Brecher argues that the practices of selling blood and kidneys are akin to the practices of prostitution and wage-labour since they all involve commodification and, by implication, should be subject to legal prohibition. I suggest that these practices need not involve commodification and that they should only be condemned if people are forced into them because of their lack of power. Rather than these practices being prohibited, I suggest that it would be preferable if they were subject to state regulation (...) in order to protect the weak from exploitation. (shrink)

The construct of “mindfulness” has increasingly become a focus of research related to meditation practices and techniques. There is a growing body of research indicating clinical efficacy from therapeutic use, while cognitive neuroscience has provided an insight into the brain regions and mechanisms involved. Significantly, these approaches converge to suggest that attention is an important mechanism with trainable sub-components. This article discusses the role of attention and argues that memory has been neglected as a potential key mechanism in mindfulness–meditation practices. (...) Specifically, it proposes that working memory offers a useful model for integrating and understanding the different mental devices that are used in meditation and suggests a model with the potential to provide a comprehensive account of how the apparent benefits of these practices arise. Tim Stuart-Buttle offers a fresh view of British moral philosophy in the 17th and early 18th centuries. In this period of remarkable innovation, philosophers such as Hobbes, Locke, and Hume combined critique of the role of Christianity in moral thought with reconsideration of the legacy of the classical tradition of academic scepticism.

It is widely accepted that the seventeenth-century natural lawyers constructed the minimal requirement for social coordination between self-seeking individuals animated by the desire for self-preservation. On most interpretations, Grotius and his successors focused on the “perfect” duties and had little to say about the “imperfect” duties of love and civility. This essay provides an alternative reading of post-Grotian natural law by reconstructing Pufendorf’s and Locke’s understanding of how the duties of civility and love might be realised in civil society. The (...) essay argues that, for Pufendorf and Locke, the desire for esteem offers an explanation of how people recognize the content of the reciprocal duties of social morality and motivate themselves to act accordingly. The reconstruction of their views on the beneficial effects of esteem-seeking points towards a new interpretation of how, and why, philosophical interest in an economy of esteem and the social nature of the self emerged, prior to their treatment by eighteenth-century authors such as Hume and Smith. Hume's admiration for the Roman philosopher and statesman, Cicero, is well-known. Yet scholars have largely overlooked how Hume's interpretation of Cicero – initially as a Stoic, and subsequently as an academic sceptic – evolved with Hume's own intellectual development. Moreover, scholars tend to focus on Hume's debts to Cicero with regard either to his epistemological scepticism or his philosophy of religion. This essay suggests instead that Hume's engagement with Cicero was at its most intense, and productive, when evaluating the relationship (...) between morality and religious belief. Closer attention to the place of Cicero in Hume's writings illuminates our understanding of Hume's intellectual development, particularly in the crucial pre- Treatise years. It also, however, shines light on Hume's interpretation of the history of occidental philosophy (not least the consequences of its engagements with Christian theology), and on how Hume saw his own work to relate to this history. Locke refrained from engaging explicitly with Hobbes in any of his writings. Locke’s policy of non-engagement should be interpreted, we argue, neither as evidence of his lack of interest in (or ignorance of) Hobbes’s arguments, nor as an attempt to conceal from the uninitiated Locke’s covert Hobbesian commitments. Locke’s silence reveals rather than conceals. What it reveals is an absolute determination to “distinguish between the business of civil government and that of religion, and to mark the true bounds between them”. (...) Approached in this way, precisely because Locke’s account of the “business of civil government” says nothing about ecclesiastical government, the second of Two Treatises can be read, in its entirety, as a powerful critical response to Hobbes. To see why, it is necessary to grasp that Part iii of Leviathan (“Of a Christian Common-wealth”) is integral to Hobbes’s positive argumentative purposes in the work. (shrink)

As Nietzsche famously declared, only that which has no history can be defined. Robert Sparling's superb book shows that corruption is a concept with a history. Although Political Corruption is ordered chronologically, it is expressly not a linear account of how one modern definition of corruption evolved. History instead discloses how the concept has been deployed in a variety of modes in occidental political philosophy, seven of which are recovered here: from Erasmus's focus on the moral integrity of the prince (...) to Weber's ethics of bureaucratic office, via Machiavelli, Étienne de la Boétie, Bolingbroke, Robespierre, and Kant. In his brief autobiography, Hume recalls how the publication of the heterodox Anglican clergyman, Conyers Middleton's Free Inquiry caused a ‘furore’ in England in 1748, whereas his own Philosophical Essays were ‘neglected’. This has secured Middleton a very marginal place in Hume scholarship. This essay argues that Middleton's importance at a crucial stage of Hume's intellectual development, during the Ninewells years (April 1749 – July 1751), was more significant than has been allowed. On his return to Ninewells, Hume reflected on (...) the reasons for Middleton's success. Section I considers the nature of Middleton's contributions to English philosophical-theological debate. In Section II, it is argued that this English context illuminates our understanding of both the manner and the matter of Hume's writings from the Ninewells years, which show a marked concern with the heathen philosophers’ treatments of the relationship between morality and religion. Here, the similarities between Gibbon's situation in the 1760s and Hume's from the late 1740s are foregrounded: a period in which both authors confronted the challenge of translating their philosophical insights into an English ‘idiom’. The essay concludes by offering some broader reflections on why intellectual historians have tended to dismiss, rather than to explore the Hume-Middleton connection. (shrink)

We argue that the appraisal of models in social epistemology requires conceiving of them as argumentative devices, taking into account the argumentative context and adopting a family-of-models perspective. We draw up such an account and show how it makes it easier to see the value and limits of the use of models in social epistemology. To illustrate our points, we document and explicate the argumentative role of epistemic landscape models in social epistemology and highlight their limitations. Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. According to familiar accounts, Rousseau held that humans are actuated by two distinct kinds of self love: amour de soi, a benign concern for one's self-preservation and well-being; and amour-propre, a malign concern to stand above other people, delighting in their despite. I argue that although amour-propre can (and often does) assume this malign form, this is not intrinsic to its character. The first and best rank among men that amour-propre directs us to claim for ourselves is that of occupying (...) 'man's estate'. This does not require, indeed it precludes, subjection of others. Amour-propre does not need suppression or circumscription if we are to live good lives; it rather requires direction to its proper end, not a delusive one. (shrink)

Dehaene and Naccache, Dennett and Jack and Shallice “see convergence coming from many different quarters on a version of the neuronal global workspace model†(Dennett, p. 1). (Boldface references are to papers in this volume.) On the contrary, even within this volume, there are commitments to very different perspectives on consciousness. And these differing perspectives are based on tacit differences in philosophical starting places that should be made explicit.  Indeed, it is not clear that different uses of “consciousness†and (...) “awareness†in this volume can be taken to refer to the same phenomenon. More specifically, I think there are three different concepts of consciousness in play in this issue. The global workspace model makes much more sense on one of these than on the others. The replies clarify existing positions and modify or develop others, specifically in response to the following: Thomas Schramme criticises the claim that health is of special importance because of its impact on opportunity, and James Wilson argues that healthcare is not of special importance if social determinants of health have a major causal impact on population health. Annette Rid is concerned that the (...) relevance condition in accountability for reasonableness is unclear and does little work. Harald Schmidt aims to flesh out where an account of responsibility for health should go since one is under-developed in Just health.
