Contingent valuation surveys have tended to yield results that seem to go contrary to what is standardly seen as 'rational choice'. We argue that some of the inconsistencies arise because bids for public environmental goods in contingent valuation surveys are often motivated by moral considerations and ethical beliefs. We analyse the expected results of CV surveys given the existence of such ethical motivations, including the valuation of actions as well as states. It is found that we cannot expect bids made (...) on this basis to reveal preferences which obey the rules commonly assumed in the theory of consumer choice. The two standard reactions to these anomalies have been to attack the validity of the method, or to urge greater rigour in survey design and application. By contrast, we conclude that the usefulness of the method for evaluating options concerning environmental public goods depends critically on the problem definition. The method should be used for the direct evaluation of realistic policy packages, rather than to try to extract abstract values for invaluable goods. The conclusion accords with current trends, including the move towards the use of deliberative methodologies. (shrink)

Within the context of China, this study seeks to examine the relationship between English language proficiency, the native dialect of the learner, and the learner’s reason, or motivation for learning English. English language proficiency can be an important vehicle for accessing high quality higher education, for interacting with non-Chinese, and for enhancing employment and career opportunities Data was gathered through an online survey with 985 usable responses recorded. Respondents included a distribution of speakers from five of the major distinct dialects (...) of China. The analysis provides empirical evidence of a diversity of propensities and motivations for English language acquisition among learners from different regions and native dialects. Access to international higher education as a type of motivation is found to have a moderating effect on English proficiency. Other findings suggest that learners in regions with more historic exposure to foreign interaction are more likely to be motivated for social reasons, those from regions with export focused commerce will be motivated for business related reasons. The results of this study may be of interest to policy makers, linguists, educators, and those with an interest in socioeconomic sustainability through language acquisition and education as a method of socioeconomic mobility. The essay replies to comments by Finnis, Gardner and Endicott, on my book, Law as a Moral Idea. It is questioned whether Finnis is right to suggest that governance by law is a requirement of justice. It is suggested that Hart's positivism may have rested upon an unduly private conception of morality. Gardner's suggestion that Law as a Moral Idea falsely manufactures disagreement with Hart is rejected, principally by pointing out that Gardner focuses upon only one issue, where (...) the book already acknowledges that Hart might conceivably agree, and ignores other issues where the disagreement with Hart seems indisputable. In response to Endicott, it is acknowledged that 'politics' could be understood as a moral idea comparable to the idea of 'law', but denied that this robs either thesis of interest. The nature of doctrinal reasoning and law's justificatory force is then discussed. (shrink)

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two (...) great lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. This study is an unusual contribution to the philosophy of mind in that it argues for the sometimes unfashionable view of dualism: that mind and matter are distinct and separate entities as Descartes believed. The author takes as his point of departure the imaginative hypothesis of disembodiment, which establishes the possibility of the mind's being a quite non-material thing. There are clear casual correlations between what is physical and what is mental, and the most serious issue confronting dualism since Descartes (...) has been how such an interaction is possible. David Enoch recently defended the idea that there are valid inferences of the form ‘it would be good if p, therefore, p’. I argue that Enoch's proposal allows us to infer the absurd conclusion that ours is the best of all possible worlds.

The late Susan Moller Okin was a leading political theorist whose scholarship tried to integrate political philosophy and issues of gender and the family. This volume stems from a conference on Okin, and contains articles by some of the top feminist and political philosophers working today. Their aim is not to celebrate Okin's work, but to constructively engage with it and further its goals.

