, it examines the empirical association between a company's human rights practices and the Christian religiosity in its local community, as well as individual CEO religiosity in the United States, both of which have not been tested in prior studies. Employing a large sample from the United States, we find a congruent association between the “human rights friendly” practices of a (...) company and the Christian religiosity of the local community. This novel finding is robust to a diverse set of tests. In addition, we find that the association between Christian religiosity in the United States and human rights is more significant in reducing human rights concerns, than it improves human rights strengths. This study interprets these results as upholding the religious morality hypothesis, namely, that companies located in areas with higher religiosity are likely to engage in more human rights-friendly practices, and the United States. Christians consider religion as an influencing factor that encourages managers to embrace human rights. Furthermore, this study finds that individual religious managers tend toward more human rights-friendly practices, supporting our religious manager hypothesis. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. Entangled states whose Wigner functions are non-negative may be viewed as being accounted for by local hidden variables (LHV). Recently, there were studies of Bell’s inequality violation (BIQV) for such states in conjunction with the well known theorem of Bell that precludes BIQV for theories that have LHV underpinning. We extend these studies to teleportation which is also based on entanglement. We investigate if, to what extent, and under what conditions may teleportation be accounted for via LHV theory. Our (...) study allows us to expose the role of various quantum requirements. These are, e.g., the uncertainty relation among non-commuting operators, and the no-cloning theorem which forces the complete elimination of the teleported state at its initial port. (shrink)

In this paper we provide a formal description of what it means to be in a local or partial information-state. Starting from the notion of locality in a relational structure, we define so-called adaptive gen- erated submodels. The latter are then shown to yield an adaptive logic wherein the derivability of Pφ is naturally interpreted as a core property of being in a state in which one holds the information that φ.

In this article I am particularly interested in the question of solidarity within the boundaries of one's own country. I discuss a qualified beneficence requirement, which claims that we ought to prevent something very bad from happening if it is in our power and if we can do it without sacrificing anything morally significant. I also discuss a fair-share principle, according to which, in Liam B. Murphy's version, "the sacrifice each agent is required to make is limited to the level (...) of sacrifice that would be optimal if the situation were one of full compliance". I argue that the qualified beneficence requirement is reasonable only in the proximity of the one who needs help. When there is no proximity we ought to be guided by a fair-share principle. I also argue that there is an intimate relation between the fair-share principle and the welfare-state ideology. (shrink)

Central African highland farmers' perceptions of common bean disease were investigated using both phytopathology and anthropological techniques. Farmers rarely mentioned diseases as production constraints in formal questionnaires. More participatory research showed farmers often related disease symptoms to the effects of rain and soil depletion for fungal diseases, or to varietal traits for bean common mosaic virus. Rain or moisture is divided into numerous forms through which it can damage plants, both physically and through putrefaction. Most conditions associated with putrefaction appear (...) to be linked to pathogens. Farmers have an understanding of plant health closely related to their concept of human health. In plants, this understanding is based on the prior state of plant health. Conceptually, local disease management strategies are based on prevention by managing the conditions that promote good plant health rather than by treating disease symptoms. Intervention strategies that build on local knowledge are encouraged. (shrink)

