Reviews the basic Catholic moral principles that apply to health care, then uses them to assess three major current trends in the health care industry.

Though we often “fear the worst”, worrying that unexpectedly bad things will happen, there are times when we “hope for the best”, imagining that unexpectedly good things will happen, too. The paper explores how the valence of the current situation influences people's imagining of unexpected future events when participants were instructed to think of “something unexpected”. In Experiment 1, participants (N = 127) were asked to report unexpected events to everyday scenarios under different instructional conditions (e.g., asked for “good” or (...) “bad” unexpected events), and manifested a strong negativity bias in response to non-valenced instructions (i.e., being asked to “think of the unexpected” with no valence given). They mainly reported quite “predictable” unexpected outcomes that were negative; however, a post-test (N = 31) showed that the scenarios used were predominantly positive. In Experiment 2 (N = 257), when participants were instructed to think of “something unexpected and bizarre”, under the same instructional manipulations as Experiment 1, this negativity bias was replicated. In Experiment 3, using a design in which positive/negative materials were matched (verified by a pre-test, N = 60), it was found that when participants (N = 102) were given negative scenarios, they reported more positive events than they do when they are given positive scenarios. Though responding still retained an overwhelming negative bias, this result provided some evidence for a weaker valence-countering strategy; that is, where a negative scenario can lead to positive unexpected events being mentioned, and a positive scenario leads to negative unexpected events being reported. The implications of these results for people's projections of unexpected futures in their everyday lives is discussed. (shrink)

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Nanomedicine is yielding new and improved treatments and diagnostics for a range of diseases and disorders. Nanomedicine applications incorporate materials and components with nanoscale dimensions where novel physiochemical properties emerge as a result of size-dependent phenomena and high surface-to-mass ratio. Nanotherapeutics and in vivo nanodiagnostics are a subset of nanomedicine products that enter the human body. These include drugs, biological products, implantable medical devices, and combination products that are designed to function in the body in ways unachievable at larger scales. (...) Nanotherapeutics andin vivonanodiagnostics incorporate materials that are engineered at the nanoscale to express novel properties that are medicinally useful. These nanomedicine applications can also contain nanomaterials that are biologically active, producing interactions that depend on biological triggers. Examples include nanoscale formulations of insoluble drugs to improve bioavailability and pharmacokinetics, drugs encapsulated in hollow nanoparticles with the ability to target and cross cellular and tissue membranes and to release their payload at a specific time or location, imaging agents that demonstrate novel optical properties to aid in locating micrometastases, and antimicrobial and drug-eluting components or coatings of implantable medical devices such as stents. ABSTRACTIn 2001, Julian Savulescu wrote an article entitled ‘Procreative Beneficence: Why We Should Select the Best Children’, in which he argued for the genetic selection of intelligence in children. That article contributes to a debate on whether genetic research on intelligence should be undertaken at all and, if so, should intelligence selection be available to potential parents. As such, the question of intelligence selection relates to wider issues concerning the genetic determination of behavioural traits, i.e. alcoholism. This article is designed (...) as an engagement in the intelligence selection debate using an analysis of Savulescu's arguments to raise a series of problematic issues in relation to the ethics of parental selection of intelligence. These problematic issues relate to wider assumptions that are made in order to put forward intelligence selection as a viable ethical option. Such assumptions are more generic in character, but still relate to Savulescu's article, concerning issues of genetic determinism, private allocation and inequality, and, finally, individual versus aggregate justice. The conclusion focuses on what the implications are for the question of agency, especially if intelligence selection is allowed. (shrink)

