In The Rule of Law in the Real World, Paul Gowder presents a new account of the rule of law based on three conditions: publicity, regularity, and generality. In this essay, I examine two closely related questions that are prompted by Gowder’s version of the rule of law. First, does the rule of law require citizens to follow the law? Second, what does Gowder’s account mean for jury nullification? I argue that the rule of law does not require citizens to (...) follow the law, but it does prohibit jury nullification. Russell Hoban’s famous children’s novel, The Mouse and His Child, centers around a child’s quest for family, community, and self-awareness. This paper works to describe the novel as philosophical insofar as the novel takes up themes and elements of Maurice Merleau-Ponty’s essay “The Child’s Relations with Others.” Because the mouse and his father are joined at the hands, because they find their motion to be a problem, and because they work through ambiguity toward a loving community, the novel puts particular (...) emphasis on what Merleau-Ponty calls intercorporeality and the way a child’s perception of ambiguity can lead to a non-pathological engagement with others in a loving, thoughtful way. Ultimately, this paper argues that the novel ought to be read and taught to children because it represents to them the emotion, language, and desire of a child as being a catalyst even for adult growth. Most Americans today view mines as little more than ugly scars on the landscape, places with no connection to an American way of life. This creative new work will force many to rethink that impression: after an introduction to the history of mining in America, the authors present eight visual and historical essays about diverse sites across the nation, each of which reveals mines not simply as physical degradations but as evolving cultural artifacts of the American landscape.

The expressive power of logic is believed to be able to model most of the fundamental aspects of information retrieval. However, it is also understood that classical logic is ineffective for handling partiality and uncertainty in IR. Applying non-classical logics such as the AGM belief revision logic and the possibilistic logic to adaptive information retrieval is appealing since they provide a powerful and rigorous framework to model partiality and uncertainty inherent in any IR processes. The maxi-adjustment method, which is an (...) effective computational apparatus of the AGM paradigm, is applied to develop the learning components of the adaptive information agents. Essentially, maxi-adjustment allows the partial representation K of a user's information needs N to be refined gradually based on the user's relevance feedback t. Generally speaking, learning in adaptive information agents is characterised by the AGM belief revision Kt*. On the other hand, possibilistic logic supports a gradated assessment of the uncertainty arising from matching K with the imperfect characterisation d of an information object D. Information matching in adaptive information agents is underpinned by K ƕ d, where ƕ is the possibilistic inference relation. This paper illustrates how maxi-adjustment and possibilistic deduction can be applied to develop the adaptive information agents. Their impact on the agents learning autonomy and explanatory power is also discussed. (shrink)

The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Members of his close (...) circle of friends, dubbed “the Quinlan Family,” regularly twitted him for preening in the mirror, and one close friend reports that Peter could not pass a reflective surface without stopping to examine his image.2 Peter’s narcissism was further empowered by his talent as a photographer. He began taking pictures while in high school when his mother, an English teacher who advised both the school newspaper and yearbook, recruited him to serve as the staff photographer for both publications. Peter was adept at making wacky collages that employ photographs and images culled from newspapers or magazines to serve as invitations, announcements to friends, and handbills for his performance activities. Under carefully controlled circumstances, Peter and his male friends donned female drag with Peter fashioning for himself a persona, “Princess Marie,” and signing himself as the same in letters to friends written in the royal first-person plural (see Illustration 2). When performing as the only male with two female partners in the Quinlan Sisters, a musical revue that he founded and for which he wrote the songs, he was generally identified in the program as “Marie Quinlan, the Sister with the Difference” (see Illustration 3).Peter experimented with personae even in his journals, where one might expect to find a less theatricalized self. But in his blurring of the line between fiction and autobiography Peter followed the lead established by Christopher Isherwood in The Berlin Stories (1935–39) and, more importantly, Christopher and His Kind (1976)—and pursued by Peter’s senior contemporaries Edmund White and Felice Picano—in which the autobiographer writes of himself in the third person in order to study himself with an almost brutal detachment, or in which the fictional protagonist is a barely disguised version of the writer’s self to the point of... This book presents a collection of contemporary discourses that reconsider the relationship of democracy as a political ideology and American ideal and education as the foundation of preparing democratic citizens in America.