Music-based interventions (MBI) have become increasingly widely adopted for dementia and related disorders. Previous research shows that music engages reward-related regions through functional connectivity with the auditory system, but evidence for the effectiveness of MBI is mixed in older adults with mild cognitive impairment (MCI) and Alzheimer’s disease (AD). This underscores the need for a unified mechanistic understanding to motivate MBIs. The main objective of the present study is to characterize the intrinsic connectivity of the auditory and reward systems in (...) healthy aging individuals with MCI, and those with AD. Using resting-state fMRI data from the Alzheimer’s Database Neuroimaging Initiative, we tested resting-state functional connectivity within and between auditory and reward systems in older adults with MCI, AD, and age-matched healthy controls (N = 105). Seed-based correlations were assessed from regions of interest (ROIs) in the auditory network (i.e., anterior superior temporal gyrus, posterior superior temporal gyrus, Heschl’s Gyrus), and the reward network (i.e., nucleus accumbens, caudate, putamen, and orbitofrontal cortex). AD individuals were lower in both within-network and between-network functional connectivity in the auditory network and reward networks compared to MCI and controls. The evidence linking tobacco product advertising to adolescent smoking initiation and resulting long-term addiction, premature death, and disability is well established. Each link in the causal chain has been substantiated: children and adolescents are especially vulnerable to advertising; point-of-sale advertising comprises 92.1% of cigarette advertising and marketing expenditures by manufacturers and 71.3% of smokeless tobacco advertising; tobacco companies have targeted youth through advertising; advertising exposure causes adolescents to start and to continue smoking; among adults who become daily smokers, nearly all (...) first use of cigarettes occurs by 18 years of age; adolescents who smoke are at high risk for long-term addiction because their brains are still developing; and long-term addiction results in the tremendous personal, social and financial costs of tobacco-related illnesses. In this paper we present an embedding of abstract argumentation systems into the framework of Barwise and Seligmans logic of information flow. We show that, taking P.M. Dungs characterization of argument systems, a local logic over states of a deliberation may be constructed. In this structure, the key feature of non-monotonicity of commonsense reasoning obtains as the transition from one local logic to another, due to a change in certain background conditions. Each of Dungs extensions of argument systems (...) leads to a corresponding ordering of background conditions. The relations among extensions becomes a relation among partial orderings of background conditions. This introduces a conceptual innovation in Barwise and Seligmans representation of commonsense reasoning. (shrink)

