Law-enforcement agencies are increasingly able to leverage crime statistics to make risk predictions for particular individuals, employing a form of inference that some condemn as violating the right to be “treated as an individual.” I suggest that the right encodes agents’ entitlement to a fair distribution of the burdens and benefits of the rule of law. Rather than precluding statistical prediction, it requires that citizens be able to anticipate which variables will be used as predictors and act intentionally to avoid (...) them. Furthermore, it condemns reliance on various indexes of distributive injustice, or unchosen properties, as evidence of law-breaking. (shrink)

Recently, an increasing number of scholars have been showing interest in old-fashioned racism again. While recent studies on old-fashioned racism apparently increase our knowledge of this psychological theory of racism, the studies actually shed light on a different type of racism, namely offensive racism. The aim of this text is to argue that psychological theories of racism, like old-fashioned racism and modern racism, depend on societies’ social norms. I will show that questionnaires are highly sensitive to social norms, and if (...) there is change in social norms, the original measurement object alters. The theory of old-fashioned racism implicitly assumes agents that follow (or conform to) the social norm to behave prejudiced. Today, however, this social norm does not exist in Western societies. If agents express the same prejudices today, they indicate their willingness to breach the social norm to behave unprejudiced. Thereby, classic old-fashioned racism measures reflect a new kind of racism today. (shrink)

This study evaluated the integration of psychology ethics into an introductory psychology course. Students in two general psychology sections were exposed to an infusion of psychology ethics in teaching, research, and clinical practice, whereas students in two sections were exposed to traditional course content. Students completed a pre and post-test assessment including a psychology ethics questionnaire and open-ended responses to three ethics case studies. Students in the ethics group displayed a statistically significant increase in scores on both measures from pre (...) to post-test. Descartes' Discourse marks a watershed in European thought; in it, the author sets out in brief his radical new philosophy, which begins with a proof of the existence of the self (the famous "cogito ergo sum"). Next he deduces from it the existence and nature of God, and ends by offering a radical new account of the physical world and of human and animal nature. Presentation times of study words presented in the Deese/Roediger and McDermott (DRM) paradigm varied from 20 to 2000 ms per word in an attempt to replicate the false memory effect following extremely short presentations reported by . Both in a within-subjects design (Experiment 1) and in a between-subjects design (Experiment 2) subjects showed memory for studied words as well as a false memory effect for related critical lures in the 2000-ms condition. However, in the conditions with shorter presentation times (20 (...) ms in Experiment 1; 20 and 40 ms in Experiment 2) no memory for studied words, nor a false memory effect was found. We argue that there is at present no strong evidence supporting the claim for a nonconscious basis of the false memory effect. (shrink)

Can we hold agents responsible for their implicitly biased behavior? The aim of this text is to show that, from the nurturing stance, holding subjects responsible for their implicitly biased behavior is justified, even though they are not blameworthy. First, I will introduce the nurturing stance as Daphne Brandenburg originally developed it. Second, I will specify what holding somebody responsible from the nurturing stance amounts to. Third, I show how and why holding responsible can help a subject develop an impaired (...) capacity. Fourth, I analyze empirical data about holding prejudiced subjects responsible and highlight that the internal motivation to control prejudiced reactions decreases implicit attitudes’ influences. Furthermore, the data show that in order to be appropriate moral demands have to acknowledge the target's autonomy and competence. In sum, from the nurturing stance, holding implicitly biased subjects responsible is appropriate if they can adequately respond to the moral demands. (shrink)

A concise summary of Nicanor’s theory of punctuation that has recently been discovered in a codex mixtus of the 15th century throws precious new light on a topic of some complexity. The general picture that emerges from the new extract does not substantially differ from that of the other known summary, which has been the starting point for all modern reconstructions of Nicanor’s theory. Therefore, these reconstructions need not be rewritten on a larger scale. The two summaries nevertheless display some (...) telling differences in how they explain and present the details, not least when read against the backdrop of Nicanor’s actual practice that can be derived from the relevant scholia to Homer. The purpose of the present article is to assess the new discovery especially with regard to these differences and their effects on how Nicanor’s theory is to be reconstructed. (shrink)

According to the standard view on the issue, the habit of marking questions with a particular typographical sign in Greek and Latin script does not arise prior to the eighth or ninth century. This period is generally credited with the ‘invention’ of the question mark (excepting Syriac evidence, which points to the fifth and sixth centuries). The purpose of the present article is to correct this view. It argues that the first indication for the use of a typographical sign that (...) marks questions can actually be detected no later than during the reign of Emperor Hadrian (a.d. 117–38), that is, more than half a millennium before the traditional date of the invention. The chief witness is Nicanor of Alexandria, who does not seem to have used question marks himself, but criticizes the misappropriation of another punctuation mark to that purpose. He thus indirectly testifies to the existence of question marks. Comparable traces can also be found later in the exegetical works of some Christian commentators. (shrink)

It entails not only collaborating once more as coauthors but also reiterating some of the criticisms and concerns that have figured prominently in virtually all our previous publications about bioethics—most recently in our book Observing Bioethics.

