Within the rough ground that is the field of education there is a complex web of ethical obligations: to prepare our students for their future work; to be ethical as educators in our conduct and teaching; to the ethical principles embedded in the contexts in which we work; and given the Southern context of this work, the ethical obligations we have to this land and its First Peoples. We put out a call to colleagues whose work has been concerned with (...) the pedagogies of professional ethics, the ethical burdens of institutional injustice, and the application of ethical theory to education’s applied fields. In the responses we received it can be seen that ethical concerns in education are broad ranging, covering terrain varying from the preparation of preservice teachers, ethics in higher education, early childhood and care, educational leadership, relational and communicative ethics. Perhaps it could also be argued that this paper demonstrates Gibbon’s observation that ‘Assumptions about the particularity of this time as new and ripe with opportunity to make a difference through philosophy of education are not new and there’s much to learn from the persistence of wanting to imagine that they are’. However, while the field of ethics is perennially concerned with human relations and pedagogical interventions to improve these, the responses collected here show that educational ethics is far from static. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 61.4 (2000) 561-575 [Access article in PDF] Claude de Seyssel's Translations of Ancient Historians Rebecca Boone Through his seven translations of ancient history Claude de Seyssel played a major role in transmitting knowledge about antiquity to the French. Despite this fact he has received little attention from scholars of the French Renaissance. Perhaps the problem is that Seyssel does not seem to fit (...) neatly into any category. He was neither French nor Italian but a Savoyard, not truly noble but the illegitimate son of a noble family, not truly a historian but a writer of history-based propaganda and a translator of histories. He began his career as a jurist, became a royal councillor, then a bishop, and in the end died as the Archbishop of Turin. Before his death Seyssel left numerous works, his most famous being a political treatise entitled La Monarchie de France, a work contemporaneous with The Prince by Machiavelli, with whom he shared a similar view of the political world. 1Much like Seyssel himself the genre of history translation has been rather neglected by scholars. A notable exception is a recent article by A.C. Dionisotti, which also examines the translations of Seyssel. The article's intention is to continue a project proposed by Arnaldo Momigliano, to collect evidence that "would help us to understand where and on what occasions and by what people books of history were written and read." 2 This essay attempts to continue this project by asking the following questions: Why did Seyssel undertake the translations? For whom were they intended? How did Seyssel conceive his task as translator? Finally, what can be inferred from his technique of translation? [End Page 561]First, the translations must be put in the context of Seyssel's life. The translations were a sideline in his busy career as royal councillor. One of many itinerant scholar-diplomats hired by the states of Europe at that time, Seyssel had been teaching law at the University of Turin when he was called into the service of France by the newly crowned Louis XII in 1498. Seyssel was of value to the court because of his reputation as a jurist as well as his connections with the court of Savoy, the state which held the mountain passes leading to Italy. This was especially important because the conquest of Milan was the main goal of Louis XII throughout his reign. Seyssel played an active role in the French occupational government in several Italian cities. Although Seyssel spent much of his time in Italy, he often followed the king around France or was in transit on diplomatic missions to England, to Flanders, and to the Swiss cantons.It is amazing that Seyssel even found the time to write, but by the end of his life, he had left an astounding variety of written works: legal commentaries, translations, works of propaganda for the French monarchy, a political treatise, and at the end of his life several religious tracts. Despite the copiousness of his written works, however, Seyssel remained outside the circle of writers at the French court. He had no connections either with Budé or with the Grands Rhetoriqueurs, such as Jean Lemaire de Belges, nor did he leave any friendly and eloquent correspondence to other humanists. If Seyssel lived during the budding years of the French renaissance, he showed few signs of appreciating it. As a Savoyard educated in Italy he probably thought of the French in the same way as did many Italians of his age: they were militarily powerful but culturally backward. 