Mounting evidence documents the extraordinary toll on human health resulting from the consumption of unhealthy food products and physical inactivity. Diseases related to poor nutrition – such as diabetes, heart disease, stroke, and some cancers – are among the leading causes of disability and death in the United States. Poor diet and lack of exercise come second only to tobacco use in actual causes of preventable death in this country. It is estimated that 6% of all adult health care, 7% (...) of Medicare, and 11% of Medicaid expenditures are attributable to obesity. According to the Centers for Disease Control and Prevention, the direct medical cost associated with physical inactivity was nearly $76.6 billion in 2000.In response to America's growing obesity problem, local policymakers have been looking for legal strategies to adopt in their communities to encourage healthful behaviors. Taking the lead from the successful tobacco control movement, nutrition advocates are seeking strategies to “denormalize” unhealthy behaviors, rather than pursuing education-based approaches that encourage individuals to change their own personal behavior. Entangled states are a specific feature of quantum physics that neither have a counterpart in classical physics nor in the realm of our ordinary experiences. In this chapter we outline the debate about these particular states both historically and systematically. We delineate how the debate originated in an argument for the incompleteness of quantum mechanics by Einstein, Podolsky and Rosen, and we show why, on the one hand, the argument is not considered convincing today, on the other hand, however, still (...) affects present discussions. In a second part we give a systematic overview over the contemporary debate on entanglement which focusses on Bell’s theorem and its consequences. Discerning different levels, we reconstruct the theorem and its premises in a clear way and discuss possible consequences. We analyze in detail the received view that Bell’s theorem implies non-locality and relate it to concepts such as “non-separability‘ and “holism‘. Especially we examine the question whether the phenomena involving entangled systems can be explained causally and whether the central conflict between a non-locality and the theory of relativity can be solved. The paper focuses on the application of a particular conception of the rule of law to situations characterized by traditional local justice and legal pluralism. While in the twentieth century international rule‐of‐law programmes were directed almost exclusively at state legal system, they have recently begun to take into account traditional local justice, namely, those institutions which in many world regions represent the main form of effective justice. Starting with a review of the positive and negative aspects of (...) traditional local justice from a rule‐of‐law perspective, the paper underlines the widespread lack of protection of human rights, particularly of women’s rights. Discussing vertical rule‐of‐law functions in contexts of legal pluralism the paper stresses the advantages of an approach to the promotion of the rule of law based on mutual recognition and influence between different legal authorities and sources. It is argued that this “interactive” approach appears best suited to the complex frameworks of relations that characterize present‐day systems of deep legal pluralism. Finally, the paper underlines the correspondence between this approach and a conception of the rule of law as an ideal framework of plural interactions characterized by the limits imposed on the law by the law itself, and it discusses its advantages from the perspective of human rights and women’s rights promotion. The article proceeds from the concept of understanding local government in Russia as a projection of the potestar (pre-state) organization of public life, which transforms under the dominance of methods of state organization of public life, but retains its influence as the essential core of political and social interaction between people. The existing complex «state-municipal» mechanism for exercising power at the local level largely determines the forms and nature of political actors’ interaction at the regional (...) level. State authorities, which are focused on the totality of their own administrative influences, have not yet succeeded in fully integrating local self-government into the general public space of responsibility for powers, since local power is unbuilt initially on the principles of autogenesis, autochthony and autonomy. The current situation contributes to the archaicism of a part of social relations. For some time now, to work in the multidimensional reality of society, the authorities have begun to need analytical models to understand what is happening. As an explanatory theoretical basis for the modes of existence of local authorities developed and described by the author in the current stage of development of Russian statehood, a modal methodology is used, supplemented by the results of constructing model-oriented political ontologies, which reflect the aggregates of the layers and actors of the municipal sphere of sociopolitical reality at the regional level that are actually and actively present in the Russian society. The author is interested in searching the patterns that operate in the environment created and cultivated by the organizational and activity efforts of state structures against the background of sociocultural and other characteristics inherent in the regions. Possible working models for the needs of public administration arising from the modes offered by the author are still under development, since the reform of constitutional rules proposed by the country’s leadership raises the question of new forms of organizing the continuum of coexistence and interaction of local and state authorities in Russia. The article outlines the main research lines that indicate a number of features and reference points of the author’s approach in understanding the relationship between local government and municipal government, which may serve as an occasion for a new circle of discussions of specialists interested in the prospects for the development of political potential in the Russian municipal environment. Relational Quantum Mechanics is an interpretation of quantum theory based on the idea of abolishing the notion of absolute states of systems, in favor of states of systems relative to other systems. Such a move is claimed to solve the conceptual problems of standard quantum mechanics. Moreover, RQM has been argued to account for all quantum correlations without invoking non-local effects and, in spite of embracing a fully relational stance, to successfully explain how different observers exchange information. In this (...) work, we carry out a thorough assessment of RQM and its purported achievements. We find that it fails to address the conceptual problems of standard quantum mechanics—related to the lack of clarity in its ontology and the rules that govern its behavior—and that it leads to serious conceptual problems of its own. We also uncover as unwarranted the claims that RQM can correctly explain information exchange among observers, and that it accommodates all quantum correlations without invoking non-local influences. We conclude that RQM is unsuccessful in its attempt to provide a satisfactory understanding of the quantum world. (shrink)

I address the view that the classical electromagnetic potentials are shown by the Aharonov–Bohm effect to be physically real. I give a historico-philosophical presentation of this view and assess its prospects, more precisely than has so far been done in the literature. Taking the potential as physically real runs prima facie into ‘gauge-underdetermination’: different gauge choices represent different physical states of affairs and hence different theories. This fact is usually not acknowledged in the literature, neither by proponents nor by opponents (...) of the potentials view. I then illustrate this theme by what I take to be the basic insight of the AB effect for the potentials view, namely that the gauge equivalence class that directly corresponds to the electric and magnetic fields is too wide, i.e., the Narrow Equivalence Class encodes additional physical degrees of freedom: these only play a distinct role in a multiply-connected space. There is a trade-off between explanatory power and gauge symmetries. On the one hand, this narrower equivalence class gives a local explanation of the AB effect in the sense that the phase is incrementally picked up along the path of the electron. On the other hand, locality is not satisfied in the sense of signal locality, viz. the finite speed of propagation exhibited by electric and magnetic fields. It is therefore intellectually mandatory to seek desiderata that will distinguish even within these narrower equivalence classes, i.e. will prefer some elements of such an equivalence class over others. I consider various formulations of locality, such as Bell locality, local interaction Hamiltonians, and signal locality. I show that Bell locality can only be evaluated if one fixes the gauge freedom completely. Yet, an explanation in terms of signal locality can be accommodated by the Lorenz gauge: the potentials propagate in waves at finite speed. I therefore suggest the Lorenz gauge potentials theory—an even narrower gauge equivalence relation—as the ontology of electrodynamics. (shrink)

