Determining whether a person who appears to have committed an offence should then be prosecuted for it requires a number of assessments and weighing of interests. Yet, to read the latest Code for Crown Prosecutors, one would think that the exercise of prosecutorial discretion is a relatively unstructured process. This is because the Code does not require prosecutors to identify an aim in seeking the punishment of the accused, and because it does not distinguish between the harms caused to the (...) defendant by punishment and the distinct harms which are caused to him by prosecution. I shall argue that the aim of the prosecutor (assuming that guilt will be proven) should be to decide whether the aims of punishment of the accused would be justified by the likely costs of the proceedings, but that this aim may be constrained by considering the harms which may be caused to the defendant by prosecution. If this structure were to be accepted, then it would both be easier to draft a Code for Crown Prosecutors which has useful guiding value and to identify to whom the prosecutor should be accountable for his decisions. Approximately 6000 men die every year from ruptured abdominal aortic aneurysm in England and Wales. Randomised clinical trials and a large pilot study have shown that ultrasound screening of men aged 65 years can prevent about half of these deaths. However, there is a significant perioperative morbidity and mortality from interventions to repair the detected aneurysm. This paper explores the ethical issues of screening men for abdominal aortic aneurysm. It is concluded that a population screening programme for abdominal aortic aneurysm (...) offers a clear balance of good over harm. It is therefore ethically justified, as long as men are given adequate information at every stage of the process. Each man has the right to be properly informed, regardless of whether he accepts the invitation to be screened and, if an aneurysm is detected, whether or not he accepts treatment. (shrink)

Hume’s History of England has received a good deal of attention over the years, but no one has ever systematically studied his sources.1 Instead, scholars have worried about Hume’s biases, his portraits of figures like Charles I, and his alleged scorn for mere antiquarianism, which resulted in a readable but superficial history. The most exciting monograph dealing with his History of England in recent years sees it as a step in the process which led to nineteenth-century historicism. This paper's philosophical ideas are developed from a General Nursing Council for England and Wales Trust‐funded study to explore nursing knowledge and wisdom and ways in which these can be translated into clinical practice and fostered in junior nurses. Participants using Carper's (1978) ways of knowing as a framework experienced difficulty conceptualizing a link between the empirics and ethics of nursing. The philosophical problem is how to understand praxis as a moral entity with intrinsic value when so much of value (...) seems to be technical and extrinsic depending on desired ends. Using the Aristotelian terms poesis and praxis can articulate the concerns that the participants as well as Carper (1978) and Dreyfus (in Flyvbjerg, 1991) among others share that certain actions or ways of knowing important for nursing are being devalued and deformed by the importance placed on quantitative data and measurable outcomes. The sense of praxis is a moralized one and most of what nurses do is plausibly on any account of normative ethics a morally good thing; the articulation of the idea of praxis can go some way in showing how it is a part of the discipline of nursing. Nursing's acts as poesis can be a part of how practitioners come to have praxis as phronesis or practical wisdom. So to be a wise nurse, one needs be a wise person. (shrink)

Recent years have witnessed a renewed scholarly interest in David Hume’s History of England (1754–1762), and this essay adds to that interest by analyzing the sources that Hume used in the History. Unfortunately, Hume did not provide a bibliography or guide to those sources, and no scholar has produced one since. We have been preparing a bibliography for publication and the following essay is a preliminary view of some of what it will show. This study aims to examine the perceptions of Black, Asian and Minority Ethnic staff in English local government on the ethical nature of their treatment at work, and its mediating effect on their Public Service Motivation. This is a particular imperative in a sector which itself delivers social justice within a strong regulatory system designed to ensure workplace equality and therefore is expected to be a model employer for other organisations. Employees place great importance on their fair treatment by their (...) employers and, in particular, the endeavour of managerial authority to implement equality at work based on their discretionary powers. 2580 valid responses were collected from 15,000 questionnaires sent to staff in five local councils in England. Our analyses show that BAME employees have a significantly stronger PSM than their white colleagues; however, this has been eroded by their perception of unfair treatment: being underpaid allied with a lack of effort from management to ensure an equal work environment, to be specific, to prevent discrimination, bullying, and racism at workplace. Most importantly, the perceived exertion made by management to ensure an equal work environment has a significantly strong mediating effect on PSM and a compensational effect on perceived lower pay. Despite the increasing focus on rationing, and rationing decisions in the NHS, little attention has been given to patient's perceptions of rationing and the potential impact this might have on people's use of services. Drawing on the qualitative findings of a study conducted in the North West of England which was concerned with the pattern and processes of primary care help seeking, this paper sets out to examine perceptions and experiences of rationing in primary care and the potential impact this (...) has on people's use of services. In relation to primary care services people had experienced rationing by deterrence, dilution and delay. There was some evidence that perceptions of rationing impacted on help seeking and the use of primary care services. The implications for understanding the way in which perceptions of rationing might influence the formulation of demand and help seeking by people using primary care services are discussed. (shrink)

Herbert McCabe, OP (d. 2001), was a significant theological figure in England in the last century. A scholar of Aquinas, he was also influenced by Wittgenstein and Marx, his reading of whom helped him articulate a distinctive Thomistic account of human embodiment that serves as a critique of other dominant approaches in ethics. This article shows McCabe's contribution to moral theology by placing his work in conversation with other important approaches, namely, situation ethics, proportionalism, and the New Natural Law Theory.