Raymond Aron (1905–1983) assumed many guises over a long and fruitful career: journalist, polemicist, philosopher of history, counselor to political leaders and officials, theorist of nuclear deterrence and international relations. He was also France’s most notable sociologist. While Aron had especially close ties with Britain, a result of his days in active exile there during the Second World War, he was widely appreciated in the United States too. His book Main Currents in Sociological Thought was hailed a masterpiece; more (...) generally, Aron’s books were extensively reviewed in the American Journal of Sociology, the American Sociological Review (in earlier days, it hosted a review section), Contemporary Sociology, and Social Forces. And he was admired and cited by sociologists of the stature of Daniel Bell, Edward Shils, and David Riesman. Yet despite appearing well poised to become a major force in international sociology, analogous to his younger collaborator, Pierre Bourdieu, Aron has almost vanished from the sociological landscape. This article explains why, offering in the process some observations on the conditions—conceptual and motivational—of reputational longevity in sociological theory and showing how Aron failed to meet them. Special attention is devoted to a confusing equivocation in Aron’s description of sociology and to the cultural basis of his ambivalence toward the discipline. (shrink)

Peter French has argued that conglomerate collectivities such as business corporations are moral persons and that aggregate collectivities such as lynch mobs are not. Two arguments are advanced to show that French's claim is flawed. First, the distinction between aggregates and conglomerates is, at best, a distinction of degree, not kind. Moreover, some aggregates show evidence of moral personhood. Second, French's criterion for distinguishing aggregates and conglomerates is based on inadequate grounds. Application of the criterion to specific cases requires an (...) additional judgment of a pragmatic nature which undermines any attempt to demonstrate French's thesis that actual conglomerates are moral persons and aggregates are not. Thus, French's theory is seriously lacking both empirical basis and empirical relevance. (shrink)

Philosophical naturalism in the spirit of Wilfred Sellars has historically sought to present a unified picture of the world, in which values, meanings, and minds find a place in the natural universe. But a number of recent thinkers have questioned the very idea of “the world” as a unified whole, arguing instead for disunity in the various discourses human beings use to talk about things. In this article I consider three such pluralist views. First, I take up the work of (...) Huw Price, who combines pluralism and naturalism; then, I look at Markus Gabriel and Raymond Geuss, whose rejection of the ideas of “world” and “worldview” is not tied to naturalist presuppositions. In response to these views, I defend weaker conceptions of “the world” and “worldview,” utilizing Hans-Georg Gadamer's idea of the “medium of language” and making the case for the unifying effects of language across the plurality of discourses. The question of the ethical life is arguably one of the most compelling, and urgent, questions of our time. As Peter Singer, among others, has pointed out, almost 10 million children die each year due to poverty, some of whom would not die if the amount of aid that we now offer increases significantly. As Singer has also pointed out, the exploitation of human beings and other animals is a major ethical and practical concern. There can be little reasonable doubt (...) that pain and suffering abound, in the world today, due to many causes such as poverty, disease, environmental degradation and destruction and anthropocentrism among others, just as there can be little reasonable doubt that some of the pain and suffering is preventable. So, what does it mean to live ethically today? Does it mean taking the point of view of the universe, as Sidgwick put it, memorably, rather than a narrow anthropocentric or speciesist view? Does it mean living in accordance with duties or obligations, or in light of recognised virtues, or with the minimisation of pain and suffering primarily in mind? Does it entail a consideration of the interests of other species and a rejection of the principle of the sanctity of human life? Does it mean not eating animals when other healthy alternatives are available, especially when those animals have been treated in ways that are inconsistent with their interests, whatever they may be? Does it mean taking active steps to reduce poverty on our part on a day to day basis? Is ethics exhausted in some sense today? And if we could reach some consensus on these questions, what difference would the ethical life make? Some argue that speciesism and the exploitation of human beings and other animals might diminish; that pain and suffering, especially gratuitous pain and suffering, would decrease, or at the very least, not increase; or that we will become more aware of the limitations of things such as "the traditional ethic of the sanctity of life", as Singer calls it. Some argue that the ethical life is closely related to a life of relationships, reflection and deliberation, all of which deepen our understanding and enrich us personally. Others argue that the ethical life is closely related to our search for a meaningful life - that the ethical life can help us to find meaning in a world in which "meaning", defined broadly, can seem elusive, enigmatic or unsubstantial. These and related issues and questions are explored in this collection, which illustrates the relevance, vitality and dynamism of ethics today. (shrink)

Questions about the status of literary truth are as old as literary criticism, but they have become both more intricate and more compelling as literature has grown progressively more self-conscious and labyrinthian in its dealings with "reality." One might perhaps read The Iliad or even David Copperfield without raising such issues. But authors like Gide , Nabokov, Borges, and Robbe-Grillet seem continually to remind their readers of the complex nature of literary truth. How, for instance, are we to deal with (...) a passage like the following from William Demby's novel The Catacombs:"When I began this novel, I secretly decided that, though I would exercise a strict selection of the facts to write down, be they 'fictional' facts or 'true' facts taken from newspapers or directly observed events in my own life, once I had written something down I would neither edit not censor it ."1What does this sentence mean? When an apparently fictional narrator distinguishes between "fictional" and "true" facts, what is the status of the word "true"? It clearly does not mean the same as "fictional," for he opposes it to that term. Yet it cannot mean "true" in the sense that historians would use, for he calls what he is writing a novel, and even if he quotes accurately from newspapers, the events of a narrator's life are not "historically" true. · 1.
