This article explores innovative legal tools in built environment settings. Using tangible examples, the discussion will leverage the authors' expertise in the law, public health, and architecture to explore strategies in domestic and international settings to explain how healthy spaces make a direct public health impact on people's lives.

A workshop in Philosophy for Children was offered this summer at Viterbo College with generous support from the Wisconsin Humanities Committee. Dr. Ronald Reed and the author conducted the week long workshop. The workshop was promoted primarily by distribution of brochures to regional schools. Four questions were addressed in the brochure: What is Philosophy for Children?, How will Philosophy for Children work in your classroom?, Why teach Philosophy for Children?, and Who should attend?. Hunger striking is a form of nonviolent action of last resort. It is a tactic used by powerless individuals to challenge those in power and achieve change. Many authors have emphasized that hunger strikers are not suicidal, but when oppressed people run out of other ways to protest or demand sociopolitical change, some of them are willing to place their health and life at risk to achieve their goals. Hunger strikes have a long, widely diffused history, and studies reveal that (...) they are typically small, brief, and often successful. Background The involvement of pregnant women in vaccine clinical trials presents unique challenges for the informed consent process. We explored the expectations and experiences of the pregnant women, spouses/partners, health workers and stakeholders of the consent process during a Group B Streptococcus maternal vaccine trial. Methods We interviewed 56 participants including pregnant women taking part in the trial, women not in the trial, health workers handling the trial procedures, spouses, and community stakeholders. We conducted 13 in-depth interviews and focus group (...) discussions with 23 women in the trial, in-depth interviews with 5 spouses, and 5 women not in the trial, key informant interviews with 5 health workers and 5 other stakeholders were undertaken. Results Decision-making by a pregnant woman to join a trial was done in consultation with spouse, parents, siblings, or trusted health workers. Written study information was appreciated by all but they suggested the use of audio and visual presentation to enhance understanding. Women stressed the need to ensure that their male partners received study information before their pregnant partners joined a clinical trial. Confidentiality in research was emphasised differently by individual participants; while some emphasised it for self, others were keen to protect their family members from being exposed, for allowing them to be involved in research. However, others wanted their community participation to be acknowledged. Conclusion We found that pregnant women make decisions to join a clinical trial after consulting with close family. Our findings suggest the need for an information strategy which informs not only the pregnant woman, but also her family about the research she is invited to engage in. (shrink)

Genetic information and technologies are increasingly important in health care, not only in technologically advanced countries, but world-wide. Several global factors promise to increase future demand for morally conscious genetic health services and research. Although they are the largest professional group delivering health care world-wide, nurses have not taken the lead in meeting this challenge. Insights from feminist analysis help to illuminate some of the social institutions and cultural obstacles that have impeded the integration of genetics technology into the discipline (...) of nursing. An alternative model is suggested - the transdisciplinary model - which was developed initially by a nurse and introduced in the 1970s into the delivery of health care and social services for children with developmental disabilities. This holistic model enables all health care professionals to have an equal voice in determining how genetic health care will be globalized. (shrink)

