Advance care planning allows patients to articulate preferences for their medical treatment, lifestyle, and surrogate decision-makers in order to anticipate and mitigate their potential loss of decision-making capacity. Written advance directives are often emphasized in this regard. While these directives contain important information, there are several barriers to consider: veracity and accuracy of surrogate decision-makers in making choices consistent with the substituted judgement standard, state-to-state variability in regulations, literacy issues, lack of access to legal resources, lack of understanding of medical (...) options, and cultural disparities. Given these issues, it is vital to increase the use of patient and healthcare provider conversations as an advance care planning tool and to increase integration of such discourse into advance care planning policy as adjuncts and complements to written advance directives. This paper reviews current legislation about written advance directives and dissects how documentation of spoken interactions might be integrated and considered. We discuss specific institutional policy changes required to facilitate implementation. Finally, we explore the ethical issues surrounding the increased usage and recognition of clinician–patient conversations in advance care planning. (shrink)

René Girard's pioneering interpretation ofthe Judeo-Christian scriptures clarifies this distinction by recourse to an ethical conception ofthe sacrificial: False religion or idolatry is essentially sacrificial, while the Judeo-Christian tradition opposes the sacrificial in (...) all its myriad forms. As Girard explains, the Passion narrative makes clear that the sacrificial or scapegoat victim, Christ, is innocent. The violence inflicted upon Christ is human, not divine. The Gospels thus reveal the violence that hides behind the sacred. Religious practices that further sacrificial violence are idolatrous, worshiping violence in the guise ofthe sacred.1 The ethical simplicity of the Girardian distinction between true faith and idolatry is complicated, however, by the issue of representation. According to the Old Testament, the one true God cannot be represented by images or figures of any kind, while idols typically take figurai form. From a biblical perspective, therefore, the question ofform is central to an understanding of idolatry. The Old Testament ban on images has never been investigated from a Girardian perspective. In this essay I apply Rene Girard's anthropological insights to the subject oficonoclasm in the Old and New Testaments. More specifically I address the second command-ment, the famous ban on "graven images," and the problem of representing God. The first is the ethical function of the ban on images; how does the second commandment function ethically to preserve the human community in the Bible? Second, is the ban on images sacrificial as understood in Girardian terms? Or is it anti-sacrificial and therefore ethically progressive? The second commandment reads: "Thou shalt not make unto thee any graven image, or any likeness of any thing that is in heaven above, or that is in the earth beneath, or that is in the water under the earth : Thou shalt not bow down thyself to them, nor serve them: for I the Lord thy God am a jealous God" (KJV, Exod. 20.4-5). At first glance, this commandment might appear as an expression ofthe most primitive form ofreligious taboo. A specific cultural activity is arbitrarily forbidden under threat of punishment. The taboo on images, unlike the law against murder for example, has no obvious moral dimension. Images of any kind must be violently expelled —sacrificed, as it were—for no immediate reason. According to the second commandment, any attempt to represent God or his creation by images is a profane violation of his "jealous" nature; the second commandment therefore often finds expression in the violent destruction ofsocalled idolatrous images. Acts oficonoclasm directed againstthe images of foreign gods are quite common in the Old Testament. Nevertheless, I argue here thatthe second commandment is in practical terms ethically progressive and anti-sacrificial. It actually questions and underminesthe whole sacred-profane dichotomy. Indeed, the ban on images is ultimately a secularizing influence crucial for the development of modernity. I also address the Christian acceptance of divine images, which has often been understood as a reversal of the Judaic ban on figurai representations. In the interpretation of iconoclasm that I am proposing here, however, the image ofChrist on the cross can be seen as a logical development of the second commandment rather than its contradiction. I. After sketching my own solution to the Value of Knowledge Problem, which argues for a deontological understanding of justification and understands the value of knowing interesting propositions by the value we place on believing as we ought to believe, I discuss Alvin Goldman's and Erik Olsson's recent attempts to explain the value of knowledge within the framework of their reliabilist epistemology.