Some moral theories, such as objective forms of consequentialism, seem to fail to be practically useful: they are of little to no help in trying to decide what to do. Even if we do not think this constitutes a fatal flaw in such theories, we may nonetheless agree that being practically useful does make a moral theory a better theory, or so some have suggested. In this paper, I assess whether the uncontroversial respect in which a moral theory can be (...) claimed to be better if it is practically useful can provide a ground worth taking into account for believing one theory rather than another. I argue that this is not the case. The upshot is that if there is a sound objection to theories such as objective consequentialism that is based on considerations of practical usefulness, the objection requires that it is established that the truth about what we morally ought to do cannot be epistemically inaccessible to us. The value of practical usefulness has no bearing on the issue. (shrink)

There are two distinct views on how to formulate an objective consequentialist account of the deontic status of actions, actualism and possibilism. On an actualist account, what matters to the deontic status of actions is only the value of the outcome an action would have, if performed. By contrast, a possibilist account also takes into account the value of the outcomes that an action could have. These two views come apart in their deontic verdicts when an agent is imperfect in (...) an avoidable way, viz., when agent brings about less good than she could. In this paper, I offer an argument against actualism that draws on the connection between moral obligation and practical reasons. (shrink)

What did Jesus mean by the expression, the Kingdom of God? As an answer, Kevin Hart sketches a "phenomenology of the Christ" that explores the unique way Jesus performs phenomenology. According to Hart, philosophers and theologians continually reinterpret Jesus’s teaching of the Kingdom so that there are effectively many Kingdoms of God. The central characteristic of denials is that they perform a non-monotonic correction operation on discourse structure. A second characteristic is that they may be used to object to various kinds of information including presuppositions and implicatures. In this paper we first use standard DRT to capture these features, implement an earlier proposal of van der Sandt in DRT and point out a shortcoming of that approach. We then adopt Layered DRT. LDRT is an extension of standard DRT designed to represent (...) and interpret different types of information conveyed in a conversation by distributing them over separate layers of the same LDRS. We will then show how LDRT allows us to solve the problems of the classic monostratal system. The resulting system makes use of a di- rected reverse anaphora mechanism to locate, remove and negate the material objected to. (shrink)

Iconic photographs are visual arguments depicting an, often dramatic, particular situation showing victims of disasters. Spectators watching the photo of the particular situation, empathise with it, and project the feelings evoked onto the events that form the context for the scene in the picture. This mobilises them into political action. In the process, however, the depicted personal misery is perused to exemplify the larger events. The tragedy of iconic photographs is analysed not as the misery experienced by the depicted persons, (...) but as the breach of their right to shame which is required for the photo to acquire iconicity. Examples are addressed, as well as the contrast classes of the self-portrait and Byzantine icons. (shrink)

This paper discusses the viability of claims of mathematical beauty, asking whether mathematical beauty, if indeed there is such a thing, should be conceived of as a sub-variety of the more commonplace kinds of beauty: natural, artistic and human beauty; or, rather, as a substantive variety in its own right. If the latter, then, per the argument, it does not show itself in perceptual awareness – because perceptual presence is what characterises the commonplace kinds of beauty, and mathematical beauty is (...) not among these. I conclude that the reference to mathematical beauty merely expresses the awe in the mathematician about the intricate complexities and simplicity of certain proofs, theorems or mathematical “objects.”. My pleasure in being here, at the Studiecentrum Soeterbeeck, to discuss the book Roger Scruton wrote on beauty, is twofold. It so happens that I am finishing a book on facial expression and facial beauty, and the chapter I sent to Roger to request his comments, resurfaced unopened in my own mail box, last week. Apparently something went wrong in the mail. Today I might get some of those comments. Secondly, reading Roger’s book, an impression of a kindred spirit has (...) stuck with me throughout.1) Sometimes, though, something like an ungrounded preference surfaces, which for Roger, clearly has intuitive force, maybe even the force of a conclusion, but for me this doesn’t always ring true. I only mention two instances where my own preferences would be different. One is, where after rightly criticising the reverence allotted to Duchamp’s Fountain, in a single sentence (on p. 98) both Radiohead and Brahms are mentioned, in an obvious effort to disqualify the former. The other is where he defends film as an art by comparing it to traditional art, by pointing to shots from an Ingmar Bergman movie, which “would sit on your wall like an engraving, resonant, engaging and composed.” (p. 102). What the incidental surfacing of such preferences makes available to us is that doing aesthetics is not a merely technical philosophical endeavour, but involves art criticism, from time to time. If you don’t love art or its core values, how could you do aesthetics? And there is a deeper thought behind this in Roger’s writings: that the use of taste belongs to the good life.2) All this, also, indicates my predicament, here and now. I feel most inclined.. Pessoa et al. (1998a) underexposed the broad and rich variety of stimuli in the amodal completion domain. The disambiguation of occluded shapes depends on very specific figural properties. Elaborations on such disambiguations of rich and complex stimuli, tied up with a visuo-cognitive origin of amodal completion, further position Pessoa et al.'s considerations on neural filling-in and the personal-subpersonal distinction.

