Within the rough ground that is the field of education there is a complex web of ethical obligations: to prepare our students for their future work; to be ethical as educators in our conduct and teaching; to the ethical principles embedded in the contexts in which we work; and given the Southern context of this work, the ethical obligations we have to this land and its First Peoples. We put out a call to colleagues whose work has been concerned with (...) the pedagogies of professional ethics, the ethical burdens of institutional injustice, and the application of ethical theory to education’s applied fields. In the responses we received it can be seen that ethical concerns in education are broad ranging, covering terrain varying from the preparation of preservice teachers, ethics in higher education, early childhood and care, educational leadership, relational and communicative ethics. Perhaps it could also be argued that this paper demonstrates Gibbon’s observation that ‘Assumptions about the particularity of this time as new and ripe with opportunity to make a difference through philosophy of education are not new and there’s much to learn from the persistence of wanting to imagine that they are’. However, while the field of ethics is perennially concerned with human relations and pedagogical interventions to improve these, the responses collected here show that educational ethics is far from static. Educational ethics is a field that continues to develop in response to changing contexts. (shrink)

The recent renewal of interest in the philosophy of Henri Bergson has increased both recognition of his influence on twentieth-century philosophy and attention to his relationship to phenomenology. Until now, the question of Martin Heidegger’s debt to Bergson has remained largely unanswered. Heidegger’s brief discussion of Bergson in Being and Time is geared toward explaining why he fails in his attempts to think more radically about time. Despite this dismissal, a close look at Heidegger’s early works dealing with temporality reveals (...) a sustained engagement with Bergson’s thought. In The Origin of Time, Heath Massey evaluates Heidegger’s critique of Bergson and examines how Bergson’s efforts to rethink time in terms of duration anticipate Heidegger’s own interpretation of temporality. Massey demonstrates how Heidegger follows Bergson in seeking to uncover “primordial time” by disentangling temporality from spatiality, how he associates Bergson with the tradition of philosophy that covers up this phenomenon, and how he overlooks Bergson’s ontological turn in Matter and Memory. Through close readings of early major works by both thinkers, Massey argues that Bergson is a much more radical thinker with respect to time than Heidegger allows. (shrink)

This paper makes a phenomenological contribution to the distinction between personal and subpersonal types of explanation. I expound the little-known fact that Husserl gives an account of personal level explanation via his exposition of our capacity to express the understanding of another’s motivational nexus when we are in the personalistic attitude. I show that Husserl’s unique exposition of the motivational nexus conveys its concrete, internally coherent, and intentional nature, involving relationships amongst the sense contents of acts of consciousness. Moreover, the (...) motivational nexus is a generative space of possibility and choice. I show that, for these reasons, motivational explanation is not causal, nor deductive nomological, nor does it reduce to subpersonal explanation. I finish with the comment that the uniqueness of personal level explanation points towards the possibility that the human sciences ought also employ types of explanations not found in natural sciences. Habermas has argued that many of the endemic socio- economic problems of Western society are either symptoms or prod ucts of a 'lopsided' process of cultural rationalization, one that has emphasized instrumental forms of rationality over communicative. But other than presenting a rather general typology of lifeworld pathologies, Habermas has not done much to specify what these problems might be, nor has he provided any 'middle-range' analysis of the mechanisms through which they might be generated. This paper discusses some of (...) the ways in which, consistent with Haber mas's general framework, rational choice theory can be used for pre cisely this task. In this analysis, rational choice theory is not presented as a comprehensive theory of action, but is employed as a critical- diagnostic tool that allows the theorist to identify undesirable social interaction patterns that arise from a broader instrumentalization of the lifeworld. In this book Joseph Heath brings Jürgen Habermas's theory of communicative action into dialogue with the most sophisticated articulation of the instrumental conception of practical rationality-modern rational choice theory. Heath begins with an overview of Habermas's action theory and his critique of decision and game theory. He then offers an alternative to Habermas's use of speech act theory to explain social order and outlines a multidimensional theory of rational action that includes norm-governed action as a specific type.In the (...) second part of the book Heath discusses the more philosophical dimension of Habermas's conception of practical rationality. He criticizes Habermas's attempt to introduce a universalization principle governing moral discourse, as well as his criteria for distinguishing between moral and ethical problems. Heath offers an alternative account of the level of convergence exhibited by moral argumentation, drawing on game-theoretic models to specify the burden of proof that the theory of communicative action and discourse must assume. ABSTRACT Philosophers who work on race and racism have been reluctant to embrace the notion that the United States is, or will soon be, a postracial society. For many, this view is refuted by a wealth of evidence that racism persists in many forms and that race continues to have a significant impact on one's life chances. Nevertheless, some critics of postracialism have refused to reject it in principle or have exempted a particular variety of it from their critiques. This (...) essay attempts to show that the ideal of a postracial society is actually a combination of two contradictory tendencies, each defined by its temporality. Distinguishing these tendencies allows us to see that there are two fundamentally different types of postracialism with contradictory assumptions and conflicting priorities. (shrink)