This chapter explores the relationship between Goldman's thesis and the classical jury theorem. It identifies the minimal modification needed in order to recover Goldman's thesis in a Condorcetian framework. Goldman's thesis can be recast as a generalization of the classical Condorcet jury theorem. The central move needed to recover Goldman's thesis from a generalized jury theorem is to replace Condorcet's assumption that there is a single truth to be tracked with the assumption of multiple such truths: (...) one for each voter. In Goldman's picture, there is still an indirect, derivative sense in which there exists an 'overall' truth about the correct outcome for the electorate in aggregate. This 'overall' truth is determined, of course, by the profile of voter‐specific truths and therefore depends on the identity of the electorate. This article combines findings from cognitive psychology on the role of processing fluency in truth judgments with epistemological theory on justification of belief. We first review evidence that repeated exposure to a statement increases the subjective ease with which that statement is processed. This increased processing fluency, in turn, increases the probability that the statement is judged to be true. The basic question discussed here is whether the use of processing fluency as a cue to truth is epistemically justified. In (...) the present analysis, based on Bayes’ Theorem, we adopt the reliable-process account of justification presented by Goldman (1986) and show that fluency is a reliable cue to truth, under the assumption that the majority of statements one has been exposed to are true. In the final section, we broaden the scope of this analysis and discuss how processing fluency as a potentially universal cue to judged truth may contribute to cultural differences in commonsense beliefs. One possible aim of epistemology is to advise cognizers on the proper choice of beliefs or other doxastic attitudes. This aim has often been part of scientific methodology: to tell scientists when they should accept a given hypothesis, or give it a certain degree of credence. This regulative function is naturally linked to the notion of epistemic justification. It may well be suggested that a cognizer is justified in believing something just in case the rules of proper epistemic procedure prescribe (...) that belief. Principles that make such doxastic prescriptions might thereby "double" as principles of justification. In the first part of this paper I contrast the regulative conception of justification with another, equally tenable, conception. Then, after noting a fundamental worry about the applicability of the regulative conception, I proceed to lay it out in more detail. The regulative justificational status of a doxastic attitude for person S at time t depends upon (a) the right set of doxastic instructions and (b) the states S is in at (or just before) t. (shrink)

What I have in mind is an explanatory theory, one that explains in a general way why certain beliefs are counted as justified and others as unjustified. Unlike some traditional approaches, I do not try to prescribe standards for justification that differ from, or improve upon, our ordinary standards. There is little consensus, however, on what the term "knowledge" comprehends, what is the scope of the "social", or what the style or purpose of the study should be. According to some writers, social epistemology should retain the same general mission as classical epistemology, revamped in the recognition that classical epistemology was too individualistic. According to other writers, social epistemology should be a more radical departure from classical (...) epistemology, a successor discipline that would replace epistemology as traditionally conceived. The classical approach could be realized in at least two forms. One would emphasize the traditional epistemic goal of acquiring true beliefs. It would study social practices in terms of their impact on the truth-values of agents’ beliefs. A second version of the classical approach would focus on the epistemic goal of having justified or rational beliefs. Applied to the social realm, it might concentrate, for example, on when a cognitive agent is justified or warranted in accepting the statements and opinions of others. Proponents of the anti-classical approach have little or no use for concepts like truth and justification. In addressing the social dimensions of knowledge, they understand "knowledge" as simply what is believed, or what beliefs are "institutionalized" in this or that community, culture, or context. They seek to identify the social forces and influences responsible for knowledge production so conceived. Social epistemology is theoretically significant because of the central role of society in the knowledge-forming process. Intuitions play a critical role in analytical philosophical activity. But do they qualify as genuine evidence for the sorts of conclusions philosophers seek? Skeptical arguments against intuitions are reviewed, and a variety of ways of trying to legitimate them are considered. A defense is offered of their evidential status by showing how their evidential status can be embedded in a naturalistic framework.

