We all know that speech can be harmful. But how? Mary Kate McGowan argues that speech constitutes harm when it enacts a norm that prescribes that harm. She investigates such harms as oppression, subordination, and discrimination in such forms of speech as sexist remarks, racist hate speech, pornography, verbal triggers, and micro-aggressions.

This paper argues that an addressee's failure to recognize a speaker's authority can constitutes another form of silencing.

Despite creating vast inequalities and propping up reactionary world regimes, capitalism has many passionate defenders—but not because of what it withholds from some and gives to others. In this paper, I present a new (i.e., previously overlooked) breed of exercitive speech act (the conversational exercitive). I establish that any conversational contribution that invokes a rule of accommodation changes the bounds of conversational permissibility and is therefore an (indirect) exercitive speech act. Such utterances enact permissibility facts without expressing the content of such facts, without the speaker intending to be enacting such facts and without the hearer recognizing that it is so. Because of the peculiar nature ofthe rules (...) of accommodation that generate them, conversational exercitives have importantly different felicity conditions and therefore constitute a new breed ofexercitive speech act. This paper argues that racist speech in public places ought to be regulable even with teh strict free speech protections of the First Amendment. McGowan argues that the same justification for regulating the hanging of a 'Whites Only' sign applies to racist utterances in public spaces.

Catharine MacKinnon claims that pornography silences women in a way that violates the right to free speech. This claim is, of course, controversial, but if it is correct, then the very free speech reasons for protecting pornography appear also to afford reason to restrict it. For this reason, it has gained considerable attention. The philosophical literature thus far focuses on a type of silencing identified and analyzed by Jennifer Hornsby and Rae Langton (H&L). This article identifies, analyzes, and argues for (...) the importance of a different type of silencing. As we shall see, there are compelling reasons in favor of regarding H&L silencing as a free speech violation and, as I argue here, the same can be said for sincerity silencing. Although additional work needs to be done to show that either one actually is a free speech violation, I demonstrate here that both types of silencing equally warrant this further attention. Moreover, I show that sincerity silencing is a fairly widespread phenomenon; so, therefore, is the harm it constitutes. As a result of these considerations, then, we can safely conclude that sincerity silencing also requires our attention. (shrink)

This paper criticizes Langton's speech act account of MacKinnon's claim about (the subordinating force of) pornography and offers a different account of how speech might enact harmful norms and thus constitute harm.

This paper argues that linguistic oppression is coherent; speech can oppress. Moreover, even though oppression is a structural phenomenon, a single utterance can nevertheless be an act of oppression. This paper also argues that ordinary utterances can oppress. That is, speakers do not need to have and be exercising authority in order for their speech to be oppressive. Furthermore, ordinary speech can oppress even though the speakers do not intend to oppress, even though the hearers do not take it to (...) oppress, even though the oppressed do not hear it, and even though the oppressed are unaware of being oppressed. On the account offered here, linguistic oppression is sneaky, hidden, and surprisingly widespread. (shrink)

ABSTRACT This paper argues for a hidden way in which speech constitutes harm by enacting harmful norms. The paper then explores the potential legal consequences of uncovering such instances of harm constitution. In particular, the paper argues that some public racist speech constitutes harm and is thus harmful enough to warrant legal remedy. Such utterances are actionable, it is contended, because they enact discriminatory norms in public spaces.

