We explore why people feel the socially improper emotions of schadenfreude and gluckschmerz. One explanation follows from sentiment relations. Prior dislike leads to both schadenfreude and gluckschmerz. A second explanation relates to concerns over justice. Deserved misfortune is pleasing and undeserved good fortune is displeasing. A third explanation concerns appraisal of the good or bad fortunes of others as creating either benefit or harm for the self or in-group. Especially in competitive situations and when envy is present, gain is pleasing (...) and loss is displeasing. Both emotions have important implications for understanding human relations at the individual and group levels. (shrink)

This paper examines the efficacy of a statelessness reduction plan implemented by the country of Chile. We evaluate the programmatic alignment of Chile’s statelessness reduction plan, #Chilereconoce, with policy enacted by the United Nations High Commissioner for Refugees in that office’s campaign to eradicate statelessness by the year 2024. In addition to evaluating the structure of Chile’s statelessness reduction plan, we explore the policy outcomes of this plan in achieving its desired goal of reducing statelessness in Chile. We use Chile (...) as a case study because it implemented the United Nations High Commissioner for Refugees’ 2014-2024 Action Plan and, therefore, can shed light on if such a plan can put a nation-state on the path to remedy the deleterious effects of statelessness. Our central argument is that Chile’s statelessness reduction plan can, in-fact, serve as a blueprint for governmental institutions to follow towards achieving the goal of reducing statelessness. The success of such a plan, however, is conditioned upon whether principle actors within governmental institutions confront, head on, structural challenges that otherwise tend to undermine the merging of a confluence of critical factors that must be aligned for success to occur. The Chilean project demonstrates that reducing statelessness requires community action, implementation of domestic legislative reform, and governmental accession to international treaties. (shrink)

Public and professional debates have come to rely heavily on a special type of reasoning: the argument-from-ignorance, in which conclusions depend on the _lack_ of compelling information. "I win my argument," says the skillful advocate, "unless you can prove that I am wrong." This extraordinary gambit has been largely ignored in modern rhetorical and philosophical studies. Yet its broad force can be demonstrated by analogy with the modern legal system, where courts have long manipulated burdens of proof with skill and (...) subtlety. This legal, philosophical, and rhetorical study by Richard H. Gaskins provides the first systematic treatment of arguments-from-ignorance across a wide range of modern discourse—from constitutional law, scientific inquiry, and moral philosophy to organizational behavior, computer operation, and personal interaction. Gaskins reviews the historic shifts in constitutional proof burdens that have shaped public debate on fundamental rights and, by analogy, on the fundamental status of intellectual and cultural authority. He shows how similar shifts have dominated polemical battles between scientific and ethical modes of authority, affecting both academic and popular discussion. Finally, he discovers the philosophical roots of default reasoning strategies in the arguments of Kant and nineteenth-century Kantian schools. Concluding that shifting proof burdens are inescapable in a world of scientific and moral uncertainty, Gaskins emphasizes the common strategic ground shared by dogmatic and skeptical reasoning. ‘The work of the philosopher consists in assembling reminders for particular purposes.’ Among the many purposes for which Wittgenstein assembled reminders, the deeper understanding of the religious life would have to qualify as one. Though on first reading this would hardly seem obvious, I hope to make this abundantly clear through an examination of his later literature. There are two ways in which he sheds light on religious issues: first , by the personal passion of his own life and the (...) forthright display of intellectual integrity expected of any professional thinker toward any discipline , and, second , by making his philosophical investigations descriptive. Any analysis of religious issues or the understanding of the religious life should involve the high degree of personal integrity and the rigorously descriptive method which Wittgenstein makes apparent throughout his writing. The riddle Frazer confronts us with in The Golden Bough is posed in the form of a question. ‘Why is this happening?’ - this life and death of the King of the Wood at Nemi? In the related context of his accounts of the fire-festivals in Europe, Frazer refines the question in a more dramatic form: ‘What is the meaning of such sacrifices? Why were men and animals burnt to death at these festivals?’ Frazer recognizes something serious in all this. (...) The practice of human sacrifice is puzzling; it does leave us disquieted! But Frazer's search for what he calls ‘a fairly probable explanation’ of the motives which gave rise to the priesthood of Nemi and its embodiment of the practice of human sacrifice, Wittgenstein in his ‘Remarks on Frazer's Golden Bough’ feels, does not help us to understand a practice like the burning of a man! With all the additional data, numerous theories, and the historical tracing of origins we are no closer to resolving the perplexities of the riddle than the riddle itself presents to us daily. It is tempting to think that we have heard just about all we want or need to know about race. As the above quotes indicate, modern notions of race have always revolved around the faculty of vision, with supplementary contributions from other senses such as hearing, as Arendt notes in a tacit allusion to one mark of Jewish difference—the way they sounded when concentrated in urban settings. Yet two very recent works—Mark M. Smith's How Race Is Made and Anne C. (...) Rose's Psychology and Selfhood in the Segregated South —have much to teach us about how race has “worked”, particularly in the twentieth-century South but also, by implication, in the United States in general. Both works assume that, historically, race is no mere add-on to the self, a kind of externality that, once detected, can be relatively easily excised. Rather, it stands right at the heart of personal and group identity in a nation where race and ethnicity continue to assume surprising new shapes and forms. (shrink)