The characterization of objective, normative reasons to φ as facts (or truths) that count in favor of φ-ing is widely accepted. But are there any further conditions that considerations which count in favor of φ-ing must meet, in order to count as a reason to φ? In this brief paper, I consider and reject one such condition, recently proposed by Caspar Hare.

Much contemporary art seems morally out of control. Yet, philosophers seem to have trouble finding the right way to morally evaluate works of art. The debate between autonomists and moralists, I argue, has turned into a stalemate due to two mistaken assumptions. Against these assumptions, I argue that the moral nature of a work's contents does not transfer to the work and that, if we are to morally evaluate works we should try to conceive of them as moral agents. Ethical (...) autonomism holds that art's autonomy consists in its demand that art appreciators take up an artistic attitude. A work's agency then is in how it merits their audiences' attitudinal switch. Ethical autonomism allows for the moral assessment of art works without giving up their autonomy, by viewing artistic merit as a moral category and art-relevant moral evaluation as having the form of art criticism. Cellular, or mobile phones are great: they allow people to communicate over long distances whenever and wherever they are, and instantaneously at that when the one called is wearing one too. Having said that, though, it must immediately be added that they, also, have a complex disadvantage, and it is one we are hard pushed to understand. In fact, due to its complexity people simply tend to neglect it, even though everyone in his right mind has had experience with it. (...) Now Walter Benjamin defined aura as “a distance however close it may be”.1) This has standardly been interpreted as a characterisation of an experience of presence, also by Benjamin. This aura supposedly suffered from the rise of photography. Aura can, also, be understood as inertia, the absence of something present. And whether aura is gone or widespread I gladly leave to more speculative-minded thinkers. I submit that we experience a person’s “aura”—her distance however close she may be—when perception tells us the person is present yet our mind realises that she isn’t. I am referring here to the observation had of another person engaged in a cell phone conversation. The inertia of the cell phone caller consists in her incapacity to address those who observe her. I think there is an immoral streak to her selfappointed moral autonomy. In a previous edition of this Dutch-Russian exchange on inertia I argued that our trafficking with facial expressions forms the model with which we’d best understand the workings of art—facial expression is the anthropological foundation of art. My discussion, today, of the cell phone conversation is meant to add to that previous suggestion. (shrink)

In this article I propose to understand inertia in art as a “disposition to meaning”. I compare inertia in art with that of a face of a person recently deceased. To acquaintances, i.e. to family and friends, it holds a promise of memories (of the deceased); to all the others the corpse offers the possibility of a projection of meanings. Art is made of plain, or extra-ordinary stuff, which is turned into artistic material. The artist is to bring the inert (...) potency of stuff to artistic life, and to turn it into something that is expressive. If she is successful, then the work will offer its audience a concentrated, absorbing experience. Art is autonomous in that the aimed for experience is morally neutral. In the view of many contemporary artists, such experiences fail art’s deeper significance: absorbing experiences are, simply, too easy. If artists want to really move the audience (to emotion), or so they feel, they should also move the audience into action. Wanting to achieve this is not just difficult; it is a paradox. (shrink)
