Background While most countries that allow abortion on women’s request also grant physicians a right to conscientious objection (CO), this has proven to constitute a potential barrier to abortion access. Conscientious objection is regarded as an understudied phenomenon the effects of which have not yet been examined in Germany. Based on expert interviews, this study aims to exemplarily reconstruct the processes of abortion in a mid-sized city in Germany, and to identify potential effects of conscientious objection. Methods Five semi-structured interviews (...) with experts from all instances involved have been conducted in April 2020. The experts gave an insight into the medical care structures with regard to abortion procedures, the application and manifestations of conscientious objection in medical practice, and its impact on the care of pregnant women. A content analysis of the transcribed interviews was performed. Results Both the procedural processes and the effects of conscientious objection are reported to differ significantly between early abortions performed before the 12th week of pregnancy and late abortions performed at the second and third trimester. Conscientious objection shows structural consequences as it is experienced to further reduce the number of possible providers, especially for early abortions. On the individual level of the doctor-patient relationship, the experts confirmed the neutrality and patient-orientation of the vast majority of doctors. Still, it is especially late abortions that seem to be vulnerable to barriers imposed by conscientious objection in individual medical encounters. Conclusion Our findings indicate that conscientious objection possibly imposes barriers to both early and late abortion provision and especially in the last procedural steps, which from an ethical point of view is especially problematic. To oblige hospitals to partake in abortion provision in Germany has the potential to prevent negative impacts of conscientious objection on women’s rights on an individual as well as on a structural level. In his posthumously published lectures, Politics in Commercial Society, István Hont argues that Jean-Jacques Rousseau and Adam Smith should be understood as theorists of commercial society. This article challenges Hont’s interpretation of both thinkers and shows that some of his key claims depend on conflating the terms ‘commercial society’ and ‘commercial sociability’. I argue that, for Smith, commercial society should not be defined in terms of the moral psychology of commercial sociability, before questioning Hont’s Epicurean interpretation of Smith’s theory of (...) sociability. I then turn to Rousseau and outline some of the difficulties involved with classifying him as a theorist of commercial society, the most important of which is that he often appeared to be more deeply opposed to commercial progress than Hont suggests. I conclude by highlighting some of the most salient differences between Rousseau’s and Smith’s views of the politics of eighteenth-century Europe. (shrink)

The algorithm, a building block of computer science, is defined from an intuitive and pragmatic point of view, through a methodological lens of philosophy rather than that of formal computation. The treatment extracts properties of abstraction, control, structure, finiteness, effective mechanism, and imperativity, and intentional aspects of goal and preconditions. The focus on the algorithm as a robust conceptual object obviates issues of correctness and minimality. Neither the articulation of an algorithm nor the dynamic process constitute the algorithm itself. The debate over the political power of business has witnessed a revival after the global financial crisis of 2007—2009. We begin by arguing that business political fragmentation or unity has important consequences for policy outcomes. The structure of the U.S. government is conducive to incremental policy changes, often in response to business pressures. In turn, these changes shape the political interests and alliances of business. We illustrate this dynamic through an analysis of the political processes leading to the enactment of (...) the Financial Modernization Act of 1999, which repealed Depression-era regulations and allowed commercial banks to enter the securities and insurance business and vice versa. The FMA condoned the emergence of largely unregulated diversified financial institutions, which proved “too big to fail” during the crisis. Several factors contributed to the FMA: political institutions, international competition, the ideological convergence of the Republican and Democratic parties, and the political interests of financial industry actors. In this paper, I critically reconstruct the development of Merleau-Pontyan phenomenology and “radical embodied cognitive science” out of Berlin-School Gestalt theory. I first lay out the basic principles of Gestalt theory and then identify two ways of revising that theory: one route, followed by enactivism and ecological psychology, borrows Gestaltist resources to defend a pragmatic ontology. I argue, however, that Merleau-Ponty never endorses this kind of ontology. Instead, I track his second route toward an ontology of “flesh.” I show how (...) Merleau-Ponty’s arguments for this ontology depend upon criticisms of Gestalt Psychology to which radical embodied cognitive science remains vulnerable, and show that it leads him to a romantic philosophy of nature. Part II is "The Renaissance View of Nature." Part III, "The Modern View of Nature," deals with very recent or contemporary philosophy and science, discerning in it a radical evolutionism first in biology and later in cosmology. Comparative ethics raises theoretical and methodological problems important for all ethical studies. Five essays in this focus section provide introductions to the ethics of specific indigenous cultures and suggest implications for further comparative studies. In this introduction, we review these findings and discuss their relevance to the concept of ethical naturalism which we have previously offered as a basis for comparative work.

Neoliberalism co-opts noisy riots like feminism and hardcore music--can melancholic siren songs fight back?