My interest here is in the way Leo Strauss and his followers, the Straussians, have dealt with race and rights, race and slavery in the history of the United States. I want, first, to assess Leo Strauss's rather ambivalent attitude toward America and explore the various ways that his followers have in turn analyzed the Lockean underpinnings of the American “regime,” sometimes in contradistinction to Strauss's views on the topic. With that established, I turn to the account, particularly that offered (...) by Harry Jaffa, of how slavery and race comported—or did not—with the Straussian account of the political foundations of the new nation and how latter-day followers of Strauss have dealt with the persisting topic of race and racism in America. Overall, I want to make two large points. First, the Straussian commitment to superhistorical standards provides the Straussians with a moral perspective on slavery, race, and racism. Second, though race and slavery have been less than central among the concerns of most followers of Strauss, the contributions of Jaffa and others have significantly shaped the present American conservative position on race, including the idea of color-blindness. Few people will easily admit to taking pleasure in the misfortunes of others. But who doesn't enjoy it when an arrogant but untalented contestant is humiliated on American Idol, or when the embarrassing vice of a self-righteous politician is exposed, or even when an envied friend suffers a small setback? The truth is that joy in someone else's pain--known by the German word schadenfreude--permeates our society. In The Joy of Pain, psychologist Richard Smith, one of the world's foremost authorities (...) on envy and shame, sheds much light on a feeling we dare not admit. Smith argues that schadenfreude is a natural human emotion, one worth taking a closer look at, as it reveals much about who we are as human beings. We have a passion for justice. Sometimes, schadenfreude can feel like getting one's revenge, when the suffering person has previously harmed us. But most of us are also motivated to feel good about ourselves, Smith notes, and look for ways to maintain a positive sense of self. One common way to do this is to compare ourselves to others and find areas where we are better. Similarly, the downfall of others--especially when they have seemed superior to us--can lead to a boost in our self-esteem, a lessening of feelings of inferiority. This is often at the root of schadenfreude. As the author points out, most instances of schadenfreude are harmless, on par with the pleasures of light gossip. Yet we must also be mindful that envy can motivate, without full awareness, the engineering of the misfortune we delight in. And envy-induced aggression can take us into dark territory indeed, as Smith shows as he examines the role of envy and schadenfreude in the Nazi persecution of the Jews. In the world according to Hume, people are complicated creatures, with convoluted, often contradictory characters. Consider, for example, Hume's controversial assessment of Charles I: "The character of this prince, as that of most men, if not of all men, was mixed .... To consider him in the most favourable light, it may be affirmed, that his dignity was free from pride, his humanity from weakness, his bravery from rashness, his temperance from austerity, his frugality from avarice .... To speak the (...) most harshly of him, we may affirm, that many of his good qualities were attended with some latent frailty, which, though seemingly inconsiderable, was able, when seconded by the extreme malevolence of his fortune, to disappoint them of all their influence: His beneficent disposition was clouded by a manner not very gracious; his virtue was tinctured with superstition; his good sense was disfigured by a deference to persons of a capacity inferior to his own; and his moderate temper exempted him not from hasty and precipitate resolutions." This sketch shows Charles in all his complexities, with his virtues, near virtues, and contradicting virtues. I have quoted it at length because it is hard to summarize without losing the subtleties that lie within it.