The author discusses the ways in which she finds the University of Pittsburgh Medical Center protocol for procuring organs from "non-heart-beating cadaver donors" medically and morally questionable and irreverent. She also identifies some of the factors that contributed to the composition of this troubling protocol, and to its institutional approval.

In _Battling to the End _René Girard engages Carl von Clausewitz, the Prussian military theoretician who wrote _On War_. Clausewitz, who has been critiqued by military strategists, political scientists, and philosophers, famously postulated that "War is the continuation of politics by other means." He also seemed to believe that governments could constrain war. Clausewitz, a firsthand witness to the Napoleonic Wars, understood the nature of modern warfare. Far from controlling violence, politics follows in war's wake: the means of war have (...) become its ends. René Girard shows us a Clausewitz who is a fascinated witness of history's acceleration. Haunted by the French-German conflict, Clausewitz clarifies more than anyone else the development that would ravage Europe. _Battling to the End _pushes aside the taboo that prevents us from seeing that the apocalypse has begun. A ‘vestigial social practice' is a norm, convention, or social behavior that persists even when few endorse it or its original justifying rationale. Begby (2021) explores social explanations for the persistence of prejudice, arguing that even if we all privately disavow a stereotype, we might nevertheless continue acting as if it is true because we believe that others expect us to. Meanwhile the persistence of the practice provides something like implicit testimonial evidence for the prejudice that would justify it, making (...) it rational for members of the next generation to acquire the corresponding prejudiced beliefs. This paper distinguishes between three different types of vestigial social practice in terms of the underlying explanatory mechanisms, and argues that the persistence of prejudicial social stereotypes is most tightly linked not to others’ beliefs or expectations, but to the ways that material infrastructure constrains options shapes social outcomes. Given that, the persistence of a practice only provides grounds to infer that most people endorse the corresponding prejudiced belief only if we are in a position to dismiss relevant alternative explanations. Theory of Literature was originally published in 1949. It is not a textbook introducing the young to the elements of literary appreciation nor a survey of the techniques employed in scholarly research. The authors have sought to unite "poetics" (or literary theory) and "criticism" (evaluation of literature) with "scholarship" ("research") and "literary history" (the "dynamics"of literature, in contrast to the "statics" of theory and criticism).

In social psychology, the concept of implicit attitudes has given rise to ongoing discussions that are rather philosophical. The aim of this paper is to discuss the status of implicit prejudices from a philosophical point of view. Since implicit prejudices are a special case of implicit attitudes, the discussion will be framed by a short discussion of the most central aspects concerning implicit attitudes and indirect measures. In particular, the ontological conclusions that are implied by different conceptions of implicit attitudes (...) will be scrutinized. The main question to be discussed involves whether implicit prejudices are mental states at all, or whether they are rather dispositions to behave in a certain way. This question will be discussed against the background of principles for belief ascription, which requires ascribed mental states to fulfill some specific explanatory role. Principles of Philosophy. Author’s Letter to the Translator (Preface).

It is often assumed that trolling is an intentional action. The aim of the paper is to argue for a form of unintentional trolling. Firstly, we outline minimal conditions for intentional actions. Secondly, an unintentional trolling example is introduced. Thirdly, we will show that in some cases, an utterance can be expressive, while it is perceived as descriptive. On the basis of the justification-suppression model, we argue that the introduced trolling example is such a case. In order to bypass social (...) sanctions for expressing prejudices, agents unintentionally express their prejudices through stories that appear to be descriptive. Thereby, the characterized behavior does not fulfill the minimal conditions for intentional action. Fourthly, we give criteria that can be used to identify unintentional trolls. Finally, after unintentional trolling is analyzed, the trolls’ behavioral goals are considered. In conclusion, an analysis of unintentional trolling is given, which has explanatory benefits in contrast to the classic intentional trolling concepts. (shrink)