Jurors’ emotions, both integral and incidental, can affect their attributions of legal responsibility and blame in several, sometimes complexly interrelated ways. The article reviews the experimental research, outlining the multiple paths of emotional influence, and explains why identifying them is worthwhile. It then discusses why the modest to moderate effect sizes found in the research may understate emotions’ actual influence in some cases yet overstate it in others, and discounts moral intuitionism as a reason for believing that emotional influences in (...) real cases are stronger than the experimental data indicates. In this paper, we argue that to properly understand our commitment to a principle of free speech, we must pay attention to what should count as speech for the purposes of such a principle. We defend the view that ‘speech’ here should be a technical term, with something other than its ordinary sense. We then offer a partial characterization of this technical sense. We contrast our view with some influential views about free speech , and show that our view has (...) distinct advantages. Finally, we consider racist hate speech. Here, we argue that if certain theorists are right about what some racist hate speech does, then such speech should fall outside the scope of the free speech principle, and so, should be as regulable as any non-speech action. According to pancomputationalism, all physical systems – atoms, rocks, hurricanes, and toasters – perform computations. Pancomputationalism seems to be increasingly popular among some philosophers and physicists. In this paper, we interpret pancomputationalism in terms of computational descriptions of varying strength—computational interpretations of physical microstates and dynamics that vary in their restrictiveness. We distinguish several types of pancomputationalism and identify essential features of the computational descriptions required to support them. By tying various pancomputationalist theses directly to notions of what counts as (...) computation in a physical system, we clarify the meaning, strength, and plausibility of pancomputationalist claims. We show that the force of these claims is diminished when weaknesses in their supporting computational descriptions are laid bare. Specifically, once computation is meaningfully distinguished from ordinary dynamics, the most sensational pancomputationalist claims are unwarranted, whereas the more modest claims offer little more than recognition of causal similarities between physical processes and the most primitive computing processes. The idea that earthly actions have consequences for the afterlife mirrors the notion of karma, “the moral law of cause and effect” believed by both Hindus and Buddhists. (...) In The Good Place, each character, in his or her own way, prepares for their release from the cycle of samsara, and each has come to accept reality as it is, accepting whatever their afterlives throw at them. The great political ideas and movements of the modern world were founded on a promise of universal emancipation. But in recent decades, much of the Left has grown suspicious of such aspirations. Critics see the invocation of universality as a form of domination or a way of speaking for others, and have come to favor a politics of particularism—often derided as “identity politics.” Others, both centrists and conservatives, associate universalism with twentieth-century totalitarianism and hold that it is bound to lead (...) to catastrophe. This book develops a new conception of universality that helps us rethink political thought and action. Todd McGowan argues that universals such as equality and freedom are not imposed on us. They emerge from our shared experience of their absence and our struggle to attain them. McGowan reconsiders the history of Nazism and Stalinism and reclaims the universalism of movements fighting racism, sexism, and homophobia. He demonstrates that the divide between Right and Left comes down to particularity versus universality. Despite the accusation of identity politics directed against leftists, every emancipatory political project is fundamentally a universal one—and the real proponents of identity politics are the right wing. The idea that an utterance of a basic (nondeviant) declarative sentence expresses a single true-or-false proposition has dominated philosophical discussions of meaning in this century. Refinements aside, this idea is less of a substantive theses than it is a background assumption against which particular theories of meaning are evaluated. But there are phenomena (noted by Frege, Strawson, and Grice) that threaten at least the completeness of classical theories of meaning, which associate with an utterance of a simple sentence a truth-condition, (...) a Russellian proposition, or a Fregean thought. And it may well be the case that a framework within which utterances express sequences of propositions provides much of what is needed to account for the relevant phenomena, a better overall picture of the way language works, and an enticingly uniform perspective on a variety of semantic problems. I do not myself take to theories that multiply propositions by appealing to propositions “presupposed” or to pairs of Fregean and Russellian propositions, or theories that show no respect for a distinction between semantics and pragmatics— where the former is the study of propositions whose general form and character is determined by word meaning and syntax—or for theories that blithely abandon general principles of composition and semantic innocence. I would like to sketch a package based on four interconnected ideas: (i) the meaning of an individual word is a sequence of instructions for generating a sequence of propositions (in conjunction with compositional instructions (syntax) and elements of context); (ii) utterances themselves are not bearers of truth or falsity; (iii) judgements of truth, falsity, commitment, and conflict are shaped, in part, by the weights attached to individual 1 propositions that occur in sequences expressed by utterances, weights that may be set (and reset) by contextual considerations; (iv) Fregean senses are superfluous; propositions might as well be Russellian (Mont Blanc and all its snow fields will do as well as any mode of presentation).. Suppose a diner says, 'Can you pass the salt?' Although her utterance is literally a question (about the physical abilities of the addressee), most would take it as a request (that the addressee pass the salt). In such a case, the request is performed indirectly by way of directly asking a question. Accordingly this utterance is known as an indirect speech act. On the standard account of such speech acts, a single utterance constitutes two distinct speech acts. On this account (...) then, 'Can you pass the salt?' is both a question and a request. In a provocative essay, Rod Bertolet argues that there are no indirect speech acts. According to Bertolet, 'Can you pass the salt?' is only a question. It is a question that merely functions as a request (without also being one). In this paper we respond to Bertolet's skeptical argument. Appealing to Searle's theory of speech acts and to certain features of linguistic communication, we argue that, despite Bertolet's challenge, there is good reason to countenance indirect speech acts. John Martin Fischer and Mark Ravizza have constructed a theory of moral responsibility according to which agents are responsible only if they take responsibility in a particular way. Crucial to taking responsibility is coming to adopt a certain set of beliefs about oneself, such as the belief that one is a legitimate target of attitudes like gratitude and resentment, praise and blame. Moreover, agents must come to adopt this belief in a way that is ‘appropriately based’ upon their evidence, if (...) they are to be genuinely responsible for what they do. In this paper I argue that agents need not meet these conditions in order to be morally responsible. I offer a case in which the agent thinks of himself as responsible, appears to be responsible, but fails to take responsibility in Fischer and Ravizza’s sense. I then argue that Fischer and Ravizza’s account of responsibility for consequences is in conflict with their contention that individuals who reject the justifiability of responsibility ascriptions fail, thereby, to be morally responsible agents. In this study, we test the interactive effect on ethical decision-making of (1) personal characteristics, and (2) personal expectanciesbased on perceptions of organizational rewards and punishments. Personal characteristics studied were cognitive moral developmentand belief in a just world. Using an in-basket simulation, we found that exposure to reward system information influenced managers’ outcome expectancies. Further, outcome expectancies and belief in a just world interacted with managers’ cognitive moral development to influence managers’ ethical decision-making. In particular, low-cognitive moral development managers who (...) expected that their organization condoned unethical behavior made less ethical decisions while high cognitive moral development managers became more ethical in this environment. Low cognitive moral development managers also behaved less ethically when their belief in a just world was high. (shrink)