The successful global diffusion of formal democracy has gone hand in hand with the hollowing out of its substance. Ever more realms of domestic public policy are removed from the purview of national legislative deliberation and insulated from popular scrutiny. Rhetoric of accountability has accompanied the increasing unaccountability of international financial and trade organizations, transnational corporations as well as of states and NGOs. The new architecture of global governance characterized by legal plurality and overlapping sovereignties has facilitated a game of (...) ‘passing the blame’ among these four actors. There is a curious ambivalence in current debates on globalization about the role of the state, which is conceived of as both central and marginal. Globalization is seen to be marked by the decline of both the external and the internal sovereignty of the state. Contrary to such a view, it will be argued here that the state is both an agent and an object of globalization. Although inadequate, the state remains indispensable as its laws and policies play a key role in transposing neo-liberal agendas to the national and local levels. If in the age of globalization and of economic Empire, political violence has been replaced by legal violence, resistance to it is also articulated in the language of law. This paper focuses on the dynamic of legal politics against impoverishment and dispossession caused by the new global designs of intellectual property protection, biodiversity conservation and privatization of the commons in India. The case studies in this paper point to the emergence of intertwined structures of rule, overlapping sovereignties and complex processes of legal transnationalization that have reconfigured the relations between law, state, and territoriality. If welfare states were concerned with the redistribution of risk and resources, cunning states seek to redistribute responsibility. Sensitivity to the history of colonialism would be an important corrective to the presentism and Westerncentrism of analyses of (legal) globalization. (shrink)

This is an excellent book, by one of the philosophy of quantum theory's brightest stars. It combines a clear presentation of determinism, probability and non-locality in several current interpretations of quantum theory, with a good deal of detailed analysis, both reporting other people's and Dickson's own results, and developing his own ideas|which are often heterodox, but always well-defended and thought-provoking. The treatment is often concise, especially when reporting standard material or others' results. There are also frequent changes of gear; both (...) because the issues are complexly related to each other, and because Dickson sensibly does not aim for a de nitive treatment of issues that are at present so controversial|accordingly, he weaves about, not forcing his material into some single line of argument. So this is a monograph, not a textbook for teaching or a treatise summing up a conquered eld. But the style is clear and vigourous; the book is packed with information (sometimes about ancillary issues); and as we shall see, Dickson does have some provocative main claims, if not an overarching single line of argument. In this short space, I can only praise the book's general virtues and state some of the main claims. (shrink)