3Undoubtedly, Seyssel believed the translations would serve his own interests at court. They were a way to cultivate patronage and to enhance his prestige by building up a reputation as an important scholar. But evidence suggests that their main purpose was to prove to the king, to whom all but one of his translations were dedicated, his utility as a councillor. Discussions of the interpretation of quantum theory are at present obstructed by (1) the increasing axiomania in physics and philosophy which replaces fundamental problems by problems of formulation within a certain preconceived calculus, and (2) the decreasing (since 1927) philosophical interest and sophistication both of professional physicists and of professional philosophers which results in the replacement of subtle positions by crude ones and of dialectical arguments by dogmatic ones. More especially, such discussions are obstructed by the ignorance of both opponents, (...) and also defenders of the Copenhagen point of view, as regards the arguments which once were used in its defence. The publication of Bunge's Quantum Theory and Reality and especially of Popper's contribution to it are taken as an occasion for the restatement of Bohr's position and for the refutation of some quite popular, but surprisingly naive and uninformed objections against it. Bohr's position is distinguished both from the position of Heisenberg and from the vulgarized versions which have become part of the so-called "Copenhagen Interpretation" and whose inarticulateness has been a boon for all those critics who prefer easy victories to a rational debate. Einstein's main counterargument is discussed, and Bohr's refutation restated. The philosophical background and earlier forms of Bohr's views are stated also. Considering that these views are more detailed, better adapted to the facts of the microdomain than any existing alternative it follows that fundamental discussion must first return to them. Their uniqueness is not asserted, however. Here the author still maintains that a hundred shabby flowers are preferable to a single blossom, however exquisite. But a hundred shabby flowers plus an exquisite blossom are more desirable still. (shrink)

However, "Letter from the Recording Angel," "The Five Boons of Life," and "Letters from the Earth," although they are in a strict sense fictional, have been judged more relevant to the present volume that to the volumes of short fiction. "Things a Scotsman Wants to Know," previously unpublished, is included by agreement with the editor of (...) The Mark Twain Papers, as being especially relevant to themes of this volume. Other unpublished items appear as supplements because of their close relation to What Is Man?, Christian Science, and " 'The Turning Point of My Life.' " The two works that break off with unfinished sentences, "Bible Teaching and Religious Practice" and the introductory section of "Letters from the Earth," were abandoned by the author or else their endings have been lost. The order of works in this volume is according to date of publication or, for those unpublished during the author's lifetime, date of composition. Refrigeration has become so well established over the last 125 years that today a crude ice maker becomes a boon for primitive people in the jungle or desert. Only a total dislocation in energy sources will quickly loosen the connections between people and cooling. A few centuries ago, Hippocrates observed: ‘most men would rather run the hazards of their lives or health than be deprived of the pleasure of drinking out of ice’ … In the U.S.A. [today], 750 million (...) frozen Eskimo Pies are sold annually and seven ice cream plants are said to be operating in Moscow … Like the men of Hippocrates, a lot of people will resist any curtailment in food and freezing operations. They have come to expect these for survival in our present social and industrial orders.These remarks, asserting the extent to which the people of the United States of America regarded refrigeration not as an optional luxury but as a necessity for survival even at the height of the energy crisis of the late 1970s, formed part of a contribution to a massive 11-volume international compendium, Alternative Energy Sources, produced in 1978 in response to Western concerns about rising oil prices and falling reserves. An enthusiastic advocate for geothermal energy, the contributor's perception provides a vivid contextual starting point for our study of Paul Theroux's novel The Mosquito Coast . In this novel the central narrative focuses upon a New England family's rejection of post-war American consumer society with its imperative to ‘build automobiles that would fail within five years and refrigerators that would fail in ten’. The novel indeed explores some of those very kinds of alternative energy sources which had been exciting scientists and inventors since the early 1970s when journals such as The Ecologist had begun to prophesy an end to energy-driven economic growth in the western world. Sears pulled their advertising from NBC's online posting of the sketch and Jim Baker argued that it was the “most blasphemous skit in SNL history.” Actor Pat Boone, who starred in the film, objected to the SNL parody, equating it to an attack on God and suggesting that the writers had earned themselves a place in hell. SNL was birthed into existence in conflict with religion. That conflict came to a (...) head on October 3, 1992 when Sinead O'Connor – after singing an acapella version of Bob Marley's “War” – held up a picture of Pope John Paul II, sang the word “evil,” tore the picture to shreds, and shouted “Fight the real enemy!”