BackgroundCarefully planned research is critical to developing policies and interventions that counter physical, psychological and social challenges faced by young people living with HIV/aids, without increasing burdens. Such studies, however, must navigate a ‘vulnerability paradox’, since including potentially vulnerable groups also risks unintentionally worsening their situation. Through embedded social science research, linked to a cohort study involving Adolescents Living with HIV/aids (ALH) in Kenya, we develop an account of researchers’ responsibilities towards young people, incorporating concepts of vulnerability, resilience, and agency (...) as ‘interacting layers’.MethodsUsing a qualitative, iterative approach across three linked data collection phases including interviews, group discussions, observations and a participatory workshop, we explored stakeholders’ perspectives on vulnerability and resilience of young people living with HIV/aids, in relation to home and community, school, health care and health research participation. A total of 62 policy, provider, research, and community-based stakeholders were involved, including 27 ALH participating in a longitudinal cohort study. Data analysis drew on a Framework Analysis approach; ethical analysis adapts Luna’s layered account of vulnerability.ResultsALH experienced forms of vulnerability and resilience in their daily lives in which socioeconomic context, institutional policies, organisational systems and interpersonal relations were key, interrelated influences. Anticipated and experienced forms of stigma and discrimination in schools, health clinics and communities were linked to actions undermining ART adherence, worsening physical and mental health, and poor educational outcomes, indicating cascading forms of vulnerability, resulting in worsened vulnerabilities. Positive inputs within and across sectors could build resilience, improve outcomes, and support positive research experiences.ConclusionsThe most serious forms of vulnerability faced by ALH in the cohort study were related to structural, inter-sectoral influences, unrelated to study participation and underscored by constraints to their agency. Vulnerabilities, including cascading forms, were potentially responsive to policy-based and interpersonal actions. Stakeholder engagement supported cohort design and implementation, building privacy, stakeholder understanding, interpersonal relations and ancillary care policies. Structural forms of vulnerability underscore researchers’ responsibilities to work within multi-sectoral partnerships to plan and implement studies involving ALH, share findings in a timely way and contribute to policies addressing known causes of vulnerabilities. BackgroundWith the emergence of Brain Computer Interfaces, clinicians have been facing a new group of patients with severe acquired brain injury who are unable to show any behavioral sign of consciousness but respond to active neuroimaging or electrophysiological paradigms. However, even though well documented, there is still no consensus regarding the nomenclature for this clinical entity.ObjectivesThis systematic review aims to 1) identify the terms used to indicate the presence of this entity through the years, and 2) promote an informed discussion (...) regarding the rationale for these names and the best candidates to name this fascinating disorder.MethodsThe Disorders of Consciousness Special Interest Group of the International Brain Injury Association launched a search on Pubmed and Google scholar following PRISMA guidelines to collect peer-reviewed articles and reviews on human adults published in English between 2006 and 2021.ResultsThe search launched in January 2021 identified 4,089 potentially relevant titles. After screening, 1,126 abstracts were found relevant. Finally, 161 manuscripts were included in our analyses. Only 58% of the manuscripts used a specific name to discuss this clinical entity, among which 32% used several names interchangeably throughout the text. We found 25 different names given to this entity. The five following names were the ones the most frequently used: covert awareness, cognitive motor dissociation, functional locked-in, non-behavioral MCS and higher-order cortex motor dissociation.ConclusionSince 2006, there has been no agreement regarding the taxonomy to use for unresponsive patients who are able to respond to active neuroimaging or electrophysiological paradigms. Developing a standard taxonomy is an important goal for future research studies and clinical translation. We recommend a Delphi study in order to build such a consensus. (shrink)

Those articles, eventually published as the book Buddhists Talk About Jesus,Christians Talk About the Buddha (Continuum, 2000), asked Christians and Buddhists to critique the founder of the other religion. The format proved successful and provoked some good (...) methodological discussion (see Ingram, p. 75 ff).Thus, in this issue we continue the format with a new question: how have you used and/or learned from the meditative and prayer practices of the other tradition? The assignment drew enthusiastic response, especially from Christians who were asked to write about their experiences of Buddhist meditation. We are publishing five articles by Frances Adeney, Mary Frolich, Paul Ingram, Terry Muck, and Bardwell Smith, along with responses by two Buddhists--Grace Burford and Robert Thurman.In our next issue (volume 22), we will publish articles by five Buddhist authors and two Christian respondents. We will be interested to see if these articles give us clues as to why Christians were more eager to take on this assignment than were Buddhists.In compiling this collection of articles, we made three observations related to good interreligious interchanges. The first is that this form of dialogue requires a good deal of trust among the participants. Talking candidly about important features of the other person's religion runs the risk of offense.Yet the way the writers and respondents--mostly longtime members of the Society for Buddhist-Christian Studies--wrote indicates that trust is developing.Of course, trust is essential for any kind of healthy dialogue. The reason for the development of interreligious dialogue in this century has been as a response to the level of destructive criticism so common to interchanges among adherents of the world's religions. To address this unacceptable level of conflict, it was necessary to step back and consciously adapt a stance of silent humility about and toward the religious other. As the dialogue movement developed, conversations began to punctuate the silence, conversations that hopefully demonstrated openness, understanding our mutual pasts and intertwined futures. Years of this kind of openness leading to understanding makes it possible to enter into a new era of dialogue, the era of constructive criticism made up of equal parts of honest commentary and unequivocal support.We have moved through this idealized paradigm of responses very imperfectly, of course. The level of destructive conflict is still unacceptably high, silent humility is [End Page iii] in sometimes short supply, openness drowned out by self-interest, and constructive criticism imperfectly practiced. Yet we must move forward, experiencing flashes of epiphany and enlightenment as humility, openness, and mutuality ride the wings of developing trust.The second observation--more a realization, actually--is that this form of interreligious interchange requires a high level of sophistication about religions other than one's own. It is hard to pin down the exact nature of this sophistication. It is not just knowledge about the other's religion that is required, although it is partly that. One cannot comment effectively about Buddhist meditation unless one has a certain fundamental understanding of what Buddhist meditation is. Christian prayer is not easy to define, but certain features of the practice are universally recognized among both theologians and practitioners. To conduct the kind of mutual evaluation asked for in this type of dialogue, basic levels of understanding are necessary.The dialogue as we envision it, however, goes beyond knowledge. In our letter of invitation to participants, we made it clear that we were also interested in writers who had some experience with the other religion's spiritual practice. As we received and evaluated submissions, it became clear that what gave the essays power and authority was the mixture of knowledge and experience of the others' spiritual practice. As you will see, it wasn't always the case that our writers had adapted meditative or prayer practice wholesale. But invariably their experience gained through learning about the practice led to changes: deeper, richer practice in their own tradition.This... (shrink)

Lutheran perspectives are used as a compass to offer scriptural, theological, and historical insights to advance the reformation of Christian language.