All separable states satisfy all Bell-type inequalities, which involve as their assumption only existence of local realistic (local hidden variable) models of the correlations of spatially separated systems, observed by two or more observers making independent decisions on what to measure (free will). The recent observation by Loubenets, that some separable states do not satisfy the original Bell inequality (1964) has no consequences whatsoever for the studies of the relation of separability with local realism. The original Bell (...) inequality was derived using an additional assumption that the local results for a certain pair of local settings reveal perfect Einstein–Podolsky–Rosen (EPR) correlations. Therefore violation of this inequality by some quantum predictions implies that either (i) the predictions do not allow a local realistic model, or (ii) the predictions do not have the required EPR correlations, or finally both (i) and (ii). In this chapter, Card suggests that the non-ideal part of Rawls’ Law of Peoples can be a resource for thinking about responding to evils when the subject is not state-centered. It is plausible that defense against great evils other than those of aggressive states should be governed by analogues of scruples that Rawlsian well-ordered societies observe in defending themselves against outlaw states. This essay explores those (...) hypotheses in relation to women’s self-defense and mutual defense against evils of misogyny, the term feminists apply to the most deeply hostile environments of and attitudes toward women and girls and to the cruelest wrongs to them/us, regardless whether perpetrators harbor feelings of hatred. With growing global concerns about water scarcity and environmental sustainability, understanding the factors influencing individual water conservation behaviors is crucial. This study utilizes the Bayesian Mindsponge Framework (BMF) analytics to investigate the relationship between concerns of local issues and water conservation behaviors in a sample of 1831 residents in Albuquerque, New Mexico, USA. New Mexico is an arid region of which 90% faced severe drought driven by the most significant wildfire in state history and some of the driest (...) months ever recorded in 2022. The results show a positive association between the drought or water scarcity concern and the number of water conservation behaviors adopted. Likewise, the positive association between the concern about population growth and development and water conservation behaviors is also observed. However, further examination is needed due to the weak reliability of this relationship. In contrast, negative associations between concerns about water quality and water bills with water conservation behaviors are also identified. Based on these findings, the study discusses the potential of building the eco-surplus culture by improving information dissemination of water-saving methods and existing water-related issues in the local areas. It is a significant attempt to bring religion and psychiatry into conversation. With particular reference to three Oriental epistemologies—Tibetan and Zen Buddhism and Tantric Hinduism—Caroline Brett seeks to offer a means of differentiating mystical states from (...) psychotic ones. She is critical of reductionism in modern psychiatry that seeks either to elide religious experience into psychopathology, or seeks too sharp a distinction between them. Brett claims, by implication, to offer a more fundamental level of discrimination between religious experience and psychopathology than the "cognitive problem-solving model" that Jackson and Fulford propose (1997a).In both mystical and psychotic states, the author argues, there are radical alterations in the structure of experience. Psychotic states, however, result from failures to complete, or, at least, to negotiate smoothly, the transition from a commitment to an epistemology based on illusory reality to one structured according to ultimate reality—a reality that is brought into focus through an alignment of transcendent vision and mundane cognition. Although this epistemological "stuck-ness" can manifest itself in action as destructive behavior, for example, psychological isolation or social and occupational dysfunction, the basis of the distinction between mystical and psychotic states lies in real differences in the states themselves.In our view, there is a tendency in much psychiatric and theological literature to homogenize mystical states and to treat experiences that (arguably) occur on a number of different levels as if they were on the same level. It is still widely thought that a mystical consciousness can somehow be abstracted from the religious traditions out of which this consciousness emerges. It is assumed that we can talk about experience in abstraction from the shared consciousness produced by schooling in a specific historical religion (Shannon 1985, 493). Analysis of the local implementation of paternity establishment and child support policy in four Wisconsin counties suggests that these policies reproduce some aspects of patriarchal gender relations. The counties' information-collecting practices focused on nonmarital mothers' sexual activity and nonmarital fathers' employment and income. Women were questioned far more extensively than men about their sexual practices and partners; women's accounts of their sexual activity were used to evaluate their overall truthfulness, and administrative practices in effect encouraged alleged fathers to (...) state whether they were convinced of the mother's sexual fidelity. By demonstrating the gendered nature of the terms under which public assistance is granted, the findings highlight the significance of the process of policy implementation for understanding the gendered character of state systems of social provision. In this paper I present and defend Rovelli's relation quantum mechanics from some foreseeable objections, so as to clarify its philosophical implications vis a vis rival interpretations. In particular I will ask whether RQM presupposes a hidden recourse to both a duality of evolutions and of ontology. I then concentrate on the pluralistic, antimonistic metaphysical consequences of the theory, due to the impossibility of assigning a state to the quantum universe. Finally, in the last section I note interesting consequences (...) of RQM with respect to the possibility of defining a local, quantum relativistic becoming.Given the difficulties of having the cosmic form of becoming that would be appropriate for priority monism, RQM seems to present an important advantage with respect to monistic views, at least insofar as far as the possibility of explaining our experience of time is concerned. We propose the quantum field formalism as a new type of stochastic Markov process determined by local configuration. Our proposed Markov process is different with the classical one, in which the transition probability is determined by the state labels related to the character of state. In the new quantum Markov process, the transition probability is determined not only by the state character, but also by the occupation of the state. Due to the probability occupation of (...) the state, the classical relation between the probability and condition probability at different times is no more valid. We have formulated the chain relation of successive transition for transition probability of the quantum Markov process instead of classical Chapman–Kolmogorov equation. The master equation is valid only in a classical Markov process. We have derived Euler-Lagrange equation in operator form as a characteristic equation of motion for the evolution of particle states as a Markov process. (shrink)