. The Republic is essentially one long argument that it's better to be like O'Connor because being virtuous comes with its own internal reward that far outweighs the reward of public recognition. Human experts are the source of knowledge required to develop computer systems that perform at an expert level. Human beings are not, however, able to reliably express what they know. As a result, experts often develop non-authentic accounts of their own expertise. These accounts, here termed reconstructed methods of reasoning, lead to computer systems that perform at a high level of proficiency but have the disadvantage that they often do not reflect the heuristics and processing constraints of a system user. Tests are proposed to establish the authenticity of reasoning methods and examples from medical diagnosis are used to illustrate how authentic methods of reasoning can be incorporated into an expert computer system. How do things come to stand for something other than themselves? An understanding of the ontology of relations allows for a compelling account of the action of signs. The Primacy of Semiosis is concerned with the ontology of relations and semiosis, the action of signs. Drawing upon the work of Gilles Deleuze, John Deely, and John Poinsot, Paul Bains focuses on the claim that relations are 'external' to their terms, and seeks to give an ontological account of this purported (...) externality of relations. Bains develops the proposition, first made in 1632 by John Poinsot (John of St. Thomas), that, ontologically, signs are relations whose whole being is in esse ad ('being-toward'). Furthermore, relations are found to be univocal in their being as relations. This univocity of being is antecedent to the division between 'ens rationis' and 'ens reale'. The ontology of relations Bains presents is thus neither mind-dependent nor mind-independent insofar as the rationale of the relation is concerned. The book includes chapters on Deleuze and Deely on relations, Jacob von Uexkull and Heidegger on Umwelten (self-worlds), Maturana and Varela on Autopoiesis. It provides a form of vicarious causality, by way of the scholastic doctrine of the 'species', that complements the emerging school of 'object oriented ontology'. The Primacy of Semiosis provides a semiotic that subverts the opposition between realism and idealism; one in which what have been called 'nature' and 'culture' interpenetrate in an expanding collective of human and non-human. Appelbaum* (bio)AbstractThe preceding commentary by Louis Charland suggests that traditional cognitive views of decision-making competence err in not taking into account patients’ emotional capacities. Examined closely, however, Charland’s argument fails to escape the cognitive bias that he condemns. However, there may be stronger arguments for broadening the focus of competence assessment to include emotional capacities, centering (...) on the ways in which emotions aid humans in processing information. Before emotional capacities are added to the list of functions essential for decisional competence, though, the feasibility and utility of such a reorientation must be demonstrated.To what extent ought persons’ capacities to experience emotion be taken into account when determining whether they should be deemed competent to make their own decisions? In the previous article, Louis Charland (1998) argues that traditional models of decision-making competence—of which the MacArthur Competence Treatment Study is a typical example—are mistaken in focusing narrowly on persons’ cognitive abilities to the neglect of emotional factors. In contrast, he suggests, constructs of competence ought explicitly to require a capacity to experience emotions, which he believes is central to meaningful decision making, before deeming persons competent.Charland, as he acknowledges, is not the first to suggest that the presence of some degree of emotional capacity is a necessary element of competence, but his argument is among the most elaborate to date and is certainly worth closer examination. Looked at carefully, however, Charland’s argument does not make quite the case for the determination of emotional capacity in competence assessment that he claims for it. Indeed, as I demonstrate below, Charland may share the same “pernicious [End Page 377] cognitive bias” that he ascribes to more traditional approaches. However, despite what I identify as the problems in Charland’s argument, others have raised more disturbing questions about the lack of attention to emotional issues in competence assessment. Thus, I am not ready to reject entirely the possibility that determinations of decisional competence ought to consider emotional factors. I conclude by outlining the questions that remain to be answered to identify more clearly the potential benefits of such an approach.The Construct of Decision-Making CompetenceSome preliminary comments about the nature of the dominant construct of decision-making competence may provide a useful frame for my response to Charland’s paper. Contemporary ideas of competence are tied inextricably to the ideal of self-determination in modern Western societies. Such societies are committed to respect for individual choice, both as a good in its own right and on the grounds that each person knows best what choices will maximize his or her own welfare. In general, therefore, states will not intervene to prevent persons from acting on their decisions, even when the choices they make—like the decision to smoke or to refuse potentially life-saving medical care—may objectively be thought to be detrimental