Simone de Beauvoir's novel She Came to Stay follows Françoise and her partner Pierre as their intimacy becomes increasingly entangled with the young and tempestuous Xavière. Many readings of the novel explain Françoise's bad feeling and eventual violence as symptoms of sexual jealousy. The book has also been read as a veiled autobiography of Beauvoir and Sartre's similar entanglement with Olga Kosakiewicz, so that, very often, Françoise's jealousy is assumed to stand in for Beauvoir's own. This article is about misreading (...) in two ways. First, I argue that the common view that this is a story in part or in whole about sexual jealousy reflects a radical simplification of the emotional and interpersonal dynamics of the “trio.” Second, I argue that this interpretive simplification is in fact common in mainstream readings of nonmonogamous relationships, where “jealousy” is used to name any and all bad feelings in the vicinity of the nonmonogamous relationship, and where that bad feeling is interpreted as caused by the nonmonogamy itself. To conclude, I suggest that She Came to Stay, and particularly its notorious ending, can be seen as Beauvoir's depiction—and refusal—of the misreadings that constitute the “situation” of nonmonogamy in everyday life. The following examines Heidegger’s analysis of world and Dasein from a transcendental perspective. It is argued that Heidegger’s reflections on the interconnected themes of world and Dasein reveal the tensions that exist between the transcendental claims before and after Being and Time and the analysis of worldliness. It begins by looking at Heidegger’s early analysis of Husserl’s critique of psychologism and naturalism, assessing what this tells us about Heidegger’s analysis of world and nature. It subsequently addresses Heidegger’s transformation of Husserlian (...) phenomenology, and intentionality in particular, arguing against interpreters who claim Heidegger’s interconnected concepts of Dasein and world are reducible to one another and hence phenomenologically problematic. In order to respond to this reading, the article examines the twin themes of, on the one hand, transcendental constitutive analysis in Heidegger’s work, Dasein as disclosive and ‘world entering’, and, on the other hand, the centrality of the world and the realm of nature as always more than Dasein’s constitutive relationship to it. In order to understand what Heidegger means by worldliness, the article will look at Heidegger’s reflections on nature as the world’s other, which nonetheless needs to be understood on the basis of worldliness. As much a doubter as a believer, Emily Dickinson often expressed views about God in general—and God with respect to suffering in particular. In many of her poems, she contemplates the question posed by countless theologians and poets before her: how can one reconcile a benevolent deity with evil in the world? Examining Dickinson’s perspectives on the role played by a supposedly omnipotent and all-loving God in a world marked by violence and pain, Patrick Keane initially focuses on her (...) poem “Apparently with no surprise,” in which frost, a “blonde Assassin,” beheads a “happy Flower,” a spectacle presided over by “an Approving God.” This tiny lyric,Keane shows, epitomizes the poet’s embattled relationship with the deity of her Calvinist tradition. Although the problem of sufferingis usually couched in terms of natural disasters or human injustice, Dickinson found new ways of considering it. By choosing a flower as her innocent “victim,” she bypassed standard “answers” to the dilemma in order to focus on the problem in its purest symbolic form. Keane goes on toprovide close readings of many of Dickinson’s poems and letters engaging God, showing how she addressed the challenges posed—by her own experience and by an innate skepticism reinforced by a nascent Darwinism—to the argument from design and the concept of a benevolent deity. More than a dissection of a single poem, Keane’s book is a sweeping personal reflection on literature and religion, faith and skepticism, theology and science. He traces the evolving history of the Problem of Suffering from the Hebrew Scriptures, through the writings of Paul, Augustine, and Aquinas, to the most recent theological and philosophical studies of the problem. This paper describes a theory that explains both the creativity and the efficiency of people's conceptual combination. In the constraint theory, conceptual combination is controlled by three constraints of diagnosticity, plausibility, and informativeness. The constraints derive from the pragmatics of communication as applied to compound phrases. The creativity of combination arises because the constraints can be satisfied in many different ways. The constraint theory yields an algorithmic model of the efficiency of combination. The C3 model admits the full creativity of (...) combination and yet efficiently settles on the best interpretation for a given phrase. The constraint theory explains many empirical regularities in conceptual combination, and makes various empirically verified predictions. In computer simulations of compound phrase interpretation, the C3 model has produced results in general agreement with people's responses to the same phrases. (shrink)

ABSTRACTThis article examines Heidegger's assessment of negativity and finitude in the late 1930s and his enlargement of these issues in the name of a leap from one type of philosophy, one type of beginning, to a wholly other beginning. The guiding concerns of this article are negativity, finitude and the leap, and how these overlapping concerns coalesce around Heidegger's attempts to move towards a wholly other type of philosophy; in fact, one which no longer understands itself to be philosophy at (...) all. For Heidegger, world is constitutively bound up with human being’s way of being. Yet after Being and Time he criticizes an excessively one-sided pragmatic reading of his concept of world, insisting that world is more than a referential totality of use involvements, tools, or existential projections. This article examines how Heidegger’s phenomenological analysis should be understood to promote both a practical orientation as well as a more transcendental dimension. The centrality of praxis in Heidegger’s work will not be contested. What (...) will be explored is whether what Heidegger calls “worldliness” or the “phenomenon of world” can be reduced to contexts of use relations or social practices and projects. The argument is made that world, for Heidegger, should be understood as an open space of meaning emergence through which diverse activities, some of which are practical, first become accessible to the human being. The claim will be advanced that world is more than the human being’s disclosive understanding and that an overly pragmatic interpretation circumvents the surpassive dimension of world. (shrink)