Eating locally continues to be promoted as an alternative to growing concerns related to industrialized, global, corporate agriculture. Buying from local famers and producers is seen as a way to promote a healthier diet, reduce environmental impacts, and sustain communities. The promotion of the local food movement presents the question: is it possible to feed a community primarily from the foods produced locally? We conducted a systematic analysis comparing the United States Department of Agriculture’s (USDA) recommended dietary requirements (...) for the estimated 2008 population with annual local agricultural production for the years 2004–2008 within the counties of the Willamette Valley growing region. Our results indicate that current agricultural production in this highly fertile region does not meet the dietary needs of the local inhabitants for any of the USDA’s six food groups: grains, vegetables, fruits, dairy, meat and beans, and oils. In the most recent year of our analysis, 2008, Willamette Valley agriculture production met 67% of annual required grains, 10% of vegetable needs, 24% of fruits, 59% of dairy, 58% of meat and beans, and 0% of dietary oil requirements. Over the past 5 years there have been significant fluctuations in crop production, particularly in 2006 when grain yields dropped to 29% of needs met. Additionally, many of these commodities are exported as cash crops, thus not contributing to meeting local food needs. We discuss these results as well as areas of potential for increasing production of edible crops for local consumption in the region. (shrink)

A rather promising value theory for environmental philosophers combines the well-known fitting attitude (FA) account of value with the rather less well-known account of value as richness. If the value of an entity is proportional to its degree of richness (which has been cashed out in terms of unified complexity and organic unity), then since natural entities, such as species or ecosystems, exhibit varying degrees of richness quite independently of what we happen to feel about them, they also possess differing (...) degrees of mind-independent and subject-independent value. In particular, their value is not dependent on the desires or preferences of humans. The fitting attitudes account of value, at least as it is standardly developed, demands isomorphic evaluative responses on the part of all valuers. In particular, it entails that all valuers should have isomorphic preferences. But this seems absurd. I consider three different strategies with which the fitting attitude theorist can deflect this challenge. The first makes use of an account of non-standard value relations in terms of permissible preference orderings. The second appeals to value appearances and the associated notions of value distance and value perspective. The third involves an account of the ultimate bearers of value as properties, rather than as propositions or states of affairs. These strategies are not all mutually incompatible. While it isn’t possible to combine the first and second strategies, it is possible to combine the first and third strategies, and also to combine the second and the third. (shrink)