to them.In some cases, however, the presumption that people will act in their own interests, as well as the notion that there is something intrinsically valuable in respecting their choices, fails (Buchanan and Brock 1989). When people’s minds are so disordered that they cannot be said to be making meaningful choices, other values come into play. Such people are called “incompetent.” When persons reach that point, the state’s interest in protecting its citizens becomes primary and someone else must make decisions on their behalf. Note that the size of this group must be sharply limited, lest a liberal society’s commitment to self-determination be undermined: There is no more profound infringement of the rights of citizens than the determination that they are incompetent. Thus, the criteria for incompetence must be selected in a deliberately narrow fashion—alternately, one might say that the standards for competence are made intentionally broad—so that all but a tiny percentage of citizens will be permitted to make decisions on their own.In the Anglo-American world, the process of formulating criteria of competence by and large has been left to the common law courts. Holdsworth (bio)On 18 September 2008, the U.S. Food and Drug Administration (FDA) issued a draft set of guidelines for those involved in developing genetically engineered animals with heritable recombinant DNA (rDNA) constructs and is requesting comment from industry and the public about their content. The document does not impose new regulations but details (...) how existing laws and regulations apply to genetically engineered (GE) animals and offers advice to developers on how to negotiate the laws in the most efficient and productive manner. The draft guidance document is not legally enforceable at this juncture, but the guidelines are recommendations reflecting the FDA's "current thinking on a topic."The modification of GE animals being developed for commercialization, which are the focus of the document, fall into six categories: modifications intended to (1) enhance food quality—e.g., faster growing fish and meats with better nutritional profiles; (2) improve animal health via increased resistance to disease—e.g., mastitis in dairy cattle and Bovine Spongiform Encephalopathy (BSE); (3) create so-called "biopharm" animals capable of producing therapeutic products such as insulin, clotting factors, and tissues for human transplantation; (4) reduce the barriers to human animal interaction—e.g., hypoallergenic pets; (5) develop valid animal models of human disease—e.g., Parkinson's disease, Lesh-Nyhan's syndrome, and cancer; and (6) improve production of industrial or consumer products such as fiber. [End Page 393]Before proceeding to a review of the draft guidelines, it is important briefly to set the controversies around GE animals in historical and ethical context.The Ethical DebateFrom its inception, the intentional genetic modification or genetic engineering of molecules, plants, and animals by the techniques of gene splicing has consistently elicited strong responses from both the scientific community and the public. There are some data to suggest that although the concerns of scientists fall primarily into the category of possible biohazards, those of the public also reflect great concern about the intrinsic moral issues, such as whether there is something fundamentally wrong with this line of work, making it a form of forbidden knowledge (see, e.g., Gaskell 1997). When news of Paul Berg's attempts in 1970 to graft the primate tumor virus (SV 40) onto the intestinal tract bacteria Escherichia coli for the purpose of studying how normal cells may be transformed into cancerous cells was shared with colleagues, he was strongly encouraged to reflect on the potential public health risks if somehow the altered bacteria broke containment and entered the environment. Thanks to Berg's leadership, these concerns soon resulted in conferences held in Asilomar, California, and New Hampton, New Hampshire, where the ethical responsibilities of microbiologists involved in this research were discussed. These initial discussions resulted in what has come to be known as "The Moratorium Letter" (Shattuck 1996) published in the journal Science in 1974. This letter, signed by 11 leaders in the field, actually recommended restrictions on several types of experiments that were considered to be particularly risky and stated "that adherence to our major recommendations will entail postponement or possibly abandonment of certain types of scientifically worthwhile experiments" (Berg 1974). An international conference on the issues came to similar conclusions about the need for a research moratorium for the sake of public safety. This essay is intended to be a systematic exposition and critique of Daniel Dennett's general views. It is divided into three main sections. In section 1 we raise the question of the nature of a plausible scientific psychology, and suggest that the question of whether folk psychology will serve as an adequate scientific psychology is of special relevance in a discussion of Dennett. We then characterize folk psychology briefly. We suggest that Dennett's views have undergone at least one major change, (...) and proceed to discuss both his earlier and his later views. In section 2 we suggest that Dennett is correctly perceived as an instrumentalist in his earlier works. We