This thesis examines the nature of the supplementary relationship between Husserlian phenomenology and deconstruction. Chapter 1 gives an account of the strategies and aims of deconstruction, determining these to be an attempt to respond, using ‘other names’, to the other which is excluded by phenomenology/philosophy in its attempts to master its own limits. In Chapter 2, it is found that alterity is encountered by phenomenology on its own thresholds, informing the genetic turn in phenomenology which is necessitated as a result (...) of the inquiries into the temporal constitution which founds the possibility of an object’s being given as such to consciousness. Furthermore, it is shown how the possibility of the genetic turn resides in the indication relation examined in the phenomenology of signification. Chapter 3 focusses on the deconstruction of phenomenology, and investigates the double movement in phenomenology which the deconstruction reveals, taking time and language as guiding threads. On the one hand, the genetic turn appears to reveal a founding alterity, which, on the other hand, phenomenology strives to suppress in accordance with its adherence to its own ‘principle of principles’. It is argued that the deconstruction aims to accord phenomenological respect to the alterity uncovered by phenomenological descriptions. This is done through thematising certain operative concepts, concepts which remain unthemtised in phenomenology precisely because such thematisation would reveal a founding non-presence intolerable to phenomenology. Deconstruction supplements phenomenology to the extent that it attempts to name, on the fissured margins of phenomenology, the radical alterity uncovered by phenomenology in a way which does not reduce the very otherness of the alterity. However, in the final Chapter, it is argued, from the perspective of Levinas, that Derrida does not in fact manage to find a sense for founding alterity in phenomenology which is ‘beyond metaphysics’. The thesis concludes by arguing that, in order to achieve its strategic aims, as detailed in Chapter 1, the deconstruction of phenomenology needs to be ethically supplemenred, one example of such an ethically supplemented deconstructive reading of Husserl being found in some of the most recent texts of Levinas. Using testosterone alone as a measure of dominance presents problems, especially when dominance is loosely defined to include a range of behaviors that may arise from multiple causes. Testosterone should be examined in relation to other hormonal and neurotransmitter factors, such as serotonin. Various hypotheses about the relationship between high and low levels of testosterone with serotonin and with impulse control are suggested for future study.

Many have rejected contextualism about ?knows? because the view runs into trouble with intra- and inter-contextual disagreement reports. My aim in this paper is to show that this is a mistake. First, I outline four desiderata for a contextualist solution to the problem. Second, I argue that two extant solutions to the problem fail to satisfy the desiderata. Third, I develop an alternative solution which satisfies the four desiderata. The basic idea, put roughly, is that ?knowledge? ascriptions serve the function (...) of recommending good informants, and disagreement over ?knowledge? ascriptions is a matter of conflicting recommendations. The upshot is that intra- and inter-contextual disagreement reports provide little?if any?reason to reject contextualism. (shrink)

Epistemic contextualists think that the extension of the expression ‘knows’ depends on and varies with the context of utterance. In the last 15 years or so this view has faced intense criticism. This paper focuses on two sorts of objections. The first are what I call the ‘linguistic objections’, which purport to show that the best available linguistic evidence suggests that ‘knows’ is not context-sensitive. The second is what I call the ‘disagreement problem’, which concerns the behaviour of ‘knows’ in (...) disagreement reports. These may not be the only objections to epistemic contextualism, but they are probably the most influential. I argue that the best current epistemic contextualist response to the linguistic objection is incomplete, and I show how it can be supplemented to deal with the full range of linguistic objections. I also develop a new solution to the disagreement problem. The upshot is that neither sort of objection gives us any reason to reject epistemic contextualism. This conclusion is, in a sense, negative—no new arguments for epistemic contextualism are advanced—but it’s a vital step towards rehabilitating the view. (shrink)

The target of this paper is the ‘simple’ knowledge account of assertion, according to which assertion is constituted by a single epistemic rule of the form ‘One must: assert p only if one knows p’. My aim is to argue that those who are attracted to a knowledge account of assertion should prefer what I call the ‘complex’ knowledge account, according to which assertion is constituted by a system of rules all of which are, taken together, constitutive of assertion. One (...) of those rules—which, following John Searle, I call the ‘preparatory condition’—is of the form ‘One must: assert p only if one knows p.’ All else being equal, simple accounts are preferable to complex accounts. I argue in this paper that all else isn't equal. While the simple knowledge account provides an elegant explanation of certain data, it is hard to see how to integrate the simple knowledge account into a more general theory of illocutionary acts. Can room be found in between the matter and void of a Newtonian universe for an immaterial and immortal soul? Can followers of Locke with his agnosticism about the nature of substances claim to know that some of them are immaterial? Samuel Clarke, well versed in Locke's thought and a defender both of Newtonian science and Christian orthodoxy, believed he could do both and attempted to prove his case by means of some hard-boiled reductionism. Anthony Collins, a deist whose only (...) lapse from materialism concerned God himself, rejected Clarke's argument. In this paper I discuss their controversy' in order to bring out the state of debate about material systems and consciousness among people influenced by Locke and Newton in the early eighteenth century, and I also assess Clarke's reductionist premise, as he himself frequently invites "the impartial reader" to do.