This article analyzes the evolution of state capacity in Peru during the recent commodity boom. Peru’s economic growth happened in a context in which inclusive democratic institutions were at play for the longest period ever registered in the country and at a time when political elites decided to invest considerable resources in developing state capacity. This case illustrates how boom-led economic growth can lead to the institutional strengthening of a weak state. However, state capacity continues to (...) be low in Peru. The causal mechanism that yields such continuity differs from those entertained in classic path-dependent explanations of state capacity in Latin America. The article identifies a novel mechanism that helped reproduce the Peruvian path intertemporally. This relational mechanism suggests that state capacity remains low because of the relatively enhanced capacities of state challengers to locally fend off and contest an otherwise much stronger state apparatus. The article argues, on that basis, the need to employ a relational analysis that gauges net state strength with respect to the power acquired by relevant non-state actors who might challenge state authority across different local arenas. Classic conceptualizations of state capacity are indeed relational, but conventional applications are predominantly unilateral and, thus, misleading. Unilateral notions of state capacity are those that focus on either state efforts and investments to assert state capacity or, alternatively, on the presence of challenges that curtail the levels of actually observed state capacity. The adaptive reuse of industrial heritage, a critical component in addressing radical climate change-related urban transitions, is increasingly pertinent. This paper distinguishes ‘urban transitions’ from ‘urban transformation,’ emphasizing a more gradual, adaptive approach to urban development under the pressures of climate change. It explores the repurposing of industrial buildings and spaces, maintaining their cultural and historical value while meeting current urban needs. Through a mixed-methods approach, the paper analyses how adaptive reuse contributes to sustainable urban development, examines the scale and (...) impact of such projects from local quarters to city-wide implications, and discusses the potential negative consequences, including gentrif ication. The study spans various global regions, including Europe, the United States, Latin America, Canada, and Australia, using case studies to illustrate the effectiveness of adaptive reuse in promoting sustainability, revitalizing urban areas, and preserving cultural heritage. The paper questions the viability of traditional long-term sustainable urban development strategies in the face of rapid environmental and societal changes, suggesting a potential need for paradigm shifts in urban planning. Probabilistic Relational Models (PRMs) are a framework for compactly representing uncertainties (actually probabilities). They result from the combination of Bayesian Networks (BNs), Object-Oriented languages, and relational models. They are specifically designed for their efficient construction, maintenance and exploitation for very large scale problems, where BNs are known to perform poorly. Actually, in large-scale problems, it is often the case that BNs result from the combination of patterns (small BN fragments) repeated many times. PRMs exploit this feature by defining these patterns (...) only once (the so-called PRM’s classes) and using them through multiple instances, as prescribed by the Object-Oriented paradigm. This design induces low construction and maintenance costs. In addition, by exploiting the classes’ structures, PRM’s state-of-the-art inference algorithm “Structured Variable Elimination” (SVE) significantly outperforms BN’s classical inference algorithms (e.g., Variable Elimination, VE; Local Conditioning, LC). SVE is actually an extension of VE that simply exploits classes to avoid redundant computations. In this article, we show that SVE can be enhanced using LC. Although LC is often thought as being outperformed by VE-like algorithms in BNs, we do think that it should play an important role for PRMs because its features are very well suited for best exploiting PRM classes. In this article, relying on Faÿ and Jaffray’s works, we show how LC can be used in conjunction with VE and deduce an extension of SVE that outperforms it for large-scale problems. Numerical experiments highlight the practical efficiency of our algorithm. (shrink)

Many state governments in the United States promote locally-produced farm products. This paper discusses issues related to the ethics and equity of such promotional programs. The paper argues that generic promotion is generally easier to justify in terms of ethics and equity than brand promotion. It also argues that informative and factual brand promotions are easier to justify than deceptive and persuasive brand promotions. Additional equity issues arising when taxpayers finance state-promotional programs are also discussed.

This paper argues that Twin Earth twins belong to the same psychological natural kind, but that the reason for this is not that the causal powers of mental states supervene on local neural structure. Fodor’s argument for this latter thesis is criticized and found to rest on a confusion between it and the claim that Putnamian and Burgean type relational psychological properties do not affect the causal powers of the mental states that have them. While it is true that (...) Putnamian and Burgean type relational psychological properties do not affect causal powers, it is false that no relational psychological properties do. Examples of relational psychological properties that do affect causal powers are given and psychological laws are sketched that subsume twins in virtue of them instantiating these relational properties rather than them sharing the narrow contents of their thoughts. Inspired by a framework of multi lingual sequent calculus, we introduce a formal logical system called locally continuous sequent calculus to represent _L_-domains. By considering the logic states defined on locally continuous sequent calculi, we show that the collection of all logic states of a locally continuous sequent calculus with respect to set inclusion forms an _L_-domain, and every _L_-domain can be obtained in this way. Moreover, we define conjunctive consequence relations as morphisms between our sequent calculi, and prove (...) that the category of locally continuous sequent calculi and conjunctive consequence relations is equivalent to that of _L_-domains and Scott-continuous functions. This result extends Abramsky’s “Domain theory in logical form” to a continuous setting. (shrink)