think that Dennett later abandons this position because of general worries about instrumentalism and, more importantly, because Dennett became convinced that an instrumentalist conception of folk psychology will not enable us to vindicate the notions of personhood, moral agency, and responsibility. This left Dennett with a dilemma. On the one hand, he does not think that beliefs, etc., will turn out to be genuine scientific posits. On the other hand, he thinks that moral agency would be impossible if we could not treat beliefs, etc. as causally efficacious in some suitable sense. In section 3 we discuss Dennett's resolution of this dilemma. The key to his current view, we suggest, is the illata-abstracta distinction. Dennett holds that both illata and abstracta are real and have causal powers, even though only illata are genuine scientific posits. He suggests that beliefs etc. are abstracta, and are the subject matter of what he calls 'intentional system theory'. The subject matter of another theory, what Dennett calls 'subpersonal cognitive psychology', are illata, which are subpersonal intentional states. The important point is that this distinction lets Dennett have it both ways: (i) Since beliefs are mere abstracta, we need not commit ourselves to the thesis that beliefs will turn out to be posits of an adequate scientific psychology. (ii) Since beliefs have causal power, we are assured of moral and rational agency. We shall argue that Dennett's current view is untenable. If we are right in our arguments, then Dennett's program to produce a scientifically plausible psychology, one that will turn out to vindicate folk psychology (in some suitable sense), is a failure. It fails in the following important ways: (i) What Dennett sketches -- intentional system theory cum subpersonal cognitive psychology -- is not a plausible scientific psychology. (ii) As a consequence, Dennett also fails to provide a satisfactory foundation for moral and rational agency. (shrink)

An exciting development in the field of assisted reproductive technologies is In Vitro Gametogenesis (IVG) that enables production of functional gametes from stem cells in the laboratory. Currently, development of this technology is still at an early stage and has demonstrated to work only in rodents. Upon critically examining the ethical dimensions of various possible IVG applications in human fertility treatment from a Sunni Islamic perspective, together with benefit-harm (maslahah-mafsadah) assessment; it is concluded that utilization of IVG, once its efficacy (...) and safety are guaranteed, could be permissible by strictly adhering to Islamic ethical principles related to marriage, biological/genetic relatedness, sexual intercourse, and moral status of the embryo/fetus versus that of the gamete. As a result, IVG will be acceptable for treating primary infertility, age-related infertility, and preventing genetic diseases. However, it will be unacceptable for application in posthumous reproduction, donor gametes, genetic enhancement, and procreation in same-sex couples. (shrink)

The majority of women who freeze their eggs for non-medical or social reasons, commonly referred to as elective egg freezing (EEF), do not eventually utilize their frozen eggs. This would result in an accumulated surplus of unused frozen eggs in fertility clinics worldwide, which represents a promising source of donation to infertile women undergoing IVF treatment. Rigorous and comprehensive counseling is needed, because the process of donating one’s unused surplus frozen eggs involves complex decision-making. Prospective EEF donors can be broadly (...) categorized into those who have achieved motherhood and those who remained childless and have given up on motherhood aspirations. A two-step systematic counseling protocol is proposed. Firstly, it is imperative to verify and ensure that these women do not want to conceive any children with their surplus frozen eggs before proceeding with further counseling and signing of consent forms. Secondly, various motivating and dissuading factors in the donation of unused surplus frozen eggs should then be comprehensively discussed with egg freezers to facilitate informed decision-making. Key motivating factors for donation include reciprocity in wanting to share the joys of motherhood among egg freezers who already have children, goodwill to help others in need, and avoiding the wastage of surplus frozen eggs after expending so much money, time, and effort. Key dissuading factors include fear of accidental incest between natural and unknown donor-conceived offspring, as well as apprehension of unexpected future contact with unknown donor-conceived offspring due to either donor anonymity being abolished in their jurisdiction or widespread consumer DNA testing. Liberal societies are built on a foundation of personal rights, including the right to make decisions about the medical treatment that one will receive or decline to receive. So essential to the liberal project is the power of individual choice that it will be abrogated only in the most extreme situations, in which persons seem to be unable to make rational decisions and thereby to protect their interests. A small number of decision-related abilities have been identified as relevant to the (...) determination of when a person will be deemed decisionally incapable: understanding, appreciation, reasoning, and choice.