Richard Lennan’s Tilling the Church treats ecclesial conflict, the possibility of change, and the tensions involved. He acknowledges the resistance to development within the Church’s structures. This resistance helps to explain the church’s distrust of women, which frustrates many Catholics. Cornell philosopher Kate Manne puts resistance to change in context by describing the social expectations of women, by showing that those who resist change feel entitled to do so, and by revealing how victimization is legitimated. “Tilling the church” is an (...) apt metaphor for transformation that does not sufficiently appreciate socially-mediated systems of privilege and vulnerability. The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

The #metoo movement has forced many fans to consider what they should do when they learn that a beloved artist has acted immorally. One natural thought is that fans ought to give up the artworks of immoral artists. In Why It's OK to Enjoy the Work of Immoral Artists, Mary Beth Willard argues for a more nuanced view. Enjoying art is part of a well-lived life, so we need good reasons to give it up. And it turns out good (...) reasons are hard to find. Willard show that it's reasonable to believe that most boycotts of artists won't succeed, so most of the time there's no ethical reason to join in. Someone who manages to separate the art from the artist isn't making an ethical mistake by buying and enjoying their art. She then considers the ethical dimensions of canceling artists and so-called "cancel culture," arguing that canceling is ethically risky because it encourages moral grandstanding. Willard concludes by arguing that the popular debate has overlooked the power of art to change our lives for the good. It's of course OK to decide to give up the artwork of immoral artists, but--as Willard shows in this provocative little volume--it's OK to continue to enjoy their art, as well. One hundred years after Gestalt views first took hold our understanding of how perceptual processes organize the visual field into objects and their local backgrounds has progressed substantially. We now know that in addition to the image-based properties that the Gestalt psychologists identified as relevant, a myriad of other image-based factors influence figure–ground organization, as do subjective factors such as past experience, attention, and intentions. Moreover, properties of grounds as well as properties of figures play a role. The recent use (...) of indirect measures and brain imaging techniques has revealed that there is much more processing of the regions ultimately perceived as grounds than is supposed in traditional approaches, and that competition and feedback are involved in figure–ground organization. These recent advances offer great promise for uncovering the mechanisms that organize the visual field into figures and grounds. (shrink)

All knowledge, Kant argues, including that of God’s existence, must be based on the forms of possible experience or deduced from premises known to be true: in the case of the existence of God, however, the former is impossible because God transcends experience, and the latter is impossible (...) because the premises themselves, to be known to be true, would have to be grounded in possible experience, while, by the very nature of the question, possible experience has been excluded. The distinction of fact and value and the problems entailed by it are concerns only for modern, Western thought. The distinction is supported by Kant, who, however, also attempts to solve its consequent problems. His first attempt is made by arguing that the standard of value is itself a fact. This brings fact and value together, but only in an intelligible world. Kant's second attempt is found in the third Critique in the argument that man, as both rational and animal, (...) must view the world in teleological terms; so doing advances the task of science, finds support in objects of natural beauty, and leads to the creation of beauty in art. Thus, ultimately, the highest complete good, a world under moral laws is itself seen as in fact really possible as the final goal of human creative artistic activity. (shrink)

