Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

Es esta interdisciplinariedad lo que dota hoy en día a la cuestión trans* de tanta relevancia, tampoco exenta de polémica con otros movimientos sociales, como las redes sociales han venido mostrando últimamente. No obstante, es la gran visibilidad que ha obtenido por diferentes medios la cuestión trans* lo que la hace susceptible de múltiples análisis, que, como se ha dicho anteriormente, no se limitan a una única disciplina o a un único punto de vista. Recommender Systems (RecSys) have been around since the early days of the Internet, helping users navigate the vast ocean of information and the increasingly available options that have been available for us ever since. The range of tasks for which one could use a RecSys is expanding as the technical capabilities grow, with the disruption of Machine Learning representing a tipping point in this domain, as in many others. However, the increase of the technical capabilities of AI-powered RecSys did not (...) come with a thorough consideration of their ethical implications and, despite being a well-established technical domain, the potential impacts of RecSys on their users are still under-assessed. This paper aims at filling this gap in regards to one of the main impacts of RecSys: personal autonomy. We first describe how technology can affect human values and a suitable methodology to identify these effects and mitigate potential harms: Value Sensitive Design (VSD). We use VSD to carry out a conceptual investigation of personal autonomy in the context of a generic RecSys and draw on a nuanced account of procedural autonomy to focus on two components: competence and authenticity. We provide the results of our inquiry as a value hierarchy and apply it to the design of a speculative RecSys as an example. (shrink)

In attempting to debunk moral realism through an appeal to evolutionary facts, debunkers face a series of problems, which we label the problems of scope, corrosiveness, and post‐hoc justification. To overcome these problems, debunkers must assume certain metaphysical or epistemological positions, or otherwise pre‐establish them. In doing so, they must assume or pre‐establish the very conclusion they seek in advancing the argument. This means that such debunking arguments either beg the question against the moral realist or are undermined as standalone (...) metaethical arguments. (shrink)

Starting on Bourdieu’s approach to precariousness, this article analyzes this phenomenon as a new flexible norm that displaces the Fordist social norm. The authors argue, based on Gramsci’s study of Fordism, that precarization creates a mechanism of discipline for the legitimization of the loss of both labour and social rights, destroying the Keynesian social pact. Such disciplining happens coercively, both by the use of new technologies and by the generalization of the function of Marx’s industrial reserve army to all productive (...) strata; and also, by consensus, through a transformation in the work culture, leading to a “new flexible man” with a flagrant loss of its autonomy. In order to develop a collaborative experience of reflexive writing, this article explores the ethnographic process through two communication devices used by the authors in their respective fieldwork: tarot readings and evolutionary astrology. Reflecting on their distinct (if not opposing) backgrounds, the authors explore and interpret how their different backgrounds and conversational devices shape their ethnographic experience as a process of revealing the unknown, following the not-knowing approach (Anderson, 1997). An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Among the many applications of artificial intelligence (AI), virtual assistants are one of the tools most likely to grow in the future. The development of these systems may play an increasingly important role in many facets of our lives. Therefore, given their potential importance and present and future weight, it is worthwhile to analyze what kind of challenges they entail. In this chapter, we will provide an overview of the ethical aspects of artificial virtual assistants. First, we provide a conceptual (...) clarification of the term ‘virtual assistant’, including different types of interfaces and recommender systems. Second, we address three ethical issues related to the deployment of these systems: their effects on human agency and autonomy and the subsequent cognitive dependence they would generate; the human obsolescence that may cause a generalized extension of the dependence problem; and the invasions of privacy that virtual assistants may cause. Finally, we outline the debates about the use of virtual assistants to improve human moral decisions and some areas in which these systems can be applied. (shrink)

Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. This article contrasts Saint Augustine’s role in the creation of the Church’s theological dogma to Loyola’s modern gesture of independence vis-à-vis the Church. It then traces Loyola’s method to the core that grounds Descartes’ philosophical works. This core, I claim, is derived from Descartes’ understanding and imitation of the Spiritual Exercises. The Exercises obviate the Church by making it redundant, unnecessary. From this disavowal and distancing, Loyola gives the exercitant the psychological tools to emerge from the Exercises with a strong, (...) new sense of self that with time will transform the institution from within. In Descartes’ case, the moral subject capable of responding to the question of what God wants (the product of the Exercises) is displaced by the epistemological certainty necessary to create a new “Method” to study and understand the world. Se analiza la gestión comunal de estos bienes comunes partiendo de la noción de responsabilidad fuerte, que cuestiona la concepción de las personas como agentes autointeresados, y se identifican requisitos ineludibles: adecuación a las condiciones (...) sociales y ecológicas de cada lugar, información completa y relevante, procesos democráticos de decisión y reconocimiento por parte de los gobiernos de la capacidad y el derecho de los usuarios de elaborar sus propias normas y monitorear su cumplimiento. The relationship between Sacred Scripture and sacred Tradition is one of the areas that Pope John Paul II indicated in the encyclical Ut unum sint as being in need of fuller study in the ecumenical dialogue. The studies carried out during Vatican II with the aid and reflection of theologians and the preparation of alternative proposals, both official and unofficial, helped to change the whole approach, thus paving the way for the doctrinal Constitution on Divine Revelation. An essential component of (...) this approach is the introduction to the first chapter on Revelation. It introduced a qualitative rather than quantitative approach to the relationship between Scripture and Tradition. Moreover, when these are both linked to the one and only source, Revelation, Tradition is mostly presented as a vibrant and dynamic process guided by the Spirit, necessary for the conservation of the Gospel. This vision, in consonance with the reflection that was being made on the theme by the ecumenical movement during the years of the Council, has contributed to an opening up of dialogue that aims for consensus in areas that have divided Christian Churches for so long. Informed consent forms have been useful in clinical practice and they constitute a part of the shared decision making in the informed consent process. They provide information to patients about clinical procedures and techniques. They also act as a remainder of the information discussed after the medical interview. Sometimes these documents are not readable to everybody. Belgian law specifies that all information that patients receive has to be proportionate verbally, but written information is also handled. The present research analyzes the (...) readability of the Flemish informed consent forms located in the webs of all General Hospitals using a simple random sample of 75 informed consent forms. By using the Douma tool, which bases its analysis in the length of words and sentences, the readability mean of the sample was 46, level “Difficult”. The 59% of them had a difficult level. The 11% were normal. It is a fact, then, that the 59% of the informed consent forms evaluated in this study are not suitable for everybody in Flanders, especially those people with low literacy. There were some researches made in other countries that agreed with these results. Written clinical information was poorly written so the informed consent forms were not working helping patients to recall information nor helping patients to become a part in the shared decision making about their health. The use of readability formulas represented a simple way to discriminate those informed consent forms that had normal readability scores from those that should be adapted. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. Philosophical intervention in the dialogue between science and theology: an analysis of the concept of consonance In the last decades, a strong debate on the relationship between science and theology has taken place. In the early 1980, Ernan McMullin introduced the notion of “consonance”, defined as the spontaneous convergence of the conclusions presented by the natural sciences and theology on certain features or properties of the universe. In this paper, I shall try, first and foremost, to carefully look into the (...) meaning that has been attributed to this relationship. Thus, I shall examine the possible implications derived from specific cases of consonance; I shall consider the connection between consonance and truth ; I shall expand on the proposal for a dialogue based on different attitudes regarding consonance ; I shall evaluate the thesis that understands consonance as a cultural construction or an a priori accepted in certain contexts; finally, I shall mention certain variations of this concept, such as strong and weak consonance, or hypothetical consonance. Then, I shall explain the assumptions on which the idea of consonance rests: the unity and intelligibility of reality, the diversity of formal objects and the realism of knowledge. All these assumptions are comprehensive proof of the indispensable intervention of philosophy, as wisdom, in any kind of exchange that occurs between science and theology. And it is only from them that criticism regarding this issue is vested authority. Finally, I suggest a series of critical proposals on the notion of consonance. I shall stress, on the positive side, the opportunity that it offers to move towards a greater disciplinary integration and foster, at the same time, the ordering mission of philosophical wisdom. On the negative side, I shall point out the confusion between religion and theology, the tendency towards a kind of epistemic naturalism of theology, the uncertain creation of the idea of scientific realism and the aspiration to an excessive interference among disciplines.