For most of their respective existences, reliabilism and evidentialism (that is, process reliabilism and mentalist evidentialism) have been rivals. They are generally viewed as incompatible, even antithetical, theories of justification.1 But a few people are beginning to re-think this notion. Perhaps an ideal theory would be a hybrid of the two, combining the best elements of each theory. Juan Comesana (forthcoming) takes this point of view and constructs a position called “Evidentialist Reliabilism.” He tries to show how each theory can (...) profit by borrowing elements from the other. Comesana concentrates on reliabilism’s problems and how it might be improved by infusions from evidentialism. This paper follows a similar tack. My emphasis, however, is the reverse of Comesana’s. I highlight problems for evidentialism and show how it could benefit by incorporating reliabilist themes. I am not sanguine that evidentialists will see it my way. They might even view my proposals as an insidious attempt to convert evidentialists to reliabilism. Well, I won’t debate the best way to formulate this paper’s recipe. At any rate, it began with the idea (which anteceded my reading of Comesana) of creating a synthesis of reliabilism and evidentialism. It retains significant strands of that idea, although the synthesis theme does not pervade the entire paper. What is mentalist evidentialism? Its original formulation was succinct. (shrink)

What is the mission of epistemology, and what is its proper methodology? Such meta-epistemological questions have been prominent in recent years, especially with the emergence of various brands of "naturalistic" epistemology. In this paper, I shall reformulate and expand upon my own meta-epistemological conception (most fully articulated in Goldman, 1986), retaining many of its former ingredients while reconfiguring others. The discussion is by no means confined, though, to the meta-epistemological level. New substantive proposals will also be advanced and defended.

I begin with some familiar conceptions of epistemic relativism. One kind of epistemic relativism is descriptive pluralism. This is the simple, non-normative thesis that many different communities, cultures, social networks, etc. endorse different epistemic systems (E-systems), i.e., different sets of norms, standards, or principles for forming beliefs and other doxastic states. Communities try to guide or regulate their members’ credence-forming habits in a variety of different, i.e., incompatible, ways. Although there may be considerable overlap across cultures in certain types of (...) epistemic norms (e.g., norms for perceptual belief), there are sharp differences across groups in other types of epistemic norms. This chapter argues that empirical findings in cognitive science can play a significant evidential role in an optimal methodology for metaphysics. It does not propose any radical metaphysical methodology or any wholesale replacement of traditional methods. Rather, it offers a supplement to traditional methods. The chapter proposes a general template for metaphysical methodology under which cognitive scientific considerations might become routine or commonplace factors in realist metaphysics, not just isolated or occasional factors. People are minded creatures; we have thoughts, feelings and emotions. More intriguingly, we grasp our own mental states, and conduct the business of ascribing them to ourselves and others without instruction in formal psychology. How do we do this? And what are the dimensions of our grasp of the mental realm? In this book, Alvin I. Goldman explores these questions with the tools of philosophy, developmental psychology, social psychology and cognitive neuroscience. Schools are interesting as complex organizations in and of themselves but even more so for how they refract the societal dynamics by which inequality is reproduced, an enduringly vexing question (Fligstein & McAdam, 2012:3). Educational attainment is core to socioeconomic status and connected to outcomes in housing, health, and employment. Unequal schools in fields characterized by stratification are often the subject of reform attempts (Tyack, 1974). We examine how a wealthier and a poorer school responded to a state-level regulatory mandate (...) for change, in the U.S. context of schools as putative engines of opportunity. Bourdieu’s “master concepts” of field, habitus, and cultural capital (Swartz, 2008) are often applied, and we used them to answer frequent but still relatively unanswered calls in the literature: first, to use the master concepts together rather than singularly, and second, to attend specifically to the organization level and what it refracts (Dobbin, 2008; Emirbayer & Johnson, 2008; Hallett & Gougherty, 2018; Lounsbury & Ventresca, 2003; Mohr, 2013). For this integrative and organizational level approach, we derived the concept of “class signature,” which enabled us to focus on practices in organizations. This lens revealed “resistant compliance” in the wealthier school and “compliant resistance” in the poorer school, both of which reshaped the stratified field, even if stratification was not rectified. These responses appeared to reproduce inequality, not simplistically, we argue, but along a winding path fraught with practical experiments, protection against penalties, redefinition of the reform’s terms, and some small gains to remedy intra-organizational inequalities. Standard theories of distributive justice systematically ignore these constraints. In light of these considerations I define what it is that must be produced and how it must be distributed in order to assure continued production.