Although the courts have ruled that companies are legal persons, they have not yet made clear the extent to which political free speech for corporations is limited by the strictures legitimately placed upon corporate commercial speech. I explore the question of whether or not companies can properly be said to have the right to civil free speech or whether corporate speech is always de facto commercial speech not subject to the same sorts of legal protections as is the right (...) to civil free speech. In the absence of clearly defined legal precedent, I emphasize moral reasons for determining the appropriate limits of corporate civil free speech. Appealing to arguments typically used to justify individual rights to civil free speech, I examine the extent to which this sort of justification may or may not be legitimately extended to corporations. I conclude that corporate rights to civil free speech must be restricted because granting rights of free speech to institutions may, in practice, undermine the moral rationale and practical feasibility of guaranteeing rights of civil free speech to individuals. Furthermore, I argue that granting corporations full rights to civil free speech will undercut attempts to develop good moral character in corporate institutions by undermining the efforts of watchdog organizations. Reading the Shape of Nature vividly recounts the turbulent early history of the Museum of Comparative Zoology at Harvard and the contrasting careers of its founder Louis Agassiz and his son Alexander. Through the story of this institution and the individuals who formed it, Mary P. Winsor explores the conflicting forces that shaped systematics in the second half of the nineteenth century. Debates over the philosophical foundations of classification, details of taxonomic research, the young institution's financial struggles, and the (...) personalities of the men most deeply involved are all brought to life. In 1859, Louis Agassiz established the Museum of Comparative Zoology to house research on the ideal types that he believed were embodied in all living forms. Agassiz's vision arose from his insistence that the order inherent in the diversity of life reflected divine creation, not organic evolution. But the mortar of the new museum had scarcely dried when Darwin's Origin was published. By Louis Agassiz's death in 1873, even his former students, including his son Alexander, had defected to the evolutionist camp. Alexander, a self-made millionaire, succeeded his father as director and introduced a significantly different agenda for the museum. To trace Louis and Alexander's arguments and the style of science they established at the museum, Winsor uses many fascinating examples that even zoologists may find unfamiliar. The locus of all this activity, the museum building itself, tells its own story through a wonderful series of archival photographs. (shrink)

When deciding what disorders to screen newborns for, we should be guided by evidence of real effectiveness, take opportunity cost into account, distribute costs and benefits fairly, and respect human rights. Current newborn screening policy does not meet these requirements.

The pattern for many years has been for the SBCS to hold its annual meeting in conjunction with the annual meeting of the AAR. On (...) the Friday before the AAR’s Annual Meeting begins, the Society’s board meets in the morning and early afternoon, followed by an AAR-advertised session late that afternoon. On Saturday, another paper session or panel is followed by the Society’s annual members’ meeting.A highlight of the 2012 SBCS annual meeting was the unanimous approval, first by the governing board and later by the membership in attendance, of a major revision of the society’s bylaws. This revision focused largely on updates necessitated by changes in the ways scholars communicate day-to-day and in scholarly publications, and in international banking practices, because of the expanding use of electronic media. This revision was well over a year in the making, with particularly generous input of time and thought by former board member Grace Burford and Treasurer Guy McCloskey, and with efficient guidance by President Terry Muck.Another highlight of this 2012 gathering was the announcement at the board meeting that the SBCS’s reapplication for formal status as a Related Scholarly Organization of the AAR was accepted for another five years. Denise Yarbrough (University of Rochester), who was unanimously approved at the members meeting as the Christian co-editor of this journal, along with Buddhist co-editor Wakoh Shannon Hickey (Notre Dame of Maryland University), who signed on in 2011.Rita Gross, who formerly co-edited the journal and was president of the Society, was elected to the board, replacing Amos Yong, whose term ended in 2012. We are extremely grateful for his leadership in many areas, including the Streng Book Award Committee. Abraham Vélez de Cea was unanimously approved to chair the Streng Book Award Committee, with Mary Jeanne Larabee continuing on the committee and David Gardiner being approved as the third member. Alice Keefe, in her vice presidential role as program chair, took note of the lively discussion about possible topics for next year’s panel sessions.The Friday afternoon seminar was titled “Contemplative Pedagogy: Pitfalls and Potentials.” Panelists included John D. Copenhaver (Shenandoah University), Kristine T. Utterback (University of Wyoming), Andrew O. Fort (Texas Christian University), and Judith Simmer-Brown (Naropa University). The respondent was William H. Green (Tougaloo College), and Wakoh Shannon Hickey (Notre Dame of Maryland University) presided. Versions of the four panelists’ papers are included in this volume of the journal, as well as additional papers on the topic by other authors.In lieu of its customary field trip, this year the SBCS encouraged participants to attend the new film Jesus & Buddha: Practicing across Traditions (Old Dog Documentaries, 2012), screened on Friday night before the AAR Annual Meeting. In the film, three leading figures in Buddhist-Christian dialogue were interviewed: Paul F. Knitter (Union Theological Seminary), Robert Kennedy, SJ (St. Peter’s College), and Chung Hyun Kyung (Union Theological Seminary). A discussion, over which Knitter presided, followed the film.The Saturday panel was “The Ethics of Wealth in a World of Economic Inequality: Buddhist and Christian Perspectives.” Panelists included Joerg Rieger (Southern Methodist University), Alan Jay Richard (Realistic Living, Inc.), and Carol S. Anderson (Kalamazoo College). The respondent was Mark Wood (Virginia Commonwealth University), and Alice A. Keefe (University of Wisconsin) presided.