In his classic text, A Theory of Justice, John Rawls argues that the structural principles of a society are just when they issue from a procedure that is fair. One crucial feature that makes the procedure fair is that the persons who will be subjected to these principles choose them after they have deliberated together in a condition marked by a certain balance of knowledge and ignorance. In particular, these people know enough to consider principles that are workable, yet converse (...) behind a “veil of ignorance,” unable to predict what their place in society will be and hence discouraged from slanting the principles toward any preferential interests. My paper questions whether this attempt to ensure the disinterestedness of the conversation of justice is feasible. I worry that when we approach this question practically, we discover that the education that furnishes us with the knowledge necessary to choose viable principles must at the same time preclude genuine ignorance about our social position and interests. As an alternative, I suggest that we convene the conversation of justice behind a “veil of existence.” In this condition, people possess knowledge about how their society works and even about their places in it; however, this knowledge does not foster preferential interests because all interests are subjected to the question of their existential meaning. As Jean-Paul Sartre explains in his essay, “Existentialism is a Humanism,” for our interests to be truly meaningful, they must be affirmed as free responses to our thrownness into existence. Yet how do we find the wherewithal to make such responsible choices rather than lapse into paralysis before their essentially arbitrary differences? My positive thesis is that we may do so by acknowledging how all of us in this existential predicament critically and mutually provoke each to commit oneself to depart from the others in specific ways. This process of provocation is thus educational. It broaches a conception of non-instrumental, non-mimetic, liberal study, one which I try to enact in a writing that employs direct address, regular returns to questions that put discourse at a loss, and expanding webs of association. In this manner, I hope to demonstrate that liberal study may deepen our appreciation of our communal nature, our camaraderie, and thus motivate us to participate unselfishly in the conversation of justice. The theologian Hugo Rahner argued that the homo ludens is a man of ‘Ernstheiterkeit’, a person who can smile under tears but also recognizes the gravity in all earthly cheerfulness. The primary aim of this study was to test the validity of this notion: Do homines ludentes exist? Two hundred sixty-three adult subjects were measured for seriousness and cheerfulness and playfulness. Results provided unequivocal support for Rahner's thesis. Numerous subjects scored high in both seriousness and cheerfulness thus confirming the existence (...) of homines ludentes. It was further found that these subjects were among those scoring highest in playfulness. Subjects scoring high in cheerfulness but low in seriousness were, however, even more closely associated with playfulness. The scores for homines ludentes did not differ from the rest of the subjects in the creative and dynamic facets of playfulness. The importance of developing empirical research to investigate hypotheses derived from non-scientific concepts is discussed. (shrink)

Richard Wollheim famously argued that figurative pictures depict their scenes, in part, in virtue of their ability to elicit a unique type of visual experience in their viewers, which he called seeing-in. According to Wollheim, experiences of seeing-in are necessarily twofold, that is, they involve two aspects of visual awareness: when a viewer sees a scene in a picture, she is simultaneously aware of certain visible features of the picture surface, the picture’s design, and the scene depicted by the picture. (...) Even though Wollheim’s notion of twofoldness has been very influential, a number of philosophers have put forward powerful arguments against it. In this paper, I defend the claim that some pictorial experiences are twofold in Wollheim’s sense. My argument has two parts. In the first part, I provide a phenomenal contrast argument in favor of twofoldness. In the second part, I respond to what I take to be the most important objections against twofoldness. I believe that both parts together provide strong support for the claim that some pictorial experiences are twofold in Wollheim’s sense. (shrink)

The calculus of Natural Calculation is introduced as an extension of Natural Deduction by proper term rules. Such term rules provide the capacity of dealing directly with terms in the calculus instead of the usual reasoning based on equations, and therefore the capacity of a natural representation of informal mathematical calculations. Basic proof theoretic results are communicated, in particular completeness and soundness of the calculus; normalisation is briefly investigated. The philosophical impact on a proof theoretic account of the notion of (...) meaning is considered. (shrink)

The middle of the second until the middle of the first century BCE is one of the most creative periods in the history of human thought, and an important part of this was the interaction between Roman jurists and Hellenistic philosophers. In this highly original book, René Brouwer shows how jurists transformed the study of law into a science with the help of philosophical methods and concepts, such as division, rules and persons, and also how philosophers came to share (...) the jurists' preoccupations with cases and private property. The relevance of this cross-fertilization for present-day law and philosophy cannot be overestimated: in law, its legacy includes the academic study of law and the Western models of dispute resolution, while in philosophy, the method of casuistry and the concept of just property. Each state’s Medicaid Fraud Control Unit prosecutes billing fraud cases against individual healthcare providers who fraudulently bill Medicaid for services provided. Once an individual is convicted of billing fraud, the Office of Inspector General for the Department of Health and Human Services may exclude the individual from billing any federal government healthcare program, including Medicaid. Excluded individuals are added to a public list of exclusions, which restricts their ability to practice professionally. Prompted by criminology research into the impact of policing (...) resources, we test whether these government enforcement initiatives against fraud serve as a deterrent to would-be fraudulent billers. We document that key enforcement proxies, the staffing level and budget of an MFCU, are positively associated with the yearly number of exclusions added at the state level. Our results are consistent with the exclusion list not being a deterrent but provide support for MFCUs’ fraud detection efforts. This paper provides industry-specific fraud insights for auditors and other individuals involved in public policy, specifically Medicaid, and introduces a novel dataset to the accounting fraud research literature.