This article provides an overview of Edmund Husserl’s lesser known account of high-level imaginative empathy. The author discusses Husserl’s solution to what we might call the ‘generalizability problem’; if empathy is conceived as a relation whereby the understanding I have of my own mind allows me to understand your mind, then how does empathy account for potential differences between us? The author also discusses some features that make empathy more generalizable than might be initially thought, as well as its limits. (...) A second major aim is to use this exegesis of Husserl to show a variety of overlaps between his theory and high-level simulation theory. The author also shows how Husserl’s phenomenological theory provides a compelling response to critiques of high-level simulation from authors that utilize a hybrid cognitive science/phenomenological approach. Robert Brandom claims that language expressing pro-attitudes makes explicit proprieties of practical inference. This thesis is untenable, especially given certain premises which Brandom himself endorses. Pro-attitude vocabulary has the wrong grammatical structure; other parts of vocabulary do the job he ascribes to pro-attitude vocabulary; the thesis introduces implausible differences between the inferential consequences of desires and intentions, and distorts the interpretation of conditional statements. Rather, I suggest, logical vocabulary can make proprieties of practical inference explicit, just as the inferentialist says (...) it can for theoretical inference. (shrink)

The 'fitting-attitudes analysis' aims to analyze evaluative concepts in terms of attitudes, but suffers from the 'wrong kind of reasons' problem. This article critiques some suggested solutions to the WKR problem and offers one of its own, which appeals to the aims of attitudes. However, goodness is not a concept that can be successfully analyzed according to the method suggested here. Reasons are given why goodness should be thought of, instead, as a mind-independent property.

There is an intuition to the effect that, if human actions are explicable in scientific terms – that is, if mechanism holds – then our lives and actions do not matter. “Mattering” depends on successful intentional explanations of human actions. The intuition springs from an intuitive analogy between manipulation and mechanism: just as a manipulated agent's actions are not successfully explained in intentional terms, neither are the actions of a mechanistic agent. I explore ways to avoid the conclusion of this (...) argument. Some of these ways are more promising than others, but all have non-trivial philosophical consequences. (shrink)

This work analyzes the centrality of law in nineteenth-century historical and institutional economics and is a prehistory to the new institutional economics of the late twentieth century. In the 1830s the 'new science of law' aimed to explain the working rules of human society by using the methodologically individualist terms of economic discourse, stressing determinism and evolutionism. Practitioners stood readier than contemporary institutionalists to admit the possibilities of altruistic values, bounded rationality, and institutional inertia into their research program. Professor Pearson (...) shows that the positive analysis of law tended to push normative discussions up from the level of specific laws to that of society's political organization. The analysis suggests that the professionalization of the social sciences - and the new science's own imprecision - condemned the program to oblivion around 1930. Nonetheless, institutional economics is currently developing greater resemblances to the now-forgotten new science. (shrink)

Ingarden’s phenomenology of aesthetics is characterised primarily as a realist ontological approach which is secondarily concerned with acts of consciousness. This approach leads to a stark contrast between spatiotemporal objects and literary objects. Ontologically, the former is autonomous, totally determined, and in possession of infinite attributes, whilst the latter is a heteronomous intentional object that has only limited determinations and infinitely many “spots of indeterminacy.” Although spots of indeterminacy are often discussed, the role they play in contrasting the real and (...) literary object is not often disputed. Through a close reading of Ingarden’s ontological works and texts on aesthetics, this essay contests the purity of Ingarden’s ontological approach and the ensuing disparity between real and literary object, particularly on the question of spots of indeterminacy. I do this by demonstrating the following five theses: 1) Ingarden’s claim that the real object has an infinitude of properties belies an epistemology, and we should instead conclude that ontologically the real object’s properties are finite. 2) Ingarden’s a priori argument that absent properties of real objects are ontologically determined is unsound. 3) The radical difference between the infinitude and finitude of givenness and absence of the real and the literary object ought to be relativised. 4) Indeterminacies within the novel are concretised in much the same way that absent properties of real objects are intended. 5) Literature makes claims that have a truth value that we can attribute to their author. Zahavi and Gallagher’s contemporary direct perception model of intersubjectivity has its roots in the phenomenological project of Edmund Husserl. Some authors :731–748, 2010; Krueger in Phenomenol Cogn Sci 11:149–173, 2012; Bohl and Gangopadhyay in Philos Explor 17:203–222, 2014) have utilised, and criticised, Husserl’s model of direct empathic perception. This essay seeks to correct certain misunderstandings of Husserl notion of direct empathic perception and thus, by proxy, clarify the contemporary direct perception model, through an exegesis of Husserlian texts. In the first (...) half of this essay I clarify the analogy between the directness of regular material object perception and the directness of empathic perception via a clarification of Husserl’s notion of co-presence. I argue that contemporary renditions of Husserl’s account which stress the dis-analogy between these two types of perception are based on a superficial and incorrect rendering of Husserl’s notion of co-presence. In the second half of this essay I clarify the notion of verification. I argue that, for Husserl, behaviour does not verify mental life. Instead, empathic verification occurs via the relation between concepts and intuitions. In my conclusions I show how contemporary authors misunderstand the fundamental nature of Husserl’s account of empathy because of the downgraded status of psychic life within contemporary cognitive science. According to Hannah Arendt, the first impetus for her final project, The Life of the Mind, was her astonishment at the apparent lack of thought at the root of Adolf Eichmann’s crimes against humanity—a “manifest shallowness” which, nevertheless, “was not stupidity, but thoughtlessness.” This spectacle of the absence of thought, in the light of the immeasurable harm done to the victims of the Nazi regime, motivated her to get to the bottom of what it means to think. Since thinking is (...) often portrayed by philosophers as a withdrawal from the world, Arendt raises the question “Where are we when we think?” In pursuit of an answer, she provides a reading of Kafka’s parable “HE,” which she interprets as a description of the “region of thought” as a battleground between the past and thefuture. This parable enables Arendt to understand the activity of thinking in terms of temporality. While Kafka’s protagonist dreams of rising above the conflict and adopting a position outside time, Arendt argues that thoughtful reflection happens in the “gap between past and future” which philosophers have called the nunc stans or the moment. Rather than being timeless, in her view, thinking moves along a diagonal “thought-train” emerging from this gap. Arendt sheds more light on thinking by considering how its temporality differs from that of willing, which is determined by a primacy of the future. This difference between thinking and willing produces a conflict between them, which many philosophers have struggled to resolve. Arendt presents Hegel as a case in which this conflict is resolvednot, as we might expect, by a triumph of thought, but rather a triumph of the will. Arendt’s reflections on the temporality of thinking in Kafka and Hegel enable us to distinguish several different forms of thoughtlessness according to their dominant tense. Although Arendt does not spell out these distinctions herself, they make it possible to develop a deeper understanding of Eichmann’s thoughtlessness and its relation to evil. (shrink)