In 1999, Dan Zahavi’s Self Awareness and Alterity: A Phenomenological Investigation initiated a critique of the standard interpretation of the distinction between the second and third levels of Husserl’s analysis of time-constituting consciousness. At stake was the possibility of a coherent account of self-awareness (Zahavi’s concern), but also the possibility of prereflectively distinguishing the acts of consciousness (Brough and Sokolowski’s rebuttal of Zahavi’s critique). Using insights gained from Husserl’s Analyses Concerning Passive Synthesis rather than the work on time-consciousness, this paper (...) provides a new, more precise vocabulary in which to carry on the debate, in the hopes of bringing it to a mutually satisfactory resolution. After briefly laying out the terms of the Zahavi–Brough/Sokolowski debate (Sect. 2), I then elaborate a three-fold distinction in consciousness from the Analyses (Sect. 3) and relate that back to the issue of objectivity in the debate (Sect. 4). I end by suggesting how this three-fold model from the Analyses helps us preserve the essentially tripartite structure (as Brough and Sokolowski insist we do) while not making one of these levels the object of another (in keeping with Zahavi’s critique) (Sect. 5). He examines the ways in which the narrators’ uncertainty leads to collaboration from interlocutors in conversational remembering and how such co‐construction of memories can instantiate instances of distributed cognition (Hutchins, 1995).