Quantum mechanics introduces the concept of probability at the fundamental level, yielding the measurement problem. On the other hand, recent progress in cosmology has led to the “multiverse” picture, in which our observed universe is only one of the many, bringing an apparent arbitrariness in defining probabilities, called the measure problem. In this paper, we discuss how these two problems are related with each other, developing a picture for quantum measurement and cosmological histories in the quantum mechanical universe. In order (...) to describe the cosmological dynamics correctly within the full quantum mechanical context, we need to identify the structure of the Hilbert space for a system with gravity. We argue that in order to keep spacetime locality, the Hilbert space for dynamical spacetime must be defined only in restricted spacetime regions: in and on the (stretched) apparent horizon as viewed from a fixed reference frame. This requirement arises from eliminating all the redundancies and overcountings in a general relativistic, global spacetime description of nature. It is responsible for horizon complementarity as well as the “observer dependence” of horizons/spacetime—these phenomena arise to represent changes of the reference frame in the relevant Hilbert space. This can be viewed as an extension of the Poincaré transformation in the quantum gravitational context. Given an initial condition, the evolution of the multiverse state obeys the laws of quantum mechanics—it evolves deterministically and unitarily. The beginning of the multiverse, however, is still an open issue. (shrink)

The processes of post-socialist transformation, especially large-scale migration from Eastern Europe to the Western hemisphere, are creating an ‘expansion of space’ from the local to the supra-local. This process involves the expansion of personal-, familial- and friendship-based networking practices which acquire significance as transnational mobile livelihoods and as significant dimensions of urban dynamics in global cities like Chicago. What are the networks, attachments and social bonds of Eastern European migrants in Chicago? Ethnographic fieldwork conducted in Chicago in 2013 (...) among recent Lithuanian immigrants brought out the importance of a cultural identity of East European-ness involving contested loyalties and limited integration. While living locally, Lithuanian immigrants are expected both to be bound to the ethnic community and to be immersed in the multicultural life-style of the mega city. However the research has shown that livelihoods and social relations among ‘one’s own people’ are involved in trans-ethnic networks and that the bonds of intimacy and the alliances among ‘one’s own people’ run through homeland roots and patrimonial linkages rather than through the citizenship loyalties of the state (the United States and/or Lithuania). The circle of ‘one’s own people’ implies extensive reciprocity and social networking among ‘friends’ and co-workers based on ‘one’s own resourcefulness’ a kind of social capital. Thus, ‘sharing important acquaintances’ ought to involve ‘doing favours’ and livelihood experiences transplanted from oversees are practised in Chicago as ‘local’ life-styles and are used for transnational networking, securing in the process the social status of those involved. Land-based climate mitigation schemes such as REDD+ imply the creation of ‘rights to carbon’ for actions that enhance carbon sinks. In many cases, the legal and normative foundations of such rights are unclear. This article focuses on special rights on the basis of improvement. Considering improvement in relation to carbon sinks requires asking what it means to ‘improve’ an environmental resource. Our answer departs in two significant respects from the standard conception of improvement, namely by reconceiving action in relation to (...) ecosystem services, and accordingly, making the case for a counterfactual baseline to be used to compare an improved and unimproved state. Our modifications potentially allow for a variety of agents to claim special carbon rights on the basis of beneficial interactions with land-based carbon sinks. We give three archetypical examples of agents who may claim pro tanto special rights to carbon based on their interaction with carbon sinks. (shrink)