Society, based on contract and voluntary exchange, is evolving, but remains only partly developed. Goods and services that meet the needs of individuals, such as food, clothing, and shelter, are amply produced and distributed through the market process. However, those that meet common or community needs, while distributed through the market, are produced politically through taxation and violence. These goods attach not to individuals but to a place; to enjoy them, individuals must go to the place where they are. Land (...) owners, all unknowingly, distribute such services contractually as they rent or sell sites. Rent or price is the market value of such services, net after disservices, as they affect each site. By distributing occupancies to those who can pay the highest price, land owners’ interests align with those of society. Without this, tenure would be precarious—by force or favor of politicians. The 18th-century separation of land from state, so little studied by historians, permitted the development of modern property in land. This change is perhaps “the greatest single step in the evolution of Society the world has ever seen.” When land owners realize that they market community services, they will organize to produce and administer them as well, and society will be made whole. In four new and nine previously published essays, Joseph Heath provides a compelling new framework for thinking about the moral obligations of economic actors. The "market failures" approach to business ethics that he develops provides the basis for a unified theory of business ethics, corporate law, economic regulation, and the welfare state.

One of the most influential ideas in the field of business ethics has been the suggestion that ethical conduct in a business context should be analyzed in terms of a set of fiduciary obligations toward various “stakeholder” groups. Moral problems, according to this view, involve reconciling such obligations in cases where stakeholder groups have conflicting interests. The question posed in this paper is whether the stakeholder paradigm represents the most fruitful way of articulating the moral problems that arise in business. (...) By way of contrast, I outline two other possible approaches to business ethics: one, a more minimal conception, anchored in the notion of a fiduciary obligation toward shareholders; and the other, a broader conception, focused on the concept of market failure. I then argue that the latter offers a more satisfactory framework for the articulation of the social responsibilities of business. (shrink)

The use of agency theory remains highly controversial among business ethicists. While some regard it as an essential tool for analyzing and understanding the recent spate of corporate ethics scandals, others argue that these scandals might not even have occurred had it not been for the widespread teaching of agency theory in business schools. This paper presents a qualified defense of agency theory against these charges, first by identifying the theoretical commitments that are essential to the theory (in order to (...) distinguish between agency theory itself and certain incorrect interpretations that have been widely promulgated), and second, by specifying more clearly the different ways that agency theory can be used to analyze relations within the firm. The recommendation that follows from this analysis is that agency theory be used as a critical-diagnostic tool, to identify the points at which both firms and markets will be vulnerable to breakdown in the absence of moral constraint. Husserl’s early picture of explanation in the sciences has never been completely provided. This lack represents an oversight, which we here redress. In contrast to currently accepted interpretations, we demonstrate that Husserl does not adhere to the much maligned deductive-nomological (DN) model of scientific explanation. Instead, via a close reading of early Husserlian texts, we reveal that he presents a unificationist account of scientific explanation. By doing so, we disclose that Husserl’s philosophy of scientific explanation is no mere anachronism. It (...) is, instead, tenable and relevant. We discuss how Husserl and other contemporary thinkers draw theoretical inspiration from the same source—namely, Bernard Bolzano. Husserl’s theory of scientific explanation shares a common language and discusses the same themes as, for example, Phillip Kitcher and Kit Fine. To advance our novel reading, we discuss Husserl’s investigations of grounding, inter-lawful explanation, intra-mathematical explanation, and scientific unification. (shrink)