This paper explores the situated body by briefly surveying the historical studies of effect and of affect which converge in current work on attention. This common approach to the situated body through attention prompted the coining of a more inclusive term, Effect, to indicate the situated body's mode of observation. Examples from the work of artist-turned-architects, Arakawa and Gins, will be discussed to show how architectural environments can act as heuristic tools that allow the situated body to research its own (...) conditions. Rather than isolating effect from affect, observer from subject, organism from environment, Arakawa and Gins' work optimises the use of situated complexity in the study of the site of person. By constructing surrounding in which to observe and learn about the shape of awareness, their procedural architecture suggests ways in which the interaction of top-down conceptual knowledge and bottom-up perceptual learning may construct possibilities in emergent rather than programmatic ways. This paper addresses a hitherto unexamined issue in the work of Michel Henry, namely, his critical interpretation of Martin Heidegger’s analysis of “appearing” and “speaking.” Throughout his distinguished career, Henry went to great philosophical lengths to distance himself from traditional phenomenology and from the work of Heidegger. However, for the most part, Henry’s critical reading of Heidegger has received little attention from phenomenologists and even that has been cursory. Hence, the central aim of this paper is twofold: (1) to show (...) that Henry’s critique of the “appearing” and “speaking” of the world remains unanswered; and (2) to show that a proper reading of Heidegger throws light on the shortcomings of Henry’s own project. Hence, because the second objective follows necessarily from having achieved the first, this paper submits that what is first needed is a re-assessment of Henry’s critique in light of a more accurate understanding of the depth-dimension of “appearing” and “speaking,” which is, I argue, evinced in the analysis of the voice of conscience in Being and Time. The paper subsequentlyoffers what I see as a more appropriate interpretation of the call of conscience in terms of a radicalised “transcendence in immanence” which is not reducible to the mere exteriority of inner-worldly beings. The paper concludes by arguing that the voice of conscience underscores the shortfalls of Henry’s critique of the “appearing” and “speaking” of the world in Heidegger. (shrink)

Institutional Review Boards are confronted with new challenges in the face of expanding technologies while fulfll-ing their existing regulatory mandate to ensure that plans are in place to protect subjects and to inform them of risks and benefts of research participation. Existing regulations and guidance do not address the issue of incidental fndings , thus leaving awareness of the issue and the application of ethical principles to IRB judgment alone. In order to assure that researchers are aware of the potential (...) for IFs, IRBs must identify which studies are likely to identify IFs and establish what plans should be put into place prior to study initiation to assure the subjects are appropriately informed of the likelihood of IFs, how IFs will be communicated to subjects, and whether the burden of follow-up falls on the researchers or is the subject's responsibility. The following examines the concept of time in Gadamer’s work, looking specifically at the role of artwork and festival as focal points of his temporal analysis. It is argued that the usual way of understanding Gadamer’s reflections on time as either “empty” or “fulfilled,” while accurate, need to be supplemented by a third species of time which is neither “full” nor “empty,” pointing instead to the underappreciated role of eternity in his thought. Eternity in this instance is not the other (...) or the outside of time, as one finds in various traditional metaphysical determinations. It is rather intended as the vast and unending time of the cosmos, hinted at in the experience of artwork and festival. (shrink)