The article aims to show the value of taking ecclesiology – the theology of the church – into account in the study of British imperial ideology by describing how Anglican intra-ecclesiological debates shaped mid-nineteenth-century discourse about the British Empire. It highlights the impact of the Oxford Movement on the mind of the British colonial administrator Sir Frederic Rogers, Lord Blachford (1811-1889), by revealing the connections between his imperial thought and concepts arising from Tractarian ecclesiology. In particular, it argues that Rogers’ (...) understanding of British colonial development builds on Tractarian ideas of balance and consistency. By retaining a sense of the importance of the historic connection with the colonies of settlement while respecting their right to be free, Rogers constituted the imperial relationship as a _ via media. _. did roger bacon and peter john olivi ever meet? We suggest a positive answer to this question. After he became a Franciscan in 1257, Roger Bacon spent ten years at the Franciscan Paris convent. In those years he wrote the De multiplicatione specierum —his most thought-out piece—the Opus majus, Opus minus, and Opus tertium, which he completed by early 1268. It is not clear whether Bacon returned to England after 1268, or remained in Paris until 1280.1 Peter John (...) I will do so, however, from the perspective of Roger Bacon – the Doctor Mirabilis – a friar who held his Order's education system in contempt. His scathing attacks included equally strong words for the Augustinians, Carmelites and (...) Dominicans, whom he lumped together with the Franciscans and dismissed as the ordines puerorum. Although he was a Franciscan, let me assure you that Bacon did not intend the "order of young boys" to be an endearing description of his confreres – but more about this later.Bacon's sharpest attacks are found in his Compendium studii philosophiae, written around 1271-1272. For those of you who are not familiar with this English friar, let me sketch out his biography. In all seriousness, what we know of his provenance, education, and career is indeed sketchy. Depending on how we read selected autobiographical remarks, he was born around 1214 or 1220 and died around 1292. After studying in Oxford, he became one of the first masters to comment on Aristotle in the Faculty of Arts in Paris during the 1240s and subsequently returned to England. Whether it was there, or perhaps later in France that he entered the Minorite Order is uncertain, nevertheless we find him in the Franciscan habit in 1256 and living in Paris. It will be from the vantage point of Paris that Brother Bacon will argue for radical curricular reform and critique the prevailing mendicant educational system. Later, perhaps back in England after 1268, he continues his criticism until his death in 1292.As I begin, allow me a few moments to explain why I think Bacon's critique should not be ignored by Franciscans nor relegated to an obscure footnote by educators. To offer a critique of a position, belief, or view is something that is to be expected from those in colleges and universities who have been educated in what we call "critical thinking." However, as Michael Roth noted in The Chronicle of Higher Education, to critique is the beginning, not the end or goal of the process. His article, entitled "Beyond Critical Thinking," warns educators that many of our best students are considered intelligent because of their sharply-honed, acquired ability to take apart, unmask, or deconstruct the beliefs of others. Experts at exorcizing and banishing meaning from firmly held texts, they are likewise unable to find or construct meaning in their own lives from these sources which have inspired, formed, and challenged countless individuals through the centuries.Let me offer you an example from my own experience at Flagler College. I have taught everything from Introduction to the Old Testament to upper-level Contemporary Theological Thought. Over the years I have seen that taking a critical approach to the material is crucial, yet there is a corresponding need to assist students along the path toward wisdom through the integration of our academic critique within a coherent worldview. For any number of reasons it is an exhilarating, empowering, and I would say, even a liberating experience for some to learn that the Scriptures are problematic, and thereby open to various interpretations. This opens the door for some to challenge the authority their parents and pastors have wielded over them, while emboldening other students to challenge and even embarrass peers. For example, one of my students discovered that the King James Bible contained John 5:4 which many modern translations eliminated since scholars hold that it was something similar to a gloss. He subsequently challenged others by questioning how they could believe that God had an eternal claim on anyone when scholars were not even sure what parts of the Bible were legitimate, or even true. My intention is to show that, starting from an empiricist philosophy of mind, it is possible to give a systematic account of aesthetic experience. I argue that empiricism involves a certain theory of meaning and truth; one problem is to show how this theory is compatible with the activity of aesthetic judgment. I investigate and reject two attempts to delimit the realm of the aesthetic: one in terms of the individuality of the aesthetic object, and the other in terms of (...) 'aesthetic properties'. I go on to argue that aesthetic descriptions must not be thought to ascribe properties to their objects, and I show how the suggestion that they are non-descriptive need not conflict with the empiricist view of meaning. The problem is then seen to lie with the analysis of the 'acceptance-conditions' of aesthetic descriptions. I counter certain idealist objections to this approach, and then present a theory of imagination, in terms of which the acceptance conditions of aesthetic judgments may be described. This theory attempts to explain how the element of thought in aesthetic appreciation may become inseparable from an experience of its object, and how the aesthetic emotions are both like and unlike their equivalents in life. The first part concludes with an analysis of the general conditions of aesthetic experience. I try to show that aesthetic experience can be described in terms of certain 'formal' properties, independently of its material object. In the second part I am concerned to show that this empiricist theory of aesthetics does not, like most empiricist theories, make nonsense of our appreciation of art. First, I attempt to show that 'understanding' art is not merely a cognitive process, but involves certain experiences that can be accounted for in terms of the previous theory. I then analyse the concepts of representation and expression, and in the course of this analysis I attempt to refute what I take to be the most serious rival analysis of our appreciation of art - the semantic theory. This volume provides a philosophical introduction to and analysis of the study of metaphor. By proceeding from the concrete analysis of complex metaphors, White is able to identify a range of features which are incompatible with standard accounts of the way words function in metaphor.
