Der zentrale Satz des christlichen Glaubens scheint schon lange wie ein leerer Allgemeinplatz, der seine Bedeutung für unser modernes Selbstverständnis verloren hat: Gott ist die Liebe und als Liebe offenbart er sich uns in Jesus von Nazareth. Gerade angesichts dieser augenscheinlichen Belanglosigkeit lohnt es sich jedoch, eine entscheidende Frage zu stellen: Was könnte es für den Menschen bedeuten, wenn dieser kurze Satz tatsächlich wahr wäre? Wahr nicht im Sinne messbarer Daten, sondern viel grundlegender: Wahr in Hinsicht auf mein Handeln, wahr (...) für die mir aufgetragene Gestaltung meines Lebens und die Verantwortung, die mir dabei zukommt. Mittels zentraler Begriffe wie Liebe und Treue, Gewissen und Autonomie, Schöpfung und Erlösung möchte der vorliegende Band ein Koordinatensystem des Denkens skizzieren, das den Leserinnen und Lesern dabei hilft, selbst über diese Grundfrage der Moraltheologie nachzudenken. The contribution focuses on the question of the proper relationship between law and morality or secular law and natural law as its pre-positive foundation. The reflection on this fundamental question of legal ethics will be accompanied by an attempt to determine the possible relationship between theological ethics and secular law. The starting point for the pursuit of these questions are the reflections of St. Augustine (354 – 430) on the relationship between faith in God and the obligation of law, which (...) he develops in the context of his great work De civitate Dei and a theology of history in its wake. More precisely, it is the juxtaposition of two kingdoms or citizenships through which the Latin church father lays the foundation for many further conceptualizations between law and ethics: He distinguishes between the ideal state of God (civitas Dei) on the one hand, whose citizens strive to restore the original state of love in the bond with God, and the factually existing earthly state (civitas terrena) on the other hand, whose goal is to guarantee minimal conditions of human life in a state of justice (status iustitiae). The preceding considerations on the relationship between law and morality in the horizon of theological ethics can then be summarized in a concise way by the example of Christian marriage theology. Christian marriage, as a legal institution and sacrament in equal measure, reflects precisely this tension between law and morality. (shrink)

Nietzsche’s Birth of Tragedy overcomes the opposition between scientific optimism and Schopenhauerian pessimism with the image of a music-making Socrates, who symbolizes the aesthetic affirmation of life. This article shows how the aesthetic ideal is an illusion whose metaphysical solace undermines itself in being recognized as such, thereby ceasing to be comforting. While I agree with recent commentaries that contest the pervasive Schopenhauerian reading of The Birth, most of these commentaries still support the view that Nietzsche wishes to communicate some (...) fundamental truth about nature or meaning in life. By contrast, I argue that he treats any such truth as a cultural fiction emerging from the poetic staging of reality, leaving us with a contradiction of appearances deprived of any intelligible ground. Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer (...) class='Hi'>Peter van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. Both the concept of a Darwinian tree of life (TOL) and the possibility of its accurate reconstruction have been much criticized. Criticisms mostly revolve around the extensive occurrence of lateral gene transfer (LGT), instances of uptake of complete organisms to become organelles (with the associated subsequent gene transfer to the nucleus), as well as the implications of more subtle aspects of the biological species concept. Here we argue that none of these criticisms are sufficient to abandon the valuable TOL concept (...) and the biological realities it captures. Especially important is the need to conceptually distinguish between organismal trees and gene trees, which necessitates incorporating insights of widely occurring LGT into modern evolutionary theory. We demonstrate that all criticisms, while based on important new findings, do not invalidate the TOL. After considering the implications of these new insights, we find that the contours of evolution are best represented by a TOL. (shrink)

This volume includes Felix Noeggerath's dissertation from 1916, published here for the first time in a reliable critical edition. The dissertation represents a daring and far-reaching re-conceptualization of Kantian and neo-Kantian thought that consists in "critique of anti-rationalism," especially in the form of vitalism. Both Kant's and Hermann Cohen's philosophies can be experienced anew through the far-reaching optic that Noeggerath developed - an optic that he reiterates and develops into a comprehensive theory of art in a 1951 essay - republished (...) here, as well. The introduction by Hartwig Wiebebach provides an overview and incisive analysis of Noeggerath's philosophical program, while the afterword by Peter Fenves describes in detail the effect of Noeggerath's thought on Walter Benjamin's own attempts at a critique of anti-rationalism. Altogether, the volume provides a new point of access to the important legacy of neo-Kantian thought in the early twentieth century not only in terms of the systematic philosophy, but also in relation to the theory of art and the philosophy of modern science. For more than thirty years, in most of the world, the irreversible cessation of all brain function, more commonly known as brain death, has been accepted as a criterion of death. Yet the philosophical basis on which this understanding of death was originally grounded has been undermined by the long-term maintenance of bodily functions in brain dead patients. More recently, the American case of Jahi McMath has cast doubt on whether the standard tests for diagnosing brain death exclude a condition (...) in which the patient is not dead, but in a minimally conscious state. I argue that the evidence now clearly shows that brain death is not equivalent to the death of the human organism. We therefore face a choice: either we stop removing vital organs from brain dead patients, or we accept that it is not wrong to kill an innocent human who has irreversibly lost consciousness. In 1931, the young Kurt Gödel published his First Incompleteness Theorem, which tells us that, for any sufficiently rich theory of arithmetic, there are some arithmetical truths the theory cannot prove. This remarkable result is among the most intriguing in logic. Gödel also outlined an equally significant Second Incompleteness Theorem. How are these Theorems established, and why do they matter? ABSTRACT In Germany, applied ethics is under attack from a diverse coalition of left‐wing organisations, disability groups, and some conservative defenders of a strict doctrine of the sanctity of human life. The attack has been pressed to the point of forcing the cancellation of conferences and disrupting lectures or classes so that they cannot take place. This essay describes the extent and nature of the attack, and makes a preliminary assessment of its significance.

Chaotic dynamics has been hailed as the third great scientific revolution in physics this century, comparable to relativity and quantum mechanics. In this book, Peter Smith takes a cool, critical look at such claims. Peter Szondi´s pathbreaking work is a succinct and elegant argument for distinguishing between a philosophy of the tragic and the poetics of tragedy espoused by Aristotle. The first of the book´s two parts consists of a series of commentaries on philosophical and aesthetic texts from twelve thinkers and poets between 1795 and 1915: Schelling, Hölderlin, Hegel, Solger, Goethe, Schopenhauer, Vischer, Kierkegaard, Hebbel, Nietzsche, Simmel, and Scheler. The various definitions of tragedy are read not so much in terms of their (...) specific philosophies, but rather in the way their views assist in analyzing tragedies with an aim to establish a general concept of the tragic. The second part presents exemplary analyses of eight tragedies: Sophocles’Oedipus Rex, Calderon´s Life Is a Dream, Shakespeare´s Othello, Gryphius´ Leo Armenius, Racine´s Phaedra, Schiller´s Demetrius, Kleist’s The Schroffenstein Family and Büchner’s Danton's Death. The readings neither presuppose a concept of the tragic determined by context (as in Hegel's idea of the conflict between two orders of right), nor do they focus exclusively on the texts´ explicit contents. Instead, they elaborate the dialectical or aporetic structures at the heart of the tragic.