This article pursues Heidegger’s protracted engagement with the question of silent origins. First, I explore the so-called transitional thinking grounded in the fundamental attunement of reticence as it is put forward in the Beiträge zur Philosophie. Second, I consider the complex matter of Heidegger’s reference to the intimate, yet distinct, roles of poetry and thinking when it comes to articulating a response to the attunement of reticence. I then move to explain what is at stake in Heidegger’s engagement with Hölderlin (...) on the nature of language, silence, and listening. This latter task involves analyzing Heidegger’s contention that Hölderlin’s poetic thought is both philosophically exemplary and futural. Finally, since I take Heidegger’s interpretation of Hölderlin to be a critical appropriation, we must assess the coherence of his redeployment of Hölderlin’s thought models, especially, I will claim, his appropriation of the halfgods. In his book A Theory of Sentience, Austen Clark argues that the content of sensory representations can be expressed as sentences constructed from a language of sentience. Such sentences specify that a determinate feature obtains in a particular space-time region, but the language's limited vocabulary prohibits the sentences from referring or attributing features to objects. In this paper, I show that this view is flawed in at least two ways. First, if sensation has the capacities that Clark and others attribute (...) to it, then the vocabulary of sense extends further than he supposes, and a limited language of sentience cannot justify a prohibition of object representation within sentience. Second, even if the language of sentience is as impoverished as he claims, and thus even if the representational capacity of sentience is correspondingly limited, object individuation can plausibly occur at the level of sensation. In the course of defusing Clark's major argument for an “object-less” theory of sentience, I offer reasons to believe both that sensory representations can be impressively sophisticated in what they say about the world, and that object representations can be surprisingly basic. Se presenta un total de once tesis, siguiendo el esquema literario, que no político, de las tesis de Marx sobre Feuerbach, con el propósito de fomentar discusiones originales entre losdetractores y defensores de la sociedad civil. A lo largo de estas once tesis se explora el papel que históricamente se le ha atribuido al mercado (...) en la sociedad civil, y se analizanlos motivos por los cuales las visiones actuales de la sociedad civil se basan por lo general en concepciones puristas que excluyen al mercado de dicha esfera. A partir de ahí se argumenta contra estas visiones de sociedad civil que se consideran erróneas por motivos tanto conceptuales como por errores de carácter estratégico. Finalmente, se defiende la necesidad de interpretar el mundo de un nuevo modo y formular nuevas propuestas de cómo los mercados pueden hoy en día ser re-incrustados en la sociedad civil con tal de fomentar la libertad y la igualdad entendidos en términos complejos.This article reflects on the concept of civil society with a focus on the debate over the appropriateness of incorporating markets into its conceptualisation. Eleven theses are presented following the literary, not political, style of Marx’s theses on Feuerbach, aimed to trigger original discussions between the critics and defenders of civil society. Through these eleven theses, the article explores the role historically attributed to the market in civil society, and analyses the reasons why current visions of civil society are generally based on purist conceptions that exclude the market from this sphere. From this point, arguments are made against these visions of civil society, considered to be mistaken for both conceptual motives and strategic-type errors. Finally, the paper defends the need to find a new way of interpreting the world and to formulate new proposals about how markets can be re-embedded in civil society so as to promote the freedom and equality understood in complex terms. The article examines such issues as the poet as mediator, Heidegger’s non-dialectical employment of mediation and the limits of mediation, nature and the holy, the fundamental attunement of ‘holy mourning,’ the dangerousness of language, and the relation between humans and gods. The following examines Hannah Arendt’s interpretations of Greek thought, specifically her phenomenological reading of Homer and Socrates as proto-phenomenological thinkers of objectivity, plurality, and logos. Drawing inspiration from these thinkers, Arendt finds the means of preserving and actualizing plurality as the existential truthfulness that emerges from the conflict in speaking and acting with others. She does this by contrasting how, after the trial and death of Socrates, thinking became professional philosophy and shifted its focus from the reciprocal interdependence of thinking, (...) speaking, and acting well in the polis and towards a reflection on truth, unity, and necessity that takes its start from an ontological order that is either prior to or beyond the world of appearances. Engaging with the literature, this article examines and assesses Arendt’s claims and focuses on the themes of plurality, conflict, and speaking, as set out in her interpretations of Homer and Socrates. This chapter looks at the genesis of Heidegger’s reflections on affect, embodied speaking together, the nature of possibility and the critique of actuality, which form the soil in which the later existential analysis of Being and Time sinks its roots. These original reflections are to be found in the 1924 summer semester lecture course entitled Basic Concepts of Aristotelian Philosophy. On the basis of this, the chapter shows how the early lectures help us understand what happens to Heidegger’s reflections on (...) affect, dynamis, and being together with others, shaping the development of his later critique of the metaphysics of actuality in both Being and Time and in the Contributions to Philosophy. Surprise has been explored as a cognitive-emotional phenomenon that impacts many aspects of mental life from creativity to learning to decision-making. In this paper, we specifically address the role of surprise in learning and memory. Although surprise has been cast as a basic emotion since Darwin's (1872) The Expression of the Emotions in Man and Animals, recently more emphasis has been placed on its cognitive aspects. One such view casts surprise as a process of “sense making” or “explanation finding”: metacognitive (...) explanation-based theory proposes that people's perception of surprise is a metacognitive assessment of the cognitive work done to explain a surprising outcome. Or, to put it more simply, surprise increases with the explanatory work required to resolve it. This theory predicts that some surprises should be more surprising than others because they are harder to explain. In the current paper, this theory is extended to consider the role of surprise in learning as evidenced by memorability. This theory is tested to determine how scenarios with differentially surprising outcomes impact the memorability of those outcomes. The results show that surprising outcomes (less-known outcomes) that are more difficult to explain are recalled more accurately than less-surprising outcomes that require little (known outcomes) or no explanation (normal).
